Storm Peak bald spots race against time A
pair of bald spots opened up on the brow of Storm Peak on Monday, setting up an interesting test for one of Steamboat’s enduring urban legends. Scores of local paddlers and skiers swear that when the two bare spots on the snowy peak link up each spring, the Yampa River has hit its peak annual flow where it roars through downtown Steamboat. Following the record snowfall of 489 inches at Steamboat Ski Area during the winter of 2007-08, the Yampa River peaked at 3,850 cubic feet per second at the Fifth Street Bridge. The last time the river surpassed the 7foot flood stage was in 2003, when the peak streamflow was 5,190 cfs. Total snowfall at the ski area that year was 344 inches. Officials at the National Weather Service in Grand Junction said Monday that this year’s peak could come as soon as Wednesday or Thursday. If that proves to be the case, the two insignificant bald spots that emerged like sooty smudges on Storm

Peak’s glistening face this week have some growing to do. I have a difficult time believing that the river is on the verge of peaking when remote sensors maintained by the Natural Resources Conservation Service reflect that 102 inches of snow remain on Buffalo Pass. But those government hydrologists know their business, and the net result may be that we settle in for a long steady runoff that keeps kayakers happy through July. Historical records teach us that 400-inch snowfall winters like the one just passed (405 inches) don’t always result in record streamflows. It all depends on how much snow falls above 9,000 feet in May (hardly any this spring) and how See Ross, page 11

Spring runoff for Routt County’s two largest rivers likely will peak this week, National Weather Service forecasters said Monday after issuing a flood advisory for the Yampa
and Elk rivers. The peak for the Elk River, as measured at a site near Milner, is expected to rise to 7.2 feet Wednesday morning, just above the flood stage of 7 feet. The Yampa River in downtown Steamboat Springs also is expected to peak Wednesday morning at 6.2 feet. Flood stage

The Steamboat Springs School Board formally accepted a lawsuit settlement offer from the Pilot & Today on Monday. The settlement was tentatively approved by board members last month on the heels of a March ruling by the Colorado Court of Appeals that the previous School Board violated the state’s Open Meetings Law by not properly announcing the intention of its executive session at a Jan. 8, 2007, meeting. As a result of the ruling and settlement offer, the district will pay $50,000 of the newspaper’s attorney fees and release the transcripts from the illegal meeting. The motion to accept the settlement offer was approved 4-1 on Monday, with a couple of board members expressing satisfaction that the lawsuit is now behind them. Board member John DeVincentis was the only dissenting vote, but he wasn’t the only one displeased with the
outcome. “I am disappointed that the wording of one motion has led to a three-year ordeal,” said board member Denise Connelly, who was president of the board at the time of the illegal executive session. “I’m happy it’s over so we can dedicate our resources to education.” Current board President Robin Crossan said she was disappointed the newspaper and the board couldn’t reach a “better” agreement. “I do believe this was probably the best in the end,” she said. “I am truly pleased that this is now behind us.” Connelly and Crossan said they looked forward to working with the Pilot in the future. DeVincentis disagreed. “As far as the working relationship goes with the Pilot, I don’t know,” he said. “I’ve always felt like the school district has tried to be amicable with the Pilot and I look at this as an in-your-face move by them to take $50,000 away from our students.” Pilot & Today Editor Brent

Boyer said it’s the former School Board, not the newspaper, that has cost the district and taxpayers. “The newspaper reached out to the School Board on two separate occasions before the Jan. 8, 2007, meeting to express its concern that the executive session would not be legal,” Boyer said. “The board chose to ignore those warnings and proceed anyway, violating Open Meetings Law in the process. “While it’s unfortunate the previous board chose the path it did, we are pleased this issue has been resolved and that both sides can now move on.” The three-judge Court of Appeals ruled that the previous board — made up of DeVincentis, Connelly, Jeff Troeger, Jerry Kozatch and Pat Gleason — didn’t properly convene the closed-door meeting. State Sen. Al White, RHayden, will host a town hall meeting in Steamboat Springs on Wednesday to discuss the 2009 legislative session. “It’s just a legislative update for anybody that’s interested,” White said Monday. “It’s an attempt to communicate with constituents and find out what’s on their minds.” This year’s session was one of White’s most difficult. As one of six members of the Colorado General Assembly’s Joint Budget
Committee, he said he was on the front lines of some of the toughest work in the Legislature. He faced considerable criticism for some of his deciWhite sions, including his vote for the FASTER legislation that will increase vehicle registration fees to pay for transportation projects statewide. Paul Draper, director of the county’s Road and Bridge Department, said more advertising this year likely resulted in more volunteers for the event that began three years ago after a Steamboat Springs resident expressed concern with litter along the highway and on county roads. Savalox said the success of this year’s program would benefit it in the future. “This year it just got dramatically bigger,” she said. “We made leaps and bounds. I’m really excited and I think it’s only going to get better in the coming years.”

The perfect, the good, the planet Paul Krugman

In a way, it was easy to take stands during the Bush years: the Bushies and their allies in Congress were so determined to move the nation in the wrong direction that one could, with a clear conscience, oppose all the administration’s initiatives. Now, however, a somewhat uneasy coalition of progressives and centrists rules Washington, and staking out a position has become much Krugman trickier. Policy tends to move things in a desirable direction, yet to fall short of what you’d hoped to see. And the question becomes how many compromises, how much watering down, one is willing to accept. There will be a lot of soul-searching later this year for advocates of health
care reform. (For me the make-or-break issue is whether the legislation includes a public plan.) But right now it’s the environmental community that has to decide how much it’s willing to bend. If we’re going to get real action on climate change any time soon, it will be via some version of legislation proposed by Reps. Henry Waxman, D-Calif., and Edward Markey, D-Mass. Their bill would limit greenhouse gases by requiring polluters to receive or buy emission permits, with the number of available permits — the “cap” in “cap and trade” — gradually falling over time. It goes without saying that the usual suspects on the right have denounced Waxman-Markey: global warming isn’t real, emission limits will destroy the economy, yada yada. But the bill also faces opposition from some environmentalists, who are balking at the compromises the sponsors made to gain political support.
So is Waxman-Markey — whose language was released last week — good enough? Well, Al Gore has praised the bill and plans to organize a grass-roots campaign on its behalf. A number of environmental organizations, ranging from the League of Conservation Voters to the Environmental Defense Fund, also have come out in strong support. But Greenpeace has declared that it “cannot support this bill in its current state.” And some influential environmental figures — most notably James Hansen, the NASA scientist who first drew the public’s attention to global warming — oppose the whole idea of cap and trade, arguing for a carbon tax instead. I’m with Gore. The legislation now on the table isn’t the bill we’d ideally want, but it’s the bill we can get — and it’s See Krugman, page 9

Put aside the question of whether a distinctly Catholic institution such as Notre Dame should award an honorary degree to a man who stands against any restrictions on abortion; put aside the notion of academic freedom, which liberals favor as an intellectual premise, but rarely practice when it comes to conservative speakers, whom you very rarely see standing at the lectern at commencement ceremonies Thomas anywhere in the United States this time of year. Focus, instead, on President Obama’s remarks and whether he is serious, or can be made so, about actually reducing the number of abortions in America, which, according to the National Right to Life Committee, has reached 50 million since

its legalization in 1973. Don’t put aside, however, the argument that there is only one reason to even want to reduce the number of abortions and that is that what is being killed, terminated, evacuated (choose your term) is, in fact, human life. At Notre Dame, the president gave an eloquent and well-crafted speech, full of Christian rhetoric and self-deprecating humor. He made a strong case for civility in the abortion debate but curiously noted that the advance in civil rights legislation came only after confrontation, some of which turned violent. Without that confrontation, he seemed to suggest, there might not be laws that liberated blacks and made it possible for him to become president. In speaking of “original sin,” the president hit upon why abortion has been so easily tolerated for so long. He spoke about “self-interest” and “crass materialism,” but he did so in the context of economics, not abortion. Possibly without
meaning to, he correctly diagnosed the underlying rationale that has caused so many to willingly, sometimes casually, snuff out another life. The president listed these goals, “Let us work together to reduce the number of women seeking abortions; let’s reduce unintended pregnancies.” (Watch for this to include a new push for contraceptives and the kind of sex education in schools that has failed to reduce and some believe encourages sexual activity.) “Let’s make adoption more available. Let’s provide care and support for women who do carry their children to term.” As the president referred to scripture and skillfully engaged in religious rhetoric, he might consider this verse: “By their fruits you shall know them.” (Matthew 7:16). Waxman-Markey is imperfect, but it’s action heart set on a clean program, without major political payoffs, Waxman-Markey is a disappointment. Still, the bill represents major action to limit climate change. As the Center for American Progress has pointed out, by 2020 the legislation would have the same effect on global warming as taking 500 million cars off the road. And by all accounts, this bill has a real chance of becoming law in the near future. So opponents of the proposed legislation have to ask themselves whether they’re making the perfect enemy of the good. I think they are. After all the years of denial, after all the years of inaction, we finally have a chance to do something major about climate change. Waxman-Markey is imperfect, it’s disappointing in some respects, but it’s action we can take now. And the planet won’t wait.

Will the president raise their visibility and encourage women to seek their help? Will he encourage women who don’t want their babies to carry them to term so that others can adopt them? Fewer American women are giving their babies up for adoption. There are about 1.2 million abortions each year in the United States and at least that many people/couples waiting to adopt. I conclude that abortion has contributed to the lack of available infants for those wishing to adopt them, which is one reason many couples adopt overseas. There is heartening news for pro-lifers as evidence has
emerged of a slight cultural shift. For the first time since the Gallup organization began measuring opinion on the subject, more Americans self-identify as “pro-life” (51 percent) than “prochoice” (42 percent). Moreover, Gallup found that momentum is now on the side of pro-lifers. Just one year ago, those selfidentifying as pro-life stood at 44 percent and those who were pro-choice at 50 percent. That is a dramatic reversal. In part, it is because of the tireless efforts by pro-lifers through pregnancy help centers, sonograms, testimonies of women who regret having had an abortion and TV commercials. It is also because a new generation has rejected the old arguments about coat hangers and back alleys. Younger
people are taking a fresh look at the issue and embracing the moral argument that all human life is sacred, whatever its status. Politicians are sensing this, which is why Obama is trying to have it both ways and possibly further divide the Catholic vote. But at least he is giving credibility to the moral argument, unlike most of his pro-choice peers. His speech was an appeal for discussion and respect for people with different views. That’s a good beginning, but the ending is what counts and the initial actions of this president when it comes to abortion and stem cell research have not been pro-life. Let’s see whether he can produce some fruit from what has so far been a dead stump.

vastly better than no bill at all. One objection — the claim that carbon taxes are better than cap and trade — is, in my view, just wrong. In principle, emission taxes and tradable emission permits are equally effective at limiting pollution. In practice, cap and trade has some major advantages, especially for achieving effective international cooperation. Not to put too fine a point on it, think about how hard it would be to verify whether China was really implementing a promise to tax carbon emissions, as opposed to letting factory owners with the right connections off the hook. By contrast, it would be fairly easy to determine whether China was holding its total emissions below agreed-upon levels. The more serious objection to Waxman-Markey is that it
sets up a system under which many polluters wouldn’t have to pay for the right to emit greenhouse gases — they’d get their permits free. In particular, in the first years of the program’s operation, more than a third of the allocation of emission permits would be handed over at no charge to the power industry. Now, these handouts wouldn’t undermine the policy’s effectiveness. Even when polluters get free permits, they still have an incentive to reduce their emissions, so that they can sell their excess permits to someone else. That’s not just theory: allowances for sulfur dioxide emissions are allocated to electric utilities free of charge, yet the cap-and-trade system for SO2 has been highly successful at controlling acid rain. But handing out emission permits does, in effect, transfer wealth from taxpayers to industry. So if you had your

News in brief Commissioners to meet with Oak Creek Town Board

The Routt County Board of Commissioners will meet with Oak Creek residents and the Oak Creek Town Board at 7 p.m. today at Oak Creek Town Hall. The gathering is part of the commissioners’ chat series around the county. Oak Creek town trustees said at a meeting last week that they hope to use the meeting to discuss policing options for Oak Creek, including a possible contract with the Routt County Sheriff’s Office to provide coverage for the town for a fee. This is the second year of
the commissioners’ chat series. The first session was May 11 in Steamboat. Future sessions are planned for 7 p.m. June 1 at the North Routt Preschool in Clark and 7 p.m. June 2 at Hayden Town Hall.
Routt County United Way Day of Caring is Wednesday Routt County United Way is coordinating the 13th annual Day of Caring from 8 a.m. to noon Wednesday. The Ski Town Lions Club is providing lunch for all volunteers. The Day of Caring provides an opportunity for people of all ages, throughout Routt County, to show they care by participat-
ing in a variety of projects that help local nonprofit groups, the elderly, disabled and less fortunate. This year, about 150 volunteers are signed up to work on more than 40 local projects. Additionally, a food drive for the LIFT-UP of Routt County Food Bank is from 11 a.m. to 7 p.m. Wednesday at Safeway and City Market. Also, the Rio Grande Mexican Restaurant is donating 10 percent of Wednesday proceeds to Routt County United Way. There is still time to volunteer for Day of Caring projects. Senate Bill 85, which would have phased out the state’s business personal property tax but was softened to create only a task force to study the issue. White also plans to discuss the state’s financial situation. Revenue projections for the fiscal year beginning July 1 required what White has called “distasteful” cuts. White said next year could be even more painful if revenues don’t return. “We pushed a lot of stuff out with one-time budget transfers,”

quickly the weather heats up. I’ve always been skeptical about this notion that there is a correlation between the bald spot on Storm Peak’s furrowed brow and the annual peak of the river’s flow. I think it’s because those blemishes on the peak occur within two broad swaths where the Steamboat Ski Area grooms the snow to erase the moguls. One of the groomed stripes is on skier’s left and the other is on skier’s right, under the Storm Peak Express Chairlift. Many of us can recall that it’s only been in recent history that the ski area has groomed Storm Peak. In fact, some large spruce trees originally had to be removed to make it feasible to groom skier’s left. However, even among veteran whitewater paddlers, there are different views on the Storm Peak Bald Spot urban legend.
None other than noted paddling author and publisher/editor-in-chief of Paddling Life, Eugene Buchanan, is a believer. “It has usually held pretty true to form all the years I’ve lived here,” Buchanan said. You can ask him about it at 7:30 p.m. Friday at Olympian Hall when he presents a slideshow about his participation in the dramatic first descent down Peru’s upper Colca Canyon and the Cruz de Condor. Friends remember Corna Corna continued from 1 people who would drop everything — even if it was just to bring me lunch,” she said. “He would do whatever he could to make you feel better. … Steamboat just lost one of the best men it’s ever had.” Several friends gathered Monday at the home of longtime Corna friend Lindsey Grannis. “We’re sitting around laughing and crying and feeling numb and going through all the phases that happen when you lose someone,” Grannis said. “He will be a big piece of Steamboat that’s missing, and I think it’s going to be felt throughout our entire community.” Grannis said she fielded phone calls from people across the country Monday. “That’s the thing about Chris: He’s got friends everywhere,” said friend Kier Delaney, who owns the Saketumi restaurant near Slopeside in Torian Plum Plaza. “This is going to be like a national day of mourning.” Like Bushnell, Delaney said Corna always was there for friends when they needed him most. “He’s the guy who would help anybody with anything … whether they deserved it or not,” Delaney said. “It always made you stronger knowing you had him with you. … If he ever felt unappreciated, that
certainly was not true.” Corna was the former president of the Mountain Business Association, a restaurant representative on the Steamboat Springs Chamber Resort Association board of directors, a member of the Base Area Reinvestment Coalition and president of the Torian Plum Condominium Owners Association. “He took that facility (Slopeside) and took something that was neutral, at best … and he immediately turned it around and turned it into something very unique and very special,” said Andy Wirth, chief marketing officer for Steamboat Ski Area owner Intrawest. “Slopeside is a real reflection of Chris Corna and his personality. … That place has been a great part of the Steamboat experience for a lot of people.” In addition to their business dealings, Wirth said he and Corna were friends. Wirth said he left Corna a message Monday morning about a ski trip they were planning to Whistler, British Columbia. In return, Corna was going to take Wirth scuba diving. “There weren’t very many heads that didn’t turn when he walked by,” Wirth said. “This town, this community will be lesser because of the loss of Chris Corna. … He was a great example of the ‘work hard, play hard’ phrase.”
Court ruled ‘notice was deficient’ School Board continued from 4 Open Meetings Law requires public bodies to cite the specific provision that allows them to meet in executive session, and public bodies must identify the particular matter to be discussed in secret in as much detail as possible. During the Jan. 8, 2007, meeting, the School Board said it was going into executive session to discuss a personnel matter regarding “access to information.” The Court of Appeals ruled that the School Board’s “notice was deficient in failing to state that the executive session would concern the release of the survey results. In addition, the notice was deficient in not identifying that the ‘personnel matter’ was specifically the performance of the superintendent.” Similarly, the Court of Appeals agreed with the Pilot & Today that the School Board failed to announce its intention to confer with its attorney during the executive session.
A transcript of the executive session revealed that the School Board sought specific legal advice during the closeddoor meeting that had been announced only as a “personnel matter” regarding “access to information.” In a special concurrence, Court of Appeals Judge Russell Carparelli disagreed with the finding of a notice violation, but he still concluded that the School Board violated Open Meetings Law by improperly making a policy decision behind closed doors with no public vote or public discussion. That decision, Carparelli wrote, came when board members directed former Superintendent Donna Howell to give a copy of the staff survey results to board members. Carparelli also concluded that the entire discussion behind closed doors Jan. 8, 2007, was illegal because it did not actually involve a “personnel” matter, but rather involved the board’s desire to keep its views about the survey results secret.

Forecaster: Weather system could bring rain Rivers continued from 3 Management Director Bob Struble said he surveyed the rivers during the past several days and that although they are rising and technically above the “bankfull” stage, the waters are not spilling over. “It’s not above bankfull. I’ve been out all weekend looking at them, and we’ve got a while to go yet,” he said. He continued to monitor the rivers throughout the county Monday. Forecaster Jim Daniels, with the National Weather Service’s Grand Junction office, said a weather system expected to move in later this week could bring rain, which would push the rivers even higher. “If you make it through this upcoming seven days or
so, you’ll probably see things recede,” he said. Struble said he expects some spillover in traditionally floodprone areas, including the junction of the Elk and Yampa rivers and several places along the Elk. “High water is the homeowners’ responsibility,” he said. “We don’t get involved unless it’s a rescue situation or another emergency.” Struble recommended that concerned homeowners read the high water management guide produced by his office. The river levels will recede slowly in the coming days as groundwater in the mountains continues to flow into the rivers, Lawrence said.
“It won’t get below what we call ‘bankfull’ until Sunday or Monday,” he said. “It should continue to drop thereafter because a lot of snow on the mountain continues to melt as we speak.” The Yampa typically peaks between May 19 and June 12. The river peaked on June 4, 2008, at 6.34 feet, and on May 18, 2007, at 5.16 feet. Lawrence said the early peak bodes well for river sports. “We’re in good shape. Ivan Basso is ready to concentrate again on racing after a day of protest at the Giro d’Italia. Riders considered the city circuit overly dangerous and their protest annulled Sunday’s times. The route through Milan had been designed to honor the city where the Giro was born 100 years ago. “I think all 200 riders looked at themselves in the mirror last night, and starting tomorrow you’re going to see quality racing
again,” Basso said Monday, the race’s first rest day. Overall leader Danilo Di Luca and seven-time Tour de France winner Lance Armstrong organized the protest. Basso, who is riding his first Giro after serving a two-year ban for involvement in the Spanish blood-doping scandal Operation Puerto, followed the pack. “I was away from the sport for two years, and I didn’t think it was right that I made the decision,” Basso said. “But I think
we need to apologize to the fans. I’m coming off a very tough time and I’m trying to do something good for cycling.” Basso won the 2006 Giro and was the pre-race favorite this year. But he is sixth overall through nine stages, 1 minute, 14 seconds behind Di Luca. Thomas Lovkvist of Sweden is second, 13 seconds behind, with Michael Rogers third, 44 seconds back. Armstrong’s Astana teammate, Levi Leipheimer, is 51 seconds behind in fourth, and stage 5 winner Denis Menchov is 58 seconds off the pace in fifth.

Gruden replaces Kornheiser on MNF THE ASSOCIATED PRESS
Monday Night Football tried a Cowboy, a comic, a columnist and a Cosell. To fill the latest vacancy in the broadcast booth, ESPN went with a winning formula — a coach, and a Super Bowl champion at that. Fresh off getting fired by the Tampa Bay Buccaneers, Jon Gruden was hired to replace Tony Kornheiser this season. The snarl-for-snarky swap came after Kornheiser cited a fear of flying in his decision to leave after three years. The same fear beset one of the most popular MNF announcers ever, John Madden, who retired from his TV career last month. Gruden has spent his entire adult life coaching football, and said this job would give him an “opportunity to see things from a different angle.” “Kind of like it’s halftime of my life,” the 45-year-old Gruden said Monday on a conference call. “Unfortunately, I don’t know many things about other aspects of life.” Gruden won the 2003 title with the Bucs, and there’s no telling how long he’ll stay away from the field. Neither he nor Norby Williamson, ESPN’s executive vice president of pro-

duction, would directly answer how long Gruden’s contract lasts, or whether he was free to leave for an NFL post if one is offered. “Maybe I can hang in and keep this job for a while,” Gruden said, later adding, “I dearly miss coaching.” Gruden will join Mike Tirico and Ron Jaworski when the show starts its 40th season this fall. Gruden will make his debut with a preseason game Aug. 13, a Super Bowl rematch between the Arizona Cardinals and Pittsburgh Steelers. MNF has used all sorts of
personalities through the years, dating to its debut on ABC. Gruden recalled watching in the days when Howard Cosell and Don Meredith shared the booth, and comedian Dennis Miller’s stint led to Kornheiser’s run. Kornheiser will continue to appear on ESPN’s “Pardon the Interruption.” “My fear of planes is legendary and sadly true,” he said in a statement released by the network. “When I looked at the upcoming schedule it was the perfect storm that would’ve frequently moved me from the bus to the air.”
