County Board of Commissioners must decide whether it can stomach fronting $1 million of its own money at a time when the county’s road and bridge fund reserves are projected to run dry in less than a decade and declining revenues have forced painful pay cuts, furloughs and layoffs. Bush said. The problem has arisen because of a provision in the $787 billion federal economic stimulus bill that requires money to be spent within three years of its enactment, by Feb. 17, 2012. Routt County wouldn’t learn whether it won the grant until Feb. 17, 2010. Although that leaves enough time to complete the two-summer construction project, Heather McLaughlin, a senior engineer in the Road and Bridge Department, said the

deadline is impossible to meet unless 44 acres of right of way is acquired in advance. Additional federal guidelines add more wrinkles. It is unclear what would be required of the project under the National Environmental Protection Act, and, in order to qualify, the county would have to use a federal process to acquire right of way from 46 property owners along the road. That process costs $300,000 more than the See Road, page 11

rowing up with Ozzie and Harriet, my sisters and I were certain that we were grossly underprivileged. We almost never were served TV dinners like our playmates were. Instead, my mother insisted on cooking flavorful, wholesome dinTom Ross ners every PILOT & TODAY night. It was an event that included fresh vegetables in summer and homecanned veggies in winter. There always was a dessert, which might have been a down-

and-dirty ice cream sundae but often was freshly baked. A rhubarb/strawberry pie, made with fruit picked in our yard, was not out of the question. Still, my siblings and I regarded a frozen Swanson chicken potpie as exotic cuisine. I must clarify that we relished my mother’s (her name is actually Beth, not Harriet) rotation of fried chicken, pot roast with real gravy, tuna casserole and made-from-scratch macaroni and cheese studded with slices of Oscar Mayer’s favorite sausage. Still, we fantasized about the meals being prepared over at the Swanson’s kitchen. But that was the ’60s, and these are more complicated times. Even in the midst of a growing awareness of the benefits of fresh foods purchased in season, and a mania with the Food Network on television, some experts are convinced that home-cooked meals, at least on weeknights, are going the way of the polar bear. Noted author Michael Pollan, of “Omnivore’s Dilemma,” offered an interesting take on the trend in a think piece in The New York Times Magazine on Sunday. Pollan devotes much of his article to the original television chef, Julia Child, whose unedited live show debuted in 1963 when “The Adventures of Ozzie and Harriet” still ruled TV as the model for American families (did anyone notice that Ozzie never seemed to leave the house and go to a job?). Child helped millions of Americans, particularly American women, lose their fear of cooking, Pollan observed. However, he sees the popular primetime shows on the food network as being less about meal preparation than they are about reality TV entertainment. In the case of

the “Iron Chef” series, it’s less a case of cooking instruction than it is sports programming, in Pollan’s estimation. As I read Pollan’s article, I had visions of sitting down in front of the television with a defrosted chicken potpie and watching chef gladiators in impeccable white coats and checkered slacks doing battle as they frantically invented six new recipes for squid. It occurred to me that the time we spend watching TV in the evenings easily could be used to shop and do some meal preparation in advance. It also occurred to me that all too often I take for granted the creative chef with whom I share a home. So on Sunday afternoon, I dug out an underused cookbook by TV chef Bobby Flay and prepared to do battle in

your recipe calls for a cup of chopped red cabbage, put it on your grocery list and buy it already chopped from the salad bar. If there’s still a little left over, you can mix it in with the dog’s kibble as a special treat. And here’s a tip for Pollan: Wired.com is reporting that the Food Network has collaborated with a gaming company and licensed 30 recipes from its TV kitchens for use in an electronic game developed for the Nintendo Wii. Now, you can learn to cook without picking up a spatula. Just keep a good grip on your Wii Remote. Your family is sure to rave about the results. Tom Ross is a longtime Steamboat resident. Kitchen Stadium. The fried squash blossoms with ricotta, roasted corn and sweet and hot yellow pepper sauce tempted me. But then I realized we were out of squash blossoms again. Don’t you hate when that happens? Instead, I set out to make Yucatan chicken skewers with red cabbage slaw and peanut/ red chili barbecue sauce. The only difficulty I encountered in preparing this delightful entrée was my utter inability to follow a recipe. For me, there’s no fun in cooking if you’re going to follow the rules. So instead of red cabbage slaw made with a hint of onions, we had jicama slaw with a hint of red cabbage. Let’s face it, red cabbage isn’t the easiest vegetable in the world to digest. Which leads me to a quick culinary tip: If

proposal. “That could potentially delay our ability to meet the water requirements” of the development. City Council also will have a discussion about project vesting periods. The Community Development Code requires that a building permit be pulled within three years of a project’s approval, but the council has granted extensions to projects recently because of the economic downturn. Rather than dealing with the issue case-by-case, the council hopes to develop a policy it can apply evenly to all projects. The city’s planning staff is recommending that it be allowed to approve one, two-year extension if the project “is still within substantial compliance of the development and dimensional standards contained within the CDC.” If a project is not still in compliance, or if an extension longer than two years is being requested, the issue would have to go before Planning Commission and City Council. Council also will revisit its affordable housing ordinance tonight in many ways. Developer Paul Franklin will request that he be allowed to remove the deed restrictions from two units

in The Olympian downtown and make a payment in lieu to the city instead. The paymentin-lieu formula itself also is up for debate. Council will discuss changes to the formula that would base the formula on construction costs rather than sales. Finally, council will consider the second reading of an ordinance that would allow developers to make a payment and institute a voluntary real estate transfer tax on their projects in addition to building affordable units in order to satisfy the city’s affordable housing ordinance. Public improvement projects at the base of Steamboat Ski Area also will be discussed tonight, and the city will consider loaning $2.6 million to its urban renewal authority to allow projects to begin on schedule this month. The issuance of a $12.5 million bond is behind schedule, but there is no risk that the city will be unable to repay its general fund, Roberts said. “It’s not a problem; it’s just getting through the process,” Roberts said. “The city’s very protected.”

Tonight’s City Council agenda provides a snapshot of the most pressing issues of recent years, as members are scheduled to revisit issues ranging from water and annexations to affordable housing and base area redevelopment. Although the city and Steamboat 700 — the proposed 500-acre project seeking annexation into city limits — have agreed the developer should pay $960,000 to help develop the city’s water rights and serve the neighborhood that could include 2,000 homes, they now are arguing about when the money should be paid. The city has proposed splitting the payment in thirds, with the first payment due 30 days after annexation, the second due a year later and the third due two years later. Steamboat 700 has proposed an initial payment of $105,000 after annexation and three equal payments of $285,000. The first of those three payments would be due at the recording of the first final plat creating a building lot, the second would be due a year after that, and the third would be due two years later. “We don’t want there to be any delay in this up-front legal work that could lead to a delay in the building of actual facilities,” said City Manager Jon Roberts, explaining the city’s opposition to Steamboat 700’s

Is your cat safe? A Steamboat Springs resident recently reported seeing an animal similar to ones blamed for the disappearance of about 50 local felines five years ago. Joanna Wragg, who spends summers in Steamboat and winters in Miami, snapped a photo of a hairless fox from her deck looking across Eagleridge Drive toward Burgess Creek Road on Thursday. But Wragg said she first saw a group of five hairless foxes a couple of weeks before at the top of Eagleridge near Mount Werner Circle. “There were four rolling in the grass like puppies,” she said. “… The adult in the middle of the road actually stopped traffic. There were three cars waiting in the road. This woman eased forward and said, ‘What on earth is that?’ I said, ‘I don’t know. I’ve never seen it before.’ The guy in the car behind me said, ‘That’s a hairless fox.’” Steamboat Springs Police Capt. Joel Rae said Monday that the department hasn’t received any reports recently about hairless foxes killing pets like it did four to five years ago. But Rae added that he saw one, and it exhibited behavior typical of foxes in the area. “We don’t have any informa-

Former councilman: Current City Council is too pro-growth Brandon Gee

Former Steamboat Springs City Councilman Jim Engelken said he is dissatisfied with the city’s legislators and is considering running for council in this year’s election. Engelken is the second former councilman — the other being former City Council President Kevin Bennett — to confirm he is considering running. Both men said the current council is too pro-development. Engelken and Bennett said they would try to slow the pace of growth in Steamboat Springs if elected. “I’m seriously considering it,” said Engelken, who is considering the city’s two-year, at-large seat. “I’m not quite ready to commit. Obviously I’ll have to make a decision soon, though.” Should he choose to run, Engelken may face Councilwoman Cari Hermacinski, who has not decided whether she will run for

Engelken said he disagreed with the City Council’s decision to fire former City Manager Alan Lanning, citing in part Lanning’s handling of enforcement issues involving the real estate and construction industries. Engelken said he also was concerned when the council nearly let builders off the hook for an estimated $4.6 million in building use tax. “To me, that really showed their true colors about what their values are and who they’re really working for,” Engelken said. Council members who supported the ordinance said it was unfair to begin enforcing the policy retroactively. Engelken said he also disagrees with changes approved by City Council to allowable height and other dimensional standards at the base of Steamboat Ski Area. Among other changes, council increased the maximum allowable height by 38 feet in the area to 105 feet. See Engelken, page 12

The Routt County Board of Commissioners met with Sen. Mark Udall’s chief of staff Monday, an opportunity for commissioners to express their views on issues ranging from health care reform to the American Recovery and Reinvestment Act. Michael Sozan was wrapping up a five-day trip to Colorado and returned to Washington, D.C., later Monday. He said he wanted to visit with the commissioners to find out how Udall could be most helpful when it comes to local issues. Routt County Commissioner Doug Monger expressed his concern with the “cap and trade” legislation being debated in Washington. Under the policy, the availability of pollution permits would be reduced and industries could sell some of their permits to other companies if they pollute less than their limit. Monger was concerned that such a policy could curtail Northwest Colorado’s energydependent economy, which largely is based on the fossil fuels that cap-and-trade could make less competitive. “We all appreciate breathing clean air and doing our part for global warming,” Monger said. “I just hope we do it methodically and JOHN F. We know because he said so, in the first of many famous speeches, that President Barack Obama doesn’t see Red America or Blue America — he only sees the United States of America. But as the president contemplates his faltering poll numbers and his stalling health care push, he might want to consider a more colorful perspective. The red-blue contrast often is overdrawn. But it’s a sensible way to underDouthat stand Obama’s summer struggles. On health care, energy, taxes and spending, he’s pushing a blue-state agenda during a recession that’s exposed some of the blue-state model’s weaknesses and some of the red-state model’s strengths. Consider Texas and California. In the

Bush years, liberal polemicists turned the president’s home state — pious, lightly regulated, stingy with public services and mad for sprawl — into a symbol of everything that was barbaric about Republican America. Meanwhile, California, always liberalism’s favorite laboratory, was passing global-warming legislation, pouring billions into stem-cell research and seemed to be negotiating its way toward universal health care. But flash forward to the current recession, and suddenly Texas looks like a model citizen. The Lone Star kept growing well after the country had dipped into recession. Its unemployment rate and foreclosure rate are well below the national average. It’s one of only six states that didn’t run budget deficits in 2009. Meanwhile, California, long a paradise for regulators and public-sector unions, has become a fiscal disaster area. And it isn’t the only dark blue basket case. Eight states had unemployment at more than

11 percent in June; seven went for Obama in November. Fourteen states are facing 2010 budget gaps that exceed 20 percent of their GDP; only two went for John McCain. (Strikingly, they’re McCain’s own Arizona and Sarah Palin’s Alaska.) Of the nine states that have increased taxes this year, closing deficits at the expense of growth, almost all are liberal bastions. The urban scholar Joel Kotkin has called this recession a blue-state “meltdown.” That overstates the case: The Deep South has been hit hard by unemployment, and some liberal regions are weathering the storm reasonably well. And clearly part of the blame for the current crisis rests with decisions made in George W. Bush’s Washington. But in state capital after state capital, the downturn has highlighted the weaknesses of liberal governance — the zeal for unsustainable social spending, the preferSee Douthat, page 9

Americans are angry at Wall Street, and rightly so. First the financial industry plunged us into economic crisis, then it was bailed out at taxpayer expense. And now, with the economy still deeply depressed, the industry is paying itself gigantic bonuses. If you aren’t outraged, you haven’t been paying attention. But crashing the economy and fleecing the taxpayer aren’t Wall Street’s Krugman only sins. Even before the crisis and the bailouts, many financial-industry high-fliers made fortunes through activities that were worthless if not destructive from a social point of view. And they’re still at it. Consider two recent news stories.

One involves the increase of high-speed trading: Some institutions, including Goldman Sachs, have been using superfast computers to get the jump on other investors, buying or selling stocks a tiny fraction of a second before anyone else can react. Profits from high-frequency trading are one reason Goldman is earning record profits and likely to pay record bonuses. On a seemingly different front, Sunday’s New York Times reported on the case of Andrew J. Hall, who leads an arm of Citigroup that speculates on oil and other commodities. His operation has made a lot of money recently, and according to his contract Hall is owed $100 million. What do these stories have in common? The politically salient answer, for now at least, is that in both cases, we’re looking at huge payouts by firms that were major recipients of federal aid. Citi has received about $45 billion from taxpay-

ers; Goldman has repaid the $10 billion it received in direct aid, but it has benefited enormously from federal guarantees and from bailouts of other financial institutions. What are taxpayers supposed to think when these welfare cases cut ninefigure paychecks? But suppose we grant that both Goldman and Hall are very good at what they do, and might have earned huge profits even without all that aid. Even so, what they do is bad for America. Just to be clear: Financial speculation can serve a useful purpose. It’s good, for example, that futures markets provide an incentive to stockpile heating oil before the weather gets cold and stockpile gasoline ahead of the summer driving season. ence for regulation over job creation, the heavy reliance for tax revenue on the volatile incomes of the upper, upper class. And, inevitably, the tendency toward political corruption. The Republicans have their mistresses, but the Democrats are dealing with a more serious array of scandals: The BlagojevichBurris embarrassment in Illinois, Sen. Christopher Dodd’s dubious mortgage dealings in Connecticut, the expansive graft case that just erupted in New Jersey, and a slew of corruption investigations featuring Democratic congressmen. This helps explain why the Republican Party might be competitive in the Northeast for the first time in years. Chris Christie easily is leading Jon Corzine in the race for New Jersey’s governorship. Rob Simmons

might unseat Chris Dodd in Connecticut. Rudy Giuliani, who has experience with blue-state crises, is pondering a run for the statehouse in New York. And it also helps explain Obama’s current difficulties. The president is pushing a Californiastyle climate-change bill at a time when businesses (and people) are fleeing the Golden State in droves. He’s pushing a health care plan that looks a lot like the system currently hemorrhaging money in Massachusetts. His ballooning deficits resemble the shortfalls paralyzing state capitals from Springfield to Sacramento. “Never let a serious crisis go to waste,” Rahm Emanuel remarked last fall. But in a crisis, all the public tends to care about are jobs and economic growth. It’s not the ideal time to pass costly social legislation that promises to reap dividends only

in the long term, if at all. That’s why Franklin Roosevelt waited until 1935, when the Great Depression seemed to be waning, to push Social Security through Congress. It’s why Lyndon Johnson established Medicare at the peak of the long post-World War II expansion. And it’s why Massachusetts’ health care plan and California’s cap on greenhouse-gas emissions both passed at the height of the recent boom, rather than the bottom. Obama still is broadly popular, and the public still is broadly sympathetic to his administration’s agenda. But the money has to come from somewhere. You can’t have a bold new liberal era without the growth to pay for it. The president wants to govern America like a blue state. But for that to work, he’ll need the nation’s economy to start performing more like Texas.

Society rewards those who make us poorer Krugman continued from 8 in 1971, such speculation often combines “private profitability” with “social uselessness.” It’s hard to imagine a better illustration than high-frequency trading. The stock market is supposed to allocate capital to its most productive uses, for example by helping companies with good ideas raise money. But it’s hard to see how traders who place their orders one-thirtieth of a second faster than anyone else do anything to improve that social function. What about Hall? The New York Times report suggests that he makes money mainly by outsmarting other investors, rather than by directing resources to where they’re needed. Again, it’s hard to see the social value of what he does. And there’s a good case that such activities actually are harm-

ful. For example, high-frequency trading probably degrades the stock market’s function, because it’s a kind of tax on investors who lack access to those superfast computers — which means the money Goldman spends on those computers has a negative effect on national wealth. As the great Stanford economist Kenneth Arrow put it in 1973, speculation based on private information imposes a “double social loss”: It uses up resources and undermines markets. Now, you might be tempted to dismiss destructive speculation as a minor issue — and 30 years ago, you would have been right. Since then, however, high finance — securities and commodity trading, as opposed to run-ofthe-mill banking — has become a vastly more important part of our economy, increasing its share of GDP by a factor of six. And soaring incomes in the financial

industry have played a large role in sharply increasing income inequality. What should be done? Last week, the House passed a bill setting rules for pay packages at a wide range of financial institutions. That would be a step in the right direction. But it really should be accompanied by much broader regulation of financial practices — and, I would argue, by higher tax rates on supersized incomes. Unfortunately, the House measure is opposed by the Obama administration, which still seems to operate on the principle that what’s good for Wall Street is good for America. Neither the administration nor our political system in general is ready to face up to the fact that we’ve become a society in which the big bucks go to bad actors, a society that lavishly rewards those who make us poorer.

More than two weeks after it was reported stolen, Steamboat Springs Police Department officers on Monday returned a car to its rightful owner. The 2001 silver Mazda Tribute reportedly was stolen July 17 from the first block of Seventh Street, where it was parked unlocked with the keys inside. Officer Stuart Hutton said a stepbrother of the car’s owner found it in the Sundance at Fish Creek shopping center parking lot and reported it to police. Officers said the car suffered no obvious damage, and nothing was taken from it. The keys still were inside. Officers processed the car for

evidence before returning it to the owner. “We’ve been scouring parking lots, as have the people who had the vehicle taken,” Hutton said.

SUNDAY, AUG. 2 12:22 a.m. Steamboat Springs Police Department officers arrested a 58-yearold New Mexico man on suspicion of speeding and driving under the influence after a traffic stop in the 300 block of South Lincoln Avenue. 2:01 a.m. Police and Steamboat Springs Fire Rescue emergency responders were called to a report of a drunken pedestrian in the 500 block of Lincoln Avenue. Police were unable to locate a responsible person to take care of the 50-year-old man, and medical crews took the man to detox. 9:38 a.m. Police and Routt County Sheriff’s Department deputies were called to a request for an officer in the 200 block of Howelsen Parkway where a man reportedly threatened another man after their children were in a confrontation. Police arrived and mediated the situation but then learned that the man who reportedly made the threat had a warrant for his arrest. Officers arrested a 32-year-old Colorado Springs man on suspicion of

being a fugitive of justice. 10:43 a.m. Police were called to a request for an officer in the 300 block of Third Street where a person complained that cars were speeding. Officers made an extra patrol of the area. 11:58 a.m. Police were called to a report of a suspicious vehicle in the 400 block of Eighth Street where a driver reported that another driver tailgated and stared at him or her. The $1 million includes $675,000 to purchase about 44 acres from 46 property owners along the current route of the county road. The commissioners are scheduled to consider a resolution to spend the money at 11:30 a.m. today, but Chairman Doug Monger said it probably would be tabled to allow county staff to gather more information. The issue highlights one of Monger’s frustrations with the federal economic stimulus bill — which he also expressed to Sen. Mark Udall’s chief of staff earlier Monday — that the legislation “makes the process so hard that no one can comply.” “It’s gambling,” Monger said.

“I’m going to tell you, I’m not going to vote for gambling $1 million dollars here.” Mitsch Bush said the gamble is a big one for reasons beyond the large number of dollars involved. She described the grant as “the most competitive … I’ve ever heard of. Everybody’s infrastructure is going to hell.” Underlying the entire issue is the poor condition of the road, which Monger described as a wagon trail that got asphalt poured on top of it. While Monger said he’d prefer to spend money on asphalt over-

lays of the existing road rather than gamble it on the right of way acquisition, Mitsch Bush and Commissioner Nancy Stahoviak described that approach as a mere bandage. “It cannot continue to exist in the condition it is in right now,” Stahoviak said. The right of way has to be acquired if the county ever wants to do the reconstruction project, and Mitsch Bush said now might be the cheapest time to purchase property. “We’re wrestling with it,” Mitsch Bush said. “The road is literally falling apart.” The reconstruction project would widen the South Routt thoroughfare, which receives more traffic than any other county road, and also would add shoulders to it. Police department keeps an eye on foxes Hairless fox continued from 4 Wildlife official said then that she thought the fox had a skin disease that resulted in hair loss. The official said because of that lack of fur, the hairless fox had to eat “constantly to sustain itself.” Law enforcement officers that year were told to destroy hairless foxes, if it could be done safely, after one bit a Steamboat resident who was trying to res-

cue his cat. Just days after issuing the order to kill the animal in September 2005, a Steamboat Springs Police Department officer shot one of the foxes after it stole a burrito from a pickup truck in a parking lot at the southeast corner of Village Drive and Walton Creek Road. At the time, police thought the fox was the same one that bit the man trying to save his cat because it was shot only a block

away from where that incident occurred. They also thought then that more hairless foxes lurked throughout Steamboat. The CU system has 54,000 students and an annual budget of $2.6 billion. Benson, a CU alum, founded Benson Mineral Group in 1965. He was elected chairman of the Colorado Republican Party four times, and he was the Republican nominee for governor in 1994. In February, Benson was named to the

Colorado Business Hall of Fame. The University of Colorado recently announced $134.5 million in donations during the 2008-09 year from 50,000 donors, a record number of contributors. The amount of the donations, however, was down from the record-setting year of 2007-08, when CU received $162.5 million. “The decline in dollars raised

Of all his concerns, Engelken said Steamboat 700 is the biggest. He said City Council is rushing the proposed 500-acre development west of Steamboat that is seeking annexation into city limits. Sozan acknowledged Monger’s concerns and said Udall supports clean coal technologies and sees natural gas as a bridge fuel. “There’s almost no other area other than health care where unintended consequences could be so large,” Sozan said about energy legislation. About health care, Sozan said Udall thinks “that health care reform is necessary, that the status quo just isn’t working, and, principally, that stabilization needs to be brought to the health care industry.” Sozan said Udall thinks insurance companies need to be brought “under

control.” For example, he said people shouldn’t be denied coverage for pre-existing conditions, rates should be more reasonable, and people should have the ability to keep their coverage if they lose or change jobs. Commissioner Nancy Stahoviak, a Yampa Valley Medical Center board member, said she was concerned about who would pay for such changes. She also said the fact that Medicare and Medicaid don’t fully reimburse medical providers is a big and unaddressed part of the problem. Three-time boxing champion Vernon Forrest was remembered Monday by about 1,500 friends, family and fellow athletes as a soft-spoken, modest competitor defined more by his work helping others than his victories in the ring. The 38-year-old Forrest, a former two-division champion who gained notoriety when he became the first boxer to defeat “Sugar” Shane Mosley, was shot and killed July 25 in Atlanta. Police have said he exchanged gunfire with at least two robbery suspects before being shot several times in the back. “I believe in God and the justice system,” his brother Alfonso Forrest told about 1,500 people at New Birth Missionary Baptist Church in Lithonia, just east of Atlanta. “We want justice fulfilled to the fullest within the law. It will happen.” Notable athletes in attendance included former heavyweight champion Evander Holyfield and boxers Antonio Tarver, Robert Allen and Buddy McGirt. Former NFL players Ray Buchanan and Jamal Anderson also attended. Holyfield said before the service that Forrest was one of the “great men” whose community service work should be celebrated. Forrest has been lauded since his death for his help launching the Destiny’s Child group homes in Atlanta, which work to provide homes for the mentally disabled. “He’s great, and what he did for the community was great,” said Holyfield, who said he had known Forrest since he was 12. Numerous photos flashed of Forrest on two large TV screens during the service of him posing with Muhammad Ali, Evander Holyfield and him flexing his arms while wearing his title belt.

Brandon Marshall’s return from offseason hip surgery has not gone smoothly for the Denver Broncos wide receiver. Marshall, who on top of his health issues has asked for a trade, missed Monday’s training camp practice, a day after an apparent leg injury knocked him out of Sunday’s team workout early. Meanwhile, defensive end/

linebacker Jarvis Moss, the Broncos’ first-round draft pick in 2007, skipped another day of practice as he considered his football future. Moss Marshall underwent hip surgery in late March. He took part in the Broncos’ opening training camp practice Friday but sat out Saturday’s

session with an undisclosed injury. He returned Sunday only to pull up lame, grabbing his hamstring after running a deep route before limping off the field. New Broncos coach Josh McDaniels neither would discuss the specifics of Marshall’s injury nor estimate when the receiver could rejoin the team’s practices. Marshall started 15 games last season, finishing third in the league with 104 catches for 1,265 yards receiving. He later voiced unhappiness with his contract

and complained the team’s medical staff did not properly diagnose his hip injury. In a June meeting between Marshall and Pat Bowlen, the team owner said Marshall had requested a trade, and the wide receiver even posted a farewell to Broncos fans on his blog. The Broncos, who traded away Jay Cutler after the Pro Bowl quarterback clashed with McDaniels, have given no indication whether they’ll accommodate Marshall.

Former New York Giants star Plaxico Burress was indicted by a grand jury on weapons charges for shooting himself in the thigh at a Manhattan nightclub and faces a minimum prison sentence of 3 1/2 years if convicted, prosecutors announced Monday.

The indictment charged the 31-year-old Burress with two counts of criminal possession of a weapon and one count of reckless Burress endanger ment, Manhattan District Attorney Robert Morgenthau said.

“The grand jury applied the law to the facts of this case,” Morgenthau said. He said the accidental shooting at the Latin Quarter nightclub Nov. 29 was treated “like any similar case against any other defendant.” Burress’ lawyer, Benjamin Brafman, said he was disappointed but not surprised by the indictment, which came after Burress testified before the grand jury and expressed remorse.

“When you have the mayor and the district attorney both publicly demanding a maximum prison sentence, it was perhaps too much to hope for the grand jury to conduct a sympathetic review of the unique facts of this sad case,” Brafman said in a statement. Burress’ former teammate Antonio Pierce, who was with Burress in the club and drove him to the hospital, was not indicted.

Denny Hamlin had few bigger fans than his grandmother. She wore her No. 11 socks, held her No. 11 stuffed bear and watched every race on TV — even as she sat and squinted only inches away from the 30-inch screen. When Thelma Clark died last week at 91, there Hamlin was a part of Hamlin that didn’t want to be at the track. With a heavy heart, Hamlin came to Pocono Raceway and snapped a 50-race winless skid. He took the checkered flag at the Pennsylvania 500 on Monday and dedicated this victory to his grandmother. “She understands the competition of the sport, and she understands how much she means to me,” Hamlin said. “Like today, she’s pretty proud.”

AUTO RACING Hamlin held off Juan Pablo Montoya during the final riveting laps, then choked up with grief in Victory Lane. Hamlin won for the third time in eight career starts at the triangle track that has become his personal playground. He has had three other top 10s there in the No. 11 Toyota. He was in tears after the emotional race, the victory coming three days after his grandmother’s death. There was a catch to his voice as he spoke, and he wiped his face with a towel before walking away for a subdued celebration. “We definitely had some angels with us today,” Hamlin said. This was Hamlin’s first victory since Martinsville Speedway in March 2008. He predicted victory and backed it up to strengthen his bid for a spot in the Chase for the championship.

There hasn’t been a Steelers training camp like this since the year Max Schmeling knocked out Joe Louis, “Gone with the Wind” was published and Jesse Owens won four Olympic gold medals in Adolf Hitler-controlled Germany. There’s no Dan Rooney around. The Steelers players reside in Rooney Hall during their three weeks at Saint Vincent College, an hour’s drive east of Pittsburgh. A Rooney remains in charge of the Steelers, the only six-time Super Bowl winner. Only it’s not Dan Rooney, who now is the U.S. ambassador to Ireland, a full-time position that allows him little time for football and none for training camp. Time enough, however, to place a weekend phone call to find out how his football team is doing. “Burt (Lauten, a team publicist) told me he called and asked how things are going,” defensive end Brett Keisel said Monday. “It’s different not having him here. We’re missing him.” Dan Rooney, one of the most successful and influential team owners in American pro sports history, has been part of a football family almost since the day he was born in 1932. His father, Art, founded the Steelers a few months later and began taking the oldest of his five sons to camp when Dan was 5. Some of Dan Rooney’s earliest memories are of catching gingerly thrown passes from one of his father’s employees. A Steelers training camp

without Dan Rooney, who first began negotiating player contracts for his father while attending Duquesne University, seemed unimaginable — at least until this summer, Rooney had attended every camp for a remarkable 71 consecutive years starting in 1937. Several players said it hit them that the Pro Football Hall of Fame owner wouldn’t be around when they sat down for their annual start-of-camp team meeting on Friday and Dan Rooney didn’t address them. Instead, Art Rooney II, Dan’s son and the team president for six years, gave the talk. “Mr. Rooney’s such a big personality who’s really encouraging to everybody,” safety Troy Polamalu said. “For him to not give us a speech, that was different.” It was the first time since the Steelers were founded during a time when pro football badly trailed college football in popularity that their players haven’t begun a season being greeted by either Art Rooney, who died in 1988, or his son. Dan Rooney calls himself the NFL’s last throwback, the only remaining link to the days when NFL ownership essentially was a mom-and-pop business and even a few hundred tickets sold might mean a profitable weekend. Now that Dan Rooney is effectively retired and his title has been changed to chairman emeritus, even those days are gone — though he hopes to attend the Titans-Steelers opener on Sept. 10. “I’m missing him, but I’m sure he’s missing us a little more,” coach Mike Tomlin said.

Clete Thomas homered with two outs in the bottom of the ninth to give Detroit a 6-5 victory against Baltimore on Monday night. Baltimore led 5-0 with one out in the top of the first. The game was tied at 5 going into the ninth, and Danys Baez (4-5) retired the first two batters, but Thomas hit a 1-2 pitch into the shrubs above the fence in center. Fernando Rodney (2-2) picked up the win with a scoreless inning of relief. Tigers starter Justin Verlander pitched eight innings, allowing five runs and nine hits, while Orioles rookie Chris Tillman gave up five runs in six innings.

After a run-scoring forceout, Ty Wigginton had a one-run double and Luke Scott added a two-run double. Willy Aybar hit solo homers from both sides of the plate for the Rays, who won nine of 10 games in the season series with Kansas City. Aybar homered left-handed off Greinke in the fifth and went deep from the right side against Ron Mahay two innings later. Greinke allowed six runs and 10 hits over five innings, and is 0-4 in six starts since his last win on June 28. Tampa Bay’s Scott Kazmir (66) gave up three runs and six hits in six-plus innings.

Rookie right-hander Randy Wells took a shutout into the eighth inning Monday night, and Mike Fontenot hit a threerun homer off slumping Aaron Harang, leading Chicago to a 4-2 victory against Cincinnati. The Cubs have gone 20-10 since July 1, and are 13-5 since the All-Star break, the best mark in the majors. Wells (8-4) allowed six hits, including Alex Gonzalez’s solo homer, over 7 1-3 innings while getting his fourth straight victory. Fontenot homered in the second inning off Harang (5-13), who leads the majors in losses. Harang hasn’t won since May 25, going 0-9 in his last 13 starts. Carlos Marmol gave up a runscoring double by Gonzalez in the ninth inning before retiring Willy Taveras on a grounder for his fourth save. The Reds have lost 13 of 14 and 19 of 23.

Andrew McCutchen homered for the fourth time in three games and Ryan Doumit went 3 for 5 for the Pirates, who have lost seven of nine.

ahead run and made a run-saving catch to give the San Diego Padres a 4-2 victory against the Atlanta Braves on Monday night. The 21-year-old Latos settled down after allowing a run in each of the first two innings. He retired 15 of 16 batters in one stretch and got a huge lift when Venable saved at least one run in the seventh with a diving catch in right field to end the inning. Latos (3-1) gave up Brian McCann’s sacrifice fly in the first and a solo homer by Adam LaRoche in the second. He allowed two runs and six hits.

Pinch hitter Rajai Davis tripled down the right field line to drive in two runs and lift the Oakland Athletics to a 3-2 victory against the Texas Rangers on Monday night. C.J. Manny Parra pitched eight outstanding innings, but Milwaukee nearly blew a fourrun lead after he gave up two hits to open the ninth. James Loney hit Hoffman’s first pitch for a two-run double, and Orlando Hudson drove him home to cut Milwaukee’s lead to a run.

Francisco Reina, a candidate for Craig City Council in the April 2009 municipal election, may have changed the landscape of city politics, despite coming in last place in his bid for local government. After 115 days of legal wrangling, the city’s 50-year-old campaign spending Reina limit is gone for the foreseeable future. Attorneys for the city of Craig and Reina agreed Friday to an out-of-court settlement that voids a city charter provision limiting a candidate’s personal contributions to his or her own campaign to $500. According to city officials, Reina was the first candidate in Craig’s history to spend more than the charter allowed. Thus, when the city cited him for a Class A municipal violation for overspending during his campaign, he also was the

first person to take the issue to court. Reina’s attorneys, led by the American Civil Liberties Union, said the spending provision violates the right to free speech, citing a 1976 Supreme Court decision known as Buckley v. Valeo as the basis for their position. In the end, the city’s attorneys agreed and signed the settlement. Reina, a 64-year-old retired soccer coach, said he looks back on the past few months with pride. “I’m proud of running and what I did after,” he said. “I think the best thing I did was give people a chance who may not be known by many people to be elected. I’m pretty happy I was able to change that for now.” He added that he does not plan to run again but instead will either spend more time with his son in Denver or move back to his native Spain, where Reina immigrated from about three decades ago. Not everyone is glad to see the spending limit disappear, however. Mayor Don Jones is unsure

what the community’s political future will look like, but he’s concerned about one possibility. “Maybe someone comes in here with some kind of an agenda and plops down $20,000 to buy the election,” he said. “It could happen.” The mayor isn’t the only local politician who fears what unlimited campaign funds may do to future races for city positions. “People are tired of campaigns being won or lost in the media … because of advertising,” City Councilor Jennifer Riley said. “This law has been on the charter for 50-plus years. I think people were comfortable that candidates couldn’t spend thousands of dollars to win elections.” It will be interesting to see what the community says in November, she added. Craig’s charter can be changed only by local voters. Therefore, the City Council unanimously approved an ordinance this month to create a ballot question for the Nov. 3 election that asks voters whether they want to delete the charter’s spending provision.

vehicles will increase despite fluctuations in fuel prices. “Sooner or later, gas prices will go up and people will want more fuel-efficient cars,” Schwartz said. Schwartz noted citizens in Snowmass Village use the vehicles to run errands and take children to school. She hopes more households will buy the cars, which start at $9,000, instead of a traditional second car.

Colorado officials released a revised proposal Monday for protecting remote national forest land in the state, adding 160,000 acres for protection and eliminating one provision for building temporary roads. The revisions bring the total area that would be protected in Colorado to nearly 4.2 million acres, up from about 4 million acres in last year’s version. Monday’s revision also eliminates a provision that would have allowed the construction of temporary roads for ranchers

to get access to federal land they lease for grazing. Theo Stein, a spokesman for the state Department of Natural Resources, said representatives of ranching groups agreed they could reach those areas without building temporary roads. The department will accept public comment on the revision for 60 days. Seven conservation groups issued a joint statement Monday saying the Colorado plan “falls far short.” The groups said the plan would allow coal mining in a fragile watershed, allow road-building and logging more than a mile into the backcountry, and allow roads

to new dam sites. The groups issuing the statement were Colorado Wild, Wilderness Workshop, Colorado Environmental Coalition, Western Colorado Congress, Colorado Mountain Club, Natural Resources Defense Council and the High Country Citizens Alliance. The Pew Environment Group, based in Washington, D.C., said the revision appears to offer less protection than the previous version. It said Colorado’s plan would open some areas to mining, logging, oil and gas drilling, and roads, and would make the state “a magnet for development.”
