relished their roles as leaders of the school, while some just didn’t want to be there. But one thought was shared among the seniors: It was their last year of high school. Most seemed ready to sprint through the 2009-10 academic year with thoughts of what lies ahead — college and the prospects of getting out of Steamboat. After spending part of her summer on a school trip in Spain, Caitlin Lucas said she was excited there were only nine more

months of high school. “We’re so close,” she said. Jaime Winter said it was kind of weird being the oldest in the school but kind of cool. That still didn’t change how she felt about starting school. “I’m not excited to be back at school,” she said. “It’s exciting to be seniors knowing that the sooner we start, the sooner we graduate.” Charlotte Letson said she wasn’t looking forward to the homework and having to wake
up early. Drew Ruff said it also dawned on him after waking up Monday morning that it was the first day of school, something that he wasn’t looking forward to. “I had senioritis for most of last year as a junior,” he said. “This is doubly bad right now.” Despite the lack of excitement from some seniors, Principal Kevin Taulman said he expects great things from the senior class. he gently surreal art of Robert Dieckhoff was everywhere you looked in downtown Steamboat Springs during the weekend. His curvilinear take on some of the Yampa Valley’s best known landmarks could be found on the back of T-shirts as well as on gallery Tom Ross walls during the PILOT & TODAY Steamboat All Arts Festival. The artist’s lush pastels seem to squeeze familiar landscapes until they bend unnaturally. What makes them so appealing? It’s all about mathematics. Dieckhoff doesn’t undertake a painting without running the numbers first. Dieckhoff told his audiences during a seminar at the Steamboat Artists’ Gallery on Friday that when starting a new painting, he doesn’t go beyond an informal sketch until he makes certain it fits into a mathematical formula. It’s a formula that has been kicking around since the 16th century — even longer. In the course of explaining his reliance on numeric formulas, Dieckhoff provided fascinating insights into the creative process. “To be an artist, you have to understand physics,” he told about 15 people last week. “To me, it’s integral to (everything). I have a library of math and physics books.” What many people don’t know about one of Steamboat’s most successful fine artists is that he has a background in science.

Dieckhoff has a degree in food science, and that means chemistry. And formulas. The formula Dieckhoff uses most often in planning a pastel landscape painting is the classic Pythagorean golden rectangle. Maybe you would recognize it as the other Da Vinci Code. The ancient Greek mathematician Pythagoras observed that there was a recurring relationship between a rectangle of particular dimensions and much of the beauty and harmony to be found in the natural order of things. A golden rectangle is one in which the ratio of long sides of the box to the short sides is 1.618 — the short sides are a little
more than half as long as the long sides. Pythagoras found this ratio could be observed in the natural environment from crystalline structures to the array of leaves along the stem of a plant. Pythagoras also noticed that the human body was “designed” so that each body part was in perfect golden proportion to all the other parts — the relationship of the hand to the forearm, and the leg to the trunk, for example. When it comes to human facial features, our perception of physical beauty often is in line with the golden ratio — the head forms a golden rectangle with the eyes aligning with the midpoint. The distance from the pupils of the eyes to the tip of the nose, the space between the outer edge of the eye to the center of the nose and many more relationships among facial features appear to be ideal when they conform to a ratio of 1:1.618. The candidates are set for this year’s Steamboat Springs City Council election, and all but one of the races will be contested. Although this year’s campaign is shaping up to be quieter than a 2007 election that saw 11 candidates vie for five open seats, November’s election shouldn’t lack for excitement. One race pits next-door neighbors against one another; two former city councilmen hope to re-gain seats on the city’s governing board; and two newcomers will battle it out for District 2. Councilman Walter Magill will run unopposed for his four-year, District 3 seat. Like 2007, however, growth and development issues — particularly the proposed Steamboat 700 project — appear to be the primary focus of candidates. City finances are another likely campaign issue because of the
recession and massive city budget cuts. Semi-retired businessman and former City Council President Kevin Bennett will take on his neighbor, current City Council President Pro Tem Cari Hermacinski in the race for the four-year District 1 seat being vacated by term-limited councilman Steve Ivancie. Hermacinski won the council’s two-year, atlarge seat in 2007. Bennett is a critic of the current council, which he thinks is too pro-development. “I would run as the loyal opposition,” he said last month. “I would offer a completely different direction for the city.” Hermacinski disagrees with Bennett’s claims that City Council is rushing the annexation of Steamboat 700, which proposes about 2,000 homes over 20 years on about 500 acres west of city limits. Hermacinski said her priorities would be fiscal responsibility and transparent government. “I think it’s a great way to serve

The Steamboat Springs City Council will discuss for the first time today the document that could govern growth in a large section of western Steamboat for the next two decades. Council members are scheduled to discuss and comment on the latest draft of an annexation agreement with Steamboat 700, the proposed master-planned community of about 500 acres that is seeking annexation. The agreement is the only item on the agenda for tonight’s meeting. The agreement would create a new zoning designation for new urbanism development,

Grocery stores are providing information about the number of customers who use reusable bags, and the results will be measured per capita, Carson said. The competing mountain towns have saved an estimated 2.4 million plastic bags, according to a news release. The winning town will receive $5,000 from Alpine Bank to install a solar panel system at a public school. “People living in the mountains, we recognize the paradise we live in, and protecting the environment is a priority,” Carson said. She said she was pleased that mountain residents supported environmental causes. “It shows the mountain towns are championing and pioneering reusing the reusables and keeping the plastic out of our rivers and out of our snow,” Carson said. Bamboo Market Health Foods, City Market, Healthy Solutions and Safeway are participating. Bamboo Market owner Anne Halloran said Americans need to retrain themselves to shop with reusable bags. Yampa Valley Recycles sells its bags for $1 each throughout town and at Bamboo and Healthy Solutions.
“I sell so many of those 99cent reusable bags,” Halloran said. “And I will kind of tally in my head, ‘OK, I bought 200 of them last month. They’re all gone, and I would say maybe one out of 10 people bring their bags in here, so we need to get a higher compliance rate of people doing it.’” She is seeing more people using reusable shopping bags and has heard children remind their parents to use the nondisposable bags. Bamboo Market cashiers sometimes encourage people to return to their cars to grab forgotten bags. Plastic and paper bags carry

As many as 1 million seabirds and 100,000 marine mammals die each year from eating or becoming tangled in plastic debris, according to a release from the ski town group. Disposable bag production emits millions of tons of carbon dioxide equivalent each year, the release stated. The process also requires fossil fuels. “Each plastic shopping bag requires 0.005 gallons of oil to produce,” the release stated. “At a consumption rate of 100 billion per year, the United States uses 12 million barrels of oil

each year to sustain its plastic bag habit.” Also, there are two “floating islands” of debris in the Pacific Ocean that when combined are larger than the United States, according to the release. The cost of disposable bags also hits consumers, Carson said. Steamboat Springs Police Department officers Stuart Hutton and Nick Moore investigated a bicycle versus vehicle accident near Hilltop Parkway and South Lincoln Avenue, where a 59year-old female cyclist sustained minor injuries to her face and arm Monday afternoon. Hutton said it appeared the woman was riding east on a path on the north side of South Lincoln Avenue at about 4 p.m. Monday when she collided with a car that was pulling out of a business driveway. The driver was turning right and said she didn’t see the cyclist, Hutton said. The collision caused some damage to the bicycle and no damage to the car, he said. Officers cited the driver for failing to yield, a traffic violation, he said. Both the driver and the cyclist said they were traveling

A 29-year-old man suffered a suspected broken arm Sunday evening while riding down Molly’s Trail on Emerald Mountain. Routt County Search and Rescue volunteers were paged at 5:55 p.m. Sunday for a 29year-old county resident who crashed his bike and was unable to descend the mountain on his own. Search and Rescue Incident Commander Dawn Alperti said the man, who was with a friend, was about half-
way down Molly’s Trail when he crashed and hurt his arm. Search and Rescue crews used an ATV and a basket to transport the man to the base of Emerald Mountain, where Steamboat Springs Fire Rescue emergency responders transported the man to Yampa Valley Medical Center. No criminal charges will be filed in the case of a missing 24-year-old Los Angeles woman found in Steamboat Springs on Sunday, Routt County Sheriff Gary Wall said. Silvia Mardini was found at about 4 p.m. at the West Kum & Go, unharmed and alone. Mardini, from the Mar Vista area of Los Angeles, last was seen running errands Friday, according to the Los Angeles Police Department. “Police and family became increasingly concerned for her welfare when by Saturday Mardini had not shown up and had sent family members text messages that indicated she was in danger,” stated a news release from the LAPD. Police Department officers searched the area around the convenience store Sunday afternoon for a man who, according to initial dispatch communications, was thought to have been involved in Mardini’s disappearance. Wall said Monday that there is no indication that anyone else was traveling with Mardini, and his office’s involvement in the case is finished. Wall said Mardini was not in custody Monday afternoon and that her parents were on the way to Steamboat to pick her up. According to a news release from the LAPD, detectives are continuing to investigate Mardini’s disappearance. The debate about the “public option” in health care has been dismaying in many ways. Perhaps the most depressing aspect for progressives, however, has been the extent to which opponents of greater choice in health care have gained traction — in Congress, if not with the broader public — simply by repeating, over and over again, that the public option would be, horrors, a government program. Krugman Washington, it seems, still is ruled by Reaganism — by an ideology that says government intervention is always bad, and leaving the private sector to its own devices is always good. Call me naïve, but I actually hoped that the failure of Reaganism in practice would kill it. It turns out, however, to
be a zombie doctrine: Even though it should be dead, it keeps on coming. Let’s talk for a moment about why the age of Reagan should be over. First of all, even before the current crisis Reaganomics had failed to deliver what it promised. Remember how lower taxes on high incomes and deregulation that unleashed the “magic of the marketplace” were supposed to lead to dramatically better outcomes for everyone? Well, it didn’t happen. To be sure, the wealthy benefited enormously: the real incomes of the top .01 percent of Americans increased sevenfold between 1980 and 2007. But the real income of the median family increased only 22 percent, less than a third of its growth throughout the previous 27 years. Moreover, most of whatever gains ordinary Americans achieved came during the Clinton years. President George W. Bush, who had the distinction of being the first Reaganite president to
also have a fully Republican Congress, also had the distinction of presiding over the first administration since Herbert Hoover in which the typical family failed to see any significant income gains. And then there’s the small matter of the worst recession since the 1930s. There’s a lot to be said about the financial disaster of the past two years, but the short version is simple: Politicians in the thrall of Reaganite ideology dismantled the New Deal regulations that had prevented banking crises for half a century, believing that financial markets could take care of themselves. The effect was to make the financial system vulnerable to a 1930sstyle crisis — and the crisis came. “We have always known that heedless self-interest was bad morals,” said Franklin Delano Roosevelt said in 1937. “We know now that it is bad economics.” And last year, we learned that lesSee Krugman, page 9

Remember when the deficit was so bad that Democrats said we (or more accurately the Republicans) were placing a terrible burden on our grandchildren? That was several trillion dollars ago. Democrats now appear perfectly fine with extending the increasing deficit and national debt to their great-grandchildren. Perhaps politicians think Thomas they will never be held accountable three generations from now because they won’t be around to explain to those not yet born why they refused to stop our financial hemorrhaging. The Obama administration forecast a 10-year budget deficit projection of

more than $7.1 trillion, but when confronted with figures from the pesky and bipartisan Congressional Budget Office, the administration was forced this week to raise that projection to approximately $9 trillion. That’s $9,000,000,000,000 dollars. For most of us who think a $1,000 deposit in our checking accounts is a large amount and a $1,000 credit card balance is too much, $9 trillion is a figure that is almost beyond comprehension. It is certainly beyond defensible. To borrow a phrase used in another context by the House leadership, it is un-American. The philosophy of government under both parties can be boiled down to two acronyms: ATM and ASM — always take more and always spend more. Who is clamoring for more laws to be passed, more programs to be started and more money to be spent? Let’s find him and lock him up for our financial security.
One answer is to be found in a new book by investigative reporter, educator and columnist Martin Gross. Gross summarizes in an easy to read and understandable style how and why government has failed its citizens. The book, to be released Sept. 1, is called “National Suicide: How Washington is Destroying the American Dream from A to Z.” In addition to listing some of the more outrageous pork projects that now are well-known to anyone who has been paying attention ($107,000 to study the sex life of the Japanese quail; $150,000 to study the Hatfield-McCoy feud are just two examples on a long list), Gross touches on even bigger and equally outrageous expenditures. The Alternative Minimum Tax, which he says is “based on an accounting lie,” will cost taxpayers $1 trillion throughout the next 10 years. America, See Thomas, page 9 Bruce Tinsley

Opponents’ arguments are not coherent son all over again. Or did we? The astonishing thing about the current political scene is the extent to which nothing has changed. The debate about the public option has, as I said, been depressing in its inanity. Opponents of the option — not just Republicans, but Democrats such as Sen. Kent Conrad and Sen. Ben Nelson — have offered no coherent arguments against it. Nelson has warned ominously that if the option were available, Americans would choose it over private insurance — which he treats as a self-evidently bad thing, rather than as what should happen if the government plan was, in fact, better than what private insurers offer. But it’s much the same on other fronts. Efforts to
strengthen bank regulation appear to be losing steam, as opponents of reform declare that more regulation would lead to less financial innovation — this just months after the wonders of innovation brought our financial system to the edge of collapse, a collapse that was averted only with huge infusions of taxpayer funds. So why won’t these zombie ideas die? Part of the answer is that there’s a lot of money behind them. “It is difficult to get a man to understand something,” said Upton Sinclair, “when his salary” — or, I would add, his campaign contributions — “depend upon his not understanding it.” In particular, vast amounts of insurance industry money have been flowing to obstructionist Democrats such as Nelson and Sen. Max Baucus, whose Gang of Six
negotiations have been a crucial roadblock to legislation. But some of the blame also must rest with President Barack Obama, who famously praised Reagan during the Democratic primary and hasn’t used the bully pulpit to confront government-is-bad fundamentalism. That’s ironic, in a way, because a large part of what made Reagan so effective, for better or for worse, was that he sought to change America’s thinking as well as its tax code. How will this all work out? I don’t know. But it’s hard to avoid the sense that a crucial opportunity is being missed, that we’re at what should be a turning point but are failing to make the turn. In my column last Monday, I made a joke about the Swiss that fell flat with some readers. Also, the Swiss don’t wear lederhosen.
Government greed to be explained in book Thomas continued from 8 he writes, spends $700 billion a year on various welfare programs, amounting to $65,000 for each poor family of four, yet we still have the poor with us. Both political parties, Gross charges, secretly encourage illegal immigration (the Democrats for votes, the Republicans for cheap labor) and then reward the immigrants’ children with automatic U.S. citizenship. Gross has discovered 1,000 duplicate programs that waste billions. The Bush administration’s signature education issue, “No Child Left Behind,”
has left behind a lot of misspent money: $24 billion per year, according to Gross, even as primary and secondary education “continue to spiral downward.” Medicare and Medicaid waste $150 billion a year dealing with doctor and hospital fraud; $45 billion a year is wasted on “improper” payments and even more on “unnecessary agencies.” The Des Moines Federal Home Loan Bank funded research, Gross writes, that found 1,399 government programs handling disappearing rural areas. If you haven’t vented enough this summer at your
local town hall meeting, this book will keep your blood pressure up and your motivation to do something about overspending high into the next election. Publisher’s Weekly wrote in its review: “A fiery A-Z compendium of government greed, chicanery, and plain incompetence. Gross enjoys a good rant, but his criticism are sound and wellsupported.” Gross does more than just list government’s sins. He offers a solution on “How to Better Govern America.” If ever there was a must-read for people who are sick of the way government operates, this is it.

They first appeared in a star catalog published by the Palermo Astronomical Observatory in Italy in 1814, but it was several decades later that British astronomer William Webb actually solved the riddle. It seems that an observatory assistant named Nicolaus Venator was in charge of the star catalog project and that he played a practical joke on the rest of us. If you reverse the letters of the two star names, Sualocin and Rotanev, they spell Nicolaus Venator. Thus, the sneaky observatory assistant achieved immortality by naming two stars in Delphinus after himself. The star at the tip of the dolphin’s nose, named Gamma Delphini, is resolved with any small telescope into one of the most beautiful double stars in the heavens. Gamma’s two colorful stars are just more than 100 light years from Earth and require 32 centuries to orbit each other. If you own a telescope, aim it at Gamma Delphini, the Dolphin’s nose, for a real celestial treat. Professor Jimmy Westlake teaches astronomy and physics at Colorado Mountain College’s Alpine Campus. he late summer sky is dominated by several giant constellations that eat up a lot of territory: Hercules the Strong Man, Ophiuchus the Serpent Bearer, Ursa Major the Great Bear, etc. Tucked in between Jimmy Westlake these skyhogs are CELESTIAL NEWS a few tiny constellations that are a snap to locate precisely because they are so small. Delphinus the Dolphin is a case in point. Although Delphinus contains no star brighter than third magnitude, one’s eye is immediately drawn to its small, distinctive diamond shape. To find Delphinus, go outside at about 10 p.m. and look high up in the southeastern sky, nearly overhead. There, you should spot summer’s three brightest stars marking the corners of the Summer Triangle asterism: Vega, nearly straight up, Deneb, fainter and to the northeast, and Altair, to the southeast of Vega. Just east of Altair, you will spot the small diamond-shaped pattern of Delphinus the Dolphin. The four main stars form the head and body of the dolphin and a fifth star, off to the lower right, marks his tail. It requires little imagination to see a dolphin here, jumping up out of the celestial sea. You can just about cover the entire constellation of Delphinus with your thumb held at arm’s length. The diamond-shaped asterism of Delphinus also is popularly known as “Job’s Coffin,” suspended halfway between heaven and Earth. The origin of this nickname is uncertain. The Dolphin’s two brightest stars are the ones marking the top and right points on the diamond. The origin of their unusual names, Sualocin and Rotanev, was a mystery for

year, he said. “I always have high expectations for the senior class,” Taulman said. “They always set the tone for the school. They define what kind of year it’s going to be.” The Class of 2010 of 163 students dwarfs last year’s graduating glass of 127. Taulman said the high school’s overall enrollment had increased by 40 students.
Not every senior was disappointed it was the first day of school. Some took the opportunity to see the positives and how they could leave their marks on Steamboat Springs High School. One such student was Hanna Kurowski. “I’m looking forward to being the upperclassman, and being a role model for all the kids,” she said. Tom Lotz took a more philosophical approach to starting
the year. He said it was a time to reflect before he spends every other weekend during the first quarter of the year traveling to different colleges across the country. “Finally, we can look back at our high school experience, look back over high school and embrace everything,” Lotz said. SmartWool, New Belgium Brewing Co. and Routt County Riders are asking movie lovers to leave their cars at home Wednesday evening and to take two-wheeled transportation to Steamboat’s inaugural Bike-In Movie. A PG-13-rated edition of the comedy classic “Caddyshack” hits a 20-by-24-foot inflatable screen at 8:30 p.m. Wednesday at the base of Howelsen Hill. Admission is free to bike riders and $2 for drivers. SmartWool Field Marketing Manager Rob Shoaf said the company started meeting with New Belgium representatives about a year ago to talk about sustainability. In addition to participating in New Belgium’s efforts to get more people biking, SmartWool showed interest in bringing the brewery’s Fort Collins-based Bike-In Cinema film series to Steamboat. (With it) I can develop my own reality.” The perception of surrealism in a Dieckhoff landscape of Emerald Mountain, for example, comes from his practice of squeezing a 260-degree viewscape into a narrower rectangle. The artist begins by taking
50 to 150 photographs of a scene he intends to paint. He uses the photos as an aid in refining his concept for the finished piece of art. Next, he draws a casual sketch. The mathematics come into play when Dieckhoff draws a complex series of intersecting lines through a golden rectangle. The points of intersection serve as his guide to where to place key points of interest in his painting. And when he gets it just right, he taps into one of the mysteries of the universe.

He also was a member of the Excellence Project, creators of the social host ordinance passed by council in a 4-3 vote earlier this year. The law allows authorities to fine adults found guilty of knowingly providing a location for underage drinking. Reisman said he is mostly supportive of current council members and Steamboat 700. “The plans that are in place have called for growth to go in that area and for growth to be concentrated. (Steamboat) 700 accomplishes both of those things,” Reisman said last week. “Based upon everything I know, I would vote for it.” Solomon was co-chairman of the 12-member Tax Policy Advisory Board, which was seated by the city in April 2004 to take a comprehensive look at the city’s tax structure. Although it offered recommendations for future shortfalls and took a hard look at a city property tax, the Tax Policy Advisory Board did not recommend any changes to the city’s tax structure. Solomon was a vocal oppo-
nent of a gravel pit proposal earlier this decade and has made campaign contributions to current council members Ivancie and Meg Bentley and Routt County Commissioner Diane Mitsch Bush. Solomon could not be reached for comment Monday afternoon.
At-large seat In the race for Hermacinski’s two-year, at-large seat, former Councilman Jim Engelken will face local landscaper Kyle Pietras. Pietras, a former employee of the Steamboat Springs Parks, Open Space and Recreational Services Department and the Steamboat II Water and Sanitation District, said he also supports Steamboat 700 because of its potential to provide jobs and affordable housing. “I’m kind of a realist,” Pietras said. “We need tourists. We need workers working. We need growth in town. Being against growth, it’s just not realistic.” Like Bennett, Engelken has been critical of the current City Council. He does not support Steamboat 700 in its current form, particularly because the city would rely on a voluntary real estate transfer tax to pay for the development’s requirements for

All in the details The eligibility of all candidates is pending the verification of nominating petitions, which were due to City Hall on Monday. Candidates will have until Thursday to resolve any problems with their petitions, City Clerk Julie Franklin said. The most common problems with petitions involve the 25 signatures of registered voters that candidates are required to obtain. The same person may not sign more than one petition, and all signers must include a physical address that matches their voter registration, among other requirements. The City Council’s seven total seats include two representatives each from District 1, District 2 and District 3 and one at-large seat. District 1 includes western Steamboat and much of Old Town. District 2 includes the mountain area, and District 3 includes southern Steamboat. Although candidates must run for a seat in the district they live in, or the at-large seat, all Steamboat Springs voters will vote on all the City Council races.

It doesn’t take Jay Cutler’s return to Denver for the Broncos to find themselves in the middle of a circus. Cutler and the Chicago Bears will visit Invesco Field on Sunday night in a preseason game like none other, one that marks the home debuts of coach Josh McDaniels, Cutler the man who chased Cutler out of town just weeks into his new job, and Kyle Orton, the methodical quarterback who replaced the Pro Bowl passer. The Broncos Marshall still find themselves dealing with a soured superstar who has trust issues with the team, a simmering feud with the coach and a trade request on the table. Sound familiar? Although Cutler forced a trade to Chicago after his clash with McDaniels six months ago, fellow Pro Bowler Brandon Marshall hasn’t been able to punch his own ticket out of town. The recalcitrant receiver asked for a trade in June and thought one would be in the works after meeting with team owner Pat Bowlen, but McDaniels quickly quashed that notion, and Marshall reported to training camp insisting he was only doing so to avoid the $15,888 daily fines he’d face for holding out. He’s practiced only about a half-dozen times this offseason, and he’s only taken a few snaps with the starting offense this month. He pulled a hamstring on the first weekend of training camp and didn’t return until a See Broncos, page 22

Once he gains experience, New York Jets quarterback Mark Sanchez probably will become more comfortable and confident in the pocket. And, if the rookie is looking for a real positive, there’s this: He won’t have to face the Baltimore Ravens again this year. Vying to become the Jets starter, Sanchez got off to a wretched start Monday night and finished with a flourish in a 24-23 preseason loss. Starting for the first time, Sanchez handed off the ball on the game’s opening play from scrimmage. Then he forced a pass while being hit in the stomach by middle linebacker Ray Lewis. The ball was intercepted by Haloti Ngata, who rumbled 25 yards for a touchdown to make it 7-0 with 52 seconds elapsed. “Not, obviously, the way you want to start. I thought I was doing the right thing; I felt Ray come free on the right side from the protection,” Sanchez said. “I was checking it down to the flat, perfect. Haloti just jumped right in front of the ball and made a really athletic play.” Sanchez nearly had his second pass picked off, too. On his final play, however, the firstround draft pick threw his first NFL touchdown pass — a 19yarder to running back Leon Washington with 5:50 left in the second quarter. Drafted fifth overall out of Southern California, Sanchez went 3 for 8 for 43 yards. He didn’t experience success until the Ravens removed several players from the first-team defense, including Lewis and safety Ed Reed. Jets first-year head coach Rex Ryan spent the previous 10 years building the Baltimore defense, but there was no way he could fully explain to Sanchez the experience of going up against the wickedly effective unit. “You put a young guy like Sanchez in there and you see our defense, it can be difficult,” Lewis said. “You saw his eyes get big, and he was jumping around in the pocket. Bottom line: We gave a lot of looks and disguises, and we confused him a little bit.”

Court: Delaware sports wagering would go against 1992 ban A federal appeals court ruled Monday that sports betting in Delaware would violate a 1992 federal ban on such wagering, essentially halting the state’s plans to start taking bets next month. The plan was opposed by the professional sports leagues and the NCAA, which claimed it violated the federal Professional and Amateur Sports Protection Act, would harm their reputations and expose young people to gambling. Delaware Gov. Jack Markell had pushed for sports betting as a way to help resolve an unprecedented shortfall in state tax revenues and balance the state
in 1976 that required parlay, or multiple bets, on at least three games. The 1992 law restricts sports betting to the four states that met a deadline to sign up for it: Nevada, where Las Vegas sports books determine the odds for sporting events across the country; Delaware; Montana; and Oregon. But the leagues argued that the exemption does not allow Delaware to offer bets on single games, or on sports other than professional football. Speaking for a three-judge panel, Judge Theodore McKee said Monday that the betting plan as currently envisioned violates the federal ban. A written opinion explaining the judges’ reasoning will be issued at a later date.

Kyle Busch deviated from his traditional victory celebration when he spotted a crying fan in the grandstands and tried to hand her the checkered flag through the fence at Bristol Motor Speedway. He was at Fairgrounds Speedway in Nashville the next day for a late model race sponsored by the Kyle Busch Foundation. Handling problems forced him out of the 150-miler, but he still went to Victory Lane to present the guitar trophy to the winner. Such is the enigma that is Kyle Busch lately. week ago after his acquittal on a misdemeanor battery charge in Atlanta, a verdict he had hoped would give him leverage for a new deal to replace the one that will pay him $2.2 million this season. His agent met with McDaniels last week on the same day Marshall met with a team executive, who apologized on behalf of the Broncos for an incident in which the receiver’s teammates were instructed not to say they were happy for Marshall about his acquittal on charges he beat up his then-girlfriend 18 months ago. Then, Marshall ran almost
exclusively with the scout team last week after telling reporters he wasn’t ready to resume his role as the Broncos’ main receiver because he was nowhere near mastering the new playbook. So McDaniels left him behind along with some injured players when the Broncos traveled to Seattle for their second preseason game Saturday. The Broncos resume practice today, and McDaniels said he expects Marshall to be in the mix. But will he run any of the Broncos’ offensive plays? Or will he simulate the Bears receivers instead of running his own routes? And will he be on the field Sunday night? The Broncos’ issues go be-
yond Marshall. While Cutler already has shown flashes of the brilliance in Illinois and also the huffiness he was known for in Denver, the quarterback the Broncos got in return for the strong-armed, mop-topped star, hasn’t exactly had a smooth transition. Orton had a nightmarish three-interception performance in the Broncos’ preseason opener at San Francisco after an awful stadium scrimmage that spawned the catch phrase “Orton hears a boo.” He atoned for his dismal debut last weekend at Seattle — save for an odd left-handed lob on fourth-and-1 that was intercepted in the end zone.
