LAST MONTH WAS UNEXPECTED to say the least… First, we ask your forgiveness for this issue’s tardiness; the events of September with the extremity of two severe weather aberrations have left a historical imprint that we did not envisage. Hurricanes Irma and Maria destroyed lives and the tragedy has been one of the most emotive events among the islands in years. Coming through this experience is the initiation of a road to recovery and restitution. We hope that all of you are starting to get back to some stability among the varying losses profoundly felt. We were deeply convicted over publishing this edition—our first ever special—specifically because the content we’d planned is now even more significant than ever before. We retitled this issue to the Reconstruction and Renovation Special, being more apt for our circumstances. You will find much of the material in this month’s magazine relevant to the rebuild effort we have to undertake. Packed with a wealth of knowledge from industry experts across the property market industry, we’re hoping this will offer insightful, inspiring, and impactful guidance. This issue is crucial granting best construction practices, hurricane learnings, and resources available to help in rebuilding the BVI to return stronger than ever. Being sensitive to the hurricane aftermath, we’ve changed the original content plan for this special edition. IT WOULD BE FAIR TO SAY that at the beginning of this summer, the majority of us never expected two life-changing weather anomalies— Hurricanes Irma, and Maria—to impact our beautiful islands so definitively; Hurricane Irma being the most devastating to the Virgin Islands, and Hurricane Maria to our beloved neighbours in Puerto Rico. It’s difficult to know how to digest the magnitude of what has occurred; early September saw people lose loved ones, homes, businesses, and livelihoods across the Caribbean, forming a rare, regional catastrophe.

Nelson Mandela—a man renowned for the incredible adversity he faced—once said, “Part of being optimistic is keeping one’s head pointed toward the sun, one’s feet moving forward.” However, it is without question that this is not going to be easy. At VIPY, and in our community, all we can do is try to keep moving forward, learning, progressing, developing, sometimes with two steps forward, and three steps back. But we must keep persevering with the goal of recovering to become stronger than we were before.

We intend to support BVI residents even more than ever, going forward with clear guidance on how to rebuild with best practices in construction, design, off-grid solutions, and prudent product choices. We will look at these subjects in-depth in our December issue. For now, the Virgin Islands community needs to pull together at this time and both the BVI Premier— the Honourable Dr D. Orlando Smith, OBE—and the Governor—His Excellency, Augustus Jaspert—had strong messages in their speeches regarding rebuilding our islands.

LEFT Surprise and disbelief filled BVI residents in the aftermath of the storm

On September 25, 2017, live on ZBVI Radio, the Premier said, “This hurricane that hit us is the scale we have never seen before; it was a Category Five, and it was really devastating…just before that, we had intense flooding, again, such as we never had before in the BVI…global warming is definitely affecting us and we now have to look at where we are as a country and make the adjustments to suit the times in which we live.” The Territory of the BVI is in a period of recovery, attempting to take and apply as much wisdom from the situation as is possible. “We have to take lessons from what has happened, certainly with Irma and review our building codes,” said the Premier. “We have lost and received damage to about 70 percent of our buildings, and that now gives us an opportunity to build smarter and stronger.” There is a strong sense of unity in this overwhelming ordeal with clear goals to collaborate in the reconstruction effort. A press release from the Premier on September 27, 2017, added to the progressive direction. “Considering our long-term goals to rebound from this disaster, we have started to establish relationships to foster our rebuild,” said the Premier. “On Sunday along with Minister for Communications and Works, Hon. Mark Vanterpool and Governor Augustus Jaspert, I toured the Pockwood Pond power plant with the United Kingdom’s Department for International Development’s, Secretary, Priti Patel. The Department for International

Development - DFID is the United Kingdom government department responsible for administering overseas aid. During the tour, Ms. Petal had an opportunity to see firsthand, the hard-working efforts of both our BVI Electricity Cooperation engineers and the UK’s Defense Force Royal Engineers to restore electricity to our islands. “Sunday, I received some good news that reminds us that we will rise again,” continued the Premier. “Our very own Tortola Pier Park was given the Port of the Year Award for the 2017 Sea Trade Awards. While to some this might seem simple, it

is a reminder of our ingenuity and also comes as some encouragement that with persistence, hard work, and strength, we will one day soon return to prominence. Even as we go through this time, I have faith that God will continue to bless the Virgin Islands.” The Governor’s comments—also on September 27, 2017—projected to the community and the world a forward-thinking diligence that the islands will be taking. “Walking through Spanish Town, I was able to see marked improvements from my previous visit last week; the togetherness of

the community continues to shine through,” said the new Governor, who took up his appointment in August. “The Deputy Governor and I thanked the volunteers in the distribution centre, as well as the hard-working public officers for their efforts to date.” There is a clear acknowledgement of the obvious in residents’ minds —this recovery will be long, but the process is a daily motion that will see the Virgin Islands rebuilt stronger and greater than before. “I continue to be proud of the community spirit of togetherness that I see displayed daily,” concluded the Governor. “With all of our collective efforts, we will see the Virgin Islands bounce back even stronger than before…May you continue to be united as we work together to rebuild the Virgin Islands…And may God continue to bless us all in this Territory.” ■ #BVISTRONG

Now that the immediate threat posed by the storms has passed, attention inevitably must turn to recovery and how best that recovery may be facilitated. We have set out below a summary of some of the pertinent issues.

Insurance Many business, property, and motor vehicle owners will have the benefit of a policy of insurance against which

they may submit a claim for loss and damage incurred as a consequence of the storms. While the majority of claims should as a matter of course be processed without the need for legal assistance, our lawyers are available to assist with the claims process and to liaise with the local insurance companies, if required. Please ensure that any damage is properly recorded and items in respect of which a claim is to be made are not discarded. Be sure to read the policy carefully and be aware of any exclusions and time limits within which claims must be submitted.

Yachts The insurance issues summarised above are as relevant in the context of yachts as they are for other types of assets. Where existing yachts are

damaged beyond repair, many owners will be interested in acquiring new vessels for which there may be a requirement for assistance in relation to financing, ownership structuring, and registration. In the latter case, the Virgin Islands Shipping Registry is operational and is accepting new applications for registration.

Employment and Immigration Most businesses in the BVI will have been negatively impacted by the storms, at least on a short-term basis and may have a requirement for staff

The recovery effort will require time and patience

to work flexibly until a sustained improvement in business prospects. For some businesses such as those involved in construction, haulage, and vehicle repair, this will no doubt be an exceptionally busy time with a corresponding requirement for additional staff. Such businesses should ensure that they make use of robust employment contracts and have a detailed understanding of those aspects of the Labour Code that are particularly relevant for staff working in such circumstances, including payment of overtime, rest periods, and limitations on hours of work. An understanding of the work permit application process will be essential where staff with specialist skills are required to assist with the recovery process and appropriate staff are not available locally. The Labour Department has announced that work permit applications for certain workers will be expedited, particularly those involved in the relief effort. In relation to existing work permit holders, the Government has announced that there will be a grace period of up to three months for the holders of work permits to regularise their immigration status following the expiry of their work permits. This will be of particular help to many of those work permit holders that are temporarily away from the BVI.

Property Reconstruction Many homes and other properties in the BVI sustained significant damage. A multitude of home and property owners will have repair and refurbishment of their properties at the forefront of their minds.

Some property owners will consider this to be a good opportunity to remodel or extend their homes. Property owners that hold their properties pursuant to a NonBelongers Land Holding Licence are reminded to review their licence carefully before undertaking such work. It would be typical for such licences to be subject to a condition that any alterations to the property (which would result in the property no longer matching the description of the property in the licence) will require the prior consent of the Cabinet of the Virgin Islands.

Customs Duty Items that are imported into the BVI typically attract duty at a rate between 5% and 20% depending on the nature of the item in question. To facilitate the recovery effort, the Government has announced that Customs duty will be waived in relation to the importation of certain items from 3 October 2017 until 31 December 2017, including: – Food; – Generators; – Clothes and shoes; – Building materials; – Electrical and plumbing fixtures and materials; and – Household furniture and appliances.

Business Development Fund The Government has announced the establishment of a business development fund whereby businesses will be entitled to apply for loans to assist with their recovery efforts. We expect the Government to announce further details of this scheme shortly. We are hopeful that this initiative will enable many enterprises to recover and reopen for business.

Banks The retail banks operating in the BVI have announced customer assistance programmes whereby there is an option to defer loan payments for a fixed period of time. Some of these assistance programmes automatically apply but others need to be applied for and we suggest that you contact your bank to ascertain if this is something that is appropriate for you. ■

Introduction In order to obtain financing for a construction or renovation project, the first step is to form a clearly defined architectural plan on the proposed construction development and/or renovation project. In order to create such detailed plans, you’ll have to engage with an architect, a project manager/quantity surveyor as well as a contractor. The architect will detail the plans on the basis of your requirements. Once this is completed, the contractor can provide an estimate on the proposed cost of the development. We recommend obtaining at least three independent quotations for comparing construction proposals. Once you have this information, you can sit down with the bank to discuss the financing requirements. It’s important to meet with your financing bank at an early stage so that you’re aware of all requirements. Once the project has started, stay within your intended project budget. It’s often tempting to change the designs and plans, however any changes to the original plans will incur additional costs. It’s therefore significant to have your plans as well as budget clearly defined at the start. This allows you to avoid either disappointment in development time or costs associated with your new home.

There are in total six licensed banks in the British Virgin Islands. Not all banks offer the same options for financing. Some will have specific requirements whether related to financing of condominiums, construction financing versus the purchase of a home, owner occupied versus rental properties, and holiday home versus residential home. Therefore, it’s important to verify what kind of financing options the bank you desire to work with offers.

Some known banks actively involved in real estate construction financing are Banco Popular, FCIB, and VP Bank.

Application forms and documents for financing A typical review for construction financing will include the following: • A Personal Financial Statement (PFS) to be completed. This will include information on both personal income from employment or business, savings accounts, investments, properties owned, and other debt for either mortgages or credit facilities • The items listed in the PFS will require supporting documents for income, rental income, liquid asset and securities listed. This will typically include a confirmation of salary, a statement of bank account not older than three months, and a confirmation on other loans and debt. If you are a business owner, the bank will usually request confirmation on assigned salary/shareholding/ dividends payable, or bonus eligibility for the business • A ‘Short Vitae’ or CV with the background of the borrower to understand their background and business activities • If the financing request is for a construction loan, the bank will require an appraisal report for land and when ready, architectural plans with value upon completion (from an appraiser in the BVI) • For foreign investors, the bank will require a certified copy of the Non-Belonger Landholder’s license (application is on condition of land purchase) and if the property will be rented out, the bank will require a confirmation of the trade license and expected forecast on rental income if this is to be considered for the repayment of the loan

Financing Options The standard financing option for a home development in the BVI is a ‘construction loan product.’ This is a loan whereby you will use the equity of the land purchase to develop your new home. Before you start, create a budget as well as plans on what your requirements are with regards to your home development or refurbishments. On the basis of your requirement, the architect will be able to prepare the required drawings. The contractor will prepare a detailed construction contract outlining the various phases of development to be completed. A quantity surveyor will determine the various stages of completion and will create a value upon completion as well as a ‘draw-down’ schedule. This will confirm the percentage of completion against the available budget and construction loan. Once a construction phase has been completed (i.e. cistern, first floor, etc.) a payment request is made to the bank. The bank will verify the completion and confirm payment to the contractor. Once the home is completed, a professional valuation is done to confirm the earlier prepared ‘valuation upon completion.’ At this stage, the construction loan is converted to an amortised loan whereby you will start repaying on a monthly basis both interest as well as capital for a defined period of time. Typically, this is up to 20 years on an interest rate which is either variable or fixed depending on the agreed terms.

Building Procurement— Self-Management The key to successfully managing your own project is to build a strong relationship with your CORE players, this consists of your Architect, Engineer and Contractor. Whether this is your first project or your fifth, management of such an undertaking will no doubt be challenging to say the least. To surmount this, we recommend that you implement weekly meetings and periodic progress reports in addition to forecasted progress reports to ensure everything goes according to schedule.

Bill of Quantities This document shows the breakdown of costs associated with the building of the project. It is extremely helpful for both the client and the contractor. It allows the client to gain a better understanding of the different components of the building process and creates a level playing field insofar that it enables a fair comparison of the rates supplied by the contractors.

Knowing your Contractor Your architect and engineer will more than likely have contractors that they will recommend you use. Get to know and evaluate each of these contractors individually. Meet with them and request a portfolio of recently completed works, which are comparable to the type of project you are about to undertake. This will allow you to get a full picture of the quality of work offered; you will also have the opportunity to relay any concerns you may have regarding the project. A site visit is always a bonus! This will help the contractor gain a better grasp of the layout and provide a more accurate rate.

Tender Documents After you receive the bill of quantities

from your project manager, the tendering process will commence. This involves the provision of the full set of construction drawings and bill of quantities to your selected contractors for pricing. In this field, having more is best. We suggest that you consider the bids from a few contractors—at least three—to ensure a fair comparison.

Negotiation If your preferred contactor’s bid is too high, you can utilise the art of negotiation to ensure the ball lands in your court. There are a few ways to go about doing this. One way of doing this is to meet with your preferred contractor to discuss if there are opportunities to crunch costs or to minimise expenses within the bid. Another way to cut costs is to source the finishing elements and components yourself. This would leave you with only the installation costs from the contractor’s side.

Getting Started After acceptance of the bid and finalisation of a contract between you and your awarded contractor, it is customary that a mobilisation payment be issued. This is an advance payment which will be repaid by the contractor over the course of the contract. It consists of 10% of the contracted sum paid to the contractor, which enables them to procure materials, the insurance bond, and the setup of a site office and staging area.

Planning and Building Authority Procedure The Planning and Building Authority procedure is not particularly onerous, but does need to be considered ahead of time. The property owner must appreciate that such procedures need to be followed and an adequate amount of time should be allowed

to get through the process. Typically, you will first apply for planning permission, based upon a basic set of floor plans and elevations. It is usual for your architect/designer to guide you through this process as they will have—hopefully—designed a house in the past that is in compliance with all of the planning regulations. Once planning permission has been obtained, the architect/ designer will then move forward with the construction drawings that will actually be used to build the house. These will typically include structural drawings and MEPF drawings, (Mechanical, Electrical, Plumbing and Fire Protection). Once complete, these construction drawings will be submitted to the building authority who will review and ensure the drawings comply with all local codes. Again, your architect/designer would usually steer you though this process. Upon receipt of the building authority’s approval, you will be ready to break ground and start the construction phase.

During the Building Process Familiarise yourself with ‘Requests for Information’ or RFIs so that you’re not alarmed when they arise, because they will. During the building process, there are many times when issues will emerge requiring clarification. In the event that this happens, an RFI will be raised and sent to your architect or engineer for explication. This may lead to change orders or variations being made. There’s no need to be alarmed, however these requests will be sent to yourself as project manager/client for approval, should variations be necessary.

Not only should the architectural drawings be followed in great detail, attention must also be paid to both the Structural and MEP drawings to avoid mishaps later on in the process. This may result in the disbursement of additional funds to rectify errors that may cause undesirable changes to the design of the property. One way to avoid this is to ensure that an inspection is carried out

before every major pour of concrete. Your engineer is responsible for ensuring that your property is structurally sound, inspection and subsequent approval is then carried out by the Building Authority. Things to look out for are; correct rebar spacing and sizes, and structurally sound blockwork; ensuring that there is concrete filling in each block that contains a rebar. Another way to protect the overall design of your property is to arrange weekly or bi-weekly meetings with your architect to ensure that what was designed is built as specified.

This will inevitably increase the construction cost of your home, but should result in reduced home insurance premiums and will give you much greater peace of mind, should the island be subjected to a catastrophic event. • T HE LOWEST PRICE isn’t always the best price. You should accept a bid based not only on its price, but also on the expertise and qualifications of the contractor. While keeping your base budget in mind, consider which contractor meets all of the qualifications for

your project. Then consider the costs. Remember, there’s always room for negotiation. • I F YOU CHOOSE THE SELFSUPPLY ROUTE for construction, be sure to consult with your awarded contractor to ascertain the schedule and corresponding dates by which the materials/ items should be on site. In this scenario, liability lies with you and any delay caused is likely to cost you additional funds, as time spent waiting is still time spent. • E NSURE THAT THERE ARE NO SNAGS in the building process. Always ensure your architect, and engineer inspect and sign off on the structural elements, MEP components, and design layout before each major concrete pour. They are the individuals responsible for quality control throughout the building process. ■

Next, repair any minor holes or damage to walls with filler and sand them down to reduce any textural differences. Once the surface is ready, taping the area well will save time and headache down the line. Take the time to actually remove light switch covers and electrical outlet plates. Be sure that furniture is removed or covered with tarps or drop cloths, and don’t forget to cover flooring as well. If painting over a dark wall or simply to create a brighter, fresher end-product, consider priming the wall before adding the chosen colour.

TOP TIPS • CLEAN BEFORE YOU PAINT Yes, you can and should clean your walls before you paint. A simple swipe of a microfiber cloth can take dust and minor dirt off a wall and make it a better surface for paint. For walls that need more serious washing, be sure to allow time for them to dry before painting. • HAVE A PLAN Try to tackle one room at a time. Your project won’t feel as big or overwhelming when you know you can complete it in a single weekend. Depending on what you’re painting, plan to begin with ceilings, then move to walls, and paint trim last. • BE PATIENT Even the best plans don’t often go off without a hitch. Set aside adequate time for preparation, painting and drying. By allowing the paint to dry and set well, there is a smaller chance of needing touch-ups later. • RULE OF THREE Avoid becoming overwhelmed by choosing three colours per room. Sticking to the rule of three will help the room look cohesively put together. The rule of three should be 60% (wall colour), 30% secondary colour (an accent wall or upholstery) and 10% home decor accents. • STIR THE PAINT Be sure to give the paint a good mix before pouring it into a tray. Don’t dip your brush or roller directly in the paint can as the colour may not be evenly distributed. • CHOOSE THE RIGHT TOOLS Rollers come in various thicknesses and are preferable for large areas and hard-to-reach spots. Brushes are good for painting furniture and also offer greater control for detail work. ■
