B-Nova

B-Nova Chassis The BLANKOM Digital B-Nova chassis is a base for a modular IPTV platform and cable TV headends. B-Nova enables the operator to setup a very compact headend configuration using various processing and interfacing modules. B-Nova scales from one chassis headend in a box to a multiple chassis bigger headend system. The Architecture of the B-Nova platform enables a very high performance with a very low power consumption. B-Nova architecture The B-Nova chassis has 6 module slots for interface and processing modules. The B-Nova architecture is future proof to support new module development later on by having all stream processing features in sub modules. Therefore, new functionality can be introduced later into the platform without touching the chassis. The stream processing in B-Nova is distributed to sub modules, which utilize virtually unlimited processing capacity in practical configurations, without problems typically caused with a central shared processor. All sub modules can process independently incoming and outgoing streams. The internal router of the chassis makes the interconnection between sub modules and the two payload gigabit Ethernet input and output ports. This means much less cabling at the headend and thereby simplifies headend configuration. The router also has a separate internal management network for sub modules and a chassis which guaranties reliable operation also in high-load situations. All internal connections are gigabit Ethernet which enables high-performance operation. Common management interfaces and power feeds for sub modules are also created in the chassis.

High-density design The new component technology and selected architecture for B-Nova creates a very high-density design, which saves a lot of rack space compared to traditional headend setups. B-Nova can have up to 12 receivers with descrambling capability in one chassis. If 6 quad receiver modules without descrambling are installed into the chassis, it increases the receiver count up to 24 in the chassis. Using quad ASI-modules means that one chassis can have up to 24 ASI inputs or ASI outputs. Installing six quad QAM modules means up to 24 QAM per chassis or up to 24 RF-out in COFDM. The B-Nova chassis can also have a mix of modules to adapt to the various application needs of the operator. Scalability In accordance with the B-Nova system architecture, the video processing is performed on sub modules, which enables lowcost applications even with a partially equipped chassis, while having the performance scalability to a fully equipped chassis. The B-Nova has virtually unlimited line speed capacity for stream processing in practical applications, which means that the B-Nova chassis doesn’t limit any practical configurations. The chassis has two gigabit Ethernet ports for payload traffic.

These ports can be used as inputs and output depending on the sub modules installed. Two Gb/s streaming ports will act as payload sharing or redundancy There is no limit for the maximum amount of services in the chassis, which makes it possible to process a high amount of services in the same chassis. Practical setup can be from several tens of services up to 100‌200 services in the same chassis. Using a multiple chassis in the headend scales setup can provide a virtually unlimited amount of services. Managing cooling B-Nova has managed horizontal ventilation, where internal temperature is actively monitored and fan speed is adjusted according to the required cooling capacity. Typically, fans rotate well below maximum speed, which increase their lifetime and generate less noise. The chassis cooling capacity is designed to support up to 100 W heat dissipation, but typical setup takes less power. The fans can be replaced during live operation without service interruption. The fans are located behind the front panel. Inputs and Outputs in Power module The Power and input/output module have two gigabit Ethernet SFP module slots for streaming payload traffic and IP inputs depending on the sub modules installed. The SFP module makes easy adaptation to electrical and fiber media to create interconnectivity from B-Nova to other devices. The module has two management interfaces (100Base-T). The first one is typically used for general management purposes, and the second interface is dedicated connection to Conditional Access Servers. The USB port can be used for first time setup using terminal software through serial connection profile. Redundancy To minimize service outage because of hardware failure, B-Nova supports 1+1 redundancy in the chassis level. To keep the B-Nova platform as cost effective as possible, all internal redundancy features are minimized. The pair of B-Nova can be configured to act in main and backup schemes, where secondary B-Nova monitors the main status. The secondary B-Nova configuration is automatically synchronized with the main B-Nova. The secondary B-Nova stays in stand-by mode until failure occurs in the main BNova. When the selected failure event trigs or the main unit is not responding, the main B-Nova shuts down all payload outputs based on dedicated hardware circuitry to ensure switch off of all streaming. The secondary B-Nova then takes over the stream processing operations. A virtual common IP address can be assigned to the pair of B-Novas to introduce them as one device to higher-level management software. Still, both devices can be accessed through their own IP address.

B-Nova 3.1a

B-Nova Chassis Embedded DVB Content Protection B-Nova has the capability to protect services with DVB scrambling. The chassis provides DVB Simulcrypt interface to Conditional Access systems, which allows integration with a large variety of CA vendors. The content protection has been designed to scale to a large number of scrambled streams with minimal system configuration. The actual scrambling is an integrated feature on the B-Nova sub modules, which provides scalable performance and maximum flexibility of the system configuration, supporting both centralized and decentralized scrambling solutions. Any service can be scrambled simultaneously with two CA systems. Other advanced features include short-key change intervals, automatic PSI/SI table generation, detailed monitoring of the interaction with CA system, support of redundant ECM generators and scheduled changes of the content protection properties. Management The B-Nova chassis has centralized management features for configuration and status monitoring of the sub modules and chassis. Management features are optimized for typical CATV or IPTV headend operations. There are many helpful features to make headend daily operation easy and effective. An Intuitive WEBUI is designed for easy management and monitoring for troubleshooting. It allows the user to establish setup quickly just by entering a few parameters, and then let B-Nova do the detailed configuration based on internal intelligence. There is still the possibility to also adjust the detailed configuration for professional users. Automatic service identification and PID remapping based on internal rules create unique values for all streams. Therefore, it is very easy to do the system-level configuration. CLI (Command Line Interface) is helpful to do configuration updates in patches and also makes it possible to manage B-Nova through low-speed communication links. Monitoring parameters and warning/alarm messages are available using SNMP protocol and traps. This allows integration to the element management system or higher-level management systems. The front panel has an indicator to get a quick overview status of B-Nova. When all indicators show green, then everything is running as expected. Also, all sub modules have status indicators for module operation and interface indicators for signal status. Indicator lamps are helpful to locate interface or a module that requires action.

Power Supply Unit PSU General description LPS-B is the power supply module for the B-Nova chassis. It is using the primary switch mode technology providing high efficiency and reliability. The module is short circuit and over temperature protected and includes the PFC (Power Factor Correction). It connects the Chassis with all external needed LAN/WAN topologies.

Backup-PSU/External Housing General description B-Nova uses external backup power for securing main power supply located in chassis. Backup Power is connected to DC IN connecter in main power supply LPS-B. Its internal switching circuit automatically takes power from external power supply, if main power supply fails. Physically backup power supply module can be installed either separate backup power supply chassis LCH-C or B-Nova main chassis LCH-A, if it has two free slots in top of each others.

B-Nova Receivers General description The BLANKOM Digital B-Nova receivers provide a very compact receiving platform for Cable TV and IPTV operators. The receivers enable flexible selection of free-to-air and scrambled services from DVB-S, DVB-S2, DVB-T or DVB-ASI sources, which can be adjusted to the operator’s service line-up with the builtin advanced transport stream processing capabilities. The BNova receivers support Standard Definition and High Definition video in MPEG-2 and MPEG-4 AVC video formats and numerous audio formats.

Modulators and Multiplexer General description The BLANKOM Digital B-Nova multiplexer (ASI, COFDM, QAM) provides a very compact headend platform for Cable TV operators. The multiplexer enables flexible multiplexing of SPTS and MPTS video services and also PSI/SI table streams. The multiplexer is ideal for an IP centric headend to create MPTS at the main headend and send them through to IP network to remote headends. The B-Nova multiplexer supports selection of free-to-air and scrambled services from IP stream sources, which can be adjusted to the operator’s service line-up with the built-in advanced transport stream processing capabilities. The B-Nova multiplexer supports Standard Definition and High Definition video in MPEG-2 and MPEG-4 AVC video formats and numerous audio formats. High-quality COFDM or QAM modulation with agile up conversion provides easy adaptation to DVB-T or DVB-C delivery over HFC-network.

Broadcast Manager General description The Broadcast Manager is a complete PSI/SI, Electronic Program Guide (EPG) and Bootload management server. It helps operators to manage all static and dynamic PSI/SI configurations and deliver EPG information, NIT and Set Top Box software updates. The Broadcast Manager eliminates routine monitoring and configuration work, raises the quality of the network output and makes sure that there will be no surprises with the services by automating the network configuration and updating processes. The Broadcast Manager consists of EPG, Network and Bootload modules, which are used for separate PSI/SI management tasks. All this modules can be used with a single management server.

The B-IRD series are devices for receiving and decoding of MPEG-2 transport streams with MPEG-2 or MPEG-4 compressed signals for SD or HD applications. Different types of input signals like DVB-S/S2, DVB-T/T2, DVB-C, IP streams or ASI are supported. The multi decryption function allows the decryption of multiple scrambled services within the transport stream. For reducing the data rate some types of B-IRDs have the ability to drop services. Standard outputs of the B-IRDs are ASI and IP interfaces for MPTS or SPTS streaming. B-IRDs with decoder are available with analog audio/video and SDI/HD-SDI outputs.

• Web/SNMP server • Redundant power supply General description DRD 694/695 is a twin DVB-S/S2-Receiver. The satellite input signals are demodulated, descrambled and are routed as transport streams to the ASI and Gig-Ethernet outputs. DRD 694/695 is receiving two digital MPEG-2 or MPEG-4 coded packets of services out of L-Band in DVB-S or DVB-S2 modulation and is generating two MPEG transport streams. The switching between the DVB-S and DVB-S2 mode could be done automatically. For the descrambling of scrambled transport streams two DVB-Common-Interfaces (DVB-CI) for Conditional Access Modules (CAM) is available for each stream. After demodulation and error-correction the MPEG transport streams are available at the two ASI outputs or at the Gig Ethernet interfaces for further processing. ASI test ports for each stream are available at the front plane. For redundancy reasons the device has two independent internal power supplies. In case of an operational failure or an interruption of the mains voltage, the current operating parameters are stored in a nonvolatile memory. After correcting the failure or switching on the device again, the module automatically operates with the last parameter configuration.

Allgemeines Der DRD 694/695 ist ein Twin-DVB-S/S2-Receiver. Die SATEingangssignale werden demoduliert, descrambled und stehen als ASI- und GbE Transportstrom am Ausgang zur Verfügung. DRD 694/695 empfängt zwei digitale nach MPEG-2- oder MPEG4-kodierte TV-Programmpakete aus dem L-Band in DVB-S oder DVB-S2-Modulation und erzeugt daraus zwei MPEG -Transportströme. Die Umschaltung zwischen den Betriebsarten DVB-S und DVB-S2 kann automatisch erfolgen. Für die Entschlüsselung von gescrambelten Transportströmen stehen jeweils zwei DVB-Common-Interface (DVB-CI) Schnittstellen für Conditional Access Module (CAM) zur Verfügung. Die MPEG-Transportströme können nach der Demodulation und Fehlerkorrektur extern an zwei elektrischen ASI-Ausgängen sowie an den GigEthernet-Schnittstellen zur Weiterverarbeitung genutzt werden. ASI-Messausgänge für die zwei Transportströme sind frontseitig zugänglich. Zur Erhöhung der Betriebssicherheit sind die Netzteile redundant ausgelegt. Für den Fall einer Betriebsstörung oder einer Unterbrechung der Netzversorgung ist die Konfiguration in einem nichtflüchtigen Speicher abgelegt. Nach dem Wiedereinschalten wird der Betrieb mit der letzten Einstellung automatisch fortgesetzt.

BISS description (DRD 695 only) DRD 695 support the following BISS modes: • 0: BISS is disabled. •

1: Transferred data is encrypted with a 12-bit code (key). The key needs to be entered in hex format. Due to a 16-bit input box the last 4 bits have to be set to zero.

E: Transferred data are are encrypted with a 16-bit code (key). The key needs to be entered in hex format. The selected code (key) will be decrypted with a 14-bit Injected-ID or with the Buried-ID.

Clear CW: Transferred data are encrypted with a unique and well known 16-bit code (key). The key needs to be entered in hex format.

MPEG-2/MPEG-4 SD/ HD signals can be processed. The input signals are demodulated and are available at the ASI output or can be streamed over IP (option). For descrambling DRD 696 has a twin DVB-CI slot which enables appropriate CAM modules to decrypt the complete transport stream. Optionally different frontends are for receiving the transport stream. DRD 696 has additionally an ASI input. With the DVB-S/DVB-S2 frontend the DRD 696 is able to receive multiplexed transport streams according to EN 302307 Annex H.2. The demultiplexed transport streams are available at the ASI outputs. The device is operated locally, either via a LCD display and an additional wheel or with the implemented web server via a web browser. A SNMP agent with the corresponding MIB is built in for the integration in a network management system. Details ASI interface There are 2 equivalent ASI outputs on the back side of the device. There is 1 ASI test output on the device front panel. If a fault occurs, the ASI operating outputs can be switched off. The test output cannot be switched off. Depending upon the (software) configuration and option, the originally received TS or the TS with one or more descrambled services can be maintained on the ASI outputs. As a standard, an ASI input is provided at the back side of the device. If a optional frontend is implemented, it is possible to switch over between the ASI and Frontend input. MPEG-4 video decoder The decoder supports MPEG-4 part10 (AVC, H.264) as well as MPEG-2 decoding. During an anamorphous 16:9 video transmission, the decoder generates a Letterbox video format from this signal. Moreover, the decoder can generate a SDTV signal (720x576) in the Letterbox format from the HDTV signal

(1920x1080i, 1280x720p) by “downscaling”. This decoder also supports DVB subtitling. The output signal is the analogue CVBS signal. DRP 393 supports extensive VBI functionalities: The teletext lines, the data lines and the WSS signal as well as the test lines are inserted in the analogue output signal. All the 13 data bytes are transferred to the VPS data line (line 16). The audio status is generated according to the selected audio output format (basis: Audio output 1). The CNI code can be manually entered if it is not available within the TS (Transport stream). The test lines 17, 18, 330, 331 and 329 are generated within the device. Thus, the audio track for blind persons (e.g. ZDF) and the dual tone can be generated from two stereo PIDs (e.g. Arte). The level of every audio output can be set individually. Dolby Digital is decoded and given out as a stereo signal. Optionally, 4 additional audio output channels can be activated. Note: Dolby Digital (AC3) and MPEG audio signals cannot be decoded simultaneously!

Details and Technical Data for DRP 393 Digital audio output SPDIF The PID selected for audio decoder 1 can also be given out via the digital SPDIF output. If a Dolby Digital signal (AC3) is selected, the AC3 signal (which is not decoded) can also be given out (“pass thru”). Wide-range power supply unit: DRP 393 has a wide-range power supply unit. The input voltage range is 100 VAC – 240 VAC. In the event of an operational disturbance or a fault in the mains supply the configuration is stored in a non-volatile memory. Upon restart the operation automatically continues from the last setting.

For test purpose, 1 kHz test signal, nominal level +6 dBm can be enabled. The test signal is available on all audio outputs. The DRP393 is licensed by Dolby Labs for Decoding of Dolby Digital and Dolby Digital Plus.

The B-Edge series are compact devices for the transmodulation of digital TV and Radio signals to HFC networks. The digital TV and Radio signals are transmitted as MPEG2 transport streams encapsulated in IP data packets over IP networks. Each device is able to transmodulate several services to RF within one unit. This makes the application very compact and power efficient especially by the direct digital modulation and conversion of the output frequency. For the different applications there are three different types of edge devices available:

General description The EQM 100 Edge QAM Modulator supports to generate up to 24 QAM channels to add DVB-C services into distribution networks in Headends or near the edge of the subscribers. Every single QAM channel can be enabled or switched off to allow installations with overlapping channels. The MPEG transport streams (TS) must be supplied over IP-networks as unicast or multicast data packets encapsulated in UDP format. The payload of the UDP packets should be compliant to the DVB MPEG-2 transport stream packets. These packets are transferred to the input of the QAM modulator and to the direct digital frequency conversion (DDS). The Output is a RF-Signal in the selected frequency range between 47 to 862 MHz that can directly feed a local CATV network or HFC cluster supporting 16 QAM … 256 QAM channels. Conversions of the MPEG transport stream like PCR re-stamping and „insertion of zero-packet” are supported. The modulator can be configured and operated via a web browser on a local PC or Laptop and can be integrated into a network management system (NMS). The implemented SNMP agent allows the integration in a network management (NMS). An EPM 130 MIB with all parameter definitions is part of delivery. In case of an IP input failure the EPM 130 can switch over automatically to the optional redundant backup IP input source. The trigger for switching can be either link-loss or sync-loss. The dual redundant power supply ensures high operational reliability. General description The IP Edge PAL EPM 130 can receive DVB transport streams with MPEG-2 compressed TV services over IP networks and is able to transmodulate these services directly to analogue RF video channels. The IP input with GbE-SFP interface receives uni- or multicast IP streams over LAN/WAN networks. For redundancy two GbE-SFP input interfaces are implemented. Furthermore 4 ASI input interfaces allows the user to use other transport stream sources. All services of the transport streams are listed and the user has to select the services for further processing. The selected services are decoded then modulated and up converted to analog PAL RF signal. Direct digital signal processing for modulation and up conversion ensures a high signal quality. For efficiency 4 PAL channels are up converted at the same time and therefore adjacent in frequency range. Up to 16 channels can be processed in one EPM 130. The amount of PAL channels is scalable in steps of 4. The output frequency range is selectable in the range from 47 up to 862 MHz.

General description The active splitter distributes the electrical input data stream (DVB/ASI) to 8 electrically equivalent outputs. One ASI test port is located on the front panel. Six LEDs indicate the operating conditions. At the module’s back there are the electrical input and output ports. DTS 397 has a redundant ASI input. In case of an error of the standard ASI input the internal ASI input control will switch to the redundant ASI input automatically. According to DVB the input data stream can be composed bytewise and/or packet-wise. However, the MPEG-2 data in the ASI signal stream is made available at the outputs as packets. Signal processing in the ASI interface is done according to DVB, Asynchronus Serial Interface (ASI). Only MPEG data meeting the MPEG-2 standard ISO/IEC 13818-1 is transmitted. The Modular Headend System MHS meets the advanced requirements of large and medium-size cable TV networks. All decoding and modulation methods of the DVB standards, together with intelligent signal processing and analog signal processing allow for a universal use of the MHS in cable TV networks. MHS is professional headend technology with highest performance. MHS allows a flexible and modular system design. With its central management system for all components it is possible to configure and control the MHS either via keypad and LCD-display (for basic configuration) or remote controlled with GUI via LAN/WAN. General description In touch with a PC and the graphics user interface (GUI) DCPM 845 a convenient configuration of all system parameters is easy possible. Configuration and monitoring of the MHS is done with help of a standard PC and Windows 2000/XP. Data traffic between PC and Control module occurs via RS-232 interface respectively Ethernet. Easy access to the 9-pin-Sub-D connector at the front panel. The Ethernet interface is located at the rear of the rack PGE 820. Control and monitoring of settings and parameters does not affect any system operation. The software for configuration, controlling, analyzing and monitoring is arranged with a clearly graphical oriented user interface. Allgemeines In Verbindung mit einem PC und der graphischen Benutzeroberfläche (GUI) DCPM 845 ist eine komfortable Systemkonfiguration aller Parameter möglich. PRD 1080 DVB-S/DVB-S2 Receiver General description The PRD 1080 is the DVB-S/DVB-S2 demodulator of the MHS. The PRD 1080 contains two independent DVB/DVB-S2 demodulators with ASI transmitters. The power supply and the controller part is common for both demodulator branches. The DVB/DVB-S2 demodulator is operational only together with other components of the MHS-system family like power supply PEN, management system PSD, module carrier PGE, etc. The PRD 1080 receives two digital MPEG-2 or MPEG-4 encoded TV-signals with DVB-S2-modulation from L-Band and generates two MPEG independent transport streams. The MPEG transport streams are available after demodulation and error correction at two electrical ASI outputs. Test outputs for the two ASI transport streams are located at the front panel. The switching between DVB-S and DVB-S2 mode can be done automatically. All inputs and outputs are located at the back plane connector as coaxial connectors. General description The Managementsystem PSD 840 is used for the configuration and control of the MHS modules. All settings can be done either with the front panel of the PSD840 or more convenient over the RS232 interface or an ethernet LAN connection with a graphical user interface (GUI) running on an external PC or laptop. All settings of the modules are stored in the management system. If a module is replaced all the configuration data are set automatically (hot-swap capability). The modules will be controlled over an internal RS485 bus system. The mechanic of the management system is 4 units high with double module width. PSD840 is only working together with other products of the MHS family, e.g. power supply PEN830, rack PGE820. Allgemeines Das Management-System PSD 840 ist zuständig für die Konfiguration und Überwachung der MHSModule, sowie zur Verteilung der über ISDN oder Ethernet zugeführten Daten. Über die serielle Schnittstelle (RS 232) kann das System und die einzelnen Komponenten mit Hilfe eines externen PCs konfiguriert werden. Die MHS-Signal-Processing-Module werden über ein internes RS-485 Bussystem gesteuert. Mechanisch ist das Management-System PSD 840 in einem 4 HE/2 MB-Modulgehäuse untergebracht. II. Preise und Zahlungsbedingungen 1. Die Preise verstehen sich ab Werk ausschließlich Verpackung zuzüglich der jeweils geltenden gesetzlichen Umsatzsteuer. 2. Zahlungen sind frei Zahlstelle des Lieferers zu leisten. 3. Der Besteller kann nur mit solchen Forderungen aufrechnen, die unbestritten oder rechtskräftig festgestellt sind. III. Eigentumsvorbehalt 1. Die Gegenstände der Lieferungen (Vorbehaltsware) bleiben Eigentum des Lieferers bis zur Erfüllung sämtlicher ihm gegen den Besteller aus der Geschäftsverbindung zustehenden Ansprüche. Soweit der Wert aller Sicherungsrechte, die dem Lieferer zustehen, die Höhe aller gesicherten Ansprüche um mehr als 20 % übersteigt, wird der Lieferer auf Wunsch des Bestellers einen entsprechenden Teil der Sicherungsrechte freigeben. 2. Während des Bestehens des Eigentumsvorbehalts ist dem Besteller eine Verpfändung oder Sicherungsübereignung untersagt und die Weiterveräußerung nur Wiederverkäufern im gewöhnlichen Geschäftsgang und nur unter der Bedingung gestattet, daß der Wiederverkäufer von seinem Kunden Bezahlung erhält oder den Vorbehalt macht, daß das Eigentum auf den Kunden erst übergeht, wenn dieser seine Zahlungsverpflichtungen erfüllt hat. 3. Bei Pfändungen, Beschlagnahmen oder sonstigen Verfügungen oder Eingriffen Dritter hat der Besteller den Lieferer unverzüglich zu benachrichtigen. 4. Bei Pflichtverletzungen des Bestellers, insbesondere bei Zahlungsverzug, ist der Lieferer nach erfolglosem Ablauf einer dem Besteller gesetzten angemessenen Frist zur Leistung zum Rücktritt und zur Rücknahme berechtigt; die gesetzlichen Bestimmungen über die Entbehrlichkeit einer Fristsetzung bleiben unberührt. Der Besteller ist zur Herausgabe verpflichtet. IV. Fristen für Lieferungen; Verzug 1. Liefertermine sind für die Fa. BLANKOM Digital GmbH unverbindlich, es sei denn, sie sind schriftlich bzw. vertraglich vereinbart und bestätigt worden. Die Einhaltung von Fristen für Lieferungen setzt den rechtzeitigen Eingang sämtlicher vom Besteller zu liefernden Unterlagen, erforderlichen Genehmigungen und Freigaben, insbesondere von Plänen, sowie die Einhaltung der vereinbarten Zahlungsbedingungen und sonstigen Verpflichtungen durch den Besteller voraus. Werden diese Voraussetzungen nicht rechtzeitig erfüllt, so verlängern sich die Fristen angemessen; dies gilt nicht, wenn der Lieferer die Verzögerung zu vertreten hat. 2. Ist die Nichteinhaltung der Fristen auf höhere Gewalt, z. B. Mobilmachung, Krieg, Aufruhr, oder auf ähnliche Ereignisse, z. B. Streik, Aussperrung, zurückzuführen, verlängern sich die Fristen angemessen. 3. Kommt der Lieferer in Verzug, kann der Besteller - sofern er glaubhaft macht, daß ihm hieraus ein Schaden entstanden ist - eine Entschädigung für jede vollendete Woche des Verzuges von je 0,5 %, insgesamt jedoch höchstens 5 % des Preises für den Teil der Lieferungen verlangen, der wegen des Verzuges nicht in zweckdienlichen Betrieb genommen werden konnte. 4. Sowohl Schadensersatzansprüche des Bestellers wegen Verzögerung der Lieferung als auch Schadensersatzansprüche statt der Leistung, die über die in Nr. 3 genannten Grenzen hinausgehen, sind in allen Fällen verzögerter Lieferung, auch nach Ablauf einer dem Lieferer etwa gesetzten Frist zur Lieferung, ausgeschlossen. Dies gilt nicht, soweit in Fällen des Vorsatzes, der groben Fahrlässigkeit oder wegen der Verletzung des Lebens, des Körpers oder der Gesundheit zwingend gehaftet wird. Vom Vertrag kann der Besteller im Rahmen der gesetzlichen Bestimmungen nur zurücktreten, soweit die Verzögerung der Lieferung vom Lieferer zu vertreten ist. Eine Änderung der Beweislast zum Nachteil des Bestellers ist mit den vorstehenden Regelungen nicht verbunden. 5. Der Besteller ist verpflichtet, auf Verlangen des Lieferers innerhalb einer angemessenen Frist zu erklären, ob er wegen der Verzögerung der Lieferung vom Vertrag zurücktritt oder auf der Lieferung besteht. 6. Werden Versand oder Zustellung auf Wunsch des Bestellers um mehr als einen Monat nach Anzeige der Versandbereitschaft verzögert, kann dem Besteller für jeden angefangenen Monat Lagergeld in Höhe von 0,5 % des Preises der Gegenstände der Lieferungen, höchstens jedoch insgesamt 5 %, berechnet werden. Der Nachweis höherer oder niedrigerer Lagerkosten bleibt den Vertragsparteien unbenommen. V. Gefahrübergang 1. Die Gefahr geht auch bei frachtfreier Lieferung wie folgt auf den Besteller über: Bei Lieferungen, wenn sie zum Versand gebracht oder abgeholt worden sind. Auf Wunsch und Kosten des Bestellers werden Lieferungen vom Lieferer gegen die üblichen Transportrisiken versichert. 2. Wenn der Versand, die Zustellung, der Beginn, die Durchführung der Aufstellung oder Montage, die Übernahme in eigenen Betrieb oder der Probebetrieb aus vom Besteller zu vertretenden Gründen verzögert wird oder der Besteller aus sonstigen Gründen in Annahmeverzug kommt, so geht die Gefahr auf den Besteller über. VI. Entgegennahme Der Besteller darf die Entgegennahme von Lieferungen wegen unerheblicher Mängel nicht verweigern. Die Rücklieferung von Waren ist nur in Abstimmung und mit Einverständnis des Lieferers möglich. Anfallende Kosten werden nicht erstattet. Haben wir einer Rücksendung zugestimmt, erfolgt eine Gutschrift nur unter Abzug einer Bearbeitungsgebühr. VII. Sachmängel Für Sachmängel haftet der Lieferer wie folgt: 1. Alle diejenigen Teile oder Leistungen sind nach Wahl des Lieferers unentgeltlich nachzubessern, neu zu liefern oder neu zu erbringen, die innerhalb der Verjährungsfrist - ohne Rücksicht auf die Betriebsdauer - einen Sachmangel aufweisen, sofern dessen Ursache bereits im Zeitpunkt des Gefahrübergangs vorlag. 2. Sachmängelansprüche verjähren in 12 Monaten. Dies gilt nicht, soweit das Gesetz gemäß §§ 438 Abs. 1 Nr. 2 (Bauwerke und Sachen für Bauwerke), 479 Abs. 1 (Rückgriffsanspruch) und 634a Abs. 1 Nr. 2 (Baumängel) BGB längere Fristen vorschreibt sowie in Fällen der Verletzung des Lebens, des Körpers oder der Gesundheit, bei einer vorsätzlichen oder grob fahrlässigen Pflichtverletzung des Lieferers und bei arglistigem Verschweigen eines Mangels. Die gesetzlichen Regelungen über Ablaufhemmung, Hemmung und Neubeginn der Fristen bleiben unberührt. 3. Der Besteller hat Sachmängel gegenüber dem Lieferer unverzüglich schriftlich zu rügen. 4. Bei Mängelrügen dürfen Zahlungen des Bestellers in einem Umfang zurückgehalten werden, die in einem angemessenen Verhältnis zu den aufgetretenen Sachmängeln stehen. Der Besteller kann Zahlungen nur zurückhalten, wenn eine Mängelrüge geltend gemacht wird, über deren Berechtigung kein Zweifel bestehen kann. Erfolgte die Mängelrüge zu Unrecht, ist der Lieferer berechtigt, die ihm entstandenen Aufwendungen vom Besteller ersetzt zu verlangen. 5. Zunächst ist dem Lieferer Gelegenheit zur Nacherfüllung innerhalb angemessener Frist zu gewähren. 6. Schlägt die Nacherfüllung fehl, kann der Besteller - unbeschadet etwaiger Scha-

densersatzansprüche gemäß Art. X - vom Vertrag zurücktreten oder die Vergütung mindern. 7. Mängelansprüche bestehen nicht bei nur unerheblicher Abweichung von der vereinbarten Beschaffenheit, bei nur unerheblicher Beeinträchtigung der Brauchbarkeit, bei natürlicher Abnutzung oder Schäden, die nach dem Gefahrübergang infolge fehlerhafter oder nachlässiger Behandlung, übermäßiger Beanspruchung, ungeeigneter Betriebsmittel, mangelhafter Bauarbeiten oder die aufgrund besonderer äußerer Einflüsse entstehen, die nach dem Vertrag nicht vorausgesetzt sind, sowie bei nicht reproduzierbaren Softwarefehlern. Werden vom Besteller oder von Dritten unsachgemäß Änderungen oder Instandsetzungsarbeiten vorgenommen, so bestehen für diese und die daraus entstehenden Folgen ebenfalls keine Mängelansprüche. 8. Ansprüche des Bestellers wegen der zum Zweck der Nacherfüllung erforderlichen Aufwendungen, insbesondere Transport-, Wege-, Arbeits- und Material- kosten, sind ausgeschlossen, soweit die Aufwendungen sich erhöhen, weil der Gegenstand der Lieferung nachträglich an einen anderen Ort als die Niederlassung des Bestellers verbracht worden ist, es sei denn, die Verbringung entspricht seinem bestimmungsgemäßen Gebrauch. 9. Rückgriffsansprüche des Bestellers gegen den Lieferer gemäß § 478 BGB (Rückgriff des Unternehmers) bestehen nur insoweit, als der Besteller mit seinem Abnehmer keine über die gesetzlichen Mängelansprüche hinausgehenden Vereinbarungen getroffen hat. Für den Umfang des Rückgriffsanspruchs des Bestellers gegen den Lieferer gemäß § 478 Abs. 2 BGB gilt ferner Nr. 8 entsprechend. 10. Für Schadensersatzansprüche gilt im Übrigen Art. X (Sonstige Schadensersatzansprüche). Weitergehende oder andere als die in diesem Art. VII geregelten Ansprüche des Bestellers gegen den Lieferer und dessen Erfüllungsgehilfen wegen eines Sachmangels sind ausgeschlossen. 11. Produktbezogene Software gilt nur als sachmängelbehaftet, wenn die zum Zeitpunkt des Verkaufs zugesicherten Funktionen der Liefergegenstände beeinträchtigt sind und der Sachmangel in der Software und nicht in fehlerhaften äußeren Bedingungen begründet ist. Softwareanpassungen im Kundeninteresse oder durch veränderte technische oder inhaltliche Rahmenbedingungen stellen keine Gewährleistungsfälle dar und sind kostenpflichtig.

General

I. Allgemeine Bestimmungen 1. Für den Umfang der Lieferungen oder Leistungen (im Folgenden: Lieferungen) sind die beiderseitigen schriftlichen Erklärungen maßgebend. Allgemeine Geschäftsbedingungen des Bestellers gelten jedoch nur insoweit. als der Lieferer oder Leistende (im Folgenden: Lieferer) ihnen ausdrücklich schriftlich zugestimmt hat. 2. An Kostenvoranschlägen, Zeichnungen und anderen Unterlagen (im Folgenden: Unterlagen) behält sich der Lieferer seine eigentums- und urheberrechtlichen Verwertungsrechte uneingeschränkt vor. Die Unterlagen dürfen nur nach vorheriger Zustimmung des Lieferers Dritten zugänglich gemacht werden und sind, wenn der Auftrag dem Lieferer nicht erteilt wird, diesem auf Verlangen unverzüglich zurückzugeben. Die Sätze 1 und 2 gelten entsprechend für Unterlagen des Bestellers; diese dürfen jedoch solchen Dritten zugänglich gemacht werden, denen der Lieferer zulässigerweise Lieferungen übertragen hat. 3. Teillieferungen sind zulässig, soweit sie dem Besteller zumutbar sind. 4. Der Lieferer behält sich die Einholung von Liquiditäts- und Bonitätsauskünften des Bestellers vor.

VIII. Gewerbliche Schutzrechte und Urheberrechte; Rechtsmängel 1. Sofern nicht anders vereinbart, ist der Lieferer verpflichtet, die Lieferung lediglich im Land des Lieferorts frei von gewerblichen Schutzrechten und Urheber- rechten Dritter (im Folgenden: Schutzrechte) zu erbringen. Sofern ein Dritter wegen der Verletzung von Schutz rechten durch vom Lieferer erbrachte, vertragsgemäß genutzte Lieferungen gegen den Besteller berechtigte Ansprüche erhebt, haftet der Lieferer gegenüber dem Besteller innerhalb der in Art. VII Nr. 2 bestimmten Frist wie folgt: a) Der Lieferer wird nach seiner Wahl und auf seine Kosten für die betreffenden Lieferungen entweder ein Nutzungsrecht erwirken, sie so ändern, daß das Schutzrecht nicht verletzt wird, oder austauschen. Ist dies dem Lieferer nicht zu angemessenen Bedingungen möglich, stehen dem Besteller die es gesetzlichen Rücktritts- oder Minderungsrechte zu. b) Die Pflicht des Lieferers zur Leistung von Schadensersatz richtet sich nach Art. X. c) Die vorstehend genannten Verpflichtungen des Lieferers bestehen nur, so- weit der Besteller den Lieferer über die vom Dritten geltend gemachten Ansprüche unverzüglich schriftlich verständigt, eine Verletzung nicht anerkennt und dem Lieferer alle Abwehrmaßnahmen und Vergleichsverhandlungen vorbehalten bleiben. Stellt der Besteller die Nutzung der Lieferung 1- aus Schadensminderungs- oder sonstigen wichtigen Gründen ein, ist er verpflichtet, den Dritten darauf hinzuweisen, daß mit der Nutzungseinstellung kein Anerkenntnis einer Schutzrechtsverletzung verbunden ist. 2. Ansprüche des Bestellers sind ausgeschlossen, soweit er die Schutzrechtsverletzung zu vertreten hat. 3. Ansprüche des Bestellers sind ferner ausgeschlossen, soweit die Schutzrechtsverletzung durch spezielle Vorgaben des Bestellers, durch eine vom Lieferer nicht voraussehbare Anwendung oder dadurch verursacht wird, daß die Lieferung vom Besteller verändert oder zusammen mit nicht vom Lieferer gelieferten Produkten eingesetzt wird. 4. Im Falle von Schutzrechtsverletzungen gelten für die in Nr. 1 a) geregelten Ansprüche des Bestellers im Übrigen die Bestimmungen des Art. VII Nr. 4, 5 und 9 entsprechend. 5. Bei Vorliegen sonstiger Rechtsmängel gelten die Bestimmungen des Art. VII entsprechend. 6. Weitergehende oder andere als die in diesem Art. VIII geregelten Ansprüche des Bestellers gegen den Lieferer und dessen Erfüllungsgehilfen wegen eines Rechtsmangels sind ausgeschlossen. IX. Unmöglichkeit; Vertragsanpassung 1. Soweit die Lieferung unmöglich ist, ist der Besteller berechtigt, Schadensersatz zu verlangen, es sei denn, daß der Lieferer die Unmöglichkeit nicht zu vertreten hat. Jedoch beschränkt sich der Schadensersatzanspruch des Bestellers auf 10% des Wertes desjenigen Teils der Lieferung, der wegen der In Unmöglichkeit nicht in zweckdienlichen Betrieb genommen werden kann. Diese Beschränkung gilt nicht, soweit in Fällen des Vorsatzes, der groben Fahrlässigkeit oder wegen der Verletzung des Lebens, des Körpers oder der Gesundheit zwingend gehaftet wird; eine Änderung der Beweislast zum Nachteil des Bestellers ist hiermit nicht verbunden. Das Recht des Bestellers zum Rücktritt vom Vertrag bleibt unberührt. 2. Sofern unvorhersehbare Ereignisse im Sinne von Art. IV Nr. 2 die wirtschaftliche Bedeutung oder den Inhalt der Lieferung erheblich verändern oder auf den Betrieb des Lieferers erheblich einwirken, wird der Vertrag unter Beachtung von Treu und Glauben angemessen angepaßt. Soweit dies wirtschaftlich nicht vertretbar ist, steht dem Lieferer das Recht zu, vom Vertrag zurückzutreten. Will er von diesem Rücktrittsrecht Gebrauch machen, so hat er dies nach Erkenntnis der Tragweite des Ereignisses unverzüglich dem Besteller mitzuteilen und zwar auch dann, wenn zunächst mit dem Besteller eine Verlängerung der Lieferzeit vereinbart war. X. Sonstige Schadensersatzansprüche 1. Schadens- und Aufwendungsersatzansprüche des Bestellers (im Folgenden: Schadensersatzansprüche), gleich aus welchem Rechtsgrund, insbesondere wegen Verletzung von Pflichten aus dem Schuldverhältnis und aus unerlaubter Handlung, sind ausgeschlossen. 2. Dies gilt nicht, soweit zwingend gehaftet wird, z. B. nach dem Produkthaftungsgesetz, in Fällen des Vorsatzes, der groben Fahrlässigkeit, wegen der Verletzung des Lebens, des Körpers oder der Gesundheit, wegen der Verletzung wesentlicher Vertragspflichten. Der Schadensersatzanspruch für die Verletzung wesentlicher Vertragspflichten ist jedoch auf den vertragstypischen, vorhersehbaren Schaden begrenzt, soweit nicht Vorsatz oder grobe Fahrlässigkeit vorliegt oder wegen der Verletzung des Lebens, des Körpers oder der Gesundheit gehaftet wird. Eine Änderung der Beweislast zum Nachteil des Bestellers ist mit den vorstehenden Regelungen nicht verbunden. 3. Soweit dem Besteller nach diesem Art. XI Schadensersatzansprüche zustehen verjähren diese mit Ablauf der für Sachmängelansprüche geltenden Verjährungsfrist gemäß Art. VII Nr. 2. Bei Schadensersatzansprüchen nach dem Produkthaftungsgesetz gelten die gesetzlichen Verjährungsvorschriften. XI. Altgeräteentsorgung Die Eintragung der Firma BLANKOM Digital erfolgt unter der WEEE Registriernummer DE 48236252. XII. Gerichtsstand und anwendbares Recht 1. Alleiniger Gerichtsstand ist, wenn der Besteller Kaufmann ist, bei allen aus dem Vertragsverhältnis unmittelbar oder mittelbar sich ergebenden Streitigkeiten der Sitz des Lieferers. Der Lieferer ist jedoch auch berechtigt, am Sitz des Bestellers zu klagen. 2. Für die Rechtsbeziehungen im Zusammenhang mit diesem Vertrag gilt deutsches materielles Recht unter Ausschluß des Übereinkommens der Vereinten Nationen über Verträge über den internationalen Warenkauf (CISG). XIII. Verbindlichkeit des Vertrages Der Vertrag bleibt auch bei rechtlicher Unwirksamkeit einzelner Bestimmungen in seinen übrigen Teilen verbindlich. Das gilt nicht, wenn das Festhalten an dem Vertrag eine unzumutbare Härte für eine Partei darstellen würde. Bad Salzdetfurth, den 23.08.2010
