t’s that time of year when we are either winding down or we have too much still to do to even contemplate the festive season. Wherever you fall, I’m sure you will agree that 2014 has been another good year for our industry, with many of our Members reporting heavy demand for our services. In return, ARCA’s services to support our membership have increased accordingly. Looking forward to 2015, we will implement the “ARCA Strategy for the Future”. This will deliver a clear vision to our members and beyond, how ARCA supports and represents our Members. As 2014 comes to a close, the opportunities for 2015 are quickly coming over the horizon. During the Health and Safety Executive (HSE) Leadership and Management seminars delivered during 2013/2014, the HSE identified that good leadership and management was the key to running a successful asbestos removal company. In order to support, promote, encourage and recognise good leadership and management within the asbestos removal industry, ARCA joined forces with the National Federation of Demolition Contractors (NFDC) and the Asbestos Control and Abatement Division (ACAD) to form the Asbestos Removal Management Institute (ARMI). Possessing a recognised leadership and management qualification is one of the membership requirements for those wishing to join the institute, ARCA are now able to provide a qualification for those wishing to join the institute who have not yet achieved a recognised leadership and management qualification. As you should all be aware by now, the Approved Code of Practice (ACoP), which supports the Control of Asbestos Regulations 2012, places a greater emphasis on Training Needs Analysis (TNA) based refresher training. The ARCA Training Committee has spent considerable time deciding on how ARCA training will be delivered in future to meet the refresher training needs of asbestos removal contractors. Those who attended the recent regional meetings will have heard Satish Patel explain How ARCA intend to deliver Training Needs Analysis based training. In the short term ARCA will be offering two types of refresher training for operatives and supervisors, ‘TNA based refreshers’ and ‘Industry refreshers’. The ‘TNA based refresher’ training will be delivered to delegates who have provided ARCA with a ‘TNA’ identifying the specific training the delegate requires. The ‘Industry refresher’ training will be delivered to those delegates who do not provide ARCA with a TNA and will based on an ‘Industry’ TNA, i.e. refresher training delivery based on industry needs as observed during ARCA audits and assessments. The ARCA Annual General Meeting (AGM) was held on the 3rd October 2014 at the London Zoo Conference Centre. During the meeting members were advised on the progress the association had made over the 12 months since the last AGM and informed of the future plans that ARCA had. Central to the future plans were the corporate strategy that ARCA were putting in place around a Mission and Vision, in order to focus all aspects of the association on the key areas identified in the Mission whilst striving to achieve the Vision.

All attending had a very enjoyable evening in a great setting, it really served to set everyone up for the Christmas season and festivities. Health and Safety Executive launches new safety campaign as an average of 20 tradespeople die every week from asbestos related diseases
1.3 million tradespeople at risk from dangers of asbestos T
radespeople, including construction workers, carpenters and painters and decorators, could come into contact with deadly asbestos on average more than 100 times a year according to a new survey commissioned by the Health and Safety Executive (HSE). As well as illustrating how often tradespeople can be exposed to asbestos, the survey revealed some common myths believed by those at risk, with 1 in seven (14 per cent) believing that drinking a glass of water will help protect them from the deadly dust and one in four (27 per cent) thinking that opening a window will help to keep them safe. Only a third (30 per cent) of those asked, were able to identify all the correct measures for safe asbestos working, whilst more than half (57 per cent) made at least one potentially lethal mistake in trying to identify how to stay safe. Twenty tradespeople, on average, die every week from asbestos related diseases. Asbestos can be found in walls and ceilings, or the structure of a building, as well as a host of other places like floor tiles, boilers, toilet cisterns, guttering and soffits. It can be disturbed by basic maintenance work like drilling holes and sanding and once disturbed, the microscopic fibres can prove lethal if breathed in, causing lung disease and cancer. The research, undertaken by Censuswide in September 2014, shows that while more than half (53 per cent) knew that asbestos could be in old buildings built before 1970, only 15 per cent knew that it could still be found in buildings built up to the year 2000. And although many of those surveyed could

pinpoint some asbestos-containing materials, others were clueless, with only 19 per cent recognising it could also be hidden in common fixtures such as toilet seats and cisterns. To encourage tradespeople to think about asbestos on every job so they are prepared to deal with the danger, HSE has launched a new safety campaign. Mark Harper, Minister responsible for Health and Safety, launched the campaign at the TradePoint store in Cricklewood. TradePoint is supporting the campaign by distributing asbestos safety kits to tradespeople through their stores across Great Britain. A key feature of the campaign is the creation of a new web app for phones, tablets and laptops that helps tradespeople easily identify where they could come into contact with the deadly material as they go about their day-today work and gives them tailored help on how to deal with the risks. Mark Harper, Minister responsible for Health and Safety, said: “The number dying every year from asbestos related-diseases is unacceptably high. Despite being banned in the construction industry, asbestos exposure remains a very serious risk to tradespeople. This safety campaign is about highlighting the risks and easy measures people can take to protect themselves. We hope the safety kits and the web app will encourage people to be aware of the risks, think twice, and
take precautions to stay safe.” Philip White, HSE’s Chief Inspector for Construction, said: “Asbestos is still a very real danger and the survey findings suggest that the people who come into contact with it regularly often don’t know where it could be and worryingly don’t know how to deal with it correctly, which could put them in harm’s way. Our new campaign aims to help tradespeople understand some of the simple steps they can take to stay safe. Our new web app is designed for use on a job so workers can easily identify if they are likely to face danger and can then get straight forward advice to help them do the job safely.” Former electrical consultant Simon Clark, who in 2012 was diagnosed with mesothelioma – the life-threatening and aggressive cancer caused by exposure to asbestos – when he was just 52, said: “When I was younger I didn’t think of the dangers of asbestos and I must have been exposed to it frequently. Since being diagnosed, I’ve had to give up my work and let some of my employees go – which is the hardest thing I’ve ever done. It is vitally important that everybody knows when they might be exposed and takes the correct steps to protect themselves.”

Contractor fined for potential asbestos risk A
County Durham contractor has been sentenced after illegally removing asbestos from a garage, putting himself, other workers and the householder at risk of exposure. John Simpson, trading as Dun N Dusted and offering waste removal services, was paid £900 by a householder to remove asbestos from a garage under his house in Jesmond, Newcastle. He had told the owner he was licensed to remove the dangerous material despite not being so. On 25 April 2013, Mr Simpson arrived at the property with two other men. Working alone inside the garage and wearing paper overalls and a face mask, Mr Simpson spent most of the afternoon taking down the asbestos insulating board ceiling using a hammer and chisel. The other men then helped to bag the asbestos debris and loaded some 20 bags into Mr Simpson’s van, parked outside the house.
A neighbour, who was concerned about the way the work was carried out, contacted the Health and Safety Executive (HSE). Inspectors stopped Mr Simpson undertaking any similar work by serving a Prohibition Notice and investigated the incident. Newcastle Magistrates’ Court heard today (27 Nov) that HSE found that Mr Simpson was neither qualified or licensed to remove asbestos. Mr Simpson failed to take suitable measures to prevent the spread of potentially deadly asbestos fibres – the debris had been simply cleared up using a brush and a domestic vacuum cleaner before being bagged and loaded into the van. The court was told the nature of the work meant that it should have been notified to HSE and that Mr Simpson had not carried out any risk assessment nor identified the type of asbestos contained in the garage. He had not prepared

Barnet building business turns ‘blind eye’
A
Barnet building firm has been fined after it ‘turned a blind eye’ to potential asbestos hazards being faced by its workers, who were converting an old pub in Victoria Road into flats. Westminster Magistrates were told (8 Oct) that concerns about health and safety on the site were raised by local people, who were also worried about the risks to passers-by. An Inspector from the Health and Safety Executive (HSE) visited on 4 March 2013 to check conditions, and enforcement action regarding unsafe work at height and inadequate fire precautions was taken against MP Builders Ltd that day. The firm was also asked to provide information about how they were managing the asbestos risks on site, but HSE heard nothing from them. As a result, HSE visited again on 22 March and served an improvement notice on the company, giving them four weeks to provide the workers with the training they needed to enable them to identify materials that might contain asbestos if found during their refurbishment works, and to know how to deal with it correctly. The deadline was later extended by a week.

MP Builders failed to comply and, despite assurances to the contrary, its failure to comply persisted, remaining in breach of the notice right up to the date of the prosecution. MP Builders Ltd of Games Road, Barnet, Herts, was fined £2,000 and ordered to pay £4,500 in costs for breaching the Health and Safety at Work etc Act 1974. After the hearing, HSE Inspector Stephron Baker Holmes said: “The improvement notice was straightforward. It was simple and inexpensive to comply with, by providing training to employees liable to be exposed to asbestos. “If the company had any doubts or questions, it had ample opportunity to ask them and I would have done all I could to help. Instead it apparently buried its head in the sand. “As well as not meeting the extended deadline, the company continued in its failure to provide any evidence of compliance at any time during more than a year. It seems MP Builders just turned a blind eye to its responsibilities.”

No air sampling had been carried out and Mr Simpson did not produce a certificate for reoccupation once the work was complete. John Simpson, 41, of Portland Avenue, Deneside, Seaham was fined a total of £1,500 and ordered to pay £1,383 in costs after pleading guilty to two breaches of the Control of Asbestos Regulations 2012. Speaking after the case HSE inspector Sal Brecken said: “Asbestos is the single greatest cause of work-related deaths in the UK, with some 4,500 deaths each year due to asbestos-related diseases, as well as many serious illnesses. “For this reason, work with asbestos requires a high degree of regulatory control to ensure it is carried out safely. Mr Simpson decided to ignore the fact an asbestos licence was required to undertake this work and his actions not only put him at risk, but also the householder and those working alongside him. “Full compliance with asbestos legislation, in particular licensing requirements, is absolutely essential. HSE will continue to vigorously enforce the law to protect both workers and members of the public from exposure to this deadly substance.” She added: “When sentencing Mr Simpson, the magistrates said they considered this breach very serious and a custodial sentence was strongly considered but due to it being his first health and safety offence they decided to deal with it by way of a fine.”

RSPH Level 4 Certificate in
Laboratory/ Project Management
Bilfinger Salamis Skills Centre becomes the UK’s most northerly provider of ARCA training
T
he offshore energy industry can be turbulent and often requires personnel to mobilise within a day. This means that it’s essential that workers have all of the necessary qualifications required and are competent to complete any work needed when they arrive on the platform. Based in Aberdeen, Scotland, the Bilfinger Salamis Skills Centre is now the UK’s northernmost provider of ARCA training courses.
A
TaC, in association with The Royal Society for Public Health (RSPH) are pleased to announce news of a new analytical qualification. The qualification is a ‘Level 4 certificate in laboratory and on site project management’ and is aimed at Managers who are involved in the running of an asbestos testing laboratory together with overseeing on site asbestos removal work from planning stage to completion. Possession of this qualification by staff will help organisations and companies meet their accreditation criteria for ISO 17025 (testing laboratories) and the additional requirements of UKAS document Lab 30. The learning outcomes are for the candidates to fully understand the requirements of laboratory management including auditing, quality control, contract and management review together with a full understanding of the procedures for the planning and management of risk in relation to asbestos removal and the role of the project manager on site. The course has been designed to be more flexible and will fit around the busy lives of laboratory managers. The candidates will initially attend one of our training centres for one day where they will receive all the instruction and supporting paperwork to complete 3 assignments (laboratory management).

This will require the candidates to gather the information they need, complete the assignments and forward their work for assessment. We have allocated 10 weeks to complete this, the first stage of the qualification. When this is complete, the candidates will return for another day where they will receive the instructions and supporting paperwork to complete an additional 3 assignments (on site project management). Once again, the candidates have been allocated 10 weeks to complete these assignments. The assignments will be assessed to ensure they meet the requirements of the qualification. When all 6 assignments have been assessed to the standard required the qualification will be granted. This qualification is the ATaC equivalent to CoCA and we are currently running a pilot of the scheme which we hope to have completed by early March 2015. UKAS are aware of this qualification as it will have to have their approval to become a CoCA equivalent. This course should be available next year (2015) so keep your eye on the ATaC blog and web site for further information.

Competent Health & Safety advice
for ARCA members
‘Competent health and safety advice’ is often misunderstood. This article explains the legal requirements and how they might be met in practice. ARCA exists to support its members and the provision of competent health and safety advice is a basic service, already available to all members. Indeed, the HSE web pages on competent advice, list trade associations as the first port of call for those needing external support. The legal requirements addressing ‘competent advice’ are intended to ensure that contractors know current standards and legal expectations, and know where to get additional advice if/when it is needed.
T
here are many sources of support and advice currently being used by ARCA members. Broadly speaking, this advice falls into the following categories: a) Expert advice tailored to members’ needs and designed to enhance, augment and test members’ own arrangements and capabilities. b) A source of advice that is paid for on an annual retainer, but either not used at all (other than to provide a named source of competent advice for pre-qualification paperwork etc.), or used very infrequently. c) Generic advice providing little practical benefit for the health and safety performance of a licensed asbestos removal contractor.
Management of Health and Safety at Work Reguations 1999 1) The specific requirement for “competent advice” comes from the Management of Health and Safety at Work Regulations (MHSW). These regulations underpin much of the regulatory framework for all dutyholders. Regulation 5 requires employers to have ‘appropriate’ arrangements in place for planning, organisation, control, monitoring and review of the ‘preventive and protective measures’ that can ensure good health and safety performance. Effective management relies on suitable and sufficient risk assessment, and arrangements to make sure that the significant findings of those assessments are acted upon. 2) Regulation 7 requires the appointment of competent person(s) to assist employers so that they comply with legal requirements.

Competent means having “sufficient training and experience or knowledge and other other qualities” and there is an expectation that this will involve an understanding of current best practice, an awareness of limitations and an ability and willingness to seek external help if required. HSE explains that duty holders “need competent help in devising and applying protective measures, unless they are competent to undertake the measures without assistance”. There is a clear preference that this person will be “in-house”. 3) Competent advice should ensure that duty holders are “up to speed” with industry standards/requirements and are aware of when (and how) to seek further information and resources. Licensed contractors should already have in-house expertise: licences are granted on the basis of the (health and safety) management arrangements described to the HSE during licence assessment. 4) Where contractors have engaged or are thinking about engaging an outside body to provide competent advice, clarity about what kind of help is needed (and why) is obviously very important. Generic, off the shelf external ‘solutions’ are unlikely to fulfill legal obligations and may add little practical value. Those considering appointing external advisors should ask the following: a) Does the external advisor have evidence of relevant training, knowledge and practical experience of the asbestos industry? b) Can they explain why they are competent to advise you?

c) Are they a member of a professional body? d) HSE guidance suggests members ask the following general questions about any external help that has been provided: Do you have a practical, sensible solution to your [needs]? Or do you think you have ended up with something completely ‘over the top’, or a mountain of useless paperwork?
ARCA & Competent Advice 5) One of ARCA’s purposes is to act as a source of competent health and safety advice for members. Unless your external advisors are providing bespoke services for a particular
purpose, this is a function ARCA could and should be providing for you as a standard part of your membership. In practice, ARCA membership entitles you to seek confidential and impartial advice and queries are always welcome by telephone phone or email.
7) Members are kept up to date on industry standards via ARCA news, regional meetings, ARCA guidance and the ARCA website. All members have ready access to telephone and email advice on any issues that arise as a basic condition of membership.
6) ARCA staff have the experience, training and qualifications to satisfy clients’ requirements with regards to competent advice and can advise on further sources of specialist assistance, as required. In addition, Colin Seditas has recently joined ARCA from the Health and Safety Executive, bringing regulatory experience in asbestos licensing, policy and management systems.

2) Recent research provides a better understanding of air movement in enclosures and shows the limitations of the previous approach described in the Licensed Contractors’ Guide (HSG247, published 2006). It is ARCA’s understanding that the recent research will be reflected in HSE’s approach to inspecting air management issues; enforcement action may be taken where licensed contractors cannot demonstrate that reasonable efforts have been made to manage airflow inside enclosures. Updated guidance will take the findings of latest research into account. 3) The term ‘air changes per hour’ is used in the guidance and ACOP. It is used to make a simple comparison between the volume of the enclosure and the volume of air being moved by NPUs. However, drawing 1000m3/hour of air through a 1000m3 space for an hour will not provide one complete air change, due to the effect of turbulence and persistent stratification within the enclosure. The previous approach to air management may result in enclosures without suitable negative pressure and with persistent ‘stratification’ caused by insufficient air mixing.

Control of Asbestos Regulations 2012 and Approved Code of Practice (CAR & ACOP) 4) Regulation 16 requires employers to prevent the spread of asbestos fibres, so far as is reasonably practicable and to reduce spread to the lowest level reasonably practicable, where prevention is not possible. Enclosures under negative pressure are intended to prevent spread and paragraph 389 of the AcoP now specifies a minimum airflow of 1000m3/hour through small enclosures (<120m3), and at least 8 “air changes” per hour in larger enclosures.
Practical guidance 5) The specified level of air movement (airflow of 1000m3/hour for small enclosures and at least 8 “air changes” for larger enclosures) has been shown to be the most reliable factor for good air management. Where this level of air movement is achieved, there is expected to be a) Negative pressure of c. -5pa (good containment) b) Thorough air mixing in the enclosure (reducing exposure and spread) c) There will also be an easy method for

determining correct air flow, by using airlock door flaps as an indicator. ‘Standard’ flaps show a deflection of around 0.2mm for each 1m3/hour of air flow (i.e. around 200mm at 1000m3/hour), regardless of enclosure size. 6) Terms & definitions - for the purposes of this guidance note: a) ‘Standard’ air locks are the ‘minimum’ 1x1x2m stages. Where space allows, larger stages should always be provided to make decontamination easier. b) Air locks (flap weight and size) – The width and weight of the flaps are significant: wider, heavier flaps will offer more resistance to air. For the purposes of this note, ‘standard flaps’ are 0.8m wide and are “weighted” by rolling up excess 1000-gauge polythene sheeting (approximately 400g). c) Extra air inlets – all air movement is expected to be carefully planned and managed. Where extra air intake is needed, this should normally be achieved by providing additional ‘air chambers’. For ease of management, licence holders should build air chambers to a uniform shape: a “single stage” airlock of 1x1x2m. They must be clearly marked with appropriate signage and fitted with barriers (netting, tape etc.) to

Where enclosures are perfectly sealed, the volume of air pulled out must be equal to the volume of air allowed in. In other words, where an enclosure has a series of NPUs intended to move 10,000m3/hour of air, it must be designed to allow 10,000m3/hour in.
AIR LOCKS HAVE LIMITS
1000m3/hour of air flow through an airlock will deflect a ‘standard’ door flap around 200mm. At 1500m3/hour, the amount of deflection (c. 300mm) starts to restrict the space available for decontamination in the ‘minimum’ 1m square stage (at 5000m3/ hour, the flaps would be hitting the next chamber of ‘standard’ airlock configuration). Where larger volumes of air are required, further air chambers should be planned and managed on site. GUIDELINE LIMITS * ‘standard’ air lock or bag lock = 1500m3/hour each * ‘standard’ additional air chamber = 5000m3/hour.
NPUs & ACTUAL PERFORMANCE
Good air management planning requires knowledge of the actual airflow achieved by an NPU. Site teams should establish actual flow during set up, using an anemometer and mark the airlock to show flap deflection with this amount of airflow. During the works, the flap deflection can be used as a reference point. For planning purposes, NPUs should be referred to by their last known actual rating rather than (nominal) manufacturer’s rating. Standard units of measurements should be used throughout the organisation: i.e. m3/ hour. Variable speed controls may be of significant benefit, enabling larger units to be ‘turned down’ if necessary. These can be retrofitted for between £60 and £100.
DUCTING & ELECTRICAL SUPPLY
The effect of ducting can be significant. As a “rule of thumb” ducting (either side of the NPU) is likely to reduce flow by 1% for each metre and by 2% for each bend.
VARIABILITY
There are a number of variables in any enclosure system: for example, flap width and weight will have an impact on the amount of deflection seen. Mark the side of the airlock to show the amount of flap deflection for the level of actual airflow through the enclosure, as designed. Comparing amount of deflection against this mark during the project will be a good indicator of performance. Where variable speed NPUs are in use, the setting on the NPU should also be clearly marked and monitored.

The plan would need to include a bag lock, airlock and two additional air chambers. b) Small enclosure (AIB removal in Housing Association property) for removing AIB in domestic cupboard i) Cupboard and airlock total volume of just 10m3. AcoP specifies 1000m3/hour airflow to ensure adequate mixing. The NPU provided for the task must be able to draw this amount of air; flap deflection would be expected to be in the region of 200mm.
Further notes 8) There may be other factors that will impact on pressure and air mixing within enclosures. For example, high/low ambient temperatures will effect pressure and (unavoidable) obstacles within the enclosure may be shown to have an impact on mixing. However, the general principles described above mark a definite advancement in our understanding of air management and should be reflected in planning and site control for all members.

Holidays and holiday pay
S
urely overtime is just that. Paid when it is worked and not when the employee is on holiday. Things just got a lot more complicated – and expensive. The Working Time Regulations 1998 (WTR) require employers to grant employees and workers (those not on contracts of employment but still provide a personal service) 28 days paid holiday leave per annum. The question then arises, how do you calculate what the employee should be paid for each day on the beach? For those who receive an annual salary with no overtime provision, the answer is easy – just divide the annual salary by 260 to arrive at the gross daily rate payable. The problems arise for those employees who work overtime. Taking a holiday for them could mean a pay cut for time in the sun without overtime.
The new normal It all comes down to normal working hours. If overtime is a fixed feature of every week, then the money earned in overtime becomes part of the normal wage and should be included when the employee is on holiday. This is so because WTR say that the employee is entitled to his normal pay whilst on holiday. The question that the Employment Appeals Tribunal (EAT) ruled on in November 2014 was whether “non-guaranteed overtime” should also be counted as normal working time and therefore, normal pay. If non-guaranteed overtime counted towards normal pay, then employees should be paid this in holiday pay. In the joined cases of Bear Scotland Ltd-V-

Fulton, Hertel (UK)Ltd –V- Woods and Amec Ltd –V- Law 2014, the EAT ruled that the new normal must now include non-guaranteed overtime, when calculating holiday pay. This reversed a decade old Court of Appeal decision, by relying on more recent authorities from the European Court of Justice.
Use it or lose it The rule on taking holidays has always been that the employee must take their holidays in the holiday year or lose them – “use it or lose it”. Only days in excess of the statutory minimum of 28 days could be carried over. But, can an employee who was not paid the non-guaranteed overtime for holidays taken, claim back pay? Unpaid holidays have been treated as unlawful deductions from wages – contrary to section 13 Employment Rights Act 1996. Section 13 claims are relatively easy to lodge at Employment Tribunals and mostly are won by employees. However, unlawful deduction of wages claims have to be lodged within three months of the deduction occurring or they are time barred by the Employment Tribunal. So, if the shortfall in holiday pay occurred within three months, the employee would be in time, but not if earlier. One exception, if the deduction (failure to pay the non-guaranteed overtime) is part of a series of deductions. A series of deductions occur if there is a temporal link between the underpayments e.g. deduction each month for trade union fees.
but how much? Series of deductions serious risk of bankruptcy If the employee can maintain that he has suffered a series of deductions by virtue of the missing non-guaranteed overtime payments from holiday pay, he may be able to claim all the accumulated missing overtime payments going back many years. This claim for a series of deductions may be enough to bankrupt some employers. The Government has been panicked into holding an emergency review of the law. No results yet.
Break the chain and sever the risk So how can employers protect themselves against back pay claims for unpaid nonguaranteed overtime? The answer, break the link in the chain. If there is a gap of three months between one holiday and the next, the back-pay claim stops there. A break will end the “series of deductions” because the earlier one will be out of time (three months to lodge a claim at an Employment Tribunal). If a potential claim exists and this claim could be used to chain together older claims of longer than three months, an employer may care to pay up on this last claim to sever the link to the former (and maybe more expensive claims). Windsor Integrated Services Group (WISG) has bought the global patents for ARI Technologies unique thermochemical conversion technology to treat asbestos.
Windsor buys global patent for asbestos treatment technology T
his clean technology destroys asbestos fibres and produces a non-hazardous product that can be used in many construction applications. The technology has been successfully used to treat asbestos by the US Department of Defense, Department of Energy and Environmental Protection Agency as well as a number of private organisations. The purchase sees WISG take global control of the unique technology through a new company ARI Global Technologies having previously secured an exclusive deal with ARI Technologies Inc which ARCA reported in 2013.
The opportunities The UK currently disposes of in excess of 210,000 tonnes of fibrous and cement bonded asbestos in landfill each year, and disposed of around 300,000 tonnes per year pre-recession*. With hundreds of thousands of tonnes of asbestos material remaining across the country in structures that were built before 2000, there are substantial opportunities for plants across the UK as well as worldwide. The benefits The technology offers many benefits over the traditional asbestos disposal route of landfill. With the rising cost of asbestos disposal, this technology provides a commercially viable alternative to landfill and reduces what was typically an expensive treatment process. The technology permanently destroys hazardous, life-threatening asbestos material while converting it into a non-toxic recycled product. The thermochemical conversion process typically reduces the volume of the waste treated by between 50 and 90 per cent and the end product from the process can be recycled in many construction applications, diverting asbestos away from landfill and putting it to beneficial use. Ball 2014

he ARCA Winter Ball was held on the 29th November 2014 at the Grand Hotel, Brighton. 180 members and their guests attended a superb evening’s entertainment set in the iconic hotel on the south coast. Guests sat down to a three course meal whilst enjoying a superb night’s entertainment provided by ‘Renfield the Butler and Friends’ and an additional performance by ‘Saxation’, a trio of girls playing saxophones. The evening’s entertainment was concluded with the guests taking the opportunity to dance the night away and into the early hours. During the evening there was a game of heads and tails which raised £2,090 for charity, in addition a further donation of £2,000 was made
by Keltbray Ltd. Therefore a total of £4,090 was raised for the Chairman’s charity, which this year is the Alzheimer’s Society Alzheimer’s Society staff and volunteers provide both local information and over 2,000 services across England, Wales and Northern Ireland to people affected by dementia in their communities. Their local services include day care and home care for people with dementia, as well as support and befriending services to help
partners and families cope with the demands of caring. From Alzheimer’s Café’s and innovative ‘Singing for the Brain’ sessions to memory-book projects and group outings, their services provide both practical support and an essential point of human contact. Many thanks to all those that made donations during the evening, you can be confident that all money raised will be going to an extremely worthy cause.
Tachograph rules relaxed G
ood news from Europe for many asbestos removal contractors because soon some vehicles will no longer have to be fitted with tachograph recording equipment and their drivers will not have to comply with EC drivers’ hour rules, but with GB domestic drivers’ hours rules instead. From 2 March 2015, a new European regulation, EU 165/2014 – will replace EEC 3821/85, setting out requirements for the construction, installation, use, testing and control of tachograph recording equipment. This new regulation crucially increases the journey distance for exemptions from 50km to 100km (62 miles) from the operator’s base. This will include vehicles or vehicle and trailer combinations with a maximum weight of 7,500 kg which are used to carry materials, equipment or machinery for the driver’s use in the course of

his work and when driving the vehicle is not the driver’s main activity. In other words, most long wheel base medium and long wheelbase panel vans when towing decontamination units. From 2 March 2015, these vehicles will no longer have to be fitted with tachograph recording equipment and the drivers will not have to comply with EC drivers’ hour rules. Instead, drivers of these vehicles must meet GB domestic drivers’ hours rules. Future bright for asbestos firm following sale to French company M
onitor Environmental Ltd, a Midlands based asbestos consultancy, has recently been taken over by a French analytical company in a move that it says will secure the long-term future of the business and its employees. Based in Ilkeston, Derbyshire, the company has been sold to The Protec Group for an undisclosed sum, and is now in the midst of an extensive expansion plan with the aim of turning Monitor into a market leader in their field along with an expansion of their current services portfolio. The Protec Group is a leading European environmental consultancy & laboratory based in Paris with further branches across the continent. Protec provide a large choice of services and products; from performing analysis and instrumentation, to health and hygiene protective equipment. Kevin Raw, General Manager at Monitor, said:

Twenty One presented with 2014 Gold Site Audit Award T
he twenty one winners of the ARCA Gold Site Audit Award for 2014 were announced at the AGM at London Zoo in October. To qualify for the award, Full Contracting ARCA Members are required to undertake 2 site audits per year within their 2 allocated quarters, with the resulting audit report assessed against a standardised marking scheme. The Award is designed to complement the existing Gold Training Award, and is awarded to companies who meet the following criteria: w all audits to be awarded a ‘C’ Grade or above, with a mean average of at least a ‘B’ Grade

In order for ARCA members to more closely monitor their own progress against this standard, all audits are graded A to F, rather than just being deemed as satisfactory or not. The grading system enables licensed removal companies to see how close they are to (or how far away they are from) achieving the Gold Site Audit Award standard. As auditing is a crucial component of the Management of Health and Safety within organisations, it is envisaged that the Gold Site Audit Award scheme will assist ARCA members to achieve, maintain and demonstrate the high standards expected of licence holders. This supports the mission of ARCA to assist ARCA members and customers in providing safe, effective and ethical management of asbestos, thereby safeguarding the public. Additional site audits, further to the two per year required under the Site Audit Accreditation Scheme (SAAS), can be arranged through ARCA. These audits are carried out by approved ARCA auditors to the same standards as the SAAS audits, and allow for direct comparisons to be made across all your audits. Non-members of ARCA can also benefit from having ARCA take care of their external auditing requirements, as can clients who can arrange for ARCA to conduct additional audits on the sites they manage. Clients can benefit from the independence and expertise offered by ARCA auditors, as an extension to the most extensive site audit scheme in the asbestos abatement industry. New ARCA Membership Category –
Asbestos Labour Supply Member F
rom early 2015, applications for membership will be invited from labour supply organisations who are able to demonstrate that they are leaders in the field of coordinating temporary asbestos labour to the highest industry standards. The Labour Supply Member (LSM) will be required to match skilled operatives with contractors’ needs, whilst complying with relevant employment, tax, and health and safety law. Successful applicants will also need to demonstrate that at least one Director or Senior Manager has an appropriate level of asbestos related training and experience. Supplied operatives will need to demonstrate a thorough understanding of decontamination procedures, as well as RPE use and basic RPE maintenance checks. LSM’s will need to ensure operatives have current medical, training and face-fit certification, and to verify the validity of the copy certificates for the Licensed Asbestos Removal Contractor (LARC). The LSM will also be required to confirm that any relevant equipment (e.g. RPE, PPE) supplied with the operative is identifiable and accompanied by appropriate records, and to document the range / extent of an operative’s practical skills and work experience. LSM’s must demonstrate robust mechanisms for sharing operative information with prospective clients in a manner that will help the LARC to carry out their own processes (e.g. training needs analysis / competency / RPE provision and maintenance

etc.) and fulfil their legal obligations to employees. Through the ARCA Governing Council and its representation on the Asbestos Liaison Group (ALG), the LSM will have a voice to raise important and relevant concerns with the HSE / ALG. In addition, the LSM will be required to have a clear policy on the service standards expected of operatives and prospective clients. For operatives, this will include the duty to work in accordance with management direction and plans of work. For the LARC, this will include appropriate systems for capturing and storing exposure records and personal monitoring results, as well as arranging appropriate supervision, insurance cover and RPE maintenance. Applicants for this new membership category will be required to undertake an office audit of their systems and procedures in order to demonstrate that they meet the requirements of membership. Once membership is approved, there will be a requirement for an annual office audit prior to renewal to demonstrate adequate and continuing maintenance of the standards required. Members will also need to demonstrate they are working in accordance with the Conduct of Employment Agencies and Employment Businesses Regulations 2003, which require that agencies and the businesses that use workers supplied by them must exchange the information they both need in order to ensure the health and safety of the supplied labour. The benefits to the LARC of employing labour
from a Labour Supply Member are anticipated to include a reduction in administrative time and costs in finding suitable labour available for work when needed, as well as the assurance that the labour supplier understands the asbestos industry and what is expected from an asbestos removal workforce. By effectively measuring the Training Needs Analysis (TNA) requirements of their operatives, LSM’s will be able to provide ongoing TNA evidence to the LARC, a requirement that a non-specialised labour agency is unlikely to be capable of providing. Although most LARC’s have a pool of local labour they can call on directly when cover or extra labour is required, hiring labour for jobs more remote from the head office, or having exhausted the pool of known local labour, can be highly risky when operatives may be less known or unknown to the LARC. Utilising the services of LSM’s can reduce the risks of hiring labour unknown to the LARC. By verifying the validity the operative’s certification, the LSM will save the LARC needing to perform this task prior to the operative commencing work on site. Clients of LARC’s can also be reassured that additional labour on their sites is being supplied from reputable and monitored sources. First asbestos trade association in the UK to gain ILM centre status A
ccess to Leadership and Management qualifications for ARCA members has taken a great step forward with ARCA becoming the first Asbestos Industry trade association to gain approved centre status through the Institute of Leadership & Management (ILM). With the long term focus from industry on recognising competency through qualifications, and ARCA members being encouraged to gain an edge over their competition by taking management qualifications from the ILM. Courses will soon be launched at ARCAs Burton, Rayleigh, Manchester and Glasgow centres. ARCA has recently successfully achieved the ILM Approved Centre status and will begin delivering ILM qualifications from February 2015 onwards. Joining the largest awarding body for leadership and management qualifications in the UK and a global network of over 2,000 accredited centres, ARCA will initially be offering the Level 4 Certificate in Leadership and Management. Throughout ILM training, participants work through the skills needed to manage their teams effectively and make sure they are achieving organisational goals. Working alongside other learners from the Asbestos Industry will be a great support for individual learning with the collective support from other managers from the same industry.
