am pleased to report to you the fantastic progress the association has recently made regarding benefits and services to members. Firstly ATaC has made excellent progress in establishing an apprenticeship scheme for asbestos analysts. ATaC has entered in to partnership with Cogent Skills, the sector skills council for the science based industries, to develop the first apprenticeship scheme for the asbestos testing industry. This initiative was instigated by the ATaC Management Committee. Through the hard work of Steve Platkiw, the ATaC Manager, assisted by ARCA’s recently appointed Marketing Manager, Sarah Haslam, the apprenticeship scheme was launched on the 9th June. All ATaC members were invited to the three apprenticeship scheme meetings which were held during June in Burton, Rayleigh and Manchester. The initiative has been well supported by our ATaC members and I look forward to reporting in the next issue of ARCA News that first cohort of apprentices has begun the apprenticeship scheme. ATaC members who attended the meetings were also informed that upskilling grants were available via Cogent Skills to further develop the skills of their existing staff. Full details of the upskilling grants will be provided to ATaC members in due course. A detailed article on the apprenticeship scheme is included within this issue of ARCA News. We have noticed that over the years the number of ARCA members paying the CITB levy has steadily increased. Currently there are approximately 100 ARCA members paying the CITB levy. CITB levy payers have access to a variety of grants for training and assessment, as long as the training and assessment programmes meet CITB requirements. In order to provide ARCA members who pay the CITB levy access to assessment and training programmes which meet the grant funding requirements, ARCA has held a series of meetings with CITB to discuss ARCA providing NVQ’s for operatives, specialist apprentice programmes and specialist upskilling programmes for existing staff. We are working hard to get the NVQ programmes on stream as quickly as possible. We are partnering with the CITB’s National Specialist Accredited Centre (NSAC), the delivery arm of the National specialist Team

(NST), which delivers training and assessment to minority specialist construction sectors, to deliver the Level 2 NVQ Diploma in Removal of Hazardous Waste (Construction) - Licensed Asbestos qualification. We are at the stage of piloting this qualification with 5 operatives. As soon as the assessment process is seen to be working effectively ARCA will be rolling this qualification out to the membership. Communication to our members, clients, dutyholders etc. is central to ARCA’s operations. As well as the existing website we have recently begun making much more use of Twitter, Facebook and LinkedIn. Judging by the number of followers, likes and links these appear to be effective channels to get our messages out and we will continue to make use of these digital media. To add to our communication channels the ARCA blog has recently gone live. The decision to launch an ARCA blog was taken as a result of the success of the ATaC blog. We intend to publish regular updates on association activities, regional meeting dates, legal updates etc. on the blog. Anyone can sign up to the blog by going to the ARCA website, www.arca.org.uk , and clicking on the ARCA blog button. Signing up to the blog will mean that all blog updates will be delivered to your email inbox and you need never miss another ARCA announcement again. Finally it was great to see such a good attendance at our first ARCA North East regional meeting which was held at the Holiday Inn in Washington, Tyne and Wear. The dates of the next regional meetings have now been set in November and I look forward to seeing as many members as possible at the meetings.

Cheshire firm in court after workers potentially exposed to asbestos A

laboratory design and installation specialist has been fined after exposing workers, pupils and teachers to asbestos material at a school in Suffolk. The incident in July 2012 occurred during refurbishment work to modernise parts of Newmarket College School’s Science block. During the work, managed by Labform Ltd, sub-contractors disturbed asbestos as they were removing a wall and channelling the floor. The Cheshire firm was prosecuted at Ipswich Magistrates Court on Tuesday 12 May after an investigation found that the company had not arranged for a detailed Refurbishment and Demolition Asbestos Survey to be undertaken, as was required. Labform Ltd, of Lymm, Cheshire, was fined £22,400 and ordered to pay £11,741 in costs after pleading guilty to four breaches of the Control of Asbestos Regulations 2012. Speaking after the hearing, HSE Inspector David King said: “Exposure to asbestos fibres is a serious and well known health risk, so it is essential that duty-holders take suitable and sufficient measures to prevent the disturbance, spread and exposure to asbestos. “Failing to take action to identify asbestos while planning work, and to ensure that any contractors who may disturb asbestos are aware of the location and type of asbestos present, and not taking appropriate measures to protect the health of others, is totally inexcusable.”

Llandudno builder jailed for exposing workers to asbestos A

builder has been jailed for exposing workers to asbestos while working at a commercial unit on a Colwyn Bay industrial estate. Brian Roberts of 123 Bryniau Road, Llandudno and three men working with him, were exposed to potentially deadly asbestos fibres while working in the unit at Eagle Farm Road, Mochdre Business Park around 11 September 2012. Llandudno Magistrates’ Court heard today (12 June) how Roberts, who had been employed by the owner of the premises trading at the time, as Light in Design to remove asbestos from the building prior to sale. The Health and Safety Executive (HSE) was alerted to the unlicensed work by a contractor

who was licensed to remove asbestos. HSE’s investigation found that Roberts removed a significant quantity of asbestos insulating board (AIB) from the premises despite not holding a licence to work with such material. Brian Roberts pleaded guilty to breaching the Control of Asbestos Regulations 2012, and was given a custodial sentence of 26 weeks. Speaking after the hearing HSE Inspector Chris Wilcox said: “The safe removal of asbestos requires a high level of skill and technical knowledge and must be done by a contractor licensed by HSE.” “Asbestos is the single greatest cause of workrelated deaths in the UK. There are specific rules in place to make sure it is dealt with safely and

contractors have a duty to ensure they protect their workers from risk of exposure. “By undertaking the uncontrolled removal of asbestos, work for which he was not licensed, Brian Roberts exposed himself and his co-workers to the risk of inhaling asbestos fibres. “The outcome of this exposure cannot easily be assessed but there remains the possibility of ill health in the future. The workers could also have posed a health risk to others, including, for example, their families and loved ones, by taking home contaminated clothing. “Those involved now have to live with the fear of becoming ill with this life-threatening lung disease.”

London council in court after decade of ignoring asbestos risks W

altham Forest borough council has been fined after it exposed members of staff and visiting contractors to the potentially lethal dangers of asbestos, which it knew to be present in the Town Hall basement. The hazardous material was identified in a survey commissioned by the council in 2002, yet it failed to take adequate action to act on the findings and put effective controls in place. As a result employees and visiting contractors were allowed to carry on working in the basement regardless of the dangers for the next ten years. Westminster Magistrates heard today (30 March) that the issue only became public by chance in mid-2012 when a local resident put

in a request to the council to see some election expenses documentation. The authority denied the request with the reason that the paperwork was contaminated with asbestos. As a result, the resident approached the Health and Safety Executive’s ‘Mythbuster Challenge Panel’, which in turn referred the concern to HSE inspectors in north east London to investigate further. HSE found that the council had a second asbestos survey carried out in January 2012. This had quickly identified problems of asbestos in the boiler room and other areas of the basement. The survey also highlighted that areas identified in the 2002 survey had not been remedied. The court heard that Waltham Forest had no

plan in place for managing the well-known risks of asbestos and there was an inadequate system in place for inspecting asbestos at the Town Hall. HSE served an Improvement Notice on the council requiring them to put in place a proper management plan dealing with the presence of asbestos. Inspectors also interviewed a number of employees and contractors who had used the basement over the years, including print-room staff who were based down there. Waltham Forest Borough Council was fined a total of £66,000 and ordered to pay £16,862 in costs after pleading guilty to two breaches of the Health and Safety at Work etc Act 1974 and a breach of the Control of Asbestos Regulations 2006.

Developer in court after workers potentially exposed to asbestos A

construction firm has been fined after exposing workers to potentially deadly asbestos fibres during the conversion of an office block into residential flats in Witham, Essex. In July 2012, Marden Homes Ltd was commissioned to convert an office block into residential flats, this involved removing a disused boiler and its pipes from the building’s former Plant Room. During the refurbishment work, employees of Marden Homes Ltd disturbed pipe lagging which contained asbestos fibres. The Health and Safety Executive (HSE), prosecuted Marden Homes Ltd at Chelmsford Magistrates Court after finding the company had not arranged for a Refurbishment and

Demolition Asbestos Survey to be available to the workers on site. The Marden Homes Ltd employees were therefore unable to identify the presence of asbestos before removing the disused boiler and associated pipework and potentially exposed themselves, and other workers, to asbestos fibres. One of the workers involved had not received any training to enable him to identify whether the materials he was removing were liable to contain asbestos. The company had, in 2013, received advice from HSE regarding the need for a refurbishment and demolition asbestos survey to be carried out prior to work liable to disturb asbestos taking place. The company also received an Improvement Notice requiring them to provide

their employees with asbestos awareness training. Marden Homes Ltd of 275 Prince Avenue, Westcliff on Sea, Essex was fined £50,000 with costs of £1413 after pleading guilty to three breaches of the Control of Asbestos Regulations 2012. Speaking after the hearing, HSE Inspector David King said: “Exposure to asbestos fibres is a serious and well known health risk, so it is essential that duty-holders take suitable and sufficient measures to prevent the disturbance, spread and exposure to asbestos. “Guidance on managing the risks of asbestos is widely and freely available. Asbestos has been subject to regulations since 1931 and relevant to the construction industry since 1969. “Therefore failing to take action to identify the location and type of asbestos present during planning of the work, not communicating that information to workers/contractors who may disturb the asbestos and then not taking appropriate measures to protect the health of those exposed is absolutely inexcusable.”

Management System Review W

ith a unique knowledge pool, a team of experts in asbestos, auditing and the HSE asbestos licensing requirements, ARCA is able to offer a comprehensive range of services to support member businesses. The Health & Safety Executive (HSE) puts great emphasis on management competency: a failure to demonstrate ‘adequate management arrangements’ has been a large factor in the decreasing number of asbestos licences granted in recent years. Case Study ARCA was approached by a company for input into a review of its management arrangements. First Apprenticeship

launched for the Asbestos Testing Industry ATaC facilitates new apprenticeship package ATaC is pleased to announce that a new Advanced Laboratory Technician Apprenticeship, which includes three technical asbestos modules, is now available for enrolment. ATaC, in partnership with Cogent Skills, the UK’s strategic body for skills in the science industries, has developed a bespoke apprenticeship package suitable for organisations involved in asbestos surveying, testing and analysis. “Currently, in the asbestos testing industry, there is a critical shortage of experienced and skilled analysts,” stated Stephen Platkiw, Manager of ATaC. “As an association for this industry, and a training provider, we met with a college earlier this year to discuss how we could work with them and the existing advanced laboratory technician apprenticeship. These discussions were extremely encouraging.” “Today, thanks to the support of the team at Cogent Skills, we are delighted that this new apprenticeship for the asbestos testing industry is available for enrolment.”

This advanced laboratory technician apprenticeship will include three asbestos related modules - asbestos surveying, air monitoring and asbestos bulk analysis - during the two year period. On completion of the apprenticeship, the student will obtain the Level 3 Laboratory Technician Apprenticeship qualifications, as well as receiving three Royal Society for Public Health (RSPH) Level 3 qualifications – one for each of the asbestos related modules – all of which are recognised by the United Kingdom Accreditation Service (UKAS). This apprenticeship is now available through various Cogent Skills’ quality assured providers capable of delivering the apprenticeship as a day release at college model, or on-site where required. “The team at Cogent Skills has been instrumental in getting this apprenticeship package up and running. Going forward they will work with employers and colleges, and will facilitate the science industries’ skills and talent initiative, the Science Industry Partnership (SIP),” commented Stephen Platkiw. “We are very encouraged by the level of

interest from the colleges,” commented Tony Prior of Cogent Skills. “ATaC is an ideal partner for an apprenticeship, as its experienced trainers will be able to work effectively with colleges to deliver all the required technical training and assessments.” Richard Burton, Head of Qualifications at RSPH said; “RSPH is delighted that ATaC have helped to develop this new apprenticeship: especially as it utilises a range of RSPH qualifications that have been produced as a result of an excellent and successful partnership between RSPH and ATaC that stretches back a number of years.”

The Apprenticeship Package The Advanced (Level 3) Laboratory Technician Apprenticeship (Industrial – Asbestos) is available through a number of Cogent Skills’ quality assured providers across England, and ATaC will provide qualified tutors to deliver the specialised asbestos training and assessments. HSE Asbestos Awareness Campaign Update I

n issue 87 of ARCA News we reported on the launch of the HSE’s safety campaign to encourage tradespeople to think about asbestos on every job, so they are prepared to deal with the danger. This was almost an experimental campaign and very different to the previous Hidden Killer campaign. It made much more use of social media and digital media. For the first time HSE designed an app which can be used on a smartphone which is a simplified version of the task manual ‘Asbestos Essentials’. A final report on the impact of this campaign is due to be published in July this year. The initial results of the campaign shows the value of doing ‘insight’, looking at your target audience and determining what can modify their behaviour. In other words are they going to pay any attention to what you are trying to do through the medium you are trying to do it. This campaign wasn’t just about awareness raising, it was about trying to get something to change in terms of behaviour. The main marketing thrust was through B&Q Tradepoint and using a commercial partner on a scale that HSE have probably not done before. Other organisations assisted in the campaign,

for example there were 27 local authorities involved, at least 50 other stakeholders and 6 commercial partners. Along with the smartphone web app, HSE handed out a safety kit through B&Q Tradepoint. There were 188,000 safety kits handed out through Tradepoint. By mid-March there were over 42,000 visits to the HSE website web app, with 32,000 unique visitors. The main item in the safety kit was a type 3 overall, and that has been used as an indicator of what kind of success the campaign has had. In other words there are items within that safety kit which you would expect the sales of to go up if people took the safety kit and thought ‘I need to keep buying this piece of kit if I’m doing this kind of job, it is relevant to me’. The indication at the moment is that there has been some behaviour change in respect to the safety kit which is very encouraging. The message is that the ‘insight’ is key, and any campaign must be informed by proper ‘insight’ research using focus groups etc., to get the key to motivation and behaviour change. Another clear message that is coming out of this insight research is the reason why HSE keep using the word ‘simplified’. HSE guidance must be simplified to

reach the target audience and it must be tested on the target audience. Digital media has been very successful, the old way of doing it, which is leaflet and handouts, has a very low demand. The channels by which messages are distributed are moving. The HSE thought long and hard about putting out a very simplified version of Asbestos Essentials. Inevitably due to simplification they were not able to say everything that they would normally say, so HSE tried to pick out the key messages for the target audience to protect themselves and protect others. PR generally around this campaign generated 350 pieces of media coverage, 98% of which was favourable, and the campaign has been shortlisted for 3 media awards. Given that this was an almost experimental campaign the initial results appear to be positive, it will be very interesting to see the full evaluation of the campaign in July.

CDM

2015 IN SUMMARY

T

here has been a significant culture change within some parts of the construction industry over the last 10 to 15 years which has contributed to the continuing downward trend in fatal and major injuries which has been very encouraging. There have also been the beginnings of some greater focus on health risk management in construction but it is early days. The construction programme that the HSE has been running for the last 10-15 years has been seeking to try to improve leadership within the industry, with industry taking far greater responsibility. This has led to a more integrated approach to managing health and safety, and health and safety is now seen as one of a range of business risks, rather than something that is a bolt on. However, there are still some issues to address in order to make sure that the responsibilities for health and safety are where they need to be in the supply chain, with everybody taking responsibility and focussing on the real issues. HSE has not changed any of the technical standards within CDM but wanted to go back to the ‘Roben’s principles’ from the Roben’s report in the early ‘70s which gave rise to the Health and Safety at Work Act. One of those principles was that those responsible for creating the risk

should have the responsibility for managing the risk. HSE also wanted to try and simplify the Regulations. The previous CDM Regulations contained cross referencing and all manner of thresholds which brought in additional duties, and it was quite difficult to understand, particularly for smaller businesses. In addition, the HSE wanted to simplify the guidance and make it more targeted, particularly to SME’s. The old CDM ACoP was a large document and was trying to cover the full range and complexity of construction work, and whilst it had some good information in it, for a smaller business or a smaller project it was not particularly helpful. It is important to remember that CDM applies to all projects, this was often a misconception with CDM 2007. It was thought that CDM did not apply to a job because it was too small or it wasn’t notifiable. CDM always applied, it was just that some of the aspects of CDM were not required. CDM 2015 applies to all projects whatever their size.

What hasn’t changed? The role of principal contractor within CDM 2015 is relatively unchanged, with the duties all very similar. The Technical Standards have not changed nor have the welfare requirements in schedule 2. There is a requirement to have coordinators in both the pre-construction phase and the construction phase of the project.

What has changed? The HSE has simplified the regulations and they have tried to deal with leadership in procurement not really being there. Therefore the Client role has been strengthened and the Client has greater responsibilities than they did under the previous regulations. There is no longer a CDM Coordinator. The coordination role in the pre-construction phase is now the responsibility of the principal designer. The idea is that the principal designer is appointed from the existing project team. This means that the function is embedded from the outset in the assembling of the project. All projects, whatever their size, need a construction phase plan. It doesn’t necessarily need to be something very complicated but there does need to be a simple written plan for all jobs. The threshold for the appointments of the principal designer and principal contractor is not linked to notification anymore, and these appointments are now necessary whenever you have more than one contractor on site. This means these appointments will be required on a lot more jobs than previously. HSE believe that the regulations are far more relevant and far more accessible to smaller projects. One of the things that doesn’t happen on smaller projects at the moment is sufficient management and planning, so the HSE has tried to address that issue in the new regulations.


health & safety Client Clients have enormous opportunities to control how the project is ultimately delivered. They need to select the right team and ask the right sort of questions to those who will be doing the work, such as what sort of work they have done in the past and whether they have the right sort of attributes to be able to deliver. Clients can set standards for how they want the project to be delivered. They are in a position to make arrangements to check that others that they are depending on to deliver the project are doing what they need to do to manage health and safety. Clients need to hold their principals to account.

Principal Designer Principal designers specifically plan, manage and monitor the pre-construction phase and manage the health and safety aspects. They need to specifically ensure that designers comply with their duties. They need to ensure cooperation with the client and others, and give the client support in supplying and obtaining pre-construction information, which is very important. Clients do not always appreciate what they have in terms of pre-construction information and the value or importance of it. The principal designer is very much there to help and take a view of what information is available and whether it is sufficient, or it needs some interpretation, asbestos surveys would be a good example of this. The principal designer is there to advise the client. The principal designer’s responsibility is to make sure that the necessary information flow actually happens and takes place between the people who need the information.

Principal Contractor The role of the principle contractor is much as it was under CDM 2007, which is managing and coordinating during the build phase, however there are some additional duties. Principal contractors have a specific duty to liaise with the principle designers for as long as they are involved with the project. For most jobs this will be the duration of the project as the preconstruction phase clearly goes on and overlaps very significantly, and sometimes almost to the end, of the construction phase. All the time that design work is going on, that is preconstruction. The HSE anticipate that for the main part those appointments will last for the duration. Principal contractors need to provide information to the principal designer that is relevant to the health and safety file. This is another area where a view will need to be taken, as only relevant information needs to go into

the file. Communicating and engaging with the work force is at the heart of what the principal contractor is doing. Operational priorities for the HSE’s inspection effort remain refurbishment and smaller projects. The HSE seeks to look at underlying causation and where management failures led to something not happening on the day. The HSE is challenging senior managers and dealing with some of the larger contractors at senior manager / head office level. The HSE is engaging early in the larger projects before they start on site, so that they can establish where issues are likely to be and what is being done to deal with them. The HSE has said on reflection this was the third bite of the cherry as far as CDM was concerned. They believe they are now where they would like to have been about 20 years ago, but these things don’t happen overnight. In addition there has been quite an evolution over the past few years. What a set of regulations / guidance can’t do is be absolutely black and white, and take account of every possible situation that is likely to arise in construction. The model that has been produced is the best fit that could be achieved. The key point is that it is a flexible set of regulations which can be put in to effect in a proportionate way. The measures that are taken to comply should be proportionate to the risks.

What CDM 2015 means for the Asbestos Removal Industry The HSE’s opinion is that on stand-alone asbestos jobs, where there is an asbestos removal contractor and an analyst involved, that this constitutes two contractors involved in construction work. Therefore this means that a principal designer and a principal contractor need to be appointed by the client. However, other than the actual appointments it is difficult to see whether any additional work would be required as a result. The contractor would usually become the principal contractor and probably the principal designer, unless the client wanted to retain that role for some reason. The design aspects of the job would be made up of a specification as to what needs to be removed and there will be a sequencing of the work, but that is all dealt with in existing plans and documentation, so it should not be a problem or issue. The HSE don’t even see a situation where an HSE inspector would criticise where a written appointment had not been made if everything else was being managed adequately. This is all supported by HSE’s enforcement policy of being proportionate and looking at what is the relevant piece of legislation for the work being done. For a stand-alone asbestos job

the Control of Asbestos Regulations 2012 is the relevant legislation. CDM has very little relevance in those situations. There could be a situation where a client has not done what they should have done under the expectation of CDM, and as a result HSE may well want to take them to task under CDM. In terms of a licenced contractor / analyst it’s quite hard to see situations where HSE would seek to enforce CDM. With the licensed asbestos removal industry there is already a very well developed procedure for dealing with this high risk work, for example a specific requirement on planning already exists. What is interesting in CDM 2015 is the client obligations. The HSE has been asking licensed contractors to meet their legal obligations but has observed that some of the difficulties contractors have had in doing this are as a result of the clients. This presents a difficult situation for a licensed contractor to deal with his client, HSE are interested in this aspect. The requirement to coordinate and cooperate already exists within the Management of Health and Safety at Work Regulations, this exists between the analyst and the asbestos removal contractor. HSE cannot actually see a great deal of difference to the way the asbestos removal industry currently works as a result of CDM 2015. Most of the requirements already exist in the asbestos removal industry, CDM 2015 may just make some of them more explicit in some circumstances. There may be some site issues which do not relate to the asbestos removal work, i.e. which would sit outside of the plan of work which may need addressing as part of a construction phase plan. In most cases the plan of work will fulfil the requirements for a construction phase plan. In summary this is a simplified set of regulations which should drive and improve collaboration, particularly in the design stages. The HSE believe the responsibilities are where they need to be in the supply chain, with everybody taking responsibility, and they should help focus on what the real issues are. There is an opportunity for Health and Safety professionals to demonstrate a proportionate and sensible approach, and HSE hope they will do so. There are much lower thresholds for appointments and Health and Safety Plans etc., but HSE do not want to see people going completely over the top to fulfil those requirements. Effective Health & Safety Management

Plan

Do

M

uch has been spoken of and written about the management of health and safety. Organisations have a legal duty to put in place suitable arrangements to manage health and safety, and within the asbestos removal industry, this has been the topic of many conversations, deliberations and reflections in many a boardroom, and occasionally in the courtroom. The Health and Safety Executive (HSE) publication HSG65, ‘Managing for Health and Safety’ (published in 2013 and replacing the previous outdated and somewhat arduous version) provides a framework to help you manage effectively, in a way that your organisation can tailor to your own circumstances. The HSE has moved away from using the POPMAR (Policy, Organising, Planning and implementing, Measuring performance, Auditing and Review) model of managing health and safety to the more universal ‘Plan, Do, Check, Act’ approach. Licenced Asbestos Removal Contractors (LARC’s) are quite used to the emphasis on planning, as all licensed work requires an initial assessment of the general and site specific risks, followed by the creation of a Plan of Work to incorporate the method of work and the control measures to be put in place to sufficiently manage those risks. This is followed up by the submission to the Enforcing Authority of a notification of the works (on Form ASB5) at least 14 days prior to commencement. The ‘Do’ element of the cycle is overarched by a highly regulated licensing regime, with each notified job having the potential for enforcing authority inspections. The remaining ‘Check’ and ‘Act’ elements are often the areas that are most overlooked, and therefore where there is generally the greatest potential for improvement. Checking involves setting up an effective monitoring system, backed up with effective performance measures. You should ensure that your monitoring adds value and isn’t just a tick in the box exercise, as effective monitoring doesn’t just identify problems, but helps in understanding what caused them and what sort of changes are needed to address them. Effective monitoring can accelerate improved performance.

Active and Reactive Monitoring Methods of monitoring health and safety performance are generally described as being

Check Act ‘Active’ (sometimes ‘Proactive’) or ‘Reactive’. Active monitoring methods tend to be preventive in nature, so include safety surveys, inspections, audits and tours, with the intention of identifying the potential cause(s) of undesired events, and taking actions to prevent or reduce the likelihood of the undesired event actually occurring. It encompasses ‘before the event’ methods. Reactive monitoring is triggered ‘after an event’, and methods include accident and incident investigation, identifying injuries and cases of ill health, and evaluating other losses such as property damage. Monitoring, whether Active or Reactive, requires the investment of time and effort, so you will need to allocate appropriate resources and possibly train staff involved in it ahead of time. Board level commitment from the key decision makers will allow you to be more able to act on what your monitoring tells you. Using a variety of methods is usually more effective than using just one or two, although you may predominantly only use one or two. For LARC’s, inspection and audit are the most used.

Inspections and Audits Inspections are generally considered to be a physical inspection of a workplace, or of a specific location or piece of work equipment within a workplace. Checklists are often used, and inspections are scheduled to be conducted at regular intervals. They are conducted by competent persons who will look for hazards, unsafe acts and conditions, as well as good points, and a record is kept which will include remedial actions. Most inspections undertaken by LARC’s are legislative requirements, such as inspections of hygiene facilities, enclosures, vacuum cleaners, air extraction equipment, and respiratory protective equipment. Other inspections may be conducted by a third party, and in the case of enforcing authority ‘inspections’, these may actually include a variety of both active and reactive methods. An audit is usually defined as a thorough and critical examination of an organisation’s health and safety systems and procedures. It assesses the implementation of the health and safety policy, other related policies, and the working arrangements. For the LARC, an audit will focus on material contained within the site specific

Plan of Work, the associated general (or standard) procedures, and the records of inspections made as described above. An audit often identifies underlying causes and reasons why there is a non-conformance, usually consists of a series of predetermined questions, and often includes a scoring system to measure improvements or deteriorations. Benchmarking one site team against another, or one regional office against another, is possible where the audit criteria, method and scoring are standardised. One case study of note is the ARCA Site Audit Accreditation Scheme, where the audit performance of an individual company can be benchmarked against the pooled results of all Full Contracting ARCA Members. Audits are planned by management in advance (even if site teams themselves don’t know when or where they will take place) as part of the organisation’s health and safety management system. Establishing ‘how things really are’ is far more beneficial in reducing risk than merely navigating through a tick box exercise.

Taking Action on Lessons Learned Monitoring performance may impress a limited few, but will benefit no-one if no lessons are learned and no action is taken. It is essential that organisations regularly review their health and safety performance, not just have a folder of records sitting on a shelf. Regular reviews will allow you to establish whether the essential health and safety principles – effective leadership and management, competence, worker consultation and involvement – have been embedded in your organisation. It tells you whether your system is effective in managing risk and protecting people. It will inform you as to where your focus needs to be and the issues you need to ‘Act’ upon. Even well designed and well developed management arrangements provide the challenge of ensuring that all requirements are complied with consistently. After an accident, injury, audit non-conformance or enforcement action, many organisations find they already had systems, rules, procedures or instructions in place that would have prevented the event but were not complied with. The secret of effective proactive monitoring is not so much focussed on what it takes, but more of what it saves.

ADR 2015

Do the European dangerous goods transport regulations (ADR) apply to me? If you are a licenced asbestos removal contractor, a waste carrier who transports asbestos or operate an asbestos waste transfer station or landfill site, then the answer is almost certainly ‘YES’. You would only be totally exempt if you only ever handle bonded asbestos. These regulations define bonded asbestos in Special Provision 168 as: Asbestos which is immersed or fixed in a natural or artificial binder (such as cement, plastics, asphalt, resins or mineral ore) in such a way that no escape of hazardous quantities of respirable asbestos fibres can occur during carriage is not subject to the requirements of ADR. Manufactured articles containing asbestos and not meeting this provision are nevertheless not subject to the requirements of ADR when packed so that no escape of hazardous quantities of respirable asbestos fibres can occur during carriage. Otherwise, you are dealing with fibrous asbestos and you will satisfy one or more of the roles whose legal obligations are specified in ADR Chapter 1. What do these terms mean? In the context of asbestos removal, transport and disposal most companies perform more than one role, often undertaking all of them.

Taking each role in turn: Consignor – person who hands over the waste to another, normally the producer of the waste entrusting it to the carrier Packer – person who puts waste asbestos into UN bags Loader - person who puts bagged asbestos into a van, or skip Carrier – person who transports asbestos waste to a transfer station or landfill site Consignee – person who accepts the waste after transport, for example at landfill Unloader – person who takes bagged asbestos from a vehicle, or unloads a skip containing asbestos from a vehicle.

That includes me then, so what do I have to do? The main responsibiliites are outlined in the table below. There is partial exemption from some of these requirements for carriers who never move more than 333kgs of UN2212 or more than 1000kgs of UN2590. This is known as the ‘small load limit exemption’ or ‘ADR Chapter 1.1.3.6 exemption’. Examples include not needing orange plates on your vehicle or an ADR qualified driver.

Will the latest changes affect me? Yes! In case you have not been advised of the amendments by your Dangerous Goods Safety Adviser (DGSA), there is a significant change affecting asbestos removal companies. Special Provision 168 Bonded Asbestos exemption The good news is this remains unchanged, should the waste satisfy the criteria for SP168 (see above) then this waste is totally exempt from the requirements of ADR, so no UN numbers, no pre-printed bags etc. The Hazardous Waste and CAR Regulations however do still apply. s announced at the ARCA Annual General Meeting (AGM) in October 2014 ARCA had committed to producing a Strategic Plan to set priorities, focus energy and resources, strengthen operations, ensure that employees and other stakeholders are working toward common goals, establish agreement around intended outcomes/results, and assess and adjust ARCA’s direction in response to the environment within which it is operating. The plan aims to align the fundamental decisions and actions that shape and guide what ARCA is, who it serves, what it does, and why it does it, with a focus on the future. This Strategic Plan has now been in place for approximately 6 months. The starting point was a Mission and Vision statement, to encapsulate the reason that ARCA exists and what it means to achieve, agreed by the ARCA Governing Council.

Each Action Plan was drawn up in accordance with the Mission, Vision, Corporate Goals, Common Objectives for All Departments and Departmental Objectives, Strategies and Tactics. The Action Plans detail: w What actions or changes will occur w Who will carry out these actions or changes w By when they will take place, and for how long w Whether additional resources are needed to carry out these actions or changes w Communication (who should know what) The Action Plans were approved by the ARCA Governing Council and are now being implemented. As reported at the recent round of ARCA regional meetings one of the commitments made as part of the strategy is to visit all of our members at their head offices within a 12 month period. These meetings will commence in July 2015. The meetings will be an opportunity for ARCA to better understand the individual needs of its members and for ARCA to explain in detail the services and support offered, and how members can best take advantage of them. The immediate effect of the implementation of the strategy has been noticeable right through the organisation. The effect has been to focus the ARCA Governing Council, the ARCA Governing Council Sub-Committees and the ARCA Management team and staff on the objectives and results are beginning to be noticed. A review of the progress of the strategy will be provided at the forthcoming ARCA Annual General Meeting on October 2nd at the London Zoo conference centre.

First UK ARI plant takes step closer T

he first ARI Global Technologies plant took a step closer to being built this month as the company received preliminary designs for a UK facility. International engineering company, Continental Research and Engineering (CR&E), was commissioned in the spring to develop the specification which will give ARI Global Technologies the blueprint from which to build the first facility. American based CR&E was responsible for developing the asbestos destruction technology into a working 15 tonne a day process facility in Tacoma, Washington. Windsor Integrated Services Group announced its acquisition of the global patents for ARI Technologies’ unique thermochemical conversion technology to treat asbestos in January 2015. This clean technology destroys asbestos fibres and produces a non-hazardous product that can be used in many construction applications. Under new company, ARI Global Technologies,

the group plans to build its own facility in the South of England to take feedstock from its highly successful asbestos disposal company, Windsor Waste Management, and is offering sub-licensing opportunities for the rest of the UK and globally. As part of the design process, CR&E will be tendering for the build on ARI Global Technologies’ behalf. Jeff Letch, Director, Windsor Integrated Services Group says: “We are very excited to be taking this significant step towards building the first ARI Global Technologies facility in the UK and

providing a commercially viable alternative to sending asbestos to landfill”. In May, ARI announced that further afield, an Australian waste management company has bought the exclusive rights to ARI Global Technologies for Australia and New Zealand. ARI Global Technologies is holding an open day in the autumn for anyone interested in finding out more about the technology and corresponding feedstock and investment opportunities.

This year the ARCA National Golf Day returned to the newly refurbished Belfry in Warwickshire. As four-time host of the Ryder Cup, The Belfry has always been a byword for world-class golf courses and thrilling moments. Now, following a £26m refurbishment the hotel more than lives up to the velvet-smooth greens. On the 14th of May 60 Members and their guests competed in a stableford competition on the world famous Brabazon course. As you would expect from a top venue such as The Belfry the course was in fantastic condition, although the weather failed to oblige. Following the days golfing a presentation dinner was held in the clubhouse and prizes were awarded to the winners of the various competitions.

Havens Hospices A

RCA members raised £10,000 to support the fantastic work undertaken by Haven Hospices. Little Havens Hospice is part of Havens Hospices which also incorporates Fair Havens Hospice. Little Havens helps by controlling pain and medication, offering respite and caring for children at the end of their lives. This free, specialist care is there for as long as it’s needed, within the family home and at our hospice. Little Havens is a registered charity – not part of the NHS – and receives limited government funding. The organisation must raise over £46,000 every week to be there for everyone who needs its care.

Little Havens are truly thankful for every penny donated to them. Your donations make it possible for them to be there for children like Harry, who receives respite care at Little Havens. They are able to give the support his family so desperately need too. Harry’s mum, Donna, says: “When Harry was diagnosed it was a massive blow. We had thought if it’s a disability we can cope with that, but can we cope with the thought of losing our child? Having somewhere like Little Havens where you can go whatever the answer is or whatever happens is just fantastic - to know you have that support.”

First Regional Meeting for newly formed North East Region

A

s part of ARCA’s strategic plan the regional meeting venues are being assessed to ensure that the majority of ARCA members have access to a regional meeting. The first stage of this process was to establish a regional meeting in the North East to better cater for our North East members. As a result the Northern ARCA region has now been divided into the North West region and the North East region. The North West regional meeting will continue to be held in Huddersfield, and a new venue in Washington, Tyne and

Wear has been established for the North East members. The first meeting was held on June 10th at the Holiday Inn, Emerson, Washington. The meeting was attended by 15 representatives of member companies as well as Steve Sadley (CEO) and Satish Patel (Training Manager) from ARCA. It was good to see many new faces who had not previously attended ARCA regional meetings and had taken this opportunity to attend a meeting more local to themselves. Those attending had the benefit of hearing first-hand the latest

How performance appraisals support

Training Needs Analysis (TNA)

Performance appraisals, whether you love them or hate them, are an integral part of the management processes that supports TNAs. A successful appraisal, when both parties are engaged and prepared, can have many rewards; an individual’s performance can be raised as they are motivated, encouraged and empowered, and have a clear understanding of where the business is heading.

Here are some key points to consider when undertaking appraisals: 1. Regular meetings are important, as these can help identify poor performance earlier and allow actions to be taken to improve it as soon as possible. Appraisals should be at least yearly, but additional appraisals throughout the year can keep performance objectives on target. 2. An appraisal meeting should be structured by following an agreed plan, usually set by the company. Individuals should be asked to come prepared by completing a self-assessment form which includes, performance feedback and Training Needs Analysis.

8. When an individual has worked hard yet not achieved the target(s), focus on the effort, and ask how they could have achieved the target(s). This will then highlight the support or training required to help the individual meet the target(s). 9. Discussing training needs is essential, both what the manager and the individual feel is required. Our industry understands the key benefits of ‘Information, Instruction and Training’.

3. Managers should be prepared by reviewing the individual’s self-assessment and performance since the last meeting, as well as their own notes on the agreed plan.

10. SMART objectives are key to gaining improvement. Clear, unambiguous objectives are required for both parties and make it easier for the individual to achieve performance.

4. 360˚ feedback. This is feedback on the individual’s performance from supervisors and/or colleagues. This may not be appropriate in the early stages if there has been no formal appraisal process in place before.

11. Produce a performance plan and ask the individual to record progress on the plan.

5. Keep the number of objectives to 3 or 4 and base them on key performances that will improve the business. Individuals should be made aware of the key business objectives and how their contribution, in terms of performance, can deliver towards these. 6. Start the meeting in a relaxed manner by explaining to the individual how the appraisal works and what it is you and the business are trying to achieve.

7. The self-assessment form is a valuable method of gaining information from the individual. Ask them to talk through the process they followed to come to the self-assessment results. Listen and be encouraging.

12. Monitoring an individual’s performance plan and progress, together with regular communications should alleviate any problems early on in the appraisal process. This will allow issues to be resolved as they occur, rather than waiting for the next appraisal meeting. Clarity at the beginning of the appraisal process enables individuals, managers and the business to gain a clear understanding of what actually needs to be achieved and how it will contribute to the success of the business. Appraisals are a key element in gaining evidence to produce a Training Needs Analysis.

them. w tell the individual where performan ce isn’t to the standard required. Ask the individual where and how they feel they could improve. For example, “We need to improve the quality of the site paperwork returned to the offic e. We’re only getting half the paperwork completed and retur ned on time, so what do you think you need to do to improve on that?” w agree objectives and when these shou ld be completed, together with how performance will be measured. Be smart about objectives, agree what good perfo rmance and poor performance will look like.
