RCA continues to work towards being a CSCS partner for the CSCS card scheme. An agreement has been signed with Reference Point, the company operating the CSCS card scheme system, for ARCA to be able to issue CSCS cards for asbestos operatives and ARCA staff have visited Reference Point’s offices to receive training on operating the system. ARCA was audited for compliance with the Construction Leadership Council (CLC) requirements of card schemes carrying the CSCS logo on Tuesday 13th June. Initial comments from the auditor were favourable and so we are now awaiting confirmation from CSCS that ARCA will be able to use the CSCS logo on cards issued through our scheme. Once all actions have been completed with Reference Point and CSCS, ARCA will then be able to issue CSCS cards for asbestos operatives. NVQs, which are now a requirement in order for asbestos removal operatives to apply for or renew a blue CSCS card, continue to be delivered by ARCA. I am pleased to say that the Experienced Worker Practical Assessment (EWPA) route to NVQ is proving to be very popular, fully justifying ARCA’s decision to develop this method of assessment for the industry, with the support of CITB. ARCA’s unannounced site audit scheme continues to progress with members finding unannounced audits providing valuable feedback on their actual site performance. This feedback is even more valuable as it is now provided in a more timelier manner, in most cases immediately the audit is completed. This has been made possible by the introduction of the ARCA auditing app which has been in use since March. The app allows the audit to be conducted electronically using a tablet and is now being used on all ARCA site audits. Once we are satisfied it has been robustly tested, we will then undertake some further development so we can offer the app to our members, so allowing them to conduct internal audits using the same criteria that are used on the ARCA audits. We would anticipate this being available during July. Members will be advised on how they can begin using this valuable tool as soon as it is available. To further invest in the ARCA site audit scheme, we have appointed a new full time

auditor for ARCA in the South East. Duncan Williams, who joined ARCA on the 1st June, comes with a wealth of experience in the asbestos industry and is sure to be a valuable addition to our team. Preparation for the ARCA Annual General Meeting on the 6th October at Lords Cricket ground is well underway. I am delighted that Archie Mitchell, Head of the HSE’s Asbestos Licensing Unit has once again agreed to deliver the keynote speech at the event. The luncheon in the afternoon is a chance for AGM attendees to socialise and catch up with old friends. Also, I’m pleased to say that Dennis Taylor, former snooker world champion, will be our afterdinner speaker, entertaining the delegates and bringing the event to a close. Members will recall last year’s ARCA Charity Week and are hopefully aware that this year’s ARCA Charity Week will be 11th -15th September. One of the charities that benefit from the ARCA Charity Week is Mesothelioma UK. Mesothelioma UK is a national specialist resource centre, specifically for the asbestosrelated cancer, mesothelioma. The charity is dedicated to providing specialist mesothelioma information, support and education, and to improving care and treatment for all UK mesothelioma patients and their carers’. I am delighted to report that Mesothelioma UK has arranged for one of their specialist nurses to attend each of the ARCA regional meetings in July to give a short presentation on mesothelioma, the work that the charity does to support those suffering from this disease and the importance of donations, such as ARCA/ATaC members’ contributions, to the continuation of this valuable work. I look forward to seeing as many members as possible at the July regional meetings.

RCA is pleased to announce a new addition to the in-house audit team – Duncan Williams. Duncan, who has over 20 years’ experience in the asbestos industry, covering both asbestos removal and surveying, will be assisting the current ARCA team in conducting site audits, predominantly in the South of England. “I am looking forward to working with the ARCA audit team and this role will allow me to support the safety standards in this hazardous industry,” commented Duncan. Under the Association’s site audit scheme, ARCA auditors conduct two site audits for each member per year. These are required to be satisfactory to maintain membership. The auditors also carry out additional site audits for many members, so providing further reviews to support their business management systems.

ARCA Member Visits

Feedback positive - Members value ARCA

T

his year ARCA has continued the programme of member visits, so giving Association representatives the opportunity to talk directly with the owners or senior managers of member companies. These member visits provide time to discuss the issues that affect individual members and how the Association is, and can, support their day to day business. Feedback from members regarding the services provided by ARCA has been extremely positive. Members value ARCA. It is really encouraging to see how highly members rate the training provided by ARCA. Members have particularly commented on the competency of the trainers and the style of delivery which keeps delegates interested and engaged. The majority of our members always try to source ARCA training, however availability and location can sometimes be an issue. We have taken this on-board and have been working to make our training courses as widely available as possible, although it will

be a challenge to provide training facilities and courses in close proximity to all of our members. It is clear from the meetings that CSCS cards are a big issue with many members. During the meetings we have been able to explain to members the changes that are occurring regarding the requirements for CSCS cards and the NVQ solutions which ARCA has developed to help members meet these requirements. Many members are greatly interested in the Experienced Worker Practical Assessment (EWPA) route to NVQ for operatives. This is an assessment process developed exclusively by CSkills and ARCA to deliver an efficient assessment over one day at an assessment centre. With regard to the ARCA Site Audit Scheme, without exception, every member visited appreciates the significant benefits of the unannounced site audits. Members have heard that it is the Association’s intention to move to a situation where all site audits

are carried out by directly employed ARCA staff. This process has already commenced with Matt Lambert taking on responsibility for being the lead auditor from our Burton office, and the appointment of a new member of staff, Duncan Williams, as the new lead auditor for the south of the country. Members welcomed the new electronic auditing process which meant that the fully completed audit form was emailed to most members immediately(i) after completion of the audit. Many members expressed interest in using the audit app for their own internal audits, so ARCA is now reviewing additional development to facilitate this. ARCA will continue its programme of member visits so all members have the opportunity to talk to their Association on an individual basis. Steve Sadley Chief Executive (i) network permitting

First Experienced Asbestos Operatives to gain NVQ with ARCA L

ast month two asbestos removal operatives from Northern Insulation Contractors Ltd arrived at ARCA to undertake the Experienced Worker Practical Assessment (EWPA) to gain an NVQ. The operatives undertook a full day of assessment with the ARCA assessor, and as it was the first EWPA to be held at ARCA a CITB auditor also attended to witness the assessment. Congratulations to Stuart Goulden and Alex Mellor on being the first operatives to gain an NVQ Level 2 Diploma via the EWPA option. Sarah Costello, Director of Northern Insulation Contractors (UK) Ltd, stated, “This was the perfect NVQ option for us, as we have a number of experienced asbestos removal

operatives and pay the CITB Levy.” “The information and support from ARCA has been great. We are now working with ARCA to plan for all our operatives to undertake an NVQ with them, this qualification enables us to drive and demonstrate the competence of our workforce with the added bonus of achieving / retaining experienced worker CSCS cards.” Stuart Goulden, asbestos removal operative at Northern Insulation Contractors Ltd added, “It was a hard assessment yet fair, covering all key parts of the job. It’s good, I’ve now got a qualification that recognises my skills.” “Our members needed an option for experienced operatives to gain an NVQ to support an application for a CSCS card. Therefore, last year we started working with

the CITB to create this option (EWPA) for our CITB Levy paying members,” commented Satish Patel, Training Manager at ARCA. “Earlier this year we were pleased to be able to offer our members a complete NVQ solution for asbestos removal operatives.” ARCA provides a number of options for asbestos removal operatives to gain an NVQ Level 2 Diploma and thereby a CSCS card. The option chosen depends on whether the employer pays the CITB Levy or not, and how much experience an asbestos removal operative has working on-site. Full details can be found at www.arca.org.uk

ARCA to deliver Keynote Speech at the European Asbestos Forum conference T he Asbestos Removal Contractors Association (ARCA) will be supporting this years’ European Asbestos Forum (EAF) Foundation conference by discussing the role of a trade association in the asbestos removal industry. Steve Sadley, Chief Executive of ARCA, will discuss points, such as, developing tools for the industry; providing the best support to assist members in good practices and endclients in the safe management of asbestos; which all drive continual improvement and professionalism throughout the industry.

The EAF Foundation was formed in 2014 to focus on improving professional networks and exchanging the best and newest of knowledge regarding all matters related to asbestos, across borders and sectors – as every country in the world has asbestos problems. This year the EAF Foundation conference will focus on ‘Asbestos and Industry’, and is being held on 26th September, at the Hilton Canary Wharf Hotel in London. CSCS Cards

Currently ARCA is working towards operating as a partner scheme with CSCS, therefore being able to issue CSCS cards to the asbestos industry.

A

ll new partner schemes must meet the Construction Leadership Councils (CLC) decision on the specification for industry card schemes carrying the CSCS logo. One of the requirements is that the appropriate qualification(s) for each occupation will be agreed between the Sector Representative Organisation (SRO) and its recognised standard setting body. ARMI (a joint venture between ARCA, ACAD and the NFDC) is recognised as the SRO for the asbestos industry and CITB is the recognised standard setting body. CITB will develop the standards and maintain those standards on behalf of the industry. ARMI, as the SRO, will direct CITB on what those standards should be. CITB’s remit is to work to the recommendations the sector representatives suggest to ensure a standard which; would be consistently applied, is deliverable within the agreed standard framework and which training providers can map their provision against.

How to reduce skills gap in industry… Trailblazer Apprenticeship for Asbestos Analysts and Surveyors Trailblazer Apprenticeships and Funding Today employers are at the forefront of the development of apprenticeships and learning; creating people with workplace skills that are relevant to business and industry. The term ‘Trailblazer Apprenticeship’ is used when a group of employers work together to design new apprenticeship standards for occupations within their sectors. In April 2017, the Institute for Apprenticeships (IfA) was set up by the Government to oversee and approve all trailblazer apprenticeships in the UK (previously with the Department of Education). Also in April 2017, the Government introduced the Apprenticeship Levy, whereby employers with a wage bill of >£3,000,000 will pay 0.5% of their staff cost into this fund. These funds - which will get a 10% top-up from Government (England) - can then be drawn upon for training and assessments of apprentices, limited up to a certain maximum funding band. It is estimated that 22,000

The Asbestos Analysts and Surveyors Apprenticeship scheme has been designed for any organisation thinking of recruiting new staff to conduct asbestos fibre counting and 4-stage re-occupation tests, bulk asbestos identification and surveying for asbestos containing materials.

he Asbestos Testing and Consultancy Association (ATaC) will be supporting Contamination Expo Series 2017 by exhibiting and discussing some of the legal duties on asbestos management. During the seminar, Stephen Platkiw, ATaC Manager, will discuss the Control of Asbestos Regulations 2012 (CAR 2012) and Construction (Design and Management) Regulations 2015 (CDM 2015), and the roles of the client, analyst and asbestos

What is the status of this new Trailblazer Apprenticeship scheme? Due to new management (IfA) and guidance, the Asbestos Analysts and Surveyors Trailblazer Apprenticeship scheme has been reviewed and a revised standard is now awaiting approval. The funding cap for this apprenticeship remains as previously allocated, £9,000. This trailblazer apprenticeship scheme will include three RSPH qualifications, which are all Ofqual regulated - RSPH Level 3 Award in Asbestos Surveying, RSPH Level 3 Award in Air Monitoring and Clearance Procedures and RSPH Level 3 Award in Asbestos Bulk Analysis. The scheme will also include a number of training modules covering asbestos removal, plans of work and risk assessment. On successful completion, an apprentice will have a unique skill set. Now the scheme is in the new approval process the Trailblazer Group is working towards availability by end of the year.

ATaC adds Full Decontamination to Analyst Qualification

Association supports industry following HSE report findings

O

n the 24th May 2017, ATaC announced that all candidates taking the RSPH Level 3 Award in Air Monitoring and Clearance Procedures with the Association will undertake full decontamination. A key finding of the “Asbestos Analysts Inspection Programme 2014/2015”, commissioned by the Health and Safety Executive (HSE), highlighted that analysts’ decontamination procedures were poor, due to no written procedures and no practical training provided. Some analysts were not following procedures putting themselves at risk, by wearing domestic clothes underneath overalls, were unshaven, and unsure how to use a DCU for decontamination. When delivering the RSPH Level 3 Award in Air Monitoring and Clearance Procedures, ATaC, has always used an actual DCU so all candidates are familiar with the unit and are walked through the decontamination procedure. Following the report findings, ATaC took immediate action by enhancing the decontamination content of this

qualification. Now all candidates will undertake full decontamination. This means that candidates, as well as being taught when to use a DCU and the decontamination procedure, will now physically go through the full decontamination process, including showering. “When we heard this finding from the HSE report, we looked at how we could further support the industry. When we deliver the RSPH qualification we cover all these findings, however we thought we could take it a step further by including full decontamination,” stated Stephen Platkiw, ATaC Manager. “This enhancement will increase the analysts’ competency and safety.” “This is a very positive move by ATaC, as it will support the health and safety of analysts, and the professionalism of the analytical industry,” commented Richard Burton, Director of Qualifications at The Royal Society for Public Health (RSPH). Surveying company fined £4,500 over asbestos claims

A

Scottish surveying company has been fined £4,500 after putting up false claims on its website. The Press & Journal reports that Ask Environmental Solutions was reported to Aberdeen Trading Standards in November 2015 over the qualifications it claimed to hold. Court papers show the company falsely claimed it could carry out asbestos removal as a member of the Asbestos Removal Contractors

Association and the Asbestos Control and Abatement Division. The claims were put on its website from an address on Montgomery Road in Edinburgh. The company’s director, Kriss Ferrier, of Wester Kippielaw Drive in Dalkeith, appeared at Aberdeen Sheriff Court last week. His solicitor John Good said he had not carried out any asbestos removal. He said: “My client works as a surveyor; he

would go round to people’s houses and tell them what work they needed done and then bring in somebody who was qualified to do it.” Sheriff Malcolm Garden said: “This is quite a serious misrepresentation, letting people think they were getting one thing and then they were getting another. “I will impose a financial penalty of £1,500 for each of the three charges.”

arroerock Construction Limited has been fined after repeated asbestos failings. Canterbury Crown Court heard yesterday how the Health and Safety Executive (HSE) carried out two investigations of working practices of the site in 2013 and 2014 while Barroerock were converting into flats a former nine storey office building in Ashford, Kent, which was known to contain asbestos. The first investigation arose from a routine inspection during one of HSE’s refurbishment campaigns. The Court was told that while a refurbishment and demolition (R&D) survey had been carried out the company had failed to act upon it. This resulted in up to 40 workers being exposed to asbestos during the early demolition phase of the project. The second investigation culminated in a visit to the site in June 2014 following complaints being made about the health and safety practices at the site. It was found that despite engaging a licensed asbestos contractor to remove the remaining asbestos materials,

Construction company fined three quarters of a million pounds after asbestos failings dangerous practices were continuing. In addition the company was unable to provide documentation to show that asbestos materials identified in the survey had been correctly removed. When the work on site was halted for the second time about 160 people were working inside the building. It was found in both HSE investigations that these incidents could have been prevented if Barroerock ensured they had effective management controls in place to avoid the risk of exposure to asbestos. Barroerock Construction Limited of Langley House Park Road, East Finchley, London, who had pleaded guilty to two offences of breaching

Regulation 22 (1) (a) of the Construction Design and Management Regulations 2007 at an earlier hearing, has been fined £750,000 and ordered to pay costs of £14,874.68. refurbishment of the basement, a former restaurant unit, into a bar venue. An unannounced visit by the Health and

asbestos in the news Safety Executive (HSE) was conducted to inspect the ongoing refurbishment works. During the visit it was discovered there had been no asbestos survey carried out before tradesmen started stripping out the majority of the space. Hatters Taverns Limited of 50 Newton Street Manchester pleaded guilty to breaching Regulation 4(3) of the Control of Asbestos Regulations 2012 and was fined £10,000. Hatters Hostel Limited of 56-60 Mount Pleasant, Liverpool pleaded guilty to breaching Regulation 5(a) of the Control of Asbestos Regulations 2012 and was fined £24,000 and

ordered to pay the combined costs for both defendants of £10,232.50. Speaking after the hearing HSE inspector Matt Greenly said after the case: “Both Hatters Hostel and Hatters Taverns have failed in their duty to protect their workers, subcontractors and visitors to his site from harm. Asbestos related diseases are currently untreatable and claim the lives of an estimated 4000 people per year in the UK. “The requirement to have a suitable asbestos survey is clear and well known throughout the construction industry. Only by knowing if asbestos is present in any building before works

commence can a contractor ensure that people working on their site are not exposed to these deadly fibres. “The cost of an asbestos survey is not great but the potential legacy facing anyone who worked on this site is immeasurable. Exposure to asbestos fibres can potentially cause life shortening diseases in the long term and Hatters Hostel Limited and Hatters Taverns Limited should have taken more care to protect workers from a totally preventable exposure. This case sends a clear message to any company that it does not pay to ignore well known risks on site.”

Two companies fined following asbestos investigation in Surrey T wo companies have been fined after unsafe asbestos work was carried out on a property in Leatherhead, Surrey. Staines Magistrates’ Court heard how Kingsley Asbestos Services Limited (KAS), although a licensed asbestos removal contractor, was sub contracted by Bourne Valley Construction Services Limited (BVCS) to carry out the work.

KAS removed some asbestos containing materials and agreed to carry out repair works on other water damaged materials within the properties. During works to cut away damaged wall coverings in the kitchen, one of the workers cut into a pale coloured board which after subsequent testing proved it to be Asbestos Insulation Board. A Health and Safety Executive (HSE)

investigation found BVCS failed to plan the work and pass on information to KAS. It was the responsibility of both BVCS and KAS to arrange for a refurbishment and demolition survey. As a consequence work was carried out without establishing the location, presence and extent of asbestos containing materials on site. HSE Inspector Rebekah Dunn said: “Asbestos still kills around 5000 workers each year and around 20 tradesmen die each week as a result of past exposure. “BVCS were in control of the works and should have provided information identified in such a survey or assessment regarding the presence of asbestos to KAS as their subcontractor.” Bourne Valley Construction Services Ltd of Salisbury, Wiltshire, pleaded guilty to breaching Regulation 13 (2) of the Construction (Design & Management) Regulations 2007, was fined £8000 and ordered to pay full costs. Kingsley Asbestos Services Ltd of Ferring in Worthing pleaded guilty to breaching Regulation 5 (1) (a) of the Control of Asbestos Regulations 2012, was fined £6000 and ordered to pay full costs.

Bedfordshire based contractor has been fined after failing to carry out suitable assessment of asbestos removal work. Luton Magistrates Court heard how Anthony West was contracted to complete demolition work at a building in Biggleswade. West then had a pre-demolition asbestos survey carried out for the building. The Health and Safety Executive (HSE) had the demolition work reported to 16 April 2015 by a member of the public which prompted an investigation into the work. The investigation found that West did not adequately check the pre-demolition asbestos survey before carrying out the work, and did

Contractor fined for poor asbestos assessment not follow advice to use a licensed asbestos removal contractor. West, of Earwig Farm House, Pavenham, Bedford has pleaded guilty to breaching sections 5,7,8 and 16 of the Control of Asbestos Regulations 2012 and has been fined £2970 and ordered to pay costs of £5419. Speaking after the hearing HSE inspector Alison Outhwaite said: “The safety failings in

this case could have led to severe illness in later years. West not only put himself at risk to exposure but potentially to fellow workers and members of the public walking past. Duty holders have the responsibility to ensure that adequate assessments take place to avoid the risk of asbestos exposure. This includes checking the accuracy and clarity of any information provided by others.”

eing fully prepared for a licence renewal assessment is vital for asbestos removal businesses – even more so today, as in recent years’ licence restrictions and reduced terms have become increasingly common. To support members, ARCA offers a licence renewal preparation service, which covers a full review of the removal contractor’s systems and procedures to support the application for a full three-year licence. For maximum benefit, ARCA advise that reviews should be carried out six to twelve months prior to the licence renewal assessment meeting. This would enable improvements to be put in place, progress to be monitored and established procedures illustrated to the HSE at the assessment meeting.

Service Packages This service includes the analysis of existing performance history in order to give a clear indication of how arrangements are likely to be viewed by the HSE asbestos licensing unit and the assessing inspector. This process will identify any potential areas of weakness to be addressed prior to an assessment. With senior management, ARCA would discuss asbestos licensing, leadership and management. lients often place undue weight on formal enforcement, regardless of the reason it was served. Contractors often may not appreciate why the Health and Safety Executive (HSE) is taking enforcement action and what it means for the Asbestos Licensing Unit’s (ALU) perception of their management capabilities. Therefore, this article is a quick guide on health and safety enforcement for contractors and also for others involved in assessing health and safety performance, such as clients. Enforcement action of any kind is not necessarily an indicator of a general health and safety failure but should always provide a good opportunity for critical review. A company’s response to formal enforcement is often more useful as an indicator of the organisation’s culture and competence.

The Health and Safety Executive’s role As the Health and Safety Executive (HSE) is the health and safety regulator for the majority of asbestos sites and all asbestos licensing decisions. HSE’s general aim is to ensure that duty holders manage and control the risks they create. HSE provides published information and verbal advice. Inspectors also enforce by: w Providing written information on legal breaches; w Requiring improvements in risk management (e.g. Improvement Notices); w Stopping certain activities (e.g. Prohibition Notices); and w Bringing prosecutions where there has been a serious breach of law. Enforcement enables HSE to tackle immediate risk and ensure anyone breaching the law is held to account, but it also promotes general legal compliance (it ‘sends a message’ to the wider community). HSE’s Policy Statement (referenced at the end of this article) describes the purpose and principles of enforcement. HSE action needs to be “proportionate”, “targeted” and “consistent”.

The Enforcement Management Model (referenced at the end of this article) describes a process to help inspectors arrive at consistent enforcement decisions.

The implications of licensing As a licensed industry, asbestos removal contractors receive a high degree of oversight from the regulator: inspectors will write to them regarding failures to follow industry and management standards, in addition to legal breaches. Licence holders and clients tend to put much greater weight on notices than ALU. Formal notices do receive ALU attention, but licence action is typically associated with a “pattern of poor performance” or suggestions of “ineffective management arrangements”; formal enforcement notices do not necessarily demonstrate this. ALU’s main concern is likely to be the overall effectiveness of an organisation’s management arrangements: written exchanges or inspection reports are the typical sources of evidence. Who and why? Ofqual, the Office of Qualifications and Examinations Regulation, is the regulating body for qualifications, examinations and assessments in England.

O

fqual’s role is to maintain standards and confidence in qualifications in England such as, A Levels, AS Levels, GCSEs and vocational qualifications. Set up in April 2010 under the ‘Apprenticeships, Skills, Children and Learning Act 2009’ and the ‘Education Act 2011’, Ofqual is a non-ministerial government department, totally independent of government and report directly to Parliament. Ofqual has a team of 191 permanent employees (as of March 2014) to deliver its objectives.

Independent Regulator As the regulating body for England, Ofqual is responsible for making sure that: w regulated qualifications reliably indicate the knowledge, skills and understanding students have demonstrated w assessments and exams show what a student has achieved w to ensure the public have confidence in the qualifications they regulate w students and teachers have information on the full range of qualifications they regulate.

Guidance for Commercial Clients W

hether a property owner, construction manager, facilities / estates manager or asbestos manager, as the client you have legal responsibilities with regard to health and safety, and managing asbestos. In summary these are: The Health and Safety at Work etc Act 1974, under Sections 2 and 3, commercial clients have a duty to ensure the health, safety and welfare of their employees and any persons who visit their premises or may be affected by work done on their premises. Also, property owners and managers have a legal responsibility, under the Control of Asbestos Regulation 2012 (CAR 2012), to manage asbestos in the workplace. It requires the duty holders to identify the location and condition of asbestos in the workplace and to manage the risk to prevent harm to anyone who works on the building or to building occupants. Additional responsibilities are placed on clients by virtue of the Construction (Design and Management) Regulations 2015 (CDM 2015), they require clients to make suitable arrangements for managing an asbestos removal project, and maintain and review these arrangements throughout.

Guidance and support The human cost of asbestos disease is devastating and significant exposures are entirely avoidable. When asbestos is managed well, inadvertent exposure is prevented and asbestos will be dealt with in a controlled and safe manner. The financial and reputational costs of getting asbestos management wrong are substantial. Although at the head of the procurement chain, clients are not expected to be ‘experts’ in either construction work or asbestos work, and do not need to directly manage or supervise the work themselves. However, they are responsible for ensuring appropriate arrangements are in place to manage and organise projects during both the ‘pre-construction’ and ‘construction’ phases of the project, so the project is carried out in a way that manages the health and safety risks. When asbestos removal is required clients need to appoint suitably competent people, therefore they need to make reasonable enquiries to satisfy themselves that contractors are appropriately resourced and competent for the work. To support clients, ARCA operates an audit scheme, where by asbestos removal contractors

need to complete two satisfactory site audits to join the Association, and then require two satisfactory site audits every year to maintain membership. To take a further step towards supporting consistent high standards and a higher level of reassurance, ARCA enhanced its audit scheme in January 2017. Members still need to complete two satisfactory site audits every year, however, ARCA audits are now unannounced. Meaning that ARCA members (excluding Ireland) will not have prior knowledge of when, or where, an ARCA auditor will be assessing their performance. This has been made possible with support from the HSE, by supplying type of asbestos removal work, and location and date information from contractors’ notification form (ASB5). Audits are a method of monitoring performance, and with ARCA site audits being unannounced, they provide an even stronger system of reassurance for clients. Also, to support clients ARCA has made available a guidance document – ‘Guidance on Clients Responsibilities on appointing Asbestos Contractors’ - which is available as a free download in the clients’ section of the ARCA website.

R

eflecting on the recent WannaCry attack, we should all take cyber security more seriously. Evidence suggests that we will be starting from a low base point with the 2016 Ipsos MORI Cyber Security Breaches Survey 2016 revealing that only 29% of surveyed companies had cyber-security policies and just 10% had formal incident management plans. The most recent annual Crime Survey for England and Wales revealed that almost one in 10 people have fallen victim to online fraud, making it the most common crime in the UK. It is far more prevalent than domestic burglary and more complex, with criminals using numerous methods from malware to spyware to ransomware to access and exploit data for financial gain. The WannaCry attack once again highlighted the vulnerability of IT systems. Much criticism has been levelled at the NHS and the way it manages information security but its approach, fallible or otherwise, will be far more sophisticated than that deployed in the majority of businesses.

What is Ransomware? Ransomware is a malicious software that encrypts or blocks access to system data and then demands payment of a ransom to release it.

How common are Ransomware attacks? Ransomware has become one of the world’s biggest cyber security threats. According to FBI statistics, hackers extorted over $209 million in ransomware payments in the first three months of 2016.

Don’t cry, help is at hand. Recent research conducted by security firm Malwarebytes revealed that 54% of UK companies surveyed had been the target of a Ransomware attack with one-third of businesses loosing revenue as a result. Although the sums demanded have historically been modest, or at least small enough for a business to absorb, they are steadily increasing. The Malwarebytes survey found that a fifth of British companies who had been affected by Ransomware were charged more than $10,000 to unlock their files, and 3% of the demands were in excess of $50,000. A business might incur further financial losses, of a potentially far greater magnitude, if system data is destroyed entirely, leading to significant business interruption.

Sophisticated targeting Historically cyber criminals have generally indiscriminately ‘knocked’ on lots of system ‘doors’. When they find an open one – for example a system that is unprotected or easy to access – they enter. Very few of us leave our house unlocked, and yet many leave the virtual door to their businesses open. Industry specialists suggest that attackers are using increasingly sophisticated methods to identify not only vulnerable systems but also those systems that contain valuable

data. These are known as targeted extortion attacks. Understanding the value of the targeted data hackers then demand a large payment for its safe release. This can create significant collateral damage and put a business in financial jeopardy.

Managing the threat: Symantec predicted a 35 per cent rise in ransomware attacks in 2017. You must ensure you are prepared. The guidance below is by no means comprehensive but constitutes the basic steps that all firms should be taking. 1. Don’t ignore the patches that are available and apply them across all devices including mobiles and laptops. 2. Don’t allow staff to install software on their desktop PCs or laptops without authorization. 3. Restrict access to sensitive parts of the company system. 4. Back up all data regularly to a system that is completely separate to the main system. 5. Ensure that all of your staff know how to respond and provide regular training. If you aren’t absolutely confident that you comply with all of these recommendations, your system is exposed and Cyber Liability insurance could be critical.

Why? In the case of a traditional burglary there is little you can safely do to mitigate the impact of the crime once the criminals are inside your property. Cyber attacks are very different with the response to the attack playing a key role in influencing the damage inflicted. An informed, immediate reaction can be the difference between zero damage and severe damage. Cyber liability insurance provides 24/7 access to an incident response team that will help you manage everything from communication with your clients and employees through to the provision of identity theft mitigation services and assistance with managing your reputation. The team will collectively ensure your business is fully operational as soon as possible, which is critical in the case of a ransomware attack. Few firms have access to the expertise that is provided by a cyber liability insurer’s incident response team in house, and equally few will know which third-party providers to turn to. Furthermore, that expertise, if sourced independently, will be expensive. A cyber-liability policy will not only ensure you know where to turn, it will also cover the cost.

Why aren’t more firm buying cyber liability cover? Perhaps because of the use of the term insurance and the big numbers often cited in the press, the value of cyber-liability cover is generally assessed on its ability to cover a financial loss. As a result, the buying decision is heavily influenced by whether or not that financial loss would be covered by another form of insurance such as professional indemnity insurance (PII). Cover for many of the financial losses that could arise as a result of a cyber attack is currently provided by other forms of insurance, so firms are understandably reluctant to buy a stand-alone cyber policy.

At this point, let’s review that Ipsos MORI survey again – only 10% of companies have formal incident management plans in place. This suggests that 90% of companies are unlikely to know what to do if they are attacked. Good-quality cyber cover starts at just a few hundred pounds – less than the typical home insurance policy – whereas the cost of managing a breach can easily run into hundreds of thousands. So why aren’t more firms buying stand-alone cyber cover?

Many of these other forms of insurance, for example PII which is designed to cover third party losses arising from the conduct of business, are however, largely untested in terms of their response to cyber attacks, and this cover may not always be available. Furthermore, unless your PII policy contains a first-party fidelity extension, it is unlikely to offer any protection for loss of your business’s own funds. A cyber liability policy does offer valuable cover for some financial losses, but it is principally designed to help you mitigate an incident by providing immediate access to the specialist expertise required to minimise the impact of an incident.

Members’ plans to support Charity Week I recently spoke to a number of members who are already planning events to support the ARCA Charity Week 2017, from dusting down their bikes to taking on a muddy obstacle race.

Rhodar A team from Rhodar’s Burton upon Trent office have signed up for a Wild Warrior. This is muddy fun run with lots of interesting obstacles, including: free fall, walk the plank, cresta run, tightropes, tunnels, giant walls, fire, balance beams, mud, water and the assault course. The majority of the team of 12 are aiming to cover 10k, with a few members planning to complete the 5km course. Good luck to all on 23th September. Thank you all for supporting ARCA charities … raise money and have fun!

LAR LAR is arranging a bike ride to coincide with the ARCA Charity Week and raise money for the ARCA Charities. They are hoping for a great day out riding, with LAR staff, professional riders and clients joining in. There will be two routes, both starting from Mottram Hall in Macclesfield, with one route at 81.6km and the other slightly shorter at 52.6km. Both routes will include a lunch break, for example the shorter route will stop after 21km at Jodrell Bank. Good luck to all on 15th September. Thank you for supporting ARCA charities … we hope you all enjoy the day and the weather stays fine

NIC Abseiling down the Roaches in the Peak District, that is 100ft, is a challenge six of the NIC staff have set themselves. Let’s hope the weather is good, so the guys can take in the stunning scenery. The staff are also planning more activities, including cake bake, a pie and ale lunch (I understand ladies will be making pies and another member of the team is going to brew an NIC ale). Also, some have set themselves a challenge in the gym with a circuit competition and the girlies are organising a relaxing lunch out, with all ticket money going to the Charity Week. Lots planned! I hope you call have a fun week and thank you all for your support.

Welfare facilities for asbestos removal work T

he legal requirements for welfare facilities at asbestos removal sites are very well defined and have been in place for a long time. This means that any failure to provide adequate welfare could have serious implications for HSE’s confidence in a contractors’ general management arrangements. All contractors need to ensure that there are adequate facilities for workers under their control, and as a minimum should include: w Changing rooms & lockers (where workers need to change into special clothing) - the use of a functioning decontamination unit normally takes care of this requirement. w Toilets & washing facilities w Rest areas (incorporating a place for preparing hot drinks & eating food) w Access to drinking water Schedule 2 of Construction (Design and Management) Regulations 2015 (CDM 2015) describes these minimum welfare facilities required for all construction sites. Welfare requirements on contractors will apply regardless of whether or not the project is CDM 2015 “notifiable”. Proprietary ‘welfare units’ or ‘welfare vans’ are increasingly being used to fulfil the provision requirements. If such are not provided as a ‘unit’, the contractor will need to detail the provision of each component. (Also reference the ACoP L143, Managing and Working with Asbestos). A ‘suitable and sufficient’ plan of work for licensed asbestos removal will identify where / how each of the required facilities are to be provided. General / generic statements (e.g. “welfare to be provided by client”) do not

explain what site teams should expect on site. Contractors need to be able to demonstrate that clear agreements have been made as part of planning the work, details of which (not just a mere mention) will be included within the plan of work. In all cases, workers must have facilities that are readily accessible (open at all relevant times), provided at no cost to workers and of an acceptable standard. Complete welfare-provision often requires good cooperation, coordination and communication between client, contractor and principal contractor etc. It is imperative that welfare provision is planned, and not left to chance or for site teams to work out this employer’s duty once they get to site. On multi-contractor sites, asbestos contractors need to ensure that welfare arrangements are properly explored and clarified at the planning stage.

The inspirational winners of the 2017 Construction News Specialists Awards were crowned in front of the industry on Wednesday 22nd March at the Grosvenor House Hotel, London. These prestige awards are considered the Construction Industry “Oscars”. Cuddy Environmental were the only Welsh based company to be shortlisted and win an

award, along with being the only asbestos company to be shortlisted from the 131 finalists across the 18 categories. The Construction News Specialists Awards brought together over 750 of the UK’s leading specialist contractors for a glittering evening of celebration, recognition and networking. Cuddy Environmental won in recognition of the way the “company approached the

category from a different angle, and showed they really go beyond the norm in terms of what they do and how they do it. The company really understands their clients’ value drivers and know how to create a solution to overcome them - rather than being the cheapest and the quickest, they think through exactly what their clients need.”

DSL sees benefits of additional ARCA site audits

ver the last two years Demolition Services Limited (DSL) turned to ARCA to carry out additional site audits to provide a further quality control system to support the business. “We have arranged eleven additional audits with nine receiving Grade A. LAR celebrate 20th anniversary A

sbestos removal specialist LAR Ltd is celebrating its 20th anniversary with a company rebrand and various events including a charity bike ride. The Stockport-based company was formed following a management buyout of Laing Asbestos Removal (part of John Laing Construction Ltd) in May 1997. To coincide with the company’s 20th anniversary, the award winning firm has decided to refresh its logo and marketing materials and improve its online presence. LAR’s Development Director, Steve Hannah said: “LAR has steadily grown over the last

indsor Waste Management has launched a new ‘Harrier’ Van Collection Service in order to provide asbestos removal contractors with even more flexibility when dealing with their asbestos waste. Harrier provides a same day collection service for orders within the M25 area and a next day collection service nationwide. Dean Newton, Group Sales Director Windsor Integrated Services Group commented:

Our corporate image has been the same for last 20 years and to coincide with the anniversary we thought it would be good to have a refresh.” To coincide with ARCA’s Charity Week in September, LAR has arranged a charity bike ride for clients and staff members to take part in. money raised will be donated to ARCA’s chosen charities.. Following LAR’s anniversary celebrations, the company is looking towards the future. Steve said: “We have just opened a new waste transfer facility at our HQ to meet the demands of the business. We are also in the process of commissioning the installation of a high-quality training facility within the Head Office building, so there is a lot to look forward to. We are committed to investing back into the business in order to continually improve our service offering.”

Windsor launches new ‘Harrier’ Van Collection Service “This service extends our already popular van collection service which provides a cost effective alternative to skips for smaller quantities of asbestos waste or perhaps for sites with restricted access or limited space. We are continually looking at ways to improve our service offering for our customers and by extending this service to same day collections, we are providing our customers with even more choice and greater flexibility.” The van collection service which was

originally launched in Spring 2013 has proved a popular addition to the service portfolio. The service is suitable for both cement bonded and fibrous asbestos, with double-bagged asbestos, wraps and boilers collected by skilled and experienced staff in sealed vans and transferred to a fully licensed asbestos transfer station for compliant disposal. How to get better at the things you care about M

ost of us go through life trying to do our best at whatever we do, whether it’s our job, family, school or anything else. I feel that way. I try my best. But some time ago, I came to a realisation that I wasn’t getting much better at the things I cared most about, whether it was being a husband or a friend or a professional or teammate, and I wasn’t improving much at those things even though I was spending a lot of time working hard at them. I’ve since realised from conversations I’ve had and from research that this stagnation, despite hard work, turns out to be pretty common. So, I’d like to share with you some insights into why that is and what we can all do about it. What I’ve learned is that the most effective people and teams in any domain do something we can all emulate. They go through life deliberately alternating between two zones: the learning zone and the performance zone. The learning zone is when our goal is to improve. Then we do activities designed for improvement, concentrating on what we haven’t mastered yet, which means we have to expect to make mistakes, knowing that we will learn from them. That is very different from what we do when we’re in our performance zone, which is when our goal is to do something as best as we can, to execute. Then we concentrate on what we have already mastered and we try to minimise mistakes. Both of these zones should be part of our lives, but being clear about when we want to be in each of them, with what goal, focus and expectations, helps us better perform and better improve. The performance zone maximises our immediate performance, while the learning

zone maximises our growth and our future performance. The reason many of us don’t improve much despite our hard work is that we tend to spend almost all of our time in the performance zone. This hinders our growth, and ironically, over the long term, also our performance. For example, research shows that after the first couple of years working in a profession, performance usually plateaus. This has been shown to be true in teaching, general medicine, nursing and other fields, and it happens because once we think we have become good enough, adequate, then we stop spending time in the learning zone. We focus all our time on just doing our job, performing, which turns out not to be a great way to improve. But the people who continue to spend time in the learning zone do continue to always improve. The best salespeople at least once a week do activities with the goal of improvement. They read to extend their knowledge, consult with colleagues or domain experts, try out new strategies, solicit feedback and reflect. The best chess players spend a lot of time not playing games of chess, which would be their performance zone, but trying to predict the moves grand masters made and analysing them. Each of us has probably spent many, many, many hours typing on a computer without getting faster, but if we spent 10 to 20 minutes each day fully concentrating on typing 10 to 20 percent faster than our current reliable speed, we would get faster, especially if we also identified what mistakes we’re making and practiced typing those words. That’s deliberate practice.

In what other parts of our lives, perhaps that we care more about, are we working hard but not improving much because we’re always in the performance zone? Now, this is not to say that the performance zone has no value. It very much does. When Beyoncé is on tour, during the concert, she’s in her performance zone, but every night when she gets back to the hotel room, she goes right back into her learning zone. She watches a video of the show that just ended. She identifies opportunities for improvement, for herself, her dancers and her camera staff. And the next morning, everyone receives pages of notes with what to adjust, which they then work on during the day before the next performance. It’s a spiral to ever-increasing capabilities, but we need to know when we seek to learn, and when we seek to perform, and while we want to spend time doing both, the more time we spend in the learning zone, the more we’ll improve.

So how can we spend more time in the learning zone? First, we must believe and understand that we can improve, what we call a growth mindset. Second, we must want to improve at that particular skill. There has to be a purpose we care about, because it takes time and effort. Third, we must have an idea about how to improve, what we can do to improve, not how I used to practice the guitar as a teenager, performing songs over and over again, but doing deliberate practice. And fourth, we must be in a low-stakes situation, because if mistakes are to be expected,


training news then the consequence of making them must not be catastrophic, or even very significant. A tightrope walker doesn’t practice new tricks without a net underneath, and an athlete wouldn’t set out to first try a new move during a championship match. One reason that in our lives we spend so much time in the performance zone is that our environments often are, unnecessarily, high stakes. In the companies I consult with, I often see flawless execution cultures which leaders foster to encourage great work. But that leads employees to stay within what they know and not try new things, so companies struggle to innovate and improve, and they fall behind. We can create more spaces for growth by starting conversations with one another about when we want to be in each zone. What do we want to get better at and how? And when do we want to execute and minimize mistakes? That way, we gain clarity about what success is, when, and how to best support one another. But what if we find ourselves in a chronic highstakes setting and we feel we can’t start those conversations yet? Then here are three things that we can still do as individuals. First, we can create low-stakes islands in an otherwise highstakes sea. These are spaces where mistakes have little consequence.

Second, we can execute and perform as we’re expected, but then reflect on what we could do better next time, like Beyoncé does, and we can observe and emulate experts. The observation, reflection and adjustment is a learning zone. And finally, we can lead and lower the stakes for others by sharing what we want to get better at, by asking questions about what we don’t know, by soliciting feedback and by sharing our mistakes and what we’ve learned from them, so that others can feel safe to do the same.

For example

Real confidence is about modelling ongoing learning. What if, instead of spending our lives doing, doing, doing, performing, performing, performing, we spent more time exploring, asking, listening, experimenting, reflecting, striving and becoming? What if we each always had something we were working to improve? What if we created more low-stakes islands and waters? And what if we got clear, within ourselves and with our teammates, about when we seek to learn and when we seek to perform, so that our efforts can become more consequential, our improvement never-ending and our best even better?

ARCA sets up practical scenarios in controlled environments, at their training facilities, thereby creating a ‘low stakes island’. These practical simulations provide the learning opportunities. For example thoroughly reviewing asbestos removal site audit reports is not just a way of identifying improvements but active learning opportunities. Working out the who, what, where, when, why and how that lead to a specific situation. These are just two examples we can apply to the asbestos removal industry.

New ARCA Training Venue in Bristol

RCA is pleased to announce a new training venue in Bristol, following a partnership with SMH Products Ltd (an associate member of ARCA). “This new training venue is a great way to support our members. We are extremely grateful to SMH for agreeing to share their training facilities with us,” commented Satish Patel, Training Manager at ARCA. “It’s an excellent facility offering both practical areas and classrooms, which we used for the first-time last month to hold a Licensed Contract Manager training course.” To support members in the South West & Wales, ARCA is now offering Operative, Supervisor and Contract Manager training courses at the SMH facility in Avonmouth. The training courses being held at the Bristol venue are included on pages 43 and 44.
