Terms & Conditions of Membership of St Mary’s Students Union Sports Clubs Length of Term: Membership valid until the 31st of July 2018 Membership Fees: The charges payable for your category of membership as set out on the SMSU website. Services: The Contract entitlement for usage of St Mary’s University facilities. Trading as: SMSU (St Mary’s Students’ Union) charity registration number: 1173502 The Business Address: St Mary’s Student’s Union, St Mary’s University, Waldegrave Road, Twickenham, TW1 4SX By purchasing a Sports Club membership for the academic year, you acknowledge and agree that:  You are eligible to join (on paying the appropriate club membership fee), any or the entire sports clubs of St Mary’s University.

1. Supply of the Service 1.1 St Mary’s University, Students’ Union and its constituent Sports Clubs shall provide the activities and services to the Member subject to agreement to the conditions to within this document.. 1.2 St Mary’s University and Students’ Union may at any time without notifying the Member make any changes to the Services which are necessary to comply with any applicable safety or other statutory requirements, or which do not materially affect the nature or quality of the Services, or which in the opinion of St Mary’s University and Students’ Union are reasonably necessary to protect the interests of St Mary’s Student’s Union members.

2. Fees 2.1 The Member shall pay the appropriate Membership Fee as listed for the Club/Clubs the member wishes to join. This membership fee is for the provision of the services and associated costs to the club. 2.2 All fees quoted to the Member for the provision of the Services are inclusive of any value added tax. 2.3 Payment of the membership fee only entitles the member to be registered as a member of the club and for the member to be covered by St Mary’s Student’s Union Insurance. The fee is associated with all relevant club costs.


2.4 The Member shall in addition pay from time to time such charges and penalties as specified by the Student Sport Development Team where/when necessary. 2.5 Only current registered students may purchase a sports club membership. If you are not acurrent student your membership will be void.

3. Warranties & Liability 3.1 St Mary’s University and Students’ Union warrants to the Member that the Services will be provided using reasonable care and skill whilst acknowledging and discharging its Duty of Care. 3.2 The Member shall provide all information which is requested by St Mary’s University and/or Students’ Union; without prejudice to the rights and liabilities of the Member and of St Mary’s Students’ Union. St Mary’s Students’ Union shall not be liable for any loss or damage suffered by the Member which is caused or contributed to by the failure to provide any such information.

4. Termination and Refunds 4.1 The member may terminate the contract at any time. Requests for refunds will be dealt with on a case­by­case basis in accordance with the refund policy. If a member wishes to terminate their membership or believes they are entitled to a refund they should contact the Sports and Societies Administrator. The eligibility period for refunds is outlined within the refunds policy. 4.2 St Mary’s Students’ Union may terminate the Contract forthwith if the Member does not comply with the Rules.

5. General 5.1 These Terms (together with the terms, if any, set out in the Membership Sign­Up or by the club itself) constitute the entire agreement between the parties. 5.2 If any provision of these Terms is held by any court or other competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Terms and the remainder of the provision in question shall not be affected. 5.3 St Mary’s Students’ Union reserves the right to amend and change these Terms and Conditions, as it deems necessary in the best interests of St Mary’s Students’ Union and the Member.

6. Data protection 6.1. St Mary’s Students’ Union takes the privacy of members seriously. If you have any questions about how your personal information is used, please do not hesitate to get in contact.


6.2. St Mary’s Students’ Union will not pass your data to third parties. 6.3. All data is processed under the Data Protection Act 1998. By purchasing membership to a Sports Club the member agrees to act in accordance with the St Mary’s Student’s Union Constitution and the St Mary’s University and Student’s Union Policies (available online at www.stmaryssu.co.uk).

7. Clean Sport Committment All sporting participants have the right to compete in doping­free sport (Clean Sport). St Mary’s University adopts the UK Anti­Doping (UKAD) and World Anti­ Doping Agency (WADA) position that cheating, including doping, in sport is fundamentally contrary to the spirit of sport, undermining the otherwise positive impact of sport on society. All athletes are expected to play, train and compete in line with the spirit of sport, including the anti­doping rules.
