President’s Report to Annual General Meeting 2015 I would like to take this opportunity to make some observations about the year that has passed from SCA (WA) Inc’s point of view. At the beginning of the outgoing Council’s term, I summarised the Council’s strategic goals as simply “to do more and to be more”. What does that mean? By “doing more” I was referring to capacity. The goal was one that was about our day to day operations, the members serviced, the events conducted, the communications produced and the audience reached. I am pleased to be able to say confidently that we can tick this box. We have put on more education events this year than in any year preceding with more registrations were processed. We did an enormous amount of work getting across the STAR reforms, consulting with government about those reforms and documenting SCA (WA) Inc’s response. We have initiated improvements in governance, processes, and developed new policies. We are doing more in the public relations and advertising space. So it has been a busy year and a year that is full of achievements. What about “being more”? What does that mean and how do we rate against this goal? “Being more” was referring to not what we do but who we are. Ultimately it is about our relevance. It is about our value proposition to members. In many ways this is the more important side of the equation. To be frank, we have more work to do on this front. What I would say about where we have come in relation to this goal is: 1. That Council does have a vision; and 2. We are well positioned to achieve the vision because of who our members are. Our industry is relatively small. The Association is relatively small. But we can hit well above our weight because our members are, by virtue of the nature of who strata managers and strata companies are, that they are very in tune with civic principles, ideas about community, ideas about involvement, governance and volunteering. Our members are a truly great asset. We placed membership as an item on the Agenda for our Annual General Meeting because we see the work of the Membership Special Interest Group as being a most high priority. I call upon all of our members to engage wholly in the conversation that the Membership Special Interest Group is embarking on. I am convinced that it is this work on membership structure and benefits which is the key that will unlock the “be more” door. Once this key is turned, it must be members that lean into the doorway. The Association will be producing surveys of our membership and holding membership forums to gain insights from our members as to what they see the Association becoming in this regard. I would also like to make a few acknowledgements here. Ida Smithwick has ended her term on Council. She has served as President of the Association, the Immediate Past President and the convenor of the Professional Standards, Legal and Licensing Committees. She has also mentored many Councillors and staff over that time. She has made an enormous contribution over many years to the Association. On behalf of the Council I would like to thank Ida for all that she has done for the Association. Phill Geary is continuing to serve on Council but must end his term as Treasurer. As Treasurer Phill has been a truly valuable asset to the Association. He has given a massive amount of assistance to staff and ensured that Council has budgeted in a way that aligns with and supports the Association’s strategic goals. Again on behalf of the Council and our members, I wish to record our thanks to Phill for his invaluable services as Treasurer.
Are you covered for a Catastrophe? Over the years, CHU has stressed the importance of protecting owners by keeping building valuations up to date and annually adjusting insurance to reflect these increases. However, even a current valuation inevitably falls short in the event of a major disaster. Natural disasters in Australia and globally have clearly illustrated how the post-disaster escalation of costs can lead to a shortfall in cover. For example, after the Newcastle earthquake building costs increased by 35% and after Cyclone Tracey costs inflated by 75%. Each Australian State has legislation that requires strata property be insured for replacement conditions – but there is no distinction between replacement conditions following a ‘typical’ loss like fire, or a less common but far more extensive event like an earthquake. As illustrated historically, the replacement value following an event like an earthquake is likely to be significantly higher. Despite this fact many strata schemes do not have adequate protection and could unbeknownst to them be in breach of their State Act. If a catastrophe was to occur not only are the unit owners at risk of a substantial financial loss, but also the body corporate and strata managers could be exposed to litigation. CHU was the first in the market to recognise this problem and developed the Building Catastrophe Insurance. This specialised insurance not only provides the additional asset and lifestyle protection strata owners require but also ensures that bodies corporate and strata managers meet the requirement under the Act to insure for full replacement value. While some insurers recommend 15% or less catastrophe cover CHU normally recommends 30% – catastrophe cover, anything less is not reflective of the historical data of post-disaster cost inflation and is unlikely to provide the necessary protection for your owners. It is a small sum for the extra peace of mind afforded by this additional cover. Of course you can nominate a higher percentage than this too. This insurance cover can be either arranged as part of the residential and commercial insurance plan or as a stand alone policy if the building insurance is placed through another insurer. It is only in this way that the body corporate and strata managers can be protected against liability and owners will be protected against financial loss due to destruction of their building. It’s important to note that it is still imperative to keep the building valuation up to date for each renewal period. Catastrophe cover is not a ‘top up’ for under insurance. Purchasing strata insurance
A common perception is that unless you have saved money on your strata insurance purchase, you have not received value. Very little attention is often given to policy coverage, which is where the real value exists, and which can only be judged after careful review and weighing of all the terms, conditions, benefits and exclusions of any given policy. What occurs in reality, unfortunately, is that there is a focus on price alone – and there is an assumption that most things are covered and that claims are not likely to occur. The experience of those in any strata insurance claims department, however, is exactly the opposite. Complex, novel and unforeseen claims are happening all the time. The process of purchasing strata insurance could be compared to buying a mobile phone service: you can opt for a basic plan, or a plan full of additional benefits, depending on what your needs are and what you are prepared to pay to cover those needs. When buying your phone you will take into account the plan costs – but you will also research the handset features and benefits, supplier service reliability, and plan features such as how many free calls you can make and how many gigabytes of data are included. You also buy on reputation and reliability, that is – the confidence knowing your calls will not ‘drop out’ unexpectedly and the range of coverage suits where you live, work and travel to. So, overall, you satisfy yourself as much as possible at the outset that you aren’t buying a plan that ends up costing you more. Insurance is not a tangible product, and this is one main difference from most other purchases we make in life. We actually buy peace of mind, but this can only come through carefully reviewing and understanding what you have purchased. Don’t be complacent in assuming that all strata insurance policies are the same, or even similar –they are not. In your time of need, you want to know that the strata policy will respond, and the claims service will be prompt, professional, and generally exceed you expectations. MORE property buyers are seeking the high life, with new figures revealing the number of off the plan apartment projects advertised for sale has increased by 154 per cent in just three years. In New South Wales the figures were up 248 per cent, Western Australia, 133 per cent, Victoria, 127 per cent, Queensland 126 per cent and despite its reasonably small unit market South Australia listings on realestate.com.au jumped by 100 per cent. REA Group director of sales and marketing, Toby Balazs, said already there were 353 new apartment developments listed on the site which was the highest volume since August 2012. “This year alone we have seen a 48 per cent growth in the volume of projects on our site since last year,’’ he said. “There’s definitely a lot more people interested in buying off-the-plan apartments than there was three years ago, as they are starting to realise the benefits of inner city living,’’ he said.

In Western Australia off the plan demand was driven by a desire by locals to live in the city according the REA WA sales manager Alan Cook. There were now 100 off the plan projects advertised for sale compared with 43, three years ago. “Changes in Government height regulations has made it easier to develop new apartments, which has also increased density,’’ he said. Western Australia buyers were after gyms, swimming pools and entertaining areas with barbecue facilities.

RESOURCES FOR LANDLORDS FROM DEPT OF COMMERCE After the recent release of the media statement Landlord fined $24,000 for tenancy law breaches, it’s timely for landlords to ensure they are complying with tenancy laws. Substantial changes to the Residential Tenancies Act 1987 took effect over two years ago. Ignorance of the law is no excuse for using obsolete agreements, handling bonds improperly or failing to maintain a minimum standard of security. There are many resources available to landlords for free at www.commerce.wa.gov.au/landlords-pack including publications, tenancy forms, videos, a checklist and an e-learning guide. From time to time amendments to the Act result in minor updates to the forms and notices a landlord is required to use throughout the course of a tenancy. Landlords who don’t engage the services of a licensed real estate agency for their property management should make sure they are always using the most up-to-date version of the forms by sourcing them directly from the Department of Commerce’s website. Landlords and property managers may also like to encourage their tenants to use Consumer Protection’s free smartphone app iRentWA to assist them to keep track of deadlines and their other legal obligations.
