Indiana Boating Safety AGE RESTRICTIONS: All Motorboat operators in Indiana must have a valid driver’s license to operate on all public waters. Operators who are at least 15 years of age and don’t have a driver’s license may operate a motor vessel if they take a NASBL approved boater education course and have an I.D. Card issued by the Bureau of Motor Vehicles (BMV). PERSONAL FLOTATION DEVICES (PFD): Boats less than 16 feet long, and a canoe or kayak of any length, must have onboard a U.S.C.G. approved PFD for everyone onboard. Boats 16 feet and longer must have wearable PFDs for everyone onboard PLUS at least one throwable (Type IV) PFD. Personal Watercraft operators and passengers must wear an approved Type I, II, III, or V PFD. Required PFDs must be readily accessible. RECKLESS OPERATION: Reckless operation of a boat, when a boat is operated carelessly in willful disregard of the rights, safety, or property of others, is a crime in Indiana. Examples of reckless operation include: • Excessive speed in regulated or congested areas or during times of restricted visibility • Operating in a manner that may cause an accident • Operating under the influence of alcohol or drugs • Operating in a swimming area with bathers present • Towing water skiers where obstructions exist or a fall might cause them to be injured • Bow riding or riding on the gunwale or transom where no seating is provided • Operation of a personal watercraft which endangers life or property. EXHAUST MUFFLER REQUIRED: No person shall operate any powercraft without a muffler, underwater exhaust, or other device that muffles or suppresses the sound of the exhaust at all speeds. WATER SKIING/TUBING: No person shall tow a person on water skis, tube, or similar device without an observer (in addition to the boat operator) aboard to observe the skier and the towline. Water skiing/tubing is not permitted between after sunset and before sunrise. PERSONAL WATERCRAFT (PWC): Persons less than 15 years of age shall not operate a Personal Watercraft. Each person on a Personal Watercraft (PWC) must wear a Coast Guard approved PFD. Additionally, the operator must wear a lanyard type cut off
switch provided by the manufacturer which will shut off the PWC should the operator fall off. A PWC is a boat and operators of PWCs must obey all boating regulations and requirements. The operator of a Personal Watercraft should operate in a reasonable and prudent manner. When operating a PWC, DO NOT: • weave through congested traffic • follow a watercraft that is towing other individuals • jump the wake of another watercraft • cut between a boat and an individual being towed • cross paths with another watercraft when vision is obstructed • steer toward an object or person in the water and turn sharply at close range. Do not operate a Personal Watercraft at night. PWCs may be used to tow skiers/tubes if the PWC is designed to seat at least three people and is at least 10 feet long. Also, a person other than the operator must be onboard as an observer. BOAT LIGHT REQUIREMENTS: Boats under way between sunset and sunrise must display a green bow light on the starboard (right) and red bow light on the port (left), as well as an “all around” (visible from 360 degrees) white light on the stern. Boats at anchor must display one all around white light visible to any approaching crafts. Rowboats or paddleboats must have an all around white light ready to display in time to prevent collision. ENVIRONMENTAL AWARENESS: It is unlawful to litter in Indiana state waters. You should properly dispose of your litter on shore. In Indiana, the discharge of sewage from marine toilets is prohibited on all public waters. A boat equipped with a toilet must have a holding tank to store the waste that can later be disposed of at a shore-side facility. A free shore-side facility is available at the DNR boat ramp on Wawasee Lake. The boat may use a treatment system as long as it is approved by the Department of Environmental Management. What can I do to help prevent the spread of Zebra Mussels? • Inspect boat and trailer for weeds and remove. Zebra mussels are often found on aquatic plants. • Flush the cooling system, bilge areas, and live wells with tap water and discard all bait that may have contacted infested waters. • Let your boat dry out of the water for 10-14 days. If visibly fouled by algae wash the hull with hot water (140 degrees F), which kills zebra mussels. High-pressure spray will also help remove them. Indiana Boating Safety age greater than $200 must be reported within 48 hours to the Department of Natural Resources. BOATING WHILE INTOXICATED: Operating a boat under the influence of intoxicants is against the law. Refusal to submit to a test may result in loss of operating privileges for one year. SPEED LIMITS AFTER “OFFICIAL SUNSET”: No skiing, or any other activity requiring speeds in excess of 10 MPH may be engaged in between the official time of sunset and sunrise. Syracuse has a flashing beacon light on the NW corner of the lake (at the public pier) that starts flashing at sunset. DAMAGE TO MARKER BUOYS: The Lake Association has been charged by the Indiana Department of Natural Resources with the responsibility of placing and maintaining StateOwned Marker Buoys. These are placed less than 200 feet from shore in locations considered particularly critical as warning to boaters to keep their distance from shore (such as off point of land) or to reduce their speed (such as entries to channels). Intentional damage or other interference with these buoys is a crime against the State and carries a severe fine, a jail sentence, or both. These buoys are anchored with a chain and will probably damage a boat if hit. LEGAL DISTANCE FROM SHORE: It is unlawful to operate a motorized boat closer than 200 feet from the shoreline, unless coming or going from the shore; also to operate at greater than idle speed closer than 200 feet from shore. REGISTRATION/TITLING: All motorboats operated on the waters of Indiana must be registered and numbered. Motorboats legally registered in another state can be used in Indiana for 60 consecutive days before an Indiana registration is required.
The Bureau of Motor Vehicles handles the application for registration and fees are based upon the length of the boat. The BMV issues a certificate of registration and 2 decals indicating the class of your boat and the month and year of expiration. You must carry the registration certificate onboard when underway. A watercraft that is required to be registered in Indiana must have a certificate of title, except for the following: • A watercraft acquired by its owner before 1/1/86 • A watercraft that is less than $3,000 in value when new • A home-built watercraft Although these are excepted, you may want to title your watercraft as it verifies ownership, in case the boat was stolen. The number on your registration certificate must be attached or painted on each side of the forward half of the vessel where it can be easily read. The numbers and letters must be 3” in height, vertical, plain block characters in contrast to the hull color. The decals are placed to the right of, and within 3” of the registration numbers. Only the current decals shall be displayed. Indiana and federal boating laws are presented in a summarized form. The laws in their entirety can be found by consulting Indiana State Law. These laws are subject to change. It is the responsibility of the operator to be aware of the most current laws when using a boat. Certain bodies of water in Indiana have local restrictions as to type and size of watercraft or motor horsepower, restricted use areas, boat speed, and times for use. 312 IAC 2-4-9 GENERAL DUTIES OF A LICENSE HOLDER Sec. 9. In addition to the terms of the license and the requirements otherwise set forth in this rule, a license holder must do the following: (1) At least fourteen (14) days before the scheduled event, deliver a list of officials who will be present during the event. (2) Obtain permission from the department to use a zone or zones in the public waters for mooring, judging, weigh-in, starting or for any other activities using public facilities. (3) Upon the request of the department, meet with a designated authorized representative or representatives before a tournament or other organized activity begins. (4) Remove equipment and refuse and otherwise restore zones used in connection with a fishing tournament or other organized activity to condition that existed before the event as directed by the department. (5) Provide officials needed to supervise participants and spectators. (6) Require each participating watercraft to clearly display a logo, banner, or other visible item approved by the department to identify the tournament or other organized activity. (7) Establish a starting location for the tournament or other organized activity within an idle speed zone. (8) Refrain from and prohibit the sale of food, beverages, or supplies within the area of the activity unless approved in writing by the department and the owner of the area. (9) Refrain from obstructing ingress, egress, or regress from private property. (10) Assure reasonable access to all persons to public use facilities, including swimming areas, mooring areas, navigational channels, and similar facilities. Limitations on the usage of facilities must include the following: (A) Except as provided in clause (B), vehicles and trailers of contestants must use no more than seventy-five percent (75%) of the ramp and parking facilities in the staging area of the tournament. (B) The owner of the staging area may, in writing, authorize more than the maximum allowed usage under clause (A). This clause does not apply to a fishing tournament that is subject to section 12 of this rule. (11) Sponsor no more than one (1) event licensed under this rule on the same waterway with starting dates separated by less than fourteen (14) days. A tournament scheduled for two (2) consecutive days is considered a single event. The Division of Law Enforcement may authorize an individual to seek more than one (1) event on the same waterway, with starting dates separated by less than fourteen (14) days if in seeking the license the individual is acting as the agent for different tournament organizations. (12) Act in good faith to fully perform the event. A person who demonstrates a pattern of violations of this subdivision may be denied another license. Applicants signature

Is it Safe to Eat Your Fish? Eating recreationally caught fish from Indiana waters can be healthy and tasty when you have the proper information. The following section should alleviate most anglers’ concerns about eating wildcaught fish. It’s all about a person’s exposure to contaminants
over time. The two contaminants that drive the fish consumption advisory are mercury and polychlorinated biphenyls (PCBs). Both contaminants are generally persistent in the environment at low enough levels they do not pose a health risk from direct contact with the water. However, both contami-

nants accumulate in fish tissue. The contaminants accumulate in human tissue like they do in fish and can build to levels that could pose a health threat. The consumption advisory is based on a model that people are consuming 8 oz. of fish on 225 days each year over 70 years. A determination can then be made from concentrations of contaminants in fish tested as to how frequently they can be safety eaten (note the fish consumption advisory groups). The consumption recommendation groups range from 1 to 5 with 1 being
unlimited consumption and 5 being do not eat. Most anglers do not eat wild-caught fish nearly this frequently. As a result, if they are aware of the contaminant levels that likely are in the fish they catch, they should have little concern about eating them.

Indiana Fishing & License Regulations 2015 WHO NEEDS A FISHING LICENSE To fish in public lakes, streams, rivers or tributaries in Indiana or its boundary waters, you must have a valid fishing license that is signed in ink, or qualify for a license exemption. You must carry your license with you when fishing and present it to an Indiana Conservation Officer (or any authorized law enforcement official) upon request. There are fines and penalties for fishing without a license.

A fishing license may be revoked if the license holder is convicted of violating fish and wildlife regulations. Any equipment, appliances and apparatus used in the violation of Indiana fish and wildlife laws may be seized for evidence and, upon conviction, confiscated. To qualify for resident fishing licenses, a person must have established a true fixed and permanent home and primary residence in Indiana for 60 consecutive days prior to purchasing a license or permit and not claim residency for fishing, hunting or trapping in another state or country. All others are non-residents. To legally fish for or take trout and salmon from public waters, you must also have a valid trout and salmon stamp privilege and a valid fishing license (signed in ink). Waterfowl/Migratory Birds Migratory game birds include rails, doves, moorhens, woodcock, snipe, ducks and geese. Migratory game bird and waterfowl hunting dates are set by the U.S. Fish and Wildlife Service in cooperation with Indiana and other states. Dates are usually available in mid-August for early seasons and late August for regular and late waterfowl seasons. Check www.dnr.IN.gov/fishwild/2713.htm for updates to migratory bird season dates. State/Federal Regulation Reminders • In order to hunt ducks and geese in Indiana, all individuals must have an Indiana hunting license, an Indiana waterfowl stamp privilege and a free Harvest Information Program (HIP) validation number. Commemorative (traditional) waterfowl stamps do not convey hunting privileges. Additionally, all persons 16 years or older must have a signed Federal duck stamp to hunt waterfowl. Federal duck stamps are available at most post offices and online at www.fws.gov/duckstamps. State waterfowl stamp privileges are available from hunting and fishing license vendors and online at IndianaOutdoor.IN.gov. • Indiana enforces all federal migratory bird laws. Violating any provision of a state law regarding federally protected migratory birds is also a violation of federal law. • Migratory game birds may be hunted from a motorboat provided it is beached, resting at anchor, tied to a stationary object, or without motion other than that imparted by wind and current acting upon the 28
hull, or due to hand-operated oars or paddles. • Hunters may retrieve dead or injured birds by hand or from a motorboat under power but may NOT shoot from a boat under power or in motion due to motor power. • Migratory game birds in a hunter’s possession must have one fully feathered wing or head attached to the carcass for identification when the hunter is in the field or traveling from the field to home. • All migratory game birds killed or crippled shall be retrieved, if possible, and retained in the custody of the hunter in the field. • No person shall give, put or leave any migratory game birds at any place or in the custody of another person unless the birds are tagged by the hunter with the following information: • The hunter’s signature. • The hunter’s address. • The total number of birds involved, by species. • The dates such birds were killed. • No person or business shall receive or have in custody any migratory game birds belonging to another person unless such birds are properly tagged. Non-Toxic Shot Hunters are required to use approved non-toxic shot while hunting all waterfowl. Hunters are also required to use non-toxic shot to hunt mourning doves on all DNR properties. Coatings of copper, nickel, tin, zinc, zinc chloride, zinc chrome, and
fluoropolymers on approved nontoxic shot types are allowed. Lead shot plated with copper, nickel or other material does not qualify. The use of lead shot for hunting waterfowl was banned nationwide in 1991. It is illegal to possess shells loaded with anything other than approved non-toxic shot while hunting ducks, geese and coots anywhere in the state. It is illegal to possess lead shot while hunting mourning doves on any state-managed property. Waterfowl Hunting on State Areas Hunters can apply for reserved waterfowl hunts by completing the reserved waterfowl hunt application online at hunting.IN.gov.
