And we have to go back in time

to tell this story of this case.

In 1971, Tracy Shannon Zerb was born.

She was a

beautiful little girl and she would grow into a

Little Tracy's mother was

Now, she had a relationship with John McNamara.

John was deemed to be Tracy's father in order to pay

child support in the 1970s by court order.

married the father of three of her children.

During that time, Miss Nessl worked as a waitress at

in North Carolina. She had a second relationship that resulted in a

child, and that child, the last name of that person

was Craig, and the child born, and I hope I say this

5

correctly is Cyra or Cyra.

children with Vicky McNamara, who together -- they

were together in marriage for 28 years, plus dating

and divorce, 30 years.

This is a story that is painful to this family,

the McNamaras, in particular.

years older, so closer to 30, if not 30, entered into

a sexual relationship with him.

John McNamara was divorced, they were living mainly in

California.

But she came to know them and for a while I'm not sure if I'm going to get

in July of 2012, it must have been after nine at that

time of the year, they wanted to go see their beloved

know if she was eight or nine at the time, moved back

and went to Montana with Mr. McNamara on a vacation.

off the days, because I don't think it matters. I'm going to just abbreviate TMC for Mr. Tim McNamara. So this time Mr. McNamara went to North Carolina.

When he was in North Carolina, having spent a total of

less than a full week by then with Miss Nessl, he paid

$20,000 down on her mortgage.

youngest daughter again, flew back to Salt Lake

City -- all of this was plane fare by Mr. McNamara --

and went to Yellowstone.

Mr. McNamara paid $10,000 down for a new GMC truck for

During the Yellowstone trip,

Miss Nessl. When they returned, shortly after they returned,

custody of Cyra was awarded to Mr. Craig and Miss

13

Nessl was ordered to pay child support.

Mr. McNamara paid her child support.

In November of 2012, Miss Nessl stopped working

at Ruby Tuesdays and moved to Soap Lake by herself to

17

join Mr. McNamara.

began to pay Miss Nessl's North Carolina mortgage.

That same month, Mr. McNamara

He put her on his bank account.

credit card bills on her personal credit cards.

In January of 2013, the couple went to Belize.

Belize is on the Caribbean side of Central America,

kind of below and east of Mexico on the coast.

they loved it there and returned in February of 2013.

They could not marry in the state of Washington,

and so they looked at potentially doing so in Belize.

In October of 2013, after having gone and figured

these things out ahead of time, Mr. McNamara purchased

11

50 acres in Belize, and for $75,000, and put

Miss Nessl's name on it along with his own.

And then Miss Nessl's dream came true.

On

October 10, 2013 -- sorry, December, in a marriage

15

ceremony, without explaining the relationship between

16

the two of them, that was conducted by a neighbor,

17

named Miss Bardalez, who was kind of the community

18

counselor, marriage person, they were married.

This relationship caused great distress on the

20

McNamara side of the family.

at this point in the story, you can be certain that

23

there was tension between Mr. McNamara and his

24

children.

Which brings us to Christmas Day, December 25,

2014.

policy was set to expire.

Which, by the way, coincidentally, is two

this is August 31 of 2014.

How does he die?

Well, he dies by a gun.

where did this gun come from?

October 2014, Miss Nessl had flown back to North

Carolina.

Again, remember, they are not always

together.

She had flown back to North Carolina and

didn't write it down -- a gun shop, she bought a

24

Glock.

will show that the bed and breakfast would be up and

running within a week or two of Tim's death.

They were both very happy in Belize, but they both missed their families.

They had children from

previous relationships.
