TO: All Seattle Children’s Hospital child patients who received preventative treatment for aspergillus exposure at Seattle Children’s Hospital at 4800 Sand Point Way NE between December 2, 2016 and November 2019 and who suffered special and/or general damages as a result of theirprophylaxistreatment(the“Class”),andtotheirparentsorguardians.
ThisNotice(1)explainsalawsuitthathasbeenbroughtonbehalfoftheClass,(2)describeswhat parents of child class members must do if they wish to participate in this lawsuit on their own behalf (rather than on behalf of their children), and (3) explains what Class members and their parents must do iftheywishtopursueclaimsfordamages. Youarenotbeingsued.

1. WhyDidIReceiveThisNotice?
TheCourthasdirectedthisnoticetoadviseclassmembersofapendingclassactionontheirbehalf. Thepurpose ofthisnoticeistoinformyouthatyourrights (ortherightsofachildforwhom youcareor cared)maybeaffectedbyaclassactionlawsuitknownas Wills, et al. v. Seattle Children’s Hospital,No. 19-2-31648-9 SEA, filed in King County Superior Court and assigned to the Honorable Jim Rogers (the “Lawsuit”). You are receiving this noticebecause Seattle Children’s has identified you, your child, or a childforwhomyouarelegallyresponsible,asanindividualwhomaybepartoftheClass.

2. WhatIsTheClassActionAbout?
Three of the plaintiffs asserting claims in the Lawsuit—L.K., V.A. and T.H. (the “Class Representatives”)—allege Seattle Children’s was negligent in exposing its patients to Aspergillus, this exposureledtotheadministrationofprophylactic(preventative)treatmenttotheClass,andthosepatients suffereddamagesasaresultoftheirpreventativetreatment.
On December 21, 2022, the Court certified the Class for purposes of deciding the question of whetherSeattleChildren’sisliableoncertainclaimsarisingfromthepreventativetreatmentofthe Class (the“ProphylaxisClaims”). TheCourtcertifiedtheClassonlyforpurposesofadeterminationofSeattle Children’sliabilityformedicalnegligenceandpremisesliability,i.e.,thefailuretomaintainsafepremises. The Court denied requests to certify a class to pursue other claims or to pursue claims that Seattle Children’s conduct caused damages and, if so, how much, if anything, should be awarded in damages. The Court determinedthatissuesof whetherSeattleChildren’s alleged negligence caused damage to the Class Representatives and others, and the types and amounts of those damages, may be different among membersoftheClass. Asaresult,thoseissueswillberesolved,ifnecessary,basedonindividualclaims ofClassmembers.
3. WhoIsInTheClass?
The Class as defined above includes only the patients who received preventative treatment for Aspergillus exposure. Unlessthepatientsoptout,theyareautomaticallyincludedintheClass.
TheClass does not includeparentsorguardiansofpatientswithintheClass,evenifthosepatients are minors. Parents who wish to pursue claims on their own behalf, rather than just on behalf of their child,mustfilloutandreturntheJoinderFormdescribedinquestion11.
4. WhoIsRepresentingtheClassAndHowWillTheyBePaid?

Class Counsel shall advancethe costs of suit, such as expert fees and deposition expenses. They willbereimbursedforthecostsofsuitandcompensatedonlyfrommonetaryrecoveriesintheLawsuit,if any. Unlessyouretainyourowncounsel,youare not responsibletopayanycostsorfeesfromyourown moneyfortheliabilityportionofthiscase.
WhatAreMyOptions?
ThecertificationofthecaseasaclassactionforthelimitedpurposeofdecidingSeattleChildren’s alleged liability on the Prophylaxis Claims does not necessarily mean that money damages will be obtained from Seattle Children’s. Rather, the Court’s certification means the ultimate outcome of the question of liability on the Prophylaxis Claims, whether favorable or unfavorable to the Class Representatives, will apply to all Class memberswho do not timely elect to be excluded from the Class. ThismeansyourlegalrightsandinterestsarerepresentedbyClassCounselandtheClassRepresentatives forthisphaseoftheLawsuit.
IfyouorachildforwhomyoucareorcaredfittheabovedescriptionofaClassmember,youhave achoicewhethertoremaininorbeexcludedfromtheClass. Yourchoiceswillhaveconsequences,which youshouldunderstandbeforemakingyourdecision:
DoNothing. Ifyoudonothing,you(thepatient)willremainamemberoftheClass. Ifyou choosetoremainamemberoftheClass,anyclaimsyouhaveagainstSeattleChildren’sfor damages arisingfromprophylaxis treatmentasa resultofpotentialexposuretoAspergillus willbedeterminedinthisLawsuitandcannotbepresentedinanyotherlitigation.
If you choose to remain a member of the Class, you should NOT file the Request for Exclusiondescribedbelow.

Ifyouchooseto beexcludedfromtheClass,(1)youwillnotbeboundbyanydecisionin this case, whether favorable to the Class or favorable to Seattle Children’s, and (2) you
may present any claims you haveagainst SeattleChildren’s by filing yourownlawsuit or youmayseektointerveneindividuallyinthislawsuit.
IndecidingwhethertoremainintheClass,youmaywishtoconsiderwhetheryourindividualclaims maybe,ormaysoonbe,barredbyanystatuteoflimitations,thenatureandextentofyouand/oryourchild’s injuries and losses that you believe were caused by preventative treatment, and the potential expense and burdenofprovingliability separatefromtheClass. Thestatute oflimitationsreferstothe timeallowedto filealawsuit. Althoughmanyclaimsaretime-barredifnotfiledwithinthreeyearsofthedateofinjury,this dependsonthecircumstancesofeachcase.
You may consult with Class Counsel or your own attorney on these issues and on your decision whether to be excluded from the Class. If you choose to retain your own counsel, you are responsible for theirfees;youarenotresponsibletopayClassCounsel’sfeesfromyourownmoney.
6. WhatAreMyRightsAndObligationsIfIRemainAClassMember?
Ifyou(thepatient)remainamemberoftheClass:
TheClassRepresentativesandClassCounsel will actas your representativesand counsel for the purpose of determining Seattle Children’s liability, if any, on the Prophylaxis ClaimstheCourtcertifiedfortheClasstopursue.
If you wish, you may also appear through your own attorney at your own expense. You mayalsoseektointerveneindividuallyandmayadvisetheCourtifatanytimeyoubelieve that you are not being fairly and adequately represented by the Class Representativesand ClassCounsel.
Youwillnotberequiredtorespondtowrittenquestions,producedocuments,appearfora deposition,ortestifyattrialduringthephaseofthecasethathasbeencertifiedfortheClass to pursue. On the other hand, if you make a claim for damages, you may be required to answerquestions,andtoprovidedocumentsandotherevidence. Thenatureandextentof suchdiscoveryandevidencewillbedeterminedbyfurtherrulingsoftheCourt.
You will be entitled to notice of,and anopportunity to be heard respecting, any proposed settlement or voluntary dismissal of the Class claims. For this reason, you should notify Wills v. 7. WhatAboutMyPrivacyRights?
Under both state and federallaw, healthcare providers such asSeattleChildren’s are obligated to protecttheprivacy of yourhealthcareinformation. The Lawsuit arises from health careprovided to you or yourchild at Seattle Children’sHospital main campus in Laurelhurst. To date, Seattle Children’s has notdisclosedyouridentityto anyoneotherthantheAdministrator,whomtheCourthasapproved forthe purposeofmailingthisnoticeandreceivinganyresponseyoumayhave,andwhoisrequiredtomaintain theconfidentialityofyouridentity. YourinformationwillnotbedisclosedinthisLawsuit,eventoClass Counsel,withoutyourconsent,unlessyouplaceyourhealthoryourhealthcareatissue,suchasbymaking anindividualclaimafterconclusionoftheliabilityphaseofthecase.

HowCanIPursueADamagesClaim?
If Seattle Children’s prevails in the liability part of the case, then the Class has no claim and there will be no further proceedings. If the Class prevails in the liability phase, then the Court will promptly conduct additional proceedings to determine the amount of damages, if any, each Class member can recover. For this reason, it is important for you to decide soon whether you want to claim damages. Communicating your intentions may also help with any discussions regarding a possible resolution bysettlement.
ClassCounselrepresentClassmembers’interestsonlyforpurposesofestablishingwhetherSeattle Children’s is liable to the Class. For purposes of any damage claim, you may retain Class Counsel or
anotherattorneyofyourchoice,oryoumayproceedonyourownbehalf,withoutanattorney. Ifyouwish to pursue a claim for damages, you should fill out and return the enclosed Statement of Intention and Selection of Representation form to provide Class Counsel, Seattle Children’s, and the Court with an indicationofyourintentions. 11. WhatIfI’mAParent AndIWantToPursueMyOwnClaimForDamages?
ParentsofchildClassmembersarenotpartoftheClass. However,youasaparentmaybeentitled tobringanindividualclaimforyourownharms,ifany,relatingtotheinjuryofyourchild. Thoseharms may include the child’s health care expenses and other monetary losses, as well as loss of love and companionshipofthechild,lossofthechild’semotionalsupport,andinjurytoordestructionoftheparentchildrelationship. Tobringindividualclaimsonyourownbehalfasaparent,youmusteitherparticipate in this lawsuit or bring your own action within the applicable statute of limitations. You may consult ClassCounseloranotherlawyerontheseissues.
Ifyouwishtoparticipateinthislawsuitpersonally,andnotjustonbehalfofyourchild,youmust return the enclosed Parent Joinderform postmarked no later than May 19, 2023, to ensureyourtimely participation in the lawsuit.
