To comply with the deposit requirement, without prejudice to the applicability of Section 112 of CA No. 141, plaintiff shall deposit with the Honorable Court the total amount of FIFTY-SEVEN THOUSAND FOUR HUNDRED FIFTY-SIX PESOS (Php57,456.00), equivalent to 100% BIR zonal value of the total affected area of the subject property. 11. The property subject of this complaint is a parcel of land, identified as Lot No. 2412, PLS-13 situated in Brgy. Pange, Baroy, Lanao del Norte registered and declared for taxation purposes in the name of Corazon Valiente married to Espedito Valiente per Original Certificate of Title No. P-10578 and Tax Declaration No. H-130006(03), respectively.

30. The purpose of summons in actions quasi in rem is not the acquisition of jurisdiction over the defendant but mainly to satisfy the constitutional requirement of due process. 13. A careful scrutiny of Original Certificate of Title No. P-10578 shows that it was issued by virtue of a free patent pursuant to Commonwealth Act (CA) No 141. 25. Upon deposit of the provisional amount, plaintiff would have fully complied with the requirements for the issuance of a writ of possession as mandated by law. In a long line of cases, the Supreme Court ruled that, once the above requirements are complied with it, it becomes the ministerial duty of the trial court to issue the writ of possession in favor of the plaintiff, without need of any further hearing. Therefore, the Honorable Court can already immediately issue to the plaintiff an order to take possession of the property and start the implementation of the26.project.However, since the subject property is covered by Section 112 of C.A. 141 and defendants are not entitled to compensation for the Affected Area-Easement of Right-of-Way, the provisional deposit representing the 100% BIR zonal value of the said affected area amounting to FIFTY-SEVEN THOUSAND FOUR HUNDRED SEVENTY-FIVE PESOS (Php47,475.00) should remain in custodial egis until the issue on the applicability of Section 112 of C.A. 141 in this case is resolved with finality.

Believing that Zachary Alexander is his son, petitioner executed an affidavit of acknowledgment of paternity on November 15, 2019. Hence, the certificate of live birth of Zachary Alexander was amended and the latter then used the name Zachary Alexander C. Taylor. Sometime in the first week of June 2022, respondent Almarie Cailing Taylor casually told petitioner that he might not be the biological father of the minor so that the spouses decided to have a DNA test to determine the child’s paternity. Petitioner however agreed that whatever will be the outcome of DNA test, he will remain to be the father of the child as he loved the child as his own. The DNA result showed that the minor child is not petitioner’s biological child. Hence, the instant petition.
