The Sangguniang Panlungsod in its Resolution No. 2011-09-746 dated September 15, 2011 approves for the 5-hectare expansion of the sanctuary for the USA funded project: from RIDGE to REEF – An Ecosystem Based Approach to Biodiversity Conservation and Development in the Philippines, and in that connection, the World Fish Center has identified the Mobod Fish and Shellfish Marine Sanctuary as suitable area for their Community Based sea ranching of sandfish (sea cucumber) project. The intention will eventually amend the pertinent provision of Ordinance No. 38-99, known as the Fisheries Code of Oroquieta City. Likewise, said Fisheries Code has been lately amended embodying Ordinance No. 475-2012 dated July 26, 2012, among others, declaring a total fishing ban in the sea waters of Oroquieta City and imposing administrative fines/penalties. The Office of the City Treasurer in its letter dated August 16, 2012 & August 14, 2012 and endorsed by the Honorable City Vice Mayor to these committees, recommends specifics in the effective implementation of the city’s Fisheries Code as has been done in any other city ordinances. The Sangguniang Panlungsod finds the wisdom of the Office of the City Treasurer logical. Due to the serious threat of marine resources, the text of the city’s Fisheries Code enacted in 1999 is patterned from R.A. 8550 with some modifications on the penalties (including the rates of penalties in its violations.) Moreover, there are locally provided local offenses with corresponding rates of administrative fines. It is very conclusive that in every law and ordinance for that matter, there is a question of how the essence of the objective could be effectively implemented, without being too harsh to the violators who in most instances are fishermen trying to earn for their daily living. What is needed is their understanding and cooperation and their discipline in order to become a law abiding citizen. There is a dire need to strictly implement the provisions of the subject ordinance for the welfare of the community, restore the dwindling natural resources and attain a balance ecology in the territory of Oroquieta City. Evidently, it is not a simple undertaking in implementing the city’s Fisheries Code. Human resources plays a vital role. Thankful enough that the existing deputized fish wardens by the Department of Fisheries and Aquatic Resources and the present volunteer fish wardens by the Honorable City Mayor residing along the coastal areas are joining hands of the city’s thrust to help protect the city’s dwindling marine lives. Hence, there is no other way that the City Government could give back of their support but to provide incentive to apprehensions. In view of the different applicable penalties in the Fisheries Code: 1) violations of R.A. 8550 Administrative Order No. 190 of the Department of Agriculture, and of the Revised Penal Code of the Philippines, on the one hand, 2) local offenses, on the other hand there is a need to amend its pertinent provisions for purposes of clarity in its implementation apart from minor re-arrangement of articles and sections as a result of the newly added provisions. As far as sanctions are concerned, amendments have been introduced by providing administrative provision to lessen the application expectedly to attain the objective of compliance of the ordinance without necessarily staining the records of the offender, thus: ORDINANCE NO. 498-2012 AN ORDINANCE TO FURTHER AMEND ORDINANCE NO. 3899, OTHERWISE KNOWN AS THE BASIC FISHERIES CODE OF THE CITY OF OROQUIETA. Be it enacted by the Sangguniang Panlungsod of Oroquieta City, in session assembled, that: Section 1. Ordinance No. 38-99, Art 2, Definition of Terms thereof Section 82-A Fish Sanctuary, shall be redesignated as Sec. 83, and the terms Deputized Fish Wardens and 12 Coastal Barangays shall be added in the definition of terms to be designated as Sec. 84 and Sec. 85, respectively, as follows: Sec. 84. Deputized Fish Wardens - For purposes of this Ordinance are those who have undergone seminar conducted by the Bureau of Fisheries and Aquatic Resources authorized to enforce the provisions under RA 8550, and are also authorized to enforce the provisions of this Ordinance considered as local offenses. This also includes fisherfolks, Barangay Officials, Barangay Tanods of the 12 coastal barangays of the City of Oroquieta who are deputized by the City Mayor to implement provisions of this ordinance considered as local offenses. Sec. 85. Twelve Coastal Barangays. - Are those Barangays, namely: Taboc Sur, San Vicente Bajo, Taboc Norte, Canubay, Pines, Mobod, Dulapo, Poblacion 1, Poblacion 2, Lower Loboc, Paypayan and Tipan. Section 2. Ordinance No. 38-99, Art. 14-A thereof shall be amended by increasing from 20 has. Fish Sanctuary to 25 hectares which shall read, as follows: ART. 14-A. Section 3. Ord. No. 38-99, shall be amended by adding new provisions as ART. 33, which new provision shall read as follows: ART. 33. Incentives to deputized fish wardens, fisherfolks, barangay officials, barangay tanods of the 12 coastal barangays of Oroquieta City. – In order to enhance the effective implementation of this ordinance, a 40% share as an incentive shall be provided to the fish wardens deputized by the Bureau of Fisheries and Aquatic Resources and the fisherfolks, fishermen barangay officials and barangay tanods of the 12 coastal barangays of Oroquieta City, who are deputized by the City Mayor to implement the provisions of this ordinance. The incentives shall be given by way of payment order slip duly approved by the designated Fishery Officer of the Office of the City Agriculture & Fisheries and in accordance with the accounting and auditing rules and regulations. Section 4. That par. 2 & 3, Section 93 of Ordinance No. 38-99, “Total Fishing Ban Period”, shall be amended by transferring and rephrasing its paragraphs 2 & 3 thereof and designated as ART. 34, which provision shall be read as follows: “ART. 34. Administrative Provision. In Order to avoid the hassle and tedious process of Court litigation, the violator may opt to avail the administrative fine, as follows: For violation of Article Nos. 18, 19, 20, 21, 22, 23, 24, 25, 26, 27, 28, 31, 32, Section Nos. 87, 88, 89, 90, 91 First Offense ------------------ Second Offense ------------------

Said administrative fine shall be paid within 72 hours at the Office of the City Treasurer from the issuance of the Citation Ticket by the deputized fish warden. If the case is filed with the City Prosecutor’s Office, or with the Court the issuance of the Citation Ticket by the apprehending deputized fish warden shall be upon approval of the City Prosecutor. Provided that for third or succeeding offense shall result in the filing of a case in Court. Section 5. ART. 33 “Penal Provision” of Ordinance No. 38-99, which shall become ART. 35 shall be amended for purposes of clarity in applying the penalty provisions which clearly falls to be with the powers of the Sangguniang Panlungsod, which shall read as follows: ART 35. Penal Provision – Any person, who violates the provisions of this Code in particular Articles Nos. 18, 19,20,21,22,23,24 ,25,26,27,28,31,32, Sections Nos. 87, 88, 89, 90, 91 hereof shall upon conviction be sentenced with a fine of not less than P2,000.00 but not exceeding p 5,000.00 and/or imprisonment of not less than six 6 months but not to exceed one year upon the discretion of the court, and confiscation and/or forfeiture of catch and fishing gear or equipment used plus cancellation and/or revocation of his permit or license. Provided that R.A. 8550, Administrative Order No. 190 of the Department of Agriculture, and the Revised Penal Code, may be applied to the violator depending on the gravity of the offense, such as, the volume of the catch, extent of damage caused on the coral reef or ecosystem of the area as a result of the violation committed and other attendant qualifying circumstances. For other violations, except those in the enumerated articles/ sections above-mentioned are considered local offenses and shall upon conviction be fined of not less than five hundred pesos (P500.00,) but not exceeding five thousand pesos (P5,000.00), or an imprisonment of not less than six (6) months, or both such fine and imprisonment at the discretion of the court and in addition, the confiscation and/or forfeiture of catch and fishing gear or equipment used plus the cancellation and/or revocation of his permit or license. Section 6. Sections affected in Ordinance No. 38-99 in view of this amendatory ordinance shall be re-numbered consecutively. Section 7. This ordinance shall take effect upon posting and publication pursuant to R.A. 7160. APPROVED: November 8, 2012
