Gunfires disrupt Christmas lights display launch in Cotabato City

COTABATO CITY – Just when Cotabato City Mayor Bruce Matabalao finished the opening of the display of Christmas lights at the plaza here past 7 p.m. Tuesday and was about to speak before the media, gunfires rang nearby, causing spectators to scamper for safety.

Police and other security units sealed off the city plaza, securing the city mayor and key officials.

As it turned out, a security guard fired his gun while chasing a thief who stole a chocolate bar from a convenience store, according to Police Colonel Querubin Manalang Jr.

“It was a warning shot, that’s what we learned. But

it’s still not right for a civilian to fire his gun. We are looking for the one who did that since no one is admitting yet,” he added.

Journalists who covered the event witnessed the chaotic scenario themselves as they ran towards the security officers for protection, fearing of any sabotage.

After things settled, the City Government of Cotabato asked the residents who may have been injured to inform authorities.

Among the attendees were children and their mothers, as well as senior citizens. “We are all calling for every Cotabateño to pray for safety and peaceful holiday celebration to everyone,” the mayor said. (Ferdinandh Cabrera / MindaNews )

Panguil Bridge in N. Mindanao 61% complete: DPWH exec

MANILA – The construction of the longest seacrossing bridge in Northern Mindanao is now 61 percent complete, the Department of Public Works and Highways (DPWH) said on Thursday.

secretary Emil Sadain, who supervises the construction of the PHP7.3 billion Panguil Bay Bridge project that will connect Tangub City in Misamis Occidental and Tubod town in Lanao del Norte, led the inspection on Wednesday and vowed

to complete the project in December next year.

Sadain said the project, which began in February 2020, is part of DPWH’s continuing Build Better More Program.

“The bridge costing PH7.375 Billion, financed

by a loan agreement between the Government of the Philippines and Korean Export Import Bank not only represents a long dream come true of the people of Lanao Del Norte and Misamis Occidental but a milestone highlighting how the design and construction of a modern bridge with sea offshore excavation depth of up to more than 50 meters has evolved,” he said in a statement.

The construction started following the full completion of all 54 bored piling works to allow the start of construction of the 36 abutments and pier column, 32 coping, and begin on both ends at Tubod and Tangub City the incremental launching method (ILM) for the superstructure.

DFA confirms death of Pinoy OFW in Qatar resort

MANILA – The Department of Foreign Affairs (DFA) confirmed Thursday night the death of a male Filipino national while working at a resort in Mesaieed, Qatar.

The department said an investigation is underway and the Philippine Embassy in Doha is in coordination with legal authorities to ascertain the facts of the case.

"They will remain in contact with the next of kin of the deceased as they work for the earliest repatriation of his remains," DFA Deputy Assistant Secretary Gonar Musor told reporters in a text message. "Out of respect to

the family, we are not providing more details at this time."

Meanwhile, the government, through the embassy, sent its thoughts and prayers to the family.

Local reports said the man died while doing repairs at the resort reportedly being used as a training base for the Saudi Arabia national team during the World Cup.

Online sports publication The Athletic reported that the Filipino worker was "involved in a forklift truck accident in which he slipped off a ramp while walking alongside the vehicle and fell headfirst against concrete." ( PNA )

The petitioner and respondent are of legal age, Filipinos, married to each other, petitioner is a resident of P5 Zacor, Barangay Tandang Sora, Butuan Cit, while respondent last known address is located in Purok 2, Solariaga Plantation, Talomo, Davao City; Petitioner has no knowledge of the exact present address and whereabouts of the respondents; Petitioner and respondent got married in the 9th of November 2005 in Davao City, Philippines; the parties begot two children, namely; Xhian Lyernard Ordanel Balbuena and Xhianeka Ordanel Balbuena; Petitioner is a seafarer, works as an OFWfor one year to one and a half year, and respondent is a graduate of BS Customs Administration; Petitioner disclosed that as a seafarer, petitioner works with diligence, attended post-graduate courses, and took and passed the licensure exams for Second officer, Third officer, and Captain, in order to augment his income and to build a bright future for his family, but all his endeavour wentfor naught; respondent on the other hand, turned out to be extravagant careless with money, and incapable of handling the family’s finances; decides important family matters be herself without conferring to the petitioner; petitioner added that respondent is unfaithful and promiscuous as a wife, irresponsible and negligent as a parent; Petitioner revealed that his marital woes began sometime in 2016 when the couple decided to engage in the business of exporting banana; the couple then hired a leadman to oversea the nitty-gritty if the said business; parties bought brand-ne house and a Toyota Fortuner, to serve the needs of the family, the family business and the children; when respcndent learned how to drive, however, she began to disappear from their conjugal home for entire day while the children were left at home with either petitioner’s sister or mother or the familys’ domestic helper; Likewise, when petitioner was abroad, he sensed that his interaction with respondent was beginning to change; respondent gets angry right away saying that she’s tired and petitioner’s calls are distractions, so petitioner gave her the benefit of the doubt; But the change in respondent progressed as the months rolled by; respondent no longer consulted or informed petitioner about the banana business; she seemed to rely exclusively on whatever the Leadman tells her; when petitioner came home, he discovered that the leadman borrowed money from the respondent and even bought her a Kawasaki motorcycle; later, petitioner also found out that the leadman and respondent were using the Fortuner almost exclusively and the former damaged it in a collision; since then, leadman and respondent began going together every day, even on trips not connected with the banana business; Petitioner observed that respondent would leave the conjugal home at 5:00 in the morning and returns only when it was already bedtime, and so the children are already deprived of her care and parenting every day; Also, one time, respondent left home early for a purportedly seminar regarding banana business but petitioner found out that it was not a seminar, but respondent lent the Fortune, to one her male friends which again led to a collision and to the damage thereof When petitioner went back abroad, he sent allotment money in the amount of PhP150,000.00 monthly, however, respondent would get angry as such amount would not be enough; and when petitioner would ask respondent about their banana business, she would respond in anger and would reason that their two sources of income is not enough as she incurred debts despite the said sources of income; when Petitioner went back home from overseas, he found out that respondent has no savings and their debts accumulated instead, so petitioner cut his vacation short and went back to work in order to pay their debts; their debts accumulated that they had to sell their house and lot so the debts would be paid; however, petitioner thought that their debts would be fully paid, he learned that respondent bought fighting cocks with the money at PhP25,000.00 each; petitioner then decided to reduce the allotment from PhP150,000.00 to PhP90,000.00 as he believed that married people should not be financing the adulterous enterprises of their cuckolding spouses; in return, respondent left the conjugal home taking the children with her and stayed in a small room in the gamefowl farm (manokan), where hazardouz chemical s are being kept; Petitioner added that respondent’s extravagance, infidelity, promiscuity as a wife and irresponsibility and negligence as a parent manifest a psychological incapacity to fulfill the essential marital obligations. Wherefore, finding merit in the motion, leave of Court to serve summons by publication is hereby granted. Petitioner is hereby order to cause the publication of this summon once a week for two (2) consecutive weeks in a newspaper of general circulation in the Philippines at the expense of the petitioner. In addition, a copy of the summons shall be served on the respondent at her last known address by registered mail.

DSWD-CAR to release new poverty database by year-end

BAGUIO CITY – The Department of Social Welfare and Development in the Cordillera Administrative Region (DSWD-CAR) targets to release before the year ends the final list of identified poor households who can be potential beneficiaries for different social protection programs and services.

“It (list) can already be utilized by other agencies or the private sector for their targeted assistance programs and projects,” DSWD-CAR regional director Leo Quintilla said in a phone interview on Wednesday.

Quintilla said they are reassessing the result of a poor household targeting survey which was started before the pandemic struck.

He said their initial survey results released in early 2022 show the Cordillera’s poor ratio at 17:100 which translates to 46,792 poor households compared to 77,811 in the earlier list.

Quintilla cited the huge effect of the pandemic to the financial condition of the households thus the need for reassessment.

Quintilla said there are households recommended for exiting or retention in the Pantawid Pamilyang Pilipino Program (4Ps).

Quintilla urged stakeholders, partners and government agencies with frontline programs for the poor to utilize the Listahanan 3 to determine their target beneficiaries.

Listahanan 3, which was launched on Tues -

day, is the third round nationwide household assessment.

“Napaka importante na ng Listahanan dahil maaassure na ang nabibigyan ng tulong ay talagang nangangailangan para mapabuti ang kundisyon ng buhay nila (the Listahanan is very important to assure that assistance will be extended to those who really need them to improve their condition),” Quintilla added. Ilocos Sur rolls out massive anti-rabies vaccination

LAOAG CITY – The Ilocos Sur Provincial Veterinary Office (PVet) has started deploying vaccinators in various parts of the province to ensure all dogs get anti-rabies shots.

PVet chief Dr. Donna Mae Rosario said Wednesday the intensified drive on dog vaccination supports the local government unit's efforts for rabies prevention and control as mandated by Republic Act 9482 or the Anti-Rabies Act of 2007.

“We are doing houseto-house to vaccinate more dogs in Ilocos Sur. Those who are near our office may visit us too so we can accommodate them on a

first-come, first-served basis,” she said in a phone interview.

In Narvacan town, for example, the PVet turned over anti-rabies vaccines on Tuesday to speed up the vaccination of at least 1,000 dogs in Barangays Maroso, Estancia, Codoog and Sarmingan, respectively.

Rosario reminded pet owners to become responsible and ensure that their pets are kept from stressful situations, such as exposure to hot daytime temperatures or confinement in a cage all day.

On the matter of rest

“Come to me, all you who labor and are burdened, and I will give you rest. Take my yoke upon you and learn from me, for I am meek and humble of heart; and you will find rest for yourselves. For my yoke is easy, and my burden light.” (Mt 11,28-30)

WORDS of Christ that clearly tell us where we can find true rest, as well as the kind of things we need do and bear if we want these things to be light and easy. These are words that are most relevant these days, since we are often confused and lost as to where we can find true rest and the kind of things that should properly engage us.

With how things are now in the world of rest, recreation and entertainment, there is a great need to develop in ourselves a sharp discerning sense of what is truly helpful and healthy.

Our need for rest just cannot and should not be met merely by earthly solutions. Our rest should involve our whole being that is not only material and natural, but also, and most especially, spiritual and supernatural.

Unless our rest covers these latter dimensions, we can never find true rest. We may have some degree of physical relief which, if not related to the spiritual and

the supernatural, can only poise us to greater dangers sooner or later.

To be sure, our true and proper rest can only be found in Christ. He gives us the rest that is not only physical. It is a rest that includes all the aspects of our life— emotional, psychological, mental, moral and spiritual. We need to broaden our understanding of rest to go beyond the physical dimension.

Christ offers us the due rest for our soul that can be harassed by the problems of this world and the requirements of our lifelong pursuit for holiness and apostolate. (cfr. Mt 11,29) This is the real rest that is indeed meant for us. Short of this, our rest would be at best only apparent, and cannot cope with the over-all demands and pressures of our life.

For this he advises us to learn from him, particularly in his meekness and humility. I imagine that these virtues were highlighted because they are the ones that would open the gates of our soul to receive God’s grace, to be guided by faith rather than simply by our senses and emotions and even by our intellectual powers.

We have to see to it that our search for rest should not get stuck in the level of our physical, emotional and intellectual conditions. This

is a crucial point because the entry point in our process of knowing is through our senses, instincts and emotions, before things get processed by our intellect, and later inspired by our faith. We should avoid letting our rest get trapped only in the world of the senses, instincts and emotions.

Our Christian faith has to enlighten us as to what kind of rest is proper to us. This faith is a God-given view of the all the truths that we need to know. It is God revealing and sharing his knowledge of things with us. It is God sharing his powers with us. We just should not be guided by our own lights and faculties, but by the light God gives us through the gift of faith.

To be sure, our faith is not just an intellectual affair, limited to the world of ideas. It involves our whole person and requires that our correspondence to it should precisely involve our whole person. Our search for true rest should be guided by our Christian faith.

Strengthen public-private partnerships to boost infra dev’t

COOPERATION between the government and private sectors has long been integral in the country’s economic development with the various infrastructure projects under public-private partnerships (PPP) already operational and beneficial to the Filipino people.

One of the oldest infrastructures built under PPP was the North Luzon Expressway (NLEX), an 84-kilometer road infrastructure connecting Metro Manila to the northern portion of the Philippines. According to its operator NLEX Corp., the expressway currently services 278,000 motorists daily.

Having been in service for decades now, the 5.3-kilometer north and south viaducts of the project crossing the swampland in Candaba, Pampanga are currently up for retrofitting due to safety concerns amid the volume of traffic and large trucks crossing the viaduct.

At a recently held House committee meeting chaired by Deputy Speaker and 3rd District Rep. Aurelio “Dong” Gonzales, NLEX Corp. officials led by lawyer Romulo Quimbo Jr. said that the company would shell out PHP8 billion for the con -

struction of a third highway that would be built between the two existing northbound and southbound viaducts.

The construction will add one and a half lanes per direction to cater to the cargo trucks and heavy vehicles. Construction is expected to begin in the first quarter of 2023 while completion is set by the end of 2024.

NLEX Corp. said it would implement a traffic scheme to avoid inconvenience and disruptions on the part of the motorists and commuters.

Concerned government agencies such as the Department of Public Works and Highways (DPWH), Department of Transportation (DOTr), National Economic and Development Authority (NEDA), and the Toll Regulatory Board (TRB) expressed support for the planned new roadway.

Apart from the new viaduct, five local bridges that will cross the expressway are also expected to be constructed with the help of the DPWH, to provide easier and faster access to NLEX.

Once completed, the new highway would ensure the integrity and safety of the expressway, ultimately for

the welfare of the motorists and the commuting public.

In our heavily challenged economy, the Marcos administration is banking on the development of more infrastructure projects as the long-term solution to decongesting heavy traffic and provide a better quality of life to the Filipinos.

With the ramped-up infrastructure program, cooperation of the private sector must be strengthened through more PPP programs as they generally execute faster than those funded by foreign loans.

The private sector is our frontliner for economic development, besides playing a huge role in nation building. They drive growth, generate jobs, and contribute to tax revenues that fund services and investment for our people.

In developing countries, the private sector generates 90 percent of jobs, funds 60 percent of all investments and provides more than 80 percent of the country’s revenues.

Iloilo province eyed to host clean energy project

ILOILO CITY – Iloilo province has been identified as one of the host areas for the renewable energy expansion project of the Meralco PowerGen Corporation (MGen) and the Global Business Power Corporation (GBP).

Bacolod City retains P3.25-B annual budget for 2023

BACOLOD CITY – The city government here, which has a PHP3.25-billion budget in 2022,, will operate with the same budgetary allocation in 2023 with the expected cut of PHP302.69 million in its National Tax Allocation (NTA) share next year.

The amount, which comprises PHP1.85 billion from the NTA share and PHP1.39 billion from local sources, was approved by the city council on third and final reading Wednesday afternoon.

Councilor Jude Thaddeus Sayson, chair of the committee on appropriations and finance, said there will be a 10 percent reduction in the maintenance and other operating expenses of all departments to “soften the impact” of the lesser NTA share.

With the creation of the Task Force on Business and Tax Mapping, the City Treasurer’s Office is expected to boost its tax collection, he added.

Sayson said the city is also looking at improved collections by the Bacolod Housing Authority and the Office of the Building Official.

“The budget is expected to be responsive to the needs

of the people of Bacolod. We have to make adjustments. It will be the same so we will not fall short of our budget. (The amount) is the same, but the priorities are different,” he said.

In his budget message, Mayor Alfredo Abelardo Benitez said the 2023 annual budget has been formulated based on a multipartite system of consultation.

The local government collected inputs from representatives of the private sector and non-government organizations, he added. (PNA)

Petitioner has no knowledge of the exact present address and whereabouts of the respondents; Petitoner and respondent got married in Cagayan de Oro City on 19” of December 2009; both were blessed with children, namely; Kristel Angel Cabonilas Sumugat and Kris Angelo Cabonilas Sumugat; Parties met in church in 2005, when petitioner was only 17 years old while respondent was 28 years old; petitioner confided to respondent that she was physicallt abused by her mother, so respondent suggested to petitioner to accompany him to his hometown in General Santos City, so as to keep her from further abuses, to which petitioner agreed; then, one night, respondent asked petitioner to have sex with him but petitioner refused to do so, as such, respondent punched her in the stomach and eventually got what he wanted; In the meantime, when the mother of petitioner learned about the incident, threatened respondent to file a case of rape against the respondent unless he marries petitioner; and so the parties were married; During their marriage, petitioner alleged that respondent treated her well at first but only after she gave birth to their first child, respondent began to change; petitioner experienced being locked up every time respondent would go out of the house; Respondent began to force himself on petitioner; and every time petitioner refuses, respondent beat her up, and would asked her, “Ngano, naa na kay laen?”in english translation, (“Why, do you already have someone else?”); Petitioner began to feel being a sex slave; And things got even worse, when petitioner had her second child; Accordingly, respondent believed that the child was not his; to the point of telling the neighbors that respondent is not the father of the second child; Likewise, petitioner alleged that when the mother of the respondent came and informed him that his ex-girlfriend was in the house, respondent bolted out of the house and did not come home for a week, thereafter, when he came home, respondent suddenly beat her up because somebody told him that she was with another man while he was away; at another time, petitioner went to her mother’s house to ask for food, and when she returned, respondent wanted to know where she had been and asked to see her panty, saying, ‘Tan-aw ko sa imong panty be. Pila ray standing position” in english translation, “Let me see your underwear, standing position would only be easy” then respondent started beating up petitioner while asking her for four times, “Naa kay lalaki, wala?” in english translation, “Do you have another man?” to which petitioner answered sarcastically, “Naa”, in English translation, “Yes, do”, as she could no longer stand of his beatings; Later, when petitioner’s mother saw her bleeding mouth, she asked respondent, “Giunsa man na nimo, Jun?” in english translation, “What did you do to her, Jun?”, respondent then answered, Gidisiplina ra man nako nang imong anak”, in English translation, “I just merely discipline your child”; Petitioner’s mother and brother got angry, broke the door of the house and rescued her; Petitioner ran away and never came back; since then, respondent was never heard from again; Such respondent’s physical, verbal, and emotional brutality toward petitioner manifests a psychological incapacity to fulfill the essential marital obligations embraced by Article 68 to 71 of the Family Code; Moreover, petitioner alleged that the root cause of such psychological incapacity is medically and clinically identified as a personality disorder that can be traced to the history of respondent before the marriage and existed at the time of the celebration of the marriage; such psychological incapacity is also grave enough to bring about the failure of resppndent to assume the essential obligations of marriage, and is incurable.

Wherefore, finding merit in the motion, leave of Court to serve summons by publication is hereby granted.

Petitioner is hereby order to cause the publication of this summon once a week for two (2) consecutive weeks in a newspaper of general circulation in the Philippines at the expense of the petitioner. In addition, a copy of the summons shall be served on the respondent at her last known address by registered mail.

PH unemployment slows down to 4.5% in October

MANILA – The country’s unemployment rate slowed down to 4.5 percent in October 2022 from 5 percent in September this year, the Philippine Statistics Authority (PSA) reported Wednesday.

In a press conference, PSA chief and national statistician Undersecretary Dennis Mapa said the Philippines achieved the same unemployment rate in October 2019.

October 2022 jobs data also reported the lowest unemployment rate in the country since the onset of the coronavirus disease 2019 (Covid-19).

The number of jobless Filipinos also eased from 3.5 million in October 2021 to 2.24 million in October this year.

PSA reported that the labor force participation rate in October stood at 64.2 percent, lower than the 65.2 percent in September.

Mapa said there is a seasonal factor in the decrease in labor force participation, especially between July and October 2022 data.

He said since students were on school break in July, many of those aged 15 to 24 years joined the labor force in that month. With the school reopening, these age brackets returned to school.

Some 49.35 million Filipinos were part of the workforce in October, with around 47.11 million individuals having jobs.

“The country’s sustained recovery of the labor market backs our confidence that our policies and interventions to reinvigorate our economy are working,” Socioeconomic Planning Secretary Arsenio Balisacan said in a statement. ( PNA )

COMPLAINT

(With Urgent Prayer for Issuance of Writ of Possession) Plaintiff, National Grid Corporation of the Philippines (NGCP), by counsel, respectfully state that:

1. That plaintiff is a private corporation created and existing under Philippine laws, with principal office address at NGCP Building, Quezon Avenue corner BIR Road, Diliman, Quezon City. It may be served with notices and other court processes through its Right-of-Way Department (ROWD)-Mindanao Division, Maria Cristina, Iligan City, copy furnished the aforementioned principal office.

2. Pursuant to Republic Act (R.A.) No. 9511, plaintiff was granted a franchise to operate, manage and maintain, and in connection therewith, to engage in the business of conveying or transmitting electricity through a high-voltage back-bone system of interconnected transmission lines, substations and related facilities, systems operations, and other activities that are necessary to support the safe and reliable operation of a transmission system and to construct, install, finance, manage, improve, expand, operate, maintain, rehabilitate, repair and refurbish the present nationwide transmission system of the Republic of the Philippines.

3. Under Section 4 of the same law, plaintiff was granted the power of eminent domain, subject to the requirements of the Constitution and existing laws.

4. Plaintiff is engaged in the business of transmitting electric power from the generating plants of power producers to distributors. As such, plaintiff’s business is imbued with public interest.

5. To address the country’s growing power demand and ensure continuous, reliable and efficient power supply, there is a need to interconnect the three (3) major power grids of Luzon, Visayas, and Mindanao into a single national grid. Aside from sharing of systems reserve, the interconnection will also help optimize utilization of indigenous energy resources such as natural gas in Luzon, geothermal in the Visayas and hydro in Mindanao. Owning to this necessity, plaintiff must immediately construct the transmission lines that will transmit power to distributors of electricity not only in Mindanao but also in Luzon and Visayas. This undertaking is for the use and benefit of the public and part of it is known as the MINDANAOVISAYAS INTERCONNECTION PROJECT (MVIP), integral part of which is the KAUSWAGAN-LALA 230kV TRANSMISSION LINE PROJECT (Project).

6. The said MVIP of NGCP is the project certified by the Department of Energy (DOE) as an Energy Project of National Significance (EPNS) pursuant to R.A. 7638 of DOE Act of 1992, as amended, entitled to all the rights and privileges provided under Executive Order No. 30, series of 2017, as evidenced by DOE Certification dated 8 May 2018 issued by the Energy Investment Coordinating Council. Hence, the immediate completion and energization of the said project is critically important.

7. Defendants HEIRS OF PANTALEON B. FERNANDEZ, namely: Rosendo E. Fernandez, Rosalie F. Escario, and Retchillo E. Fernandez, are all of legal age, Filipinos. They may be served with notices, summons, and other processes of this Honorable Court, through Rosendo E. Fernandez at their respective addresses indicated below opposite their names, viz:

8. The property subject of this complaint is a parcel of land, identified as Lot No. 893-C, CSD-10-000474, situated in Brgy. Sta. Cruz Upper, Lala, Lanao del Norte registered and in the name of the late Pantaleon B. Fernandez per Original Certificate of Title (OCT) No. P-5,973 and Tax Declaration No. H-2300160 (08).

9. The total area sought to be expropriated consists of 8,021 square meters, as shown on the attached Sketch Plan and Narrative Technical Description, and particularly described as follows:

Machine copies of the BIR Zonal Valuation applicable to the subject property, Reports on the Counts of Improvements/Quit Claim with Acknowledgment Receipt as proof of affected improvements, are attached and made as integral parts of this complaint.

10. A careful scrutiny of Original Certificate of Title No. P-5,973 shows that it was issued by virtue of a free patent pursuant to Commonwealth Act (CA) No. 141. As annotated in the said title, the subject property is subject to a conditions and public easements and servitudes recognized and prescribed by law especially those mentioned in Sections 109, 110, 111, 112, 113 and 114 of Commonwealth Act. No. 141, as amended.

11. Sections 111 and 112 (as amended by P.D. 1361) of C.A. 141 provide: “Sec. 111 – All persons receiving title to lands under the provision of this Act shall hold such lands subject to the provisions hereof and to the same public servitudes as exists upon lands owned by private persons xxx.

“Sec.112. Said land shall further be subject to a right-of-way not exceeding sixty (60) meters in width for public highways, railroads, irrigation ditches, aqueducts, telegraph and telephone lines, airport runways, xxx and similar works as the Government or any public or quasi-public service or enterprise xxx may reasonably require for carrying on their business, with damages for the improvements only.

“Government officials charged with the prosecution of these projects or their representatives are authorized to take immediate possession of the portion of the property subject of lien as soon as the need arises and after due notice to the owners. xxx”

12. Such legal easement has been consistently recognized and applied by the Supreme Court in a long line of cases, where it ruled that a landowner whose property is subject to the legal easement imposed by Section 112 of C.A. 141 is not entitled to compensation for the portion thereof covered by the 60-meter easement of right-of-way, except only for the value of the existing improvements that will be affected.

13. Considering that plaintiff is a private corporation performing a public service, it is a quasi-public service, it is a quasi-public entity entitled to enforce such easement of right-of-way of up to 60 meters in width on the subject property without cost, except for the improvements that will be damaged by the project.

14. As shown in the aforementioned said sketch plan, plaintiff’s project merely imposes a forty (50) meter wide easement of right-of-way over the subject property, which is well within the sixty 60-meters wide easement reserved under Section 112 od C.A. 141.

15. To enable plaintiff to construct and maintain the Project, it is both necessary and urgent to enforce an easement of right-of-way pursuant to Section 112 of C.A. 141 and/or acquire the portion of the subject property, to ensure stability and reliability of the power supply in Mindanao and other regions of the country.

16. Plaintiff negotiated with defendants informing them of its intention to take immediate possession of Lot No. 893-C, CSD-10-000474 for the implementation of its project. Plaintiff likewise offered defendants the value of the improvements to be affected by its project but waived their rights over the improvements. However, with respect to the subject property, no agreement was reached between the parties. Hence, plaintiff has no other recourse but to file the instant complaint.

17. Section 13 of R.A. 11361 provides that Rules 67 of the Revised Rules of Civil Procedure governs plaintiff’s expropriation cases. Under Section 2 of Rule 67 of the Revised Rules of Civil Procedure, plaintiff may already enter and possess the portions of the subject properties during the pendency of the expropriation case.

18. Section 2 of Rule 67 of the Revised Rules of Civil Procedure states that: “Section 2. Entry of plaintiff upon depositing value with authorized government depositary. – Upon the filing of the complaint or at any time thereafter and after due notice to the defendant, the plaintiff shall have the right to take or enter upon the possession of the real property involved if he deposits with the authorized government depositary an amount equivalent to the assessed value of the property for purposes of taxation to be held by such bank subject to the orders of the court. Such deposit shall be in money, unless in lieu thereof the court authorizes the deposit of a certificate of deposit of a government bank of the Republic of the Philippines payable on demand to the authorized government depositary.”

19. In compliance with the notice requirement, plaintiff notified defendants through a Letter Offer of its intention to file an expropriation case if the possession over the subject property cannot be timely secured and/or issues regarding compensation for the subject property cannot be resolved except through judicial intervention.

Plaintiff further, serves, simultaneous with the filing of the instant Complaint, a Notice to Take Possession (Annex “B”) upon the defendants.

20. To comply with the deposit requirement, plaintiff, notwithstanding that R.A. 10752 does not specifically apply to it, shall deposit with the Honorable Court the total amount of FOUR HUNDRED ONE THOUSAND FIFTY PESOS (Php401,050.00), equivalent to 100% BIR Zonal Value of the total affected area of the subject property. Such total amount to be deposited by plaintiff includes the 100% BIR Zonal Value of the Affected Area-Easement of Right-of-way amounting to Php379,000.00, which defendants are not entitled to receive by virtue of Section 112 of CA 141, but plaintiff is willing to deposit only for purposes of issuance of writ of possession.

21. Notwithstanding that R.A. 10752 does not specifically apply to plaintiff, it shall deposit the said amount with this Honorable Court consistent with the purpose of the said law and OCA Circular No. 113-2019 to simplify the deposit requirement in expropriation cases for the benefit of the defendants and in the interest of immediate implementation of projects intended to benefit the public.

22. Upon deposit of the provisional amount, plaintiff would have fully complied with the requirements for the issuance of a writ of possession as mandated by law. In a long line of cases and OCA Circular No. 113-2019, once the above requirements are complied with it, it becomes the ministerial duty of the trial court to issue the writ of possession in favor of the plaintiff, without need of any further hearing. Thus, as cited in the said OCA Circular:

“Municipality of Cordova v. Pathfinder Development Corporation cases emphasizes the mandatory issuance of the writ of possession upon the receipt of the required deposit. “No hearing is actually required for the issuance of writ of possession, which is actually required for the issuance of a writ of possession, which demands only two (2) requirements: (a) the sufficiency in form and substance of the complaint; and (b) the required provisional deposit xxx Upon compliance with these requirements, the petitioner in an expropriation case is entitled to a writ of possession as a matter of right and the issuance of the writ becomes ministerial.”

23. However, since the subject property is covered by Section 112 of C.A. 141 and defendants are not entitled to compensation for the Affected Area-Easement of Right-of-way, the provisional deposit representing the 100% BIR Zonal Value of the said affected area amounting to THREE HUNDRED SEVENTY-NINE THOUSAND PESOS (Php379,000.00) should remain in custodia legis until this case is resolved with finality.

24. Moreover, it must be emphasized that an expropriation proceeding is an action quasi in rem, wherein the fact that the owner of the property is made a party is not essentially indispensable insofar as it concerns the immediate taking of possession of the property and the preliminary determination of its value, including the amount to be deposited.

25. Action quasi in rem names a person as defendant, but its object is to subject that person’s interest in a property to a corresponding lien or obligation. In a proceeding quasi in rem, jurisdiction over the person of the defendant is not a prerequisite to confer jurisdiction on the court, provided that the latter has jurisdiction over the res. 26. The purpose of summons in actions quasi in rem is not the acquisition of jurisdiction over the defendant but mainly to satisfy the constitutional requirement of due process. Since the issuance of writ of possession is ex-parte, ministerial, and non-litigious in nature, the issuance thereof, even prior to the service of summons, will not violate defendants’ right to due process as the same can be done even without defendants’ participation. Besides, the issuance of a writ of possession does not prevent defendants from raising objections to and defenses against the expropriation of his property.

27. Plaintiff intends to present three (3) witnesses, namely: (a) Engr. Licinio B. Capili, (b) Engr. Nolito L. Notar, and (c) Windsor C. Abaga, Sr., to establish, among others, NGCP’s authority to exercise the power of eminent domain, the propriety of its exercise in this case, and the bases for the determination of the just compensation. Copies of their Judicial Affidavits (with attached Exhibits “A” to “O”) are attached as Annexes C, D, and E and made an integral part hereof. Plaintiff intends to present additional witness if necessary.

PRAYER

WHEREFORE, premises considered, plaintiff most respectfully prays of this Honorable Court to:

1. ISSUE a Writ of possession in plaintiff’s favor; authorizing plaintiff to enter and take possession of the properties subject of this complaint that will be affected by the construction and implementation of the Project, consisting a total area of 8,021 square meters, more or less, as described in paragraphs 8 and 9 hereof; order all defendants to vacate the portion of the subject property; directing the Philippine National Police (PNP) to assist plaintiff in the implementation of the said writ of possession so that project construction can immediately commence even during the pendency of the case; direct the Registry of Deeds for the Province of Lanao

del Norte to enter the Writ of Possession in the Primary Entry Book and annotate the same in the Registration Book pursuant to Section 69 of Presidential Decree No. 1529;

2. ISSUE an Order of Expropriation declaring the existence of a legal easement imposed by Sec 112 of CA No 141 over Lot No. 839-C, CSD-10-000474 and confirming plaintiff’s lawful right to enforce such easement of right-of-way, to take possession of and to occupy the 8,021-square meter portion of defendants’ property as specified in paragraph 8 and 9 hereof;

3. ISSUE a Judgment declaring and confirming plaintiff’s lawful right to enforce an easement of right-of-way, take possession of and occupy the 7,580-meter Affected Area-Easement of Right-of-way of defendants’ Lot No. 839-C. CSD-10-000474 as specified in paragraphs 8 and 9 hereof, for the construction and implementation of the Project, at no cost, except for the value of the improvements affected by plaintiff’s project; FURTHER, after the determination of just compensation of the 441-square meter Affected Area-Tower Site of defendants’ Lot No. 839-C, CSD-10000474 to authorize the payment thereof by plaintiff to defendants after deducting the capital gains and documentary stamp taxes for the transfer of the said 9-square meter Affected Area-Tower Site, in the name of plaintiff, all other outstanding realty taxes and dues under the Local Government Code, which plaintiff shall remit to the Government; FURTHER, declaring plaintiff as the lawful owner of the said 441-square meter Affected Area-Tower Site, as described in paragraph 9 hereof;

4. DIRECT the Office of the Clerk of Court, Regional Trial Court, Kapatagan, Lanao del Norte to return the amount of Php379,000.00 deposited by plaintiff once the Honorable Court confirms that defendants are not entitled to compensation for the 7,580-square meter Affected-Easement of Right-of-way, as specified in paragraphs 8 and 9 hereof, pursuant to Section 112 of the Commonwealth Act. No. 141 and applicable jurisprudence;

5. DIRECT:

a) The Registry of Deeds for the Province of Lanao del Norte to register and annotate the Order of Expropriation and Judgment on the OCT No. P-5,973 or any certificate of title that may hereafter be issued covering the portion of the property subject of this case pursuant to Section 85 of Presidential Decree No. 1529; and b) The Municipal Assessor of Lala and/or Provincial Assessor of Lanao del Norte to cancel TD No. H-2300160 (08) and to issue a new and separate tax declaration in the name of plaintiff covering the portion of the subject property sought to be expropriated herein.

Plaintiff prays for other relief as just and equitable under the premises.

NorMin cops nab 405 ‘wanted persons’ in 30-day anti-crime ops

CAGAYAN DE OR CITY –Philippine National Police (PNP) chief Gen. Rodolfo Azurin Jr. lauded the successful monthlong intensified campaign against wanted persons of Police Regional Office 10 (PRO10), which resulted in the arrest of 405 wanted individuals.

According to report submitted by Brig. Gen. Lawrence B. Coop, PRO10 chief, Azurin noted the significant increase of 24 percent on the arrest of wanted persons compared

from previous month’s recorded number of arrests.

Azurin said Northern Mindanao cops sustained positive results on their campaign against illegal drugs with 172 operations, which resulted in the arrest of 212 drug personalities, filing of 159 filed cases, and the confiscation of 644.8 grams of shabu with an estimated “standard drug price” of PHP4.3 million, and 97.8 grams of marijuana with an estimated value of PHP11,745.

Davao City intensifies total firecracker ban

DAVAO CITY - To ensure the safety of Dabawenyos as they celebrate the holiday season, the city’s security and safety cluster assured Thursday it will intensify the firecracker ban.

Angel Sumagaysay, head of the Public Safety and Security Office (PSSO), said it is in line with the City Ordinance 060-02 also known as the Firecracker

Ban which prohibits the possession, use, sale, manufacture and distribution of pyrotechnic devices in the city.

“The city’s security units have already been briefed as to the full implementation of the ban. I have already sent a memo to our security forces to really implement the ordinance,” Sumagaysay said in a radio interview.

That petitioners are husband and wife respectively in a marriage performed under Civil rite on January 30, 2004 at Imus, Cavite, both petitioner’s had been converted to Muslim and thereby embraced Islam Religion as their new found faith, by virtue of their respective intellectual choices which were duly registered with this Court, both of them can be served summons and other legal processes relative to this case at their resident at Purok 3, Coralao, Majayjay, Laguna and Bldg., 16, Unit 403, Centennial Village, Taguig, Metro Manila respectively; That said marriage did not last long due to lack of love and affection until the relationship manifested incompatibility and sustained misunderstanding between petitioners and reached the point of irreconcilability and they separated for each other for some reason of which both petitioner finally decided to legally break or severe their marriage bond for more than ten (10) years their separation, they had never been communicating or supporting either financially or emotionally to each other, neither minding each other affair’s; petitioner seek judicial decree of divorce, thereby, severing their marriage bond on January 30, 2004 so that they will have free hand to do what a single man or woman could do without marital burdens. Reconciliation between them had already been diligently employed but all proved futile.

WHEREFORE, finding this petition to be sufficient in form and substance, set the initial hearing of this case on December 19, 2022 at 9:00 a.m. at which time, date and place. Any interested party may appear and show why the petition should not be granted. Let copy of this Order be published in newspaper of General Circulation in the City of Iligan once a week for three (3) consecutive weeks at the expense of the petitioners.

ZAMBOANGA CITY –Authorities arrested 10 people and seized more than PHP6.8 million worth of smuggled cigarettes in two separate anti-smuggling operations here in Zamboanga Peninsula, a top police official said Thursday.

Col. Richard Verceles, operations chief of the Area Police Command-Western Mindanao, said seven of the 10 individuals were arrested Thursday morning near Manalipa Island here.

They yielded more than PHP6.5 million worth of smuggled cigarettes when their motorboat, MPB Shenan, was intercepted by the 2nd Zamboanga City Mobile Force “Seaborne” Company (2ZCMFC) and Bureau of Customs (BOC), he said.

Verceles identified the seven suspects as Alrasid Pawaki, 34, the skipper; Halil Larino, 34; Sawang Haron Totoh, 36; Albhazrie Alimuddin, 20; Arsam Dani Abdulbasid, 19; Ahmad Amjari, 28; and Usman Amil Larino, 45. They are all residents of Sumisip,

11. The truth of the matter is that ABDULJABBAR is the name adopted by petitioner’s father as the latter’s Haj name after he performed Hajj. It has been a tradition among Muslims and Maranaos that children adopt the first name of their father as their surname. As such, the entry in the birth certificate is alfattah abduljabbar pacalna to signify that Alfattah is the son of Abduljabbar Pacalna;

12. Petitioner has been reflecting the surname of his mother NOROL as his middle name and the surname of his father PACALNA as his surname in accordance with the Civil Code of the Philippines;

13. Petitioner believes that the correction of these entries in his Certificate of Live birth under Registry No. 99-226 falls within the ambit of Rule 108 of the Rules of court;

14. This petition is filed without the slightest intention to defraud or prejudice any person, the government or any private entity; its ultimate purpose being to correct the erroneous entries as appears in the public records of the Civil Registry and thus make it reflective of the petitioner’s correct information as appears in all his official records.

The PSA survey results showed the number of unemployed Filipinos decreased to 2.24 million in October from 3.5 million a year ago, with 1.26 million securing employment this year.

The Philippines can learn a lot from Korea because it has an advanced public health management system similar to the US Centers for Disease Control and Prevention (CDC), she said.

Through Senate Bill 2505 or the Philippine Centers for Disease Control and Prevention Act, the DOH aims to move out of the pandemic and ensure health care for every Filipino.

The bill, when enacted into law, will establish the Centers for Health Statistics, Surveillance and Epidemiology, Health Evidence, and Reference Laboratories.

Records from the National Rabies Prevention and Control program showed that there are about 300 to 600 Filipinos who die of rabies every year.

Rabies is a viral disease that causes acute inflammation of the brain in humans and warm-blooded animals, with dogs being the most commonly involved.

Early signs include fever and tingling at the bite site, usually followed by violent excitability, a fear of water, paralysis in some parts of the body or loss of consciousness.
