PEALS dismisses the case against businessman and Esports Founder Bernard Lu Chong and recalls the warrant of arrest in a 27-page decision last April 13, 2023, CA-GR SP No. 174135 from the Special Seventh Division.

The decision granted the petitioner Bernard Lu Chong, the annulment of the said charges against him of alleged illegal shipment originating from Vietnam which had undeclared goods and dangerous drugs through the company Fortuneyield.

The local government has scheduled the festival on June 1-4 based on Executive Order N0. 48 Series of 2023 issued by Mayor Grace Carmel Paredes-Bravo on May 2.

The day-long Magdiwata Environmental Summit will take place on June 3 at the municipal grounds where experts, environmental -

PBBM eyes talks with Vietnam over reported presence in PH EEZ

MANILA – President Ferdinand R. Marcos Jr. has emphasized the need for the Philippines and Vietnam to reach an agreement to avoid potential maritime disputes.

Marcos discussed with Vietnamese Prime Minister Pham Minh Chinh his intent to hold a dialogue with Hanoi to avoid a repeat of sightings of Vietnamese vessels in the Philippines’ exclusive economic zone (EEZ).

This was after the Philippine Coast Guard (PCG) spotted Vietnamese vessels in the West Philippine Sea (WPS) in March.

“Nag-usap kami ng Prime Minister (The Prime Minister and I talked). We have to find a way. Sabi ko huwag

‘yung ganito na nag-a-ano tayo, mag-usap tayo nang mabuti (I told him we have to have a thorough discussion on the issue),” Marcos said in a media interview

on Thursday while on board PR001.

“And that’s why I have asked our foreign ministers, ating Foreign Secretary and then the Foreign Minister of

Vietnam to begin, develop the talks so that we can have an agreement na hindi na siguro magkaproblema ng mga ganyang klase (to avoid any problem).”

In a report last month, the PCG said it spotted at least 20 Chinese and Vietnamese vessels near the Sabina Shoal during its maritime patrol from March 16 to 21.

Getting no response despite multiple radio challenges, the PCG deployed its personnel through rigidhull inflatable boats in and around the shoal to disperse the foreign-flagged vessels.

Marcos said the talks between the Philippines and Vietnam should start as early as possible.

“Dahil hindi naman (Because it’s not) contentious, it’s something that we never had to worry about before, ngayon lang (just now),” he said. “Kaya’t kailangan habang maaga eh pag-usapan na natin at makahanap na tayo ng sarili nating usa -

pan. Mainam nga na hindi magkagulo, hindi magkaincident ng mga nangyayari sa atin ngayon (That’s why we need to talk as early as now and find a way to avoid tension and a repeat of incidents like that).”

On May 1, Marcos directed the Department of Foreign Affairs and the PCG to map out the Philippines’ fishing ground in the WPS. His order came after the near-crash incident off Spratly Island between a Chinese coast guard ship and a Philippine patrol vessel.

MANILA – Senators admitted on Tuesday that there are “issues” in the implementation of Republic Act (RA) 11036 or the Philippine Mental Health Act.

Senator Christopher Lawrence Go cited the distressing situation at the National Center for Mental Health (NCMH) in Mandaluyong City.

Senator Raffy Tulfo conducted a surprise ocular inspection at the NCMH in early April after receiving a tip on the worsening condition of the hospital.

Specifically, it aims to provide mental health services to the community level and integrate mental health and wellness programs to the grassroots.

RA 11036 also seeks to improve facilities and promote mental health education in schools and workplaces.

Senator Sherwin Gatchalian, who chairs the Committee on Basic Education, said he will soon sponsor a bill that will go deeper into the mental health and wellness programs of basic education institutions.

“This hearing is timely because in Section 23 of RA 11036, it’s mentioned there explicitly that the integration of mental health into the education system is mandatory as described in the law. But if you read the law very carefully, it gave you a broad framework on what to go into. But on the

detail of what programs; who will implement the programs; what are the bottlenecks to implement the programs are missing,” Gatchalian noted.

The lawmaker explained that his bill will complement RA 11036 to address the bottlenecks and identify the agency which will implement the mental health and wellness programs in schools.

60,000 schools nationwide but we only have 1,500 registered guidance counselors in our country. So, obviously there is a massive shortage in terms of the personalities who implement mental health programs in our schools,” Gatchalian said.

tal health like other health concerns.

3. The properties shall be sold on an “ AS IS, WHERE IS ” basis which means that the buyer accepts whatever the physical status of the property/ies including whether it is occupied or not.

4. The OFFERED PRICE per property shall not fall below the minimum gross selling price of the property set by the Fund. Example : If the minimum gross selling price of the property is P600,000.00, the Offered Price to be indicated in the Offer to Purchase shall be “P600,000.00” or higher.

DOH offers Ilocos LGUs add’l fund, rewards to ramp up vax drive

MALASIQUI, Pangasinan –

The Department of Health in Ilocos Region (DOH-1) will provide local government units (LGUs) in the region with mobilization funds and incentives to boost the vaccination campaign for children against measles, rubella and polio.

In a statement on Thursday, DOH-CHD-1 director Paula Paz Sydiongco said the mobilization fund will assist LGUs in the financial processes and increase allocations for the ongoing Measles-Rubella and bivalent Oral Poliovirus Vaccine Supplementary Immunization Activities (MRbOPV SIA) campaign.

“This fund will be allocated according to the number of eligible children, vaccinated children, and vaccination coverage and timely reporting,” she said.

LGUs will get mobilization funds worth PHP20,000 for every 100 to 500 children vaccinated, PHP25,000 for

every 50 to 1,000 children, PHP30,000 for every 1,001 to 2,000 children, PHP35,000 for every 2,001 to 3,000 children, PHP40,000 for every 3,001 to 4,000 children, PHP45,000 for every 4,001 to 5,000 children, PHP50,000 for every 5,001 to 10,000 children, and PHP55,000 for every 10,000 above inoculated children.

Aside from the mobilization fund, additional financial incentives will be given depending on the LGU’s accomplishment in meeting their vaccination targets and addressing the increasing number of susceptible children against vaccine-preventable diseases (VPD) in the country.

There will be an additional cash incentive based on their accomplishment starting from PHP15,000 to PHP41,250 for 100 percent accomplishment; PHP10,000 to PHP27,500 for 95 to 99.9 percent accomplishment; PHP5,000 to PHP13,750 for 85 to 99 percent accomplishment.

Timely reporting will also entitle LGUs to a PHP5,000

incentive.

Sydiongco said selected health personnel, technical staff, administrative support and immunization coordinators at the regional and provincial level who will act as coordinators, supervisors, and monitors during the campaign will also be given incentives subject to the availability of funds.

“We will base the number of children vaccinated as per MR target population. And the number of vaccinated children will be determined after the campaign period, including approved extension days,” she said.

Sydiongco thanked the LGUs and the health workers as well as the parents who had their children immunized.

“The vaccination teams will go to the communities to give MR-OPV vaccines to children aged zero to 59 months old so we urge everyone to support this vaccination drive as the vaccines are free, effective, and safe,” she said. (PNA)

DA-BFAR program to boost 'bangus' industry in C. Luzon

a. GROUP SALE Available to interested buyers employed under the same employer. Their employer shall meet the following requirements prior to submission of offer:

- Accredited pursuant to the criteria provided in the prevailing guidelines on the Pag-IBIG Fund Employer Ac creditation Program;

- Have a Collection Servicing Agreement (CSA) or will have CSA with the Fund relative to the deduction and remittance of housing amortization.

NOTE: This mode of sale is also available to members of employees’ associations or cooperatives whose employer has a CSA or willing to execute a CSA with the Fund.

The interested buyers shall submit their individual offer stating their desired property to purchase, offered price and preferred mode of payment (cash, short-term installment or long term installment) to their group’s authorized representative.

The group’s representative shall batch the offers and accomplish Offer to Purchase (HQP-AAF213) with attached List of Interested Employees/Members and Properties to be Purchased under Group Sale (HQP-AAF-214).

The “aggregate Gross Selling Price” of the properties subject of group’s initial offer for the year should be at least Ten Million Pesos (P10,000,000.00). Example :

b. BULK SALE Available to interested buyers of more than one (1) acquired asset with the aggregate “Gross Selling Price” of at least Ten Million Pesos (P10,000,000.00). Example :

Interested buyers shall accomplish Offer to Purchase (If an individual, HQP-AAF-212; if a juridical entity, HQPAAF-213) indicating their preferred mode of payment (cash or short-term installment) together with a List of Properties to be Purchased under Bulk Sale (HQP-AAF-215).

The Fund shall grant a discount depending on the aggregate gross selling price of the properties as follows:

c. RETAIL SALE Available to any buyers who are interested to purchase Pag-IBIG Fund acquired assets. nterested buyers shall submit their offer indicating their preferred mode of payment (cash or short-term installment) using the form Offer to Purchase (If an individual, HQP-AAF-212; if a juridical entity, HQP-AAF-213). The Fund shall grant a discount depending on the chosen mode of payment:

If the mode of payment is through long term installment, the buyer shall attach a copy of his/her proof of income to the Offer to Purchase. The Offer to Purchase shall be sealed in a mailing envelope.

6. The sealed envelope containing the offer shall be dropped in the drop box located at Pag-IBIG Fund Butuan Members Service Branch, Kho Building, Jose Calo Aquino Avenue, Butuan City.

7. The interested buyer shall be required to register at the frontline counter prior to dropping of sealed offers. A Registration Stub will be issued as proof of registration.

8. In case the offer will be dropped by a representative, an Authorization Letter signed by the buyer and photocopy of valid ID of the buyer with contact number shall be presented upon registration. The authorization shall only be limited to the dropping of sealed offer.

9. Acceptance of sealed offers shall be from 8:00am to 4:00pm starting May 29, 2023 until June 2, 2023 . No offers shall be accepted after the said cut-off time and date.

10. The determination of winning offers shall be on June 5, 2023 at the 4th Floor Pag-IBIG Fund Building JR Borja Street Cagayan de Oro City.

11. The determination of winning offers shall be monitored by a representative from Commission on Audit (COA). Attendance of the buyer in the venue is only optional.

12. The buyer who has the HIGHEST OFFERED PRICE on a specific property shall be considered the winner.

13. In case there are identical offers constituting the highest offer on a specific property, the tie shall be resolved by toss coin. However, in case there are more than two (2) highest offerors, the tie shall be resolved through draw lots.

14. The result of the negotiated sale shall be released and posted in the Pag-IBIG Fund official website at www.pagibigfund.gov.ph on the following week after the scheduled date of determination of winning offers. Buyers are encourage to check the result on the said website.

15. Any notification sent by Pag-IBIG Fund through email or SMS shall be sufficient compliance to the notification requirement and presumed to be deemed received by the buyer. In this regard, the Buyer shall ensure that the contact number and email address indicated on the Offer to Purchase are active. The buyer shall inform Pag-IBIG Fund immediately on any changes on his/her contact number.

16. The winning buyer shall be required to pay a NON-REFUNDABLE RESERVATION FEE OF ONE THOUSAND PESOS (P1,000.00) (except for Bulk Sale) within five (5) working days from date of receipt of Notice of Award (NOA). If the mode of payment is through cash or short term installment, a downpayment of at least five percent (5%) of the net selling price shall be paid together with the reservation fee.

17. The winning buyers must abide by the terms and conditions of his chosen mode of payment:

a. Cash Payment – the balance on the net selling price shall be paid not later than thirty (30) calendar days from date of signing of Deed of Conditional Sale (DCS).

b. Short-Term Installment – the balance on the net selling price shall be paid in equal monthly installments, provided that the chosen payment term shall not exceed twelve (12) months subject to an interest based on the Full Risk-Based Pricing Framework for threeyear fixing period. For Bulk Sale, the applicable interest rate shall be based on the Fund’s Full Risk-Based Pricing Framework for Wholesale Loans.

c. Long-Term Installment – payment shall be in the form of monthly amortization based on the approved term, which may be up to a maximum of thirty (30) years with the following considerations:

c.1. Approval and term shall be subject to eligibility requirements stipulated under the Circular 428 Omnibus Guidelines on Sale of Pag-IBIG Fund Real and Other Properties Acquired;

c.2. The amount shall be the buyer’s offered price;

BANGUS PRODUCTION. The Department of Agriculture-Bureau of Fisheries and Aquatic Resources Central Luzon (DA-BFAR 3) is set to implement a program that will boost the bangus (milkfish) industry in the region. An initial discussion was conducted by fisherfolk groups as well as representatives from the local government units in the provinces of Aurora, Bataan, Bulacan, and Zambales with regard to concerns and plans for the implementation of the Bangus Development Program.

CITY OF SAN FERNANDO, Pampanga – The Department of Agriculture-Bureau of Fisheries and Aquatic Resources Central Luzon (DA-BFAR 3) is set to implement a program that will boost the "bangus" (milkfish) industry in the region.

DA-BFAR 3 Regional Director and national focal person for bangus development Wilfredo Cruz said on Thursday that fisherfolk groups as well as representatives from the local government units in the provinces of Aurora, Bataan, Bulacan, and Zambales have conducted an initial meeting to tackle issues, concerns, and

plans for the implementation of the Bangus Development Program.

“We aimed at coming out with a detailed implementation plan for the bangus development program in the region while at the same time, identifying solutions and strategies that may arise during

c.6. In case the application has been disapproved due to buyer’s fault, any downpayment not to exceed 5% of the net selling price and processing fee shall be forfeited in favor of the Fund.

18. The winning buyer shall take possession of the property without seeking assistance from the Fund.

19. If the winning buyer fails or refuses to push through with the purchase of the properties, or fails to comply with the terms and conditions of the sale, he/she shall lose his/her right as the winning buyer and the Fund shall offer the subject property/ies on the next list of properties to be offered for negotiated sale.

It has been prophesied that God will pour out his Spirit upon all men. The Holy Spirit is intended for all of us. We are all meant to be filled with the Holy Spirit. But this divine will obviously has to contend with the way we receive and do things, and that is, that we take to this reality in stages

involving a whole range of human means of teaching, evangelizing, etc.

We need the Holy Spirit because only in him can we truly recognize Christ. Only in him will we be able to have Christ in our life, to remember all his words and even to develop them to attune them to current needs and situations. Only in him can we see things properly. Especially these days when truth, justice and charity have become very slippery, and people are left confounded and vulnerable to fall into skepticism and cynicism, we need to be in the Holy Spirit to be able to sort things out and stay away from the mess.

We need the Holy Spirit to be able to read the signs of the times properly. The world is getting very complicated, and we definitely need the Holy Spirit to guide us. We cannot rely anymore on our politicians and other leaders. We, including politicians and especially them, actually always need the Holy Spirit.

C. Visayas LPG players without registration, license warned

CEBU CITY – An official of the Department of Energy on Thursday urged Liquified Petroleum Gas (LPG) players in Central Visayas to legalize their business operation by securing registration and license to operate (LTO).

Lawyer Rino Abad, director of the Department of Energy’s (DOE)

Oil Industry Management Bureau, said LPG refilling plant operators and bulk distributors must register before constructing their facilities.

Abad said the standard compliance certificates (SCC) issued to LPG players are no longer enough to guarantee the legality of their business operations.

He said marketers, dealers, and retailers should be covered with a license to operate (LTO) before they can legally trade LPG products to the public.

SCC, he explained, must be converted into a registration certificate or LTO as required under Republic Act 11592 or the LPG Industry Regulation Act.

Abad led other government officials in engaging with industry players in Central Visayas during the May 10 to 11 LPG Regional Summit held in a mall at the South Road Properties

here that culminated in an open forum on Thursday. DOE and Department of Trade and Industry officials presented to more than a hundred industry players here RA 11592 and its implementing rules and regulation.

“The old oil deregulation law is no longer applicable. Although this new law has some kind of a regulatory effect but such regulation pertains to safety standards insofar as the LPG industry is concerned. The law does not speak of control as to price and decision on how to go about the business,” Abad said in a press conference at the sideline of the summit.

Jose Rey Maleza, chief of the DOE-Visayas Energy Industry Division Management, said those who will fail to register and obtain an LTO could face an administrative fine of PHP5,000 per day of operation for first offenders, PHP10,000 for second offenders, and PHP20,000 for third offenders.

Those who will fail to comply with the standards will be slapped with a PHP20,000 to PHP30,000 per cylinder as an administrative fine, Maleza said.

said among the features of the new measure is the establishment of an exchange and swapping center in every locality.

The purpose of the exchange and swapping, he said, is to allow a consumer to choose which LPG product he wants to use.

He said there are 38 to 45 million LPG cylinders circulating in the country, but the replacement of around 4 to 5 million for being no longer safe for use could be addressed through exchange and swapping program under the new law. (PNA)

Globe foils over 4M malicious bank -related SMS from January to March

platform Globe has prevented more attempts to rob Filipino depositors of their hard-earned money in the first quarter of 2023 after partnering with banks and financial institutions to fight online fraud.

The latest data showed the number of malicious bankrelated messages blocked by Globe reached 4.07 million from January to March this year. The figure is 2.7 percent higher than the 3.97 million blocked in the same period last year.

“Malicious activities such as identity theft, phishing, and spam messages can severely impact consumers and major stakeholders in various industries, especially the financial sector. At Globe, we understand the importance of safeguarding our customers from these threats. Through our partnership with the banking industry, we hope to enhance our ef-

forts in tackling cybercrime for the consumers' safety and security,” said Globe Chief Information Security Officer Anton Bonifacio.

Globe signed a Memorandum of Understanding (MOU) with the Bankers Association of the Philippines (BAP) last August to address the rising volume of financial crimes. The partnership paved the way for Globe and BAP member banks to share data and intelligence for enhanced fraud detection and prevention.

Just last month, Globe also inked an agreement with the Rizal Commercial Banking Corp. (RCBC) as part of its commitment to work with banks against online fraud. The agreement allows both parties to have a direct and round-the-clock communication channel to report any fraudulent activity for immediate investigation and blocking.

Over 12 months, Globe

blocked 85 million bankrelated spam and scam messages amid its strengthened crackdown against fraudsters. This was part of the record-high 3 billion scam and spam messages filtered out between January 2022 and January 2023.

Aside from the partnership with banks and financial institutions, Globe continues to invest in tools and launching channels to streamline spam and scam SMS reporting both internally and externally,

It has invested about $20 million to step up its spam and scam SMS detection and blocking system. Its round-the-clock Security Operations Center filters out unwanted messages, including app-to-person and person-to-person SMS from international and domestic sources.

AN ORDINANCE INSTITUTIONALIZING AND PRESCRIBING THE USE OF ORDINANCE VIOLATION RECEIPT (OVR)

IN THE ENFORCEMENT OF ORDINANCES IN THE CITY OF MALAYBALAY.

WHEREAS, Section 16 of Republic Act No. 7160 otherwise known as the Local Government Code of 1991, explicitly provides, among others, that “[e]very Local Government Unit shall exercise the powers expressly granted, those necessarily implied there from, as well as powers necessary, appropriate, or incidental for its efficient and effective governance, and those which are essential to the promotion of the general welfare.”;

WHEREAS, Section 458 of the same law authorizes the Sangguniang Panlungsod to enact measures and ordinances which regulate businesses, activities and use of properties for the promotion of the general welfare of its constituents and the peace and order of the locality, the protection of the environment, health, safety and general well-being of their constituents and their locality;

WHEREAS, the Sangguniang Panlungsod of Malaybalay City has enacted various ordinances in pursuit of the aforementioned ideals and aspirations and such ordinances generally imposes administrative penal provisions for the violation thereof;

WHEREAS, to effectively enforce the implementation of the various ordinances enacted by the Sangguniang Panlungsod, particularly on the issuance of citation tickets for violations thereof, there is a need to create mechanism which would streamline and facilitate the systematic issuance of citation tickets/ordinance violation receipts, hence, this Ordinance-

Now, therefore, be it ordained by the 9th Sangguniang Panlungsod of the City of Malaybalay, Bukidnon, in session assembled, that:

SECTION 1. TITLE — This Ordinance shall be known and referred to as the “MALAYBALAY CITY ORDINANCE VIOLATION RECEIPT (OVR) CODE OF 2022”.

SECTION 2. THE ORDINANCE VIOLATION RECEIPT (OVR). This ordinance hereby prescribes and authorizes the printing and use of an official and accountable form which shall be known as the Ordinance Violation Receipt (OVR). This OVR shall be used and issued for violation/s of all existing and future ordinances which prescribes administrative fines and penalties.

The City Treasurer’s Office is hereby authorized to cause the printing of the OVR and shall act as the custodian of the same. The pro-forma OVR to be printed shall ensure that the violator issued therewith shall be informed of the following:

i. The Ordinance and specific section/s and act/s violated and/or committed by the violator;

ii. The date, place and time, if applicable, of the violation;

iii. The amount of fines and/or penalties for the violation;

iv. The complete name and position of the issuing/citation officer;

v. The allowable period of time to pay the fines/penalties; and,

vi. The right to contest the administrative fines/penalties with the concerned office as provided in the applicable ordinance

SECTION 3. SCOPE AND COVERAGE OF APPLICATION — The use of the OVR shall be applicable to all ordinances enacted by the Sangguniang Panlungsod of Malayblay City. Further, Ordinances enacted by the Malaybalay Sangguniang Bayan, which are still in effect upon the approval of this ordinance, are covered by the provisions hereof.

SECTION 4. PROCEDURE IN THE ISSUANCE OF ORDINANCE VIOLATION RECEIPT (OVR).

The following procedures shall be observed by any person charged with the enforcement of an ordinance -

a. Inform the violator of his/her violation;

b. Issue the OVR, indicating the name, address (should be verified) and other pertinent data of the person ap prehended, as may be required in the OVR, including the violation;

c. Inform the violator of his/her right to avail the No Contest Provision, as provided in Section 5 hereof;

d. Document the violation/s through pictures or videos, if applicable.

When the offender is a corporation, partnership, organization or any similar entity, the OVR shall be issued to its President or General Manager or Managing Partner and/or General Manager, or such other Officer-in-Charge with the business.

In case the offender is a minor, no OVR shall be issued to the said minor. The provisions of Sec 57-A of R.A. No. 9344, as amended (The Juvenile Justice and Welfare Act of 2006) shall be applied by the apprehending officers in such cases.

The original copy shall be given to the violator, the duplicate copy shall be forwarded to the City Treasurer’s Office and the triplicate copy shall be retained by the apprehending officer.

SECTION 5. NO CONTEST PROVISION . Any person apprehended for the violation of a City Ordinance, who does not wish to contest the violation and is willing to pay voluntarily the fine imposed shall be allowed to pay the said fine with the City Treasurer, to avoid being criminally prosecuted, where applicable. Unless otherwise specifically provided in an ordinance, the availment of the no-contest provision shall be available only up to the third offense of a specific violation/offense.

For uniformity, the person/s issued with the OVR shall be given seven (7) working days from the issuance or receipt of the OVR within which to pay the fine or penalty, unless a longer period is prescribed by the applicable ordinance. This Section is hereby incorporated and deemed part of all the previous ordinances which impose administrative penalties but did not expressly provide a NO-CONTEST provision upon its approval

SECTION 6. PROCEDURE IN THE AVAILMENT OF THE NO-CONTEST PROVISION.

A. A violator shall be given seven (7) working days from the issuance of the Violation Ordinance Receipt (OVR) within which to pay the penalty;

B. Payment of the penalty shall be made in the City Treasurer’s Office who shall issue an Official Receipt;

C. Failure to pay the prescribed fine within the prescribed period warrants the apprehending officer to file the case with the City Prosecutor’s Office, when applicable, attaching an affidavit indicating therein that the violator failed to pay or did not avail of the No-Contest provision.

SECTION 7. THE FOLLOWING ORDINANCES ARE COVERED IN THE OVR.

A. ALL ORDINANCES FROM 1946-2001

1. Ord. No. 490 Series of 2001- THE CODIFIED CODE OF GENERAL ORDINANCES OF THE CITY OF MALAY BALAY.

B. PEACE AND ORDER AND PUBLIC SAFETY

2. Ord. No. 900 Series of 2019 — AN ORDINANCE ENACTING THE LAND TRANSPORTATION AND TRAFFIC CODE OF THE CITY OF MALAYBALAY.

3. Ord. No. 907 Series of 2019 — AN ORDINANCE MANDATING THE STRICT IMPLEMENTATION OF NEW CURFEW HOURS FOR CHILDREN FROM 10:00 O’CLOCK IN THE EVENING TO 5:00 O’CLOCK IN THE MORNING THE FOLLOWING DAY, PRESCRIBING THE PROPER PROCEDURE FOR THEIR APPREHENSION AND CUSTODY PURSUANT TO REPUBLIC ACT NO. 9344, OTHERWISE KNOWN AS THE JUVENILE JUSTICE AND WELFARE ACT OF 2006, AS AMENDED, AND FOR OTHER PURPOSES.

SECTION 8. APPREHENDING OFFICERS.

Applying Art. 152 of the Revised Penal Code, Persons in Authority and Agents of Persons in Authority shall act as apprehending officer/s for the implementation of the OVR.

Moreover, the concerned offices of the City Government of Malaybalay, its officials and employees and other government officers and employees, who are mandated by an ordinance to implement the same shall act as apprehending officers. Additionally, the City Mayor may deputize other government officials and employees as apprehending officers for the enforcement and implementation of this ordinance

SECTION 9. APPORTIONMENT OF THE PROCEEDS OF ADMINISTRATIVE FINES

The proceeds of the administrative fines collected from or paid by the violators of the Ordinances incorporated herein shall be apportioned as follows:

A. Fifty Percent (50%) of the fines collected shall accrue to the General Fund of the City;

B. Fifty Percent (50%) shall accrue to the apprehending Office or Barangay Trust Fund which will be created for the operational and administrative expenses of its individual offices. In this connection, the City Treasurer is hereby authorized to create a Trust Fund Account for this purpose. The 50% shall be allocated further, as follows:

i. 60% shall be used for the operation and administrative expenses (Maintenance and other Operating Expenses) of the apprehending office or barangay;

ii. 30% shall be given to the apprehending members as incentive; and

iii. 10% shall be given to administration personnel.

Provided that the apportionment herein shall not override the apportionment of administrative fines, if and when provided, in the concerned City Ordinance violated.

SECTION 10. DISSEMINATION.

The Public Education Section under Public Order and Safety Division and the Community Relations and Barangay Affairs Section under Community Affairs Division both under the City Mayor’s Office is hereby directed to disseminate this Ordinance, including its dissemination through social media.

SECTION 11. RECORD KEEPER OF THE ISSUED OVR - The Public Order and Safety Division will be the one who will keep track of all the records regarding the issuance of OVR.

SECTION 12. IMPLEMENTING OFFICES - The Lead Offices shall be responsible in the implementation of the respective Ordinances that fall under their responsibilities/office with the support of other offices:

SECTION 13. SEPARABILITY CLAUSE — In case any part or provision of this ordinance is declared unconstitutional or invalid by a competent court, the remaining provisions not affected thereby shall continue in full force or effect.

SECTION 14. REPEALING CLAUSE - All local ordinances, resolutions, local executive orders or any administrative issuance found to be inconsistent with any provision or provisions of this ordinance are hereby repealed or modified accordingly.

SECTION 15. RETROACTIVE EFFECT. This ordinance shall have no retroactive application to those infractions committed prior to the effectivity of this ordinance

SECTION 16. EFFECTIVITY - This Ordinance shall take effect immediately fifteen (15) days after publication in any newspaper of general circulation in the locality. ENACTED.

ANTI-DISCRIMINATION ORDINANCE (ADO) ON THE BASIS OF SEXUAL ORIENTATION AND GENDER IDENTITY AND EXPRESSION (SOGIE) FOR THE PROTECTION OF LESBIANS, GAYS, BISEXUAL, TRANSGENDER, QUEERS, INTERSEX AND ASEXUAL (LGBTQIA+) RIGHTS IN THE CITY OF MALAYBALAY

WHEREAS, the 1987 Philippine Constitution under Section 2, Article II, provides that, “the state values the dignity of every human person and guarantees full respect for human rights”,

WHEREAS, consistent with Republic Act No. 7160, as amended, otherwise known as the “Local Government Code of 1991”, the Sangguniang Panlungsod has the power to enact ordinances for the generat welfare of the City and its inhabitants pursuant to the general welfare clause;

WHEREAS, to uphold the rights of all Filipinos especially those discriminated against based on their sexual orientation and gender identity and expression (SOGIE), it is the commitment of the City Government of Malaybalay in keeping with its platform on “inclusive governance” to recognize and protect the rights of Lesbians, Gays, Bisexual, Transgender, lntersex and Queer (LGBTIQ) people;

WHEREAS, the Philippines is a state party to several international agreements such as, the Universal Declaration of Human Rights, International Covenant on Economic, Social and Cultural Rights (ICCPR), the Convention on the Elimination of all Forms of Discrimination Against Women (CEDAV\/), affirming LGBTIQ rights as Human Rights this universal, indivisible and inviolable;

WHEREAS, the Yogyakarta Principles, the only international human rights instrument that specifically tackles LGBTIQ rights and SOGIE issues specifically provides for a framework by which SOGIE-based issues are dealt by state and nonstate actors. Through this instrument, the awareness that general human rights principles apply to the LGBTIQ sector in the same way that they apply to other persons is mainstreamed;

WHEREAS, pursuant to the Gender and Development (GAD) programs and initiatives of the City, we have to mainstream all people on both ends of the gender spectrum in all development agenda;

WHEREAS, it is the policy of the Malaybalay City Government to afford equal protection to LGBTIQ people as guaranteed by our Constitution and to craft local legislative in support of this aim;

NOW, THEREFORE, be it ORDAINED by the Sangguniang Panlungsod of Malaybalay City, in session duly assembled that:

SECTION 1. TITLE. This Ordinance shall be known as the “Anti-Discrimination Ordinance (ADO) on the Basis of Sexual Orientation and Gender Identity and Expression (SOGIE) in the City of Malaybalay”

SECTION 2. DECLARATION OF POLICY. It is hereby declared a policy of the City of Malaybalay to promote gender equality and fairness and effectively eliminate all forms of discrimination that violate the rights of Lesbian, Gay, Bisexual, lntersex and Queer (LGBTQ) people and to afford equal protection as enshrined on the Bill of Rights.

SECTION 3. DEFINITION OF TERMS.

a. DISCRIMINATION - constitutes any distinction, exclusion, restriction, preference or other differential treatment that is directly or indirectly based on sexual orientation, gender identity, or gender expression, which has the intention or effect of nullifying or impairing the recognition, enjoyment, or exercise on an equal footing, of political, civil, economic, social, and cultural rights;

b. GENDER EXPRESSION — is how a person publicly present their gender. This can include behavior and outward appearance such as dress, hair, make-up, body language and voice. A person’s chosen name and pronoun are also common ways of expressing gender;

C. GENDER IDENTITY — is each person’s internal and individual experience of gender. It is their sense of being a woman, a man, both, neither, or anywhere along the gender spectrum. A person’s gender identity may be the same as or different from their birth- assigned sex. Gender identity is fundamentally different from a person’s sexual orientation;

d. LGBTIQ - refers to a diverse and complex range of identities based on SOGIE. This term refers to all gender and sexuality non-coming people, including but not limited to lesbian, gay, bisexual, transgender, intersex and queer person:

d. 1 LESBIAN — a woman whose emotional, romantic and sexual energies are geared towards other women;

d. 2 GAY - a person who is emotionally and/or physically attracted to members of the same sex. Although alJ encompassing, this term refers mainly to men;

d. 3 BISEXUAL — a person who is emotionally and/or physically attracted to members of both the same and opposite sex;

d. 4 TRANSGENDER — is the state of one’s gender identity (self- identification as woman, man or neither) not matching one’s "assigned sex” (Identification by others as male or female based on physical/generic sex). Transgender does not imply any specific form of sexual orientation; transgender people may identify as heterosexual, homosexual, bisexual, pansexual, polysexual or asexual.

d. 5 INTERSEX — those who are naturally born and possesses both male and female organs;

d. 6 QUEER - those two are gender non-conforming and who do not want to be defined by any of the labels.

e. SEX - is a human and civil status of a person acquired by birth having organ and system of reproduction;

f. SEXUAL ORIENTATION - refers to the emotional or sexual attraction or inclination of a person towards persons of his/her own sex, or both masculine and feminine sexes.

SECTION 4. COVERAGE. This Ordinance shall cover any person, natural or juridical, who commits any of the acts herein prohibited and enumerated and shall be held liable and penalized accordingly, provided that in the case of juridical persons, such as but not limited to corporations, associations, partnerships, educational and vocational institutions, whether public or private, the manager and head of office shall also be held criminally accountable and responsible.

SECTION 5. PROHIBITED ACTS. The following constitutes acts of discrimination and therefore punishable.

a. Denying or limiting access to an employee oopportunities for promotion, transfer, training, schooling or any other benefit which are otherwise granted to other employees similarly situated on the basis of actual or perceived sexual orientation and gender identity and expression (SOGIE);

b. Refusing employment to a job applicant on the basis of actual or perceived SOGIE;

C. Denying access to public programs and services to medical and other health services on the basis of actual or perceived SOGIE;

d. Refusing admission to or expel or dismiss a person from educational institutions on the basis of sexual orientation and gender identify and expression.

e. Revoking any accreditation, recognition, registration of any organization in educational institutions, workplace and communities on the basis of actual or perceived SOGIE;

f. Subjecting either verbal or written, to insult any person by reason of SOGIE including those posted in social media;

g. Refusing to provide goods or services and/or imposing onerous terms and conditions to a person on the ground of one’s actual or perceived SOGIE as a prerequisite for providing such goods or services where the said terms

and conditions are not imposed on another person under the same or similar circumstances;

h. Refusing or failing to allow any person to avail of services or accommodation in an apartment, condominium, townhouse, flat, hotel, inn, dormitory and any other places of dwelling being rented out or offered to the public of for a fee on the basis of actual or perceived SOGIE;

i. Denying an application for a license, clearance, certificate or any other document issued by government authorities or other pñvate juridical entities, on the basis of actual or perceived SOGIE;

j. It shall be unlawful to commit harassment, unjust detention and involuntary confinement because of one’s actual or perceived SOGIE;

k. It shall be unlawful to refuse entry and/or disallow a person or group of persons from entering any establishment such as restaurants, bars, stores, movie houses, shopping malls, and other places or entertainment and other businesses which are open to the general public; and/or to refuse to attend to, or serve any orders for food, drinks and other goods, consumable and non- consumable; or to subject one to discrimination or harassment in buses, taxis, ships, airplanes, on the basis of actual or perceived SOGIE;

i. It shaw be unlawful to organize groups and activities which promote and if\Gite discrimination against persons based on actual or perceived SOGIE;

m. Any act of discrimination or harassment based on actual or perceived SOGIE, which demeans the dignity and self-respect of a person or impairs, mars, reduces or nullifiers the recognition, enjoyment or exercise of a person’s human and legal rights and basic freedoms in civil, political, labor, economic, social, cultural, education spheres.

SECTION 6. AFFIRMATIVE ACTS. The City shall endeavor to mainstream “gender-fairness” by conducting and celebrating activities such as, but not limited to:

a. Seminars, trainings, workshop, fora and symposia about SOGIE and on “inclusive” workplace in both private and public spaces;

b. Women’s Month incorporatîng LGBTIQ activities in March of every year;

c. International Day against Homophobia and Transphobia (IDAHOT) on May 17 of every year.

d. A month-long celebration of Philippines LGBTIQ March (mid- November to mid-December), including World AIDS Day on December 1 and Human Rights Day on December 10 of every year, and

e. All other days of observance as legislated and passed by the National Legislature and Malaybalay City Council in the future, including a day commemorating the establishment of the Malaybalay LGBTIQ Council and passage of the ADO shall be designated by the City Council and the Mayor and be observed annually.

SECTION 7. INCORPORATION OF SEXUAL ORIENTATION, GENDER IDENTITY AND EXPRESSION (SOGIE) CONCERNS WITH THE FuCTiONS OF VIOLENCE AGAINST WOMEN AND CHILDREN (VAWC) DESK/HUMAN RIGHTS DESK IN MALAYBALAY CITY POLICE STATION AS WELL AS BARANGAY VAWC DESKS.

The Malaybalay City Police Station is strongly encouraged to handle the specific concerns relating to SOGIE through existtng Violence Against Women or VAWC/Human Rights Desk in all police stations Malaybalay City.

SECTION 8. CREATION OF THE MALAYBALAY CITY COUNCIL.

There shall be created a Malaybalay City LGBTIQ Council (MCLGBTIQ) which shall oversee the implementation of this Ordinance and other existing laws, regulations and guidelines relevant to the protection and promotion of the LGBTIQ ñghts who shall integrate and synchronize programs, projects and activities for the LGBTIQ community and which shall coordinate with existing government agencies both in Malaybalay City and the local government support efforts to promote gender development.

The MCLGBTIQ shall conduct trainings and livelihood programs for the LGBTIQ community in coordination with other City departments/omces and national government agencies, including private agencies.

SECTION 9. COMPOSITION OF THE MALAYBALAY CITY LGBTIQ COUNCIL.

The MCLGBTIQ shall be formed by virtue of an Executive Order with the following offiœrs; Chairpersons, ViceChairpersons, Executive Director, ten (10) Members of the Board and a Technical Working Group (TWG). The council members need not be members of the LGBTQIA+ community.

SECTION 10. OVERSIGHT FUNCTION OF THE MALAYBALAY CITY LGBTIQ COUNCIL UNDER THE ORDINANCE. The Malaybalay City LGBTIQ Council (MCLGBTIQ) shall perform oversight functions over the implementation of this Ordinance including the implementation of anti- discrimination programs provided herein. The MCLGBTIQ shall exercise the following principal functions:

1. Monitor complaints concerning violations of any provision of the Ordinance;

2. Facilitate and assist the victims of stigma and discrimination to ensure that they have legal repre sentation, counseling and psychological assistance;

3. Maintain discñmination documentation, case monitoring system, and set-up a databank to easily access various cases and experiences stigma and discrimination;

4. Recommend to the Sangguniang Panlungsod anti-discrimination policies and programs;

5. Monitor or review all policies embodied in resolutions, ordinances, codes and other policy documents to determine if they are free from discriminator statements and provisions to effectively eliminate discrimination stigma and stereotyping LGBTIQs.

SECTION 11. APPROPRIATION. Subject to the availability of funds for the effective implementation ofthis Ordinanœ, the City Government of Malaybalay shall source out funds from the five percent (5°4) of the annual budget appropriated to finance the Gender and Development (GAD) plans, projects and programs after complying with the existing laws, rules and regulations and to cover the operational and management expenses ofthe Malaybalay City LGBTIQ Council as well as for other expenses necessary for the proper, responsive and full operation ofthe organized and established LGBTIQ Council.

SECTION 12. PENALTIES. Any person liable under this Ordinance shall be penalized with imprisonment for a period of not less than sixty (60) days but not more than one {1) year and/or a fine of not less than One Thousand Pesos (Php 1,000.00) but not to exceed Five Thousand Pesos (Php 5,000.00), or both at the discretion of the Court, without prejudice to any applicable criminal, civil or administrative action that may be instituted under the provision of existing laws.

SECTION 13. INDEPENDENT ACTION FOR DAMAGES. Nothing in this Ordinance shall preclude the victim of discrimination based on actual or perceived sexual orientation and gender identity and expression, from instituting a separate and independent action for damages and other affirmative relief.

SECTION 14. IMPLEMENTING RULES AND REGULATIONS. Within sixty (60) days from the effectively of this Ordinance, the Malaybalay City LGBTIQ Council shall jointly formulate, after thorough consultation with multi-sectoral groups and stakeholders, the Implementing Rules and Regulations and guidelines of this Ordinance. The multi-sectoral groups and stakeholders to be consulted shall be composed of experts and representatives from various sectors such as civil society, LGBTIQ non-government organizations, LGBTIQ organizations and community-based organizations.

SECTION 15. INFORMATION CAMPAIGN. Within thirty (30) days from the approval of this Ordinance, the City Public Information Office shall conduct an information campaign to apprise the public of the provisions of this Ordinance.

SECTION 16. SEPARABILITY CLAUSE. Should any part or provision of this Ordinance be held unconstitutional or invalid by a competent court, the other parts or provisions hereof which are not affected thereby shall continue to be in full force and effect.

SECTION 17. REPEALING CLAUSE. All local Ordinance of the Sangguniang Panlungsod of Malaybalay City and Executive Orders and Administrative Regulations of the Local Chief Executive, or parts thereof which are inconsistent with any of the provisions of this Ordinance are hereby repealed, revoked or modified accordingly.

SECTION 18. EFFECTIVITY CLAUSE. This Ordinance shall take effect fifteen (15) days after its complete publication in a newspaper of general circulation in Malaybalay City.

DA trains banana farmers in 3 Caraga towns on production

BUTUAN CITY – At least 75 farmers from the towns of Sison and Tagana-an in Surigao del Norte and Remedios T. Romualdez in Agusan del Norte have completed a six-day capacity training on Banana Production Good Agricultural Practices that concluded Wednesday.

In a statement Thursday, the Department of Agriculture (DA) 13 (Caraga) said the farmers were the recipients of this year’s second phase of the banana production project implementation under the agency’s Special Area for Agricultural Development (SAAD) program.

Each of the farmers’ groups from the three towns will soon receive a PHP1.4 million project package from the SAAD program for a total of PHP4.2 million.

The project will involve the release of banana planting materials, fertilizers, and other farm inputs to each of the organizations.

with container no. SITU 9031817 by the joint operatives of the government, under the direct supervision of the Philippine Drug Enforcement Agency (PDEA), at the Manila International Container Port – Container Freight Station 3 on 22 March 2019.

The alleged charges were brought about the illegal importation of prohibited drugs which was filed against him by the joint operatives of the government under the direct supervision of the Philippine Drug Enforcement Agency (PDEA).

Based on the affidavits filed before the PDEA RO-NCR, the Department of Justice (DOJ) found that there was an alleged OJ) found that there was an alleged attempt to confuse the authorities because the documents filed with the SITC Container Lines Phils., Inc. (SITC) shows that Fortuneyield, the company where herein petitioner served as a former President, was the consignee of the subject illegal shipment originating from Vietnam. However, the subsequent documents filed showed that Wealth Lotus was the consignee of the subject shipment originating from China.

Here, the petitioner asserts that there was no probable cause to indict him as one of the accused in the present case. Petitioner insists that he was no longer connected with Fortuneyield long before the commission of the alleged importation of illegal drugs on 22 March 2019. In support thereto, the petitioner reiterated on the preferred General Information Sheet (GIS) of Fortuneyield, which was submitted to the Securities and Exchange Commission (SEC) on 10 July 2018, and the Board Resolution dated 01 June 2018 issued by the corporate secretary, evidencing his replacement as President of Fortuneyield following his resignation due to medical reasons.

Pertinently, it is well to emphasize that the court’s dismissal of a case for lack of probable cause for the issuance of a warrant of arrest must be done when the evidence on record fails to establish probable cause; that is when the records readily show uncontroverted and, thus, facts that unmistakably negate the existence of the elements of the crime charged.

In this case, the crux of the controversy rests on whether the petitioner’s claim that he was no longer connected with Fortuneyield on or about March 22, 2019, the time of the alleged commission of the crime, because of his resignation, assignment of shares, and replacement as President of the said company long before the said commission of the crime, has been sufficiently established.

WHEREFORE premised considered, the instant Petition is GRANTED. Accordingly, judgment is hereby rendered ANNULLING and SETTING ASIDE the assailed Orders dated 13 September 2021, 25 October 2021, and 29 April 2022 issued by the RTC-Manila, Branch 53 in Criminal Case No. R-MNL-200002-CR. Judgment is likewise rendered ORDERING the dismissal of the case insofar as herein petitioner Lu Chong is concerned and QUASHING

the issued warrant of arrest against petitioner in connection with the afore-indicated case.

A Memorandum of Agreement was signed between the first Chairperson of CDA, Chair Edna Aberilla and the DOE Secretary, Emmanuel Pelaez that these so called ECs must register with CDA within three (3) years. An Omnibus Rules and Regulations were drafted to put the Agreement into reality.

But these so-called Electric Cooperatives have all these years created a strong cabal of vested interest. Of the 119 so-called ECs, only 13 were registered with CDA that have recognized the capital contributions of their respective member-consumer-owners. Those recently registered with

“It is therefore my continuing call for stronger government interventions particularly on the provision of psychosocial services,” he said.

Dr. Razel Nikka Hao, DOH Disease Prevention and Control Bureau director, reported to the committee that since RA 11036 was passed, 62 of their personnel were trained on Basic Institutional Review Board (IRB); 51 as future trainers for IRB; 1,556 completed the World Health Organization Quality Rights e-training; 28 with Lived Experiences completed the course on mental health advocacy and leadership (pilot implementation); and over about 40 media practitioners were trained on responsible and ethical reporting and portrayal of suicide (pilot implementation).

Hao also reported there are already 362 access sites nationwide covering 27 priority mental health medicines with over 124,000 service users in 2022.

“The health facilities ratified network has included 75 mental health facilities across the country. 23 of which to be specialty care centers, 52 as acute and custodial care facilities. We also currently maintain with NCMH the mental health hotline with over 53,000 community calls from 2019 to 2022,” she said. (PNA)

In addition, AGRICONNECT Conference and Exhibition 2023 offers a diverse range of sessions and speakers covering various topics relevant to sustainable agriculture.

Some of the highlights include:

Environmental Protection: This session features Mr. Narapat Kaeothong, Assistant to the Minister of Agriculture and Cooperatives, who will provide an overview of the ministry’s initiatives on environmental protection.

Mr. Takayuki Hagiwara, Regional Programme Leader

of the Food and Agriculture Organization (FAO), will discuss the graduation process from farmer to entrepreneur.

Innovations in Smart Farming: This session aims to examine how technology can play a pivotal role in securing a prosperous future for Southeast Asia.

Matthew McDonald, APAC Precision Technology Product Manager at CNH Industrial will share his insights on this topic.

In addition, Stewart Andrews, CEO of BioSci (Thailand), Ltd., will expound on his experiences in implementing actionable data insights and intelligent farming.

Furthermore, topic about sustainable food security and digital form will be presented by Tobias Fausch, CIO of BayWa AG.

This is followed by the session organized by the German-Thai Cooperation Project for Clusterfarms, the Department of Agricultural Extension and the Thai Society of Agricultural Engineering. Discussions and views on the achievements, challenges and opportunities of adopting Smart Farming technologies in Thailand will also be on hand.

Carbon market regulations will be discussed by Dr. Bjöern Ole Sander, Country Representative of Vietnam for the International Rice Research Institute, in a regional exchange on carbon market regulations for the agricultural sector.

The discussion will feature examples from Southeast Asia.

Additionally, an industry expert panel discussion on

vertical farming will take place, featuring Ms. Christine Zimmermann-Loessl, Chairwoman and Co-Founder of the Association for Vertical Farming, Mr. Ralph Becker, CEO/ Founder of Urban Greens Hydroponics Systems, Inc., and Mr. Sansin Sriphiromrak, CEO of Distar Fresh. They will discuss characteristics of successful business models in vertical farming. Participants will also have the opportunity to engage in interactive sessions and roundtable discussions.
