Maguindanao Sur election officer killed in ambush

COTABATO CITY—The election officer of the municipality of Sultan sa Barongis in Maguindanao del Sur was killed in an ambush while on his way home Monday afternoon.

Election officer Haviv Macabangen Maindan died after he suffered multiple gunshot wounds, according to lawyer Udtog Tago, provincial director of the Commission on Elections in Maguindanao.

The ambush took place 2:30 p.m. in Purok Libas, Barangay Pinguiaman, Lambayong, Sultan Kudarat province. Lambayong, although in another province, is situated between the municipalities of Sultan sa Barongis and Buluan (where

(Cha-cha) as a priority even as several lawmakers push to amend the Constitution.

Senate Majority leader Joel Villanueva said there are laws already in place to

MANILA

– A total of PHP202.5 million worth of smuggled agri-fishery products were seized by the Department of Agriculture (DA) in separate operations at the Manila International Container Port (MICP) in January alone.

In a press release issued on Tuesday, DA said the seized products were contained in 24 container vans consigned to Asterzenmed Inc. and Seaster Consumer Goods Trading Inc.

It said the confiscated goods were either misdeclared or misclassified.

The multi-million worth of smuggled agricultural products by consignee Asterzenmed Inc. were discov-

ered in several operations while nine of the 24 container vans containing fresh red and white onions with a total estimated market value of PHP77.8 million belonged to Seaster Consumer Goods.

On Jan. 23, three containers found to be carrying fresh yellow onions, red onions, potatoes and roasted sweet potatoes with an estimated market value of PHP24.4 million were seized by authorities.

This was followed by the confiscation of three more containers loaded with red onions, imitation crab stick, and frozen boneless beef, with a total estimated market value of PHP31

‘Honesty cart’ boosts values formation at Pampanga school

The Importance of Sports Activities in Schools

Sports activities offered at school are an excellent way for students to develop their personalities. In general, sports activities help students improve their physical fitness. They help to achieve coordination, balance, and flexibility by strengthening the bones and improving the muscles. Sports also improve stamina

and concentration, as well as aid in the treatment of depression and anxiety.

Basically, young ones are more active in dealing with tasks in every undertaking. In sports, pupils can participate in a variety of activities at their levels. These include athletic meets, Physical Education (PE) games, and similar activities in which students participate in ball games, swimming, chess, athletics, board games, and other activities.

Engaging in sports has its relationship towards learning. It has positive impact not only to the physical aspect of one individual; in reality it has more positive effects on mental, emotional and social aspects of one’s life.

The Department of Health (DOH) has deployed seven doctors who graduated from the Doctors to the Barrios (DTTB) Program to several provinces of the Ilocos Region to give health care services to depressed, marginalized and underserved communities.

“These medical doctors will be responsible for implementing the national and local health programs. They will conduct regular medical consultations and referral of critical cases to appropriate health facilities,” said DOH Ilocos regional director Paula Paz Sydiongco in a statement on Tuesday.

The goal of sexuality education is to increase and improve young people’s capacity to make thoughtful decisions about their relationships, sexuality, and overall emotional and physical well-being. Children and teenagers are not encouraged to have sex because of sexuality education.

Sexuality education delivered within a safe and enabling learning environment and alongside access to health services has a positive and life-long effect on the health and well-being of young people.

Studies in various European nations have demonstrated that the implementation of comprehensive national programs for sexuality education has decreased the number of adolescent pregnancies and abortions as well as a drop in the prevalence of HIV infection and STIs among young persons aged 15 to 24. Beyond that, sexuality education can enable young people to build deeper and more lasting relationships by boosting confidence and enhancing skills to handle various obstacles.

The expression of sexuality and sexual behavior are influenced by social standards and gender inequalities. Many young women lack sufficient

control or power in their romantic relationships. On the other hand, young males may experience peer pressure to act in ways that conform to male sexual norms and partake in manipulative or dangerous actions. A high-quality sexuality education can help avoid abuse and promote mutual respect and consensual relationships by having a beneficial influence on attitudes and values and by balancing power dynamics in intimate relationships.

In the Philippines, sex education is not totally implemented due to some issues being a conservation nation. However, the Department of Education (DepEd) has rolled out a Comprehensive Sexuality Education (CSE) K to 12 Curriculum Guide starting with Regions 1, 7, and 11 — regions with the supposed highest rate of teen pregnancy. Accompanying the curriculum are DepEd teacher trainings on CSE.

The present government curriculum is still founded on conservative principles, advocates are pointing out. They would prefer to see the positive sexuality framework, a method that promotes sex as a normal and healthy aspect of life rather than something to be embarrassed, used instead.

The Department of Education (DepEd) emphasizes that the review of the K to 12 curriculum remains ongoing and the experience with Most Essential Learning Competencies (MELCs) will be used to inform and enrich the curriculum. In this post pandemic situation, there is a need to continue enhancing the professional development of teachers. Teaching strategies also shall be one of the focuses on this INSET that the teachers must acquire as we anticipate challenges in the learning delivery to produce quality learners.

One provisions of R.A No.10533 otherwise known as The Basic Education Act of 2013 is to ensure that the enhanced basic education program meets the demand of quality teachers and school leaders, thus the DepEd in collaboration with the academe and other institutions shall conduct In-Service training. It aims to retain current DepEd teachers to meet the content and performance standards

of the K to 12 Curriculum.

To ensure that learners have acquired necessary competencies, teachers must be rated using the Result-based Performance Monitoring System (RPMS) tool for it reflect the results of their performance. With this IPCRF must also be reviewed during this 5-day training.

This School-based Inservice training helped a lot in acquiring different pedagogical skills necessary in carrying out the job, upgrading teachers on different teaching strategies, working collaboratively with colleagues to review the design, selection, organization and use of effective diagnostic, formative and summative assessment strategies consistent with curriculum requirements, and many more.

Most importantly, the bond, the camaraderie among teachers and the good rapport being experienced continuously inculcated in ones pure heart where friendship never ends.

Some four-score years ago during the height of the people’s struggle against British colonial rule in India, Mahatma Gandi’s “Satyagraha” (Love Force) approach to liberate his people from the clutches of Imperialism had manifested a principle that was not given much attention then but is now reverberating through-out the world. Gandhi’s simple statement was, “If man has to be saved from doom, development must be in harmony with nature and not at its expense.”

In the Philippines, we have a more precise declaration from a Lumad leader foretelling of an impending disaster if we continue on sacrificing nature in the name of so-called progress, “Only when you have cut the last tree, only when you have caught the last fish, only when you have dried the last river, only then will you realize that you cannot eat your money.”

An environmentalist from Canada has even a more horrible prediction, “At the rate we are destroying the ozone layer and the world’s resource base and subjecting to extinction some 100 species of flora and fauna every day, what seems unimaginable may become possible, which is, the end of life on Earth.”

In the light of the present ecological disasters we are now experiencing, we should now do some reflections with reference to the above-mentioned warnings that have not been taken heed-of at all. Have the loggers not decimated our forests? Have industries not treated bays and rivers as their waste pits? Have costly agricultural technologies tied-up to the use of heavy toxic chemicals not continuously promoted and practiced though there are more ecologically sustainable ways? And isn’t it that all of these were done in the name of development?

It behooves upon us now to examine the dominant paradigm, in whose name and for whose cause, advancing the common good has been pursued but has only been successful in inflicting massive destruction to the ecosystems, our very means to life. That kind of “development” is anchored on growth-at-all-cost strategies; it is extractive as it is consumerist, based on the “money-must-grow” principle.

That paradigm is now described as a giant offbalance. So as not to fall, it

must run. And in running, it destroys everything it finds in it path, i.e., rivers, bays, forests, agricultural lands, communities, indigenous cultures, etc. It continues building military arsenals capable of killing mankind forty times over. Because of it, we are now losing Mother Earth, that is, if we have not lost Her already.

That economic system oftentimes follows trickledown approach described, that as if, we allow sparrows to pick on something that has already passed the digestive tracts of cattle.

We cannot continue on pursuing the unsustainable pattern of resource exploitation that only survives by whetting the consumerist appetite that has produced a throw-away materialistic, consumerist society. The message has always been, spend, buy this, buy that, so that you will be happy.

As you spend, the economy will prosper, then, you will have more money. And because you have now money, you can buy more and more. What to buy? All that the modern technologies can offer in efficiently exploiting our

COMES NOW, petitioner through the undersigned counsel and unto this Honorable Court, most respectfully avers that:

PARTIES

1. Petitioner is of legal age, Filipino citizen, widow and a resident of Kapatagan, Lanao del Norte. She may be served by this Honorable Court’s notices and other processes through the undersigned counsel with Office Address as here-under indicated;

2. Respondent PNP RETIREMENT AND BENEFITS ADMINISTRATION SERVICE (RBAS) is a government entity with office address at ‘ Camp Crame’, Quezon City where it may be served with this Honorable Court’s notices and other processes.

3. Respondent MERLYN D. TENCHAVEZ is of legal age, Filipino citizen, single and a resident of ‘ Pakilawag, Sultan Naga Dimaporo, Lanao del Norte’ , where she may be served with summons, notices and other processes of this Honorable Court; CAUSE OF ACTION

4. Petitioner was legally married to Ret. SPO2 MARCOS B. RAMIREZ. Their marriage ceremony was celebrated sometime 12 September 2007 by the ‘Presiding Judge’, Hon. Salome P. Dungog, of RTC, Branch 35, Ozamis City. The couple, however, were not blessed with any children. Copy of their ‘ Certificate of Marriage ’ is hereto attached and marked as Annex “A” hereof;

5. Petitioner’s husband, (Ret.) SPO2 MARCOS B. RAMIREZ, was an officer of the ‘ Philippine National Police ’ until he retired from service sometime 08 August 2014. (Ret.) SPO2 MARCOS B. RAMIREZ died sometime 03 June 2021. Upon his death, the latter’s legal beneficiary is entitled for the transfer of the pensioner’s pension to him/her upon application before the PNP RETIREMENT AND BENEFITS ADMINISTRATION SERVICE (‘RBAS’, for short), ‘ Camp Crame’, Quezon City. Petitioner applied for the said ‘ transfer of pension ’ before the afore-mentioned office.

6. Upon application, however, petitioner learned that another woman, herein respondent, MERLYN GONZAGA TENCHAVEZ, claiming to be the lawful wife of (Ret.) SPO2 MARCOS B. RAMIREZ, had also applied for the said “ transfer of pension ’. Apparently, said respondent presented to the RVAS a ‘ Certificate of Marriage ’ indicating that (Ret.) SPO2 MARCOS B. RAMIREZ and her were married to each other as early as 08 June 1982, or about 25 years prior to the marriage of (Ret.) SPO2 MARCOS B. RAMIREZ and herein petitioner. Despite said certificate being an UNSIGNED DOCUMENT, either by (Ret.) SPO2 MARCOS B. RAMIREZ or respondent, MERLYN GONZAGA TENCHAVES, RBAS admitted the same and duly considered said document in arriving at its decision respecting petitioner’s application. Said “ Certificate of Marriage ’ is hereto attached and marked as Annex “B” hereof;

7. As can be gleaned from Annex “B” also, it is indicated therein that respondent, MERLYN GONZAGA TENCHAVES, was only 16 years ild at the time of her alleged marriage with (Ret.) SPO2 MARCOS B. RAMIREZ. Consequently, her marriage with SPO2 MARCOS B. RAMIREZ was void ab initio, which was what RBAS also arrived at in its decision. Finally, respondent, MERLYN GONZAGA TENCHAVES is shown to have birth a child from another man which, apparently, is a ground for disqualification by a surviving spouse/wife for the ‘ transfer of pension ’ of pensioner. Accordingly, the application of said respondent was denied;

8. Unfortunately, by reason of the certificate (Annex “B”) submitted to by respondent, MERLYN GONZAGA TENCHAVES, the application of herein petitioner was also denied by the RBAS ratiocinating that her marriage with (ret.) SPO2 MARCOS B. RAMIREZ was also null and void for failure to secure a judicial declaration of nullity respecting the first marriage of (Ret.) SPO2 MARCOS B. RAMIREZ and respondent, MERLYN GONZAGA TENCHAVEZ, as required by Article 40 of the Family Code. The “ Letter of Denial ” of RBAS, dated 10 November 2021, is attached as Annex “C” hereof;

9. Petitioner was, then, advised to secure a court order declaring her as the legal beneficiary of (Ret.) SPO2 MARCOS B. RAMIREZ reiterating their mandate respecting claims of death benefits, which is “ Memorandum Circular No. 2014-044 ” entitled “ Guidelines and Procedures in the Issuance of Decree of Entitlement and Distribution ”, excerpt thereof is hereby quoted, to wit:

“If they discover that it is a case of “ delayed registration” or contracting parties has “ no signature ”, kindly advise the concerned claimant to secure court order

declaring that they are the legal beneficiary prior receiving and processing of their claims” Copy of the said ‘ Memorandum’ is attached in this petition as Annex “D” hereof.

10. It is the opinion of herein petitioner, however, the committed an error when it considered the UNSIGNED certificate of marriage between respondent, MERLYN GONZAGA TENCHAVES, and (Ret.) SPO2 MARCOS B. RAMIREZ, in concluding that a marriage between the latter parties subsists;

11. For all intents and purposes, such document (Annex “B”) is no more than a mere scrap of paper. It has no legal or official value whatsoever. A marriage does not suddenly exist just because an incomplete and irregular ‘ certificate of marriage ’ is submitted to the civil registrar without any participation thereto by one, in fact, even both, of the contracting parties. Notice also some other discrepancies in the said certificate which are as follows:

a) The marriage between respondent, MERLYN GONZAGA TENCHAVEZ, and (Ret.) SPO2 MARCOS B. RAMIREZ was supposedly celebrated sometime 08 June 1982 yet the ‘ Certificate of Marriage ’ (Annex “B”) form used and submitted to the civil registrar is the ‘ January 1993 Revised Form’ . It is clear that said document was belatedly submitted and registered before the civil registrar;

b) Cleverly, it was not indicated in the said document does as to when it was received by the local civil registrar concerned. It’s not even sure if it was actually received by the latter office as nothing was indicated in Annex “B” of such fact;

c) Sometime 31 July 2007, (Ret.) SPO2 MARCOS B. RAMIREZ applied for a CENOMAR (‘ Certificate of No Marriag e’) before the ‘ National Statistics Office ’. Said office confirmed, in a certificate, that he does not appear in the ‘ National Indices of Marriage ’ as of 31 may 2007 database. Copy of (Ret.) SPO2 MARCOS B. RAMIREZ CENOMAR is hereto attached and marked as Annex “E” hereof. Thus, clearly, the questioned certificate of marriage (Annex “B”) was registered not earlier than 31 May 2007 notwithstanding that (Ret.) SPO2 MARCOS B. RAMIREZ and respondent, MERLYN GONZAGA TENCHAVEZ, were supposed to have been married to each other 25 years prior (1982). To reiterate, petitioner and (Ret.) SPO2 MARCOS B. RAMIREZ’ marriage was celebrated sometime 12 September 2007 ;

d) Finally, the marriage of (ret.) SPO2 MARCOS B. RAMIREZ and respondent, MERLYN GONZAGA TANCHAVEZ, supposed to be solemnized by an RTC Judge. Considering that the respondent was still a minor at that time (16 years old), it is safe to conclude that they were not issued, and did not have, the corresponding ‘ Marriage License ’ at the time their supposed marriage. It’s appalling to think that an RTC Judge solemnized their marriage despite this absence of a mandatory requirement. Mostly likely, no marriage transpired between (Ret.) SPO2 MARCOS B. RAMIREZ and respondent, MERLYN GONZAGA TENCHAVEZ, sometime 08 June 1982, or at any time for that matter. The date/ information respecting the circumstances of the celebration of marriage filled up in the certificate of marriage (Annex “B”) of respondent, MERLYN GONZAGA TENCHAVEZ, and submitted before the civil registrar for registration, is, mostly likely, a fabricated event just so she could claim for the ‘ transfer of pension ’ of (Ret.) SPO2 MARCOS B. RAMIREZ;

12. That unless and until the other claimant can secure a judicial declaration of the existence of marriage, if that be the case, respondent’s alleged marriage with (Ret.) SPO2 MARCOS B. RAMIREZ cannot be considered existing. Thus, there was no need for the latter to secure a judicial declaration of nullity of a previous marriage before his marriage with the petitioner. Obviously, you don’t have a non-existing marriage declared void as there is nothing to declare, to begin with. Thus, the grievous error committed by RBAS in denying petitioner’s application for ‘ Transfer of Pension ’;

13. The only group of heirs that may be prejudiced by this petition, and a favorable judgment thereof, are the decedent’s siblings as they are the only remaining compulsory legal heirs of the latter. Thus, they are also furnished copies of this petition; PRAYER

WHEREFORE, premises considered, it is respectfully prayed, after DUE NOTICE, POSTING, PUBLICATION and HEARING, that an ORDER be issued declaring petition, MARIA MONETTE R. PANCIPANCI, as the legal wife of (Ret.) SPO2 MARCOS B. RAMIREZ. Consequently, it is hereby prayed that respondent, PNP RETIREMENT AND BENEFITS ADMINISTRATION SERVICE (RBAS), be ORDERED to grant the application of herein petitioner for the ‘ transfer of pension ’ of her husband, (Ret.) SPO2 MARCOS B. RAMIREZ, upon compliance with the other requirements of the said office. Consequently, it is also prayed that the Civil Registrar General, Philippine Statistics Authority and all other pertinent government offices be ORDERED to delete in their ‘ National Indices of Marriage s’ the supposed marriage between (Ret.) SPO2 MARCOS B. RAMIREZ and respondent, MERLYN D. TENCHAVEZ.

Other reliefs just and equitable under the premises are also prayed for.

Over 32K PWDs in C. Visayas get PHP128.6-M cash for work

CEBU CITY – More than 32,000 people from 129 localities in Central Visayas region have benefited from the cash-for-work program for persons with disabilities (PWD), with the release of PHP128.6 million, the Department of Social Welfare and Development (DSWD) in Central Visayas (Region 7) reported on Tuesday.

DSWD-7 regional director Shalaine Marie Lucero said the cash assistance given to the 32,336 PWDs was taken from the Kapangyarihan at Kaunlaran sa Barangay (KKB) modality financial assistance and implemented through the poverty alleviation initiative, Kapit-Bisig Laban sa Kahirapan Comprehensive and Integrated Delivery of Social Services (KALAHI-CIDSS).

She said the PWDs were given the minimum regional wage of PHP435 per day in exchange for services or tasks to be accomplished for six to 10 days in their respective communities.

a. Anchoring — Dropping or heaving anchor at a place designated by the Authority with sufficient depth of water vessels anchor or may ride at anchor within the harbor.

b. Apprentice Pilot — A Master who is an applicant for accreditation as Harbor Pilot in the PIEMO Pilotage District and where he has to undergo an apprenticeship training for three (3) months under the Accredited Harbor Pilots Association before he becomes a regular harbor pilot and confirmed by the Authority.

c. Authority — The PHIVIDEC Industrial Authority (PHIVIDEC IA)

d. Chief Pilot — A regular harbor pilot who is elected as such by the members of a Pilots’ Organization.

e. Docking — The service of conducting a vessel to a designated berth. For purposes of assessment of pilotage charges, docking shall include the following:

• Transit of pilot from shore to pilots’ boarding station

• Dropping of anchor

• Conduction of vessel to berth

• Carrying of lines to shore

• Securing of vessel at berth

f. Entering A Harbor — Coming into a protected part of a sea, lake or other body of water used by vessels as a place of safety.

g. Harbor Pilot — A master mariner who is a duly licensed harbor pilot by MARINA or PCG and who is a member of a pilot organization duly accredited by the Authority to act as a regular pilot on any vessel, engaged in foreign or coastwise trade, within limits of the PIEMO Pilotage District. This may also refer to a ship captain or master of a vessel who is duly accredited as a harbor pilot by the Authority for purposes of piloting a vessel under such terms and conditions as may be prescribed by the Authority.

h. Mooring — The typing up of a ship’s bow onto a floating buoy which is secured to the sea bed/anchorage.

i. Pilotage District — The water(s) and harbor(s) which comprise the territory of the PHIVIDEC Industrial Authority as defined in its Charter, the P.D. No. 538.

j. Pilots’ Organization — A single proprietorship, partnership, or corporation duly accredited and authorized by the Authority to render pilotage services in the PIEMO Pilotage District.

k. Qualified Pilot — A harbor pilot who has been accredited by the Authority in accordance with rules and regulations.

l. Shifting — A special service rendered by pilots, upon the Master’s/Agent’s request, wherein the vessel is transferred from one berth to another berth, or from an anchorage to another anchorage area, or from berth to anchorage or vice-versa.

m. Undocking — The service of moving out a vessel from a designated berth, and shall include the following:

• Pilot command to let go of lines

• Heaving of anchor

• Services of removing the vessel from berth and piloting it to the pilots’ boarding station

• Transit of pilot from pilots’ boarding station to shore

n. Unmooring — To let loose from or take in the principal mooring lines preparatory to leaving anchorage.

o. Untwisting — The service of unwinding the twisted or tangled parts of the anchor chain.

p. Vessel — Every sort of boat, craft, or other contrivance used or capable of being used as means of transportation on water, the tonnage limitation of which shall be specified in the prescription of pilotage rates, taking into consideration the conditions of the port.

SECTION 2. Statement of Policy on Pilotage — The conduct of pilotage service is a vital function of maritime travel that directly affects the efficient operations of the port, the over all cost of transport and distribution of goods, safety of the vessel crew and even the protection of the maritime environment. It is hereby declared and recognized that the responsibility to undertake pilotage service is inherently vested in the Authority who is hereby authorizing the discharge of such responsibility to accredited Harbor Pilot s Organization and/or accredited individual pilots.

SECTION 3. Coverage — This Order shall cover all foreign and domestic vessels and all government ports within the territorial jurisdiction of the Authority.

SECTION 4. Accreditation of Pilots/Pilots’ Organization — Unless a law has been passed on “Open Harbor Pilotage Services ” in the country, and a Pilotage Board has been created, there shall be one (1) Harbor Pilots’ Organization to be accredited by the Authority through the Office of the Administrator upon recommendation of an Evaluation Committee composed of the Manager of the Port Management and Development Department (PMDD) as Chairperson; Division Manager, Port Management Division, Harbor Master, Representatives from Legal Services Division, Human Resource Division, and Safety and Security Division as members, respectively.

In the exercise of Authority’s supervisory power and to safeguard life and property, the Authority may permanently or temporarily prevent a pilot organization and/or individual pilot from piloting a vessel, if after due investigation, such pilot organization or individual pilot is found to be incapable of discharging its/his duties.

SECTION 5. No Employer-Employee Relationship — The Harbor Pilot Organization and/or individual pilot, though accredited by the Authority, is not its employee. As such, the selection and hiring of the accredited pilots shall be the prerogative of the accredited pilot organization. The Authority therefore shall not be liable in any manner for the acts or omissions of a Harbor Pilot Organization and/or individual pilot in the performance of their duties. However, the accreditation extended to them shall constitute the authority or permit to render pilotage service within the PIEMO Pilotage District.

There being no employer-employee relationship between PHIVIDEC IA and the Harbor Pilots’ Organization, all pilots and/or Pilots’ Organization, in the performance of their duties shall be under the direct control and supervision of the Accredited Harbor Pilots’ Organization for the efficient and orderly administration of the PIEMO Pilotage District.

SECTION 6. Applicable Pilotage Rate — The Authority shall prescribe the pilotage charges which can be imposed and collected by pilots or pilots’ organization. The Authority shall be entitled to collect ten percent (10%) share of its gross income from pilotage fees, in consideration of the grant of such privilege and for the use of the port facilities.

SECTION 7. Charging of Hazard Fees — Risk or hazard is inherent in pilotage services. Accordingly, pilotage rates already take into account the element of risk involved in the performance of such service. The charging of hazard fee is therefore prohibited.

SECTION 8. Special Services — Special services rendered by pilots shall be as follows:

a. Shifting — However, there shall be no charge where a vessel is shifted from one berth to another within the same side of the pier or wharf, and there is no need to undock the vessel.

b. Ship to Ship Docking/Undocking

c. Dead Ship Docking/Undocking or Mooring/Unmooring

d. Meeting Vessel at a Point Other than the Pilots’ Boarding Station/Quarantine Anchorage

e. Untwisting

f. Channeling In or Channeling Out

SECTION 1. Compulsory Pilotage Service — For entering a harbor and anchoring thereat, or passing through

navigable rivers, straits or channels within a pilotage district, as well shifting, docking and undocking every vessel with 500 GRT and above, engaged in coastwise or foreign trade shall be under compulsory pilotage. However, ship captains or masters may be allowed to pilot their own vessels, provided they are duly accredited by the Authority under such terms and conditions it may impose consistent with existing government regulations.

SECTION 2. Exemption — In the following cases, pilotage service is not compulsory;

a. Government vessels not engaged in commercial trade;

b. Vessels of foreign government entitled to courtesy; and,

c. Vessels calling at private ports not located within a designated channel whose owners have formally waived the requirements of compulsory pilotage.

SECTION 3. Control of the Vessel and Liability for Damage — The Harbor Pilot Organization to which a pilot belongs and/or the individual harbor pilot, as the case may be, shall be solidarily responsible for any damage caused to a vessel, life, or property due to its/his negligence or fault without prejudice to the Organization’s recourse against the erring pilot.

Except when the Master of the vessel is constrained to retain overall command of the vessel even on pilotage grounds whereby he can countermand or overrule the order or command of the Harbor Pilot on board, any damage caused to a vessel, life, or property by reason of the fault or negligence of the Master shall be the liability of the registered owner of the vessel concerned without prejudice to recourse by said owner against the Master.

SECTION 4. Pilotage Equipment and Facilities — To safely and efficiently render the service, the pilots organization shall make available such equipment as required by the Authority, all serviceable and ready-line condition, including reserved and standby equipment. The equipment and facilities shall include but not limited to pilot launches, communication equipment, pilot stations, land transport and office equipment.

SECTION 5. Availability of Pilots — The organization shall have in readiness at all times sufficient manpower necessary to undertake pilotage services within one (1) hour from receipt of notice in writing or by signals as provided under paragraph [ l ] of Section 4 of Article IV of this Policy.

SECTION 6. Pilotage Service Fees — Any vessel which employs a Pilot Organization/Harbor Pilot shall pay the pilotage fees at the rate prescribed by the Authority, with the following conditions:

a. If the service of a pilot organization is refused by the vessel without any justifiable reason after its pilot has reported on board, said pilot organization shall nevertheless be entitled to payment of fees.

b. When upon written request of the Master, a pilot is kept on standby on board a vessel in excess of three (3) hours and the delay is attributable to the vessel, said pilot shall be entitled to an allowance in accordance with the rate prescribed by the Authority.

c. If for any justifiable reason, a pilot is not yet on board upon the arrival or departure of a vessel where pilotage is compulsory after prescribed signals are displayed, such vessel shall anchor and keep the signals displayed for at least one (1) hour.

Article III Pilots’ Organization

SECTION 1. Capitalization — A Pilots’ Organization, if a corporation, shall have a minimum paid-up capital of Fifty Million Pesos (P 50 Million). If a sole proprietorship or partnership, it shall have a minimum capitalization of Fifty Million Pesos (P 50 Million).

SECTION 2. Privilege Fee — For and in consideration of the grant of privilege to undertake pilotage service and/or the use of port facilities, a privilege fee equivalent to 10% of the gross income derived from pilotage services shall be paid by the Pilot Organization/Harbor Pilot.

SECTION 3. Posting of Indemnity Bond —

a. The Pilot Organization shall post an indemnity bond of Five Million Pesos (₱ 5 Million) to cover in whole or in part any liability arising from any accident resulting in damage to vessel(s), port facilities and other properties and/or injury to persons or death which any member may have caused in the course of his performance of pilotage duties. The bond herein required must always be current.

b. Liability of Pilots’ Organization/Individual Pilot — Nothing in these regulations shall relieve the Pilots’ Organization or members thereof, individually or collectively, or any accredited pilot from any civil, administrative and/or criminal responsibility for damage to life or property resulting from the individual acts of its members as well as those of the Organization’s employees and crew in the performance of their duties.

Article IV

Evaluation Committee, Criteria for Evaluating Qualifications of Pilot Organization/Pilots

SECTION 1. Creation of Evaluation Committee — Though the hiring and firing of accredited pilots is not the prerogative of the Authority, it shall exercise its regulatory power to confirm and authorize the pilots in the employ of the accredited organization to render pilotage service in the harbor of PIEMO. Anent thereto, an Evaluation Committee is hereby created which shall be composed as follows:

a. Manager, Port Management and Development Department who shall act as Chairperson;

b. Division Manager, Port Management Division

c. Harbor Master;

d. Legal Services Division;

e. Human Resource Division; and

f. Safety and Security Division

The overall functions of the Committee shall be:

1. To receive, verify and process all applications pilot organization/pilots for accreditation and their supporting documents;

2. To evaluate the qualification of all applicants and recommend those qualified in accordance with the criteria established by the Authority.

SECTION 2. Qualifications and Requirements —

A. An applicant for accreditation shall submit proofs/documents that the members of the organization and/or the individual pilot, possesses the following qualifications:

1. A Filipino Citizen;

2. Not more than 60 years old; Provided, that incumbent pilots who are presently more than 60 years old shall not be covered by this limitation and they shall be allowed to continue as pilots for a period of two (2) years or until they reach Seventy (70) years of age, whichever comes first, unless otherwise disqualified for other reasons.

3. Of sound physical and mental condition and of good moral character;

4. Holder of Maritime Industry Authority (MARINA) license as harbor pilot .

B. The applicant shall also submit the following documentary requirements, which, in the case of an applicant pilot organization, it shall submit the requirements for each of its individual members;

1. Application letter together with duly sworn Information Sheet/Biodata;

2. Master Mariner with a valid Certificate of Competency (CoC) and Certificate of Endorsement (CoE) from MARINA;

3. Copy of Pilot’s examination rating and License/Certificate issued by MARINA to practice as harbor pilot in the Pilotage District of PIEMO;

4. Employer’s Certification of Services rendered as Shipmaster or Seafarer’s Identification and Record Book;

5. Copies of Certificates of Training Courses attended, Positions/ Qualifications and Commendations/ Awards in the maritime/port service;

6. Current Physical and Mental Fitness Certificates from a government physician, and current Board of Marine Inquiry (BMI) clearance to the effect that no case has been filed, pending and/or decided against the applicant organizations;

7. Clearance from the Safety and Security Division (SSD) of the PHIVIDEC-IA which shall conduct background check on the pilots/pilots’ organization for accreditation;

8. Document showing not in the MARINA watch list.

SECTION 3. Accreditation — The accreditation of pilot organization/pilot shall be issued by the Administrator upon recommendation by the Evaluation Committee on the Accreditation of Pilots/Pilots’ Organization of the Authority. Payment of accreditation fee shall be Five Thousand Pesos (P5,000.00).

SECTION 4. Duties and Responsibilities of the Pilot or Pilots’ Organization — The duties and responsibilities of a Pilot Organization/Harbor Pilot shall be as follows:

a. It/he shall respect and follow the schedules of duty agreed upon with the shipping lines/ship agents. In case the pilot on duty unjustifiably refuses or fails to answer vessel’s call for pilotage service, the pilot organization shall be responsible to the Master of the Vessel to immediately provide a substitute pilot.

b. The pilot organization shall ensure that at all times there shall be pilot(s) on duty and available at the pilot station in such number as may be necessary to properly service the normal requirement of vessels calling at the district. It shall likewise, make available such equipment and facilities in serviceable condition, which are necessary for the efficient rendition of pilotage services.

c. A pilot on duty shall report alongside the vessel within one (1) hour from the raising of signals in accordance with paragraph (1) of this Section, unless the Authority, in consultation with the pilot organization, deems the water and weather conditions are not favorable for piloting subject vessel. If it is determined that the vessel cannot be serviced immediately, the pilot organization/pilot shall inform the vessel’s master by any

The master agent of an outgoing vessel under compulsory pilotage shall give the pilot(s) on duty advance written notice of the time of sailing thereof at least one (1) hour before the vessel actually departs. If the vessel cannot depart within said time, the master/agent shall notify the pilot organization concerned thirty (30) minutes before the expiration of one (1) hour.

e. A pilot and/or pilot organization shall be held responsible for the direction of a vessel from the time he/it assumes his/its work as a pilot thereof until he/it leaves it anchored or berthed safely; Provided, however, that his/its responsibility shall cease at the moment the Master neglects or refuses to carry out his/its order.

f. The lawful order/command of a pilot in charge of a vessel shall be promptly obeyed by the officer-in-charge of any vessel which the pilot may consider as an impediment to the safe maneuvering of the vessel under his control.

g. All pilot boats shall be painted white above the waterline and black below, with the letter “p” in black, not less than 30 centimeters in length, on both bows above the waterline.

h. During the day, pilot boats in use shall carry at the foremast visible all around the horizon, an international, code flag “H” 30 meters in length.

i. During the night, the pilot boat shall carry on its masthead, a red light at a distance of 8 feet below the white light and of similar construction and character to the white light, at a height of not less than 20 feet above the hull and visible all around the horizon at a distance of at least 3 miles.

j. Pilot stations shall be established at strategic places as may be designated by the Authority in consultation with all parties concerned. Pilots on duty shall be sufficient in number and available at any time as necessary to effectively perform their duties.

k. The following signals from vessel shall be recognized by all pilots:

1) To ask for a pilot by day;

a. The International Code Flag “G” above the bridge visible all around the horizon.

2) To ask for a pilot by night;

a. Two long and one short blasts on the ship’s whistle or any other means of communication.

l. Advice to Pilots’ Organization which will originate from the shipping agents or operators shall be done in the following manner: For docking:

a. 12 hours for domestic vessels

b. 24 hours for foreign vessels For undocking:

a. 1 hour after clearance to depart has been granted for domestic vessels

b. 1 hour clearance to depart has been granted for foreign vessels at the baseports and 24 hours after clearance for such vessels in outports.

m. The Pilot’s Organization/pilot shall report to the Manager, Port Department or Harbor Master, illegal acts or unusual occurrences that may have come to their knowledge and shall, if requested in case of emergency, assist the Authority’s officials and Customs or Coast Guard Officer in the performance of their duties, and the enforcement of pertinent laws and government regulations.

SECTION 5. Marine Accident/Vessel Clearance — In case of a marine accident causing damage to government pier/wharf/facility, involving a vessel, whether or not under a Harbor Pilot, clearance of said vessel shall be held in abeyance by the Manager, Port Department/Division Manager or his authorized representative, in co-ordination with the Collector of Customs in case of vessels engaged in foreign trade, until liabilities are determined unless a cash or surety bond in an amount sufficient to answer for the estimated cost of the damage is posted by the vessel. Where it is established that the vessel is liable, the owner/agent thereof, shall pay the full amount of the damage. If the decision is contested by the shipping line through an appeal to higher authorities, then a cash surety bond, in an amount equal to the estimated cost of repair of the damage shall be posted by the appellant.

SECTION 6. Disciplinary Action and Dismissal — The Manager of the Port Department of the Authority shall, either at his own initiative or upon complaint under oath of misconduct, negligence, inefficiency, incapacity or violation of the pilotage rules and regulations or refusal to comply with lawful orders of the orders of the Authority, order the investigation of an erring pilot, by the Legal Services Division of the Authority.

The record of the proceedings of the Legal Services Division, together with the report/recommendations, shall be forwarded to the Manager, Port Department who may thereby reprimand, suspend or cancel the accreditation of the respondent pilot or organization/pilot or impose such fines as the circumstances of the case may warrant. The decision of the Manager, Port Department shall be final unless, within thirty (30) days after its promulgation, an appeal is perfected and filed with the Office of the Administrator/CEO of the Authority, which the latter may modify, confirm or reverse.

Article V Final Provisions

SECTION 1. Penalty Clause — Any servicing pilot organization and/or individual pilot who is found to have violated or neglected to perform his/its duties/responsibilities under any of the provisions of this Order shall be subject to punishment by suspension and/or cancellation of his/its accreditation as pilot/pilot organization and to imposition of fines. After due notice and hearing, the following administrative offenses shall be meted out the hereunder prescribed fines:

These fines shall be the solidary liability of the erring person or individual pilot and the organization to which the pilot belongs and shall be without prejudice to claims of vessels or third parties against the erring person or pilot or pilot organization.

Nothing herein provided shall preclude the Authority from pursuing other legal measures to protect its interests against the Pilots’ Organization and/or any individual pilot.

SECTION 2. Visitorial Powers — The Organization shall make available at all times during office hours for inspection, examination and audit by the Authority, all books of accounts, properties, inventories, payroll, and financial records of the Organization, and all other records, concerning its operations.

SECTION 3. Power of the Manager , Port Department — Nothing herein prescribed shall preclude the Manager, Port Department from taking emergency measures in the public interest and/or promulgating specific regulations/ guidelines which are necessary to effectively and reasonably carry out the provisions of this Order.

SECTION 4. Appeal — Decisions of the Manager, Port Department issued pursuant to this order may be appealed within fifteen (15) days from receipt thereof to the Office of the Administrator by the parties who are adversely affected by said decision, otherwise, the same shall become final.

SECTION 5. Repealing Clause — All orders, rules and regulations, circulars, and memoranda previously issued and/or adopted by the Authority which are inconsistent herewith are hereby repealed or modified accordingly.

SECTION 6. Separability Clause — If for any reason any section or part of these Regulations is declared unconstitutional or invalid by competent judicial authority, the declared or invalid section or part thereof shall not affect other sections or parts which shall remain valid and effective.

SECTION 7. Effectivity Clause — This Order shall take effect fifteen (15) days after its publication in a newspaper of general circulation.

PROVINCIAL ORDINANCE NO. 2022-72

“AN ORDINANCE CREATING THE CAMIGUIN PROVINCIAL ENVIRONMENT AND NATURAL RESOURCES OFFICE AND ITS FUNCTIONS, PROVIDING FUNDS THEREOF, AND FOR OTHER PURPOSES.

Be it ordained by the Sangguniang Panlalawigan of Camiguin, in Regular Session:

SECTION 1. TITLE. This Ordinance shall be known as the “ CAMIGUIN PROVINCIAL ENVIRONMENT AND NATURAL RESOURCES OFFICE (PENRO) CREATION ORDINANCE ”.

SECTION 2. POLICY. In line with the national policy as provided for under Section 17 (3), Paragraph (iii) of Republic Act 7160 subject to supervision, control and review of the Department of Environment and Natural Resources, it is the policy of the Provincial Government of Camiguin to adopt measures and guidelines for the protection and conservation of the environment, proper waste management and introduction of technologies ideal and beneficial to its constituents, and the proper utilization of mineral resources applying a well-balanced approach and mechanism without detriment to the ecosystem.

SECTION 3. OBJECTIVES. This Ordinance is enacted to create an office which the primary function is for the implementation of existing laws on environmental protection and conservation, and regulation with regard to the proper utilization of mineral resources in the province.

SECTION 4. SCOPE. This Ordinance shall cover the functions of the office created, its organizational structures, and the corresponding duties and responsibilities of all personnel under therein.

SECTION 5. DEFINITION OF TERMS. For purposes of this Ordinance, the following terms/words used are defined as follows:

The Province. The Provincial Government of Camiguin.

The Governor. The Provincial Governor of Camiguin.

PENRO. The Provincial Environment and Natural Resources Office.

CEC. The Camiguin Environmental Code of 2011. An environmental ordinance of the province which was enacted by the Sangguniang Panlalawigan of Camiguin aiming to conserve, protect the environment and natural resources of the province.

DENR. The Department of Environment and Natural Resources which is a national government agency tasked under the law to monitor, regulate, and implement environmental laws and regulate the utilization of natural resources and minerals in the country.

PDS. Preliminary Disinfection Storage. A disinfection storage owned and possessed by the Provincial Government of Camiguin intended primarily for infectious and hazardous waste generated by health care facilities in the province.

PMRB. The Provincial Mining Regulatory Board.

SECTION 6. POWERS AND FUNCTIONS OF THE PROVINCIAL ENVIRONMENT AND NATURAL RESOURCES OFFICE (PENRO).

To carry out its mandate, the Office shall:

a. Formulate and adopt an effective measure in the protection of the environment and the conservation of lands within the territorial jurisdiction of the province;

b. Enforce national laws, provincial ordinances, national issuances and regulations, and issuances from the Governor on environment and natural resources;

c. Implement the Camiguin Environmental Code (CEC) of 2011 and all existing environment-related laws, ordinances, resolutions, agreement and issuances relative thereto;

d. Implement the environmental programs and projects as mandated by the national government and the Office of the Provincial Governor;

e. Make some recommendations to the Office of the Governor, through the Provincial Legal Office, to revisit/ amend existing environmental ordinances or draft an environmental ordinance to address the current environmental issues in the province and outside, that would tend to affect the island in general;

f. Make recommendation to the Office of the Governor to reactivate and reconstitute the Provincial Solid Waste Management Board;

g. Serve as Secretariat and Member of the Solid Waste Management Board;

h. Manage, supervise, and oversee the over-all operation and maintenance of the sanitary landfills, Preliminary Disinfection Storage, and waste facilities possessed or owned by the province;

i. Conduct research and studies in coordination with the Provincial Planning and Development Office of the emerging local and global environmental issues like solid waste management, water treatment and the like, and provide mechanism to anticipate the same that would be beneficial to the constituents in general;

j. Collaborate with other local government units, non-government environmental organizations, civic groups, national agencies, foreign entities, local communities on conservation of the environment and effective implementation of all related laws;

k. Formulate and assist in the planning of a long-term, sustainable, and well-balanced utilization of natural resources and minerals;

l. Investigate and make recommendations to the Governor for the approval/disapproval of the renewal of existing quarry permits;

m. Investigate and make appropriate recommendations to the Governor for the regulations and suspension of quarry operations to any or all of permit holders due to; alleged violations of existing national laws, ordinances, national environmental guidelines, environmental issuances by the Governor, violation of terms and conditions of any permits which are integral to its operation, actual/immediate threat to lives and limbs of the residents, or to impose revocation of the same, if the grounds so warrant, within the bounds of the law.

n. Prepare and submit monthly reports to the Governor and the Sangguniang Panlalawigan as to the status, developments, and implementation of the existing local or national environmental programs;

o. Prepare and submit monthly reports to the Provincial Governor a comprehensive itemized monthly report of the actual volume of extraction of quarry materials regardless of its classification made by every quarry permit holder/operator including its outstanding balance of allowable volume to extract as provided in the quarry permit;

p. Perform such other duties and responsibilities that any statute, ordinance, or directive from the Governor that may give, vest, or assign.

SECTION 7. COMPOSITION. The Office shall consist of the Office Proper to be headed by the Provincial Environment and Natural Resources Officer or Provincial ENRO which has an equivalent to a department head of the province. The next lower in rank is the Supervising Environmental Management Specialist that would assist the Provincial ENRO with the functions of the office and coordinate with the Office of the Governor. The Office shall have 2 divisions under.

1. Environmental Services Division

2. Natural Resource Management Services Division

1. Environmental Services Division which shall be headed by a Senior Environmental Management Specialist. Under the same are:

a. Ecological Solid Waste Management Unit which shall be headed by an Environmental Management Specialist Il, Environmental Management Specialist I, and Administrative Assistant II personnel;

b. Camiguin Sanitary Landfill and PDS Operation Management Unit which shall be headed by an Environmental Management Specialist Il, Environmental Management Specialist I, and Administrative Assistant II personnel;

c. Pollution Control Management Unit which shall be headed by an Environmental Management Specialist II, Environmental Management Specialist I, and Administrative Assistant II personnel;

2. Natural Resource Management Services Division which shall be headed by a Senior Environmental Management Specialist. Under the same are:

a. Forestry Management Unit which shall be headed by an Environmental Management

Specialist Il, Environmental Specialist I, and Administrative Assistant II personnel;

b. Small Scale Mining Management Unit which shall be headed by an Environmental Management Specialist Il, Environmental Management Specialist I, and Administrative Assistant II personnel; and

c. Coastal Management Unit shall be headed by an Environmental Management Specialist Il, Environmental Management Specialist I, and Administrative Assistant II personnel.

The aforementioned positions shall have the corresponding salary grades

The Provincial ENRO shall be appointed by the Governor, subject to the confirmation by the Sangguniang Panlalawigan. Likewise, all the Civil Service qualifications and requirements including all pertinent documents relative thereto must be fully complied with and accomplished prior to its confirmation.

For this purpose, the PENRO shall have the following Organizational Structure and Staffing Pattern:

SECTION 8. QUALIFICATIONS, POWERS AND DUTIES OF PROVINCIAL ENVIRONMENT AND NATURAL RESOURCES OFFICER (PENRO). As provided for under Section 484, Article XIV of Republic Act 7160, no person shall be appointed as provincial environment and natural resources officer unless:

a. He/She is a citizen of the Philippines;

b. A resident of the local government unit concerned, and of good moral character;

c. A holder of a college degree preferably in environment, forestry, agriculture or any related course from a recognized college or university;

d. A first grade civil service eligible or its equivalents;

e. He/She must have acquired experience in environmental and natural resources management, conservation and utilization of at least (5) years.

The Provincial ENRO shall take charge of the office in coordination with the Office of the Provincial Governor and perform the following duties and responsibilities:

1. Formulate measures for the consideration of the Sangguniang Panlalawigan and provide technical assistance and support to the Governor in carrying out measures to ensure delivery of basic services and provision of adequate facilities relative to environment and natural resources services;

2. Develop plans and upon approval of the Governor implement the same, particularly those which have to do with environment and natural resources programs and projects which the Governor is empowered to implement and which the Sangguniang Panlalawigan is empowered to provide for under the law;

3. Establish, maintain, protect and preserve communal forests, watersheds, tree parks, mangroves, greenbelts, and similar forest projects and commercial forest, like industrial tree farms and agro-forestry projects;

4. Provide extension services to beneficiaries of forest development projects and technical, financial and infrastructure assistance;

5. Manage and maintain seed banks and produce seedlings for forest and tree parks;

6. Provide extension services to beneficiaries of forest development projects and render assistance for natural resources-related conservation and utilization activities consistent with ecological balance;

7. Promote the small-scale mining and utilization of mineral resources;

8. Coordinate with government agencies and non-governmental organizations in the implementation of measures to prevent and control land, air, noise, and water pollution with the assistance of the Department of Environment and Natural Resources;

9. Be in the frontline of the delivery of services concerning the environment and natural resources, particularly in the renewal and rehabilitation of the environment during and in the aftermath of man-made and natural calamities and disasters;

10. Recommend to the Sangguniang Panlalawigan and advise the Governor on all matters relative to the protection, conservation, maximum utilization, application of appropriate technology and other matters related to environment and natural resources; and

11. Exercise such other powers and perform such other duties and responsibilities as may be prescribed by statutes, this ordinance, issuances from the national government, and directives from the Governor.

SECTION 9. THE HUMAN RESOURCE DEPARTMENT. Within 30 days from the passage of this Ordinance, the Human Resource Department (HRD) of the province shall provide for a definite qualifications, duties and responsibilities of each position as abovementioned except the position of Provincial ENRO. The said qualifications, duties and responsibilities shall be in accordance to the existing applicable statutes like the Administrative Code of the Philippines, Civil Service Law in relation to Qualification Standards (as Amended 2017), Department of Budget and Management Circulars, and Commission on Audit regulations. The Office of the Provincial Governor and the Sangguniang Panlalawigan shall be furnished with the said documents in compliance of this Section.

SECTION 10. APPROPRIATION. The amount necessary to implement the provisions of this Ordinance shall be included in the province’ annual budget.

SECTION 11. SEPARABILITY CLAUSE. If, for any reason or reasons, any part or provisions of this Ordinance shall be declared unconstitutional or invalid, other parts or provisions not affected thereby shall continue to be in full force and effect.

SECTION 12. REPEALING CLAUSE. All existing Provincial Ordinances, Executive Orders and issuances made by the Provincial Governor, or portions thereof which are inconsistent are hereby repealed and modified accordingly.

SECTION 13. EFFECTIVITY. This Ordinance shall take effect fifteen (15) days after the publication in a newspaper of local circulation or posting in a conspicuous place in 5 municipal halls of all the municipalities under the territorial jurisdiction of the Provincial Government of Camiguin.

non-renewable resources from the bosom of Mother Earth. That is the meaning of extractive and consumerist. That is the meaning of the money-must-grow principle. It is “pacman-like” diabolical monster gulping-up everything it sees --the forest, mega-diversity, the ozone layer and even all life-forms on Earth.

And because we have allowed that at the expense of our spirituality and that of the Earth, nature’s fury is upon us now! That love-force of Gandhi, that pure spirituality of our Indigenous People that gives high adherence to the Laws of Nature, that ecological warning from a Canadian Environmentalist, must now change our mindset. Only then can we be saved from doom!

That kind of reflection of change not only on dates but on paradigm has indeed come of age. The urgent call of the times now is sustainability, justice and peace through social transformation for people, planet prosperity and peace. In a world under the regime of One Percent whose total wealth is far greater compared to the combined assets of the ninety-nine percent of the world’s population, there is so much veneration to the profitmotive that has already captured the mindset of all governments, all institutions, all universities and even of religious groups.

As unbridled consumerism and materialism is the order of the day, mother earth has been sacrificed to the altar of greed and profit, the reason why humanity is now facing its 6th extinction. As thousands of concerned scientists and environmentalist categorically warned, “the earth is now one minute before midnight.”

Mother Earth (GAIA) is now very sick as its lungs (the forests with all the life forms) are now gone; its veins (the rivers) have dried-up or polluted; its hair (the ozone layer) is now bald; its stomach (oceans and bays) are now very acidic (polluted) and she is now trembling (earthquakes) as manifested in the deaths of 26,000 people, mostly children during the recent earthquakes in Syria and Turkey. With one voice, let us shout together, WE LOVE YOU GAIA! Let us feel the oneness and inter-connectedness of all of God’s creation, be flowers, forest, birds, fish and with the stars which is indeed true love..

Grace Poe said the pronouncement of President Marcos will definitely affect the consensus on the need for charter change.

“Kung hindi susuporta ang Pangulo, mas uunahin ng kongreso ang mga nasa priority list tulad ng (If the President will not support, the Congress will deal with priority list first like the) Internet Transactions Act or CDC bill,” Poe said in another statement.

Poe suggested that new laws intended for foreign investments like amendments on the Public Service Act, Retail Trade Liberalization Act, and Foreign Investments Act should also be discussed by lawmakers in charter change public consultations.

“Kung foreign investments lang din ang usapin (If it is about foreign investments), it might not be relevant to go around the public asking if they agree to term extensions or other non-economic provisions,” she said.

Also agreeing with President Marcos, Senator Alan Peter Cayetano said he will focus instead on pursuing measures pertinent to values, prices, jobs and income.

Cayetano admitted that a lot needs to be changed in the Constitution but noted that some of it are “very political.”

“Ngayon galing sa (Coming from the) pandemic, additional distraction talaga (really). Madidistract lang tayo (We will just be distracted),” the lawmaker said.

Undeterred by the President’s pronouncement, Senator Robinhood Padilla urged Filipinos to support his call for a Constitutional Assembly that aims to

amend some of the Constitution’s economic provisions.

“Sana mga kababayan, itong mga economic provision na ito maisagawa natin dahil ito ginawa ng mga kapitbahay natin sa Asya at sila masigabo na (Hopefully my countrymen, we can work on these economic provisions because our progressive Asian neighbors have already done these),” Padilla said in a radio interview also on Tuesday.

Padilla clarified he harbors no ill feelings toward Marcos.

“’Pag titingnan po natin ang dati niyang interview noong siya po ay mambabatas, naniniwala siya noon na kailangan ng economic provisions sa Saligang Batas. Kailangan magbukas tayo sa foreign investment. Pero siyempre presidente siya, wala na ‘yan sa mandato niya, tama lang po ‘yan (The President, when he was a lawmaker, believed in amending economic provisions in the Constitution to bring in more foreign investments. Now that he is the President, this is not his mandate anymore so there’s nothing wrong with it),” he said.

Senate President Juan Miguel Zubiri told reporters that he sees no problem with what Padilla is doing.

“Trabaho niya yan bilang (It is his job as the) chairman of the Constitutional Amendments. Hayaan natin siya sa trabaho niya. Pero pagdating sa plenaryo, pagdating ng Rules Committee, pagbibigyan po natin ang priorities, ang nakabinbin pang (Let him do his job. But when it comes to the plenary, in the Rules Committee, we will prioritize the pending) 19 LEDAC [Legislative-Executive Development Advisory Council] priority measures,” Zubiri said.

Senator Imee Marcos said changing the Consitution might be a good idea but noted that it is not timely given the country’s current situation.

“Everybody has agreed naman kasi na ‘yung (because the) economic provisions kailangan palitan (needed to be changed). Wala namang ibang tututol. Ang problema pag binuksan mo yung Saligang Batas, talagang kakalkalin lahat. Hindi maiiwasan ‘yun. Kaya’t (No one will disagree, The problem is when you open the Constitution, everything will be scrutinized. It can’t be avoided. That’s why) given the state of our economy and health threats that face us today, ‘yung kapatid ko matagal nang sinasabi talaga na huwag muna yung constitutional issues kasi mahabang usapin yan. Baka cannot afford tayo ngayon (my brother have long been saying not to discuss constitutional issues because it will be a long discussion. We could not afford it right now),” Marcos told reporters.

In an interview after arriving from his Japan state visit, President Marcos expressed confidence that the country can achieve its goals within the present constitutional framework.

Tago said he was able to attend the short wake period of his municipal officer before the body was sent to Maindan’s final resting place in his hometown of Pikit, Cotabato Monday evening for a Muslim burial ceremony. He added that Maindan was a generous person and he could not believe somebody wanted him dead.

Maindan was originally assigned as election officer of Pandag, Maguindanao del Sur.

At the time of election in May 2022, he was reassigned to Mangudadatu, also in the same province, before his latest assignment in Sultan sa Barongis.

The COMELEC office in Maguindanao condemned the attack and sought a thorough investigation.

Asked if the motive could have been related to work, Tago said “it could be possible.”

Khadija Benpolok, DENR12 information officer, said the suspects from Barangay Danlag in Tampakan town will be facing charges for violation of Republic Act (RA) 9147 or the “Wildlife Resources Conservation and Protection Act,” which prohibits the collection, hunting or possession of wildlife species.

“The last time I checked, our enforcement unit was still preparing the necessary charges against the vloggers,” she said in a phone interview.

On February 1, the DENR-12 Enforcement Division, Conservation and Development Division (CDD), Provincial Environment and Natural Resources Office –South Cotabato and the City Environment and Natural Resources Office – General Santos, together with the local police, raided Barangay Danlag after receiving information from concerned residents about the vloggers’ activity.

Felix Alicer, DENR-12 executive director, earlier created a composite team to investigate the information that the vloggers allegedly hunted or trapped wild birds for content production shown on social media.

He lauded the tipsters for their information that led to the seizure of least 21 wildlife species from the residence of the vloggers and some of their neighbors.

Among those confiscated were a crested goshawk and several short-billed brown doves, which were turned over to the DENR-12 Regional Wildlife Rescue Center in Lutayan, Sultan Kudarat for proper care.

The seized wild birds have been released to their habitat in Tampakan town, Benpolok said. DENR-12 officials did not identify the vloggers but the agency

said in an earlier statement that the suspects’ social media channel has at least 22,000 subscribers.

MindaNews tracked Facebook page Dj Maru tv Official, which contains videos showing trapped or caged birds apparently caught in the mountains of Tampakan, host of the largest untapped copper and gold minefield in Southeast Asia.

Dj Maru tv Official’s linked YouTube account has 22,500 subscribers. The YouTube videos, however, have been taken down.

Benpolok said authorities have not caught any of the vloggers and other residents allegedly involved in the illegal wildlife hunting and trapping in the mountains of Tampakan.

“The vloggers and their cohorts may have been tipped by their neighbors before the raiding team could have arrived,” she added.

Engr. Mama Samaon , DENR12 assistant regional director for technical services, earlier said that collection, hunting or possession of wildlife species is a criminal offense under RA 9147.

A violator faces an imprisonment of at least one month to four years and a fine of P5,000 to P300,000, depending on the classification of the wildlife species, the law stated.

“Inasmuch as we like to accommodate a bigger number of registrants but there is a constraint in space initially 3,000 is the maximum number of registrants we can accept because yun lang ma-accommodate ng SMX but due to request ng mga lawyers na ma-accommodate pa sila we have to extend the number of participants from 3,000 to 3,500 and we are utilizing SM Cinema 6,” Atty Uy said.

The tickets for the national convention were immediately sold-out as this is the first faceto-face IBP national convention after the pandemic.

He said they have invited Chief Justice Alexander Gesmundo along with 14 Associate Justices of the Supreme Court to the convention. Also invited were House of Representatives Speaker Martin Romualdez and Senator Francis Tolentino. Meanwhile, Vice-President Sara Z. Duterte

has confirmed that she will attend the fellowship dinner.

This is the third time that Davao City hosted the IBP National Convention, the first was in 1999, and the second in 2013.

Meanwhile, another inspection of three Asterzenmed Inc. containers resulted in the confiscation of PHP24 million worth of red onions and assorted meat products, while PHP21.5 million worth of smuggled assorted meat products were also confiscated after an inspection of three other container vans.

The latest operation reported on Jan. 27 led to the discovery of two container vans loaded with potatoes and fresh yellow onions with an estimated value of PHP23.6 million.

The DA said the confiscated agricultural products originated from Hong Kong, China and have no Sanitary and Phytosanitary Import Clearance.

The operations that lead to the confiscation of multi-million smuggled agri-fishery products were done through the combined efforts of the DA Inspectorate and Enforcement, together with partner agencies including the Philippine ERRATUM

The DA said the campaign against agricultural smuggling is consistent with the directive given by President Ferdinand R. Marcos Jr. to “safeguard the welfare of Filipino farmers and fishers and make locally grown agricultural produce more competitive.”

Anti-smuggling law

In an earlier interview, DA Assistant Secretary James Layug said the anti-agricultural smuggling law should be revisited to protect farmers, fishers, and consumers.

“Akin pong sinusuportahan ang amyenda sa anti-agricultural smuggling law upang ma-include ang price manipulation, which ang composition po niyan ay hoarding, profiteering, and cartel (I support the amendment of the anti-agricultural smuggling so we could include price manipulation, which covers hoarding, profiteering, and cartel),” he said.

Layug said this form of economic sabotage should be addressed by fortifying regulations, digitization in the DA, pushing for the establishment of cold examination facilities for agriculture, as well as continuous collaboration with the local authorities.

“Mapapadali ang commodity monitoring at document tracking para maging mas mapabilis ang pagtawid ng produkto at maprotektahan natin ang borders laban sa smuggling (Commodity monitoring and document tracking could be made easier so we could deliver the products faster and protect our borders against smuggling),” he said.

Meanwhile, the DA said it has confiscated about PHP1.5 billion worth of smuggled agricultural products since October last year.

The amount includes more than 8 million kg. of smuggled agricultural products.
