序 收藏-藏於人類的本性,每個小男孩或小女孩都有過收藏郵票或其他什麼小玩意的經驗。從我的運動員時代到現在 ,我也愛收藏名星運動員的簽名照片、衣物、籃球、足球等等。而我的弟弟則喜歡在旅遊的時候在當地尋找一些他認為有價值 或能升值的舊東西、古董等。 我們的收藏興趣大致也來自於我的父親。我的父親不大講究吃的、穿的,在生活上很節儉,反而在收藏上毫不吝嗇 。他尤其喜歡黃花梨,從小件的投資,像筆筒,鏡箱,小盒等開始,如獲至寶。 父親喜歡把自己的收藏展示在家裡,觀賞其木 紋,觸摸其材質,感受其形態,享受其歲月的歷練,怡然自得。父親甚至將收藏興趣發展成事業,投身藝術行業,開辦了自己 的畫廊,至今已近三十年。 而我的母親是吳冠中的乾女兒,耳濡目染下,我和弟弟很自然的也展開了藝術收藏之旅。在對藝術追尋的過程中, 慢慢從認知,提升了品味、也改變了我的性情、漸漸我的藝術判斷力都有所增長。當然碰上好運氣和眼光的話,藏品增值,則 另有一番喜悅在心頭。 在此,我想跟分享說是:既然收藏的傾向生於我們的本質,那麼就隨心往自己的喜愛踏步,力所能及地開始吧!去 享受收藏,去學習、去分享其讓我們成長的各般樂趣吧!

Prologue The habit of collecting is rooted in our instinct. The collection of stamps or small gadgets are more or less the first attempt for most little boys and girls to kick start their collection. Since the days of being an athlete, I started collecting autographed photos, clothes, basketballs and footballs from famous athletes. And my younger brother, instead, loves to search for old items and antiques when he travels – things that he considers as valuable or having the potential of value growth. Our passion for collection mostly comes from our father. My father leads a thrifty life. He does not have strong passion for food or fashion, but he has been very extravagant in building up his collection. He is very fond of huanghuali. He started his investment in little pieces such as pen case, mirror box, locket as his little treasure. With delightfulness, he likes to display his collection at home, and observe the curves, the touch, the texture, and understand the stories behind each piece. My father has eventually developed this hobby into a career – he devoted himself in the art field, and opened his own gallery. Now, it has been almost 30 years. Master Wu Guanzhong is my mother’s godfather. Under her influence, my brother and I have started our own journey of art collection for more than 10 years. My knowledge in art and my taste in it has been enhanced and refined; it changed my disposition, and honed my artistic judgment. Sometimes, with good luck and vision, you can also have the chance to enjoy the extra happiness in the value increment of certain pieces. The last thing I want to share is: do follow our hearts and instincts – work on what we like, collect what we can, and start right now! Enjoy collecting, keep learning, and go sharing every single joy that lifts us up.

劉錕 1968年生於北京,1992年畢業於中央工藝美術學院。其 作品中多以暗示手法呈現東方式的調侃,對於內心深處錯 綜複雜的心情勾勒,巧妙的投射於作品人物的表情中。當 專注在舞蹈本身的時候,人性化的情緒與超現實的跳躍中 得以宣洩與抒發,舞蹈反而成為了彼岸與幻象。 1996年於北京舉行首個個人展覽,2003年踏上國際舞台 ,參加於紐約舉辦的亞太藝術博覽會;2004年與香港一 畫廊舉辦名為「隱秘的力量」之個展,並於2005年舉辦 名為「雙人舞」之個展。 劉錕的作品展示出一種對生命的詮繹,描繪出人與環境在 空間與時間之間的關係。生命是以經歷組成的,時而充滿 希望,時而感覺沮喪。扭動,跳躍,或甚佇立著思考著生 命這個課題,劉錕畫筆下的人物的各種形態總能讓我們正 視內心和反思生命。 Liu Kun Born in Beijing in 1968, Liu Kun graduated from the Central Academy of Art and Design in 1992. His images are often in an oriental satirical and humorous form, the outline of a complicated feeling is reflected on the character’s facial expression. He often uses viscid strokes and extravagant backgrounds to imply the sensation from the twists and jumps of a dance, and makes a playful re-construction of dance. Liu started his solo exhibition in 1996 in Beijing and stepped on his first international stage in Asia-Pacific Arts Fair in New York in 2003, and held solo exhibitions, including “The Power of Mystery” in 2004 and “Shall We Dance” in 2005 in Hong Kong. Liu Kun’s works are an interpretation of a way of life, a life depicting the relationship between man and his environment in space and time. Our lives are made up of many experiences, sometimes we are full of hope, and sometimes we feel disappointed. Twisting, jumping or just standing around contemplating life, Liu Kun’s figures are intriguing and make us look inside our own hearts and contemplate on our own lives.

閆博 1970年生於北京。1996年於天津美術學院畢業。自 1991年起參加了國內外各種聯展共三十餘次。於 1996年進行首次個人展後,先後在北京、香港等地 舉辦個人畫展。作品獲中國美術館、中國現代文學 館等博物館收藏。 閆博的作品雖主要以日常生活中的情境和肖像為題 材,但閆博總能以不一樣的眼光看待事物,描繪出 不一樣的角度。閆博散發出對生命的熱愛賦予了其 作品生命力和獨特的色彩。 Bob Yan Bob Yan was born in Beijing in 1970 and studied at the Tianjin Fine Art Academy, graduating in 1996. He has participated in over 30 national and international exhibitions since 1990. Since then, his works have won many prizes and widespread acclaims in China, Hong Kong and Singapore. Yan’s works mainly focus on scenes and portraitures of routine life. However, Yan can always look things differently and depict in different angle. His inexhaustible passion towards life endows his artworks with liveliness, uniqueness and vitality.

沈敬東 1965年生於中國江蘇省南京市。1991年畢業於南 京藝術學院美術系版畫專業。個展:1999年起參與 超過四十個聯展,2006年於北京舉行首個個人展「 一張畫的展覽」,「英雄的造像」,於2008年首次 於美國舉行個人展覽「英雄」。 他創作的瓷雕及油畫“英雄系列”使人聯想到毛澤 東及一心為人民的英雄雷鋒 。實際上“英雄”是以 畫家本人為模特兒創作出來的,他向人們傳達了: 神,人,英雄在一體之內,人皆英雄。沈敬東的“ 英雄”形象卡通化,構圖飽滿有穿透力,在中國當 代藝術潮流中顯是顆明亮的新星。 Shen Jingdong Born in Nanjing, Jiangsu Province, China in 1965. Graduated from the Department of Fine Arts, Nanjing Academy of Art in 1991. Shen has participated in over 40 joint-exhibitions since 1999, and he held his first solo exhibition in Beijing in 2006 "Exhibition of One Painting" and in 2007 "Images of Heroes". In 2008 he held his first solo exhibition “Hero” in USA. His creation of sculpture and painting series “Hero series” is reminiscent of Mao Zedong and one of the heroic figure Lei Feng. “Hero” is modeled after the artist himself. He conveyed the message of “God, Man and Hero as one. Everyone as Hero”. Shen’s “Hero” has a cartoonish image, the composition is filled with penetration and live as a shining star in the most trendy Chinese contemporary art trend.

任哲 1983年生於北京,2005畢業於清華大學美術學院 雕塑系,獲學士學位。任哲的作品參加過多次國內 外展覽,從2005年起北京的「首屆798雙年展」, 2007年「的香港國際藝術博覽會」及2007年紐約 的「亞洲當代藝術博覽會」等。 任哲以中國古代武士為題,雕塑並沒有著意刻畫人 物的神情,而是突顯人物強烈動態和氛圍,他大膽 地簡化了一般雕塑追尋的繁瑣細節,反而注重形態 和體態的躍動詮釋。

Ren Zhe Born in Beijing in 1983, Ren Zhe graduated in 2005 from the Academy of Arts and Design of Tsinghua University, China, majoring in Sculpture. His works are found in many international exhibitions, from 2005 “First 798 Exhibition”, “International Contemporary Art Fair 2007” (Hong Kong), “Asian Contemporary Art Fair 2007” (New York), etc. Ancient Chinese warrior is one of Ren’s major characters. His sculptures do not deliberately focus on the facial expression but highlight the strong movements and atmosphere. He boldly simplifies the tedious details, which are pursued after by sculpture creation, but to concentrate on the morphology, the postures and the movements. 12

龎均生於上海的藝術世家,十一歲與姐姐舉辦首 個聯展。兩年後,成功投考杭州美院,後來轉到 中央美術學院繼續進修。龎均融匯中西方的藝術 哲學,他的畫作既能表現西方印象派及野獸派的 爆發力,亦蘊東方文人畫的詩情畫意,成功建立 了東方油畫的表現主義。龎均於華人藝術界有著 舉足輕重的地位,作品廣為海內外美術館及私人 珍藏。1994年被納入《中國當代藝術界名人錄》 ,次年並列入《英國劍橋世界名人錄》。

Born in 1936 in Shanghai to an artistic family, Pang Jiun held his first exhibition with his sister at the age of 11, afterwards, he was admitted to the Hangzhou Academy of Fine Arts two year later, and transferred to the Central Academy of Fine Arts in Beijing. Pang Jiun’s works possess the verve of Western Impressionist and Fauvist art, as well as the poetic ambiance of Chinese literati paintings. Pang Jiun has a strong influence on the contemporary Chinese art scene. His artworks have been selected as public and private collections nationally and internationally. Pang Jiun was named one of the Who’s Who in the Chinese Contemporary Art World in 1994, and was listed in Cambridge Who’s Who in 1995.

馬興文 馬興文兩度親赴義大利,來到傳承百年、具有世界頂級 玻璃秘造技藝的“玻璃之城”穆拉諾島完成此系列。 作品靈感來源於馬在大草原上馳騁飛躍時的瞬間狀態, 表現了馬在奔騰時的無拘無束、自由、瀟灑和飄逸,透 明澄淨的玻璃材質則更映襯出馬純潔、善良、赤誠的品 質。 此系列參與了『馬興文心•水•墨世界巡迴藝術展』 從中 國出發,途經美國,歐洲等地。本系列的作品也被浙江 美術館、美國Frost Art Museum、羅馬Palazzo delle Esposizioni 等機構展出和收藏。 Simon Ma Murano, Italy is renowned as the “Capital of Glass” for producing the world's topmost glass art. He has visited Murano twice and, inspired by it, he has created this piece of glasswork. This work is inspired by the instant status of horse’s gallop leap on the prairie. It expresses the unrestrainedness, freedom and elegance of its leap. The transparency of glass represents the nature of horse as being pure, kind and loyal. The collection has been exhibited worldwide during the “Hear • Water • Ink World Tour Exhibition” from China to America and Europe. The collection has also been exhibited and collected by various museums such as Zhejiang Art Museum, Frost Art Museum in the United States, Rome Palazzo delle Esposizioni in Italy, etc.

畢衡 1985年生於遼寧,2009畢業於中央美術學塑系獲學士學位。 畢衡從2008年開始參與首次展覽後,便繼續在中國不同的主 要城市展開展覽,包括北京,上海,三亞和香港。 畢衡其中一件最為人熟悉的作品是『中國變形金剛』,此作 品為他的畢業作,高9.7米,重約4噸。此雕塑是以中國式卡 車和變形金剛兩者形象結合而成。雕塑的臉部是根據中國英 雄——關雲長而造,雕塑手執關刀,其風姿充分展示出這位 三國時代以義氣而聞名的英雄的風采。 變形金剛是現代最受歡迎的漫畫人物之一,其英雄的形象也 在他拯救人類免受外星人攻擊的劇情裡入木三分。 畢衡成功地把這兩位劃時代的英雄人物重新詮釋、兩相融合 ,從而塑造成此作品。 Bi Heng Born in Liaoning Province in 1985, Bi Heng graduated in 2009 from the Central Academy of Fine Arts, majoring in Sculpture. He held his first exhibition in 2008 and continuously exhibited in major Chinese cities including Beijing, Shanghai, Sanya, and Hong Kong. "Chinese Transformer" is one of his most famous series of sculptures. A larger-sized "Chinese Transformer" has been crafted upon his graduation and afterwards exhibited in major Chinese cities. The height of that work is 9.7 metres and weight 4 tons. Like his graduation work, which features a mixed image of a Chinese-style truck and a transformer, the work in this lot further integrates another Chinese icon - the hero Guan Yunchang - into the formation. This Guan Yunchang is wielding a single-edged sword, his most beloved weapon. The work fully embodies the dominating air of courage, righteousness and sharpness of this hero living in the Three Kingdoms era. Meanwhile, the transformer is also among the most recognisable pop images in the modernity. It wins so many hearts through heroic deeds of saving human race from the alien attack. The artist has successfully merged the characteristic of the two images together in creating this harmonious work that transcends time and space.

Buyers agree to be bound by the terms and conditions (including the following terms and conditions) and important notices (which are made orally or in writing prior to or during an auction) stipulated and/or issued by Sun International Auction Limited (the “Company”), found in the Company’s catalogue, auction halls (including announcements), the Company’s documents and website, as well as their subsequent amendments made by the Company from time to time (“Terms and Conditions”). The Company has the absolute discretion to refuse to accept the authorization being valid with or without a reason. Generally, to place a bid, the Bidder simply raises his bidding paddle. The auctioneer will take incremental bids on each lot, until only one Bidder remains. The Bidder with the highest bid accepted by the auctioneer will purchase the lot. Each lot will normally have a reserve price, which is previously set and agreed. If the highest bid falls below the reserve price, the lot will remain unsold. 2. Absentee Bids If the Bidder is unable to attend the auction in person, the Company will be happy to execute written bids on the Bidder’s behalf. This service is free and the Bidder’s information will be kept confidential. The absentee bid form is attached on the back of each catalogue. The Bidder can also download it from the Company website. The Bidder should indicate the item upon which the Bidder wishes to bid and the maximum bid amount which the Bidder is willing to make to Seller with other requested information on the absentee bid form, and return the completed absentee bid form to the Company either by fax, by post, by email or in person to the Company’s responsible officer 24 hours before the auction. When the Company executes an absentee bid on the Bidder’s behalf according to the instructions given in the absentee bid form, the lot will be bought with reasonable endeavour for the lowest bid that exceeds all competing bids and which meets or exceeds the reserve price. When the bidding price of a lot after the next bid increment exceeds the Bidder’s maximum bidding price, the Bidder’s bid will be rounded down to the nearest amount consistent with the bidding increment set down by the auctioneer. In the event of identical maximum bidding price from more than one absentee Bidders being received, the earliest absentee bid form being received by the Company will take precedence. The Company shall not be held liable whatsoever for failing or omitting to place a bid for any absentee Bidder resulting in any unsuccessful bid. The Company has the absolute discretion to notify or not to notify any successful absentee Bidders after the conclusion of the auction. Nevertheless, the Company shall not be held liable for omitting to notify successful absentee Bidders or any errors contained in the invoice so mailed, should the Company elects to notify the successful absentee Bidders, whch notification will be made by sending an invoice by mail. It is the Bidder’s responsibility to check the auction results. 3. Telephone Bids If the Bidder is unable to attend the auction in person, the Bidder may register for telephone bidding. This service is complimentary and may not be available in relation to all lots. The Company’s responsible officer may, at his absolute discretion, contact the Bidder from the auction hall prior to the auction of the Bidder’s specified lot(s) and, if the telephone connection is successful and uninterrupted, will relay live auction to the Bidder and also may place bids for the telephone Bidder to the auctioneer. For details, please contact the Company’s responsible officer. As the number of telephone lines is limited, it is necessary to make arrangements for this service 24 hours before the auction. The Bidder shall provide his telephone number to the Company for the purpose of the telephone bidding; any bidding via such telephone number shall be deemed to be the Bidder’s bids and Bidder have to make sure the phone is available for ownself. The Company has the absolute discretion to place or not to place any bid for the telephone Bidders, and determine any dispute arising from telephone bidding. For the security reason, all telephone bidding conversation may be recorded. 4. Bidding Deposit Before bidding, each Buyer is required to produce an identification document, complete a registration form and pay a deposit; the deposit is to be determined by each auction hall and is generally levied at HK$500,000 or above. The Company reserves the right to ask the Buyer for the provision of documents such as any credit proof is sued by a bank or other proof so f assets. The said deposit will be arrange to refund to the Buyer where there is no successful bids or upon completion of the settlement of a successful bid within 14 days.

5. Buyer’s premium 5.1 The Buyer’s Premium of Each Lot Payable by the Buyer. The Buyer should pay the hammer price and in addition, the Buyer’s Premium to the company. a) For hammer price below HK$20,000,000(inclusive), the Buyer’s Premium should be calculated at 20% of the hammer price. b) For hammer price higher than HK$20,000,000, the total amount of the Buyer’s Premium should be that first HK$20,000,000 of the hammer price should be calculated at 20% and the rest amount of the hammer price should be calculated at 18% c) For hammer price higher than HK$50,000,000, the total amount of the Buyer’s Premium should be that first HK$20,000,000 of the hammer price should be calculated at 20% and the amount which exceed HK$20,000,000 but within HK$50,000,000 (inclusive) of the hammer price should be calculated at 18% and the rest of the hammer price should be calculated at 15% 5.2 The Buyer acknowledges and agrees that the Company may or will pay to an agent and/or any third party a commission or rebate for introducing the Buyer to the Company and/or providing services to the Buyer prior to, during and/or after the Buyer taking and/or having taken part in an auction. 6. Payment The Company accepts cash, cheque, bank draft, wire transfer or credit card for payment. If paid by cheque, the Buyer is only allowed to collect the lot after the clearance of the cheque by the bank. The Buyer may pay in full for a successful bid at the auction hall; otherwise, the Buyer is required to pay 30% of the hammer price of the lot as a deposit. After the conclusion of the auction, the Company may, at its absolute discretion, mail an invoice, payment guide and delivery information to a successful Buyer. The Buyer shall pay the hammer price, Buyer’s premium and any applicable tax. All payable amounts shall be settled within fifteen (15) days after the conclusion of the auction. The Company will only accept payment from the addressee on the Company’s invoice and has the absolute discretion to refuse any third-party payment. 7. Collection and Delivery After settlement of a successful bid, the Buyer may collect the lot at the auction hall or arrange self-delivery service. For any uncollected lot after fifteen (15) days of the conclusion of the auction, the Buyer shall be responsible for all storage fees, handling fees, taxes and insurance premium. 8. Taxation All payments payable by the Buyer to the Company are exclusive of any sales tax and value-added tax or otherwise (whether to be levied in Hong Kong or elsewhere). It is the Buyer’s responsibility to pay relevant taxes in accordance with the applicable laws in the relevant countries. 9. Presale Exhibition Exhibition of lots before the auction will be free and open to the public. 10. Auction Results All auction results will be uploaded to the Company website after the conclusion of the auction. If the Buyer has any enquiry relating to such results, please call Hong Kong (852) 2251 3300. It is the Bidder’s responsibility to check the auction results. The Company shall not be liable to the Bidder for failing to notify the Bidder for any successful bids, notwithstanding any provision to the contrary. 11. Storage Service The Company can arrange storage and delivery services of the lot at the Buyer’s request. At the conclusion of the auction, all lots will be available for collection in the auction hall. All uncollected lots will be stored in a warehouse with no charges for the first fifteen (15) days after the conclusion of the auction (“Free Storage Period”). Subsequent to this Free Storage Period, the Company will arrange the storage of the uncollected lot and the Buyer shall be generally charged a storage fee of HK$100(to be changed from time to time) per day for each uncollected lot. 12. Insurance All risks in the lot pass to the Buyer when it is knocked down to the Buyer on the fall of the auctioneer’s hammer in respect of the lot. The Buyer hereby irrevocably agrees to accept the risks and shall consider whether to buy insurance to cover such risks in the lot on the understanding that after the conclusion of the auction, the Company will provide an insurance coverage up to fifteen (15) days for each lot sold or upon the collection of the lot by the Buyer (“Insurance Coverage Period”), whichever occurs the earliest; such insurance may only cover the risks in the lot in part only, or not at all. 13. Sold Please note that the Company considers an item as “sold” if:1. The bidding price is higher than the reserve price; and2. Auctioneer announced the paddle number and knock with the hammer. 14. Bidding Guide All biddings will start from a reserve price with a bid increment and Bidders must notify the auctioneer with their number paddles. Upon acceptance of the highest bid by the auctioneer, the Buyer shall immediately sign a Confirmation of Sale (“Confirmation Document”) provided by the Company. The Buyer then pays and collects the successful lot with this Confirmation Document in accordance with the Terms and Conditions. All hammer prices are in Hong Kong Dollar or the equivalent foreign currencies converted into Hong Kong Dollar according to a bank exchange rate on that day. Any arrears for payment of a lot of the Buyer shall be deemed as a breach of contract and the lot shall also be deemed as unsold. All deposits of the lot shall be forfeited and the Company may take legal proceedings to recover any arrears. 15. The Company as an agent Unless otherwise stated in other provisions, the Company sells as an agent for the Seller. All completed sale of lots are contracts made between the Buyer and the Seller. 16. Before the auction 16.1Examination of lotsBuyers are strongly advised to examine personally any lot in which they are interested, before the auction takes place. Neither the Company nor the Seller provides any guarantee in relation to the nature of the lot. The lot is sold on an “as is” basis.

16.2 Catalogue and other descriptions All representations, condition reports and statements set out in the catalogue for the lot or at the back of the catalogue indexes, or which are made orally or in writing elsewhere, are opinions only and are not to be relied on as statements of fact. Such statements do not constitute a representation, warranty or undertaking made by the Company. References in the catalogue as to defects of the lot or their restorations (“Defects and Restorations”) are for guidance only and Defects and Restorations should be evaluated by personal inspection by the Bidder or his appointed expert. The absence of such a reference does not imply that an item is free from defects or restoration, nor does a reference to a particular defect implies the absence of any others. An estimate of the lot should not be relied on as a statement that this is the price at which the item will be sold or its value for any other purpose. Neither the Company nor the Seller is responsible in any way for errors and omissions in the catalogue, or any supplemental information. 16.3 Buyer’s Responsibility All lots are sold on an “as is” basis without any representation or warranty of any kind by the Company or the Seller. Buyers are responsible for ascertaining the actual condition of the lots and the information mentioned in the catalogue 17.At the auction 17.1 Refusal of admissionThe Company has the absolute discretion to refuse any person to enter the auction hall, to participate in any auction and to reject any bid. 17.2 Registration before bidding Each Buyer is required to produce Identification Documents belonging to him, complete a registration form and pay a deposit of HK$500,000. The Company may ask the Buyer for the provision of any credit proof issued by a bank or other proofs of financial situation. If the deposit is paid by cheque or wire transfer, the Buyer is only allowed to collect the bidding paddle after the clearance of the cheque or wire transfer by the bank. 17.3 Bidder as principal When making a bid, the Bidder is accepting personal liability to pay the hammer price, including the Buyer’s premium and all applicable taxes, plus all other applicable charges, unless it has been explicitly agreed in writing with the Company, before the commencement of the auction, that the Bidder is acting as agent on behalf of a third party (“Principal”) acceptable to the Company and that payment shall be made by the Principal; by such case, the Company will only look to the Principal for payment. 17.4 Currency converter At some auctions a currency converter may be operated. Error may occur in the operation of the currency converter and we do not accept liability to bidders who follow the currency converter rather than the actual bidding in the saleroom. 17.5 Video recording or digital images The Company may record the auction by means of video recording or digital images or otherwise for security reasons or to assist in solving any subsequent dispute which may arise in relation to bids made at the auction. At some auctions, there may be a video or digital projection of images of lots. In case there are errors occurred in its operation resulting in poor quality of the image, the Company shall not be held liable and/or responsible for such errors and shall not be held liable for all loss, damage howsoever caused. 17.6 Reserve Price Each lot will normally have a reserve price, which is previously set and agreed. If the highest bid falls below the reserve price, the lot will remain unsold. 17.7 Auctioneer’s discretion Notwithstanding any provision to the contrary, the auctioneer has the absolute discretion to refuse any bid, to advance the bidding in such a manner as he may decide, to withdraw or divide any lot, to combine any two or more lots. In the case of errors or disputes, whether during or after the conclusion of the auction, the auctioneer has the absolute discretion to determine the bid of the successful Bidder, to continue the bidding, to cancel the auction or to re-offer and re-sell the items in dispute. If any dispute arises after the conclusion of the auction, the Company’s auction record is conclusive. 17.8 Payment and collection a) Unless otherwise agreed, payment of the Purchase Price for a lot and any Buyer’s Expenses are due in Hong Kong dollars immediately on conclusion of the auction (the “Due Date”) notwithstanding any requirements for export, import or other permits for such lot. b) Title in a purchased lot will not pass until Sun International Auction Limited has received the Purchase Price and Buyer’s Expenses for that lot in cleared funds. Sun International Auction Limited is not obliged to release a lot to the Buyer until title in the lot has passed and appropriate identification has been provided, and any earlier release does not affect the passing of title or the Buyer’s unconditional obligation to pay the Purchase Price and Buyer’s Expenses. c) The Buyer is obliged to arrange collection of lots within 15 days of the auction. Purchased lots are at the Buyer’s risk (and therefore their sole responsibility for insurance) from the earliest of from the earliest of collection or 15 days after the auction. 17.9 Remedies for non-payment or failure to collect purchased lots If the Buyer fails to make payment in full in good cleared funds within the time specified by the Company, the Company shall be entitled in the Company’s absolute discretion to exercise one or more of the following rights or remedies (in addition to any other rights or remedies available to the Company by law): a) to charge an interest at a rate as the Company shall reasonably decide; b) to hold the defaulting Buyer liable for the total amount due and to commence legal proceedings for its recovery together with interest, legal fees and costs to the fullest extent permitted under applicable law; c) to cancel the transaction of the lot;

d) to re-sell the lot in an auction or a private sale on such terms as the Company shall think fit;e) to pay the Seller an amount of the net proceeds payable in respect of the hammer price by the defaulting Buyer,; f ) to set off any amounts, which the Company owes to the Buyer in any other transactions, against the outstanding amount remaining unpaid by the Buyer; g) where there are outstanding amounts payable to the Company by the Buyer, in respect of several transactions, the Company has the absolute discretion to apply any amount paid by the Buyer to discharge any outstanding sum (in whole or in part) owed by the Buyer in respect of any particular transaction, whether or not the Buyer has so directed; h) to reject at any future auction any bids made by the Buyer including his authorized officer or to demand an extra deposit from the Buyer before accepting bids as the Company thinks fit; i ) to exercise all the rights and remedies of a person holding security over any lot in the Company’s possession owned by the Buyer, whether by way of pledge, security interest or in any other way, to the fullest extent permitted by the law of the place where such lot is located. The Buyer shall be deemed to have granted such security to the Company and the Company may retain such lot as collateral security for such Buyer’s obligations to the Company; and j ) to take such other action as the Company may deem necessary or appropriate.If the Company re-sells the lot as set out above in sub-clause (d), the defaulting Buyer shall be liable for payment of any deficiency between the total amounts originally due to the Company and the money obtained upon re-sale as well as for all costs, expense, damages, legal fees and commissions and premiums of whatever kind associated with both auctions or otherwise arising from the default. If the Company pays any amount to the Seller as set out above in sub-clause (e), the Buyer acknowledges that the Company shall have all of the rights of the Seller, however arising, to claim the Buyer for such an amount. 17.10 Failure to collect purchased lots Where a purchased lot is not collected within fifteen (15) days from the date of the auction, whether or not full payment has been made, the Company shall be permitted to arrange storage at the Buyer’s expense at HKD$100 (to be changed from time to time) per lot per day and only release the item after payment in full has been made of removal, storage, handling, insurance and any other costs having been incurred, together with payment of all other amounts due to the Company. 18 Extent of the Company’s liability Neither the Seller nor the Company including the Company’s employees or intermediary (or referrers), is responsible for the correctness of any statement of whatever kind concerning any lot, whether written or oral, nor for any other errors or omissions in description for any faults or defects in any lot. Neither the Seller nor the Company including the Company’s employees or agents, give any representation, warranty or guarantee or assume any liability of any kind in respect of any lot with regard to commercial value, fitness for a particular purpose, description, size, quality, condition, originality, authenticity, rarity, importance, medium, provenance, exhibition history, literature, historical relevance or otherwise. Except as required by local law, any statement or opinion made by the Company (including those persons invited or requested by the Company) shall not be construed to be a warranty made by the Company for any lot or be relied upon by the Buyer. 19 Waiver and severability The Company’s failure to exercise or enforce any right or provision of this Buying Terms and Conditions shall not constitute a waiver of such right or provision unless acknowledged and agreed to by the Company in writing.If any provision of this Buying Terms and Conditions is found by a court of competent jurisdiction to be invalid, the other remaining provisions shall remain to have full force and effect. 20 Law and jurisdiction The rights and obligations of the Company and Buyers with respect to these terms and conditions, the conduct of the auction and any matters connected with any of the foregoing shall be governed and interpreted by the laws of Hong Kong SAR. The Buyer and the Company agree to submit to the non-exclusive jurisdiction of the Hong Kong SAR courts. 21 Arbitration Any dispute or claims including but not limited to any breach, validity and termination of this Buying Terms and Conditions shall be referred to and finally resolved by arbitration in Hong Kong in accordance with the Rules of the Hong Kong International Arbitration Centre (“HKIAC”). The language of the arbitration shall be Chinese. The number of arbitrator shall be one (1) or as stipulated by HKIAC to be the minimal number of arbitrator.

2.書面競投 若未能親臨拍賣現場,太陽國際拍賣行非常歡迎競投者委託太陽國際拍賣行作出書面競投。這項服務是免費,而競投者有關資料將會保 密 。書面競投表格可於拍賣圖錄後找到,該表格亦可在太陽國際拍賣行的網站下載。競投者請在書面競投表格註明意圖競投的拍賣品和最 高 競投價及提供所需的資料,並在開拍的二十四小時前將已填妥的書面競投表格傳真、郵寄、電郵或親身交給太陽國際拍賣行的工作人 員。 太陽國際拍賣行將盡合理努力以最低價,並達到或超過底價為競投者投得指定的拍賣品。當拍賣品的競投價在下一次每口喊價後高於 競投 者註明的最高競投價,太陽國際拍賣行將會下調競投者的競投價至最接近拍賣官之每口喊價。若太陽國際拍賣行收到相同競價的書面 委託 ,將會優先處理較早提交的書面委託,太陽國際拍賣行不會對不能或遺漏代競投者作出競投致令競投失敗負任何責任。太陽國際拍賣 行有 絕對酌情權是否通知成功的競投者,如太陽國際拍賣行選擇通知則會郵寄發票予成功的競投者,而太陽國際拍賣行亦不會對發票中出 現之 任何錯誤或錯漏負任何責任。競投者須自行查詢拍賣結果。太陽國際拍賣行保留絕對權利,拒絕任何書面競投。

3.電話競投 若未能親臨拍賣現場,競投者亦可選擇參與電話競投,這項服務是免費,並不適用於所有拍賣品。太陽國際拍賣行的負責人員在有絕對酌 情權的情況下可能在意圖競投的拍賣品拍賣前在拍賣廳致電競投者,及如在電話成功接通及通話不受干擾的情況下轉達競投實況及代為出 價。欲知詳情,請聯絡太陽國際拍賣行的負責人員。由於電話線有限,請先在拍賣會前二十四小時預約此項服務,若競投電話線已滿,太 陽國際拍賣行保留絕對權利,拒絕任何電話競投。競投者須提供其電話號碼給太陽國際拍賣行作電話競投之用; 任何透過該電話號碼作出的 競投會被視為由該競投者所作出; 競投者必須確保電話沒有給予第三者使用。太陽國際拍賣行有絕對酌情權代競投者出價並對電話競投的任 何爭議有最終決定權。基於保安原因,電話競投過程可能會被錄音。

4.保證金安排 準買家在競投之前,必須填妥及簽署登記表格,並提供具照片有效的身份證或非香港居民 提供具照片有效的護照/通行證。保證金按個別專 場拍賣來定,一般最高是港幣五萬圓正。本公司有權要求準買家出示銀行信用証明或其他財產証明文件。若準買家沒有成功競投任何拍品 或對競投勝出的所有拍品完成交收後,保證金將會在拍賣完結後十四天內,以太陽國際拍賣行決定的方式按排退回給準買家。請確保閣下 提供有關之銀行資料詳情。

10.競投結果 所有競投結果均會於拍賣會後上載於太陽國際拍賣行之網頁以供 查閱,如對拍賣結果有任何問題 ,請致電香港(852)2251 3300。 競投者須自行查詢拍賣結果。太陽國際拍賣行毋須為沒有通知 成 功競投者付上任何責任。

11.貯存 太陽國際拍賣行可協助買家安排拍賣品之貯存及寄運事宜。拍賣 完畢後,所有拍賣品將首先貯於 拍賣場內供買家提取,其後則會 存於倉庫,太陽國際拍賣行將不另收取貯存費用,惟買家如拍賣 後十五天內仍未提取拍賣品,太陽國際拍賣行將安排貯存該等拍 賣品,費用由買家負責。費用為 每件拍賣品每天港幣一百元(此費 用隨時更改)。

12.保險 當拍賣官敲槌並確認接受買家之最高競投價時,有關拍賣品之所 有風險均會由買家承擔。買家不 可撤回地同意接受有關風險及自 行考慮是否對有關拍賣品投保以涵蓋該風險;買家亦明白太陽國 際拍賣行會為售出的拍賣品投保,但此投保可能不涵蓋任何風險 或只涵蓋部份風險,而保障期最 長為拍賣會後十五天或自買家提 取該拍賣品為止(“投保期”),以較早者為準。

13.成交 正式成交須符合以下條件: 13.1. 競投價高於保留價;及 13.2 拍賣官敲槌並宣讀競投牌號。

14.競投須知 競投由底價開始,以遞增的喊價進行拍賣。競投者應價須以號碼牌 顯示,成 功競 投後 須 隨 即簽 署太陽國際拍賣行提 供的“成交確 認 書”,並憑此書依拍賣條款及細則付清款項及提走拍賣品 。拍賣成 交價是按照港幣計算,如以外幣結算則按當日銀行外匯兌換價折算 成港幣。如買家逾期 未付清款項,買家會被視為毀約,該拍賣品會 被視為尚未出售,其已付之保證金不作退還,太陽 國際拍賣行有權 從法律途徑追討欠款。

15.太陽國際拍賣行作為代理人 除另有條文訂明外,太陽國際拍賣行為賣家的代理人。拍賣品的 成交合約,則為買家與賣家之間 的合約。

16. 拍賣之前 16.1鑒定拍賣品 太陽國際拍賣行鄭重建議準買家於拍賣進行之前親自檢查及鑒定其有興趣競投之物品。太陽國際 拍賣行或賣家不會對買家就拍賣品的性質作出任何保證,而拍賣品亦是以其在拍賣時的現狀出售 。

16.2 圖錄及其他說明 所有在該拍賣品所載之圖錄中、在圖錄索引背後或在其他地方以 口頭或書面方式作出之陳述、拍 賣品狀況報告及聲明(“聲明”)均只屬意見之表述,而不應依據為事實之陳述。此聲明並不構成 太陽國際拍賣行任何 形式之任何陳述、保證或承諾。圖錄所提及 之有關瑕疵或修復,只作為指引,而該等瑕疵或修復應由競投者 或由競投者 指定的專家親自檢查。未有提述此等資料,亦不表示 拍賣品全無瑕疵或未經修復; 而如已提述特定瑕疵,亦不表示並無 其他瑕疵。拍賣品之估價,不應被依據為拍賣品會成功拍賣之價 格,或用作其他用途的價值。太陽國際拍賣行或賣家不 會對圖錄 或任何補充資料中的任何錯誤或遺漏負責。 16.3 買家之責任 所有財產均以其“現狀”拍賣,太陽國際拍賣行或賣家均並不就 此作出任何陳述或保證。買家有責任 查明並了解有關拍賣品之狀 況及圖錄所提及之事項。

17.拍賣之時 17.1 拒絕入場 太陽國際拍賣行有絕對酌情權拒絕任何人士進入拍賣場地、參與 拍賣,亦可拒絕接受任何競投。 17.2 競投之前作出登記 準買家在競投之前,必須提供身份証明文件,填妥及簽署登記表 格並支付保證金港幣五十萬元正。太陽國際拍賣行可能 要求準買 家出示銀行信用証明或其他財務狀況證明。若買家使用支票或電 匯付保證金,在支票或電匯成功過戶後,買家 才可獲得拍賣牌。

如太陽國際拍賣行因上述第(d)段重新售賣拍賣品,不履行責任的 買家將支付太陽國際拍賣行原來該買家尚欠太陽國際拍賣 行的全 數款項與拍賣品再重售時所得款項的差額,及負責任何有關原來 之拍賣及重售拍賣或因不履行責任時產生的所有費 用、 支出、賠 償、 律師費、 佣金,及酬金。如太陽國際拍賣行因上述(e)段支付 賣家任何金額,買家則承認太陽國際拍賣 行有賣家之所有權利可 就此金額向買家追討,不管該等權利如何產生。 17.10 未有領取已購拍賣品 如已購得之拍賣品未有在成功拍賣後15天內領取,則不論該拍賣 品是已全數付款與否,太陽國際拍賣行將替該拍賣品安排 倉儲,買家須為此支付每件拍賣品每天港幣一百元正(金額將會不時更改)。太陽國際拍賣行只會在因該等倉儲所引致的搬 移、處理、貯存、保險及任何其他費用,連同結欠太陽國際拍賣行之所有其他款項全數付清後,方會讓買家領取已購拍賣 項目。

18. 太陽國際拍賣行之法律責任 不論賣家或太陽國際拍賣行,或太陽國際拍賣行任何僱員或代理人,無論是以書面或口頭形式對任何拍賣品作任何種類的 陳述、 任何其他說明之誤差或任何拍賣品之任何缺陷的描述有任何錯誤 或遺漏,均不負有任何責任。賣家、太陽國際拍賣 行、太陽國際拍賣行之僱員或代理人均無就任何拍賣有關其商業價值、是否適合作某特定用途、或其他描述、大小、質量 、狀況、原創性、真實性、罕有程度、重要性、媒介、出處、展覽歷史、刊物或歷史的關聯等作出任何陳述、保證、擔保 或承擔任何責任。除非當地的法律要求,否則太陽國際拍賣行之任何陳述或意見(包括太陽國際拍賣行邀請或要求之人士所 作出的) 均不應被解釋為太陽國際拍賣行對任何拍賣品所作出的保證或被買家所依賴。

19. 條款之放棄及分割性 17.3 競投者為主理人 除非競投者在拍賣開始前與太陽國際拍賣行明確地以書面協定其 將為被確認第三者之代理人,並協定太陽國際拍賣行只 會向主理 人收取款項,否則在競投時,競投者是以個人承擔法律責任去繳 付落槌價,包括買家所支付的佣金及所有適用 的稅項,以及所有 其他適用的費用。 17.4 貨幣兌換顯示板 在某些拍賣會上,本公司會使用貨幣兌換顯示板,而該等顯示板 在操作時難免有出現錯誤。買家可能因依賴貨幣兌換顯 示板(而 非拍賣場的實際競投)而蒙受之任何損失,本公司概不負責。� 17.5 錄影或電子影像 為了保安理由或協助解決任何有關拍賣會事宜之爭議,太陽國際 拍賣行或會拍攝拍賣過程。在某些拍賣會上,當中某些 拍賣品或 會以影片或影像投映放出,如有投映操作上之出錯致令影像質素 不佳,太陽國際拍賣行不會對此承擔任何責任 及不需作出任何賠 償。

除非太陽國際拍賣行以書面作出同意,縱使太陽國際拍賣行未有 行使或執行條款所受予之權利,仍未能視為放棄有關條款 之行 為。若法庭裁定條款中某條款無效,其他留下條款仍保持有效。

20. 法律及管轄權 各方的權利及義務,就有關本業務規定,拍賣的行為及任何與上 述條文的事項,均受香港法律管限及由香港法律解釋。太 陽國際 拍賣行及買家接受香港法院之非排他性管轄權。

21. 仲裁 凡因本買家拍賣條款及細則所引起的或與之相關的任何爭議、 糾紛或索賠,包括但不限於違約、協議的效力和終止,均應 根據《香港國際仲裁中心機構仲裁規則》,在香港仲裁解決。仲裁員人數一(1)名或由香港國際仲裁中心指定之最低人數。 仲裁語言為中文。

17.6 保留價 每一件拍賣品將會有一個預先訂定的保留價,若最高喊價低於保 留價,該件拍賣品將不會成交。 17.7 拍賣官之酌情權 拍賣官有絕對酌情權去拒絕接受任何競投、以其決定之方式進行 拍賣、將任何拍賣品撤回或分開拍賣或將任何兩件或多 件拍賣品 合併拍賣。如遇有出錯或爭議,不論在拍賣之時或之後,拍賣官 有絕對酌情權終止成功競投者所作的競投、是 否繼續拍賣、取消 拍賣或將有爭議性的拍賣品重新拍賣。如在拍賣後有任何爭議, 將會以太陽國際拍賣行的拍賣紀錄為 依歸。 17.8 付款及領取 a) 除非另有協定,否則不論拍賣品之出口、進口或其他許可證之任何規定為何,均必須於拍賣會結束(「到期日」)後 立即以港元支付拍賣品之買入價及任何買家之費用。 b) 所購拍賣品之擁有權將於太陽國際拍賣行悉數收取買入價及買 家之費用後方可轉移。太陽國際拍賣行概無責任在拍賣 品之擁有 權經轉移及合適之證明經已提供前將拍賣品交給買家,而提早交 付拍賣品不會影響擁有權之轉移或買家支付 買入價及買家之費用 之無條件責任。 c) 買家有責任安排在拍賣會後十五天內領取已購買之拍賣品。 買家不可撤回地同意接受有關風險及自行考慮是否對有關 拍賣品 投保以涵蓋該風險;買家亦明白太陽國際拍賣行會為售出的拍賣 品投保,但此投保可能不涵蓋任何風險或只涵 蓋部份風險,而保 障期最長為拍賣會後十五天或自買家提取該拍賣品為止(“投保 期”),以較早者為準。 17.9 不付款或未有領取已購拍賣品之補救辦法 如買家未有在太陽國際拍賣行 規定的期限內繳付全數及有效清 賬,太陽國際拍賣行有絕對的權力行使以下一項或多項權 利或補 救辦法(附加於在法律上可用於太陽國際拍賣行之其他權利或補救 辦法): a) 根據太陽國際拍賣行合理決定之利率收取利息; b) 不履行全數及有效付清款項責任的買家須承擔尚欠之全部金額 及在適用法律允許的範圍內最大程度地承擔因太陽國際 拍賣行 取回此金額而開始的法律訴訟程序相關的利息及訴訟費用; c) 取消該項拍賣品之交易; d) 根據太陽國際拍賣行認為適當的條款對公開重新拍賣或私下 重新售賣拍賣品; e) 代不履行全數及有效付清款項責任的買家支付賣家應收的 拍賣淨收益; f) 將太陽國際拍賣行在任何其他交易中欠下買家之款項用作抵銷 買家未付之款項; g) 如買家因多項不同之交易而欠下太陽國際拍賣行數筆款項, 太陽國際拍賣行有絕對酌情權將買家所付之任何款項用以 償還 買家就某一交易尚未清償之任何款項(部份或全部),而不論 買家是否作出該等指示; h) 在將來的任何拍賣中,拒絕買家或其授權代表作出競投, 或在接受任何競投之前收取太陽國際拍賣行認為有需要的額 外買家保證金; i) 在拍賣品所處地方之法律許可之下,就太陽國際拍賣行持有 買家的拍賣品,太陽國際拍賣行可以抵押品持有人的身份 行使 最高程度之權利及補救方法,不論是以抵押方式、保證方式或 任何其他形式。買家已被視為授予太陽國際拍賣行 該抵押品及 太陽國際拍賣行可保留此拍賣品作為買家對太陽國際拍賣行 全數及有效付清款項責任之附屬抵押品; 及 j) 採取任何太陽國際拍賣行認為需要及適當之任何行動。

Personal Information Collection Statement This Statement is provided to the Client as an individual client (including prospective clients (including demo trading platform users) and data subjects) of the Sun International Auction Limited (the “Company”) in accordance with the requirements of the Hong Kong Personal Data (Privacy) Ordinance (the “Ordinance”).

(x) Marketing products, services and other subjects of the Company and the Group(please see paragraph 1.3 below) to the Client;

1. Use of Personal Data

(xii) Transfer of such data to any place within and outside Hong Kong for the above purposes and/or relating thereto.

1.1 Users All personal data concerning the Client (whether provided by the Client or any other person, and whether provided before or after the date the Company handles auction or related services and/or provides relevant consulting services to the Client) held by the Company will be kept confidential but the Company may provide such information to the following parties for the purposes set out in paragraph 1.2 (each, a “User”):

1.3 Use of Data in Direct Marketing The Company intends to use the Client’s data in direct marketing and the Company requires the Client’s consent (which includes an indication of no objection) for that purpose. In this connection, please note that:

(i)

Sun International Auction Limited and any of its Associates and Affiliates (the“Group”);

(ii)

Any local or foreign governmental, regulatory or other bodies or institutions, whether as required by law or regulations v applicable to any member of the Group;

(iii)

Any director, officer or employee or agent of the Group;

(iv)

Any local or foreign person (such as lawyers, advisers, nominee, accountants, custodian, third party service providers, insurance companies, logistics companies, transportation companies, warehouse companies and appraisers / valuers etc.) authorized by the Company and/or the Group when carrying out the Client’s Instructions ,daily operation and the business of the Company and/or the Group;

(v)

Debt collection agencies (in the event of default)

(vi)

Any actual or proposed assignee of any rights and obligations of the Group;

(xi) Maintaining credit history of the data subjects for present and future reference; and

(i)

The name, contact details, products and services portfolio information, transaction pattern and behaviour, financial background and demographic data of the Client held by the Company may be used from time to time by any member of the Group in direct marketing;

(ii)

The following classes of services, products and subjects may be marketed;

(a)

Financial, insurance, securities, fiduciary, investment services, immigrant investor programs, local or foreign study, auction and related services and products; Reward, loyalty or privileges programmes and related services and products;

(b) (c) (d) (iii)

Services and products offered by the Company and any member of the Group with the co-branding partners (the names of such co-branding partners can be found in the application forms for the relevant services and products, as the case may be); and Donations and contributions for charitable and/or non-profit making purposes; The above services, products and subjects may be provided or (in the case ofdonations and contributions) solicited by the Company and / or:-

(vii)

Third party financial institutions, insurers, credit card companies, securities and investment services providers;

(a) Any member of the Group;

(viii)

Third party reward, loyalty, co-branding and privileges programme providers;

(ix)

Co-branding partners of the Company and the Group (the names of such co-branding partners can be found in the application forms for the relevant services and products, as the case may be);

(b) Third party financial institutions, insurers, credit card companies, securities and investment services providers, third party local or foreign immigration consulting companies, education consulting companies, educational institutions, insurance companies and auction companies;

(x)

Charitable or non-profit making organisations; and

(xi)

External service providers (including but not limited to mailing houses, telecommunication companies, telemarketing and direct sales agents, call centres, data processing companies and information technology companies) that the Company engages for the purposes set out in paragraph 1.2 (x).

(c) Third party reward, loyalty, co-branding or privileges programme providers; (d) Co-branding partners of the Company and the Group (the names of such co-branding partners can be found in the application forms for the relevant services and products, as the case may be); and (e) Charitable or non-profit making organisations; (iv) In addition to marketing the above services, products and subjects itself, the Company also intends to provide the data described in paragraph 1.3(i) above and, when requesting the Client’s consent or no objection as described in paragraph 1.3(iii) above for use by them in marketing those services, products and subjects; and the Company requires the Client’s written consent (which includes an indication of no objection) for that purpose;

1.2 Purposes All personal data concerning the Client may be used by any User for the following purposes: (i)

Enabling the Company and/or the Group to provide daily operation of the services (including demo trading platform services),and facilitating the same relating to the Client, including handling auction and/or related services and/or providing relevant consulting services;

(ii)

Enabling an actual or proposed assignee of the Company and /or the Group, or participant or sub-participant of the Company’s(and/or the Group’s) rights in respect of the data subjects(persons who provide data and include the Client) to evaluate the transaction intended to be the subject of the assignment, participation or sub- participation;

(iii)

Creating and maintaining the Company’s and/or the Group’s scoring models;

(iv)

Any person to whom the Company and/or the Group is under an obligation or otherwise required to make disclosure under the requirements of any law binding on or applying to the Company or any law binding on or applying to the Company and/or the Group, or any disclosure under and for the purposes of any guidelines, rules or similar directives given or issued by any legal, regulatory, governmental, tax, law enforcement or other authorities, or self-regulatory or industry bodies or associations of financial services providers with which the Company and/or the Group are expected to comply, or any disclosure pursuant to any contractual or other commitment of the Company and/or the Group with local or foreign legal, regulatory, governmental, tax, law enforcement or other authorities, or self-regulatory or industry bodies or associations of financial services providers, all of which may be within or outside Hong Kong and may be existing currently and in the future.

(v)

Ongoing transaction administration, including without limitation the collection ofamounts outstanding from data subjects, enforcement of data subjects’ obligations in respect of security, charge or other rights and interests held by any member of the Group;

(vi)

Complying with any obligations, requirements, policies, procedures, measures or arrangements for sharing data and information within the Group and/or any other use of data and information in accordance with any group-wide programmes for compliance with sanctions or prevention or detection of money laundering, terrorist financing or other unlawful activities;

(vii)

Any other purpose relating to the execution of the Client’s Instructions (including instructions given in the demo trading platform) or in connection with the business or dealings of the Group;

(viii)

Comparison with the Client’s personal data (irrespective of the purposes and sources for which such data were collected, and whether collected by a User or any other person) for the purpose of: (a) data verification;

(v) The Company may receive money or other property in return for providing the data to the other persons in paragraph 1.3(iv) above and, when requesting the Client’s consent or no objection as described in paragraph 1.3(iv) above, the Company will inform the Client if it will receive any money or other property in return for providing the data to the other persons. If the Client does not wish the Company to use or provide to other persons his data for use in direct marketing as described above, the Client may exercise his opt-out right by notifying the Company.

2. Rights of Access and Correction The Client has the right to have access to and correction of the Client’s personal data as set out in the Ordinance. In general, and subject to certain exemptions, the Client is entitled to: (i) (ii) (iii) (iv) (v)

Request access to the Client’s personal data within a reasonable time, at a fee which is not excessive, in a reasonable manner and in a form that is intelligible; Request the correction of the Client’s personal data; Enquire whether the Company holds personal data in relation to the Client and ascertain the Company’s policy and practices in relation to data; Be informed on request which items of data are routinely disclosed to debt collection agencies, and be provided with further information to enable the making of an access and correction request to the relevant debt collection agency; and Be given reasons if a request for access or correction is refused, and object to any such refusal.

3. Disclosure Obligation Unless otherwise stated the Client must supply the personal data requested to the Company. If the Client does not supply this data, it will not be possible for the Client to have auction business with the Company as the Company will not have sufficient information to provide auction and/or related services.

4. (ii)

任何本地或外地政府機構、監管機構或其他團體或機構(不論是法例或是任何本集團成 員適用的規例所要求);

(iii) 本集團的任何董事、高級職員、僱員或代理人;

(d) 為慈善及/或非牟利用途的捐款及捐贈; (iii) 上述服務、產品及項目的可能由太陽國際拍賣行及/或下列各方提供或(就捐款及捐贈 而言)徵求:

(iv) 由太陽國際拍賣行及/或本集團授權的包括本地或外地的任何人士(例如律師、顧問、 代名人、會計師、託管人、 第三方服務供應商、保險公司、物流公司、運輸公司、倉儲公司 及鑑定/估價師等),以便執行客戶指示及涉及太陽 國際拍賣行及/或本集團的日常運作 及業務; (v)

(a) 本集團的任何成員; (b) 第三方金融機構、承保人、信用卡公司、證券及投資方服務供應商、本地或外地第三方移民顧問公司、升學顧問公 司、教育機構、保險公司、拍賣行;

(xi) 就以下1.2(x)段列明的用途而被太陽國際拍賣行任用之外部的服務供應商(包括但不限 於寄件中心、電訊中心、電 話促銷及直銷代理人、電話中心、資料處理中心及資訊科技 公司)。

1.2 目的 客戶的所有個人資料可被任何使用者用於下列目的:

如客戶不希望太陽國際拍賣行如上述使用其資料或提供予其他人士作直銷用途,客戶可通知太陽國際 拍賣行行使其選擇權 拒絕促銷。

讓太陽國際拍賣行及/或本集團成員之實際或潛在承讓人,或太陽國際拍賣行及/或本 集團成員對資料當事人(提供 資料的人士,包括客戶)的權利、或附屬參與所涉交易人士的 參與人,或附屬參與人可評估涉及有關轉讓、參與或附 屬參與的交易;

(iii) 建立及維持太陽國際拍賣行及/或本集團的信貸模式; (iv) 太陽國際拍賣行及/或本集團根據對太陽國際拍賣行及/或本集團具法律約束力或適用 的任何法律規定,或根據及 為符合任何法律、監管、政府、稅務、執法或其他機構,或金 融服務供應商的自律監管或行業組織或協會作出或發 出的並期望太陽國際拍賣行及/或 本集團遵守的任何指引或相關指令,或根據太陽國際拍賣行及/或本集團成員向 本地或 外地的法律、監管、政府、稅務、執法或其他機構,或金融服務供應商的自律監管或行業 組織或協會的任何 合約或其他承諾(以上不論於香港特別行政區境內或境外及不論目前 或將來存在的),而有義務或以其他方式被要 求披露該等資料的任何人士; (v)

持續的交易管理包括但不限於向資料當事人及執行資料當事人應負義務就本集團的任何 成員作出的擔保,收費或其 他權利和利益追討欠款;

(vi) 履行或遵守在本集團為符合制裁或預防或偵測黑錢,恐怖份子融資活動或其他非法活動 的任何方案就於本集團內共 用資料及資訊及/或資料及資訊的任何其他使用而指定的任 何義務、要求、政策、程序、措施或安排; (vii) 任何有關於執行客戶指示(包括在模擬交易平台發出的指示)或與本集團業務或交易有 關連的目的; (viii) 為了下列目的而進行客戶個人資料的比較(不論收集此等資料的目的及來源,及不論此等 資料是向使用者或任何其 他人士所收集的): (a) 資料核實; (b) 信用調查;及/或 (c) 編製或核實資料,以便採取使用者或任何其他人士認為合適的行動(包括可能與客戶或任何 其他人的權利、義務 或權益有關的行動);

太陽國際拍賣行可能就因如以上1.3段(iv)所述將資料提供予其他人士而獲得金錢或 其他財務回報,太陽國際拍賣行會 於以上1.3(iv) 段所述徵求客戶同意或不反對時如是 通知客戶。

Recent Changes To Imports Of Elephant Ivory And OtherWildlife Material Into The Usa The USA has recently changed its policy on the import of property made of or containing elephant ivory. Only Asian elephant ivory may be imported into the USA, and imports must be accompanied by DNA analysis confirming the item was from as Asian elephant and confirmation that the object is more than 100 years old. We have not obtained a DNA analysis on any lot prior to sale and cannot indicate

whether the elephant ivory in a particular lot is African or Asian elephant. Buyers purchase these lots at their own risk and will be responsible for the costs of obtaining any DNA analysis or other report required in connection with their proposed import of such property into the USA. The USA also requires all imports of property made of or containing any wildlife material to be accompanied by a scientific confirmation of species and in some cases an additional confirmation of age. We have not obtained such confirmations prior to sale (unless specifically indicated) and buyers will be responsible for arranging and paying for any such additional confirmations or opinions required for their proposed import into the USA. A buyer’s inability to export or import any lot containing elephant ivory or other wildlife material is not a basis for cancelling the purchase. Authenticity Certificates As certain manufacturers may not issue certificates of authenticity. Sun International Auction Limited has no obligation to furnish a buyer with a certificate of authenticity from the manufacturer, except where specifically noted in the catalogue. Unless Sun International Auction Limited is satisfied that it should cancel the sale in accordance with the Limited Warranty provided in the Conditions of Sale, the failure of a manufacturer to issue a certificate will not constitute grounds for cancellation of the sale. Removal Of Watch Batteries A watch with batteries which may be designated as “dangerous goods” under international laws and regulations governing thetransport of goods by air freight. 拍賣成交後,買家應支付落槌價連相應於該落槌價之適用佣金。拍賣成交日(含成交日)起十五天內 ,買家應向本公司付清購買之款項並提取拍 賣品。除接受買家付款外,本公司保留拒收其他來源付 款的權利。太陽國際拍賣行可協助買家安排拍賣品之儲存事宜。拍賣完畢當天 , 所有拍賣品將首先儲 存於拍賣場內供買家提取,其後則會存於倉庫。買家如拍賣後十五天內仍未提取拍賣品, 太陽國際拍賣 行將安排儲存該等拍賣品, 費用由買家負責。費用為每件拍賣品每天港幣一百元 (此費用隨時更改)。 本公司接受以下幾種付款方式: 電匯 請將匯款指示連同您的姓名及競投牌號或發票號碼一起交予銀行。但買家請留意電匯須於承兌後方 可提取拍賣品。. 銀行名稱:
