PROPERTY NEWS Why Buy in Spain? Spain has a great variety of landscapes, from mountains and lakes in the north to sandy beaches, olive groves and vineyards in the south. The drive from Burgos in the northwest to Malaga in the south-east takes you through so many different panoramas; you could be forgiven for thinking you are driving through several different countries. For years the south-eastern Mediterranean coast has been one of Europe’s most popular holiday destinations and is the place of choice for most British second homes. However, in recent years the north-west (Galicia) with its craggy shores on the Atlantic is attracting a large amount of attention amongst buyers looking for more rural retreats away from the tourist hubs of the Costas - at more sensible prices.

Only in the last two or three decades, and since Spain’s entry into the European Union, have things really begun to move ahead and to modernise. For those who live in the countryside however, life remains quite traditional and unchanged, blissfully so to visitors who look back to a more intimate and unspoilt village life that is long past in most countries. People are also attracted by the relaxed and slower way of life in Spain and the culinary delights like paella and tortillas are legendary... and affordable. Overall, there are loads of reasons that Spain is the number one destination for Britons buying abroad.

Legalities Based on news stories about property buyers in Spain having their property demolished, I think it’s safe to say that buyers now realise that it’s not only imperative to get a solicitor, but it’s absolutely necessary to get a good solicitor. Another vital factor is that you need to find a solicitor who is independent from the estate agent, developer or company showing you the properties, so that you know the solicitor is working for you and not the property professional. Some solicitors may draw up a contract of sale which is in favour of the estate agent (or end seller), and the reason behind this is quite disingenuous. By safeguarding the agent the solicitors will be assured of retaining their valuable business. Compare your one transaction to the many the solicitor stands to gain from the agent or developer and you will understand the clear conflict of interest here.

Getting Started Buying a property and living in Spain is straightforward if you are a national from another EEC (European Economic Community) country. If however, your nationality falls outside the Euro zone you may be able to buy a property but there might be time restrictions as to how long you can stay in the country. Furthermore, there are certain guidelines as to work

permits for non EEC nationals. You can find out information pertinent to you by accessing the Spanish Embassy website or through a variety of internet websites. There are also specialist emigration organisations that will often do a free consultation letting you know your options.

Finance In Spain purchase costs could be 10%+ over and above the purchase price and when considering the dramatic changes in currency exchange rates, this percentage could climb much higher. So, if your property price is £100,000 it could cost £110,000 (or more) by the time you complete and take possession of the property. It’s important from the start that you clearly understand how much a property will cost you as this will determine what price range you can look at. While researching the Internet, attending property trade shows and emailing estate agents, start to investigate what

is included in the property price versus what gets added on. In Spain the purchase price includes the estate agency fee (usually 5%, but nowadays maybe 3%). For all property and land, 10% of the purchase price is paid as a transfer tax that goes to the Spanish Treasury. In addition, there are notary fees and a land/property registration fee, which varies according to the purchase price of the property. Also consider solicitors and mortgage fees. Solicitors usually charge 1% of the purchase price + VAT at 21%.

Make sure that you have done your homework and that you are using a reliable and trustworthy solicitor. This may include asking for personal referrals - and these must not include your developer or agent - or using specialised Spanish websites. If the solicitor does not fully comprehend English or you have any reservations at all - move on and find someone else. Your solicitor will review the sale agreement, verify titles, and carry out other checks to ensure that you’re protected. They, or a notary, may be responsible for paying any taxes and registering the property with the land registry if this is required. Charges vary for legal and notary services but can cost around 1% to 2% of the sale value of the property. In Spain the cost is determined by the government. You need to bear in mind that the legal system in Spain may not work in your favour if trouble strikes, so it is of paramount importance that you hire qualified people who can ensure that you do not have to take legal action. Don’t put yourself in the position of needing legal redress. You may have the law on your side but the legal system abroad can keep you tied up for years and cost a fortune. Make sure you - and your solicitor - get it right from the start and the purchase will move forward easily, most purchases in Spain do, you only hear about those that don’t.

Qatar to build Zaha Hadid hotel

shaped like A desert flower Qatar will construct two buildings designed by late Iraqi-British architect Zaha Hadid, including a tower shaped like a desert flower close to the site of the 2022 soccer World Cup final, a member of its ruling family has confirmed. Sheikh Mohammed bin Hamad al-Thani, the brother of Qatar’s Emir, commissioned Hadid in 2013 to create the structures, one a 38-story hotel in the form of a hyacinth and featuring a ninepointed base to shield visitors from the searing Gulf sun. Sheikh Mohammed’s Al Alfia Holding said in a statement it would construct the tower “designed in response to current and future environmental challenges” by 2020 in the city of Lusail, 23 km (14 miles) north of the capital Doha.

“We often look at nature’s systems when we work to create environments, at her unrivaled logic and coherence,” Hadid, who died in March, said of the project. Now led by Patrik Schumacher, Hadid’s architecture firm ZHA has announced a number of new projects including a new central business district for Prague and a technology park near Moscow. In April, the firm said it would complete 36 projects that had been started or were under contract before Hadid’s death including an “oyster-like” ferry terminal in Salerno, Italy, the King Abdullah Petroleum Studies and Research Center in Riyadh, and the Mathematics Gallery at London’s Science Museum.

Spanish prime property market

bounces back

T

he prime property market in Spain has recovered strongly with buyers from Latin America and the Middle East rising, according to the latest index report.

The recovery of the market mirrors the recovery of Spain’s economy which is expected to see growth of 2.6% in 2016, more than the UK and Germany, says the analysis from international real estate firm Knight Frank.

It also points out that the recent ruling regarding Marbella’s 2010 Town Plan, which affects around 15% of Marbella’s housing stock, has led to some caution for those properties affected, but it has also refocused attention on properties in established areas which comply with the 1986 Urban Plan, as well as those which sit beyond the municipal boundary in areas such as Benahavís and Estepona.

‘Ultra-loose monetary policy by the European Central Bank and low oil prices have led to an increase in consumer spending, higher employment and rising household incomes. The market fundamentals are improving,’ said Kate Everett-Allen, Knight Frank partner, But she added that a backdrop of global uncertainty remains. The report highlights two key property market trends. Firstly, the rise of the non-EU buyer. Latin Americans now have a strong presence in Madrid, Middle Eastern buyers are active in Marbella plus Swiss purchasers in Ibiza as the profile of Spain’s luxury buyers shift. The second key trend is the strength of the €1 million to €3 million price band and nearly all of our prime markets now consider it their most active market segment while confidence is returning to Barcelona where the number of residential sales increased by 86% between 2012 and 2015 Online property searches on Knight Frank’s website by Middle Eastern web users searching for a property in Marbella increased by 164% between 2014 and 2015. A third of Madrid’s prime buyers now come from abroad. In 2015 Latin American buyers accounted for 30% of all the prime sales agreed by Knight Frank’s Madrid sales team. The report also says that the top tier of Ibiza’s property market has become uncoupled from the wider market, recording price growth of 10% in the year to April 2016 while Mallorca saw a 55% increase in the number of applications for new residential projects in the first two months of 2016 compared with the same period in 2015. Overall, the report says, rising sale volumes in Marbella suggest confidence is returning to the market. Price growth is slowly shifting into positive territory with newly built

The report also says that the top tier of Ibiza’s property market has become uncoupled from the wider market and is witnessing strong price gains as demand outpaces supply. The number of sales on the island increased 37% in the three years to 2015 and foreign buyers have become more active. Ibiza attracts more than 8,000 private flights a year and according to NetJets, London to Ibiza and Palma de Mallorca are some of its most popular routes. As the southern coast becomes more developed so attention is turning to inland markets and the northern coastline. Residential sales in Spain

record highest growth since January 2013

Residential property sales in Spain increased by 23.6% in May year on year, the highest figures since January 2013, the latest official figures show. The figures from the National Statistics Institute also show that home sales have now increased year on year for four months in a row. However, sales did fall back slightly from the year on year figure of 29% recorded in April. The second hand market and, to a lesser extent, sales of new homes, were responsible for the May increase, up by 26.7% and 12% year on year respectively. The data also shows that in the first five months of the year home sales increased by 15.8% compared with the same period of 2015, with second hand homes up 21.9% but new house sales down 3.4% over the five months. Month on month sales growth has slowed. Compared with April sales in May 2016 were up by 3.5% but this was the lowest increase registered in this month in the past five years. The highest numbers of home sales per 100,000 inhabitants were registered in the Balearic Islands and La Rioja and Andalucía was the region to register most home sales, followed by Catalonia, Valencia and Madrid. In contrast, the regions which registered the least home sales in May were La Rioja, Navarre and Cantabria but in relative terms, home sales rose in all of Spain’s regions except for Navarre, which registered a decline of 20.2% compared with May 2015. The most significant increases were in the Balearic Islands with growth of 70%, followed by La Rioja up 68.9% and Murcia up 61.8%, while the lower increases were in Cantabria with sales growth of just 1.7% and Galicia up 7.8%. Falling asking prices in Spain

could encourage British buyers despite Brexit There are signs that British buyers are still keen on buying property in Spain but those selling are likely to be more successful if they lower their asking price. Agents are reporting continued interest in the Spanish property market from British buyers despite the decision to leave the European Union. This is coming from holiday home buyers and those considering moving to Spain to live. But the latest index suggests that sellers in Spain are having to be realistic about the price their property is likely to achieve outside a few popular areas. Data from the latest asking price index from Idealista shows they fell national by 3.1% in June year on year. Month on month asking prices fell 1.4% to their lowest level since the economic downturn despite rising briefly at the beginning of the year. But there are substantial regional differences. Whist the national average index continues to fall, some areas are already recovering. Idealista point out that prices in some big cities and areas on the coast have risen substantially since bottoming out, led by Barcelona with growth of 19.5%, Madrid up 6.4% and Valencia up 6.1%. There is effectively a two speed recovery in the Spanish market, according to Fernando Encinar, head of research at Idealista. He explained that prices continue to fall in inland locations but rise in popular coastal spots such as the Costa del Sol and cities such as Madrid and Barcelona.

On a quarterly basis asking prices rose the most in the second quarter of the year in Malaga with an increase of 1.5%, up by 0.8% in the Costa Blanca and up 0.8% also in Tenerife and the Canary Islands. Real estate agents believe this could attract more foreign buyers. Lucas Fox International said it has seen a rise in enquiries from British based buyers since the vote to leave the European Union. Some disillusioned with the referendum result and considering a move to Spain, in particular to the key cities of Madrid, Barcelona and Valencia, where there are job opportunities and the local economy is rapidly recovering. A report last week claimed that the number of British citizens looking to move abroad had increased by 30% with Spain being the third most sought-after destination after Australia and Canada. Another study by the London School of Economics suggested that around 10% of 18 to 25 year olds who voted to stay in the EU are now considering a move abroad. An example is Sebastian King, a 22 year old living in the South of England working in financial services. He contacted Lucas Fox just a few days after the result. ‘I have been looking to move to Valencia for a year or so now but the Brexit result made me want to get a move on,’ he said. ‘For me Valencia has it all, the climate, it’s exciting, full of history and culture as well as having a beach. Overall, I think Spain has lots of potential and for my business it is an ideal place to expand, thanks to a

cheaper workforce. When I compare the UK to Spain I see Brits simply surviving whilst the Spanish are really living,’ he explained. British buyers currently account for less than 10% of Lucas Fox’s total sales throughout Spain, mainly in resort areas such as Marbella, the Costa Brava and the Balearics and the company has lost a small number of potential offers that were on hold pending the referendum result but say that so far, no accepted offers made before the Brexit vote have been lost. ‘We feared that the referendum result would impact immediately on pending deals but this doesn’t seem to have been the case and the increase in enquires from UK buyers and UK based EU residents looks set to more than compensate sellers,’ said Lucas Fox Costa Brava partner Tom Maidment. ‘Additionally, we have been offered several interesting properties by British couples who now want to sell up and return to the UK to profit from the weak pound. The high end Spanish property market relies far less on the British than it used to and our buyer profile is diverse and includes French, Dutch, German, Swiss, Swedish, Norwegian, US, Russian, Middle Eastern and Asian buyers,’ he added.

He also pointed out that despite the weakening of the pound, Spanish property is still very attractively priced at 30% to 35% below the peak of 2007 whilst Spanish banks continue to offer competitive mortgage packages. ‘I think the effect of the UK leaving the EU will be felt mainly in resort areas, such as the Costa Blanca where there are many British retirees and holiday home owners who have invested in lower priced properties,’ said Lucas Fox co-founder Alexander Vaughan. ‘I appreciate that it is still early days but we don’t expect it to overly affect our day to day business. Spain will always have an appeal for the British even though it may become marginally more expensive for them holidaying or buying here. In the long term, British buyers should still benefit significantly if they buy property in Spain, as sales prices have consolidated and, in prime areas, continue to appreciate,’ he pointed out. ‘Rental returns are also attractive, with buyers of New Development properties in Spanish cities benefitting from yields in excess of 4%. We are hopeful that we may even see the positive impact of Brexit on the Spanish real estate market,’ he explained. ‘Many non-European buyers have started looking at alternative city locations to London which also have good property investment potential. There is also the prospect of some London based banks and financial institutions moving their staff from London to Madrid,’ he added.
