PROPERTY NEWS Why Buy in Spain? Spain has a great variety of landscapes, from mountains and lakes in the north to sandy beaches, olive groves and vineyards in the south. The drive from Burgos in the northwest to Malaga in the south-east takes you through so many different panoramas; you could be forgiven for thinking you are driving through several different countries. For years the south-eastern Mediterranean coast has been one of Europe’s most popular holiday destinations and is the place of choice for most British second homes. However, in recent years the north-west (Galicia) with its craggy shores on the Atlantic is attracting a large amount of attention amongst buyers looking for more rural retreats away from the tourist hubs of the Costas - at more sensible prices.
Only in the last two or three decades, and since Spain’s entry into the European Union, have things really begun to move ahead and to modernise. For those who live in the countryside however, life remains quite traditional and unchanged, blissfully so to visitors who look back to a more intimate and unspoilt village life that is long past in most countries. People are also attracted by the relaxed and slower way of life in Spain and the culinary delights like paella and tortillas are legendary... and affordable. Overall, there are loads of reasons that Spain is the number one destination for Britons buying abroad.
Legalities Based on news stories about property buyers in Spain having their property demolished, I think it’s safe to say that buyers now realise that it’s not only imperative to get a solicitor, but it’s absolutely necessary to get a good solicitor. Another vital factor is that you need to find a solicitor who is independent from the estate agent, developer or company showing you the properties, so that you know the solicitor is working for you and not the property professional. Some solicitors may draw up a contract of sale which is in favour of the estate agent (or end seller), and the reason behind this is quite disingenuous. By safeguarding the agent the solicitors will be assured of retaining their valuable business. Compare your one transaction to the many the solicitor stands to gain from the agent or developer and you will understand the clear conflict of interest here.
Getting Started Buying a property and living in Spain is straightforward if you are a national from another EEC (European Economic Community) country. If however, your nationality falls outside the Euro zone you may be able to buy a property but there might be time restrictions as to how long you can stay in the country. Furthermore, there are certain guidelines as to work
permits for non EEC nationals. You can find out information pertinent to you by accessing the Spanish Embassy website or through a variety of internet websites. There are also specialist emigration organisations that will often do a free consultation letting you know your options.
Finance In Spain purchase costs could be 10%+ over and above the purchase price and when considering the dramatic changes in currency exchange rates, this percentage could climb much higher. So, if your property price is £100,000 it could cost £110,000 (or more) by the time you complete and take possession of the property. It’s important from the start that you clearly understand how much a property will cost you as this will determine what price range you can look at. While researching the Internet, attending property trade shows and emailing estate agents, start to investigate what
is included in the property price versus what gets added on. In Spain the purchase price includes the estate agency fee (usually 5%, but nowadays maybe 3%). For all property and land, 10% of the purchase price is paid as a transfer tax that goes to the Spanish Treasury. In addition, there are notary fees and a land/property registration fee, which varies according to the purchase price of the property. Also consider solicitors and mortgage fees. Solicitors usually charge 1% of the purchase price + VAT at 21%.
Make sure that you have done your homework and that you are using a reliable and trustworthy solicitor. This may include asking for personal referrals - and these must not include your developer or agent - or using specialised Spanish websites. If the solicitor does not fully comprehend English or you have any reservations at all - move on and find someone else. Your solicitor will review the sale agreement, verify titles, and carry out other checks to ensure that you’re protected. They, or a notary, may be responsible for paying any taxes and registering the property with the land registry if this is required. Charges vary for legal and notary services but can cost around 1% to 2% of the sale value of the property. In Spain the cost is determined by the government. You need to bear in mind that the legal system in Spain may not work in your favour if trouble strikes, so it is of paramount importance that you hire qualified people who can ensure that you do not have to take legal action. Don’t put yourself in the position of needing legal redress. You may have the law on your side but the legal system abroad can keep you tied up for years and cost a fortune. Make sure you - and your solicitor - get it right from the start and the purchase will move forward easily, most purchases in Spain do, you only hear about those that don’t.

Property prices in Spain expected to
continue rising FOR THE rest of 2016
R
esidential property prices in Spain are expected to continue rising for the rest of the year, even if the current growth, slows, according to a new analysis report. Property sales, prices and building activity have all increased in 2016 and the report from bank BBVA suggests that this will continue in the coming months. The Spanish property market recovery is being fuelled in part by improving mortgage conditions and a sharp increase in tourism which has pushed up demand for holiday homes along the Spanish coast. However, BBVA has suggested that the second half of the year might not be as good as the first half, as there are signs that growth in the Spanish economy could moderate. ‘Lower economic growth and what that does to consumer confidence is expected to knock some of the wind out of the sails of the housing market recovery,’ said Mark Stucklin of Spanish Property Insight.
Spain rose by 7.5% in the second quarter of the year, compared to the same period of 2015, while sales climbed by 23.7%.

The firm points out that although properties in these streets are very different from each other, there are common elements among them. Indeed, the most sought after are modern and minimalist homes that retain their original structural elements with features including original pillars and beams that are incorporated into the overall design and modern decor. These properties are often located in historic buildings and have views of the most representative areas of the city.
New home sales are also rising, up 0.8% quarter on quarter, suggesting that this side of the housing market is recovering too. Foreign buyers accounted for almost 14,000 of house purchases, representing 13.4% of all the housing transactions carried out, compared to 12.9% in the first quarter of the year while year on year foreign buyers were responsible for over 51,500 transactions, around 13.4% of the total housing transactions. British buyers made the greatest number of purchases at 19.73% of the foreign sales, followed by Germans at 7.38%, French at 7.5%, Swedish at 6.95%, Italians 5.99% and Belgians 5.63%.
‘Even so, BBVA expect new development to continue expanding on the back of stronger demand and the gradual disappearance of the new homes glut, at least in areas where there is demand, such as big cities and popular coastal regions such as the Costa del Sol and the Costa Blanca,’ he added.
Separate research has named Hernani Street in San Sebastián as the most expensive in Spain with property prices averaging €12,700 per square meter, a 6% increase over last year. Spacious apartments with large windows or terraces that open towards La Concha Bay are the most exclusive in the city.

It also says that luxury homes are still a scarce commodity in many of the most exclusive areas of Spain. This shortage of supply is ahead of the huge international demand that has led to an increase prices in Spain’s major cities, a situation that is expected to be maintained in the near future as the demand by European and American buyers seeking investment property continues. Price increases were between 4% and 6% in the majority of the locations researched and there was a double digit rise in the most exclusive addresses in San Sebastián, specifically Hernani Street and Valencia’s Colón Street.

Smart homes still overpriced, undersold and misunderstood says Beecham Research

New report says that a lack of awareness and knowledge of smart home products and their benefits is holding back market growth but still predicts healthy revenues High price tags continue to put smart homes beyond the reach of most home owners and many who can afford to pay are not being sold on the benefits, according to a report from Beecham Research released today. While new home comforts and easy living remain the main incentives for potential customers, it is practical applications such as home safety and money saving devices such as smart thermostats and energy meters that are currently driving the market, along with smart home entertainment systems. The report, ‘Smart Home Market – Current Status, Consumption Trends and Future Directions’, says that a lack of awareness and knowledge of smart home products and their benefits is a barrier to market growth, along with concerns about data privacy and lack of device interoperability.

While Beecham Research says that these smart home ‘speed-bumps’ make some of the more over-optimistic forecasts simply unrealistic, it still believes that new industry partnerships and innovative routes to market will help drive impressive market growth. It predicts that revenue from the sale of smart devices for the home will achieve at a compound annual rate growth of around 34% over the next five years, from $3.1bn in 2015 to $16.2bn in 2020. “A basic light bulb is more than 20 times cheaper than its smarter counterpart,” says Olena Kaplan, Senior Analyst at Beecham Research and author of the report. “But evidence shows that consumers are willing to pay a premium price if they understand the value of the more expensive product. The crucial question is; does the smart bulb, or any smart home product, offer sufficient benefits for consumers to justify the price tag?” The report points to the Amazon Echo smart home hub and Samsung Smart Things as a sign that major companies are trying to attract more customers and get a foothold in the home by offering entry products at affordable prices. “In the energy market, the Smart thermostat was amongst the first smart devices to control home energy consumption but it has evolved to manage heating systems and energy used by individual appliances,” says Kaplan. “For example, Nest now also offers IP security cameras and CO2 smoke alarms, while Hive offers a smart power socket, motion sensor and windows/door sensors.”
New Partnerships and Players Another key driver for the smart home will be new industry partnerships and routes to market, according to the Beecham Research report. For example, insurance companies will sell devices directly as part of their policies or offer discounts from retailers, while utilities companies, security providers and telecom operators also see the opportunities to partner with products companies to deliver new services and value add. “As initiatives to encourage the adoption of smart devices proliferate, the partnerships offering specific financial advantages or benefits will show a stronger uptake,” says Kaplan. “These partnerships will also drive the shift from product to subscription or cloud-based service offerings.” The Beecham Research report also takes a look at the global markets and levels of smart home adoption across different geographies. “For example, the US market is much more advanced than Europe and other parts of the world due to a more proactive attitude towards connected consumer devices and the popularity of safety systems,” says Kaplan. “Countries where vendors are investing in promoting smart products and raising awareness of their benefits are already seeing faster uptake.” To find out more about the Smart Homes Market report, please visit: www.beechamresearch.com

• PROPERTy Mixed messages about the recovery in the Spanish property market continue but some of the ups and downs could be down to a court ruling on a controversial mortgage ground clause. The latest data from the National Statistics Institute show that the increase in property sales slowed to 1.1% in July compared to the same month in 2015 and down from the 19.4% recorded in June, a fall of 10.2%. However, the slowdown may be due to the Supreme Court’s ruling in June in connection with the registration of some mortgages being deferred awaiting correction as the July figure probably would have been higher without the case. And it should not deter from the fact that the NSI figures have now shown six months in a row of year on year sales rising. A breakdown of the figures show sales of second hand homes increased by 2.9% year on year in July but new home sales fell by 6.5% and the biggest rise was in Asturias and Extremadura, both with increases of 21.4%. The next highest number of sales were recorded in the Balearic Islands with growth of 14.7%. In contrast, the biggest fall was in La Rioja with sales down by 23.1%, followed by Navarra down 14.2% and the Basque Country down 13.8%. But figures from the General Council of Notaires show that sales fell by 7.9% in July year on year but a more moderate fall of 1.4% when seasonally adjusted. Sales of apartment fell by 10% while single family home sales increased by 0.7%. But the Council says that generally the market is recovering even although it also reports that prices have fallen. The average price of property sold in July was €1,274 per square meter, a decrease of 3.6% compared to the same time last year. The Notaires report says that one thing holding the market back is over supply and there are not enough buyers for the types of property coming on the market.
