WATER WOES Ocean Acres residents look into legal options as battle with council continues over stormwater drainage problems

THE ONGOING battle between Ocean Acres residents and Surf Coast Shire Council looks set to intensify. Following heavy rains earlier this month, the stormwater drainage problems again surfaced, with some houses having their kitchens flooded. One resident told the Surf Coast Times she was already out of pocket after being forced to take it upon herself to do something about the stormwater run-off. “Water was coming down from Coombes Road and the run-off was going into our property,” said Rachel O’Neill. “Now council has diverted more water from Coombes Road into our property.

“We had asked them to run a drain past the house, but they ran one past every house except for ours. “Now the drain stops short of our house and all the water runs into our property. “I have had to spend $2,000 getting earth movers in to build up an area with dirt mounds to try and stop the water from coming on to my property and flooding it.” O’Neill also said Ocean Acres residents were continuing with their bid to seek legal advice on the matter – which has continued to escalate. “We are in the process of getting legal advice,” O’Neill confirmed. “There was quite a big meeting between residents and a group was formed and a decision made to put some money in each to seek some legal advice. “Every time we get decent, heavy rain, people’s
places are flooding and to think that council could make us pay to have the stormwater problem fixed is just not right. “We already pay some of the highest council rates in the state and we want to take this further to see what options we have.” While residents look into legal avenues open to them, Surf Coast Shire chief executive officer, Mark Davies, said no decision as to how the matter will be handled – or funded – has been made. “Council commissioned a report earlier this year on the drainage issues and an executive summary has been sent to all affected residents, as well as confirmation that the complete report is available from council’s website,” he said. “It details a number of options, including new pipelines and easement swale drains and confirms
indicative costs per affected lot. “Council has substantially completed works within the road reserves in accordance with the report’s recommendations. “Capacity of swale and table drains in the area has been increased which has alleviated drainage problems at a number of properties. “Council has been working with residents to confirm the issues and has proceeded with developing detailed engineering designs of several options and assessment of relative costs. “No decision has been made on the preferred option to address remaining drainage issues; nor has a decision been made on how these projects will be funded. Council will, however, seek to resolve the issues effectively and in a manner that considers the needs of residents in the estate.”
