Trouble with the neighbours? What rights do you have when it comes to your neighbours? When is somebody's conduct considered to be a nuisance to his neighbours? By definition a nuisance occurs when a neighbour interferes with an owner's (or lawful occupier, e.g. tenant) use and enjoyment of his land. However, this interference must be unreasonable before it will be classified as a nuisance in the legal sense of the word. Therefore the interference with a neighbour's rights to the proper enjoyment of the rights associated with his property, will only be unreasonable (and therefore prohibited by the common law) if the reasonable man, acting in the same circumstances, will not have acted in this manner. Let's look at some particular cases that will be considered a nuisance. Please note that each case will have to be judged on its own merits, and therefore these are just some guidelines. Foul, unpleasant or noxious odours or
stenches by their very nature cause discomfort and physical distress to people and may therefore be regarded as nuisance. Noise can adversely affect the physiological and psychological wellbeing of people. Therefore excessive noise is a nuisance against which legal action can be taken. The sounding of whistles, sirens or hooters by the Police or Ambulance in the execution of their duties cannot be a nuisance. Smoke, even if not accompanied by noise or foul odour, or even if it is not bad for your health, will amount to a nuisance if it materially interferes with a person. Animals will be a material interference if they are kept in a place or in circumstances that causes physical discomfort to other people. Municipalities are generally empowered to prohibit the keeping of
animals which cause a nuisance or they can take steps to abate the nuisance. Trees are natural to plant and use on land. Generally the obstruction of natural sunlight by trees or the invasion of land by leaves from trees is not a nuisance. However, a person may repel branches or roots of trees which intrude upon his land. The pollution of water so as to render it less potable or a danger to health or the environment can also constitute a nuisance. This will include the discharge of polluted water or fluids which interferes with the ordinary comfort of another person. A person may not prevent or affect the natural flow of water from his property to any lower lying property. The above are just some examples of nuisances. It is always better to discuss a possible nuisance with your neighbour first. See if you can come to an amicable solution. If that doesn't help, then legal action would be the next step. If you are causing the nuisance, just put yourself in your neighbour's shoes and see if you would be prepared to put up with the nuisance caused by you. After all, it's a case of common courtesy and decency. We can all live in complete harmony if we respect our neighbours as much as we respect ourselves.

This beach front property at Long Beach, presented the architect with a restricted site, normal planning and spatial challenges but at the same time a forward thinking client allowed the opportunity for the designer to create something special. The client wanted a contemporary house, with industrial and natural nishes for an inviting home, perfect for entertaining. The design had to be sophisticated yet appropriate for the coastal conditions. As a design philosophy the environmental conditions had a great inuence on the design. Natural light is probably the most important design element of this dwelling and the effects of the natural light on the interiors and exteriors of the building. Floor to ceiling windowpanes and frameless stacking doors were used to enable maximum light penetration and to ensure maximum viewing frames towards the beach. The site with it’s inspiring views over the ocean however did create conicting design parameters which had to be solved. An example was solving the problem with the viewing lines facing the setting sun. This was resolved by use of concrete overhangs above the windows, solid timber pergolas
and the use of tinted glass. The internal spaces are interesting, comfortable, sophisticated and sometimes unusual. The site is very narrow; the challenge was to provide natural light and ventilation to all areas as the neighbour's walls are solid. By maximizing the full width of the relatively narrow site, the architect moved the building onto the lateral boundary and made sure that the living spaces, kitchen and all the bedrooms could have a view over the beach. By avoiding massive substructures on the ground oor, the connection between the interior spaces; kitchen and living areas and the outside deck area, re pit and lawn leading to the b e a c h b e c o m e o p e n a n d o w i n g. Therefore creating the perfect exible entertainment area. The interior décor and furniture compliment the interior architecture perfectly. The interior has an industrial design inuence. This was achieved by the use of rustic and natural materials. Solid timber oors, offshutter concrete ceilings, exposed red brick and I-beam columns were used. A considerable amount of energy went into the detailing of certain interior feature elements, such as the central staircase. The staircase was carefully detailed with solid timber stair treads tted on top of steel Ibeams and completed with frameless glass railing. The client had a denite vision for what they desired their home to be like and which was clearly communicated to the architect in the brieng and conceptual design stages of the project. The success of the project was the result of a good team effort, client architect and contractors alike, with an uncompromising attitude to follow the concept through.

Christmas Oreo, Nutella & Strawberry Trie I love the look of a trie on a Christmas table, but I really don't like soggy sponge cake. What makes it especially nice to serve a trie at Christmas time is that we get fresh berries at this time of year! Not wanting to be defeated by the soggy sponge - I got onto a bit of research and the result is this recipe. Can you honestly think of 3 ingredients that would make a better trie: Oreos, Nutella & Strawberries? Ingredients: Ÿ Ÿ Ÿ Ÿ Ÿ Ÿ Ÿ Ÿ Ÿ Ÿ
3 Packets Oreo cookies 2 Punnets of Strawberries Nutella and peanut butter lling 1/4 cup chunky peanut butter 1/4 cup smooth peanut butter 1/2 cup Nutella 1 cup icing sugar 1/3 cup cream 3 tbsp unsalted butter 1/2 tsp pure vanilla extract
Method: Crush the Oreos roughly. Hull the strawberries and halve on the length. To make the lling: add peanut butter, Nutella and butter in a deep bowl. Beat it all together until everything is properly blended. Now, add icing sugar, vanilla extract and cream, beat on the lowest speed until everything is mixed together. Find a beautiful glass bowl (a large ower vase also looks great). Place a layer of the Oreos (about 1/3) in the bottom of the bowl. Place the sliced strawberries around the outside edge of the Oreos with the sliced side against the bowl. Add a third of the Nutella mix. Repeat the process until the ingredients are done. Make sure you end with the lling on top. Now you can go big with your garnishing of the top. Pile it high to create a festive spirit, think fresh cherries, chocolate whispers, gold dust a few more fresh strawberries and maybe some pomegranate rubies.

Summertime and the livin’is easy ... though the cotton is not high and the fish are not jumpin' – we are gonna have a whale of a time! For those of us that are not fortunate enough to enjoy a well-earned period of hakuna matata away from home, let's keep busy in the garden - excellent, affordable therapy. ANTS are very active this time of the year, working diligently to feed the queen and soldiers and their main food source is honeydew secreted by aphids- mealybug, Australian bug, soft and hard scale. Aphids and scale insects suck sap through their needle-like mouth parts, sometimes injecting toxins into the plant. Unfortunately the secreted honeydew is not only food for ants, but it encourages the growth of unsightly sooty mould and severe infections can cause chlorosis (yellowing) of leaves. TRICK AND TREAT - Ants protect aphid colonies against their natural predators and if action is not taken, the situation will get out of hand. Spray affected plants with Efekto's Aphicide or Garden Ripcord. In the case of smooth or waxy surfaces (some scale insects have waxy bodies too), use a wetting agent, mixed in the same bottle with the selected insecticide, helping it “stick”, instead of simply running off. Efekto has two products to offer - G49 Wetting Agent or Insure. ANTS - surface ants can be well controlled by applying Efekto Ant. However, it would be better to eradicate entire colonies or at least keep the population to a minimum by using a food bait to be taken back to the nest. EFEKTO'S Ÿ AnTrap – two bait stations in a packet, break out the three corners and place wherever you see activity. They are amazingly intelligent little creatures, and soon everyone will know it's “party time”. You don't have to buy a dozen, four at the most. Ÿ Ant Vanish – a granular food bait. Scatter a little at a time, and replenish when necessary. When granules remain, it is a sign that the problem is
taken care of. Take care not to use close to an area where you applied a chemical product for any other pests. The ants will detect it and instinctively (and wisely I guess) stay clear of the food bait. A HOLEY WAR? - You can rely on Efekto's Fendona It can be most annoying to find tiny holes in favourite clothing items or one of your Penquin Classics ready to be discarded. Not to mention an invasion in your pantry, bathroom cabinets, laundry rooms, under sinks and bathtubs - silver fish! They feed on mold, fungi and carbohydrates such as sugar, starch or cellulose and have voracious appetites. Spray areas with Efekto's Fendona, it's odourless and leaves no residue. In wardrobes, clothes shelves and book shelves - remove items and sponge on, wait for it to dry and replace items. NOT FOR THE SENSITIVE NOSED Efekto's Naphthalene marbles, works well, but the smell lingers and could be unpleasant in linen- and clothing closets. There are several more fragrant options that silver fish cannot stand. Use sachets filled with Ÿ Citrus peels and leaves Ÿ Bay leaves, sage, whole cloves Ÿ (not ground) Ÿ Lavender – even sachets with cotton balls sprayed with lavender oil. FLIES AND MOSQUITOS - part and parcel of summer, once again, Efekto's Fendona works miracles. Effective for a period of 3 months indoors, 1 month outdoors. Flies and maggots go hand in hand. Make sure that you don't leave unwanted items in overflowing trash cans (e.g., the bones of your last Kentucky take-way, trimmings of meat, fish, chicken) before going away on vacation. Flies will generously deposit their eggs and maggots swarming all over the place is indeed a gross affair. Seal such matters in plastic bags and keep in the deep freezer until rubbish removal day.
