legal standing in Namibia?

Although every human being is recognised as a person by Namibian law, our law also gives legal standing to other entities. The distinction is best understood with reference to the two classes of person recognised by the law: namely, natural and juristic. Every human enjoys non-derogable status as a legal subject. Human beings are referred to natural persons and enjoys the protection of our constitution as such. A juristic person is a social entity, a community or an association of people which has an independent right of existence under the law. Although it is independent of the natural persons who are its members, it acts through them. Three categories of juristic persons are recognised: · Associations established in separate legislation: These may be constituted only with governmental permission, usually where the government has an extensive interest in their operation. Examples are Nampower, Namwater and Transnamib. · Associations incorporated in terms of enabling legislation: These are also controlled by government in the interests of society, but do not require governmental permission, only registration in terms of a general enabling statute, for their creation. Examples are close corporations, companies and banks. · Associations which comply with the common-law requirements for the establishment of a juristic person: These associations were known as universitates at common law, which requires merely that the association continue to exist irrespective of changes in membership. It carries rights, duties and capacities distinct from those of its members. The object

of these associations is not the acquisition of gain in which case it must register as a company. Legal personality begins at birth, prior to which the foetus is generally regarded not as a legal person but merely as a part of the mother. It therefore (in general) has no rights or duties or capacities. The term birth is regulated by two common law requirements. Firstly the delivery must be fully completed; there must be total separation between the body of the mother and that of the infant. Secondly the child must be or have been alive, and lived independently, after separation. A stillborn foetus, or one that dies during delivery, is therefore not regarded as a person. There are certain measures in Namibian law which provide for the protection of the rights, duties and capacities of a fetus until it's birth. Aside from some statutory security and a number of common delictual principles, there is, most notably, the nasciturus fiction. It provides that, if it be to the advantage of the nasciturus or unborn child, it is deemed for legal purposes already to have been born, and its interests thus are kept reserved. There are three requirements in Namibian common law for the operation of the nasciturus fiction: · The fiction must operate to the advantage of the nasciturus. The fiction may not be applied if it would be to the disadvantage of the nasciturus, or where only a third party stands to benefit. · The benefit to the nasciturus must accrue after its conception. · The nasciturus must ultimately be

born alive, in the legal-technical sense. In practise no legal personality is actually granted to the foetus by deployment of the nasciturus fiction; it remains without legal standing, and does not have a right (to life, for instance) that can be enforced on its behalf. The benefits accruing to it through the fiction are held "in suspense" until it is born, at which point the fiction is no longer, so to speak, fictional.

Chocolate Chip Scotch Bars This is a delicious family recipe given to me by good friends from Seattle. Make sure that you use the darkest, stickiest brown sugar you can find and the bars should be sticky and wet when baked, so don't overdo them. Ingredients: 2 cups flour 1 tsp baking powder ¼ tsp bicarb 1 tsp salt 2/3 cups butter 2 cups brown sugar

2 eggs slightly beaten 2 tsp vanilla 2 cups flour 1 cup chocolate chips over the top Method: Sift the 2 cups flour Add baking powder, bicarb, salt Sift again Melt butter Remove from the heat Add brown sugar Mix well and leave to cool

If the grass is greener on the other side... You can be sure the water bill is higher too! Nevertheless, most of us want a lawn, even if it is only a small patch. It makes a garden look greener and cooler and what a bonus for kids and pets, they can frolic about without bringing in all that dust and mud into the house! The psychological benefits are worth the extra effort and expense. In most parts of the country the soil temperature has risen sufficiently in August to start preparations for a new lawn. SEEDING OR SODDING If you want a smart well established lawn within a month, sodding is the way to go. However, sods are only available in Kikuyu which is not shade tolerant at all. Should there be areas with too much shade, these can be planted up with plugs of LM lawn (also known as Rundu lawn) – the two varieties are both creepers and blend well together, offering an ideal solution. Should you prefer to sow, also take shade and sun into consideration and buy you seed accordingly. There is a large range of lawn seed varieties available and your local garden center should be able to assist you in making the right choice. LM lawn seed is now for the first time available in the Mayford seed range which is distributed by Efekto. SOIL PREPARATION Whether you seed or sod, soil

preparation would be the same. Dig over the area to a depth of about 20cm, removing excess stones (and ALL WEEDS!) – per square meter work in 1 bag of compost and 60gr of Efekto’s super phosphate. If the soil is very poor, add 150gr per square meter of Efekto’s Vitaboost organic pellets. Optionally, to prevent any remaining weed seeds from germinating, scatter Snapshot by Efekto over the area – 500gr will be sufficient for 20 square meters. Seed by dispersing seeds in rows (4cm apart, .5cm deep) made with the thumb or a broom stick, or scatter as evenly as possible. Rake over soil lightly and water with a sprayer until seedlings are 1cm high. Soil should not be allowed to dry out during the first month of growth in order to develop strong roots. After three months the first application of Efekto’s 7:1:3 (SR – slow release) can be applied with 6 weekly intervals until the end of May the following year. SODS – should be put down immediately, when left rolled up for more than two days, they will ready for the compost heap! Lay the sods right up against each other and fill any gaps with compost or clean river sand. If you budget is a bit tight, lay in a chessboard pattern, also filling the gaps in between with compost or river sand to keep the area level. Gradually the grass will cover the bare patches. The soil might sag after the first thorough watering, therefore compact the sods with the back of a

garden spade or a sturdy plank to prevent the roots from dangling and drying out. MAINTENANCE – don’t worry, we won’t confuse you, just one or two golden rules. • Water: During the growing season – from spring to autumn – lawns have to receive 25-30mm water at least once a week to promote new root growth. Avoid shorter and more regular irrigation, rather use a sprayer than a held hand hose. Too busy? Consider an automatic irrigation system connected to a timer switch. • Drought: Set the blades of your lawn mower high when it is warm and dry and stop mowing altogether during heavy droughts. The more growth you allow above the soil, the less damage and yellowing will result. The grass will recover fast after the first rain. • Weeds – especially annuals will take hold in lawns that are not properly maintained. Various weed killers are available, but prevention is better than cure. Fertilize regularly (always water well afterwards to prevent burn), mow correctly and regularly – the soon flourishing lawn will smother the weeds.
