Divorce: how to fight fair Mediation - making a divorce work out. Currently in every divorce action there still has to be a guilty and innocent party and evidence has to be produced to the effect that one of the spouses committed a matrimonial offence. Divorce in itself is a difficult transitional phase and in applying the fault principle people, who will otherwise have no significant contact with the legal system, often end up in protracted and complex civil litigation with multiple parties, numerous factual and legal issues at great emotional and financial cost. The difficulty about a divorce action is that even though the subject matter is commercial, the commercial component is inextricably linked to the personal component, which in many instances is actually the obstacle barring the way to well managed divorce and, in the best interest of the children, a positive ongoing relationship post divorce. The stand-off that can happen between divorcees creates winners and losers and even winners can perceive themselves as losers given the nature of the legal remedies available. This so often results in divorcees not speaking to each other for years despite having to raise their children. It is obvious that when a relationship is conflicted, resolving financial

issues and coming up with a plan in respect of the future parenting of your children unique to your very own relationship will obviously involve tremendous stress points. In the litigation process this so often results in one parent asserting abuse whilst the other responds with deliberate campaigning to alienate the children. Even during the mediation process it will remain a personal uphill battle for both parents to contain their emotions to make sure that none of their differences influence their children's outlook and that the children at all times be allowed to have a good relationship with both their parents, grandparents and family members on both sides.. Unlike in the litigation where communication is conducted through legal representatives, mediation can only take place if both parties are present. Being in the presence of a neutral third party a safe space is created where all the parties can re-establish communication, to resolve disputes, or at least highlight difficult issues at a very early stage. For obvious reasons this can practically and psychologically be better than the old school litigation route where intransigent attitudes so often become so intractable that conflict is

perpetuated and matters are cycled and re-cycled through the court system. As mediation is confidential, privileged and without prejudice the court never hears what is said in mediation. It therefore allows both parties to be heard whilst working through the practical aspects so that each party can take ownership of the outcome. Mediation, depending on how much the parties want to resolve their issues, can be a transformative and empowering process to achieve a sense of self-value and strength to solve their own problems by means of a new way of communicating. Communication is important for healing and although it will obviously not be easy during the initiation of the mediation process it provides a start to come together, move away from punishing the reasons for divorce and make sure that your divorce, unlike your marriage can work out. It will surely be much better to have regrets over the good aspects of a former marriage, having been able to work past accumulated resentments than to have regrets because of the necessity to ratchet up hostility in the first place.

With autumn knocking at our door we discuss pool heating options to extend the swimming season. To make the right choice for pool heating there are a variety of aspects to taken into account such as the: • size of the pool • average water temperature needed • height of the pool above sea level • use of a solar blanket or not • type of pool (rimflow, shape, gunite, fibre glass, indoors) There are 2 main options for heating your pool: Solar panels There are different types of solar panels. Mounting solar panels looks easy, but installed incorrectly will hamper the flow rate of the pump resulting in the pool cleaner not working, bubbles in the pool to name but a few problems. Solar panels are mounted on the roof of the house and will heat the pool to about the ambient temperature of the day. The water of the pool is pumped up to the roof through the solar panels which heat the water and then returns to the pool. For example: When the outside temperature is 20°C, the water which exits the solar panels (correctly sized for the pool) will be at about the same temperature. Bear in mind that the distance between the solar panels and the pool will have a big influence. Per one meter piping the water temperature goes down with 0,8° C. This sounds all very good, but during the night when it is cold the solar panels will have the reverse effect and cool the pool water down. It is thus very important to manage the period when the pool pump is switched on.

In this article we can not give you all the tips but one important tip is: In the hot summer days when temperatures easily runs over 38 degrees it is very important not to turn the solar panel pump on through the peak heat period of the day. In summary: The use of Solar panels will lengthen your swimming period through the year, but will not be effective during mid April – August. At the coast with lots of mist and strong winds the use of solar panels is less effective so generally not advised. The start-up cost in fitting solar panels are lower than the cost of a heat pump, but they need more maintenance. Heat pumps Enjoy an extended swimming season, with a pool heat pump.

Conclusion: A heat pump can be fitted on every pool without a roof nearby, can be set on a temperature not to exceed and is low maintenance where the solar panels are lower in price but needs more attention and can not be fitted in all situations. One very important aspect to keep in mind is: although a heat pump works very well, most heat pumps go into a defrost mode below 10°C. Thus if your heat pump is not working during certain times in July, check the thermometer… it is most likely below 10°C . My advise if this happens is... go and get a warm cup of coffee!

The season is turning! April is thus the month to get beds ready for spring flowering annuals, vegetables and bulbs. Alas, we did not have much rain, all the more reason for proper soil preparation – healthy soil saves water! There are three main types of soil: 1. Sandy soil: does not hold water well as it filters through too quickly, so plants need more frequent watering. 2. Silt soil: very fine rock or sand particles which is a poor soil structure. 3. Clay soil: holds water for long periods. Plants with roots remaining in waterlogged soil will perform very poorly and may eventually die. 4. Loam soil: being a mix of sand and clay soils, holds water well while allowing air to circulate through. It contains organic matter and micro-organisms which keep the soil healthy. IMPROVING YOUR SOIL – Whatever your soil type, its nutrient quality can be improved by adding compost and not merely organic fertilizers. By providing food for soil organisms such as earth worms their activity is encouraged and your soil has better aeration and water penetration. Now add an organic fertilizer.

Apart from Efekto’s Vitaboost (which is 100% organic) most of their other fertilizers contain bio-carbon which gives them less chemical content. BIO-CARBON is a non-metal element and forms an important component of all living organisms. The addition of bio - carbon increases the availability of nutrients to plants by maximizing the utilization of Nitrogen, Phosporous and Potassium. It also increases water retention in soil and combined with oxygen and hydrogen, it forms fatty acids that enhance the flavor of fruit and vegetables. Fermented chicken litter is used in many fertilizers to reduce the chemical content, but adds a strong smell which is reduced by adding bio-carbon, also making the product safer to use in areas where children and pets play on the lawn. Fertilizers with bio-carbon are less volatile with no danger of burning if applied according to instructions. VEGETABLE BEDS – Sufficient compost with 150gr/m2 of Efekto’s Vitaboost together with 60gr/m2 of Efekto’s 2:3:4 which is correctly balanced for growth above the soil as well as varieties like beetroot, turnips, carrots, etc., that grow beneath the surface.

additional boost can be given in the seedling stage with Efekto’s Seagro.
