Springtime Tallahassee Tallahassee REALTORS have had a long history of involvement with Springtime Tallahassee. Walton Beach’s Billy Bowlegs Pirate Festival, the Rough Riders from Tampa, and even the Vulcans from the Winter Festival in Minnesota are just a sample of out-of-towners who make the annual springtime trek to Tallahassee. The Springtime Tallahassee festival is another great reason to live and work in Tallahassee. room sink has a sewerlike odor coming out of it. The only things that go down the drain are soap, water, shaving cream, beard from shaving, toothpaste, and a small amount of hair. I removed the drain pipe, and there is a black, slimy, gelatinous substance coating the inside of the pipe. It wasn't enough to clog the pipe, but that is the substance that’s smelling. What is the black stuff, and how do we get rid of it and the smell? Answer: That odor is from exactly what you have been sending down the sink, adhered to the trap by the grease created
by soap and skin oil. It happens to everyone, and to every sink. Some people pour a mixture of baking soda, vinegar, and lemon juice into the drain to clear that decomposing mess from the inside of the pipe and make it smell fresh. You might want to periodically clear the hair and soap that sticks to it out of the drain to reduce the opportunity for goo to build up. Confidence among homebuilders edges up By Alex Veiga Associated Press
U.S. homebuilders’ confidence in the housing market edged higher this month, reflecting improved demand for new homes as the traditional spring home-selling season ramps up. But the outlook for sales of single-family homes over the next six months dimmed slightly as builders continue to grapple with a shortage of skilled workers, ready-tobuild land and rising building materials costs. The National Association of Home Builders/ Wells Fargo builder sentiment index released Monday rose to 47. That’s up from February’s reading of 46. Readings below 50 indicate that more builders view sales conditions as poor rather than good. The overall index had been above 50 from June through January, reflecting a strengthening housing market. The latest reading, based on re-
sponses from 296 builders, comes as the spring home-selling season gets going. The season typically sets the pattern for residential hiring and building construction in the ensuing months. A surprisingly strong pace of new-home sales in January boosted hopes that the spring buying season will be solid enough to lift the overall economy. Sales jumped 9.6 percent to a seasonally adjusted annual rate of 468,000. That’s the fastest pace in more than five years.

Home bidding process depends on an accurate, complete set of specifications In my column last week we explored the required information for a complete set of plans (drawings) needed for your bid package. This week we will cover the specifications or the written documentation of what you want the bidder to cost out, as depicted on the drawings. It is the specifications that break down the interrelated infor- Mark Worley mation Building Basics shown on drawings into organized, technical sections so the general contractor, trade contractors and suppliers are better able to identify the work to be performed. Since they are written instructions, specifications are frequently adjudged by the courts as having greater importance than drawings when these documents are in conflict. Simply put, “Specifications rule over the drawings.” If what you want is not written into the specifications or detailed on the drawings, your desired products will not be a part of the contract and will be treated as a change order. This can result in additional cost to you and extra construction time. Most often, bid packages submitted to builders do not include adequate product information or installation guidelines, leaving the builder to guess as to what the owner wants. The result of this is owners receiving broadly
variable pricing from competitors. If you want it, put it in writing. If you do not know what you need, ask a consultant for advice or to help you develop your bid package. The necessary technical sections for your bid package are listed in the accompanying chart. An example of what should be included within the Windows section is manufacturer brand name, listing model number, sash material, glass type and color. To be included is any specialty windows, along with notes concerning the use of different window grid configurations. Painting specs should include areas to be painted, number of coats (including priming), type of paint (oil-based or latex), finishes (flat, satin, gloss, etc.) and brand name. The Allowance section within the specifications contains elements that we refer to as the owner’s decoration selections and choices. These items exemplify the owner’s decorating
taste and desired lifestyle. Because these items require many hours of research and coordination, most of the time these selections are finished after the construction contract has been finalized in order to accelerate the construction delivery date. Allowance The amounts are your budget for each listed phase, so it is imperative that you have an adequate budget to satisfy your expectations. If not planned for with the proper research, this one section is where most conflict arises during the bidding process. When comparing competitive bids, make sure all bidders are giving the same allowances. Bottom line: do as many selections as possible prior to letting out your bid package to builders. If possible have everything selected for such items as brick, stone, stucco and mortar, as well as cabinets, appliances, electrical fixtures, your front door, flooring type,

Developing a compete bid package may be a daunting task to an owner, but careful research will result in you receiving a just and equitable quote for your project.

MIAMI — Some remnants of a prehistoric Native American village could be preserved and displayed at the site of a long-planned hotel and entertainment complex in downtown Miami. A mediator tells The Miami Herald that the site’s developer reached an agreement with preservationists and state and local officials after two days of intense discussions. MDM Group agreed to redesign its complex to include glass enclosures over a pair of carved postholes. Archaeologists say those mark the foundations of Tequesta dwellings or other structures. A brick-lined well believed to have been part of a 19th century Army fort also will be covered with glass. The glass enclosure will allow views of the artifacts from the exterior. The agreement still must be approved by the Miami city commission.

The Congressman sees a gradual reduction in the home finance system’s reliance on Fannie Mae and Freddie Mac, government-sponsored enterprises that Southerland believes contributed to the subprime debacle and the financial meltdown. “Any changes (to Fannie and Freddie) now could be disruptive but I see a longerterm plan that gives everyone involved in mortgage finance time to adjust,� said Southerland. O n i m m i g r at i o n r e fo r m , Southerland hopes to make incremental progress on issues like border security but warns that “comprehensive� may not be politically practical or possible at this point in time. He was most emphatic on threats to the deductibility of mortgage interest on a homeowner’s federal income tax return. “Not happening on my watch,� said Southerland. “It’s too important to hard-working, middle-class Americans. And it’s too important to home ownership and the economy.�

Buyers seeking financing must adjust to mortgage industry’s rule changes Law sets limits on institution fees By Pat Gaver Special to HomeFinder.com Weekly
Prior to August 2007, there was a myriad of lending products on the market, among them 100percent financing readily available without the documentation of assets or income. These products were expanded to credit scores well below 600. There was absolutely no recognition of intent to pay, or ability to repay. As borrowers began to default, the effect snowballed, and the housing market imploded. In short, inappropriate credit was expanded to the most precarious levels in history. Investors were misled. Each party, in the process, had to own their own part in this fiasco. The immediate result was a frozen credit market. In response, the pool of investors for the mortgage market evaporated. Consequently, 95 percent of the lending in the market over the past five years has been done through Fannie Mae, Freddie Mac and Ginnie Mae. In a normal market, they should only account for 70 to 80 percent of loan purmortgage chases. But banks of all sizes stopped making residential real estate loans. Beyond that, regulatory agencies began to make changes to protect not only the consumers, but the financial market. Most recently, the Dodd–Frank Wall Street Reform and Consumer Protection Act placed new regulations on lenders. While nobody wants
to have “more regulation,� it was necessary. If institutions want to take more risk, they should have to prove the ability to sustain the risk in the event of loss. Dodd-Frank set limits on how much an institution can earn as a fee from a customer. The ability to repay a loan is set as a limit of 43 percent of the applicant’s total income. Finally, the law insures against an interest rate that is out of market through a vehicle called the High Priced Mortgage Loan. These regulations provide clear protection from a borrower paying too much and buying too much. In fact, this should be extended to all types of lending. Credit cards and automobile lenders can take consumers right over the edge of financial failure with their lending products. Many consumers over-calculate their ability to manage debt. For the past five years mortgage clients have been frustrated with the lending process. It is a process of determining the source and stability of income, as well as the source of funds needed in the transaction. A recent case will be a great illustration. The client had access to six figures of assets. However, the assets were clouded in a joint account held as a business entity. The client was putting almost 50 percent down. They needed to show proof of additional funds of just a few thousand dollars, but were not able to produce necessary documentation required by the investors Fannie Mae or Freddie Mac. In frustration, the buyers just paid cash.
While this is just one example, many mortgage customers have similar struggles. They are great potential mortgage customers. The bank making the loan ends up looking foolish when it can’t make the loan. It is the design of the products for Fannie Mae and Freddie Mac that simply will not take the loan. A new day is dawning. Local, regional and nationally branded banks are stepping back in to fill the void. At this time, we are seeing all of them require the documentation of the ability to repay. This is one of the lessons learned in the financial crisis. If clients don’t prove they can pay, they will definitely prove they can’t pay when the loan goes into foreclosure. The institutions themselves are becoming the investors. They have been witness to many great loans that were not eligible for Fannie and Freddie. They are also in touch with current market trends that suggest programs which would continue to revitalize and stabilize the real estate market. Products may include loans for clients who do not have traditional income formats, or properly sourced assets. Some mortgage customers may have great assets, but no traditional income streams. Some lenders are converting assets to income streams for qualification, beyond what the standards of current investors require. Another opportunity in the market is the client who went through a short sale. It could be due to job loss, relocation, divorce, significant value loss, or
other determined reasons. Lenders are becoming available for these clients right out of the short sale. These consumers will need a 20-percent (or more) down payment. They may have a shorter loan term. They will likely be purchasing much less home as well. Bottom line: Local, regional and national banking organizations are coming back to the market. It may take a year or two, but they will fill the void in good-quality, lowrisk loans that are currently not available. They will return to being a 20 to 30-percent carrier of mortgage debt investment. This is music to the ears of the economy, the real estate market, and financial professionals. Recovering security deposit may be a hassle By Gary M. Singer

Question: I rented an apartment for 12 years, signing a new lease every year. Several months ago, the bank foreclosed on my landlord. Since then, I have been trying to figure out how to get my $1,200 security deposit back, to no avail. What do I do? –
Jerry Answer: Because you are an existing tenant in the building when the foreclosure began, you almost certainly would have been served in the lawsuit and should have responded by letting the court know about your lease and security deposit. This would have allowed the court to include
the return of the deposit in the final order of foreclosure. You can sue your former landlord for the money, and you don’t necessarily need to hire an attorney. You will have to lay out the cost of filing the suit and finding and serving the landlord with legal papers – it may cost you several hundred to
$1,000 – but you can have the judge award those fees back to you. For some people, filing a lawsuit over $1,200 is not worth the time and hassle. You may find it more advantageous to forget about the security deposit and instead pursue as much or more money from the lender — your new landlord —
through a “cash for keys” program. In all likelihood, the lender will not renew your lease once it expires. But you may be offered $1,000 or more if you agree to turn over the property quickly and in good condition at the end of the lease. Contact the lender and see if this is a possibility.
