For vinyl tiles badly set, the only fix is a do-over By Alan J. Heavens The Philadelphia Inquirer

Question: When Hurricane Sandy flooded our basement, we had a contractor pull up the carpeting and install vinyl tiles. He prepared the concrete floor by scraping

up the rug glue that remained, and used commercial adhesive to put down the new tiles. Some of the tiles do not lie flat against the floor; their edges bow slightly, creating a space that rises above the adjoining tile. This looks bad, and I expect that

dirt – or water, when the floor is mopped – will eventually accumulate in the spaces. The contractor says the floor is not even. Is there a way to correct the way this looks? Should some sealant or grout be used to close the spaces? Answer: I assume you

tile floors and the first thing I’ve done in each case is make sure the surface on which each is installed is level. Otherwise, you are going to have problems, and you are. What compounds the problem is that these are glued-down tiles rather than self-adhesive, which are easier to install and to fix. With self-adhesive, you simply cut the affected tile, pry it up, and sand the glue. Glue-downs are embedded in mastic, which is tougher to remove. The unevenness should have been determined beforehand and corrected with a leveling compound designed for use on concrete surfaces. Vinyl tile is not designed to be grouted. You snap chalk lines and then you butt each tile up against the next. Solution: It is a doover. Q: Anything I put on my back deck gets mildew on it every year. I clean it with ammonia and water, then put on a new coat of stain about every two to three years. Just wondering if there is anything else to do. A: You can try a sealant, but if your back deck is on the north side where the sun doesn’t shine very much, regular maintenance is probably the only answer. I’ve tried many things over the years, but periodic “de-greening” and sealing is usually the best answer. Q: I have a fine dining room table with a dark stain and the standard, I assume, urethane protective finish. By mistake we placed on the naked wood hot plates without an undercover protection. The result is a series of three white spots. My guess is

that the urethane coating blistered and turned white. How do I remove the white spots without further damage and treat the area to bring back the dark finish? One suggestion was to use fine-gauge steel wool to remove the white blister finish and treat it from there. What are your suggestions? A: I’ve had that sort of problem with steam from a coffeemaker putting a white spot on a cherry cabinet, but what I noticed is that more steam removed it. But your question piqued my curiosity, in that we have a missionstyle oak dining room table that could suffer the same problem if someone is careless. The solution I’ve found on the Internet is, oddly enough, applying more heat to the white spot created by something hot. Prospects improving for Centerville Conservation Community Land manager Keith Parker’s day starts at about 7:30 each morning. Apparently, the same is true for the turkeys, deer and fox squirrels that live at the Centerville Conservation Community. The 1,000-acre preserve and residential community blends open spaces, swamp, two stocked lakes and untouched woodlands to create an environment that homebuyers are starting to rediscover. “There is roughly 680 acres just left natural for the wildlife,” Parker said. “An example – this morning I saw turkeys and deer while out doing my work.” Fox squirrels dart through the woods and occasionally, a bald eagle will visit as well. Started in 2004 by developers Hurley Booth and Jon Kohler, Centerville was the first conservation community of its kind in northern Florida, with construction tightly controlled by various rules and the oversight of an architectural review committee of residents. It is located at the corner of Centerville and Pisgah Church roads. The recession and real estate’s collapse, however, brought activity at Centerville to a virtual standstill and the project went into receivership. This past week banking company BB&T closed on a sale of the land, facilities and remaining homesites to Centerville Group LLC, an investor group from Jacksonville. You can hear the relief in Marie Eddy’s voice. She and Parker both decided they would remain committed to Centerville, even when the outlook wasn’t good. “We stuck with it and it’s nice to see it finally being completed. It’s a

gorgeous neighborhood,” said Eddy, a licensed community manager with Homeowners Association Management Inc. Even before the new investors came along, Eddy said she began seeing a big increase in the number of people inquiring about the available lots and wanting to build in Centerville, which currently has 80 remaining homesites priced from $80,000 to $180,000. PrimeSouth Properties – Fezler, Russell & Ferrie Inc. is in charge of sales. There has been as many as eight lot sales recently, Parker noted. “It seems like the minute they are sold they have

plans ready for approval.” Custom homebuilder Jason Meadows, president of White Oak Construction LLC, lives in Centerville and has completed three houses to date. He has two homes under way, as well as plans in the works for three more. Saxon Hannon, Bridgewater Builders LLC and others are building there as well. The 30 homeowners enjoy 7.5 miles of hiking trails on the property and have use of stables and fenced pasture for horses. The bass in the lakes are plentiful. “I have caught some that weighed 8 or 9 pounds and released them,”

Parker said. To maintain its architectural standards, Centerville is under tight rules on styles of homes, exterior finishes, the homes’ orientation on the lots and other requirements. “They are actually very strict with the architectural control com-

mittee,” said Meadows. “It’s a process to go through. It’s more difficult than any neighborhood I have worked in, but I appreciate the value after it’s over with.” To the credit of the receiver, lender and courts, there was an effort to maintain the common areas and facil-

ities while the property awaited sale. “We were able to weather the storm through the tough times,” Meadows said. “We didn’t have as much work to do.” Still, word of mouth kept them and other builders going. “We live out here and we work here, and we really want it to be successful,” said his wife, Andrea Meadows, a broker who has sold lots there. Such a policy can say a tenant will be subject to a non-renewal if one or more of the following conditions apply: 1. The tenant received one or more 7 day Notices of Noncompliance within the preceding twelve months. 2. The tenant was late with rent 2 or more months within the preceding twelve months. 3. The tenant has violated the lease and/or the community rules four or more times within the preceding twelve months, and each of the violations is documented in the tenant’s file.

You have the right to non-renew a tenant at the end of a lease term. Florida law does not require that you have a reason for the non-renewal. Nonetheless, you better have one, and it better be documented in your file. Without that documentation, you may be vulnerable if the tenant later claims you are violating the Fair Housing Law. Often, documentation is key to winning a fair housing case.

5. The owner and/or management plans to use the unit for purposes other than the rental of a residential unit.

It is also a good idea if your office develops a renewal policy. The policy will set the standard for who stays and who goes. Thus the decision about renewal will not be arbitrary.

This is just an example. Your renewal policy should reflect your property’s priorities. Of course, your policy is only good if it is consistently applied.

4. The tenant owes an amount to management for rent, late charges, repairs, or other amounts, and the debt is more than 30 days past due.

May begins the peak moving season when the majority of Americans who are relocating are moving short and long distances. Peak moving season lasts through September, with the most requested dates occurring Memorial Day weekend and the July 4 holiday. The 2013 moving season is slightly unusual compared to years past due to the last days of the month in May, July and August falling on Friday, Saturday and Sunday. Consumer demand for these weekends will be high and there is a limited supply of industry resources available, including reputable, licensed moving companies, truck rentals and shipping containers. Many consumers will be competing for these weekends and demand will push up prices. You may want to consider moving during the weekdays, if possible. The majority of moving companies are reputable businesses, however, as with any industry, there are unscrupulous characters. The industry has seen an increase in criminal activity; much of this has been fueled by the Internet, the Great Recession and many consumers basing moving services or products (leased trucks and containers) on the lowest price available. The problem has become so significant, the American Moving and Storage Association (AMSA) developed the ProMover program, which qualifies and confers ProMover status on reputable moving companies.

What’s more, in late 2012 the Senate Committee on Commerce, Science and Transportation conducted an investigation of household goods fraud in the moving industry. The investigation revealed Florida is leading the country in these cases. The majority of the fraud is perpetrated online by move brokers and virtual moving companies who quote extremely low prices to lure consumers into their scam. In response, the Florida Movers and Warehousemen Association recently partnered with the AMSA and in March initiated its own Florida ProMover program. However, many rogue operators fraudulently display these emblems as well as other quality service logos to fool consumers. It is always wise to check with the designating entity to ensure validity. Whether you plan on executing the move yourself or retaining the services of a professional moving company, now is the time to start evaluating your options, determine your budget, make the arrangements and confirm move dates, if known. Too often consumers wait until the last minute to plan, make arrangements to pack, and move all their belongings to their destination. This adds unnecessary stress when they encounter a lack of available rental trucks, shipping containers and reputable movers. Do-it-yourself moves can save you money, but be sure you reserve a rental truck with a recognized brand known for maintaining its fleet. Beware of rental companies with cheap rates; many of them tend to overbook, meaning

there’s no guarantee the truck will be available even though the truck was reserved and paid for in advance. Beware of hidden charges; get a clear understanding on what the cost of the rental truck includes, hours of use, mileage, fuel, equipment, moving pads, etc. Most importantly, get the right

size truck for your move. The same process applies for shipping containers, which have become very popular. Do business with a reputable brand that has the resources to ship containers safely and on time. It’s also wise to check homeowner associations, local ordinances, or condominium/apartment

rules regarding placement of containers on their property. Some have very specific rules regarding placement or the length of time a container is allowed on site. Florida and many other states regulate moving companies who perform intrastate moves. Just because a moving company has

Question: We took out a reverse mortgage a few years ago and now want to leave the house to move closer to our children. The loan is more than the property is worth, so we can’t sell it. What happens if we just walk away from it? – Frank Answer: In a typical reverse mortgage, home-

owners 62 years or older can receive money from a lender to pay off their current loan and supplement their retirement income. As long as the borrowers are living in the house, they don’t have to repay the loan. But once the borrowers no longer live there, the loan must be paid in full. Most reverse mortgages are “non-recourse” loans, meaning that the lender can take back only

the house as repayment and can’t seek the deficiency from the borrowers or their probate estates. In your case, you should review the paperwork and confirm that you have a non-recourse mortgage. If so, you could walk away from the home knowing that the bank can’t come after you for the difference. You do want to make sure that any asso-

ciation dues are paid in the interim. Also, you are responsible for the home during the foreclosure process, so it makes sense to try to communicate with your lender to see if it will allow you to complete a short sale or another foreclosure alternative. Reverse mortgages can be ideal in the right situations, but they do have drawbacks, includ-

ing high upfront costs. They can be great longterm solutions but shouldn’t be used as short-term Band-Aids.
