Tallahassee Marketing Officially ‘Improving’ This week, Tallahassee joined a list of 263 housing markets in America that are officially considered “improving” according to the National Association of Home Builders/ First American Improving Markets Index (IMI). The index is based on six consecutive months of growth in jobs, housing permits, and home values. Question: I would like to know if there is any method, other than moving an outdoor AC compressor, to minimize its noise when it is running at the same time people want to be on the back deck enjoying the summer. I live in a condominium and have a double whammy of this problem — the compressor for my home, close to my back door, and also the compressor belonging to my next-door neighbor, very close to the other side of my back door. These compressors are pretty new. They are not loud, but the normal humming of their motors is very noticeable in this very small area. Also, because of the small area available, plantings or traditional fencing around the equipment is not possible. Do you know of any new, low-profile surround material which will baffle the noise, allow for the necessary circulation space, but not make the compressor enormously larger? If something does exist that meets these criteria, is it reasonably affordable? Answer: From what I am led to understand, there is no way that all the noise of an air-conditioning compressor can be eliminated. While many manufacturers have made their products quieter than they used to be, compressors still make noise. It is the price we pay for comfort — along with high electric bills. The only way peace and quiet can be achieved in the summer while keeping cool rests in that house I’ve been coveting on Frenchman’s Bay in Maine. There are items called

“sound blankets,” manufactured by a few companies. Putting a blanket around a motor suggests fire hazard to me, but the manufacturers say that the compressor motor in your air conditioner is internally cooled by a refrigerant, so it will never overheat when insulated. Apparently, the heat does increase by a “negligible” 2 percent, they say. One manufacturer says its product reduces the noise by 5 decibels, which it says is a 30 percent to 50 percent reduction in the perceived noise. As far as price? That’s something you can do for yourself by shopping online. But I doubt it would be as expensive as moving the compressor, or in your case, selling the condo and moving. Do your research carefully. Find out up front what all the pros and cons of these sound blankets are and what the warranty is on the product. Make sure it comes with a money-back guarantee. It is pointless to spend even a little money on useless stuff.

By now, you’ve planted your warm-season vegetable garden, and are just waiting for the harvests that give you fresh goodies for summer salads and sandwiches. Don’t stop with just those first crops. With some careful planning

The key is replanting. “It’s so simple, but many gardeners don’t do it,” Fendley says. “For example, every 10 to 14 days you can seed radishes, plant a few seeds at a time, not the whole packet, and you’ll have crisp radishes continually from spring to late fall instead of leaving them in the ground to get tough and woody. “Instead of planting one long row or bed of lettuce, consider interplanting lettuces with longer growers like onions or carrots. Two weeks later, sow more lettuces between the longer growers, and so on until the weather gets too warm for lettuce. Since the plants mature in one to two months you’ll get a continuous harvest of lettuce.” Good candidates for succession planting, according to Fendley, include: » Greens such as lettuce, spinach and kale in

spring and again in fall. Plant Swiss chard after lettuces are done. » Once summer’s sweet corn is done, plant broccoli transplants for a fall harvest. » Plant vine-type cucumbers early, followed by bush cucumbers a month later. » Directly sow seeds of carrots, radishes, beets, bush beans and snap peas into the garden every few weeks in June and July. When you shop for seeds and transplants, look closely at the maturing dates, choosing a variety of short, mid and long-maturing types. Crops also continue longer on a natural basis if you harvest regularly. Historic WaterOak Plantation is for sale Special to HomeFinder.com Weekly

Tallahassee will add another chapter to its history today. It does not happen often, but one of the community’s historic estates is being offered for sale by the family who has owned it for more than 30 years. WaterOak Plantation has been listed for sale with Century 21 Manausa and Associates. This is not merely another home on the market. It is a new chapter in Tallahassee history – a history that began with the birth of our state. In 1821, the United States purchased Florida from Spain, and over the next 20 to 30 years, most of the land was sold to individual planters wanting to take advantage of the fertile red hills of this area for the expanding cotton market. This was the case for the Bradford brothers, Thomas, Edward, Henry and Richard. They settled large tracts of land near what we now know as Bradfordville. WaterOak was founded as a small cotton plantation of 1,840 acres by Richard Bradford, who later would become the first Florida officer killed in Confederate action during the Civil War. After the war, numerous plantations were created through large land buys all along Thomasville Road, offering worldclass quail hunting to affluent Northerners. Clement Griscom, a shipping magnate from Philadelphia, was one of the most active buyers. Upon his death in 1916, his daughter Frances C. Griscom established her WaterOak Plantation on 7,000 acres, naming it for the antebellum property belonging to Richard H. Bradford. Frances Griscom later

became known as the nation’s first woman’s golf champion. She occupied the mansion she built in 1945 and entertained such dignitaries as Bob Hope, Bing Crosby and the Duke and Duchess of Windsor. In 1951 she sold 6,429 acres to Julien C. “Bull” Headley. She kept 300 acres until her death in 1973. Griscom left part of her land to her faithful property manager, while 80 acres and the plantation house was sold to Lester Tabb. In 1985, Margaret and Tom Johnson purchased the plantation from Tabb. enough to raise and breed horses and to build separate homes for their family to enjoy was no small

task. One look at WaterOak and they knew they were home. The family was in-

volved with breeding and training cutting horses with the help of Sonny Little, a Texas cowboy and renowned trainer. They added 60 head of cattle to their 25 horses. Over the years, the Johnson family renovated the historic mansion and built homes along Lake

McBride for daughters Wendy (Boyle) and Laura (Goodfellow). Tom Johnson died in 2005, and Margaret followed in 2011. The children — Scott, Wendy and Laura — have decided that it is time for the next chapter of WaterOak Plantation to be written.

by Harry Anthony Heist, Attorney at Law In the “Public Records” section of your typical credit report, you will see things like evictions, foreclosures, suits for money and bankruptcy filings. Most application processing companies obtain and compile this data to allow the landlord to make a more informed decision on whether or not they will rent to the applicant. Often you will see that an eviction was filed on the applicant, and the disposition was “Voluntary Dismissal” or “Dismissed”. Does this mean that the tenant was not evicted or that everything was amicably resolved? Don’t be so sure. The “Dismissal” Not all tenants who have evictions filed against them are actually “evicted” by the Sheriff. A number of things can happen. The tenant may vacate the premises voluntarily shortly after the eviction is filed. The tenant may pay all the money owed, and the landlord requests that the eviction be stopped. The tenant may enter into a Stipulation with the landlord, under which payment arrangements are made, and the tenant successfully stays and pays pursuant to the settlement terms. In all these scenarios, the eviction filing will show up in the public record and will be in this public record for many years. Eventually, the eviction matter is “dismissed” and is recorded as such. There are two main ways an eviction is dismissed. It will either be by the landlord’s attorney filing a “Voluntary Dismissal”, or the court entering a “Dismissal for Failure to Prosecute”. In both cases, the public record will show the case as being dismissed, BUT it does not always mean that things were worked out or that the tenant paid the rent. Usually, it is quite the opposite and simply means the tenant vacated and the eviction was not processed further. The Voluntary Dismissal When a tenant vacates, the attorney may file a “Voluntary Dismissal”. This means that the case is no longer being prosecuted, as no further action is necessary on the file. The landlord got what they wanted, which is possession of the premises. In the situation where a Stipulation is entered into by the parties, the Stipulation may provide that the case will be voluntarily dismissed upon the tenant making the payments as planned. Unfortunately, the landlord, when looking at a “Voluntary Dismissal”, usually has no way of knowing why the case was dismissed. Without further information, the best assumption a landlord can make is that the eviction was filed and that the tenant vacated.

Many evictions are filed as Two-Count Complaints. Under the first count the landlord is asking for possession, and under the second count the landlord is suing for money damages. In order to get a judgment for money damages in Count Two, the tenant will have had to be served personally with the eviction action or will have filed an answer to the complaint. Often, neither of these two contingencies occur, and at the end of the eviction or some time after the eviction is over, the attorney will file the Voluntary Dismissal with the court to close the case out. There may even have been a Final Judgment for Eviction somewhere in the public records, but the final action showing up may be that “Voluntary Dismissal as to Count Two” The Dismissal for Failure to Prosecute If an eviction is filed, the tenant vacates and the attorney takes no further action, the Clerk of Court’s office will eventually send out a notice to the attorney and the tenant stating that the case will soon be dismissed by the court on its own, if the attorney for the landlord or the tenant does not pursue the case any further. This could be six months after the case has been filed, or even more than a year. The attorney will either then file a Voluntary Dismissal closing out the case or do nothing, and the Court will go ahead and dismiss the case. If a Two-Count complaint has been filed and no personal service has been effected on the tenant, the Court will know that the case is probably not going to proceed any further and will want the case dismissed. This dismissal by the court happens to tens of thousands of cases each year. The Court does not want to keep files unnecessarily open and will purge them from their active case system. When the landlord looks at the public record results, it will show as a “Dismissal”. What should the landlord do when the record shows “Dismissed”? There is a high probability that the applicant had an eviction filed against him or her by a prior landlord and just vacated. It is imperative that if any eviction filing shows up on the public record, the landlord looks into the matter deeply to find out exactly what happened during the eviction. Did the tenant pay and stay? Did the tenant vacate? Did the tenant get fully evicted? These are all questions that can be answered by looking at the Court file further and contacting the prior landlord. Most counties are now online on the internet, and a lot of information will be available to the landlord by simply going to the website of the Clerk of Court where the tenant had the eviction filing and examining the docket. Question: I was having trouble making my mortgage payments and agreed to give the deed back to the lender in lieu of foreclosure. The bank even gave me $3,000 for moving expenses. I moved out three months ago, but I still haven’t received the money, the deed has not been recorded and the foreclosure lawsuit has not been dismissed. Is this OK? – Darrin Answer: This is pretty typical, but it’s not OK. You are responsible for anything that happens with the property while you are still the owner, including homeowner’s association fees and property taxes. You even will be held liable if someone gets hurt walking across your lawn. It’s important to make sure that your lender promptly records the deed to cut off this liability. When you give your property back to the lender, you should do a walk-through with your lender’s local real estate agent and have the agent sign that the property was given back in good shape. If this is not possible, make sure that you take dated pictures to document that you left the home in good condition. Make sure to turn off the electricity and water as well. If the bank’s attorneys have not already done so, you should file a copy of the settlement agreement with the court in case you need to ask a judge to enforce it later. But before going back to court, call your lender and ask about the money, the deed and the foreclosure dismissal. Most of the time, you have to follow up to make sure the deal is completed. Gary M. For one community, everything’s better in an Airstream By Alyson Ward

HILLSBORO, Texas – When your home has wheels, you can go anywhere. And when your home is an Airstream, you’re part of a special club, your smooth silver box of a home attracting attention and affection wherever you go. Just off the interstate in Hillsboro, Texas — about an hour south of Fort Worth on I-35 — there’s a whole neighborhood full of Airstream trailers. They’re lined up on tidy lots: big ones, little ones, vintage trailers and trickedout newer models. And the people who own them have formed a community there. They may be on the road several months of each year, but the North Texas Airstream Community is their home base: It gives them a mailing address, a small house to stay in, a group of neighbors that they know they will see again. Their homes may have wheels, but they have a piece of solid ground to return to when they wish. The community was started in 1991. A group of Airstream owners found a 50-acre spot in Hill County, put a fence around it and divided it into lots. They combined their skills — a retired plumber, a retired electrician, a man who knew how to use a backhoe — and dug trenches for water and sewer lines. And soon they started attracting people from all over the country who wanted to stay for a night, for a week or for years. “It’s a group of people who enjoy trailering, Airstreaming,” says Joe Gardner, who has owned Airstreams since ’88 and lives here with his wife, Gypsy. “And we’re a group that’s very close-knit.” There are just a few requirements for moving in: Residents must be at least 45, have an Airstream and belong to the Wally Byam Caravan Club International, the overarching organization named for the Airstream’s inventor. In fact, the club’s president lives in Hillsboro – as do several former international presidents. There are about 150 properties, most of them on 40-by-80-foot lots. Those tiny lots are the perfect size for an Airstream trailer and a carport to cover it – and for a compact little home known as a villa. Much like Airstream trailers, the villas are designed with no wasted space, full of little compartments and hideaway storage. The community, says Jim Haddaway, the community president, “was originally for those who had Airstreams to have a lot,” a place to park

their trailers. “Then they got the idea to build a house, a place to sleep,” he says. “Then, why not build one big enough to have washers, dryers, bedrooms?” The steel-framed villas look a bit like storage sheds from the outside — and for some, that’s pretty much what they are. But many of the residents live in their villas and have turned them into two-story homes with 1,200 or 1,500 square feet with multiple bedrooms, full-size baths and a kitchen big enough for real cooking. Airstream’s iconic silver trailers have dotted the country’s highways for more than 70 years. Its smart design and familiar rounded profile have made it a rolling aluminum symbol of American freedom and wanderlust. And though lots of people own trailers made by other companies, the Airstream has a certain mystique. Its unchanging appearance has allowed it to absorb our collective history, its unique shape and clean lines embodying a simpler time. And it even feels like a simpler time in the North Texas Airstream Community. People come and go all the time, but residents can’t recall any crime since the place opened 18 years ago. There are no street lights, signs or traffic lights; when the sun sets, it gets truly dark. There’s always a game of cards going on in the clubhouse. And every Tuesday evening, just about ev-

erybody in the neighborhood — well, everyone who isn’t traveling — gathers for a potluck dinner. Who lives here? Former teachers, retired military personnel, people who worked for oil companies. Most are retired. Many are longtime Texans. All are wanderers, full of stories about the places they’ve been and the places they want to go. Most folks are retired, but everyone has business cards so they can quickly share contact information with new friends they meet along the way. Their lives are on the road. But this community is the place they call home. As the sun sets behind tall trees, a warm light glows from the silver trailer parked on Lot 703 – and from the white steel-sided villa built next to it. Sheila and Eddy Lewis live on this lot on Avenue D when they’re home. But that’s only about four months out of the year. The rest of the time, they travel, eat and sleep in a 34-foot Airstream trailer. “This is kind of our home base,” Sheila says of their white, steelsheathed two-story villa. They drop in and stay for a while, then hit the road again. In 1974, the Lewises were living in Colorado, and one day they wandered into an Airstream showroom in Colorado Springs. A woman was using a fan

and strips of ribbon to demonstrate the aerodynamic shape and good design of the Airstream trailer, and that made a lasting impression on the young couple. “She convinced us,” Eddy says. “So we started saving our pennies.” In 1997, after Eddy retired from the military, the couple finally bought their Airstream. Two years later, they sold their home, put most of their stuff into storage and hit the road full time in their 34-foot Airstream Classic Excella. The two take odd jobs here and there, temporary positions they find through word of mouth or in ads they find in RV magazines. They’ve worked at Yellowstone National Park, Eddy doing maintenance and Sheila registering campers. Last year they went to Des Moines and spent a few months at Adventureland Amusement Park. Sheila worked in the gift shops; Eddy did games. They spent last summer at a campground in North Carolina, and in a few weeks they’ll head to Coffeyville, Kan., where they’ll pack and mail holiday orders at an Amazon.com shipping center. Their ’94-model Airstream has been repainted inside, and a few years ago they installed a wood-laminate floor. There are curtains on the window above the kitchen sink, a clock and a cross on the wall; it’s small, but it looks like a real home. In fact, before they hit the road, the Lewises have to pack only clothes and food. The rest is already at their fingertips, stowed away in one of the trailer’s many drawers and storage cabinets — “you’d be surprised how much you can get in an Airstream,” Sheila says. Jim and Janie Haddaway met twice accidentally. And they ended up marrying in 2000 after a string of coincidences that, Jim says, “could only happen to an Airstreamer.” The couple lives in one of the property’s conventional homes — houses built with an attached carport for Airstreams. Jim is the president of the North Texas Airstream Community. He’s also a former president of the Wally Byam Caravan Club International, one of several who live in the community. Jim has been an Airstreamer since 1978, but Janie didn’t buy her first Airstream until 1997, after her husband died. “I used to provide the entertainment for the neighborhood trying to back into the driveway,” she says. But she was taken with the Airstream way of life. In June 1996, Janie went to Alaska with good friends, traveling with their Airstream group on a caravan. In North Pole, Alaska, she met Jim.
