I had a recent question from a reader who had a smart meter installed and checks online for usage. The reader reported usage was normal for one or two days, then surged for the next day or two. There is no pattern to the

Now is the time to make your house shine! When getting ready to sell your home, you should think: CLEAN, CLEAN, CLEAN! Potential buyers can see past a lot of things, but the five senses play an extremely important part in buying.

The sense of smell is huge! As a REALTOR®, I have to sometimes say, “Excuse me for saying this, but your front entrance smells like cat urine.” If this were the case, do you think it would affect a buyer’s first impressions?

The sense of sight is important. The smallest details make the biggest impact: grungy knobs on your appliances or cabinets; dirty corners or baseboards; dead potted plants; or dead branches hanging over your home. Another thing I notice in homes is the air conditioner filter. A dirty filter is a sign that you don’t maintain your a/c unit. Buyers may think, “If the appliances and filter are so dirty, I wonder what else was neglected in the maintenance of the home.”

Check out all the doors and cabinet drawers in your home to make sure they don’t creak and to see they open and close with ease, so they don’t make any sound. People also buy with their ears. Offer up some soothing music, a lightly scented candle, and fresh flowers, and watch what happens!

If you have a vacant home for sale, it is extremely important to leave the utilities on. Buyers want to feel the ceiling fan, air conditioning, or heating working, and the chill coming from the refrigerator and freezer. Feeling is a big part of buying and this makes a huge difference. Last but not least, try to offer up something to eat during an open house. Buyers will remember your home if you give them something to make it stand out in their minds, and I can’t think of a better “something” than food! Let them taste your house! clothes. “Wells are sneaky things,” Ulmann says. Now to the reader in Avalon with the rottenegg-smelling tap water he first noticed after Hurricane Sandy. Although I thought the answer from the plumbing contractor I provided said it all, I also like to share the experiences of readers with similar problems. Not every problem is exactly the same and not every solution works — something the DIY TV talking heads don’t seem to understand. From Nick and Marilyn Chapis: “We’ve had a house in Avalon since 1978, and this past year for the first time ever, we experienced the hydrogen sulfide odor. “Our water heater booklet gave a couple of reasons that this could happen,” Nick said, including that an “anode rod in the heater eroded or bacteria in our water multiplied due to too low a temperature in the heater.” The Chapises called their plumber, who drained the tank and then refilled it, and turned the pilot light back on, at a cost of $400. “We turned the temperature up, ran our washers and showered, and in a couple of the days, the odor was gone.” Mary Jane Jerrett of Ocean City had the problem the Chapises’ plumber pointed to as a possible cause: “I also had that sulfur smell about five years ago, when the house was five years old. A plumber friend thought maybe it was because of a dry drain.” She tried cleaning the drains with a product she obtained from a hardware store, but then realized the odor was present

only when the hot water was on. “The first thing I did was get out the manual for the hot water heater,” she said. “The manual stated that the rotten-egg smell was actually the anode rod. As it breaks down, it gives off that smell.” Although she is now a widow, Jerrett still thinks “that I can do all of the do-it-yourself projects” that she and her late husband did. So she went to a plumbing supply store and bought an anode rod, and “I’m sure the guys at the counter had a good laugh on me when I left with the 5-foot rod.” “They didn’t bother to tell me that they sell an articulating one that is easier to put in in tight spaces,” she said. She called her plumber. The cost was a little more than $200 five years ago. Save the manual and read it when you buy any product, rather than just sticking it in the back of the kitchen drawer. Remember, too, that the Internet can be a great information source if you filter out the misinformation.

town after surviving life-changing injuries in Iraq or Afghanistan. “We all know what we’ve been through, more or less,” said Kelly, who retired from the Army with injuries from serving in Iraq and is facing the likely amputation of his left leg this year. The men and their

families, strangers to one another until they moved to the west Orange County town, have formed a unique safety net, woven not only of military service but also of common circumstance and challenges. Legislature Cracks Down on Unlicensed Contracting Thanks to Rep. Halsey Beshears and the Florida Legislature, unlicensed contracting will now be receiving the regulatory scrutiny it deserves. Beshears, a Republican from Monticello who represents District 7 in the Florida House of Representatives, shared that good news earlier this month with the members of the Tallahassee Builders Association (TBA). H e r e p o r te d t h a t a b i l l h e sponsored was passed in the House and Senate and signed by Governor R i c k S c o t t to i n c r e a s e f i n e s , penalties, and enforcement actions against unlicensed contractors. The bill allocates $250,0 0 0 to the Department of Business and Professional Regulation (DBPR) to conduct stings and sweeps in search of unlicensed activity. “ T h i s i s a h u g e w i n fo r o u r industry and for consumers who are often the victims of unlicensed contracting,” said Florida Home Builders Association (FHBA) Director of Governmental Af fair s Doug Buck, who joined the legislator in addressing TBA members. “We owe Rep. Beshears a deep debt of gratitude for his leadership on this issue.” Beshears and Buck also touched on other actions from the 2013

adapt to lives without limbs and cope with the aftermath of war wounds. “Their lives have been permanently changed,” said Bill Criswell, who arranged for the men and their families to build their futures in a town with large oak hammocks and dirt roads. “Our idea was to give these guys an opportunity to restart their lives and say thank you to them for the sacrifices they’ve made.” About six years ago, Criswell helped organize a program called Home At Last as an arm of Habitat for Humanity in west Orange County. He has used the charity’s clout and connections to build homes provided free to injured veterans, with wheelchair-friendly features such as wide doorways, lower countertops and ramps. The families, usually recommended by Veterans Affairs doctors, could have chosen sites elsewhere in the county, but all picked Oakland, a community of 2,600. “We wanted something quiet, peaceful,” said Andrea Griffin, Marcus Griffin’s wife, who hears a neighbor’s rooster crow each morning. “This seemed to be exactly right.” Although life in Oakland may seem idyllic,

the veterans admit they are struggling with their new reality. They loved being soldiers, and they all banked on long careers in the military. They say they miss the adrenaline rushes and wish they could go back. Some have battled depression and post-traumatic stress disorder, though they realize they are fortunate to be alive and home with family. “You slowly understand life is different than you had expected or envisioned it would be,” said Corcoran, a sergeant major of the Army who commanded 800 men overseas and now relies on his son T.J., 15, to put a shoe on his right foot each morning. “But you then realize that you’ve got to get busy living now or you start dying.” An avid sportsman, the burly Corcoran, 44, has arranged hunting trips for the other wounded veterans in Oakland. Reaching out to the other soldiers comes naturally to him, he said. Additionally, the families often support each other. “We’re used to being Army wives,” Michelle Kelly said. “We’re there for one another.” Just like any combat veterans returning home, the troops in Oakland are searching for their niche in civilian life.

ND considers buying Lawrence Welk’s childhood home BISMARCK, N.D. — The State Historical Society of North Dakota is considering buying the boyhood home of Lawrence Welk, though some worry the farmstead may not draw many tourists because most of the famed champagne music bandleader’s fans have died or will do so soon. So the organization proposes to use Welk’s home in the tiny town of Strasburg to also highlight the importance of agriculture and the region’s German-Russian heritage. “Even with the Welk legacy aside, it’s history worth preserving,” said Sen. Robert Erbele, RLehr, who successfully fought this year to include funding for the bandleader’s birthplace in the historical society’s budget. The idea comes two decades after Congress earmarked $500,000 to develop a tourist industry in Strasburg, including a museum of German-Russian heritage to draw visitors to Welk’s birthplace. Embarrassed lawmakers later withdrew the money when the idea was mocked nationally as a symbol of wasteful spending. Merl Paaverud, director of the historical society, said the agency’s board meets July 12 and may decide whether to spend $100,000 on the six-acre parcel that includes the home where Welk and his seven siblings were born. The property is still owned by Welk’s extended family and includes a barn, summer kitchen, granary, buggy house, blacksmith shop and outhouse. The home, about 75 miles southeast of Bismarck, has been on the market since last fall.

“It’s not a done deal,” Paaverud said. “We’ll be taking input from people, locals and interested parties.” Sen. Joe Miller, RPark River, said he’s a fan of the North Dakotaborn bandleader — but he doesn’t think the state should foot the bill for Welk’s birthplace. “It’s just less money we could put toward tax relief, roads or whatever,” Miller said. North Dakota’s newfound oil wealth has placed unprecedented demands on lawmakers for spending, from the mandatory to the absurd, Miller said. “Just because people

think we have lots of money people think they can come at us with ridiculous requests,” he said. Welk’s nieces, Evelyn Schwab, 84, and Edna Schwab, 80, have given tours of the farmstead since it was restored with

private funds in the early 1990s. Welk donated about $140,000 for the restoration before his death in 1992 at age 89, Evelyn Schwab said. Though Welk returned home often, “He never lived to see the place

restored,” she said. “That was the sad part.” Not a fan of farm life, Welk left North Dakota when he was 21 after performing at barn dances and other community events. His big break came when ABC picked up his eponymous television show in 1955. The show, famous for its bubble machine and Welk’s phrases “Ah-one, an’ ah-two” and “wunnerful, wunnerful” in his German accent, ran until 1971 and is still shown in reruns. The Schwabs said Welk’s farmstead drew more than 7,000 people in 1992 but attendance has slipped to about 500 last

year. “For the first few years, we were swamped with people but as the years go by attendance has dropped — younger kids have their own types of music now,” Evelyn Schwab said. “If it wasn’t for reruns, it would have died out a long time ago.” The Schwab sisters and Sen. Erbele, whose district includes Strasburg, said the state’s purchase of the farmstead would preserve Welk’s musical legacy and bring in much-needed tourism dollars. “We think $100,000 is a drop in the bucket for the state,” Evelyn Schwab said.

by Harry Heist, Attorney at Law LICENSING FOR PROPERTY MANAGERS? Should managers of single family homes, duplexes and triplexes have special licenses? Were you aware that “property management” is not a “real estate activity” according to Florida Statutes Section 475, and therefore requires no licensing or working under a real estate broker? The massive increase in rogue managing is making some take a closer look at licensing as a possibility for next year’s legislative session. Stay informed and begin gathering instances of unlicensed conduct by these rogue managers. Currently the majority of FREC complaints are generated in the property management context. Rogue, unlicensed managers are governed by no one. E-FILING IS IN FULL SWING As expected, the new E-Filing the State of Florida requires attorneys to now use got off to a bumpy start, but things seems to be settling down. Each courthouse has its own distinct computer system, and the Florida E-Portal is attempting to “talk to” each and every system. Once the court system can catch up to the E-Filing, we will be able to have more evictions filed the same say as they are received. Fun times for all! DENYING AN APPLICANT FOR NON-CREDIT ISSUES We all know that it is legally necessary according to the FCRA to send an applicant an adverse action notice if he or she is declined for bad “credit”, but what about if the problem is a bad landlord reference or other reason not related to credit? Is there a required notice? Not really, but it is a good idea to tell all denied applicants in writing why they were declined, to avoid the appearance of discrimination if the denied applicant happens to be of a protected class. YOUR LEDGER AND EVICTIONS All too often when we have to ask for a ledger amount breakdown, we

find out that the property manager can’t figure out what the final ledger amount represents, or has to go back many months examining each ledger entry. This becomes a huge problem in the event of an eviction, when the judge wants to know the breakdown on your notice, and the manager is all confused. Accounting software programs generally will show the balance due, and that balance can represent a myriad of items, some not allowed on a Three-Day Notice. The key is to understand your ledger and not blindly rely upon that final balance when preparing your Three-Day Notice. MODIFYING YOUR LEASE When a prospective resident asks for extensive lease modifications or has the proposed lease reviewed by an attorney, this is a sign of bad things to come. A problem applicant rarely makes a nice resident. If you modify a lease for one person and not another, you could get yourself in Fair Housing hot water, plus whenever you stray from your standard lease, the possibility of making errors later increases dramatically, as you may not remember the change from earlier in the year. We recommend that unless it is a very small, insignificant change to the lease, do not modify your lease to suit the whim of the resident to be. Stand firm and explain to the applicant that your company needs to be consistent, and that your lease is fair. Your lease should be modified only on rare occasions and only with your attorney’s blessing. USED APPLIANCES AND YOUR RESIDENT Your resident just notified you that the refrigerator is on the blink. Trying to save some money, you promptly replace the refrigerator with a used one that is perfectly good. Legal? Probably, but suppose that used refrigerator does not have an ice maker or water dispenser and the prior one did: is this adequate? Look for the answer to this question in next Sunday’s paper. Question: Nine months ago we received a loan modification, but our bank later sold the loan to another lender. We have continued making timely payments, but the new lender won’t recognize the modification and has been sending us threat-

ening letters. We have called and explained, to no avail. What can we do to fix this? — Sally Answer: Banks often sell loans to one another, and each sale can be an adventure for the borrower. The most important thing that you can do is send in your payments on time and document all communication that you

have with your new lender. You should send the bank a copy of your loan modification paperwork by fax or certified mail — and be willing to send it again and again, if necessary. Call often, getting the names of the representatives you speak with and writing down what they tell you.

Always stay calm and polite, no matter how frustrating this experience can be. At the same time, don’t be afraid to be persistent. Also, keep in mind that the problem could be different than what you originally thought. For example, you may think the lender is just ignoring the modifica-

tion, but instead the issue may be that the bank doesn’t have your insurance information and bought you a new policy, which caused your monthly payments to rise. You should be able to get this resolved on your own. But as long as you document everything, your lawyer will have the

tools he or she needs in case it comes to a lawsuit.
