air-conditioning coils can cause the machine to underperform. 2. Refrigerant leaks. Air conditioners work most effectively and efficiently when the refrigerant charge exactly matches the manufacturer’s specifications and is neither undercharged nor overcharged. 3. Drainage problems.

NAHB Promotes Affordable Housing in Lobbying Congress When a builder, remodeler, and housing-related professional joins the Tallahassee Builders Association (TBA), they also become a member of the Florida Home Builders Association (FHBA) and the National Association of Home Builders (NAHB). FHBA lobbies the Florida Legislature on housing issues and NAHB is a strong voice in Washington, working with Congress and the White House to promote affordable housing. NAHB is governed by the 100member Executive Board that includes two prominent TBA members, the father-daughter team of John and Karen Koelemij, owners of Orange State Construction. Both are Presidents of TBA and John was the 1985 President of NAHB and a Past President of FHBA. Recently, Karen Koelemij was in Washington for NAHB’s Legislative Conference, meeting with Florida’s U.S. Senators Marco Rubio and Bill Nelson as well as members of the Florida Congressional delegation on NAHB’s legislative priorities. She was joined by more than 750 builders from across the nation to urge their lawmakers to support policies that will keep the housing recovery moving forward and increase housing opportunities for all Americans. “We are sending a loud and clear message to members of Congress that a strong housing market is critical
to create jobs and boost economic growth,” said Karen Koelemij, whose company specializes in apartments and property management. In 300 individual meetings with their representatives and senators, builders discussed the following key housing issues:
Immigration reform. NAHB called on Congress to enact comprehensive immigration reform that protects the nation’s borders; focuses on the direct employer-employee relationship so that U.S. employers remain accountable only for the identity and work authorization status of their direct employees; and creates an efficient, temporary guest worker program that allows employers to recruit legal immigrant workers when there is a shortage of domestic workers.

window air conditioners have a thermostat sensor behind the control panel, which measures the temperature of air coming into the evaporative coil. If the sensor is knocked out of position, the air conditioner can cycle on and off too often or otherwise behave erratically. Of course, what Hutchinson is too polite to say is that you should have tested the AC well before the start of hot weather. Too often we hope for the best because we think it saves money. So if your air-conditioning is operating just fine and dandy, you might want to make an appointment with your service contractor to check out the heating system before winter blows in. Even if your air-conditioning is doing well, you probably are not enthusiastic about spending the arm and the leg needed to pay for comfort this summer. Owens Corning, the maker of that pink insulation, has these suggestions: » Program your thermostat — Homeowners can save energy and money using a programmable thermostat with the air conditioner to automatically adjust the setting at night or when no one is home. Waiting to turn on the air conditioner when you return home won’t cool your home any faster; it could result in excessive cooling and unnecessary expense. » Shade your windows — Sunny windows make air conditioners work two to three times harder. Reduce air-conditioning costs by closing curtains on the south- and westfacing windows during the day. Window shades, blinds, or drapes will reflect heat away from the house. » Insulate your investment — Properly insulating a home can help keep
it cooler during summer (and warmer in winter) and save homeowners up to $220 annually on energy bills. The attic is the easiest and most affordable place to add insulation to a home. » Weatherize — Air leaks can lead to wasted energy and spending. Weather-stripping will keep cool air in during summer. Insulating areas around air-conditioning ducts in unconditioned spaces, such as attics, crawl spaces and garages, also will save energy and money. Question: I have a barn with metal roofing and siding that is showing signs of color fading. I have no leaks that need to be fixed; it just doesn’t look good. There is not much rust, a little mold growing, and I don't want it to get worse. I also want to change the color to a red. Answer: If it is an old metal roof, it is probably terne, and the ideal choice for coating has always been Tin-O-Lin, which is available from roofing supply companies. I used it for years on my terne gutters, and it worked just fine

Callaway Gardens CEO hopeful despite resort’s slow recovery By Tony Adams

Less than a year after selling 7,000 of its13,000 acres, Callaway Gardens is still working to lure more visitors to the nature-oriented attraction amid a U.S. economy that is slowly rebounding. But Edward Callaway, the chairman and chief executive officer of the resort in Pine Mountain, Ga., conceded this week the first six months of this year have
been worse than expected. That has prompted belt-tightening that includes cutting some jobs and deciding to close the gardens for more than a week in early January. “We spent $2.5 million on capital improvements this year. We thought we would grow our business by that much in the year. We’re not going to,” Callaway said. “We’re getting good growth in social (daily and weekend visitors), but not groups. So I have
the holidays. Those revamped rooms drew rave reviews, so the move was made to rehab them all. “We opened them back up on April 1,” Callaway said. “Our business was off during those three months because we were closed three months.” The executive, grandson of the 60-year-old resort’s founders, Cason J. and Virginia Hand Callaway, and son of Howard “Bo” Callaway, a longtime gardens ex-
trimmed our expenditures to fit our budget.” Much of that money was spent to upgrade the 274-room Mountain Creek Inn off U.S. 27 and adjacent to Callaway Gardens. Florida leads foreclosures, but crisis is easing up By Paul Owers

Florida finished the first half of 2013 with the nation’s highest foreclosure rate, but new cases are on the decline, according to a report released Thursday. From January through June, one in 58 homes across the Sunshine State was facing foreclosure, figures from the RealtyTrac listing firm show. Palm Beach, Broward and Miami-Dade counties posted the highest foreclosure rate among metro areas. One in 43 homes in South Florida was in some stage of distress. In June, the number of properties that received a foreclosure filing in Leon County was 61 percent lower than the previous month and 43 percent lower than the same time last year, RealtyTrac said. Meanwhile, Florida continues to have one of the nation’s longest timelines for repossessing homes. It takes an average of 907 days to foreclose in Florida, RealtyTrac said. Only New York and New Jersey (1,033 days) had longer delays. But while foreclosures remain elevated in Florida, new filings fell 23 percent in June from a year ago, RealtyTrac said. Daren Blomquist, a
spokesman for RealtyTrac, said the bulk of the foreclosure activity in Florida is a result of older cases moving through the various stages of the court system. “Those loans are from the housing bubble and not ones that originated in the last few years,” he said. Irvine, Calif.-based RealtyTrac monitors public records for three types of foreclosure filings: new cases, scheduled auctions and bank repossessions. In June, Florida had a 100-percent increase in the number of auctions, when a judge sets a date for a home to be repossessed. South Florida auctions more than tripled. An auction occurs after the case has been resolved through a trial or a summary judgment ruling. Hoping to reduce the backlog of files, Palm Beach County Chief Judge Peter Blanc earlier this year ordered that older cases be set for trial. Judges in other counties also are trying to move cases along, lawyers say. “Judges are routinely setting the cases for trial on their own, without the plaintiff asking them to do it. That’s a huge difference,” said Jerry Tepps, a foreclosure defense lawyer in Sunrise.
High-tech gadgets monitor seniors’ safety at home WASHINGTON — It could mean no more having to check up on Mom or Dad every morning: Motion sensors on the wall and a monitor under the mattress one day might automatically alert you to early signs of trouble well before an elderly loved one gets sick or suffers a fall. Research is growing with high-tech gadgets that promise new safety nets for seniors determined to live on their own for as long as possible. “It’s insurance in case something should happen,” is how Bob Harrison, 85, describes the unobtrusive monitors being tested in his apartment at the TigerPlace retirement community in Columbia, Mo. Living at home — specialists call it aging in place —iswhatmostpeoplewant for their later years. Americans 40 and older are just as worried about losing their independence later in life as they are about losing their memory, according to a recent survey by the Associated Press-NORC Center for Public Affairs Research. Common-sense steps likegrabbarsinbathrooms and taping down rugs to prevent tripping can make homes safer as seniors deal with chronic illnesses. Technology is the next frontier — and a far cry from those emergency-call buttons seniors sometimes wear to summon help. Already, some companies are offering monitoring packages that place motion sensors on the front door, a favorite chair, even the refrigerator, and then send an alert to a family member if there’s too little activity over a certain period of time. Other gadgets can make pill bottles buzz when it’s time for a dose and text a caregiver if it’s not taken, or to switch off a stove burner that’s left on too long.
Researchers at the University of Missouri aim to go further: Their experiments show that certain automatic monitoring can spot changes — such as restlessness in bed or a drop in daytime activity — that occur 10 days to two weeks before a fall or a trip to the doctor or hospital. “We were blown away that we could actually detect this,” said nursing professor Marilyn Rantz, an aging-in-place specialist who is leading the research. A change in gait, such as starting to take shorter or slower steps, can signal increased risk for a fall. Basic motion sensors can’t detect that. So Rantz’s team
adapted the Microsoft Kinect 3-D camera, developed for video games, to measure subtle changes in walking. The researchers installed the sensor package in apartments at the university-affiliated TigerPlace community and in a Cedar Falls, Iowa, senior complex.On-sitenursesreceived automatic emails about significant changes in residents’ activity. One study found that after a year, residents who agreed to be monitored were functioning better than an unmonitored control group, presumably because nurses intervened sooner at signs of trouble, Rantz said.

Specific timing issues are laid out in Florida Statutes which must be followed to avoid the landlord having to refund the entire security deposit to the tenant, even if the tenant owes the landlord money. Many landlords fail to take the law seriously and are surprised when a tenant leaves owing a substantial amount of money to the landlord, only to demand the full security deposit back from the landlord because the landlord failed to send the notice out in time or get the tenant the balance of the deposit if any back in time. When does the notice have to be sent to the tenant? The required timing of the Notice of Intention to Impose Claim on Security Deposit, hereinafter “Notice”, depends on whether you are making a claim against the deposit or whether you are returning the full deposit to the tenant. Timing of Notice when making a claim If making a claim against the deposit, the Notice must be sent out within 30 days from the date that the tenant vacates the unit and not one day later. Failure to send out this Notice within the 30 days will result in the landlord having to refund the full amount of the security deposit to the tenant, regardless of amount owed to the landlord. The is no excuse for failing to send the Notice out within the 30 day time frame. A number of years ago, the time frame was 15 days. Now it is 30 days. Timing of Notice when returning the full security deposit If you are returning the full security deposit, you do not have to send out the Notice at all! Simply get the money in the mail within 15 days of the date that the tenant vacated the premises. Many apartment communities fail to send the money to the tenant within 15 days due to accounting issues and the time delays in requisitioning the money and getting a check from the corporate office. Unfortunately the judge does not care how your system works. The money must be sent out within 15 days period. Returning a portion of the deposit If you sent the Notice out and you are returning a portion of the deposit, you must return this portion of the deposit within 30 days from the date you sent out the Notice.
Examples: 1. Tenant vacates September 5 and you are not making a claim against the deposit. You must return the deposit by September 20. The Notice need not be used. Simply send the money. 2. Tenant vacates September 5 and you are returning some but not all of the deposit. You must send out the Notice by October 5 and you must return the balance of the deposit within 30 days from the date you sent out the Notice. The Security Deposit Law 83.49 (3)(a)- (3)(c) 83.49 Deposit money or advance rent; duty of landlord and tenant (3)(a) Upon the vacating of the premises for termination of the lease, if the landlord does not intend to impose a claim on the security deposit, the landlord shall have 15 days to return the security deposit together with interest if otherwise required, or the landlord shall have 30 days to give the tenant written notice by certified mail to the tenant’s last known mailing address of his intention to impose a claim on the deposit and the reason for imposing the claim. The notice shall contain a statement in substantially the following form: This is a notice of my intention to impose a claim for damages in the amount of ____________ upon your security deposit, due to ________. It is sent to you as required by S. 83.49(3), Florida Statutes. You are hereby notified that you must object in writing to this deduction from your security deposit within 15 days from the time you receive this notice or I will be authorized to deduct my claim from your security deposit. Your objection must be sent to (landlord’s address). If the landlord fails to give the required notice within the 30 day period, he forfeits his right to impose a claim upon the security deposit. (b) Unless the tenant objects to the imposition of the landlord’s claim or the amount thereof within 15 days after receipt of the landlord’s notice of intention to impose a claim, the landlord may then deduct the amount of his claim and shall remit the balance of the deposit to the tenant within 30 days after the date of the notice of intention to impose a claim for damages. (c) If either party institutes an action in a court of competent jurisdiction to adjudicate his right to the security deposit, the prevailing party is entitled to receive his court costs plus a reasonable fee for his attorney. When you don’t have or want a traditional garden, you can still enjoy homegrown vegetables and herbs, thanks to some alternative ways of planting. Here are two easy ones to try — and you don’t need a yard to use them. Pallet planting This year, McDonald Garden Center in southeastern Virginia introduces its customers to pallet planting. Materials you need include a pallet, enough landscape fabric to line the pallet on both sides, vegetable or flower transplants, 1 cubic foot potting soil and fertilizer. Here’s how to plant a pallet, courtesy McDonald Garden Center. Place the landscape fabric-lined pallet on end and fill with potting soil. Be sure not to pack too full so that the landscape fabric is bulging, but tap the soil down so it levels out, making sure to fill it to the top. Pick out veggies, herbs or flowers in annual packs to use for planting. Veggies, herbs or flowers in cell packs are smaller and easier to work with. Cut the landscape fabric in the shape of an “x” to create a small hole or planting pocket and sprinkle in fertilizer.
Tomatoes are among the easiest plants to grow in straw bales, which are embellished with flowering annuals. The bales also are disease and weed resistant. MCT

Plant the edible or flower in the hole and push any excess soil up around the roots. Space edibles out on each row of the pallet — about 3 inches apart. Finish planting by adding edibles or flowering plants to the top of the pallet. These should be more vertical plants. When watering, make sure the pallet is vertical with the open/top side up and slowly water every two to three days during spring or fall — and daily during summer when soil dries out quickly.

straw bales. Older ones can be composted or recycled. » Earlier planting time because as the new straw decomposes, it releases heat that's good for seedlings and transplants. Poly tent covers are easy to fashion to protect crops from night temperatures that drop too low. Karsten’s book features dozens of graphics and fullcolor photographs that show how to arrange straw bales — five to 20 bales — into singlerow or intricate-style gardens that support the growing needs of diverse crops, including peanuts, cabbage, strawberries, tomatoes, carrots, beets, radishes, potatoes and lettuce. He also shares how to condition the bales over 10-12 days, using water and fertilizer so the bale center decomposes to create the ideal environment for seeds and plants. Planting mixes can be used directly on top of the bales to grow cool-season crops such as peas, beans and lettuces; trellising wire-type structures can also be used to support vining crops. The 140-page book, which includes plant profiles for the best crops, is $20. “Straw bale gardens are as rewarding and bountiful as they are easy and efficient to grow," Karsten says.

Question: My partner and I are looking to buy our first house together, but Florida doesn’t recognize our marriage. Does the recent Supreme Court decision help us in terms of owning real estate? – Steve Answer: Not yet. It’s likely to be a while before the high court’s marriage ruling trickles down to real estate law. Typically, when a married couple buys a home, they do so as “tenants by the entireties,” which is a legal status of ownership that gives the spouses certain privileges. For example, when one spouse dies, the other automatically owns the property alone without any further action. While same-sex couples aren’t allowed to own property this way in most jurisdictions, including Florida, a similar bundle of rights can be created. I have long advised that unmarried couples buying property together enter into an agreement regarding the management of the house. That pact also should specify what happens to the home if the relationship sours. Same-sex couples should follow this advice as well. They can set up a trust agreement for the ownership of the house, and the details of the agreement can help decide what happens in the event of a split or death of a partner. Certain types of trusts can even provide for protection from creditors, if that’s an issue for you. So while the simplicity of tenants by the entireties ownership structure is not yet available to most same-sex couples, proper planning can give them the same legal protections. Gary M.
