one? The roofer stated that he would try running the water hose on the roof, however, we had enough rain, so he can’t seem to get a good day for it. –Desperately seeking dryness Answer: You may think what you see is the source of the leak, but because water always flows to its lowest point, it may

be originating someplace else. If you cannot get up on the roof to check things out yourself, and this problem persists, you have a couple of options. One is to hire another roofer to check the first one’s work. The danger is, of course, that the second roofer might pan the first

When Hiring a Remodeler, It Helps to Speak the Language Each year, hundreds of Tallahasseearea homeowners make the decision to remodel their residence. In many cases, those remodeling jobs are handled by the professional remodelers in the Tallahassee Builders Association (TBA), who continually sharpen their skills through the education and networking offered by TBA’s Remodelers Council. Whether it’s a small cosmetic remodel such as replacing bathroom fixtures, or a major down-to-the-wall-studs overhaul of your kitchen or adding new space to your home, understanding the terminology your professional remodeler is using can be very helpful to ensure you get the finished project you want. As you interview potential contractors, this glossary of common terms used by builders and remodelers will help you understand the language of your remodeling project – help you avoid miscommunication with your contractor. Allowance: A specific dollar amount allocated by a contractor for specified items in a contract for which the brand, model number, color, size or other details are not yet known. Bid: A proposal to work for a certain amount of money, based on plans and specifications for the project. Building Permit: A document issued by a governing authority, such as a city or county building department, granting permission to undertake a construction project. Call-back: An informal term for a return visit by the contractor to repair or replace items the home owner has found to be

unsatisfactory or that require service under the warranty. Certified Aging-in-Place Specialist (CAPS): CAPS professionals have learned strategies and techniques to meet the home modification needs of home owners who want to continue living in their homes safely, independently and comfortably regardless of age or ability level. CAPS graduates pledge to uphold a code of ethics and are required to maintain their designation by attending education programs and participating in community service. Change Order: This is written authorization to the contractor to make a change or addition to the work described in the original contract. The change order should reflect any changes in cost. Cost-plus Contract: A contract between a contractor and home owner that is based on the accrued cost of labor and materials plus a percentage for profit and overhead – also known as a time-and-materials contract. Draw: A designated payment that is “drawn” from the total project budget to pay for services completed to date. A draw schedule is typically established in the contract. Lien Release: A document that voids the legal right of a contractor, subcontractor or supplier to place a lien against your property. A lien release assures you that the remodeler has paid subcontractors and suppliers in full for labor and materials. Mechanic’s Lien: A lien obtained by an unpaid subcontractor or supplier through the courts. When enforced, real property – such as your home – can be sold to pay the

subcontractor or supplier. If a subcontractor or supplier signed a lien release, then this lien cannot be enforced. Plans and Specifications: These are drawings for the project, and a detailed list or description of the known products, materials, quantities and finishes to be used. Punch List: A list of work items to be completed or corrected by the contractor, typically near or at the end of a project. Subcontractor: A person or company hired directly by the contractor to perform specialized work at the job site – sometimes referred to as a trade contractor. The second is what former colleague Dawn Fallik did when the source of a leak in a third-floor front wall of her rowhouse eluded everyone, and the cost of repairs and diagnostics reached $5,000 — but to no avail. A mason suggested an inspector who uses infrared and moisture sensors to pinpoint sources of such leaks — in Fallik’s case, a bad pointing job. The homeowner uses the information to hire a contractor to make repairs. Smelly dishwasher sources This suggestion from reader Joe Lucie: “Everybody knows how the dishwasher works, but no one reads the manual when there is a problem,” he says. “I have never had problems with any smells; maybe it’s because we rinse off the dishes before putting them in the washer. “Stress to your readers how important it is to keep the manual and read it.” Contrary opinions are welcome. Q: Is it legally OK to keep a snake in a cage in a rental property in Chicago? I have a tenant who wants to keep a corn snake. I am afraid that if it gets loose, it will damage property, or even bite little kids. I made it clear in a lease that if there’s any danger, or if something happens, then it is the tenant’s full responsibility. The tenant argues that she has a kid, and she knows her full responsibility. What is your suggestion? A: While the Chicago Herpetological Society website notes that one Illinois municipality pro-

hibits keeping snakes in residential properties, I can find no reference to any law in Chicago or Cook County, Ill., that says your tenant cannot keep one. My kinfolk in Connecticut have a pet snake (feeds on frozen mice), and two years ago on St. Francis Day, one of the choirboys brought a snake to church, wrapped around his neck until the blessing was given. Pythons and boas are banned in a lot of places because they are dangerous, but this one isn’t, I’m told. Corn snakes, according to a number of Internet sites that appear reliable, tend to be docile, don’t bite, and don’t get too long. I imagine if it ever got loose in your building, your other tenants might be a bit spooked. If you have spelled out liability and responsibility in the lease, that should be it. Perhaps you should have asked for a bigger damage deposit.

The answers may lie in your home, where common household items such as coffee grounds or old pie tins can become easy, eco-friendly tools to give your garden a boost without breaking the bank. Turn old boots or shoes into planters, or reuse packing peanuts by laying

them at the bottom of large flower pots to aid in drainage and make for lighter lifting, suggests Stacy Tornio, editor of Birds & Blooms magazine. “You can take anything you have and upcycle it,” she says. Some simple, easy ways to repurpose household items for a bargain backyard:

THE SKIPPING TENANT

by Harry A. Heist, Attorney at Law Tenants are “skipping” at a record rate. Skipping of course is the common name given to the act of simply walking out on a lease. The lease is signed, the tenants move in, live in the unit for a while, and then for whatever reason, decide to pack up and move. Can you stop them? Of course not. Just like you cannot force a person to pay the rent or prevent them from moving in unauthorized occupants or getting those 5 pit bulls, a tenant who is desirous of leaving will do so. It is that simple. Since the tenant has decided to leave and does, you are now faced with the dilemma of an empty unit and rent owed to you. What can you do? Suppose you are managing a unit for another. The property owner who is often out of state is baffled and cannot understand how this can be. Often we hear them say, “But they have a lease!” or, “Why did we even have a lease? It is worth nothing”. What do you tell this angry and baffled property owner? How do you handle it when it happens to you? This article will examine some of the harsh realities of the tenant “skip” and how you can deal with the problem. Notice I said, “deal with the problem”, not solve the problem. If anyone knows how to solve the problem of the tenant skip, you call me right away! This article will examine the three simple paths you can take when a tenant skips out on you. Sue the Tenant When a tenant skips before the end of the lease term, the tenant will owe rent until the unit is rerented or until the end of the lease, whichever occurs first. This statement assumes that no other document is in place, or the tenant has not signed an early termination addendum which may liquidate the amount owed. What does the tenant owe? You will not know until the unit is re-rented or the lease expiration date. Now the big question: should you sue the tenant? In most cases we will advise you to do a careful cost/benefit and risk analysis when deciding whether to sue the tenant. Before you can even think about suing, you must know where the tenant is, so he can be served with the lawsuit. In many skips, the tenant disappears and cannot be found. If you cannot find him, you cannot sue him. a. Cost: Unless you can find an attorney who will file a lawsuit on a contingency basis where you pay nothing unless or until you win, using an attorney to file a lawsuit is often cost prohibitive. Many landlords are under the impression that the tenant will be responsible for their attorney’s fees and costs, and this is true in most cases, but just because you “win” in court does not mean you will collect a dime. Most attorneys will not take a case like this on a contingency basis. b. Benefit: By suing the tenant you may be able to get a judgment against the tenant, allowing you to lien any real property the tenant owns, and also may be used in attempting to garnish wages, another expensive, cumbersome process full of exemptions. Will you collect your money even if you win? Probably not. People who skip do not care much about getting sued, because if they did, they would not have skipped in the first place. They are usually what we call “judgment proof”. c. Risk: The risk involved in filing a lawsuit against a tenant may come as a real surprise. Why

would there be risk? The tenant owes you money after all. The risk arises when the tenant claims there was a “legitimate reason” why she skipped out. She may claim you failed to maintain the property, felt unsafe, was told she could leave early, you name it. There are a thousand reasons that a tenant who is being sued can come up with to justify why she broke the lease, and the judge in the case might believe the early departure was justified. If the judge finds for the tenant, YOU will have to pay the tenant’s attorney’s fees PLUS your attorney’s fees, if you hired a lawyer to fight the case. If the property owner has a lot of time on his hands and wants to file a small claims case without a lawyer, there is probably nothing wrong in giving it a try, UNLESS an attorney pops into the picture and defends the tenant. If you are managing the property and the owner asks you to do it, just say NO. Property management agents should not be acting as the attorney for the owner. Settle with the Tenant Once you know how much the tenant owes, if you are able to get in touch with the tenant, writing a demand letter or having your lawyer write a demand letter at minimal cost is not a bad idea. A demand letter may open up some dialogue and result in an offer by the tenant to pay all, something or possibly set up a payment plan. Settlement is not a bad word. It is often the smart thing to do. Your attorney can provide you with the proper form to use when settling with the tenant, as everything should be in writing. Forget about the whole thing and move on Your final option is to do nothing. Direct your energies into getting the unit rerented. You can always decide to sue at a later time, and you have up to 5 years to do this. Conclusion: If you are a seasoned property manager or landlord, you probably understand everything you have just read. The problem is your out of state owners who just doesn’t understand how Florida law works, and that Florida is what is known as a “debtor” state. If you are managing property for them, you will often get unreasonable demands about collecting the money. In many states, the creditor has significantly greater rights in pursuing the debtor. Florida is known for its lenient laws as they pertain to collecting money from a debtor. There are head of household exemptions, personal property exemptions and although not unique to Florida, bankruptcy protection. Does this mean that it is impossible to collect a debt? Absolutely not. In many cases people will pay. Most cases? Probably not. The best approach is to have your lawyer take a look at your the situation or send your property owner to the lawyer for a quick look, and have the lawyer give the advice necessary for you or the owner to make an informed decision. Exercise care in what lawyer you may send the owner to as some lawyers may not be completely honest and will choose to take a case AND you or your owner’s money knowing full well that the chances of collection are slim.

Tornio says she’s also seen people repurpose utensils as garden markers and borders for flower beds. Even something as innocuous as old nylons can be reused in the backyard to tie up floppy plants or line the bottom of pots so water can get through but dirt cannot. Packing peanuts are also a good drainage medium, and lighten the load when large pots need to be moved around, Tornio says.

Whimsical decor Household items can also add a touch of whimsy to garden decor. Use an old musical instrument like a tuba to build a water fountain, or create a “bottle garden” by placing empty soda bottles over tree branches with your kids, says Sara JenkinsSutton, vice president of Chicago-based garden and floral design firm Topiarius Urban Garden. “When your cheese grater starts to turn rusty, turn it over, hang it on a deck and fill it with flowers, plants or outdoor chalk,” she suggests. Scatter vintage chairs or old farm equipment throughout your garden to add height and depth.

Wasabi coleus takes garden greenery to another level Electric lime makes it pop By Norman Winter McClatchy-Tribune News Service

Lime green continues to be one of the hottest colors in the garden, and a coleus, Wasabi, provides it like few others. Electric lime has always been my favorite, but I find myself daily pinching out flowers. But Wasabi, with its showy serrated leaves, has not had its first bloom. While lime green or chartreuse is a color that shouts “look at me,” it also somehow makes all other colors look stunning. Foliage plants like Wasabi can also serve as a transition color, tying the garden together when you might otherwise have a clashing of colors. It is like a mediator between rivals, bring tranquility to the garden. I am not the only one raving about Wasabi. In trial grounds, it has garnered a perfect score since the last week in May. As it was getting established in early May, it was scoring better than 3 out of 5. Since then: perfect 5 out of 5. Wasabi is suggested to reach 30 inches in height and 28 inches wide. That may be achievable in the North, but it grows like it’s

on steroids in the South, where it can be allowed to grow larger. It offers you the possibility of growing an incredible lime green hedge. Wasabi is easy-togrow, low-maintenance and almost foolproof when grown in welldrained soil and watered through droughty periods. In Columbus, we have already surpassed our yearly total rainfall including some torrential downpours of 5.7 inches in less than two hours. The Wasabi was just extraordinary through the deluge. Since we grow coleus for its boldly colored foliage, the fact that Wasabi has had no blooms will make every gardener and landscape professional ecstatic. This trait makes it a perfect partner for another coleus from the same company, Redhead. A combination of Redhead, with its large dark red leaves, and the lime green Wasabi might just be all you need to win Yard of the Month in your neighborhood. Our careful bed preparation, with loose welldraining organic matter, allowed us to come through such record precipitation. If you have tight, heavy clay, then work on improving your soil condition, too. Ideally,

at least one-third of the final soil mix should be some type of organic material. To accomplish this, spread 2 to 4 inches of organic matter and about 2 pounds of fertilizer per 100 square feet. My favorite fertilizer for coleus is a 12-6-6. Till this in and you’ll be ready to plant. This pre-plant

Question: I have been thinking about getting a reverse mortgage for my home, but I heard that the rules have changed recently. What are the new rules? – Arthur Answer: A reverse mortgage is a loan for people age 62 or older. It gives you money from the equity in your home and does not require repayment of the loan until you move, sell the property or pass away. The homeowner is still responsible for property taxes and insurance. Congress recently passed legislation altering the guidelines for the Federal Housing Administration reverse mortgage program, which accounts for most reverse mortgages. The

changes will make it harder to qualify for a reverse mortgage, but will provide homeowners more protection if they get one. Previously, borrowers could qualify with no financial assessment, but now senior citizens will need to show they can pay for their taxes and insurance. If the lender feels the borrower is a financial risk, it could still give the loan, but could hold aside a cushion to pay for the taxes and insurance. Also, the program now will set limits on how much cash the borrowers can receive at closing, leaving the rest of the proceeds available later. In the past, some married couples would leave one spouse off the reverse mortgage to quali-

fy for a higher amount. When that spouse passed away, the surviving spouse would need to either pay the loan in full or face foreclosure. The new rules will require both spouses to be on the loan to avoid this situation, but the change will cause decreased borrowing power for the couple. The changes will begin rolling out the end of September and over the following months, so you may want to start the process now.

Walls that tell a story Use your own memories to create ‘salon’ art

Those beautiful summer vacation photos are in a cardboard box. Somewhere. The souvenirs you picked up on that overseas trip years ago are jumbled in a drawer. Your collection of (fill in the blank) is in the kitchen cupboard. Why not showcase these personal treasures and create great art at the same time? One clever way to do it is to mount shelves or frames on a wall and fill them with whatever pleases you. Decorators call it a salon wall, and it has origins in 17th-century Paris, when the Royal Academy held exhibitions, or “salons,” to showcase student work. Their art would be mounted in a closely knit configuration. A visually balanced arrangement is what you’re after, says New York interior designer Elaine Griffin. “It’s the eclecticism — photos with found objects, for example — that makes it beautiful and stylish,” she says. “Every element should speak to you or tell you a story.” To create a salon wall, plan carefully. Lay out the arrangement on the floor first, and then transfer it from the floor to the wall, piece by piece. “Start at the center of the composition and work your way outward, a little bit in each direction, left, right, up, down,” Griffin says. Spacing doesn’t need to be the same around all objects, but it can look better when it’s equal around an individual element. Use a geometric shape — square, circle, triangle or diamond — as a loose basis for your ar-

rangement. Create an axis in the center of the wall, a focal point from which all the elements radiate, Griffin advises. Laying the idea out on a template — a piece of art paper on which you draw the shapes — will help consolidate the finished look. “It’s nice if you have the entire collection for a wall ready to hang at once, but you don’t have to — you can install as you collect,” Griffin says. David Kassel, a collage artist in New York City, creates salon walls for designers like Bunny Williams, Jamie Drake and Jeffrey Bilhuber. Through his company, ILevel, he’ll put up anything a client gives him, but also offers his own collections: exotic turtle shells, vintage medicine bottles, colorful plates, even a framed set of 1940s Rorschach ink blots. “For small objects you can use shadow boxes. Sconces are a wonderful way to display bottles, vases, rocks or any three dimensional objects. You can choose from simple contemporary wall wedges or more traditional options like carved, goldleaf sconces,” Kassel says. If you want to turn your wall into a photo gallery, hanging the pictures without frames creates a clean look that lets the pictures pop, says Jeff Southard, a spokesman for Collagewall.com, which helps clients create photo walls. Avoid hanging several versions of the same picture, he says; instead, use a variety of close-ups, action shots, etc. “Given the choice between a perfect bland photo and a flawed, energetic one, go for the lively one,” Southard says. “Don’t be afraid to ex-

hibit your passion. Cars, kids, architecture — even good food. When guests come over, you can talk about something you love.” San Francisco photographer Jason Rodman, for example, mounted a series of black-and-white images of the city on his wall. In Seattle, Sara Shrader’s pride in her two baseball-loving sons led her to take photos of their various team caps over the years. She created a collage wall that included pictures of the boys in action. A company like Picturewall.com provides templates for rectangular and stairway displays, and sends a kit that includes wood frames and acid-free mats. You just drop in your photos. Kassel says such displays should continue to evolve. “Families grow, important events continue to happen, collections change over time,” he says. “A great salon wall is never finished.”
