I suppose I should look upon fruit flies as old friends. Our formal introduction took place in junior high school, in science lab. Now they visit regularly, every late summer and early fall. Still, for old friends, they can be bothersome. No, they don’t bite, but I’d rather do without their flitting around any ripening fruit in the kitchen. As it turns out, fruit flies don’t really turn up this time of year; they just make their presence known. All summer they’ve been hanging around outdoors, attracted there, as they are indoors, to ripe and overripe fruits. Cooling temperatures drive them indoors. An abundance of ripe and overripe apples, tomatoes, pears and other fruit, much of it now brought indoors, provides further enticement for their move. It’s actually fruit flies’ larvae — small, white maggots — that are feed-

ing on the fruits. After feasting for five or six days, larvae are transformed into the all-too-familiar flies. The females do more than just flit around for the few days they are alive; they fly up to six miles and keep busy laying eggs — up to 2,000 of them. The eggs hatch into maggots, which feed, become adults. To control fruit flies, start by regularly discarding overripe fruit. It also helps to clean kitchen sink drains, where bits of fruits or their juices may lodge.

Rock on Fall decor trend set in stone

Along with grainy woods, metallics and other textural elements, rock and mineral-themed decor is part of a fall trend toward nature and natural elements. In many cases, real rocks and minerals are integrated into the decorative items. Los Angeles interior and product designer Hilary Thomas says she responds to the divergent qualities of primitiveness and sophistication in rocks and minerals. “I find that using pieces like petrified wood and malachite helps a space look more collected and layered,” she says. And the range of colors — the bright agates, the neutrals — is fun to play with. “You can be colorshy and still tie a room together or make a big statement with a finial,” she says. Thomas creates lamp finials out of slivers of malachite, howlite and agate, as well as unusual specimens like inky iridescent labradorite, creamy blue-tinged chrysophase and petrified wood. The colors range from intense purple, turquoise and cranberry to light sunny yellow, snowy white and a range of striated hues. The Chinese view jade as a protective stone, and it features prominently in feng shui, the ancient art of harmonizing individuals with their environment. The Vikings carried calcite, believing it aided in navigation. Na-

tive Americans considered chalcedony — the family of minerals that includes jasper, onyx and agate — capable of imparting strength and courage. “I have a client who keeps a pyramid of lapis lazuli under her bed to ward off bad vibrations,” says Toronto-based mineral and bead dealer David McDonald. Examples of Brazilian agate and onyx cut into bookends can be found at TheRockShed.com. Some have the crystalline characteristics of geodes, while others come in vibrant pink, teal and red hues. The cool-season landscape offers wonderful opportunities to keep the edible landscape going, and for the culinary artist in as well as the Monet designer outdoors. In the last few years the edible landscape has skyrocketed in popularity, and with good reason — it is fun, tasty and may save you a buck, too. But to be honest it been mostly reserved for the long warm season and perhaps an afterthought for the cool season ahead. With cool weather just starting, unless you live in South Dakota, now is the time to consider your options, and the leafy crops are certainly the place to start. If you think I am talking about kale and cabbage, I am not. Those are certainly high on the list and offer a lot of cold hardiness. Colorful foliage for the flower border or mixed container doesn’t have to be relegated to kale and cabbage especially when you have a variety like Red Fire. One of the most beautiful partnerships I have seen in recent years

combined Red Fire with the delightfully fragrant Sapphire Gem violas. Of course, violas and pansies are also edible, though I also enjoy their color and aroma. With a companion planting like this, you will have that ever-present temptation to go out and pick some leaves for a fresh salad, or topper for tasty burgers. Red Fire is slow to bolt and will keep you harvesting those glorious ruffled leaves. Feel free to harvest young outer leaves once or twice a week depending on rate of growth. In addition to Red Fire don’t forget other great re-leafed selections like Red Sails, Galactic Red Leaf and of course the plain old green-leafed types like Black Seeded Simpson are showy as well. In the South, however, mustard greens reign supreme. The leaves of varieties like Red Giant offer deep burgundy leaves bringing untold beauty to the edible landscape. While almost any color will work as a partner, the warm colors of pansies with orange, yellow or salmon, provide a companionship of rare coolseason beauty. The Ultima Apricot Salmon pansy is one such selection. This partner-

All too often, Realtors and the buyers we work with overlook the nearby properties for sale in western Jefferson County, simply due to the assumption that an out-ofcounty commute is just too far. It’s not. West Jefferson County, which shares a long north/ south border with eastern Leon County, is just as accessible to Tallahassee’s hot spots as most northeast Leon County subdivisions. There are three east/ west thoroughfares to choose from. The widened and improved U.S. Hwy 90/Mahan Drive leads straight to Capital Circle Northeast and to downtown. Owners might have to pick least-bad option Question: I live in Illinois and own an investment property in Pembroke Pines that’s at least $130,000 underwater. I know that I can’t refinance and don’t have a hardship allowing me to get a loan modification. Any suggestions? – Valerie Q: I own a condo through my divorce. I rent it out, but it’s worth less than I owe. I have spoken to dozens of lenders and no one will refinance the mortgage. My credit is perfect and I have worked hard for 35 years to get it that way. What can I do? – Sandi Answer: Unfortunately, there isn’t always a great solution to every problem. Sometimes people just have to choose the option that will do them the least harm. Lenders call this “loss mitigation.” Because neither of your situations seems to have a clean exit, you will need to weigh your priorities and choose the path that will do you the least harm. Look at whether your rental income covers most or all of your monthly expenses. If it does, it may make sense to hang in there as property values rise in the long term. Also, think about how important your credit score really is to you. If you won’t need a loan for the next few years, it may not really be that important to have a top-notch credit score right now, at least when compared to your dwindling savings account. Now that you have checked so many lenders for a refinance, take a deep breath and keep trying to find one that will offer you a refinancing. For that matter, go back to some of the lenders you spoke with before, be-

cause new programs are being created all the time. Even if the lender told you no six months ago, it may say yes now. The most important thing is to look at all of your options objectively and pick the one that is the least bad for you — and then don’t give up until you get it done.

Getting bedroom glamour on a budget

Your tenant owes you 3 months’ rent and is currently under eviction. The air-conditioning breaks, and the tenant places a work order. The eviction is almost completed. Must you make the repair? The answer is a simple “yes”. The tenant has three unauthorized occupants living in your apartment, and his garbage disposal is broken. Do you need to get it fixed? You bet. The rent delinquency, noncompliance or eviction status has nothing to do with your obligations under the lease and Florida law to maintain the premises and make necessary repairs. No matter how angry you are at the tenant or how delinquent the tenant may be in rent or other monetary obligations, the landlord must proceed as if the tenant is completely current and not in violation of any of the lease terms or under eviction. The Landlord’s Obligations The landlord’s obligations are many. Florida Law Section 83.51 clearly states the landlord’s obligations, and they must be followed unless specifically excluded in the lease agreement. The lease agreement may add further obligations on the landlord, and finally there is the common law implied warranty of habitability. 1. The Landlord’s Obligations under the law 83.51 Landlord’s obligation to maintain premises. (annotated) (1) The landlord at all times during the tenancy shall: As you can see, there is no exception here for evictions or when the tenant is in default. The landlord’s obligations are “at all times during the tenancy” (a)Comply with the requirements of applicable building, housing, and health codes; or All state and local building housing and health codes are included here. These can be obtained by the landlord ahead of time, or you can wait until you get an inspection by the DBPR if you are an apartment community, or local code enforcement office for single family homes, and you will surely find out! (b) Where there are no applicable building, housing or health codes, maintain the roofs, windows, screens, doors, floors, steps, porches, exterior walls, foundations, and all other structural components in good repair and capable of resisting normal forces and loads and the plumbing in reasonable working condition”¦ The landlord’s obligations under this subsection may be altered or modified in writing with respect to a single-family home or duplex. The above requirements apply to all housing. In the event you are renting out a single family home or duplex, you may shift these obligations to the tenant, but this must be done clearly in the lease agreement or addenda. For example, a single-family landlord or duplex owner or manager may wish to make the tenant responsible for plumbing issues, and this would be allowed. (2)(a) Unless otherwise agreed in writing, in addition to the requirements of subsection (1), the landlord of a dwelling unit other than a single-family home or duplex shall, at all times during the tenancy, make reasonable provisions for: This wording is a bit confusing, but the following obligations apply to apartment communities but do not apply to single family homes or duplexes IF these obligations are placed on the tenant by the lease agreement or addenda. 1. The extermination of rats, mice, roaches, ants, wood-destroying organisms, and bedbugs”¦ 2. Locks and keys. This does not require that the landlord re-key after each move-out, but we recommend it. 3. The clean and safe condition of common areas. This is a very serious obligation, especially in light of the “safe condition” requirement. 4. Garbage removal and outside receptacles therefore. 5. Functioning facilities for heat during winter, running water, and hot water.

Note that air conditioning is not mentioned here. This is an example in which the lease will govern and/ or if there is air conditioning provided, the landlord must keep it working. Also, many local building codes do contain provisions requiring central air conditioning or screens on windows. (b) Unless otherwise agreed in writing, at the commencement of the tenancy of a single-family home or duplex, the landlord shall install working smoke detection devices. As used in this paragraph, the term “smoke detection device” means an electrical or battery operated device which detects visible or invisible particles of combustion and which is listed by Underwriters Laboratories, Inc., Factory Mutual Laboratories, Inc. or any other nationally recognized testing laboratory using nationally accepted testing standards. (4) The landlord is not responsible to the tenant under this section for conditions created or caused by the negligent or wrongful act or omission of the tenant, a member of his family, or other person on the premises with his consent. In the event a tenant intentionally or negligently breaks or damages something that would normally be the landlord’s obligation, the landlord does not need to take action. However, the problem is proving the tenant’s actions or negligence. Always document and photograph a repair after it is completed, as some tenants will intentionally break something again in an attempt to withhold rent. Common repair requests Some common requests by a tenant during an eviction would be items such as pest infestation problems, plumbing problems, garbage disposal repair, water heater repair, and quite often, airconditioner repair. We recommend that unless you are dealing with a situation in a single family home or duplex in which these obligations may be shifted to the tenant by the lease or addenda, the items are dealt with immediately, just as you would for any other tenant. The property manager or landlord must completely put out of his or her mind the fact that the tenant may be delinquent or under eviction. 2. The landlord’s obligations under the lease The landlord may have further obligations to the tenant for repairs or maintenance under the terms of the lease. We always recommend shifting as much of this as practical, but there will be many situations where the landlord is contractually liable to maintain or repair something on the premises, or this liability is implied. An example of this might be a hot tub or pool. While we doubt that either of these are a necessity of life, if they exist on the premises and are not excluded from the landlord’s obligations, these items would need to be fixed and put in working condition just like any other item, regardless of the tenant’s delinquent rent or eviction status. The consequences of not making a repair The landlord may have filed a typical eviction for nonpayment of rent. During the eviction, the tenant requests a maintenance issue be attended to. The landlord refuses to deal with the problem, and a hearing is set by the court. Even though the landlord’s failure to make a repair after an eviction action is filed or after the tenant is delinquent should not become a part of the testimony put forth in an eviction trial, this type of thing invariably will come out in court, causing the judge to possibly not look kindly on the landlord. The landlord may be placed in a position in which he or she will have to explain to the judge why something that was indeed the landlord’s obligation was not fixed. If the judge is not satisfied with this reason, the sympathy factor for the tenant increases dramatically, and if the tenant had other repair or maintenance issues prior to the eviction which he or she is using as an eviction defense as the reason for rent withholding, the landlord will definitely not look good. Once you pay the rent, I will make the repair! Unfortunately, we hear that landlords say this to their tenants on occasion. This is probably one of the worst things you can say to a tenant, and if a judge knew you did, you would be in some hot water in court. This is clearly not allowed under Florida law. The dangerous, threatening or belligerent tenant A tenant under eviction or delinquent in rent may be a danger to the landlord. Tempers may flare during a repair which could result in a serious altercation involving injury or even death. If necessary, retain the services of the police when going to the rental premises if you feel in any way that you are in danger, and refrain from discussing the eviction or delinquency at all costs.
