This problem requires the assistance of the “Your Place” community. Please send in your ideas. Question: For at least eight months there has been a subtle, rhythmic hum that is constantly audible throughout my house that everyone
hears. The noise is always the same, with no change in the pitch or pattern. We turned off the main breaker to the house to determine if it might be coming from one of our home systems, and it was still audible. We can also hear it when standing outside of my house. We even invited a neighbor to help us lo-
cate the source. He could hear the noise, but also was unable to pinpoint the source. It’s definitely not the neighbors’ central airconditioning systems. A neighbor directly across the street from my house installed a geothermal heating system and was wondering if that could be the source. Do geother-

Old Homes Can Be Green, Too!
This old house is my home! But sometimes I wonder about its efficiency compared to the new green-certified homes being built by our best builders today. Must I leave this old home, with all its wonderful memories, in order to join the ranks of today’s energy-conscious home owner? Read on. If you are willing to make the effort, there are many things you can do to lower your utility bill and reduce your energy usage. Simple, no-cost changes include turning off lights when you leave a room; turning off fans in empty rooms; unplugging Rae Roeder, your chargers when your device is charged or, if you have multiple chargers, CRS, ePRO, GRI, investing in a power strip that is only on when you need it. Low-cost changes SFR, SRES such as placing foam insulators behind your outlets to decrease conditioned air Rae Roeder Realty leakage save more than you think. Increasing the insulation in your attic is a major energy saver and you may get assistance from your utility company. When a major appliance needs replacement, get one that is Energy Star rated. When you repaint, chose low-VOC (volatile organic compounds) paints. The lists seem endless. The Florida Green Building Coalition (FGBC) has developed The FGBC Florida Green Home Retrofit Guidelines to assist owners of existing homes remake them in a more energy-efficient and healthy style. Of course, the guidelines span 50-100 pages and you can be intimidated before you begin. Remember, as in all guidelines manuals, they are there for reference and to answer your questions. Go instead to www.floridagreenbuilding.org/consumer-help and select the Green Home Retrofit Checklist where you can document your energy use on a monthly basis. Compare your home to the “average” home of your size, and read some of the useful habits you can develop. You are provided with checklists for energy, water use, health concerns, materials, and sustainability. With these tips in mind, any remake should be a money saver in the long term. Fewer U.S. homes repossessed in Oct. By Alex Veiga Associated Press
LOS ANGELES — Fewer U.S. homes are completing the foreclosure process and ending up repossessed by banks because investors are increasingly buying up properties when they go on sale at public auction. The trend reflects a growing appetite among investors for buying homes before they exit the foreclosure process and end up back on the market. Some 37,775 homes nationwide completed the foreclosure process in October. That’s down 1 percent from the previous month and a decline of 29 percent versus October last year, foreclosure listing firm RealtyTrac Inc. said Thursday. At the front end of the process, lenders initiated
foreclosure action against 58,939 homes last month, an increase of 2 percent from September, but a drop of 34 percent from October 2012, the firm said. Foreclosure starts have been down nationally on an annual basis for15 months in a row, while home repossessions have fallen annually for 11 consecutive months.

Designers offer 10 top kitchen remodeling trends

When Michelle and Jon Christy bought their 1980s-era home in North Tustin, much of the residence already was remodeled. Except for the kitchen. It was dated. And it was olive green. “I wanted to lighten up the kitchen, because the kitchen had been dark,” Michelle Christy said. “I thought white cabinets would give it a nice, clean, crisp look.”
Nearly half of new homeowners undertaking a home improvement project within three months of buying a residence set their sights on a kitchen overhaul, according to a report from the National Association of Realtors. The array of choices for big-ticket appliances to even a simple backsplash can be daunting. But people should consider what will appeal to a broad range of future homebuyers. Even a minor remodel can recoup most of the cost when you resell, according to Remodeling magazine’s 2013 Cost vs. Value report. “You may have a hard time selling your house if

leased by Houzz, a popular home design and remodeling website based in Palo Alto. The site’s Fall Kitchen Trends study gathered responses from 7,812 homeowners either planning renovations or in the midst of them. Earlier this year, the National Kitchen & Bath Association came out with survey results from 300 of its memberdesigners. The list below includes seven trends from the Houzz survey followed by three from the association. Kitchen designers also weighed in. 1. Chef’s stoves. Understanding The New Early Termination Law

Before the law change Before the recent change to Florida Statute 83.595, when a tenant chose to break a lease by vacating before the end of the lease, commonly called “skipping” or vacating early, the landlord was only allowed to charge the tenant rent through the earlier of the lease expiration date or the date a replacement tenant took occupancy. In addition, many companies also charged a Termination Fee, Termination Penalty or Liquidated Damages charge, BUT in a major Florida class action lawsuit, the judge in that particular case ruled that these various practices were unlawful and inconsistent with Florida Statute 83.595. The New Law A common misconception is that under the new law, when a tenant vacates early, you can NOW charge the tenant a Liquidated Damages or Early Termination Fee. This is only partially correct, and it is crucial that you understand the law. Under the new law, you can give the tenant a CHOICE to either owe a flat fee “Liquidated Damages/Early Termination Fee” OR owe rent until the unit is re-rented. The TENANT makes the choice, NOT you. If you do not want to give the tenant this choice, you will not use the Addendum, and you can ONLY charge the tenant your rent loss, as has been the law. Suppose you want to hold the tenant to all the rent due under the lease? If this is what you want to do, then simply do it. The law still allows you to do this. You will not give tenants a choice in the matter, and if a particular tenant vacates early, you will charge rent as it becomes due under the terms of the lease until the unit is re-rented. In a soft market, when it may take a while to re-rent a unit, this is your best bet; you really do not need to read any further, AND you will NOT use the Addendum. Suppose you want to charge the tenant a “Liquidated Damages/Early Termination Fee” when they vacate early? You CAN if and only if 2 things occur: A. You present the attached Addendum to the Tenant AT THE TIME OF LEASE SIGNING AND B. The tenant picks Choice #1 What happens if the tenant picks Choice #1? You can charge the tenant a flat “Liquidated Damages/Early Termination Fee” of a maximum of 2 months’ rent when they vacate early and NOTHING more other than rent, and charges they may owe at the time of vacating early. The tenant may or not pay it, but if not paid, this 2 months’ rent can be sent to collections. What happens if the tenant picks Choice #2? You can charge the tenant rent that he owes at the time he vacates and rent as it becomes due until the unit is re-rented or the end of the lease, whichever occurs first, just like you have been doing or should have been doing all along. Can you charge the tenant a Concession payback? The law does not clearly provide that you can or you cannot. If the tenant picks Choice #1, it may be dangerous to charge a concession payback, because some judges are apt to consider a liquidated damages charge as exclusive.

Now for some Q&A: Q- Do I have to use the Addendum? A- Absolutely not. It is your choice. If you don’t provide the Addendum to the tenant to sign, the tenant will owe rent that is owed at the time the tenant leaves early PLUS all rent as it becomes due until the unit is re-rented or the end of the lease, whichever occurs first. Q- Can I have current residents come in and sign the Addendum? A- No. You can only use the Addendum at lease or renewal signing. Q- Do I need to fill in all the amounts on the addendum before I give it to the tenant? A- Yes, do not leave anything blank. Q- Suppose I use the Addendum and the tenant picks Choice #1? A-If the tenant chooses to vacate early, you can only charge the tenant 2 months’ rent plus whatever they already owed you for rent or other amounts under the terms of the lease. NOTHING MORE. Q- Suppose I use the Addendum and the tenant picks Choice #2? A-You can charge the tenant rent that is owed at the time the tenant leaves early PLUS all rent as it becomes due until the unit is re-rented or the end of the lease, whichever occurs first. Q- Can I force the tenant to sign the Addendum? A- No. If the tenant refuses to sign, they simply will owe rent that is owed at the time the tenant leaves early PLUS all rent as it becomes due until the unit is re-rented or the end of the lease, whichever occurs first. Q- Should I utilize the new law and use the Addendum? A- It is purely a business decision. In a soft market, it would be better not to utilize the new law and the Addendum. If you feel you will rent out the unit in less than 2 months, it would be better to use the Addendum IF the tenant picked Choice #1. There is no guarantee what the tenant will choose. Q- Can I force the tenant to pick a particular Choice, #1 or #2? A- No. If you use the Addendum, you are at the mercy of the tenant and his choice. Q - Can we require the tenant to give notice before he vacates early if he picks Choice #1? A-- Yes, but if he does not, you can only charge the 2 months’ rent amount as if he simply walked out on you tomorrow. Q- If the tenant picks Choice #1 and gives us notice, can we charge the tenant through the notice period PLUS the 2 months’ rent? A- NO. You can ask the tenant to give you notice, BUT you cannot hold him to it. Q- If I decide to use the Addendum, must I offer it to everyone? A- For Fair Housing purposes if you use it for one, you should use it for all, at least in a given time frame. Q- Why does the tenant get to make a choice? Why can’t we just charge them liquidated damages? A- The tenant only gets to make a choice if you decide to use the Addendum. The Governor said he would not sign the bill into law unless the tenant was given a choice, so the bill was amended late in session to get it passed.

Half of respondents preferred it, with marble, stone slab and other materials trailing far behind. “A lot of people are using the backsplash as sort of the jewelry of the kitchen,” said Sheila Schmitz, Houzz.com editor. “That’s where they’ll put that splash of color.” 5. Floors. Hardwood floors led the list of choices, but here’s another area where tiles made a strong showing, coming in second. 6. Stainless steel. A majority of respondents favor stainless steel appliances. 7. Islands. They’re popular but not a must. While 61 percent said they’re incorporating an island, for some others, it would be the wrong choice, either because the room is too small or the configuration wouldn’t work. 8. Transitional style. This look – a blend of traditional and contemporary – has grown in popularity, according to the kitchen and bath association. 9. White cabinets. Whites and off whites are the top choice for color schemes, at 73 percent, an increase of 6 percent over the previous year. 10. Gray color schemes. Grays are coming on strong, according to the survey and designers. “In kitchens, shades of gray have noticeably jumped in use over the past three years,” the association said in its summary.

Patrick Blake grew up in a house in southeastern Virginia where his mother devoted one room, the living room, to antiques. “I always loved walking around in that room, gazing at her bed warmer hanging on the wall, the old spinning wheel in the corner, the iron and corn popper leaning against the fireplace,” he says. Now 43 and living and working as a freelance visual merchandiser and designer in the same area, Blake still loves those items, and shares that passion nationwide with more than 7,500 fans of primitives through his Facebook page — Primitive Lane. You can go www.facebook.com/ p.l.blake.primitivelane, and join in the conversation that includes people from Ohio, New York, Florida, Utah and Maine, as well as Virginia. “I love that this group has members from all the country,” says Tammy Zuch, a “Primitive Lane resident” from Pennsylvania. Other members echo those sentiments and find the online fellowship refreshing and invigorating — a club where everyone shares their fabulous finds and fond memories. The posts are often nostalgic, a way of looking back and reflecting on the good times they had as children. “I love Primitive Lane because it takes me back to being a kid and going to my Aunt Maggi’s house,” says Lisa Marie Case of Windsor, Va. “Primitive Lane also shows how you can take a yard sale find and make it a new treasure; these items make a house go

Lane,” Simpson said. “It’s fun to see the bargains everyone gets.” In Newcastle, Wy., Crystal Soares posts photos of snow outside her home and her “primitive snowman” hanging on a wall indoors. For some like Rebecca Gingo Kosierowski in northeast Pennsylvania, primitives make practi-
cal-sense living. “After getting married and having children and pets, I love the no-fragile aspect of primitive antiques. I never mind if things have chips or scratches because after all children do that to your stuff,” she says. “And, I love the purpose of primitive items — buckets for holding sugar, crocks for canning. I also love the quality of these items that have existed for over 100 years.” What is a primitive and where do you best find them? “Primitive is a style of living,” Blake says. “It takes you back to Colonial times when things were simple and flaws were welcomed. The word primitive is today’s name for what was once considered Colonial in the 1950 and 1960s, Early American in the 1970s, Country in the 1980s and Americana in the 1990s. It seems as if each decade has a new name for this decorating style. “An antique is an item that is over 100 years old. So a vase from 1900 is an antique, but not necessarily a primitive item. I always like to say primitive is ‘Little House On The Prairie’ meets ‘The Waltons.’ Look at the sets and props used on these shows. That is primitive,” Blake added. Thrift stores are the best affordable places to find primitive pieces because antique shops tend to want higher prices. Patrick also searches eBay, Etsy, Facebook, Craigslist and yard sales. Favorite primitives among his collection include a spinning wheel, wooden mashers, canning jars with zinc lids, rolling pins, crocks, a Hoosier cabinet and old milk bottles — as well as an old radio that his grandfather used to listen to baseball games and a bench his dad
made. “He’s now gone so this simple piece of furniture is worth millions to me,” Blake says. When Blake wants to perk up a primitive piece, he employs a painting technique he’s nicknamed the PPPP — Patrick’s
Primitive Painting Process, which he says is a simple technique: sand, paint black, paint desired color, sand, stain and apply paste wax. “This process creates a wonderful aged patina to any item,” he says.

With the spread of wireless Internet and portable devices such as tablets, it’s common now to send spreadsheets and emails from any room in the house, not to mention the nearest coffee shop. In fact, among major home-renovation projects, home-office improvements provide the puniest return on the in-
vestment when a home is resold, according to Remodeling magazine’s 2013 “cost vs. value” report. “I get this question a lot,” says Elizabeth Cb Marsh, an associate interior designer at Jenkins Baer Associates in Baltimore. “Especially in large, new-construction homes, there are these bonus rooms that are just there.” When her clients make

Government Must Play Key Role in Housing Finance Usually, we devote our TBA Today message to topics of local interest. But when it comes to the all-important aspect of having a new home financed, the federal government has played and should continue to play a significant role. That’s why I wanted to share with you that our National Association of Home Builders (NAHB) – TBA’s Washington, DC-based parent organized, told Congress last week that an effective housing finance reform plan must include a federal backstop to ensure that 30-year, fixed-rate mortgages and reliable mortgage financing for multifamily housing remain readily available and affordable. Testifying before the Senate Banking Committee, NAHB Chairman Rick Judson, a home builder from Charlotte, NC., said that NAHB is a strong proponent of housing finance system reform. “NAHB believes that the U.S. housing finance system must be multifaceted with both competing and complementary components, including private, federal and state sources of housing capital,” said Judson. “To achieve this, it is important to reform and restructure the conventional mortgage market and also improve other parts of the housing finance system, including FHA, the Federal Home Loan Banks and state housing finance agencies.” The key to the sustainability of the 30-year, fixed-rate mortgage is a securitization outlet, because originators do not have sufficient capacity to hold such long-term assets which are funded with shortterm deposits.
Currently, Fannie Mae and Freddie Mac provide the securities vehicle along with a government guarantee for investors.

Families with children have even more options for converting an office space. These days, it is common to transform a dull study into a kids’ homework hub, says Pam Ginocchio, co-founder of the children’s design blog Project Nursery. To begin, she recommends giving each kid a workspace: a small metal desk in a fun color with a clip-on lamp and a comfy swivel chair. Create a comfortable reading nook on the floor with beanbags. Then mount floating
shelves from floor to ceiling and display books with the covers facing out to entice young readers. Appoint one wall as a place for scribbling ideas or displaying schoolwork by applying a layer of magnet paint and then chalkboard paint from floor to ceiling. Consider allowing a computer for older kids’ homework, but try to banish video games and other distractions, says Project Nursery co-founder Melissa Fluhr, who stresses the value of a quiet, contemplative space. If contemplative is not your family’s speed, Fluhr suggests using the bonus room as an off-off-offBroadway theater. For a kid who likes to perform skits, play songs and choreograph dances, build a basic plywood stage in the corner of the room. Above that riser, hang a rounded shower-curtain rod and a pair of dark, tab-top curtains. Hang costumes and dress-up clothes in a cubby, and store puppets, musical instruments and other props in a toy chest. Finish by hanging a mirror at tyke height so children can watch themselves rehearse, and don’t forget to add a few comfy chairs for the audience. If your child has another obsession, turn an undersized room into her special hangout. Just be prepared to update the theme in a year or two.

Tenant won’t cooperate in showing house for sale By Gary M. Singer Sun Sentinel – Fort Lauderdale
Question: I am trying to sell our rental house, and our real estate agent is having no luck getting our tenant to cooperate. The tenant has always paid on time and takes decent care of the place but does not ever seem to be available to allow a prospective buyer to look at the house. I need to sell, but I also need the rent until I can sell it. What
can I do? – Miranda Answer: The law and most written leases allow the landlord to access the rental house to make repairs, provide agreedupon services and show the property to lenders, contractors and prospective buyers or new tenants. The landlord must give reasonable notice to the tenant and access the house during certain times. The access should be with the tenant’s consent, unless in the case of
a genuine emergency. If your tenant is being unreasonable, you still may be able to enter, but in doing so you risk repercussions. Barring a genuine emergency, I don’t recommend entering without consent, because you could be opening yourself up to accusations of missing or broken items and harassment. Keeping your own home staged in the proper condition to show and
rearranging your life around a showing schedule is hard enough when you are the one with the incentive to sell. But for your tenant, it’s just extra work and inconvenience with no gain at the end. Before putting a house on the market, speak with the tenant and explain that selling the house will not affect the lease. Maybe the tenant will want to buy it. Acknowledging the tenant’s efforts in helping you can be a pow-
erful motivator. Consider throwing in a restaurant gift card or offering a small discount on the rent. That may go a long way to making it worth the tenant’s while to cooperate. Try to find out what your tenant’s reluctance to showing the house is and look at the concern from his or her viewpoint. This should help you to find a solution that works for both of you. In most cases, good commu-
nication will solve the problem. But if the tenant is just being unreasonable, the law is on your side.
