Master Builder Mark Worley Addresses Consumer Questions As often as possible, we like to use our TBA Today article to touch on subjects of interest to consumers who are building a new home, remodeling their existing home, or looking for the products and services offered by our associate members. This week, we asked Mark Worley, CIP, GMB, of Worley Construction – the only Graduate Master Builder in Tallahassee and one of only 13 statewide as recognized by the National Association of Home Builders – to answer two questions posed by consumers.

Q. We are considering a renovation to our existing home next year and were wondering what the procedure is for making payments to the contractor for his work? A. The payment schedule should be addressed within the contract with a value stated for each phase of the project. All payments should be based on the percentage of work completed. You should never pay for uninstalled work unless it is related to the original deposit to the contractor or custom fabricated items such as cabinets and countertops. If your project is a simple bath remodel the contract should specify amounts owed as each phase is completed. On a large multi-phase project such as a whole house remodel, it is advisable to have a third party verify all completed work. This is the same procedure used in new construction and relieves not only the owner, but the builder as well, of disputes related to completed work and prompt payments.
Q. We just moved into a used home and our two year old dryer is taking considerably longer to dry clothes. Do you have any suggestions? A. Look for lint build-up in the dryer as well as the exhaust vent to the exterior of the house. If your exhaust vents upward (vertical), you will need to inspect and clean more often than a horizontal

downturn. And while the new-home market appears to be “heading in the right direction,” as Haber put it, suppliers still appear wary of revving up. Although there is more building going on than there was last year and a drop in the lower-cost bank repossessions that competed directly with new homes in the critical markets of the West and South, the level comes nowhere near the 1.5 million units a year that economists consider a healthy market. “The shortages and price increases reported by both home builders and lumber dealers are particularly concerning, given that the current rate of construction is still far below what would be considered normal or necessary to meet underlying demand,” David Crowe, the chief economist for the National Association of Home Builders, said in a June report. There were similar shortages in 2004 and 2005, but 1.8 million houses were built in each of those years, Crowe said. In the first six months of this year, builders reported a 5.17 percent increase in the cost of materials that go into a house, Crowe said. Most lumber dealers reported that the prices of the products they handle had increased an average of about 10 percent in the same period. The price increases tend to be felt by small and medium-size builders, who don't have the buying clout of the national ones. South Jersey builder
Bruce Paparone said, however, that the increases appear to have been confined to the first part of the year, and that what he and many colleagues are facing now are rising labor costs — some of which also are attributable to post-Sandy rebuilding. Paparone belongs to group of 20 builders from all over the country that meets periodically to share experiences. A recent meeting in California focused on what he called “a dilution of labor,” he said, resulting in efforts to keep construction quality at high levels. Sandy contributed to a labor shortage already in the making because of the loss of workers during the downturn and the effects on immigration-rule changes, Paparone said. He learned something else about the market at his “Builder 20” meeting, Paparone said: “Everyone in the country experienced a slowdown in newhome sales in the third quarter, not just us.”

Couple’s barn renovation is a 25-year undertaking Recycled items add to its style

RAVENNA, Ohio — Tom Hutter and Nancy Angerman have never lived in a conventional home. So choosing to build a house by reconstructing an old barn and outfitting it with things like salvaged brick and torn-up sidewalks was hardly out of character for them — even 25 years ago, before reclaiming architectural salvage became trendy. The couple’s home is a 19th-century barn that
Hutter and a crew dismantled and moved from its former site in Sharon Township, Ohio. Refurbishing the barn has been Hutter’s passion, a project accomplished a bit at a time over more than two decades. “You know, when you think back on it, it was quite an undertaking,” Hutter said. “But it was cool to be able to do.” The three-level, 4,400square-foot barn sits on 2.7 woodsy acres. Its rustic elements are juxtaposed with an up-to-date, open layout and energyefficient construction methods. The majority of the building materials were

recycled — so much, in fact, that Hutter joked it’s easier for him to tick off what was purchased new. Walls and ceilings are sheathed in old wood from barns and mills. Kitchen
counters were fashioned from blackboards once used in local schools. Floors are covered in reclaimed brick, roofing slate and pieces of old flagstone sidewalks. “I
ruined one truck schlepping that stuff,” he said of the sandstone. The heavy structural timbers are exposed, giving the place a rustic charm. One bears the scars of buckshot. Some still display the metal tags that were affixed to them when the barn was dismantled, each with an identifying code written in marker that would ensure everything went back in the right place. Hutter isn’t sure what sparked the desire to renovate a barn, but it was the last in a progression of unorthodox homes. When they were first married, Hutter and Angerman rented an 1870s

YOUR TENANT BROKE THE LEASE - NOW WHAT?

Your tenant skipped out in the middle of the night 3 months into a 12 month lease. No notice given, not even the keys left behind. The only thing the tenant left you with was a mess and a vacant apartment. Your owner or management company is wanting you to sue the tenant for the money owed and collect this money. Can you sue? Should you sue? Is it worth it? Are there risks? Tenants break their leases on a regular basis. Sometimes they give you notice, but often they just get up and leave. While in some cases you are quite happy to be rid of a problem tenant, in other cases the skip was unexpected, and the landlord is upset at the loss of rental income and the prospect of a vacancy or having to retain a new tenant. The usual reaction by the landlord is to want to sue the tenant to recover the lost rent. Unfortunately, most landlords are unsuccessful at collecting the rent in this fashion, and in our opinion, it is just not recommended. For how much can you sue the tenant? You can only sue the tenant for the rent that you lost as it becomes due plus the damages to the property that exceed ordinary wear and tear, and these damages must be proven. When can you sue the tenant? You can sue at any time after the skip, but you will not know what is owed until you have the unit re-rented. You cannot calculate the rent owed for the remainder of the lease and sue for this amount, as acceleration is not allowed. Where is the tenant? In order to sue someone, you need to find them. If you cannot find them, you cannot sue them. It is that simple. So you find the tenant and sue the tenant. Now what? The landlord or the property manager will have to attend a pre-trial which could take hours of waiting. At the pre-trial the tenant may not show up, and you will receive a default judgment. If the tenant shows, the case might be settled, or if it is not settled, the case will be set for trial at a later date. This will require another trip to court where a full fledged trial will be held and all witnesses must attend.

Can an attorney sue the tenant for you? Sure, and you will be throwing good money after bad. A typical small claims suit handled properly will cost between $500.00 to $2500.00 on average in attorney’s fees. You still will need the landlord, the property manager and/or witnesses in court at the pre-trial and definitely at the trial. Doesn’t the tenant have to pay your attorney’s fees? If you win in court, the judge may award you attorney’s fee and costs based on the lease or Florida statute. Collecting them from the tenant is a whole different story. Can the tenant win in court? A tenant who breaks a lease will come up with all kinds of reasons why the lease was broken, most of these reasons pertaining to the condition of the property, repairs that they claim were not completed, safety issues, noise issues or just about anything under the sun. These can all be LIES, but you will have to defend yourself against these lies. Many tenants can lie more convincingly than you can tell the truth. If the tenant wins, YOU will have to pay the tenant’s attorney’s fees. Many judges feel a lot of sympathy for a tenant who breaks a lease, if the tenant comes up with a good sob story. The Counterclaim Risk Any time you file a lawsuit, you run the risk of the tenant, with or without an attorney, filing a counterclaim against you. This means that the tables are turned, and now you are not only a plaintiff, but you are a defendant and must defend yourself against the tenant’s alleged claims. This often will require you to hire an attorney and subject you to not only your attorney’s fees, but the tenant’s attorney’s fees in the event he retains an attorney and prevails in court. A simple lawsuit you file against a tenant for rent that he owes you can result in a complex counterclaim filed against you for damages the tenant allegedly suffered due to your actions or inactions. The accusations the tenant may make could be totally false and outrageous, but you will still be required to defend yourself. ARE YOU CONVINCED YET? Our office does not recommend lawsuits against a tenant unless it is an eviction. If the landlord wishes to pursue a tenant, we recommend that they do this on their own and recommend that the property manager does not file suit for the landlord. Do some landlords win and collect their money? Absolutely. Most do not. We recommend that you take the money you would have spent filing a lawsuit, pay for an extra ad in the newspaper, and re-rent the property as soon as possible.
farmhouse on the outskirts of Hudson that had been remodeled into a Western ranch. Later he renovated two houses: a vacation cottage in Ravenna, which he turned into a year-round home, and the historic C.A. Reed House in Ravenna, which he divided into four apartments. The Reed house is now listed on the National Register of Historic Places. “After that he said, ‘OK, I think I need a new project,’ ” Angerman recalled. Hutter heard about the barn from a tradesman he worked with on the Reed house. The barn, which he believes predates the Civil War and was reconstructed in1878, stood in the way of a runway expansion at Medina Municipal Airport and needed to be moved. Hutter served as the general contractor on the barn project, often working alongside the tradespeople he hired. He and a crew took the barn’s structural timbers apart, and then the timbers were trucked to the new site, pressure-washed and reconstructed to form the frame of the home. He had the vision to turn the bare-bones structure into a home with a striking central staircase that leads from a lower entry level up to the main living area and on up to a top floor outfitted with bedrooms and a workout space. He hired an architect for some of the initial engineering work, but the design was mostly Hutter’s. The project started in the late 1980s, but wasn’t ready for occupancy until March 1993. “We moved in way before it was finished. Way, way, way before,” said their daughter, Emma Taylor, who now lives in Glasgow, Ky. “Every time I’d come back from college, there’d be a little piece more, more, more,” Taylor said.

Compost or mulch? People often confuse the two, although each fulfills a different function in gardening. Which one you want depends on your needs. “Compost is used to feed crops; mulch is used to suppress weeds,” said Daniel McGrath, a horticulturist with Oregon State University Extension. “Compost is decomposed organic matter that is generally higher in nutrients and relatively low in carbon compared to mulch. Mulch is raw, undecomposed organic matter.” Unlike compost, mulch is generally not mixed into the soil, he noted, but is applied 2 to 4 inches deep on top of the soil around a tree or shrub. Mulch has fewer nutrients and is not meant to replace fertilizer, which should be added as a supplement. Mulching does, however, maintain soil moisture, prevent most weed seeds from germinating and keep soil temperatures constant around plants, said Mar-
tha Smith, an extension horticulturist with the University of Illinois. Which kind of mulch you choose depends on what you’re growing and where. Some mulch, especially crushed rock and commercially made, color-enhanced mixtures, can beautify pathways, driveways and play areas. Good mulch is easy to apply and remove; is free of noxious weeds, insects and disease; and adds organic materials to the soil as it breaks down. “There are different byproducts used across the U.S. based on local supply,” Smith said. That includes pine needles in the South, hazelnut shells in the Northwest and buckwheat hulls in the Southeast. Some different mulch materials from which to choose: » Shredded bark, wood chips and shavings. Easy to spread and long-lasting, but can rob the soil of nitrogen and make landscape plants turn yellow. Look for “arborist chips” or ground-up tree branches that can make a good mulch and often are available for the asking from tree trimmers. » Gravel and stones. Stone doesn’t have to be replaced like organic
mulches, but it is expensive and will work into the ground. Stone is great for problem areas, though, like deep shade or in channels cut for stormwater runoff. » Black plastic and straw. Both are commonly used in vegetable gardens and orchards. Plastics, however, prevent water from entering the

Question: My homeowner’s association recently announced that our private security guards are going to start giving traffic tickets within the community. The board will sit in judgment over the $50-$100 fines. Is this legal and enforceable? –
Manfred Answer: Yes. Your association, acting under the authority of its governing documents, has the right to create community rules and may enforce those rules by levying fines up to $100. If your community has traffic rules, such as a set speed limit, it can enforce fines against violators.
It’s similar to breaking any other rule, such as having a dirty roof or overgrown shrubbery. You also can be responsible for your guests’ violations. While your community’s security guards can write you up, they can’t issue summons for you to be in court or detain you. Simply, they can issue a

rules violation and refer you to your association. Your association’s board of directors will have appointed a fining committee of people not on or related to the board. These people will give fined residents notice of a committee meeting, where the violations will be reviewed. The residents have the right to
show up and argue their cases, but the ultimate decision rests with the committee. Just like with any other fine, if you don’t pay, you could lose your rights to common amenities, such as the community pool, or have your gate access denied. Generally, though, these fines don’t give your association lien rights to
foreclose on your home.
