Question: In March 2011, I had my kitchen gutted and redone with new floor, cabinets, “green” furnace and water system, counters — the works. I installed a new Samsung French-door refrigerator, an over-thestove microwave and, for
the first time, a dishwasher. The washer and dryer are in a mudroom near the kitchen. In June, the motherboard of the two-year-old dishwasher expired. It would have cost $500 to fix, so I bought a new one. In July, the microwave stopped working (loud intermittent buzz, no power). Then the electrical
panel of the fridge stopped working, now blinks. The fridge still keeps things cold, but the ice maker has completely fallen apart and doesn't work. Do I have gremlins? To whom do I turn for help? I have a circuit-breaker box in the mudroom. Do I need a surge protector? We do have the occasional
brownout/blackout when there’s lightning. Answer: I assume that when you redid the kitchen, the electrical wiring was upgraded for the new appliances. Whether you did or not, I recommend hiring an electrician to see what needs to be done now. I recently read that 80 percent of all power surg-

Holiday Decorating When Selling Your Home People are out in droves shopping for gifts, festive foods, party goods— and even houses! Those who are looking at houses during this time of the year are more likely to be serious buyers rather than casual lookers. And while they do expect to see some holiday décor in the homes they are viewing, it is important for sellers to keep this old adage in mind: less is more. The usual rules still apply when it comes to having as little clutter in your home as possible and ensuring the atmosphere is not personalized to Nancy Stedman, CLG, CRS, GRI the occupants. It is important that buyers can picture themselves in the home that is being sold. When putting out the holiday decorations, items Retriever Property Enterprises should be generic, simple, tasteful (not “cutesy”), and very limited. For every decorative item you put out, remove a non-seasonal accessory. Clutter is still clutter, even if it is our favorite holiday clutter. Do not put out items that are personalized as it will not help prospective buyers picture themselves in the home. Make the type of decorations singular; for example, one wreath, one tree, one centerpiece, etc. Too much red-and-green can be visually overwhelming. Stick to the more generic green, white, and gold or silver where possible. Outdoor lights and decorations should also be minimized. Leave the wreath with Rudolph the Rednosed Reindeer on it packed away. Inflatable items on the lawn should be put aside for next year. Items such as these break the “cuteness and clutter” barriers. And, finally: the tree. If you have a high ceiling, by all means get a tall tree that accentuates that feature of your home. However, in all cases be careful not to get a tree that will take up a large amount of floor space. Consider removing a piece or two of furniture from where you are putting your tree to keep the sense of space. Gift packages should be out of sight, or at least well out of the way and not overly abundant. Leave valuables and heirlooms out of sight, especially the breakable ones. Once again, less is more! Vacuum survey Just about everyone does it, in the house, shop or car. I’m talking about vacuuming, which is a way of introducing results of an Electrolux survey on the subject of busting dust. Dust pick-up is the most important vacuum factor in the United States and worldwide. More than
31 percent of Americans surveyed named it as their primary consideration when buying a vacuum. Noise is the most irritating thing about vacuuming, but Americans are less bothered than most (26 percent compared with 36 percent globally). Globally, more men (41 percent) than women (32 percent) say they think noise is the most irritating factor when vacuuming.

Rising rates weigh on real estate funds By Alex Veiga Associated Press
One look at the lackluster gains of real estate mutual funds this year might give the impression that commercial property owners are struggling through a relapse of their post-financial crisis woes. But demand for commercial real estate has been improving along with the economy, boosting occupancy and rental rates for many owners. Even so, a surge in interest rates has spooked investors, dampening the funds’ returns. Real estate sector equity funds have delivered an average total return of 1.93 percent so far this year, according to Morningstar. The funds, often composed largely of real estate investment trusts holding commercial properties, are still up an average of nearly 6.1 percent from a year ago and have delivered an annualized
return of 19.3 percent over the past five years. Still, the slide in real estate funds represents a buying opportunity for investors. “REITs are finally looking fairly valued,” said Abby Woodham, fund analyst at Morningstar. “They could, of course, go down further, but the valuation is much more attractive now than it has been for quite some time, so it’s not all doom and gloom.”

In this urban oasis, no grass is allowed Planting journey may never end

MINNEAPOLIS — When Alice Menge started gardening, it was all about islands. With a nudge from her husband, Dick Sherwood, she’s gone continental. “At first, I had cut out some islands,” Menge said of their St. Paul, Minn., yard, “but he hated cutting around those because it meant trimming by hand. So I just started filling in.” After three decades of filling in, their yard — front, back and boulevard — is all garden. With an eye for design honed by taking classes, visiting other gardens and learning from her own mistakes, Menge has crafted a natural, lived-in showcase with a harmonious array of textures, shapes and colors. Viewed from the screen house in a corner of the yard, the landscape seems to levitate its way up to the two-story house. The front, anchored by a ginormous, rough-hewn maple, enchants. And that’s before you follow one of the tidy stone paths to a fairy garden on the east side of the greentrimmed stucco house. So, after covering every square inch of the property with gardens, is she done? “Hmmm, probably never,” said Menge, 63. Spoken like a true gardener. Even when the destination is reached, the journey doesn’t end. And this journey involved collecting rocks from far-flung locations, fits and starts with waterworks and plants and a storm that cost them a third of the 80-year-old maple, as well as some unusual evolutions.

For starters, Menge worked “backwards,” not tackling the front until the back was finished. The back yard itself has mutated mightily, from flowers to perennials to the current shrub-andtree-dominated landscape. In the beginning was a lawn. And it was “a very good lawn,” Sherwood said. “But ... they’re boring.” Menge, who had been relegated to container plants when she lived in an apartment, wanted something more when she married Sherwood and moved into his St. Paul home. So she planted perennials, just the flower gardens her homesteading grandparents had let her plant in western North Dakota. But to her surprise, Menge found the flowers from them unfulfilling. “It was all color, no real

structure,” she said. “And deadheading perennials was a massive amount of work. I would spend up to six hours collecting a 5gallon pail of deadheads. So then I decided to start going vertical because it’s such a small yard.” So out went most of the flowering perennials, and in came shrub roses (including University of Minnesota introduction Ole and Lena) and Diablo nine-bark and tamarix; burberry and chokeberry and elderberry. Up the walls of the house and the arbor outside the garage went Engleman ivy and trumpet vine, plus lilac bushes trained into tree form. Menge left some perennials in place — daylilies and coreopsis — plus a few pots of annuals, such as victoria salvia, to add color. “I like to use blue to cool down the hot pinks,” she said.
But the intent was to craft a relatively lowmaintenance panorama with what Menge calls “lift” and “pull,” inexorably rising from a fountain area toward the house. Scattered throughout the back yard, part of which is enclosed by a thick, 10-foot hedge, are stone paths and groupings of lava rocks and bakedclay rocks from North Dakota and stones from along the St. Croix River. The rocks are even more visible out front, where the landscape is more low-lying, with wild geranium, snow-on-themountain and shadefriendly hostas and astilbes forming a carpet under the massive maple. Enclosed by a black wrought-iron fence, the front yard has the air of a cottage courtyard, not at all cluttered like so many grass-free gardens. The boulevard came

last, Sherwood said, “after we started wondering ‘Why do we still have a lawn mower just to do that?’ ” Indeed, for all the property’s design integration, for all the connective tissue wrought by myriad stone paths and water music, the major evolution of these gardens has been giving this couple more time to actually enjoy the
fruits of their labor. They removed a laborintensive pond, replaced cedars that didn’t like winter and spruces that didn’t like summer, got rid of most plants that had to overwinter inside and (reluctantly) eschewed Zone 5 plants such as Japanese maple. Best of all, they built the screened-in enclave where they can soak it all in.

What’s a person to do when the party invites pile up and you need easydo hostess gifts? Or, you need a gift for a shut-in or casual friend? Think hyacinths — those sweet-smelling, nostalgic bulbs that say you care without a lot of fuss and muss. A quick stop at the grocery store or florist yields you long-lasting potted hyacinths in shades of blue, purple, white and pink with a cluster of fragrant florets covering a sturdy stalk, according to the gardening experts at www.iBulb.org, a nonprofit educational site that focuses on the beauty and use of flowering bulbs. That hyacinth pot may be a foil-covered or plastic version, but you can dress it up and make it look pricey by slipping the plastic pot into a decorative container, bowl or basket. Or, go the naturallooking route and wrap pit in fabric such as burlap and tie it with raffia. The bulbs with roots and soil intact can also be carefully lifted from the plastic pot and replanted in a larger container — think three to five grouped together — where they will continue to thrive. When shopping for hyacinths, purchase the plants with buds closed. They bloom from bottom to top, so print a helpful card that suggests the recipient give the hyacinth proper light and temperature care. The plant should be kept in an area with partial sunlight or partial
shade and temperatures of about 60 degrees Fahrenheit. Heat speeds up the natural flowering process, and cooler temperatures help blooms last longer. Water the plants as needed to keep the soil moist, but avoid over-watering because this leads to rotten bulbs. No fertilizer is necessary because the nutrients needed for the plant to grow are stored in the bulb. For fancier gift-giving needs, place a potted hyacinth in a basket filled with seeds and gardening tools for the 2014 season.

If you have a policy whereby if a tenant is locked out of the premises, he or she is to call a locksmith, you may not have to read any further. In this case, you have no involvement with the situation, and hopefully the locksmith will not have damaged the lock and/or changed out the lock. Hopefully as well, the tenant does indeed call a real locksmith rather than simply break the lock to gain access. Many of our clients do have a policy of opening up a locked door for a tenant and sometimes will charge the tenant for this service. How the landlord goes about giving access to a tenant can have a serious effect on the landlord’s liability. The Scenario It is 3 a.m., and your on-call maintenance tech or maybe you receive the dreaded phone call or knock on the door. The “tenant”s has misplaced his keys and is obviously intoxicated. You are quite familiar with this tenant, having seen him at the pool, you have seen him drop off rent in the office, he plays volleyball on Sundays, uses the exercise room and has even made maintenance requests. You simply grab the keys and allow him access. The problem is that he is not an actual tenant, but has been an unauthorized occupant for quite some time. He has now decided, once you grant him access, to take his roommate’s valuables, leave, never to return again. The Problem It is quite obvious what the problem is in this case. You failed to see if this person was indeed the tenant on the lease, and the ramifications could be severe. Each year we see this scenario unfold, and landlords are faced with paying fairly large sums of money to the actual tenant who was not home when you allowed the unauthorized person access. You may argue that it was not your fault that the unauthorized person took his roommate’s personal property, as after all they have been living together for quite some time, but the problem remains. You allowed an unauthorized occupant, not on the lease, access to the rental premises. Creating a Policy Your first step should be to create a written policy for your company regarding lock outs. All employees who engage in allowing a locked out tenant access should be required to read this policy and sign a statement that they have read it and agree to abide by the policy. No exceptions should ever be made to the policy. Your next step will be to provide the lock out access rules or procedures to the tenant and make this part of the lease, the Community Rules and Regulations, or a separate addendum to which the tenant has clearly agreed. Lock out access procedure In the event a tenant is locked out, they need to follow certain procedures for you to even act upon this lock out. They should be required to provide you with 2 forms of government issued identification. This identification should then be brought to the office and compared with the copies of the identification you have in the tenant’s file. Names should match up completely, and a visual examination of the picture ID you have in the file should match up with not only the ID the tenant is showing you, but the tenant himself. Once this match is established to the satisfaction
of you or the bleary eyed maintenance tech who was just awakened, the identification provided by the locked out tenant should be copied, notes made on the copy, and the copy of the ID placed in the file. If the tenant cannot provide you with the required ID, the tenant should not be given access. If the tenant cannot provide you the required identification, there is no doubt that the tenant will not be satisfied, and an altercation or argument could ensue. Keep your lock out policy handy in the event the tenant is not able to satisfy your requirement, express regret, and tell him he must hire a locksmith. But, we know this tenant! Most of the legal problems we deal with occur when the landlord or an employee makes an exception to the rule. Every time an exception is made, the chances of a problem increase dramatically. If an exception is made once, it may be expected that an exception is made the next time. If you make an exception for one resident but not another, you run the risk of being accused of discrimination. People often look alike, especially when related to one another. Most recently, we dealt with a situation where the brother of a tenant gained access due to looking similar to the actual tenant. Had the maintenance tech carefully looked at the identification and made the comparison, the difference would have been evident, but this was not done and the landlord paid the price. The inherent problems with lock out access a. The person giving access will need to have both access to the keys to the unit and the tenant’s file. Due to privacy issues, it is recommended that there is limited access to the tenant’s file. b. Some companies fail to keep a copy of the tenant’s identification in the file. There is absolutely nothing illegal about keeping a copy of the tenant’s identification in the tenant’s file. This is not a fair housing violation. We strongly urge you to keep a copy of the picture identification in the tenant’s file. c. Many landlords do not have a written policy for the employee who will be engaged in granting access. This is simple. Write one up now. d. Many landlords have not provided the policy or rules to the tenant regarding lock outs. Create your rules, and distribute them to all tenants. Charging the tenant for giving access After reading this article, you may have decided to take the route of telling the tenant that he must call a locksmith, but some of you may have decided that you will assist in lock outs and should be compensated if you grant access. We agree. The extra work involved and the increased liability on the landlord justifies a reasonable charge to the tenant. Some of our clients require this to be paid before the access is granted; others charge it as additional rent which must be paid with the normal rent at the next payment period. If you are going to charge the tenant for anything, it must be clearly agreed to by all parties involved. Landlords often create charges upon a whim and expect that they can force the tenant to pay the charge. Clearly state the charge in your lease or whatever is incorporated in your lease, such as the community rules and regulations.

Birds will peck seeds from your plants and seek shelter all winter long. 5. Evergreens, including holly trees, make good shelter for roosting. And hollies, with their fall and winter berries, will draw birds that won’t come to feeders, such as a ravenous flock of cedar waxwings. 6. Squirrels love bird food. In fact, they think it is squirrel food. Hang feeders distant from tree trunks and branches so they can’t leap from them onto the feeders. Use baffles above feeders. 7. A plain birdbath is a good bird attractor. But they are prone to freezing in winter. A concrete birdbath with a heating element will assure a ready supply of water, which means birds will visit
your yard when your neighbor’s birdbaths are frozen. 8. Keep the feeders clean. Every two weeks or so, empty them out and brush them with bleach and water in a 1 to 4 concentration. Birds carry a variety of diseases, but most concerning is conjunctivitis, an eye disease that’s been especially hard on finches. 9. Keep notes. Every year Scardino does a feeder watch through the Cornell Lab of Ornithology’s Citizen Science, tracking numbers by species. But she doesn’t need a note to remind her of her favorite backyard bird, a massive pileated woodpecker — think of Woody the Woodpecker about the size of a crow — that stayed around for a whole season.
