expenses, has pushed short sales to the forefront, although the jury remains out on whether that process moves more quickly now than it has previously. Anyway, I cautioned my colleague against buying a foreclosure, an endeavor still best left to the pros, especially experienced investors. Donald Sepety of Prudential Fox & Roach in Collegeville, Pa., who specializes in foreclosures, maintains that his biggest job is getting prospective buyers to understand that they’ll be acquiring the property as is. The lender is going to do nothing to bring a foreclosed house up to code, for example; the buyer has 60 to 90 days to have the necessary work done to get a certificate of occupancy before moving in. So an inspection before purchase is critical, allowing the buyer to negotiate with the lender to lower the price, according to Sepety and other experts. “Buying a house for $30,000 below market value doesn’t mean much if you have $40,000 in necessary repairs,” says Todd Hills, CEO of pawn-store website Pawngo.com. Use the home inspection to calculate how much the repairs will cost and to be certain you can pay for them, especially repairs that can’t wait, Hills says. Avoid buying more house than you can afford by preparing ahead of time, he adds. Determine the maximum you will pay for the property before you go to an auction. Also check how much of a down payment you should have on hand, typically 5 percent to 10 percent of
the asking price. Hills suggests dealing with Fannie Mae and Freddie Mac, which have a large inventory of foreclosed homes. “They also have the capability to offer a variety of money-saving benefits, including down payments as low as 3 percent, no mortgage insurance even though the down is less than 20 percent, no required appraisal, and you can have a credit score as low as 580,” he says. A Federal Housing Administration 203(k) loan lets you build repair costs into the mortgage of an owner-occupied property. If you're planning to make a killing by buying and flipping foreclosures, though, think twice. “Due to the large pool of foreclosures today, reselling is a lot tougher,” Hills says. “If you don’t plan to live in the home, make sure that the property can be rented while you attempt to resell it,” he added.

TBA Grows with Construction Industry Rebound As the area’s housing and construction activity improved in 2012, the Tallahassee Builders Association (TBA) went to work growing its membership. I am proud to report that last year TBA added over 100 new members to its membership rolls. Overall, we increased membership by 31.9 percent, making us one of the fastest-growing builders associations in America, and the second-fastest growing in Florida, behind only the Northeast Florida BA in Jacksonville. size of a tiny motel room, the two-room structures are a huge improvement over the tattered tents and tin shacks where 347,284 Haitians still linger three years after the devastating Jan. 12, 2010, earthquake. But as Haiti’s government moves to resolve the biggest reconstruction issue — permanent housing — officials are facing a lack of funds to solve the problem and getting criticized over the size and location of the houses that are being built. “It’s better than a tent, but it’s not the real aspirations of the people,” said Leslie Voltaire, an urban planner who worked on housing issues after the quake. “They want respect and you are downgrading them.” But Patrick Rouzier, housing adviser to President Michel Martelly, said the 344-square-foot houses are more than dignified. They consist of two rooms, a kitchen and bath. “We cannot cross our arms and say we won’t do anything for the people underneath the tents,” said Rouzier, a businessman. “I rather help them and at least for the next hurricane season they won’t be in the tents.” At a cost of $48 million, the 3,000 houses being built on the outskirts of Croix-des-Bouquets are only part of the government’s housing fix. The plan also includes revitalizing quake-damaged neighborhoods and urbanizing slums and undeveloped areas. Internationally, there has been a low success rate for the type of contractor-built, government-sponsored post-disaster projects the new community represents. Even before the quake left more than 300,000
dead and wiped out 410,000 homes across Port-au-Prince and its surrounding cities, Haiti’s housing stock was substandard. The poor lived mostly in deplorable slums scattered around the capital. But after promising to help Haiti “build back better,” donors hesitated to pour money into permanent construction. Instead, they financed repairs for homeowners, rental subsidies for tent dwellers and the construction of 160,000 temporary shelters for a halfmillion people. Nowhere are the failed promises of reconstruction as glaring as in the empty model homes sitting inside Zorange, a public housing village near the Port-au-Prince airport. Designed mostly by foreign architects and builders, the homes were promoted as part of a housing expo championed by former President Bill Clinton. “It was hoped that either a private sector or maybe an investor, or maybe a large donor would pick up and scale up one of these models. But this is where the money has run short,” said Jessica Faieta, the United Nations Development Program’s deputy regional director for Latin America and the Caribbean. Not far from the failed expo is one of the few donor-financed permanent housing projects that did happen. The houses, however, remained unoccupied for about eight months before quake victims like Marie Therese Pierre were identified by a government agency and allowed to move in. For Pierre, the sparsely furnished tworoom house with a kitchen and bath, is a big upgrade.

SEATTLE — “We call it Craig’s house, in fact,” says David Henderson, stay-at-home dad, firsttime general contractor and, more to the point, ace hunter-gatherer. And it is. From the firply kitchen cabinets to the old-growth, clear-fir ceiling; from the stainlessand-copper bathroom sink to the live-edge madrona bar. There’s also the Wolf kitchen exhaust fan, the fir stairs (once two massive warehouse beams), the cedar bathroom ceiling (from a swimming-pool room) and fir doors (fell off a truck) remade into barndoor sliders. Craig is all over this place. “There are so many things in this house that have a story,” Henderson says. “Karen found the house looking online during a typhoon in Vietnam. We had lots of time on our hands,” he says, speaking of his wife and the trip they took with their two 5year-olds in 2008. “We lived on the bluff over Shilshole Marina, but the house was old, and we needed more room. But we wanted to find a house that had an equally amazing view. This house had that. But it was just ugly.” Leaping to the end of his adventure in Blue Ridge, he adds, “Everything from your feet up is new” — 14 months from ripping off the roof and gutting what lay beneath to completion. With as much of it as possible culled from Craigslist. “The guys would say, ‘Dave, what are we gonna put here?’ And I’d say, ‘I
don’t know yet. I haven’t found it.’” Going shopping with Henderson means pulling your chair up to the computer. He figures he spent an hour a day trolling the site’s “materials” department. It was a habit that paid off over and over again. He found a guy from Snoqualmie Pass who built a timber-framed house. “I got a lot of timber from him. We’d meet at the park-and-ride to
make the swap. “Ecco Haus had a Bellevue store, but they closed. They had this whole kitchen advertised; the cabinets, the counter. It even came with plans from their kitchen designer.” The main floor holds the living spaces. The family opened the downstairs with a wide set of steps to a family room and kids’ art/play room. The powder room there: a cool stainless sink with a copper exterior; $300, Craigslist. Henderson nods toward the ceiling: 10,000 linear feet of old-growth

The untouched, 55-year-old lumber was discovered in a lumber company warehouse. “I was the first guy down there,” Henderson says. “They had 11 people coming to see it after me. We really didn’t have plans for the ceiling. It was just going to be white.” Henderson’s Craigslist adventure worked both ways. “I sold a lot of the stuff on Craigslist, even the old insulation. By the end it was amazing how much leftover stuff we sold.”

Latest Landlord/Tenant Scams by Harry Anthony Heist, Attorney at Law
With every crisis or economic downturn you see an increase in fraud and scam artists seeking to prey on the individual who already is in a weak and vulnerable position. The property manager needs to be keenly aware of what is happening in the online world and how it can affect them and the property owner. The popular website craigslist.org and others have been a fertile breeding ground for scammers, and with the increase in foreclosures and vacant homes, new and improved scams are appearing. Ads for your rentals at a lower rent amount! Some property manager have actually found photos, descriptions, addresses and prices of the homes they have on the rental market appear online on other classified ad websites. Often the rent price listed is lower than on the property manager’s site. The scammer takes action when an individual interested in the home contacts them. They have the interested party send money to them for the deposit, first month’s rent, last month’s rent, etc. Some scams involve the “landlord” being out of town, and the prospective tenant is asked to send a small sum to the landlord for the keys to be overnighted so the tenant can check out the property for himself. The scammer then simply takes off with the money, and the prospective “tenant” finds out he has been ripped off. Some of the scammers even go as far as physically showing the home to the prospective tenants, taking phony applications, deposits, etc., and do this multiple times on the same property. Beside the fact that there is fraud, you are now competing with phony ads making it appear your prices are inflated. The problem If an individual is ripped off by a scam artist, it is really not your problem or that of the property owner, UNLESS the “tenant” goes as far as moving into the home. Fake landlords seek out vacant homes and are actually placing tenants in these homes. You discover there is a family residing in the home, call the police, and the police refuse to get involved.
Why will the police not get involved? While the police may be interested in the fraudulent aspect of the matter, you cannot depend upon them or expect them to remove the tenant, who as far as you are concerned is trespassing in the unit. Law enforcement is extremely cautious not to get involved with being “used” by a landlord to evict a tenant, and the standard response is, “It is a civil matter,” which means you have to hire an attorney to file some type of dispossession action. Protecting your owners Some desperate owners, upon discovering that there is a tenant in their home, will actually seek to cut a deal with the tenant and have the tenant sign a lease with them, thinking that at least they now have a tenant. We advise against this. The owners have no idea whether the “tenant” has been scammed or is in fact a scammer himself. The simple act of trying to cut a deal validates the tenant’s occupancy in the unit and complicates the issue further. Although it may seem burdensome, it is crucial that you constantly inspect your vacant homes for signs of entry or lock tampering. Some property managers have increased their charges to their owner, due to the necessity of the homes being checked more often. The faster it is determined that someone has entered a unit or has taken up residence in a unit, the easier it will be to have them removed. Although law enforcement does not want to get involved, they will be of some help, especially if it can be proven that the person has not been in the unit for any length of time and has absolutely no legal right to be there. Being able to show clear and concise records and inspection reports to law enforcement will assist in having law enforcement at least question the tenant in the unit, and they may encourage the tenants to leave without the necessity of legal action. Keep an eye on craigslist.org for your area and notify them and law enforcement immediately if you see your homes posted on the website.

Getting the contract right at the start is one of the most important steps in a successful closing. Mark all the key dates on your calendar, such as the inspection and mortgage financing deadlines.
