NEVADA MMJ TESTING TO BEGIN, BUT DISPENSARIES STILL IN LIMBO

PUERTO RICO’S governor unexpectedly on Sunday signed an executive order allowing medical marijuana use – but where it will be grown, how it will be distributed and which ailments can legally be treated are still up in the air. The executive order gives the secretary of health the authority to “intervene extensively” with the island’s controlled substances act. While he didn’t say which ailments will qualify for MMJ use, the governor mentioned multiple sclerosis, AIDS, glaucoma, Alzheimer’s and migraines as conditions that studies have shown can be treated with cannabis. The U.S. territory’s health secretary now has three months to issue a report on how the order will be implemented. Proponents of the order say it’s a “step in the right direction” that will help patients find relief. Opponents said the action leaves enforcement of controlled substances laws in “judicial limbo.” The executive order also said the definitions of medical and non-medical use must be established.

NEVADA DISPENSARIES waiting for the green light to open received some good news this week after a health official said rules are now in place that allow laboratories to start testing cannabis. Dispensaries that received licenses to sell MMJ have been in limbo for months as they waited for the state to finalize rules on testing, which is required before sales can begin. Although labs can now begin testing, business owners told the Las Vegas Review-Journal they’re still unsure when they’ll be allowed to open. The Independent Laboratory Advisory Committee, in charge of recommending limits on pesticides, heavy metals and other impurities, has met five times, the Review-Journal reported. Early gatherings were nothing more than figuring out how to conduct meetings, and only during the fourth meeting on April 16 did the committee vote on pesticide rules. Out of that meeting, formal state policy was set, but committee members still wonder about the state’s rigid rules on testing, which could drive up prices.

MAINE MMJ CAREGIVER CRACKDOWN POSSIBLE MEDICAL CANNABIS caregivers in Maine enjoy a good amount of autonomy and some sizable competitive advantages over licensed dispensaries, as they don’t face the regulatory hurdles and state oversight that storefront operations encounter. But that may be about to change. The Department of Health and Human Services is backing a new legislative effort to give officials more oversight powers when it comes to Maine’s roughly 1,700 MMJ caregivers, according to the Bangor Daily News. Caregivers are allowed to serve up to five patients and cultivate up to six plants per patient. Some operate pseudo businesses and make a living by selling medical marijuana to patients, dampening the market for licensed dispensaries. The health department has limited oversight on caregivers, as it can’t force them to divulge much information or register their information. So the agency came up with a bill that would give health officials more authority to enforce existing rules and penalize caregivers who overstep their bounds. The Maine Association of Dispensary Operators is supporting the move, arguing that the freedom caregivers have puts the entire state’s industry in jeopardy by risking unnecessary federal attention, the newspaper reported. Caregivers, however, are resisting and suggest that they’re being targeted unfairly. They point out that their reach is already limited to a handful of patients, while the state’s eight dispensaries can serve as many patients as they wish.

CAN VETS BE PRESCRIBED MEDICAL MARIJUANA…? DEAR DOCTORS, I am a veteran who has recently returned from Iraq. A guy in my support group was talking about how he uses marijuana to help with his PTSD (depression in particular). Does that really help? Can I get in trouble with the VA and lose my benefits if I become a medical marijuana patient? Signed, Wondering Vet DEAR WONDERING, Thank you for your question. There are many veterans returning home, and many who have been home for years, who experience PTSD and have tried a number of treatments. When it comes to the science, the research on marijuana as a treatment for PTSD is very promising, but still in its early stages, primarily due to the barriers to marijuana research at the federal level. A lot of this research has been done is Israel. A 2009 study by Dr Irit Akirav showed that rats treated with marijuana within 24 hours of a traumatic experience successfully avoided any symptoms of PTSD compared to the untreated group. Marijuana has also been shown to address specific symptoms of PTSD, such as anxiety where research has shown that it can enhance fear extinction and retention during exposure based therapies. Some also find marijuana a more effective treatment for sleep problems than most prescription drugs, with fewer side effects. The key is to find a good doctor who can monitor you as you begin to use marijuana as a treatment if you so choose. In your state, Oregon, PTSD is a condition that can qualify someone as a medical marijuana patient with a recommendation from their doctor. Oregon has also recently approved marijuana possession and sales for those 21 and older.

(Courtesy of a Veteran Via Drug Policy Alliance)

Other states where you can qualify for a medical marijuana recommendation for PTSD are California, Massachusetts, Washington DC, Maine, Michigan, New Mexico and Nevada. Although PTSD is not an approved condition in Colorado, Washington, or Alaska, any adult 21 and older can obtain marijuana in those states. Here is where it gets tricky. Because the VA is a federal agency, doctors who work there might be reluctant to recommend marijuana. The federal government does not recognize marijuana as medicine, even though the state of Oregon does. The VA does have the discretion, in states where it is legal, to grant benefits to veterans who are also medical marijuana patients. But, this is carried out largely as a “don’t ask, don’t tell” policy and VAs in states where medical marijuana is legal but not widely accepted, might deny benefits to veterans who are found to be using medical marijuana. You live in a state with a progressive view of medical marijuana, but you might want to ask someone in your group who is a patient, if they have talked to the VA and how it went, and if they have a doctor they are working with. The decision to use medical marijuana is a personal one, and should be between the patient and their physician. However, be aware that the stigma against medical marijuana use and the conflict between federal and state law might put veterans receiving benefits at a disadvantage. Check out the group Veterans for Medical Cannabis Access for more information. Sincerely, The Doctors Dr. Malik Burnett is a former surgeon and physician advocate. He also served as executive director of a medical marijuana nonprofit organization. Amanda Reiman, PhD, holds a doctorate in Social Welfare and teaches classes on drug policy at the University of California-Berkeley.

ILLINOIS HANDS OVER MMJ DOCUMENTS AS PART OF LAWSUIT ILLINOIS HAS released roughly 13,000 pages of documents tied to its marijuana program – including applications from five businesses competing for cultivation licenses – to attorneys as part of an ongoing lawsuit over how the state awarded permits.

John Rooks, one of the lawyers who represents a company that sued the state over its licensing process, said it’s the first time the state has disclosed such information. The documents were provided to lawyers connected to the dispute but were not made public, according to the

Associated Press. The Illinois MMJ process has been fraught with controversy, including multiple lawsuits. Rooks told the AP that the secrecy-shrouded process has hindered his client, Chicago-based PM Rx, from discovering “what really occurred” when business license applications

were evaluated. PM Rx has in the past contended that “scoring procedures weren’t followed and background checks weren’t completed.” At least three other lawsuits have been filed, including one in which the plaintiffs allege that winners of licenses didn’t follow proper procedures.

IN THE CHRONIC NEWS ANOTHER CANADIAN CITY BEGINS CRAFTING DISPENSARY LAWS LAWMAKERS IN Victoria, British Columbia, are drafting their own bylaws to regulate the city’s medical cannabis dispensaries even though the Canadian government has banned such operations. Victoria’s city council approved a bill asking staff to draft licensing and zoning regulations for dispensaries, following a similar move to regulate medical marijuana stores in Vancouver. Under new regulations passed by Canadian officials two years ago, licensed cultivators must mail cannabis to MMJ patients or their healthcare providers, and storefront dispensaries are not allowed. But scores of dispensaries that existed before the new regulations went into effect remain in business in some cities, and new ones have even launched recently. More than 80 dispensaries have opened in Vancouver in the past two years alone, for example. Victoria police officials told The Canadian Press that law enforcement doesn’t “have time and energy to be running around busting 18-yearolds selling marijuana across the counter.” Canada’s health minister has come out against Vancouver’s plans to regulate dispensaries, saying police should enforce federal laws.

FORMER TOP KROGER LAWYER INVESTING IN OHIO MARIJUANA CAMPAIGN AN EX-ATTORNEY for grocery store chain Kroger has signed on as one of the investors behind a campaign to legalize both medical and recreational marijuana in Ohio. Paul Heldman, the former top lawyer for Kroger, on Friday announced that he is backing ResponsibleOhio, which has generated controversy with its plan to initially limit cultivation sites in the state to 10 and give major campaign backers primary ownership of those businesses. Heldman is investing in one of the companies that would own a cultivation facility, according to Cincinnati.com, along with a former design consultant, a New York City fashion designer, and a pair of descendants of President William Howard Taft. Heldman worked for Kroger for a quarter century before retiring last year. In a press release, he said one reason he is backing the initiative is because his son has epilepsy, which he hopes can be treated with MMJ. ResponsibleOhio has collected around 250,000 signatures of the roughly 306,000 it needs to make the 2015 ballot in November. A competing legalization campaign has also received preliminary approval from the Ohio attorney general. The new campaign, which would allow more cultivation sites, is being run by a group called Better for Ohio. The group’s measure now needs to be cleared by the Ohio Ballot Board before organizers can begin gathering signatures.

WA LAW PAVES WAY FOR MARIJUANA PACTS WITH TRIBES WASHINGTON STATE Gov. Jay Inslee has signed a bill that sets up a framework for his office to work with Native American tribes interested in growing and distributing cannabis. The newly minted law gives the state the authority to enter into agreements with tribes looking to join the marijuana industry, allowing the governor’s office to set up pacts covering everything from criminal and civil law enforcement, regulatory issues and research to taxes and dispute resolution. Tribes entering such agreements with the state would also have to adopt a tax structure that’s similar to the one set up under Washington’s recreational cannabis program, though there would be exemptions for sales “to the tribe, tribal enterprises, tribal member-owned businesses, or tribal members on marijuana grown, produced, or processed within its Indian country.”

June/July 2015

Some industry leaders have said in the past that because of their tax-free status, American Indian cannabis businesses would have an unfair sales advantage over their non-tribal competitors. The Washington State law seems to close that loophole, forcing tribes to charge the same state and local taxes as rec shops operating outside of tribal lands. The Warm Springs, Suquamish and Tulalips tribes, among others, have expressed interest in entering the marijuana industry, according to Northwest Public Radio (NWPR). The law seems to be a formality, as tribes don’t need permission from states to grow and sell marijuana on native lands after the Justice Department last year told U.S. attorneys to avoid prosecution of those that decide to enter the cannabis industry. Still, Suquamish Tribal Chairman Leonard Forsman said it’s necessary to avoid “any inadvertent gaps” between tribal and state laws.

…this procedure locks in the terpenes and the freshness of this flowers optimal potential. Welcome to OrientExpress. known as “Kind Bill,” this process was impossible to do prior to the invention of commercial grade closed-loop butane extraction systems. Instead of using dry plant material as is the norm for BHO extractions, the live resin process used fresh frozen plants, which were harvested only hours earlier; this creates a product which has the terpene profile of the live plant rather than the dried flowers (terpenes degrade and change as the plant is dried).

BEGINNING God created the Heavens and Earth and all that dwell therein, including Cannabis Sativa. What a magnificent day when the earth was old and humans were young, just about 10,000 years ago (8,000 BC) when early man made the discovery. He learned how to grow the cannabis plant and across scattered villages from ancient Taiwan to Mesopotamia these first growers stored hemp cord and seeds in pottery, and it is these artifacts that have been found today. The evidence suggests that these were the first men to use agriculture on Earth and it all started with Cannabis Sativa.

marijuana as a medical drug and documented its effectiveness in treating the pains of rheumatism and gout.

THE HEMP seed is called the most nutritionally complete food on earth. Yes its true, the cannabis sativa seed contains all the essential amino acids and fatty acids necessary to maintain healthy human life. Over next 4000 years Cannabis seeds were used for food throughout China and the far east. Eventually mankind discovered the rich fibrous plant could be turned into textiles and Hemp fabrics were used throughout China and Turkestan.

THE DIVINE FARMER, 4800 years ago in (2737 BC) the Great Chinese Emperor Shen Nung whose name literally means “Divine Farmer” became the father of Chinese medicine, he did extensive research on plants and recorded it in his treatise “On Herbal Medical Experiments Poisons”. He tasted over 365 different herbs and subsequently died from toxic overdose. However, before he left the planet, he noted the first recorded use of

IN 1500 BC both the Chinese and Scythians cultivated Cannabis for food and use it to weave fine hemp cloth.

1200 - 800 BC: Bhang is mentioned in the Hindu sacred text Atharvaveda (Science of Charms) as “Sacred Grass”, one of the five sacred plants of India. It is used medicinally and ritually as an offering to

Shiva who is one of the main deities of Hinduism. It is believed that since Lord Shiva is always in deep meditation, Bhang helps Him to stay in a state of complete bliss and concentrate. Today, there are 4-5 Million sadhus and monks (Holy Men) widely respected for their holiness. They regularly consume Bhang and smoke marijuana so that they can reach a blissful state and be like Shiva. 700-600 B.C.: The Zoroastrian Zend-Avesta, an ancient Persian religious text of several hundred volumes, and is said to have been written by Zarathustra (Zoroaster), the text refers to bhang as Zoroaster’s “good narcotic” (Vendidad or The Law Against Demons)

700-300 B.C.: Scythian tribes leave Cannabis seeds as offerings in royal tombs.

500 B.C.: Scythian couple die and are buried with two small tents covering censers. Attached to one tent stick was a decorated leather pouch containing wild Cannabis seeds. This closely matches the stories told by Herodotus. Hemp is introduced into Northern Europe by the Scythians. An urn containing leaves and seeds of the Cannabis plant, unearthed near Berlin, is dated to about this time.

The Scythians in 300 BC were among the earliest peoples to master mounted warfare. At a full gallop both men and women warriors used a double-curved bow, shooting over the horse’s left shoulder. Scythians came to dominate the entire steppe zone, stretching from the Carpathian Mountains in the west to the central China and the south Siberia in the east, creating what has been referred to as the first Central Asian nomadic empire.

Cannabis was an integral part of the Scythian cult of the dead, wherein homage was paid to the memory of their departed leaders. After the death and burial of their king, the Scythians would purify themselves by setting up small tepee-like structures which they would enter to inhale the fumes of hemp seeds (and the

resinous flower calyxes surrounding the seeds) thrown onto red-hot stones. In a famous passage written in about 450 B.C., Herodotus the first to make any mention of Cannabis in Western literature describes these funeral rites as follows: ...when, therefore, the Scythians have taken some seed of this hemp, they creep under the cloths and put the seeds on the red hot stones; but this being put on smokes, and produces such a steam, that no Grecian vapour-bath would

surpass it. The Scythians, transported by the vapour, shout aloud mourning their dead friend. 40 BC -33 AD: Jesus is born in Bethlehem, and he is anointed with very expensive perfume. Upon His crucifixion in Jerusalem, time is split in two. Christ (a Greek word) or the Messiah (an Aramaic word). Both words mean “the anointed.” Sulah Benet (1903–1982), was a Polish anthropologist -The reason Benet’s writings have attracted some modern attention is her claim that the herb known as kanehbosm or kneh-bosm mentioned in the Hebrew Bible may relate to religious use of cannabis. Kaneh-bosm is listed in the Book of Exodus as one of the ingredients of the holy anointing oil and was used in ancient Jewish religious rites. In the book of Exodus, Moses receives the instructions for making and distributing the “hemp” enriched holy oil. Then the Lord said to Moses, “Take the following fine spices: 500 shekels of liquid myrrh, half as much of fragrant cinnamon, 250 shekels of qaneh-bosm, 500 shekels of cassia--all according to the sanctuary shekel--and a hind of olive oil. Make these into a sacred anointing oil” (Exodus 30: 22-33). The anointing of Jesus is a subject of considerable debate. Sulah Benet’s claim has not found support in the academic community. SipaBoard Smart Paddleboard

Xeric Halograph Watch Sure, it has two hands that move around the dial in a circular fashion. But the Xeric Halograph Watch is far from your average analog timepiece. Instead of placing markers around the circle, it uses a series of arc to indicate the hours and minutes, with the hands sporting two indicators a piece for the inner and outer bands. The watch is powered by a PTS S-01 automatic Chinese-made movement visible through openings in the dial and case back, the face is covered by a domed crystal, and the case measures in at a sizable 46mm. Available in a variety of colors with matching straps.

Most “smart” products add in app compatibility and call it a day. The SipaBoard Smart Paddleboard is intelligent in several different ways. For one, it features an electric jet propulsion engine built into the board that provides up to 3.5 knots of assistance. It’s also inflatable, so it’s easy to pack to and from the water, and the jet doubles as a compressor that can inflate

the board in six minutes. And yes, it’s smart in the common sense, too, with a Bluetooth 4.0 connection that lets you control the speed from your phone or watch and gives you an alert when the battery hits 50%. Yet there’s really no need to put your electronics at risk, since there’s also a wireless control built right into the paddle.

LTD Smoking Pipe Rugged and dependable yet surprisingly sophisticated, LTD Smoking Tools are an upgrade over your standard glass pipe. The steps go something like this: put some weed in the basket. Drop in some butter. Hit the butter button. That’s pretty much it. It can also make oils or tinctures, is self-cleaning, and features a stainless steel and black build that won’t scream “stoner!” if you happen to leave it out on the counter. We guess you could also use it to infuse stuff with other, more kid-friendly herbs like oregano or rosemary, but that seems like a huge waste of potential.

Viva La Vape Revolt Vaporizer Featuring a dynamic glass ceramic heating element that has been designed from enhanced patented technology of older models, the Viva La Vape Revolt Vaporizer is a state of the art vaporizing device. The vaporizer’s Ground Glass Technology (GGT) allows for a hands free vaping experience once the device’s digital thermostat has been turned, and comes equipped with a replaceable fuse for an optimal vaporizing performance.

Our preferred method of preparing cubes is to use “Azos” from “Extreme Gardening” If you’re using a “Clone Machine” remove filter to help prevent clogging

Timing and sharp tools are key to move fast but safe, scalpels leave nasty cuts if not careful!

“PRO TIP” • If cuts are droopy or you have a ton to do, cuts like refrigerators. Ganja Goo

Just because you are eating something with marijuana in it doesn’t mean it has to taste like you are eating something with marijuana in it. It also doesn’t mean it has to be the typical brownie. Now don’t get me wrong, everyone loves a good pot brownie, but I feel like we reach a point where homemade pot brownies are just not appealing. Everything gets tried when it is the only thing on the menu. When I was at one of my local dispensaries the other day I decided to try a new edible. Medicated Marijuana Taffy. Now I had seen the taffy in a couple of dispensaries but always shied away from it. I figured it wouldn’t be very strong; it would be hard like Laffy Taffy and it would taste awful. I decided to go ahead and spend the $15 on a box of Purple Passion Ganja Goo Taffy. Now there are few different flavors of taffy; Cherry, Sour Apple, Purple Passion, and Chocolate, I chose Purple Passion hoping it would have a grape flavor to it. Each taffy is a hybrid, anytime blend and with 1 gram of flower in each box of taffy. I go home and the first thing I did was try the taffy. Now no one at the dispensary had mentioned how much of it to eat. Should I eat the whole thing, split it in half, cut it in ¼? I figured I would cut it in half and give it an hour to start working. I open the box and unroll the taffy, this taffy is the softest taffy I’ve ever had and it smells amazing, like grape just what I had hoped for. I rip the taffy in half, eat it and save the other half for another day. The Ganja Goo did not taste as atrocious as I thought it would.

Yes you could still taste a hint of Marijuana but it was not like you were chewing a handful of flowers either. Twenty minutes later and I am high as I have possibly ever been. However, I am not so high where all I want to do is lay down, eat and sleep. The taffy had given me an active, euphoric high. I had a bunch of chores that I needed to do, the taffy had taken away any pain that I had allowing me to complete the chores in no time. Truthfully, the best way to explain the effect it had on me would be to imagine what it would be like to take Adderall and smoke weed at the same time. I had a great head and body high yet I was focused, ready to work and take on anything that could have come my way. It wasn’t such an active high where it kept me awake though, I was able to sleep and sleep well that same night. In fact when I woke up the next day, after about six hours of sleep, I was still fairly high. I would absolutely recommend Ganja Goo, medicated Marijuana taffy to anyone who is looking for an incredible high, looking for an unusually fast working edible, and wants to relieve any sort of pain. Yet, that being said I would advise anyone who is eating the Ganja Goo for the first time to begin with ¼, you can always eat more later on.

MUSIC

WRITTEN BY JOHN OLIVER

ELVIS BEFORE NOON Elvis Before Noon is an East Valley favorite to an audience that had to be reminded of just how fun great live music can be. A forerunner in the early 90s revival currently sneaking up on the music scene, EBN knows the score when it comes to writing their brand of power pop with a Southwestern seasoning reminiscent of the bands that put Phoenix on the map. Their set lists are also full of a wide range of favorites, ranging from spot on Johnny Cash classics to whimsical Weezer cuts, Motown, rockabilly, and The Beatles, maybe even an Elvis song or two. There’s just about a little something for everyone and Elvis Before Noon is best described as a “rockin’ good time.”

should come as no surprise because Daylon Greer, the band’s primary vocalist and songwriter has a a true love for the bands that put Phoenix on the map years ago. Tunes by The Refreshments, Roger Clyne and The Peacemakers, and Gin Blossoms are always on the set list and Greer’s own origi-

nals are perhaps a little reminiscent of the desert sound that Tempe made famous. All of this is even more authentic with the occasional presence of Scott Johnson on lead guitar. The Gin Blossom dedicated some downtime from the infamous multi-platinum selling band to bending some strings with Elvis Before Noon for

most of the band’s formative years and the recording of the EBN’s first album. Looking back, Johnson, as the story goes, stumbled upon the talented Greer when he randomly walked into a bar and heard Greer performing a Blossom song. Enough said. Shortly thereafter, Daylon added longtime friend “Ringo” on drums, If there was a persona for the vintage culture as well as pop culture, Ringo is a walking testimony to being a manicurist for these facets in our lives. As a Beach Boys and Beatles fan (duh) he is the epitome of preserving what is classic but yet bringing it into the forefront of our lives. Typically, thru his sense of humor. One day, Mr. P-body--a local DJ with virtually much of the Valley’s resume under his belt came to see the band at The Vig. No one knew that he just happened to also have a background of playing in the Tempe live music scene. Coming out of the audience with a bass in tow, he sat in with the three, originally “just for fun.” He ended up staying and made this website. Born at The Vig Arcadia that fateful Sunday, and named in a Valley Ho Hotel room months later, Elvis Before Noon is truly a “happy accident” that just.. happened. Somewhere along the line, Roger Singleton, another talented friend would also play lead guitar after years of gigs that preceded EBN. Presently, He is amazing as a sonically versatile guitarist that “can play anything” offer harmonies, and bring the flavorful sizzle to a show with a perfect sear. To this day, the sponta-

neous energy of the band is an ever-lasting quality. The band often remind audiences of just how fun great live music can be. Their setlists are also full of a wide range of favorites as well, ranging from spot on Johnny Cash classics to Motown musings and whimsical Weezer cuts with Greer often serving as a virtual impressionist, doing many voices with amazing accuracy. There’s just about a little something for everyone and Elvis Before Noon is best described as a “rockin’ good time.” Most recently, Elvis Before Noon has garnered gigs at Hotel Valley Ho, Martini Ranch, Coach House, W Hotel, The Phoenician, and a variety of private and special events such as Phoenix Open’s Birds Nest, Four Peaks Brewery’s “Randomonium” Festival, Pre-Thanksgiving Bash at Montelucia Resort, the 20-30 Club’s “Niteflite,” Scottsdale Culinary Festival, AZ Cardinals Big Red Rib Festival and Great Lawn gigs, and Viva Las Vegas. The band has also recorded a promotional song for a major ad firm representing Valley Metro Light Rail garnering radio and media attention. Additionally, the band has just recorded 10 original Greer penned songs at Uranus Studio which is owned by Gin Blossoms frontman, Robin Wilson. Greer’s songs are so well written, so radio ready, that they are indistinguishable from the crowd pleasing covers. It’s available on iTunes now. The attainable goal is that other bands will one day cover Elvis Before Noon songs.

Q&A

Sarazen Brooks How long have you been an artist? 6 years full time, but I have studied art my entire life.

Who’s been your biggest influence?

I have learned a lot from so many people in my life. But I would have to say my mentor James Picard. I’m still recalling lessons he taught me years ago that I didn’t fully comprehend at the time.

What’s your favorite style of art?

There isn’t one specific style I prefer over another. There is just a certain type of energy that causes me to gravitate towards a piece and resonates with me.

ARTIST NAME: Sarazen LOCATION: Scottsdale, AZ

BLAZED420

If you could be anywhere in the world right now where would you pick? Arizona

What is your most memorable life moment?

The car accident I was in around the spring 2010. I was rear ended at high speed, while being stopped at a red light. It has impacted and sometimes rules my life. I now live with a few chronic pain conditions and get injections every few months. The accident is both a blessing and a curse. It expedited my art. I was already mentoring with James at the time and thought a career as an artist was years away. It caused me to stay home mostly for 2 years, and I spent it all painting. It also has caused me to have a new-found appreciation for all the little things. Everyday I can paint and do the things is such a blessing. In my first month recovering I sold my first 2 commissioned works for more than double than my job. I never returned back to work.

If you could meet anyone dead or alive who would that person be? Damien Hirst

What do people tell you that your best quality is? My ability to think creatively

Do you have any tattoos?

Yes I have a skull tattoo on my middle finger. I got it at a tattoo party…. probably not my best life choice, but more tattoos to come.

Tell us something that no one knows about you? I dance and paint in my underwear all the time.

If you could be anyone else who would you be?

Carlos Castaneda would be

pretty mind blowing… him or Angelina Jolie her life seems ok ;)

What’s you most valued possession?

I am currently in the process of selling all my belongings. It has been a very strange and freeing process. I don’t feel an attachment to material possessions right now. If had to answer I would say my bronze Buddha meditation statue of Sitara. I place her where I am painting, or working to unblock obstacles.

Tell us about your suspended art project.

I am currently working to put together a performance show that is pretty high energy. I create a piece of art live and suspended by a harness at the waist while doing back-flips and spinning. This geared towards venues and private events that with music or Djs. I have trained with The Underground Circus and performed for a large event in Whistler. The energy that came off the crown was electrifying.

If you could be Prime Minister what is one thing that you feel you could change? I would give people back more of their freedoms and privacy. I feel very strongly that is something that is quickly being stripped from us.

How often do you freestyle draw new designs and concepts?

Almost every time I create which is also why I have ventured into so many styles. I find it very limiting to only create one

type of art. There is so much freedom in trying something new. There is a chance it will go terribly wrong but also the chance to out do your self. I find it very exciting.

What are your plans for the future?

Life really does happen as your making other plans. At the moment, I would say large-scale interactive installations… I have a lot of things I have yet to create

Who is your favorite artist?

Basquiat, his movie moved me so much to drop out of my final year of college. I was studying human kinesiology and felt deep down it was not the right path. Next day I called my mom, who also an artist, if she could get me a canvas and paint. Within months I finished the smallest little painting and knew I had found my passion. The following next week I landed the mentorship with James through a wonderful twist of fate. It all happened very fast.

THE 280E CANNABIS CONUNDRUM

IF

you are in the Cannabis industry and are not already familiar with IRS Code section 280e, then you are likely going to face a rude awakening this tax season. Even with all the noise about this issue, it is still surprising to find operators that are not paying attention to some basic business principles such as knowing how costs (in this case taxes) will affect their business. It doesn’t mean that you have to become a CPA because the rules are fairly straight forward and there is significant literature addressing the topic. However, using a trusted advisor to navigate areas of unfamiliarity (taxes and otherwise) would be the most beneficial way to insure that that you don’t go out of business due to the burden of unexpected taxes or worse, end up in jail ala Al Capone. First, let’s understand the law: Internal Revenue Code section 280e specifically states “No deduction or credit shall be allowed for any amount paid or incurred during the taxable year in carrying on any trade or business if such trade or business (or the activities which comprise such trade

40

BLAZED420

or business) consists of trafficking in controlled substances (within the meaning of schedule I and II of the Controlled Substances Act) which is prohibited by Federal law or the law of any State in which such trade or business is conducted.” Whew…what does that mean? The IRS is a group of clever individuals whose job is to maximize revenue to the United States by taxing income. They are not concerned whether the income was derived legally or illegally, but whether you pay your taxes on the income generated. Federally, Cannabis is still a controlled substance and illegal and therefore falls under the provisions of IRS Code section 280e. Per the provision, unlike “ordinary” companies that are able to deduct expenses in determining taxable income, 280e related entities (Cannabis being one type) cannot deduction normal and ordinary operating expenses. The result is that a Cannabis related entity will be denied these deductions, will report higher taxable income and of course pay more taxes. This is where many operators are getting themselves in trouble. They fail to realize and account for the ad-

June/July 2015

ditional tax burden that will be imposed and then either don’t have the cash to pay or simple didn’t know the law and fail under audit. Under 280e Instead of paying a tax rate of 30% or 40% a Cannabis business might end up paying 60% to 90% in taxes. Second, understand your cost of goods sold: From a retail standpoint Cost of Goods Sold (COGS) are the costs that a business incurs such as materials, certain labor and the wholesale price of goods purchased that are subsequently retailed. From a grower standpoint, COGS can include additional components that are directly related to production such as seeds, nutrients, electricity for grow lighting, supplies etc. COGS is considered an adjustment to revenue as opposed to an expense deduction and as such does not fall under the provisions of 280e. Consequently, while a Cannabis company cannot deduct operating expenses, it can adjust revenue for cost of goods sold. Therefore, it would be prudent for an operator to have a good understanding all of the components of COGS. Third, develop a strategy:

Given that Cannabis related entities are limited on expense deductions but can adjust for COGS, in order to minimize the tax burden, hiring professional advice is a relatively small expense when compared to the potential exposure. That being said, here are a few tips that each Cannapreneur should consider and discuss with their trusted advisor: Diversify your services – consider offering additional services such as Yoga, or meditation, or stress counseling. You may be able to allocate some of your operating expenses to these other services and take them as deductions against these goods and services. Use IRS Code 263a to capitalize costs to inventory – Code Section 263a allows an organization to capitalize certain expenses which then become a component of inventory. Once the inventory is sold and run through COGS these previously disallowed expenses now become an adjustment to revenue (as opposed to a disallowed expense) as a component of inventory and COGS. Correct legal entity – A regular S-Corp is required to pay a fair wage to the owners and operators of the enti-

ty, yet these wages would be considered a non-deductible expense under 280e. On the other hand, a Limited Liability Corporation (LLC) is not required to pay the owner a salary and instead the earnings of the LLC are the owner’s taxable earnings. The owners would report net income allocated as opposed to salary and therefore there is no salary expense that would be disallowed. Fourth – Stay well informed of potential law changes: In 2011, a bill called “The Small Business Tax Equity Act” was introduced to congress. Essentially, the bill attempted to resolve the difference be-

tween state and federal law allowing for an exemption from section 280e for medical marijuana entrepreneurs as long they were in compliance with State law. The 2011 bill died and was reintroduced in 2013 emphasizing all marijuana businesses but it died as well. In April 2015, a pair of congressmen (Rep. Earl Blumenauer and Sen. Ron Wyden of Oregon) have reintroduced the bill for a third time. This legislation is gaining widespread support by organizations such as Americans for Tax Reform, the National Cannabis Industry Association, Drug Policy Alliance, Marijuana Policy Project, Amer-

2

icans for Safe Access, and NORML. Given the amount of attention and support this topic has garnered, there is hope that “third time’s a charm” and marijuana businesses will finally become exempt from 280e. However, with congress one never really knows. Finally – change is a constant: Cannapreneurs need to recognize that the Cannabis industry is going through growing pains in the same way that many other first time industries have developed. There are many factions, special interest groups and profiteers that are each trying to influence the future

MARIJUANA RECIPES

HOT BUTTERED BHANG Ingredients Half a cube (1/8 pound) of butter or ghee 1/3 - 1/2 oz. of marijuana leaves 8 ounces of vodka 1-2 pinches Cardamom seed Honey

Method 1. In a pan, melt the butter or ghee. Break up the mari-

FLAVOURED BHANG DRINK Ingredients 2 cups water 1 ounce marijuana (fresh leaves and flowers of a female plant preferred) 4 cups warm milk 2 tablespoons blanched and chopped almonds 1/8 teaspoon garam masala (a mixture of cloves, cinnamon, and cardamon) 1/4 teaspoon powdered ginger 1/2 to 1 teaspoon rosewater 1 cup sugar

Method 1. Bring the water to a rapid boil and pour into a clean teapot. Remove any seeds or twigs from the marijuana; add it to the teapot and cover. Let this brew for about 7 minutes.

2. Now strain the water and marijuana through a piece of muslin cloth, collect the water and save. 3. Take the leaves and flowers and squeeze between your hands to extract any liquid that remains. Add this to the water. 4. Place the leaves and flowers in a mortar and add 2 teaspoons warm milk. Slowly but firmly grind the milk and leaves together. Gather up the marijuana and squeeze out as much milk as you can. Repeat this process until you have used about 1/2 cup of milk (about 4 to 5 times). Collect all the milk that has been extracted and place in a bowl. By this time the marijuana will have turned into a pulpy mass. 5. Add the chopped almonds and some more warm milk.

Grind this in the mortar until a fine paste is formed. Squeeze this paste and collect the extract as before. Repeat a few more times until all that is left are some fibers and nut meal. Discard the residue.

6. Combine all the liquids that have been collected, including the water the marijuana was brewed in. Add to this the garam masala, dried ginger and rosewater. Add the sugar and remaining milk. Chill, serve, and enjoy.

juana leaves into the pan. Once the butter and leaves are hot and sizzling, add in 8 ounces of vodka. Be careful that the hot butter doesn’t make the mixture splatter. Pour the Vodka in swiftly to avoid problems. Continue boiling the mixture for roughly 30 more seconds, stirring simultaneously. Add a pinch or two or powdered cardamom seed while boiling.

2. Once mixture has been boiled to desired amount, strain the fluids and mash the contents through a strainer. You should use a tool like a spoon to try and squeeze all the juices out. Throw away the mush, or reboil to try and bet more juices out. Pour the liquid into two 4 ounce wine glasses. This Recipe serves two people. This is an extremely efficient method for extracting the THC. Add honey to taste and enjoy as a hot chocolate-esque Drink! The effects of the recipe will be felt within 15 minutes . Prepare to have a good time!

PEANUT BUTTER SCOOBY SNACKS Ingredients 2 cups flour 2 eggs 1 cup of peanut butter chips 1 tbsp. vanilla 1/2 cup cocoa 1/2 cup sugar 1/4 pound (1 stick) butter 1 tsp. walnut extract 1 oz. of finely ground cannabis or 3.5 grams of Kief from flower

Directions 1. Preheat oven to 350 degrees. 2. Combine all ingredients in a large mixing bowl. 3. If there is not enough liquid to mix all ingredients

after 5 minutes of stirring, add a tiny amount of milk to aid in mixing of remaining ingredients.

4. Taste batter before cooking and adjust amount of sugar to your liking. 5. Place on a lightly greased cookie sheet and bake for

8 to 12 minutes, depending on how large you made your cookies.

6. Can be cooked for a shorter time for chewier cookies, or a longer time for drier, crisp cookies.

ASK THE GROWER with Chad King Where are you from originally?

I grew up on the East Coast in New Hampshire. I have lived all over though. It has been wicked fun to see the changes in marijuana all over the country. Now I’m living the dream in Arizona. Tell us about your 1st plant experience seeing or growing? I got into plants about 10 years ago. I learned and waited until one of the first medical marijuana initiatives passed. My first try in growing was Deep Water Culture (DWC) – which is basically suspending the roots of the cannabis in nutrient rich-oxygenated water. A great method but maybe not a great starter method.

What’s your favorite strain to grow and smoke?

Favorite Flavor is actually a tough question.

The fun thing about cannabis flower is all the different strains and the effects they produce. Beautiful nugs can look different-smell different, taste different, smoke different. Its alternative medicine, with lots of alternatives-flavors. I like variety, and that’s what I like about cannabis. Right now though, I love Blueberry Muffin. It’s an *H4L grow of Blueberry, A Juicy Fruit crossed with a Thai - As a plant, she has been cooperative. It’s a flower that is sweet and sedating. Perfect for desert.

What’s your opinion on legalizing cannabis for recreational use in Arizona?

Personally, I think everyone that wants access to cannabis should have it. I support adult use and I support children who need it for medicine with parents’ consent. I like working for Health for Life (H4L) because as a company they are keeping a focus on the Medical Marijuana. When…cough.. cough… If “recreational use” comes around- we will serve those voters too. But we will serve them differently. Different flavors for different demographics.

Do you have a favorite style of Growing cannabis medium, dwc, hydro, soil etc.?

I like DWC, its fun. But I probably prefer soil. Right now, I am growing most of

46

BLAZED420

June/July 2015

H4L plants Hydro- again, it changes, depending on environment and access to resources. While we have a system that works, we are always trying to find ways to make it better. Variety is the spice of life.

If there was one product that you wanted to have what would it be and why?

Are you asking in life? In growing? Or on the industry? - As a grower I wish for many things, like equipment, tools, cleaning alternatives, and I always wish them to be organic and safe for the plants and people. Maybe that is unrealistic. In the industry- I am really excited about CBD plants and products. THC has been known, examined and scrutinized for a while- it’s fun to see other cannabinoids help re-excite people about this plant. The data and research looks good for a number of medical conditions. I have seen a few new CBD products on the market- with and without THC. Anti-Aging creams, Anti-Oxidant CBD Water Mixes and Bananaca like sprays- a variety of ways to use this medication without smoking and a variety of ways I get to grow this plant. This plant as a medicine could produce a lot of great products.

How do you best control bugs?

That’s a million dollar question. We strive for an ultra-clean facility. We wear

scrubs in the facility and they never go outside. Of course we do organic preventative spraying and maintenance. There are a few options for organic pest and insect management. But any gardener or farmer knows- plants attract bugs and bugs are bugsand the garden is messy - all you can do is try your best to keep it clean!

How long have you been growing?

It’s been about 10 years – um, whenever it became legal. Time is a funny thing- I lost track of the date somewhere ;). But it’s been a while. And I am really grateful for the opportunity to do this legally. My family watches me do this and they are amazed. It’s a great opportunity. I know they are proud.

Do you currently grow for a dispensary or just for yourself which one?

I’m growing for a State Licensed Dispensary. Health for Life in Mesa Arizona.

Do you do concentrate extractions what’s your favorite method or strain? I have made my own extractions. I personally don’t make them anymore but fortunately we do have an amazing Concentrate Production Team at the Dispensary I am growing for. They are making some innovative products and they make it my preferred wayCO2. (Keeping it clean!). My current favorite flavorthe Blueberry Muffin- also

makes for a great concentrate! I think the extraction machine is wicked cool but, I like working with the growing plants.

What’s your best harvest per light indoors and biggest plant outside?

Yup, All Concentrates. Wax or Shatter- it doesn’t matter. I like the oils, cartridges, the vape pens are a great product. While I love the smell of the plant- I know a lot of people don’t. It’s a cleaner way to inhale and has a less intrusive smell.

I really haven’t done a lot of outdoor growing. I have seen some great outdoor grows, and I like the idea. But most of the teams I have worked with do this insidefor a number of reasons. It works.

Do you enjoy wax?

Best harvest was a Blue Dream or a Bubba Kush - I got about a pound a light.

What is one of your favorite quotes?

“[They] were so preoccupied with whether or not they could, they didn’t stop to think if they should.” – Jurassic Park.

Favorite music artist while you grow?

Oh this is a fun one! I listen to what the grow team and/ or the plants want. We listen to all sorts of music. Of course, many Growers will say the plants, the ladies, re-

spond to the music- it makes them happy and healthy. We like to play a variety- to make sure all the ladies get what they want. We listen to all sorts of music. Honestly, it could be 70s or 80’sPop – a love song, or it could be Dance Music, Rock n Roll, you name it. We don’t listen to much country right now and rap only when we are feeling feisty. When we need to get everyone pumped-I usually go to the Guardian of the Galaxy Sound Track.

FLOWER OF THE MONTH

Available at

Strain Name: Jack Flash

nant

The Jack Flash, Sensi Seeds started out with the Jack Herer’s gene pool and then crossed it with Super Skunk and Haze. Jack Flash offers an earthy citrus aroma, impressive yields, and the active cerebral legacy of her Jack Herer parent. This hybrid gets its name from its lightning-fast onset which may prove useful to patients needing immediate symptom relief.

Looks: Soft but dense buds.

Strain Attributes:

Grade: A Type: Hybrid – Indica Domi-

Very frosted, lightly covered in light orange hairs. The buds look a little bit bubbly.

Smell: Very spicy scent that just barely burns the nose if you take a big inhale of it.

Happy – 99% Energetic – 98% Euphoric – 96% Creative – 60%

Flavors:

Taste: If you can imagine a fruity cake batter (uncooked) then that pretty accurately describes the flavor here.

Pungent Sweet Pine

Effects: The buzz for this bud comes on hard and fast. Eye

What others have to say about Jack Flash:

movements slow down slightly. This is another very relaxing buzz. It feels like waves of relaxation are radiating down through my body from my head. Slight body euphorics, with small tingling sensations all over my body. This is an exceptionally good body high, compared to some other indicas that I’ve reviewed in the past. Thought processes seem to be slightly slowed as the high wears on, but definitely not to the point that I am not functional.

Potency: Effects lasted 1.5 – 2.5 hours

48

BLAZED420

June/July 2015

“It gives a productive high. Nice in the morning with your coffee. Energy, focus, lots of smiling and laughing...I’ve heard there’s two versions. This is the sativa dominant strain and it’s wonderful.”

“The body buzz was immediate and light, giving that extra buoyancy to movement that a great high will have occasionally. Per usual, it wasn’t a strain that had me particularly “munchy” but it gave me plenty of cotton mouth, as I surprised myself after noticing my water jug was empty about 45 minutes in.”

WRITTEN BY: BILL BROTHERS

A sit down with

CARLOS ALFARO for the Campaign to regulate Marijuana like Alcohol… BROTHERS: CAN YOU TELL

MORE ABOUT THE MPP – ARIZONA PROJECT?

ALFARO: “It has been a long and deliberative drafting process involving a diverse group of stakeholders. There were some bumps in the road, but in the end everyone came together to produce the best possible law for Arizona. We are united in this effort to end marijuana prohibition and replace it with a system in which marijuana is regulated and taxed similarly to alcohol. In summary, the Regulation and Taxation of Marijuana Act would allow adults 21 years of age and older to possess and privately consume and grow limited amounts of marijuana (it will remain illegal to consume marijuana in public); create a system in which licensed businesses can produce and sell marijuana to adults and

establish a Department of Marijuana Licenses and Control to regulate the cultivation, manufacturing, testing, transportation, and sale of marijuana; as well as provide local governments with the authority to regulate and prohibit marijuana businesses.”

BROTHERS: WHERE DO

YOU SEE THE MMP – ARIZONA PROJECT IN THE YEAR?

ALFARO: “Victorious by 2016! Basically we have to contest with the PR battle against the negativity that has been labeled for so long. Reform is a battle, but what we have seen in all the other states that has made it legal has nothing but a positive outcome. Marijuana is safer than alcohol and we have all the data to back this up; so I think once we educate the masses we will be a legal marijuana state.”

FAST FACT: Any adult caught with more than an ounce of weed but less than 2 1/2 ounces can be slapped with a $300 fine and community service, but the newer measure says having up to eight ounces is only a Class 3 misdemeanor, with a $500 fine and the possibility of 30 days in jail. The earlier one keeps the law above 2 1/2 ounces the way it is, with possession being a felony.

52

BLAZED420

June/July 2015

BROTHERS: WHY DO YOU FEEL THAT THE LEGALIZATION OF MARIJUANA WILL BE BENEFICIAL TO THE STATE OF ARIZONA?

ALFARO: “Economical first and foremost. We’ve see in Colorado over 700 million in revenue the first year alone. That and, when it’s legal in Arizona, this same formula will create jobs, stimulate the economic growth, as well as give eighty percent to public education and the remaining twenty percent to healthcare.” BROTHERS: WHAT HAS BEEN THE BIGGEST CHALLENGE SO FAR WITH YOUR PURSUIT OF LEGALIZATION?

ALFARO: “Old school mentality that marijuana is dangerous – so putting out the positive message that people understand. It’s not going to melt your brain and the fact of the matter is that marijuana is safer than alcohol. If we can keep the positive messages out there I thing that in the end this challenge will be overcome.”

and add a 15% sales tax that will go towards education and public health. There will be a commission that regulates this and will allow any house hold to grow up to six plants per person and twelve per household legally. The municipality will have local control.”

BROTHERS: TO STAY WITHIN THE LAWS IF 6 PLANTS ARE LEGAL WHAT HAPPENS AT 7 PLANTS?

ALFARO: “The commission will have the authority to come in and fine the individual like a parking fine up to three hundred dollars and confiscate the plants. As well an additional one hundred per plant and if over six, and if you go larger like one hundred plants that would be a felony, and a fine per plant. A felony comes in after 2.5 ounces if you’re transporting it as well.” About Carlos Alfaro:

PLEASE SUMMARIZE THE REGULATION OF TAXATION ACT?

Carlos Alfaro is a student of Economics and Philosophy at Arizona State University. As a young activist in Arizona, Carlos organizes professional lectures, programs and public talks to promote ideas about free markets, civil liberties, and education. He is the former President of the ASU College Republicans and Executive Board Member of the Students for Liberty.

ALFARO: “Absolutely - it will pretty much mirror what Colorado has done

Carlos was born in Guadalajara, Mexico, and currently lives in Scottsdale, Arizona. He is fluent Spanish.
