The Huntington Town Board is taking a shot at regulating what some say is an uptick in deer by hosting a public hearing on a plan to allow seasonal bow hunting on Eaton’s Neck. It was a windy summer morning at the Northport Yacht Club on Monday, where more than 100 sailors from age 8 to 17 rigged their own boats and hit the water to race at the 20th Annual Make-A-Wish Junior Sailors Regatta. Sailors hailed from the Northport Yacht Club, Centerport Yacht Club, Huntington Yacht Club, Cold Spring Harbor Beach Club and Huntington YMCA, and all gathered to raise funds for the Make-A-Wish Foundation, a nonprofit organization that grants children with life-threatening illnesses wishes within their lifetimes.

For the Doherty family, which has headed the regatta for nine years, the Make-AWish Foundation has a very personal significance: a family friend who died from a heart condition at age 16 was a Makea-Wish recipient and was able to take a trip to Walt Disney World Resort thanks to the organization. Keara Doherty, 17, who has been the top fundraiser all nine years since being involved with the event, said that once she ages out of sailing in the regatta this year, she plans to become more directly involved with the Make-A-Wish Foundation and to help her dad, Bob, who is inrEgatta continued on page a26

LIPA, school and town fight over power plant advances State appellate court sides with municipalities in rulings By Rohma aBBas

Huntington Town and NorthportEast Northport school district’s fight to knock the lights out of a Long Island Power Authority lawsuit that looks to drastically decrease how much the utility pays in taxes on the Northport power plant recently got a big boost. Last week, a New York State appellate court ruled in favor of the municipalities, clearing the way for both to go to trial against the utility and engage in pretrial depositions and discovery. In 2010, LIPA filed a tax certiorari lawsuit against the town, claiming the town greatly overassessed the Northport power plant and that it should be paying millions less in taxes. Northport-East Northport schools, along with Huntington Town, filed companion lawsuits in May 2011 that claimed LIPA didn’t have the right to file to reduce its taxes and that it breached a 1997 contract promising it wouldn’t. In

2013, a New York State Supreme Court justice upheld the district and town’s rights to sue LIPA and National Grid, and last week’s court ruling upheld that lower court ruling. LIPA sought to have the school district tossed out of the suit, but the district claimed it was a legal third-party beneficiary of a 1997 power supply agreement between LIPA and the Long Island Lighting Company. Last week’s court ruling upheld that claim. It cites a 1997 letter from LIPA to the Nassau-Suffolk School Boards Association, to which Northport-East Northport belongs, that upon the issuance of a 1997 power supply agreement, “LIPA will immediately drop all tax certiorari cases against all municipalities and school districts,” and that “neither LIPA nor LILCO will initiate any further tax certiorari cases on any of their respective properties at any time in the future unless a municipality abusively increases its assessment rate,” as “spelled out in the [PSA].”

Skipper’s Pub of Northport Village has set its sights on the sky with plans to create rooftop dining at its Main Street eatery — but the proposal saw a bit of grounding by village zoning officials and residents on Wednesday, July 29. Gas station, store plans rev up in Northport By Rohma aBBas

The entrance to Northport Village off of Route 25A could be in store for a face-lift. Long considered an eyesore by some, the corner of Woodbine Avenue and Route 25A is the subject of a zoning board application for a gas station and convenience store. Applicant Edward Clark, of Babylon, and his architect Harold Gebhard, of Lindenhurst, are seeking area and use variances to move forward with the plan, but the zoning board wants more information — particularly on traffic impacts — following a public hearing on the proposal last week. Currently, a vacant white building that was once a gas station and auto repair shop sits on the property. The applicant is seeking to rehabilitate the current building, add a canopy, gas pumps, a convenience store and eight parking spaces. If approved, a maximum of six cars could gas up at a time. Clark said he’s been in discussions with BP to be the new gas station.

The convenience store would sell soda, coffee, packaged foods, bread, milk and more, but there would be no food preparation on site, Clark said. He said he needs the convenience store to offset the cost of gas. Zoning board members expressed some concern about the appearance of the project, especially the size of the convenience store and the height of a proposed canopy atop the gas pumps. Clark and Gebhard said from its peak to the ground the canopy would be about 18 feet high. Zoning board member Arlene Handel said she was concerned about the height of the canopy obscuring a “historic entry point” to the village. “It’s very much an important part of the character of the village,” she said. She added that a tall canopy “is really going to cut upon the view.” ZBA Chairman Andrew Cangemi had a flurry of questions about the project that were mostly traffic-related. He wanted to know the number of cars the project is anticipated to generate during hours of operation and its

peak hour volumes, and how the lighting would look. Some residents in the audience expressed dissatisfaction with the proposal and questioned whether the community needed another gas station. But Cangemi pointed out that the site needs work and a gas station had already existed there. “We understand something’s got to go in there,” Cangemi said.

Clark said he’s been trying to move forward with developing the site for several years and called the long process a “nightmare.” “I’ve been paying rent, real estate taxes on this property for three years to get to this point now,” he said. The public hearing will be held open until Sept. 16. Cangemi asked the applicant to come back with a traffic study.

Pedestrian injured in crash Man seriously hurt in Huntington Station crash Saturday By Elana Glowatz

A pedestrian was seriously hurt on Saturday night, Aug. 1, as he tried to cross New York Avenue in Huntington Station. The Suffolk County Police Department said 20-year-old Antonio Molina was hit by a Jeep on the road, just north of East 18th Street, shortly before 11 p.m. and is now in serious condition at Stony Brook University Hospital.

The 2002 Jeep had been driving north on New York Avenue at the time of the crash, police said, and its 26-year-old driver was not hurt. Both the pedestrian and the driver are Huntington Station residents. Police impounded the Jeep for a safety check. Detectives from the SCPD’s 2nd Squad are investigating the crash. Anyone with information is asked to call them at 631854-8252.

Cops search for driver who struck car, fled scene Suffolk County police are seeking the public’s help in identifying and locating a woman whom they believe struck a parked car in Huntington Station late last month. Police said a woman driving a newer model Honda Pilot made a left turn onto 1st Avenue in Huntington Station and struck the rear of a parked vehicle on July 21 at about 7:10 a.m. The driver of the Honda, which was dark-colored and had gold New York State plates, fled the scene. Cops described the woman as possibly Hispanic with dark hair, wearing a white T-shirt and tan pants. Suffolk County Crime Stoppers is offering a cash reward of up to $5,000 for information that leads to an arrest. Anyone with information about the crime is asked to anonymously call Crime Stoppers at 1-800-220-TIPS (8477). All calls will be kept confidential.

An East Northport woman has been convicted of stealing $30,000 meant to fund a van with a wheelchair lift for a Huntington teen with cerebral palsy. Maureen Myles, 62, was convicted on Friday of grand larceny, scheme to defraud and petit larceny following a seven-day trial in Central Islip, according to Suffolk County District Attorney Tom Spota’s office. DA detective-investigators arrested Myles in December 2013 for making off with the money, which donors raised at a benefit dinner in Northport. The DA’s office said State Supreme Court Justice Fernando Camacho found Myles guilty of one count of third-degree grand larceny, two counts of fourth-degree grand larceny, scheme to defraud and petit larceny. Myles was previously convicted of a felony — in 2004, a jury found her guilty of grand larceny and scheme to defraud, for buying $40,000 worth of Bermuda cruise tickets using credit card numbers she stole from her em-

A Northport man accused of helping his uncle in carjacking a Commack woman after the uncle ran down two Suffolk County cops in Huntington last year pleaded guilty to charges relating to the crimes in court on Tuesday. Nicholas Franzone, 23, pleaded guilty in Central Islip at a court conference to robbery, criminal possession of stolen property, unauthorized use of a vehicle, petty larceny and aggravated unlicensed operation of a motor vehicle, according to Bob Clifford, a spokesman for Suffolk County District Attorney Tom Spota’s office. Franzone’s crimes were for stealing gas and participating in stealing a Commack woman’s car and her credit cards as he and his uncle, Chad Moriszan, 35, were trying to dodge capture after striking officers Nicholas Guerrero and Heriberto Lugo. They fled the scene of the hit and run, leaving Guerrero seriously injured. Guerrero had to be hospitalized for more than three weeks with a severe head injury. He underwent surgery and a regimen

Many of the new hires follow retirements from earlier this year. Polansky said he’s excited about the new team at the high school.

On July 13, Alzheimer’s Disease Resource Center Inc. held its Fifth Annual Col. Kenneth F. Lawlor Memorial Golf Outing at the Huntington Country Club. Eighty-nine registered golfers took part in the event, which raised funds for Alzheimer’s disease research and care. Golfers also had the chance to win a car in the Hole-In-One Challenge while on the links. After a round of golf, the participants enjoyed a cocktail hour, dinner and a chance to win raffle prizes. The event is named after Col. Kenneth F. Lawlor, who was diagnosed with Alzheimer’s in the last years of his life. Four Huntington girls’ lacrosse players have been named Academic All-Americans by U.S. Lacrosse. Class of 2015 members Samantha Lynch (University of Notre Dame), Anna Tesoriero (Stony Brook University) and Caitlin Knowles (University of Virginia) and rising senior Katie Reilly (verbally committed to Princeton University) were all named to the All-Academic team. The honor is reserved for a player who exhibits exemplary lacrosse skills, good sportsmanship on the field and represents high standards of academic achievement in the classroom, according to U.S. Lacrosse. The player should also have left her mark beyond the lacrosse field and the classroom by making significant contributions through community service. Several of those girls also competed Saturday as part of Long Island’s All-American Lacrosse festival at the Mitchel Athletic Complex in Uniondale. A dozen Blue Devils girls’ lacrosse players appeared on Suffolk County teams in

games against their Nassau counterparts. The top 48 girls in the classes of 20152020 are selected by a committee comprised of knowledgeable figures in high school lacrosse. Only players in good academic standing are considered for participation. The players then competed in separate games based on their graduating year. New Huntington alumni Lynch, Tesoriero, Fiona Geier (American University) and Alyssa Amorison (Ohio State University) played on Team Suffolk 2015. Reilly and Taylor Moreno (verbally committed to the University of North Carolina at Chapel Hill) played on Team Suffolk 2016. Huntington’s Emma Greenhill and Isabella Piccola were members of Team Suffolk 2018. Future Blue Devils Abby Maichin, Kathleen Rosselli, Holly Wright and Maya Santa-Maria played on Team Suffolk 2020.

The attorney said his client didn’t even see the officers struck and wasn’t even aware that there was a second officer on the scene. The pair of officers pulled over Moriszan and Franzone during a traffic stop. “He’s glad that it wasn’t worse,” he said. “He’s glad that officer Guerrero survived.” Franzone has cleaned up his act since the incident, Fitzgerald said. The attorney said his client was on drugs — prescription pills — and since being incarcerated he’s gotten clean. “[He] seems to be a pretty intelligent young man who unfortunately got wrapped up in some bad stuff.”

A sticky situation in Centerport Kayakers rescued from Mill Pond mud By Victoria Espinoza

A hovercraft came to the rescue of two kayakers stuck in mud in a Centerport pond on Tuesday night, according to Steve Silverman, a spokesman for the Town of Huntington Fire Chiefs Council. The Centerport Fire Department received a call around 9 p.m. on Tuesday night of a man and a woman stuck in a kayak approximately 100 yards off the shore of Mill Pond. Once rescuers arrived, they realized they were not able to reach the kayak due to thick mud that was restricting boat access. Centerport Fire Chief Brian Mark then made the call to the West Islip Fire Department for assistance. West Islip’s hovercraft was the only vessel that could

The Suffolk Police Aviation unit assisted as well, providing a helicopter that gave light to the rescue scene. Firefighters launched the hovercraft from an access point on Centershore Road

and were able to reach the kayak in several minutes. The Centerport Rescue Squad checked the uninjured couple. The pair was covered in dark mud. Forty firefighters and emergency medical personnel in total participated in the rescue, which was successfully completed in slightly more than an hour with no injuries.

It’s an unbelievable feeling to see Nikki representing her country and being a contributor, and I’m just full of pride and proud of the player and the person she’s become.” Team USA, which was vying for its fifth consecutive gold medal, lost in a close match that involved several ties and started off being a difficult matchup because of the weather. Ortega, who scored 19 goals and 10 assists over the course of the tournament, and had at least a hat trick in four of her seven games, said the team did not play like themselves. “I personally think we were more talented and it just didn’t go our way,” she said.

“The weather when we got out there was horrible and a lot of us couldn’t even catch, but lacrosse means so much to me and I had to give up so much to get to where I am, so to know it all paid off in the end really means a lot. I never dreamed of accomplishing all of these things.” The team had outscored Canada 15-9 in pool play, but Simons Tortolani said she thinks part of the team’s downfall was that it’s competition wasn’t as tough as Canada’s was throughout the tournament. “I think the team did come together and certainly improved, in retrospect, it probably would’ve been better for us if we had some more challenging games during the pool play,” she said. “But it was a great experience for all of us who were involved. Getting to know these girls and coaching players like Nikki is a privilege and an honor and the girls represented our country and our sport in a way that I’m truly proud of.”

LIPA pays roughly $70 million in taxes on the Northport power plant, town officials have said. The utility contends the plant is worth less than 11 percent of the value reflected by its current assessment. If LIPA was successful in lowering its assessment and thus the amount it pays in taxes, town residents could be hit with tax increases of up to 10 percent. Those who live in the Northport-East Northport school and library districts could get a whopping 50 percent increase in their taxes. John Gross, senior managing partner at Ingerman Smith, who represents the school district in the case, said the next step is to move forward with discovery and a motion for summary judgment in favor of the district. “And if we win that, that means the claims they made to reduce the value of the plant are thrown out,” Gross said in an interview on Tuesday. She said that this year the fundraiser brought in $46,000. A survey of the area’s residents shows support for the proposal, according to town spokesman A.J. Carter. “Our major concern is safety. Traveling our roads at night is hazardous, and using our property has become impossible,” Ken Kraska, a resident of Eaton’s Neck, said at the July 14 Town Board meeting. Kraska said he and many other residents own several acres of “virgin, wooded, undeveloped land,” and the deer population is starting to overrun it. He also described the deer as aggressive, especially during mating season. The issue of Lyme disease also

The Northport Yacht Club also hosts an annual swima-thon that contributes to the total funds raised for the Make-A-Wish Foundation. This year, there were 120 participants who swam 3,800 laps (53 miles) in total. Of the group, 16-year-old Bryce Winters came in first place. Fundraising worked on a kid-bykid basis, with individuals and sponsors setting rules for how sponsors would donate, sometimes based on number of laps swam or number of hours spent swimming. Peggy Doherty said that the yacht club plans to continue hosting the fundraiser for years to come and that she and her family plan to stay involved. “The kids are doing so much better with fundraising [as the years go on],” she said.

People have had to hire companies to spray for ticks, and you have to do it constantly to stay on top of it,” Joe DeRosa, another Eaton’s Neck resident said at the meeting. DeRosa has several grandchildren and says he’s constantly on alert with them as well. Mel Ettinger, trustee and police commissioner of Asharoken Village, said that an increased deer population has been a problem for years there, too. “Every year there are more accidents involving deer and automobiles,” Ettinger said. Animal activists don’t support this method of dealing with the issue and believe that there

are more humane ways to reduce the number of deer. “Bow hunting is one of the cruelest forms of hunting,” Kristin DeJournett, cruelty casework manager for PETA said. DeJournett described alternative methods to keep deer away, including targeting food supply by cutting back on edible plants. An increase in native plants, or plants that grow naturally in a particular region, without direct or indirect human intervention, will help reduce interest from deer, since native plants have grown over time and have a natural resistance to local deer, she said. DeJournett said that scarecrows could work against deer, as well as placing soap or pepper spray on your property, because

the smell deters the animals. “Lethal methods don’t work to control animal populations in the long-term,” she said. “When animals are killed, more animals move in to replace them, and it creates a temporary increased food supply, which causes the remaining does to breed at an accelerated rate.” Wendy Chamberlin, president of the Wildlife Preservation Coalition of Eastern Long Island, also shares the belief that bow hunting is a cruel and ineffective option. “For sentience animals, that have thoughts and feelings, it is particularly cruel…it is a long, drawn out, agonizing death,” she said. I think it is a cruel way to handle this, and it’s dangerous. It is bad for the residents and bad for the deer.”

It was a night to remember. The thunder cracked so loudly in the middle of the night above our house that I lost my hearing for a few seconds. I jumped out of bed, worried about the dog and his heavy weather anxieties. Sure enough, he was in great need of reassurance and affection. Once I had my hands on him, I was further stunned by the rain—or was it hail?—thudding against the windows. The power went out decisively, with-

out any warning. It was surely a wild night out there, I decided, before falling back to sleep. Little did I know how wild, until I started out my front door to an early morning meeting. Branches, twigs and leaves were strewn everywhere on the driveway and front lawn. Getting to work took five times as long as usual and involved strategic detours around downed trees and power lines. Traffic lights were out, and once again I marveled at the graciousness of local drivers, who allowed each other a turn at the intersections. The sight at the newspaper building was worse than anything thrown at us by Hurricane Sandy. We were deeply grateful to have gotten off relatively lightly in terms of damage then. But Nature made up for it this time. The parking lot was filled with the corpse of what had been a stately, leafy tree. In falling, it had ripped off part of the roof and the pipeline of electrical lines that normally go up the side of the building. The lines were everywhere, entwined in

the limbs, and one side of the road leading to the building was entirely blocked by another giant fallen tree. My first thought as I stood looking at the chaos was that it was Tuesday. Now might not mean much to the average resident, but Tuesdays and Wednesdays are our two busiest, most time-pressured days for preparing the newspapers for publication. So what was the first thing I did? I got a cup a coffee from a shop that was still open. After that, in rapid succession, was getting a team together with electric saws, collaring an electrician to assure us that it was it safe to walk among the electrical lines on the ground, assessing the electrical damage to the building, finding a generator to put us back in production, getting the word out to our staff, first to stay away, and then to hurry in when the generator arrived. They all came through the clogged roads, as you can see from the physical evidence of the newspaper you hold in

your hands — unless you are reading this on our website. So here we are, with the office open for business as usual, as if nothing extraordinary had happened. To me, it’s a small miracle that we have timely editions this week. But then

again, it’s something of a wee miracle every Thursday when a new paper comes out, the work of so many minds and hands. Heartfelt thanks to all who made the miracle happen. You are all champs.
