Judiciary launches online portal giving easy access to legal information BY DELANA ISLES THE TURKS and Caicos Islands has become the first country in the Caribbean region to provide its populace with easy and free access to judicial information. The portal - called the Turks and Caicos Islands Legal Information Institute (TCILII) - was launched during a virtual meeting on November 17. The judiciary-led initiative is to ensure that legal practitioners and the public alike, have free access to legal material necessary to advance and inform the protection of their legal rights. In attendance at the virtual launch ceremony were TCI justices of appeal, justices of the Supreme Court, chief magistrate, attorney general, director of public prosecutions, president of the Bar Association, TCILII committee chair Justice Tanya Lobban Jackson, AfricanLII project director Mariya BadevaBright, and members of the TCI Bar Association. The initiative is one driven by the new Chief Justice Mabel Agyemang, who in brief remarks said the need for an informed bench cannot be overemphasised. “…an independent, impartial,

honest and competent judiciary is integral to upholding the rule of law, engendering public confidence and dispensing justice.” She said it is a blot on jurisprudence for any court to give decisions which simply fly in the face of binding decisions of higher courts. Therefore, it is for this reason that every effort must be made to ensure that decisions of the Supreme Court and the Court of Appeal, which are courts of record, are made accessible to members of the bench, the legal fraternity, and indeed the entire public, the chief justice said. TCILII is now one of many legal information institutes in the world, notable among which are WorldLII, CanLII (Canada), BAILII (British and Irish LII) and AustLII (Australia). The institutes are produced by non-profit organisations which promote legal information through structured and monitored internet law reporting, and the provision of legal resources. Madam Agyemang explained that they do so to encourage competent and informed work in courts throughout the world. The institutes have become a useful tool for lawyers throughout

the Commonwealth as they are a repository of decided cases, accessible to everyone, often at no cost, and, very importantly, in a searchable format, she added. Finding relevant cases on any question of law is often as easy as entering keywords. The chief justice noted that the TCI, without a system of law reporting, currently relies on the institutional knowledge of its bench, and the Bar for local precedents. “In my short time here, I have observed that the usual starting point for precedents cited by counsel are decisions from England and Wales, and other Caribbean countries. “Often, these cases are downloaded from BAILII because of the neutral citation numbers that the LIIs use.” Among her first orders of business upon her appointment on April 1 this year, the chief justice requested that the portal be customised. “So that in addition to the regular offerings of LIIs, TCILII should promote scholarly thinking and enterprise by providing a

place for scholarly papers from the bench and Bar to be placed, for our education and the education of many within the region who will access TCILII. “It is also my hope that other countries in the region will follow our lead so as to broaden access to decisions made by regional courts.” TCILII is built and hosted by AfricanLII which is a programme of the Democratic Governance and Rights Unit at the Department of Public Law, University of Cape Town, South Africa. A Ghanian national herself, the chief justice is a highly respected jurist whose work in African included introducing legal information institutes into the Kingdom of Swaziland (now Eswatini). Madam Agyemang stated that knowing the track record of AfricanLII, and also being affiliated with its parent organisation DGRU, she sought them out to explore the possibility of providing TCI with its own legal information institute. That work from AfricanLII was provided free of charge to the Turks and Caicos Islands.

She noted that TCILII will mean accessible judgments to everyone, and it is her hope that future judgments will be informed by binding decisions of TCI courts. TCILII committee was made up of Justice Tanya LobbanJackson as chair, Renee McLean - Registrar of the Supreme Court, Nalini Shiwram-Kulpa - Court Administrator, Selvyn Hawkins - Representative of the Bar Association, Kerchelle Bain Secretary of the Bar Association, Desiree Downes - Principal Crown Counsel, Legislative Drafting Division at the Attorney General’s Chambers, Gogontle Gatang Senior Crown Counsel, Legislative Drafting Division - Attorney General’s Chambers, Clemar B Hippolyte - Principal Crown Counsel, Civil and Commercial Litigation Attorney General’s Chambers, and Tamika Grant Crown Counsel at the Office of the Director of Public Prosecutions. Check your consumer rights, department urges THE DEPARTMENT of Trade, Industry and Consumer Affairs has no power to regulate the prices at which goods or services are sold in the Turks and Caicos Islands. A spokesperson for the department made this announcement in a statement on November 20, also inviting consumers to review their rights in the Consumer Protection Ordinance 2016. However, they said, anyone who has been adversely affected in relation to the purchase of goods or

services may submit a complaint to the department. The ordinance was passed by the House of Assembly in 2016 and was subsequently amended and entered into force on February 24 this year. The objective of the ordinance is to make provision for the protection of consumer interests in relation to the supply of goods and services. The department is tasked with ensuring the rights of consumers, fair trade, competition and the dissemination of accurate

information in the marketplace. Jury trials to return in 2021 amid pandemic BY DELANA ISLES SPECIAL provisions have been put in place for the resumption of jury trials in the Turks and Caicos Islands this coming January via audio-visual link. This information was issued by Chief Justice Mabel Agyemang this week, by way of a practice direction - an additional rule to the civil and criminal procedure in the TCI’s courts. The direction comes just after the House of Assembly passed the Jury Amendment Bill 2020 earlier in November to allow the jury trials to be held. The bill was presented by Attorney General Rhondalee Braithwaite-Knowles. It makes provisions for the sitting of the court with a jury in separate rooms and for deliberation of the juries to also be made in different jury rooms. In explaining the bill, the attorney general had noted that justice delivery has been as impacted by the global pandemic as every other sphere of life. “Many jurisdictions that dismissed the idea of alternatives to jury trials, or jury trials in modified form, are now reconsidering their stance and considering options.” She added: “The judiciary in the

Chief Justice Mabel Agyemang TCI is steadily building a backlog of criminal cases awaiting trial; and a number of cases are moving towards trial. “The judge-alone trials, although provided in legislation and directed in Practice Direction No. 3 of 2020, are not popular.” She said the courts are accumulating a backlog that will be difficult to clear within a year or two, should Covid-19 continue. This, she said, is because there is no adequate infrastructure to hold jury trials in this changed climate.

In order to provide for the constitutionally guaranteed right of fair hearing which includes trial within a reasonable time, the amendment to bill sought to provide means by which the courts may sit with a jury in separate places, while connected by video link to ensure participation of the jury, as if they were in one room, under normal circumstances. HOW IT WILL FUNCTION The commencement date of jury trial is January 5, 2021.

Beaches GM confirms December 21 reopening BEACHES Turks and Caicos is welcoming visitors back to the all-inclusive resort on December 21, general manager James McAnally confirmed this week. McAnally spoke to the Weekly News on Thursday, November 25, adding that talks are progressing in a fruitful manner on a disagreement over taxes with the Government. Last week Unique Vacations - an affiliate of Unique Travel Corp, the global representative for Sandals and Beaches Resorts - revealed the new opening date in an email to travel partners. This came just days after

Leader of the Opposition Washington Misick told the Weekly News that executives of the resort had sent him a letter saying it would remain closed until April 2021. Beaches is involved in an ongoing dispute regarding an alleged $26 million tax bill that the Government says it is owed, but which the resort denies. The Government has been silent on the issue after stating on November 2 that the resort had cancelled a November 18 mediation - a claim that was strongly refuted by Beaches. While McAnally told the

newspaper that talks are continuing, he added there is no official announcement on the progress of those discussions. On November 12, Misick said he has had discussions with the Governor’s Office and the Premier’s Office to work towards an amicable solution. Beaches Turks and Caicos is one of two of the chain of resorts that will be reopening in December. Beaches Ocho Rios reopens on December 18, and all of the other resorts in the chain located in various Caribbean islands have reopened.

They will be held on both islands of Grand Turk and Providenciales, with one jury trial taking place at any time in courts one and two in the Supreme Court building, Providenciales, and another at the Supreme Court, Grand Turk. For trials in Providenciales, the judge, court staff, interpreter, counsel on both sides, defendant(s), and one witness at a time, and one prison officer will be in court one. Provided that where the defendant is in custody in Her Majesty’s Prison at Grand Turk, the defendant will participate in the trial from a courtroom in Grand Turk via video link. The attorney of a defendant in Her Majesty’s Prison who participates in the trial in Providenciales may opt to be with the defendant in person at Grand Turk, or be in Providenciales as the justice of the case may require. The jury will participate in the trial from court two in the presence of a court official assigned by the registrar. People in either courtroom will not exceed ten persons at any time. In the case of 12 person juries, the entire jury will be saturated in the Supreme Court Annex, if not in use by the SIPT trial. In the event that court is not available, the jurors will split eight and four, and will be placed in two separate courtrooms in the Supreme Court Building. As it relates to vulnerable witnesses giving testimony during trial, these persons will be led in evidence from a separate room by

way of audio-visual link. Meanwhile, for trials in Grand Turk, the judge, court staff, interpreter, counsel on both sides, defendant(s) and one witness at a time will be in the Supreme Court courtroom. For due compliance with the physical distancing protocols, the jury may participate in the trial and conduct their deliberation from the jury room and the Judicial Education Institute (JEI) Office by means of video link, in the presence of a court official in each room. Persons in either of these settings will not exceed ten persons at any time. As it relates to 12 member juries in the nation’s capital, jurors again will be split up and will attend trial from two separate rooms. Jury selection will be done in jury rooms, as well as in designated spaces outside the courtroom, and the judge will address the court using a public address system which must be heard outside the building, in the tent. All potential jurors and all participants in a jury trial must access the court building wearing masks. Similarly, all attorneys, interpreters, court staff and court users are required to wear a mask in and around the court premises and during court proceedings. A judge may wear a mask at his/ her discretion and counsel may give opening and closing speeches in masks unless otherwise permitted by the judge.

BEACHES OPENING DATE CONFUSION Beaches Turks and Caicos, the largest resort operation in the territory, announced previously that it would soon reopen, welcoming thousands of guests from abroad. The opening would provide much-needed jobs for Islanders, many who have not had a pay cheque in months. Now we’re hearing that it may open somewhere in mid-December, or worse still, April of next year. Is this some kind of game? What are your thoughts?

We can survive

The Government needs to take their focus off Beaches. If they do not want to open, so be it. Let it sit and dry rot. All workers on work permit should have been sent back home as there was no work. That is the law. As far as I’m concerned it is a tactic used by loan sharks and mobsters. If it were up to me, not another work permit would be approved for Beaches or anything associated with Butch Stewart. Either they want to do legitimate business or they don’t. Point blank. Furthermore, we can survive without Beaches. Just hold on for the Ritz Carlton to open and get additional airflow. And they better make sure pay their taxes as mandated too.

Let’s see the docs

If the development agreement between Butch and our Government were published, would that not make clear who is in the right on the taxes owed issue? Surly that agreement defines the outcome. And while we’re at it, let’s see the Ritz Carlton agreement, so we don’t have to go down this torturous road again.

A dangerous game

To whom much is given much is expected or so that saying goes. With Beaches being the largest employer

in the TCI, the largest resort and flagship at this time and until sometime the Ritz Carlton opens, they have certainly done enough to tarnish and destroy the brand. First, they promised to open for the winter season, next they attacked the integrity of the Government, then threatened to remain closed throughout the winter season. These changes hurt the TCI, damaged the bookings, reservations and business profile of Beaches. It was designed to hurt the Government of the people of the TCI - a political stunt. But they ended up shooting themselves in the foot. One thing is clear - the TCI is by and large a five-star brand and destination. The fly-by-night all inclusive, cheap and lower end of the market brand and imaging of Beaches does not suit the TCI well. Their actions, tactics, games and stupidity over $24 million, petty cash, of what must be the TCI Government’s money does not even make sense. Do they even value or understand their brand or the country they are making most of their monies in? This is a dangerous game they are playing and the TCI people are not pleased.

Put our country first

Beaches Turks and Caicos has to make a business decision. They are a for-profit entity. I summon the TCI Government along

with the leader of the Opposition and the Hotel and Tourism Association to meet Beaches at the negotiation table for an amicable resolution. Put country above selfish and ulterior motives!

Firm but fair

I hope that island negotiators with Beaches are firm but fair. Firm, in not letting any entity impose its will in changing those sacred trusts on the use of property in the Islands. But also, fair in helping Beaches attain its goals whenever possible but in keeping with those standards other resorts are held to.

Being played again

Beaches has a history throughout the Caribbean of collecting the taxes from the visitors then dragging their feet on paying those monies over to the governments. When the Government asks for their money, Beaches then uses the money as a bargaining chip to get special advantage for their corporation. So, it is that very game being played once more.

Reckless and irresponsible

Opening in April of 2021 cements the fact that the TCI does not need them in such a time as this. Entering Covid-19 lockdown, the Government had $200 million in the bank, reached October 2020 with $155 million ahead of the clock and with stamp duty revenues the Islands are doing well without them. They are a reckless and irresponsible chain abusing their market dominance and inherent power.

This kind of irresponsibility must be checked with decisive legislation and strident policy resolve. It is time they go. The TCI does not need them. They cannot threaten or shake the people down and survive as if their hands are clean. This Premier and Minister of Finance, Sharlene Cartwright Robinson, is doing well not to fall for their threats, must continue to stand up to them and stand strong, if only for the people. This is a watershed moment in the TCI, and we must decide now where do we go from here. Let Beaches go, make them sell their property. They have too much, let us find a new partner to empower our people. If they go, we lose nothing. Ninety-nine percent of their staff are on work permits, meaning they benefit us nothing. Very few of their top management are locals.

Business minded

Beaches is a business pure and simple. They are not a community charitable organisation. They will open when it is economically feasible for them to do so. Good corporate citizenship be damned! The Government needs to take note and make decisions that are beneficial to Turks and Caicos Islanders and those residents who have permanent status.

CDC ranks TCI at level four for Covid-19 But territory tops Caribbean in Thanksgiving bookings BY DELANA ISLES THE CENTRE for Disease Control (CDC) has issued a travel notice on its website stating that the Turks and Caicos Islands is now a level four Covid-19 risk - the highest classification. According to the CDC, a level four warning indicates that the territory has a “very high” level of the disease. It advises: “Travellers should avoid all travel to the Turks and Caicos Islands. Travel may increase your chance of getting and spreading Covid-19.” They also warned that if people must travel to the TCI, they should talk to their doctor ahead of travel, especially if they are at increased risk for severe illness from Covid-19. For several months, the TCI hovered at a level three risk, but over the past week there have been steadily increasing cases of Covid-19 in Providenciales, and two new cases in South Caicos. The number of people who tested positive rose by six, then by 14 in just the span of a few days with the week ending and, so far, holding steady since last Saturday at 39 active cases. One person from among the 39 infected is currently under hospital care. Prior to that, active cases numbered less than 20 for several weeks, falling and staying below 10 for a long time. This trend prompted a sense of renewed hope from health officials and the public at large.

Despite many warnings from the CDC and Dr Anthony Fauci, the US’s top infectious disease doctor, about travel during the holiday season, Americans are still vacationing in droves. And for this Thanksgiving holiday season, they are overwhelmingly choosing the Turks and Caicos Islands. POPULAR FOR THANKSGIVING Travel insurance comparison site, Squaremouth, shares surprising new traveller behaviour as the holiday season begins.

Two arrests made after jewellery store heist TWO out of five men who robbed a jewellery store in Providenciales last week have been arrested. Adolphe Mervel, 39, was arrested at the scene, while Willegince Noel, 21, was arrested after further enquires. Three other suspects escaped. According to the police press office, the shop along Leeward Highway was robbed of an “array of jewellery” at about 5.10pm on Wednesday, November 18. A group of armed and masked

men made away in a white minivan towards Blue Hills. Police responded to reports of a robbery in process and managed to intercept the van and capture Mervel. The others escaped. The arrested men, Mervel and Noel, are currently in police custody. At time of press, they had not been charged. More US residents are travelling for Thanksgiving this year, the site reports. Although the accuracy of these figures is unknown, as the pandemic has meant that travellers are now required to get insurance to visit many countries. Squaremouth reports a 26 percent increase in overall travellers. US residents taking domestic trips have increased by over

170 percent, while international travellers have decreased by 44 percent. Forty percent of Thanksgiving travellers specifically searched for coverage for coronavirus, replacing top concerns from previous years, such as weather and financial default. Younger generations are making up the majority of those insuring trips. Travelers age 34 and under

now account for 45 percent of all insured Thanksgiving travellers this year, up from 37 percent last year. Travellers are spending more on their Thanksgiving trips, even with reported travel deals and discounts, Squaremouth finds. The average trip cost has increased across the board for the most popular destinations, with the TCI being the most expensive trip. “The US remains the most popular destination, while Turks and Caicos is the only international destination to see an increase in travellers over the Thanksgiving holiday,” Squaremouth revealed. The TCI continues to top the Caribbean in destinations of choice for US travellers, third only to the US and Mexico. Earlier this week, 70 MBA students at New York’s Columbia Business School who recently violated the university’s Covid-19 travel policy were temporarily prohibited from attending inperson classes. The group had travelled to the TCI on a trip that was not schoolsponsored. The TCI remains on New York State’s quarantine list, despite efforts by local authorities to have it removed.

Blue Hills pensioner fatally struck by car A SEVENTY-year-old man from Blue Hills died after he was hit by a car while walking along the side of Millennium Highway in Providenciales. According to the police press office, two pedestrians were struck by a white four-door Toyota Wish early on Monday morning (November 23) at about 5.30am. The pensioner died at the scene. A 40-year-old woman was taken to Cheshire Hall Medical Centre with non-lifethreatening injuries. The driver of the car, Bruno

Lexime, has been charged with causing death by dangerous driving and dangerous driving. At time of press, he was in police custody awaiting his first appearance in court on Thursday (November 26). Commissioner of Police Trevor Botting offered condolences to the family and friends of the deceased who was an active member of the local community and businessman in Blue Hills. “When these things happen, it affects the whole community,”

he said. “My thoughts and prayers are with all of you. “I would also extend a speedy recovery to the lady who was also involved in the tragedy today. The circumstances of this collision are now subject to a criminal investigation.” The vehicle was damaged on the right side of the front windshield, right front wheel and bumper areas. South Caicos school closes due to Covid-19 exposure BY OLIVIA ROSE THE MARJORIE Basden High School in South Caicos was closed on Monday for deep cleaning after a staff member displayed Covid-19 symptoms. A statement from the Ministry of Education on Sunday (November 22), advised parents that face-to-face learning at the school would cease with immediate effect, until further notice. The ministry explained that: “The disruption to face-to-face learning is due to possible exposure by school personnel to Covid-19. “The school will be deep cleaned and sanitised during this period and will resume face-to-face learning upon approval from the Ministry of Health.

“In the interim, all students will resume virtual learning commencing Monday, November 23, 2020.” The Education Ministry added: “The health and safety of our staff and students are of paramount importance, hence we are taking the necessary precautions and urging staff, students and the general public to continue to practice the safety protocols prescribed by the Ministry of Health. “This includes the wearing of masks, frequent washing and sanitising of hands and practising social distancing.” Speaking to the Weekly News on Thursday, Talia Thomas, education officer for high schools, said the school has been deep cleaned.

“We’re waiting on clearance from the Ministry of Health because there’s certain protocols that have to be in place before we could return our students and staff. “We have to make sure the environment is safe. We would’ve

already completed the deep cleaning and so now we’re just waiting on the final approval.” The closure of the high school came as two new cases of Covid-19 were recorded on South Caicos over the weekend.

This marks the first Covid-19 school related case since face to face learning resumed for fourth and fifth formers in October. All students across the TCI are expected to return to a traditional classroom setting in 2021.

Government launches second round of employee cash grants BY OLIVIA ROSE WORKERS outside of the tourism and hospitality sectors are being urged to apply for the Government’s second employee cash grant. On Saturday (November 21), the Government opened its database to accept online submissions from across the territory. This round of payments will see $600 paid to people in various sectors whose earnings have been affected by the decline in economic activity due to the Covid-19 pandemic. A statement from the Government on Monday, reminded that the grants are open only to employees with Turks and Caicos Islander status. “It will provide cash grants of $600 to eligible employees who can provide evidence that they were employed at least one month prior to the lockdown that occurred

on March 26, 2020. “In this database, the applicant will see two options and will be asked if he/she is applying for the first time. “The first-time grant is offered to employees operating in sectors other than the hospitality and tourism sector.” However, workers within the tourism and hospitality sector are eligible to receive a second stimulus cheque, the statement explained. “Applicants are advised that incomplete applications will not be processed. “Therefore, it is important that you ensure that you read the instructions on how to fill the application to understand clearly what is needed, inclusive of the evidence to be provided.” Those wishing to apply for the cash grant are urged to only submit one application, as applying multiple times may result in their

benefits being forfeited. “Applicants will be notified of the outcome as soon as possible following the submission of their applications,” the statement continued. “Successful applicants will receive an approval letter issued by the Ministry of Finance, Trade and Investment. “A single payment of $600 will be made by the Government Treasury directly to the applicant via cheque or direct credit to the nominated bank account within two weeks of the date on the letter of approval.” A number of sectors are excluded from benefitting from this cash grant since workers were gainfully employed during the Covid-19 lockdowns. These sectors include the TCI public service, TCI statutory bodies, TCI bodies of good governance, TCI constitutional bodies, hospital, healthcare or

medical facilities. Other categories of workers that are excluded include any water, electricity, telecommunications (including internet services) or other sectors encompassing the provision of electronic communications including print and electronic media, waste disposal and sanitation companies and self-employed people. Employees have until Saturday, December 5, at midnight to submit their applications. Application forms are available on the Government’s website at https://tcistimulus.gov.tc Employees who wish to apply for the second cash grant must support the following requirements: -Turks and Caicos Island status, as verified by supporting documentation. -Have been employed for at least one month prior to the March 2020 lockdown: specifically employed at some time during the period

February 2020 to June 2020. -Reside and can be located in the Turks and Caicos Islands. On March 26, Premier Sharlene Cartwright Robinson announced the first stimulus package to lessen the impact of the global crisis on residents. Since then more than $8 million has been disbursed in stimulus payments to more than 7,000 hotel, tourism and hospitality workers. Speaking at a media conference on October 28, the premier said: “In spite of the challenges of the first stimulus package, as we speak today over 90 percent of all those who had applied and qualified have been paid.” She added: “In addition to all the money we have already paid to the various sectors – workers here in TCI – you the people will have an additional $5 million in your hands over the next few months.”

Labour ministry meets with Ritz-Carlton SENIOR staff of the multi-million dollar Ritz-Carlton Residences resort being built on Grace Bay, Providenciales, have met for the first time with members of the labour ministry. The November 17 meeting examined labour laws, pay and benefits, vacation and sick leave, pensions plans and work agreements among other topics. Hon. Vaden Delroy Williams, Minister of Immigration, Citizenship, Labour and Employment Services, led the talks at the Office of the Premier in Providenciales. He was joined by his Permanent Secretary Desmond Wilson, Deputy Secretary James Astwood and Commissioner of Labour Edwin Taylor. Attending the meeting on behalf of Ritz Carlton were John Hazard, Corey Guest, Roberto Spita and Steven Redkoles, a press release

said on Monday (November 23). Guest, multi-property director of human resources, said: “When I exited the plane in the TCI last year, I felt an immediate connection with the island as it truly felt like home. “We look very much forward to a successful opening and partnering with you and the community.” According to the press release, Williams said he is “very elated” about the world-renowned Ritz Carlton coming to the TCI. The minister added that he is confident that the opening of this resort will create major employment as well as entrepreneurial opportunities for the residents of the TCI. He said he is looking forward to the Ritz Carlton team working closely with his ministry during the various phases of the project, to ensure that the end result will be beneficial to all.

Participants then talked about offer letter and work agreement templates and requirements, and retention rates. And finally, partnering with any schools, colleges and vocational institutions that have hospitality,

culinary, engineering or technical programmes to discuss partnerships for internships and offering leadership and development courses. The luxury-branded RitzCarlton 10.5-acre development which features the first 12 storey buildings in the TCI is set to be completed in the summer of 2021. The US and Swedish Covid-19 responses IN AMERICA, the Covid-19 crisis has spiralled out of control, registering almost 200,000 cases on Friday alone. Across states, the number of Americans hospitalised has exceeded capacity. Primarily, it took nearly 100 days for America to reach one million cases. Lately, there is a shattering record of a million new cases in just in one week – more than the entire population of the TCI, 22 times over. As America topped 12 million total cases, it now finds itself in a perfect storm – a surging virus mixed with colder weather conditions propelled by a strong sense of family and tradition. Hereafter, new curfews and restrictions for non-essential businesses are in effect. Residents are asked to stay at home and officials have cancelled and postponed 18 football games. There are longer lines at testing sites, as travellers are trying to get tested before going to celebrate Thanksgiving with their families. And despite the Centres for Disease Control and Prevention’s ominous appeals to avoid travelling this holiday, people are swamping the airports.

However, there seems to be some progress – the US Food and Drugs Administration is working tirelessly to approve the first Covid-19 vaccine. Meanwhile, Sweden’s herd immunity risky gamble to combat Covid-19 has failed. Officials refused to lockdown, hoping that it will lead to widespread immunity; instead the coronavirus surged. Today, Sweden is admitting Covid-19 patients faster than its European allies, sinking the country deep into a crisis. The country’s death toll has risen four times higher than Finland, Denmark and Norway combined. And now the government has decided to change course and get tough. Nowadays, they’re rushing to put restrictions in place; the wearing of masks,

testing and tracing, and social distancing that they failed to do in the first instance. There is an intended lockdown and public gatherings with more than eight people are prohibited. Bars and restaurants are closing at 10.30pm and Sweden is now appealing for help from its neighbours who practiced and implemented safety precautions to help make informed decisions. What is appalling, are the inadequacies of the Swedish and US governments’ responses and the indoctrinated attitudes the citizenry exhibited. Like Americans, Swedish are refusing to adhere to safety protocol. President Trump had called the virus a hoax and defied science by doing nothing.

He even fought against a lockdown and valued money over lives. The people responded likewise and although more than 250,000 Americas have died and the infection rates are escalating, half of America’s population, like the president, are still down-playing the severity of the virus. Similar actions were demonstrated among Swedes and the authorities are only taking notice since the death tolls spiked to 6,406. Even now, the government is still stopping short of a total lockdown to halt the situation. So, what can the TCI learn from America’s dreadful mishap and Sweden’s failed experiment? The virus will not ‘just go away’; precautions have to be taken and there must be a shift in policy from coercion to voluntary compliance to cementing individual commitment, while providing the necessary tools and guidelines. The authorities must weigh between material wealth and health and safety. Sweden and the US inherently, are the two countries with soaring mortality rates that failed to expeditiously lower the count as the pandemic surged.

Bridging the political divide ONE of the greatest factors causing a division in this country is politics. The majority of the TCI’s citizens align themselves with one of the major parties. Somehow this affiliation with the political parties is so strong that we don’t see the good in others who are on the opposing team. There is a clarion call by many to unite but until we reach a point in our lives and realise that we must put country over politics, the division will continue to widen deeper. One way to bridge the political divide is to stop appointing members to the board just because they are supporters of the Government. We must appoint the people with relevant knowledge and who would get things done on the board and the appointment should be done jointly by both major political parties. Another way to bridge the political divide is through the actions of the speaker of the House of Assembly. While it is true, that the speaker is appointed by the Government, they have an opportunity to bridge the political divide

by being unbiased in dealing with the Government and the Opposition. Bridging the political divide requires leaders to lead by example. Believe it or not, thousands of followers follow their leader. Once you become the government of the day, you are the government for all people. Leaders should embrace everyone and not be biased in their treatment of individuals even if these individuals do not support them and constructively criticise them. Leaders should never encourage their

followers to bad mouth individuals on the other side but it is well known that some negative stories about individuals are being encouraged. Leaders, sometimes, should know that the simple things matter. If they are going to greet people, they should greet everyone. They shouldn’t just say hi to the people that they think voted for them and then pass straight by the people who did not vote for them. Leaders should recognise the accomplishments of everyone, not just those

persons that voted for that party. Yet some of these very leaders want to speak about unity from time to time and especially on JAGS McCartney Day when their actions are far from it. My last point on bridging the political divide is to encourage individuals from different political persuasions to come together on a regular basis to discuss the issues and provide solutions. Too many times we are afraid to unite because we do not want our political party to think we are against them if we constructively criticise them. It would even be better if some of us come together and established businesses together despite our political affiliations. This would send a strong message to the electorate that no matter who you are, you can still work together. In conclusion, a country should not be divided over politics. We think politicians and the political parties are the answer to our issues but they have proven they are not, so why do we have a political divide?

TCI works with US Homeland Security to tackle people and drugs smuggling BY OLIVIA ROSE THE GOVERNMENT is actively working with the US Department of Homeland Security to prevent illegal smuggling of people and weapons into the territory. A reconnaissance aircraft from the US Customs and Border Protection which recently landed at the Providenciales International Airport last week was part of the partnership. The aircraft, based in Miami, has high surveillance capabilities which will enable it to identify “early, fast boats” approaching the territory. Governor Nigel Dakin in an Instagram post on Friday November 20 explained that the visit forms part of the Government’s ongoing work to bolster the TCI’s border security efforts. “This first week has been

about orientation, providing communication links, building up relationships so operations run smoothly,” he said. “Because while not permanently stationed here they will, from now, be regular and welcome guests in TCI and important colleagues wherever they are based in our region - providing one component of sophisticated, layered and coordinated defence of TCI. “For those that have followed the work we’ve been doing for a year or more you will know that as part of the National Security Strategy we have been working to build up the established collaborative arrangements we have with our partners involved in preventing the illegal movement of people weapons and guns into our islands.” He added: “The operational cooperation we have with the US

is now of a very different order than it once was, and much of the increased success against sloops over the last year has come from partnered operations with a set of US agencies as well as Royal Naval helicopters and other support. “Much of this is unseen but today I visited what will become a regular sight in TCI a reconnaissance plane from the US’s Department of Homeland Security - based in Miami working in direct support of ‘OPBAT’ - the alliance between the US, Bahamas and TCI.” Governor Dakin stressed that due to the surveillance range of the reconnaissance aircraft, sloops and speedboats could easily be detected in TCI’s waters. “Airborne and on patrol its surveillance capabilities are such that it can dominate the ocean between Haiti and DR and

ourselves. “It gives us a far greater ability to identify early, fast boats approaching us as opposed to the large sloops which we have got very good at identifying and intercepting. “Our tremendous maritime police now have increasing ‘over the horizon’ intelligence to work with, which increases their impact and makes us all safer.” The TCI has been a partner of OPBAT since 1982 when it was formed to counter cocaine smuggling from Columbia to the

Bahamas and TCI. Back then, Columbian smugglers used the Islands’ ports as a trans-shipment point for marijuana and cocaine. The agreement was entered into by the TCI, Bahamian and United States governments to cooperate and enhance the ability of the Bahamian government. They aimed to help interdict, prosecute and convict drug traffickers as police forces of both Caribbean countries were illequipped to locate the smugglers’ aircraft and small boats.

Cadets complete RMA Sandhurst military training BY OLIVIA ROSE TWO cadet officers have become the first in the TCI to complete a rigorous eight weeks of training at one of the world’s leading military academies. Adrian Parker and Francis Glinton travelled to the Royal Military Academy Sandhurst in the UK in September following a training course with the Royal Marines in the TCI. Along with cadet officer Dixie Smith who will attend RMA Sandhurst in 2021 and a fourth officer who is yet to be selected – they will lead the Turks and Caicos Islands Regiment. The commissioning course is an extremely challenging course designed to teach the fundamentals of soldiering and develop officer cadets as leaders. On Saturday (November 21), the training concluded with the prestigious Sovereign’s Parade which saw the men formally moving from being a cadet officer to an officer. Inspecting officer Baroness Sugg, UK’s Minister for the Overseas Territories, took the salute and congratulated the officers on their hard work and dedication. In an Instagram post on Tuesday, Governor Nigel Dakin said he

wrote to the officers on the eve of the parade to congratulate them. They responded: “It has been an honour being a part of a chapter in TCI history. “The training and experiences here at Sandhurst have changed my perspective on service above self and enhanced my understanding of the importance of inner strength and resilience. “As I become a commissioned officer tomorrow I will stand humbled, proud and eager to return home to serve my country and people with courage, integrity, strength and national pride.” They added: “Goodnight Sir. It has not been easy but we never wanted easy.” The creation of the TCI Regiment, announced early December 2019, is part of a strategy to enhance the territory’s response in times of emergencies and disasters such as hurricanes. On November 13, Dakin explained that when the TCI Regiment stands up next year the new officers will each take command of a troop of marines. “They will have earned the right to do so but the right to lead only brings with it service and responsibility. “If Sandhurst has done its job their marines will always come first, beyond everything else they

will have internalised the idea of ‘Serve to Lead’ - Sandhurst’s motto.” Governor Dakin explained that work has been ongoing to ensure the TCI Regiment is fully operational by the 2021 hurricane season. He said: “In their absence, much work has been done over the last month under Colonel Grant’s leadership supported by his Second-in-Command, Adjutant, Regimental Sergeant Major and Chief Clerk. “The Permanent Secretary National Security, Tito Lightbourne has been helping in terms of the civilian/military interface. “Standing up a regiment from

scratch is a fascinating experience. Just for starters a defence bill is required and a draft will come to Cabinet soon.” He further revealed that the budget for the next financial year will include provisions for the TCI Regiment. “There’s a requirement for conditions of employment, a regimental handbook, standing orders including standards of discipline, a maritime operational manual, a statement of requirement for UK support, establishing a social media presence, decisions around procurement of weapons, accommodation, and crucially because in the end it’s the quality

of your people that matters - a robust selection, recruitment and training package to be developed. “On the latter we want our two commissioned officers, Parker and Glinton, to be part of the wider team that selects the first tranche of the future regiment. “By next hurricane season TCI will have a significant body of disciplined men and women able to support us at our hour of need while also supporting the protection of our maritime borders.” The officers are expected to return to the TCI on Sunday (November 29). The world-renowned RMA Sandhurst has trained British Army officers since 1802.

Caribbean tourism has taken a hit, CTO says at Tourist Board event But may eventually benefit from pandemic BY DELANA ISLES INTERNATIONAL arrivals into the Caribbean declined by 63.7 percent this year compared to 2019, but there is hope for the region. Neil Walters, acting secretary general of the Caribbean Tourism Organisation (CTO), spoke about the impact on tourism during the Tourist Board’s second annual tourism symposium. It was held virtually as part of Tourism Environmental Awareness Month and streamed live on Facebook on November 18. Walters gave the keynote address, ‘Challenges and opportunities: Lessons from the Covid-19 pandemic’. The CTO estimates - based on information received from member countries - that between January and August 2020, international arrivals into the Caribbean declined by 63.7 percent or 14.3 million fewer trips compared to 2019 for the same period. The US market declined by 65.3 percent, the European market declined by 62.5 percent and the Canadian market declined by 50.8 percent. Cruise arrivals declined by 58.4 percent with 8.5 million cruise passenger visits to the region. During this address, Walters said these results are against a backdrop of what would normally be the busiest periods for the Caribbean tourism - January to March, July and August. To date, 32 Caribbean destinations have opened, the CTO secretary general revealed. However, he added that the CTO’s estimation of a 50 to 70 percent reduction in arrivals by the end of this year, remains the same. Walter has warned member states to be mindful of the impact on their economics, such as reduced revenue from tourism, closure of businesses (primarily tourism related ones), high levels of unemployment and significant strain on social services, especially health. Early in the pandemic, the Caribbean Development Bank had estimated that reduction in real GDP for the Caribbean could

potentially be in the range of 15 to 30 percent. They further estimated that public debt could increase by levels of between 15 and 60 percent. The International Monetary Fund (IMF), meanwhile, estimates that the global economy will contract by 4.9 percent in 2020, with Latin America and Caribbean countries projected to contract by 9.4 percent in 2020. OPPORTUNITIES FOR CARIBBEAN COUNTRIES But out of every challenge comes opportunity, Walters says, and this fully applies to this pandemic, particularly for the Caribbean region. “While it has impacted the travel and tourism sector, it allows for a reset, since travel and tourism is affected globally, and every major region has lost its share of international arrivals. “Of interest here is the fact that in 2019, the Caribbean outpaced the world’s growth rate for international arrivals. “The efforts made by Caribbean destinations to control the virus with some success, have created a marketable position as a healthy region.” Walters said not many regions in the world have replicated this. He stated that over many years, it was noted that Caribbean tourism needed an overhaul, but that this could not be achieved since overhaul limits the use of the product and it also requires significant fund outlays. But in this changed climate, international donor agencies have made funding available in response to Covid-19 to allow the regional tourism sector to reposition itself in the new normal. The CTO secretary general said that the regional organisation has begun to access these funds with the expected results being an audit of the regional sector skill sets and a needs assessment. This along with a training programme will enhance the sectoral labour force and service quality. He said these results should begin to be seen during 2021. In addition, a programme to

promote community-based tourism will also roll out in 2021. While this was a discussion phase prior to the pandemic, Walters said adjustments have been made to ensure that lessons learned will be applicable to this and future pandemics, and other natural and man-made hazards.

Nurse awarded for heroic efforts during pandemic A REGISTERED nurse and emergency medical technician has strengthened her commitment to fight for those she cares for, in ways that go above and beyond the call of duty. During the Covid-19 pandemic, Cleola Been founded a home care company especially dedicated to the elderly and other members of society. For her invaluable contributions that greatly benefit her patients and their families, she has been named a CIBC FirstCaribbean Unsung Frontline Hero. The bank launched the initiative in August with the aim of identifying those unsung heroes who have shone brightest in the darkest moments of the crisis with the help of the public. Been was nominated for providing a service that ensures

patient comfort, family support, and ultimately alleviates pressure off of the hospital and social welfare programmes. She vied for the title among three other worthy nominees spanning Medical Personnel, Protective Services and Community Hero Award categories. “Working in nursing and being in constant contact with elderly persons particularly a high-risk group for Covid-19, I just had to do something that would help keep them safe,” Been said. “That was my greatest motivation. I also have a grandmother that’s 86-years-old so I couldn’t imagine something happening to her at this time, and wanted to extend that to our general elderly population as well.” Turks and Caicos HomeAid Care, the first of its kind in

Providenciales, made its debut in June, a CIBC FirstCaribbean press release said on Wednesday (November 25). “In working privately since 2015, I’ve encountered a lot of people who needed help and couldn’t afford to get it,” Been said. “I thought if I found a way, at least I can help a few on a more consistent basis.” Despite challenges associated with government relations, Been has garnered much-needed support from people in the community. In the short span of time that her company has been operational, she has also had many highlights, noting the greatest one being the success of her “charity case”. “When I first encountered him, he had just had a stroke. “The ministry openly express its sincere gratitude to Mr Misick for his generous gift of one year of free accommodations to the Turks and Caicos Islands Government.” The completion of this building is a “critical milestone”, the ministry said, and comes at a time when the it is rebranding its image to increase awareness. “This rebranding will set the Ministry of Education apart from the other ministries. “It will allow the Ministry of Education to reflect on its strengths, values and mission as a place of learning, preparing future leaders, equipping them as future leaders of society.”

The rebranding of the Ministry of Education will include a full campaign of community awareness, allowing the community to grow to appreciate and understand its mission. It will be a continuous effect and will be incorporated in all aspects of the ministry’s initiatives. “A campaign that will continue to promote the Ministry of Education and will attract and inspire the community,” the statement said. As for her next steps, Been said: “Going forward during Covid and beyond, I would like to expand and make my business much bigger than what it is right now. “I would like to extend my services to other family islands that currently do not have.” She added: “That is my big plan: I want everybody to be able to access healthcare, especially the elderly, and get the care and service that they need just to make it on a daily basis.”

The tests are for anyone who is not showing symptoms of the disease. Those with symptoms should remain at home and call the ministry’s hotline on 2329444 or 333-0911. Symptoms include fever, headache, dry cough, shortness of breath, runny nose, vomiting, diarrhoea, joint pain, loss of taste and loss of smell. Anyone who attends the clinics should bring a government issued ID and pen, maintain a physical distance of at least six foot and wear a face

CDC warns against travel to over 20 Caribbean countries including the TCI THE Centers For Disease Control, (CDC), is urging Americans to avoid travel to 21 Caribbean countries. The CDC raised the almost two dozen countries to Level 4, saying the countries have a “Very High Level of Covid-19,” even though the region lags way behind the US on coronavirus, and most have been able to contain the virus. The CDC says travel to these countries “may increase your chance of getting and spreading COVID-19.” They are: Antigua & Barbuda, Aruba, Bonaire, Belize, Cuba, French Guiana, Guadeloupe, Guyana, Haiti, Jamaica, Puerto Rico, Saba, Saint

Martin, Sint Eustacius, Sint Maarten, the Bahamas, Trinidad and Tobago, the Dominican Republic, USVI, Suriname and the Turks & Caicos Islands. The updated advisory was issued on Nov. 21. FORMER House of Assembly Speaker Oswald Ingraham died on Monday at the age of 82. Leader of the Progressive Liberal Party Philip “Brave” Davis, in a statement said he is mourning a good friend, who was a gracious and consummate statesman. Ingraham, who was Speaker during the second Christie Administration, also served as Deputy Governor-General. He was also the Member of Parliament for South Eleuthera for 10 years, from 2002-2012. “Oswald Ingraham lived a full life and made his contributions to The Bahamas in both the private and public sectors,” Mr Davis said. “We thank him for his service as he transitions into eternity. I am saddened to learn of the passing of a good friend, a parliamentary colleague and businessman, Oswald Ingraham. “Oswald was fair in his rulings as Speaker and always protected the rights of the opposition, allowing them to have their say when the governing caucus would eventually have their way.” Mr Davis touted Ingraham as an ardent supporter of the progressive movement. “This native of Tarpum Bay, South Eleuthera would go on to represent his community in the halls of Parliament as the representative for South Eleuthera from 2002 and 2012 and served as the Speaker of the House of Assembly from 2002 to 2007,” the PLP leader said. “He would also go on to serve as Deputy Governor General between 2012 and 2017 where he presided over several official state recognised ceremonies. At all times Oswald was gracious in his deportment and the consummate statesman.” Ingraham was an entrepreneur in the tourism and hospitality industry, operating a small hotel in his constituency of South Eleuthera. “Death is not a full stop, but a mere comma in the sentence of life, therefore, Oswald may be absent in the flesh but present in the spirit as he lives on in the hearts and minds of those who knew and loved him,” Mr Davis said, sending condolences on behalf of his wife and party executives and members to Ingraham’s family. Former Prime Minister and PLP leader Perry Christie also said he is in mourning over the death of a treasured friend. “We have been political comrades for some forty years and shared a close common kinship with Tarpum Bay, Eleuthera,” Mr Christie said in a statement. “Oswald Ingraham was a towering figure in the life of Eleuthera, where he achieved prominence and distinction in a variety of spheres. In performing this role, Mr Ingraham always acquitted himself with complete distinction. He upheld the dignity of this high constitutional office whenever he was called upon to fill a temporary vacancy, and he attended his duties in this regard with efficiency, reliability, and unfailing courtesy to one and all. “Finally, on a more personal note, I am deeply indebted to the support and encouragement that Oswald extended to me all through my years before, during, and after his involvement in public life. Regional News Kamala Harris loves Jamaica, says cousin DISTURBED by reports that United States vice-president-elect Kamala Harris has been snubbing her Jamaican roots, her cousin Patrick Harris has strongly come out in her defence. “Kamala loves Jamaica dearly, and even though the media here is harping on her South Asian heritage, we know she has Jamaica on her mind,” Patrick Harris shared with The Sunday Gleaner. Kamala Harris was born to Indian mother Shyamal Gopalan Harris and Jamaican father Donald Harris. Her rise to vice-president-elect of the super power has been a source of pride for nationals of both countries, but some Jamaicans have expressed disappointment and even anger over what they perceive to be a deliberate slight of her Jamaican roots whenever Harris makes public speeches.

“We are very proud of her but we are straining our ears to hear her acknowledge Jamaica. It would go a far way in soothing Jamaicans at home and abroad if she would just say it. All we keep hearing about is her Indian mother. Jamaica is tiny compared to India but our culture is world renowned,” expressed Philadelphia-based Maureen Williams. But Harris’ cousin pointed to her body language and persona as being uniquely Jamaican. “You can see when she is on stage and the reggae music starts how she dances like a true Jamaican. She has not and will never forget her roots. Maybe she doesn’t say enough but she lives it and represents our country well,” he said. Bermuda: Baby among four new coronavirus cases THE Premier highlighted his frustration on Tuesday night after a baby contracted the coronavirus because people failed to follow precautions at a workplace. David Burt was speaking after Kim Wilson, the Minister of Health, reported that there were four coronavirus cases out of 808 test results received on Tuesday. The age range of all 239 confirmed cases in Bermuda is from infant to 101 – with the baby the youngest case so far. Mr Burt said: “The fact that we are dealing with someone who is under the age of one clearly is due to the fact that at a workplace people were not following simple and basic precautions. “There was an individual who had symptoms who was there for a week, persons were concerned and nothing was done – inexcusable. “So we are actually now dealing with potential additional restrictions … and we got lucky in capturing the case and identifying the cluster as quickly as possible because individuals had a concern and they took it upon themselves to go ahead and get tested.” He added: “I’m upset because this is completely and absolutely preventable and it is inexcusable for this particular workplace for that to have happened, completely inexcusable. “If there is one place where they should have known what the rules are, it’s that place.”

Ms Wilson said that one of the new cases was a returned resident who arrived on a Delta Air Lines flight from Atlanta last Sunday. Three were transmitted on island with a known contact – one had household contact with an underinvestigation case linked to a workplace. The other two were residents who had close contact in the same household as a case linked to the same workplace. The age range for the three onisland transmissions is infant to 56. The latest results bring the number of active coronavirus cases to 25 with none in hospital. A total of nine people with Covid-19 have died and 205 people have recovered from the coronavirus. The country status has changed to “clusters of cases”. Ms Wilson appealed to the public to reduce their “bubbles”. She said: “Choose only one or two other households to socialise with for the next few weeks. “It is particularly easy to be casual in the workplace and relax around colleagues as you would around your family. Do not do this.” Ms Wilson added that gatherings of different households over the holiday season should be limited to as few people as possible so that social distancing could be maintained. She said that gatherings should be held outdoors rather than inside where possible and that ventilation should be increased indoors and

guests should wear masks. Ms Wilson said that health officials were in talks with care home operators over a proposal to restrict visitors to only people ruled to be “essential”. Changes are also expected to be made to regulations so that larger gatherings will be limited to 50 people, instead of 75 at present, without special permission. Ms Wilson said a “more comprehensive mandatory mask

He said that bars were thought to

be the “largest risk factor” and that changes to regulations were expected to include a requirement for bar staff to be screened for the coronavirus with saliva tests. Mr Burt said that police have been asked to take a zero-tolerance approach, especially to licensed premises, which he added was not used last weekend after police announced they would crack down on people who flouted the rules. He warned that licensed premises who failed to stick to health rules could be shut down for 24 hours. Mr Burt said: “I have no desire whatsoever to revert to shelter-inplace … but if we do not all do our part, we will be forced to do so. “We have seen other countries where small outbreaks have turned into larger outbreaks. “That is not what we will have here.” Mr Burt said that the WeHealth Bermuda app – along with contact tracing, mask-wearing and social distancing – would give “even greater protection” from the coronavirus. The technology is to be piloted this week. Mr Burt added: “When phones that have WeHealth Bermuda installed are near each other, the app uses Bluetooth signals to determine how long and how close users were together. “If a WeHealth Bermuda user tests positive for the coronavirus, they can privately share their diagnosis with the app.

US election 2020: Biden says White House co-operation ‘sincere’ US President-elect Joe Biden says the White House has so far been “sincere” in helping his transition to power. “It has not been begrudging so far, and I don’t expect it to be,” he told NBC News in an interview. He spoke as he unveiled his choice of top officials for when he takes over from Donald Trump in January. Mr Trump finally agreed to allow the formal transition process to begin on Monday, nearly three weeks after the presidential election. Yet he still refuses to admit defeat, repeating unsubstantiated claims that the 3 November vote was “rigged”. President Trump’s efforts to challenge the results in key states in courts have so far failed. On Tuesday, Pennsylvania and Nevada officially certified Mr Biden’s victory, a day after the same outcome was announced in Michigan. Mr Trump is expected later on Wednesday to join his lawyer Rudy Giuliani in Gettysburg, Pennsylvania, where what is being described as a “hearing” of the state senate’s Republican majority on allegations of voter fraud is taking place. State officials have denied the allegations, and on Monday Pennsylvania’s supreme court dismissed a Trump campaign lawsuit aimed at invalidating millions of

Windrush generation: UK ‘unlawfully ignored’ immigration rules warnings THE Home Office unlawfully ignored warnings that changes to immigration rules would create “serious injustices” for the Windrush generation, a report by the equalities watchdog says. It found the “hostile environment” policy, designed to deter “irregular” migrants from settling, had harmed many people already living in the UK. The Windrush generation came from the Caribbean to the UK from 1948 to 1971. The Home Office said it was determined to “right the wrongs suffered” by them. Labour said ministers should be “deeply ashamed” of the report’s findings. An estimated 500,000 people living in the UK make up the surviving members of the Windrush generation. They were granted indefinite leave to remain in 1971, but thousands were children who had travelled on their parents’ passports. Because of this, many were unable to prove they had the right to live in the country when “hostile environment” immigration policies - demanding the showing of documentation - began in 2012,

under Theresa May as home secretary. This adversely affected their access to housing, banking, work, benefits, healthcare and driving, while many were threatened with deportation. The Equality and Human Rights Commission’s (EHRC) report found a “lack of organisation-wide commitment, including by senior leadership, to the importance of equality and the Home Office’s obligations under the equality duty placed on government departments”. It added: “Any action taken to record and respond to negative equality impacts was perfunctory, and therefore insufficient.” The report also said: “From 2012, this [hostile environment] agenda accelerated the impact of decades of complex policy and practice based on a history of white and black immigrants being treated differently.” The EHRC recommended that, to ensure “measurable action”, the Home Office should enter an agreement with it by the end of January 2021, involving “preparing and implementing a plan” of “specific actions” to “avoid a future

breach”. This should apply to its immigration work “in respect of race and colour, and more broadly”, it said. The Home Office has agreed to enter an agreement with the EHRC. The commission’s interim chair Caroline Waters said: “The treatment of the Windrush generation as a result of hostile environment policies was a shameful stain on British history. “It is unacceptable that equality legislation, designed to prevent an

unfair or disproportionate impact on people from ethnic minorities and other groups, was effectively ignored in the creation and delivery of policies that had such profound implications for so many people’s lives.” In a statement, Home Secretary Priti Patel and Home Office permanent secretary Matthew Rycroft said they were “determined to right the wrongs suffered by the Windrush generation and make amends for the institutional failings they faced, spanning successive

governments over several decades”. They added that the department was already applying a “a more rigorous approach to policy making” and would “increase openness to scrutiny, and create a more inclusive workforce”. It was also launching “comprehensive training” for all staff “to ensure they understand and appreciate the history of migration and race in this country”, they said. But Satbir Singh, chief executive of the Joint Council for the Welfare of Immigrants, said campaigners had “repeatedly warned the Home Office that their hostile environment policies would inevitably lead to serious discrimination and to the denial of rights, particularly for people of colour”. He added that “successive home secretaries” had “ignored these warnings” before the situation hit the headlines in 2018. For Labour, shadow home secretary Nick Thomas-Symonds said: “Ministers must work urgently to rectify this, including getting a grip of the Windrush compensation scheme, which has descended into an offensive mess, piling injustice upon injustice.”

Rishi Sunak warns ‘economic emergency has only just begun’ The “economic emergency” caused by Covid-19 has only just begun, according to chancellor Rishi Sunak, as he warned the pandemic would deal lasting damage to growth and jobs. Official forecasts now predict the biggest economic decline in 300 years. The UK economy is expected to shrink by 11.3% this year and not return to its pre-crisis size until the end of 2022. Government borrowing will rise to its highest outside of wartime to deal with the economic impact. The government’s independent forecaster, the Office for Budget Responsibility (OBR) expects the number of unemployed people to surge to 2.6 million by the middle of next year. It means the unemployment rate will hit 7.5%, its highest level since the financial crisis in 2009.

However, fewer jobs are expected to be lost than predicted this summer. Setting out his Spending Review detailing how much would be spent on public services, Mr Sunak said the government was dealing with an “economic emergency”. He added: “That’s why we have taken, and continue to take, extraordinary measures to protect people’s jobs and incomes.” The government has subsidised the wages of employees unable to work due to the pandemic, in an effort to protect jobs. It said extending these schemes to next March meant 300,000 fewer people would be out of work. Mr Sunak confirmed that around 1.3 million public sector workers excluding some NHS staff and those earning less than £24,000 - will have their pay frozen next year. The shadow chancellor, Anneliese Dodds, criticised the pay freeze. She said: “Earlier this year the chancellor stood on his doorstep and clapped for key workers. Today, his government institutes a pay freeze for many of them. Other rates were also increased. From next April, 16 and 17 year-olds will see their pay go up to £4.62 per hour, from £4.55 today. Mr Sunak said the new 0.5% target - which adds up to about £4bn in savings - will be “temporary”. And millions of retirees will see the future value of their pension cut owing to a planned change in the way payments are calculated from

Maxwell, who is awaiting her trial at the Metropolitan Detention Center (MDC) in Brooklyn, New York, is “in de facto solitary confinement under the most restrictive conditions,” according to her legal counsel. Maxwell is “excessively and invasively searched” and monitored 24 hours per day, treatment her lawyer says is more restrictive than prisoners convicted of terrorism or capital murder. Netflix removes Dave Chappelle’s show after comedian’s complaint NETFLIX has removed comedian Dave Chappelle’s 2000s sketch show after he complained he wasn’t getting paid as part of the deal for it to be streamed. Chappelle’s Show first aired on Comedy Central from 2002 to 2006. But in excerpt from a recent standup gig that he posted on Instagram, he claimed he “never got paid” royalties after the show’s original run. He castigated Comedy Central’s parent company ViacomCBS for continuing to make the show available on HBO Max. “People think I made a lot of money from Chappelle’s Show,” the 47-year-old said in his routine. “When I left that show I never got paid.” He claimed he was “desperate” when he signed his original contract, and that its terms mean ViacomCBS and other parties can rebroadcast Chappelle’s Show without being obliged to pay him. “I found out that these people were streaming my work and they never had to ask me or they never have to tell me,” he said. “Perfectly legal because I signed the contract.” Chappelle recently referenced the matter while hosting the weekly comedy show Saturday Night Live

Ken Jennings, the megachampion of one of America’s favorite game shows, scored a Grammy nomination Tuesday for narrating Alex Trebek’s 2020 memoir — joining a list that includes Streep, MSNBC anchor Rachel Maddow and journalist Ronan Farrow in the best spoken word album category. But Jennings, who narrated the book along with Trebek, seemed surprised to be sharing the honor with the late “Jeopardy” host. “This should 100% be Alex’s Grammy nomination,” Jennings tweeted shortly after the nominees were announced. “He wrote the book and reads much of the audiobook! Meghan: Duchess of Sussex tells of miscarriage ‘pain and grief’ The Duchess of Sussex has revealed she had a miscarriage in July, writing in an article of feeling “an almost unbearable grief”. “I knew, as I clutched my firstborn child, that I was losing my second,” Meghan said in a piece for the New York Times. She went on to describe how she watched “my husband’s heart break as he tried to hold the shattered pieces of mine”. Meghan wrote that “loss and pain have plagued every one of us in 2020”. The 39-year-old shared her experience to urge people to “commit to asking others, ‘are you OK?’” over the Thanksgiving holiday in the US. A source close to the duchess confirmed to the BBC that the duchess is currently in good health and the couple wanted to talk about what happened in July, having come to appreciate how common miscarriage is. Tommy’s midwife Sophie King said talking about baby loss in pregnancy is “a real taboo in society” so “mothers like Meghan sharing their stories is a vital step in breaking down that stigma and shame”. She said the duchess’s “honesty and openness” sends a “powerful message to anyone who loses a baby: this may feel incredibly lonely, but you are not alone”. Clea Harmer, chief executive of stillbirth and neonatal death charity Sands, said it was a “sad reality” there was a stigma surrounding pregnancy loss and baby death, which “leaves many parents feeling isolated”. “The isolation we have all felt this year has made it even more difficult for parents whose baby has died during the Covid-19 pandemic and has brought back painful emotions for all those who have lost precious loved ones,” she said. Dr Christine Ekechi, of the Royal College of Obstetricians and Gynaecologists, said it was “important” that any stigma or shame surrounding this issue was removed. “Sadly, early miscarriages are very common and they can be a devastating loss for parents and their families,” she said. The late-night comedian will host the 2021 edition of the annual awards show honouring the year’s top musical achievements, the Recording Academy announced Tuesday. “Despite the fact that I am extremely disappointed that the Grammys have refused to have me sing or be nominated for best pop album, I am thrilled to be hosting this auspicious event,” Noah said in a statement. “I think as a one-time Grammy nominee, I am the best person to provide a shoulder to all the amazing artists who do not win on the night because I too know the pain of not winning the award! Scientists make breakthrough in antiaging treatment and reverse signs of ageing in human cells WHILE ageing is a natural process, we humans have always fought against it. And now a group of scientists from Israel have managed to actually reverse the process of ageing in what is being hailed as ‘breakthrough research’. The adult blood cells that went through the therapy using oxygen were found to be growing younger. The project was undertaken by scientists of the Tel Aviv University and the Shamir Medical Center and the findings have been published in Aging magazine on 18 November. What the team did was to treat the cells in a pressure chamber with

high-pressure oxygen. They were able to not only halt the ageing process but reverse two major processes associated with ageing and its illnesses. The first one was the shortening of telomeres (cap-like structures present in chromosomes) and the other was an accumulation of old and malfunctioning cells in the body. Professor Shai Efrati of TAU led the research on hyperbaric oxygen treatments (HBOT) in healthy ageing adults. As Al Jazeera reports, about 35 adult human beings who are more than 64 years old were part of the study. All of them were given HBOT for 90 minutes a day, five times a week

I was sitting by the phone all night long thinking: ‘Should I call 911?’” Hutchison said of his symptoms, which were gone after about 12 hours. “Nobody prepared me for the severity of this.” All vaccines come with a list of possible side effects, including rare

but serious side effects. However, experts have long stressed that with modern vaccines it is not possible to contract the pathogen that one is being vaccinated against by taking the vaccine itself, while any side effects that do occur are nearly always short-lived and far less serious than the disease it provides protection against, even if they are unpleasant. Detailed safety data from late stage trials of Pfizer’s vaccine, developed in collaboration with the German company BioNTech, has not yet been released, but the companies said the vaccine does not present “any serious safety concerns.” Initial data showed that fatigue and headaches were the most common side effects, both occurring in fewer than 4 percent of trial participants after the second dose. Since both vaccines have the potential to result in severe but temporary side effects, possibly more often than other common vaccines like flu shots, some experts have urged doctors and public health officials to inform the public that effects like a temporary but high fever are possible, while taking care to counter those who would use the ultimately harmless side effects to promote anti-vaccination conspiracy theories.

Physicists could do the ‘impossible’: Create and destroy magnetic fields from afar The huge SLS core stage was transferred from Louisiana to Mississippi for testing earlier this year.

SLS: Nasa ‘megarocket’ assembly begins in Florida NASA has started assembling the first Space Launch System (SLS) rocket on a launch platform ahead of its maiden flight next year. The SLS is the giant rocket that will send US astronauts back to the Moon this decade - with the first crewed landing targeted for 2024. Engineers in Florida have begun stacking the segments that make up the vehicle’s two solid rocket boosters. The rocket is scheduled to make its debut in November 2021. The SLS consists of a giant, 65m (212ft) - long core stage with four engines that’s flanked by the twin solid fuel boosters. Together, these produce a massive 8.8 million pounds (39.1 Meganewtons) of thrust that can loft astronauts into orbit; the rocket subsequently hurls them towards the Moon. Teams at Nasa’s Kennedy Space Center in Florida lowered the first of 10 booster segments into place on a structure known as the mobile

launcher on 21 November. The process is taking place inside the iconic Vehicle Assembly Building (VAB) at Kennedy. The boosters will burn six tonnes of solid, aluminium-based propellant each second when the SLS launches. They provide 75% of the vehicle’s thrust at lift-off. The mobile launcher they’re being stacked on is a 115m (380ft) -tall structure that’s used to process and assemble the SLS before moving it to the launch pad. It’s a huge symbolic step, not only for the SLS - which has been under development for a decade - but also Nasa’s plan to send the next man and the first woman to the lunar surface by 2024, known as Artemis. “Stacking the first piece of the SLS rocket on the mobile launcher marks a major milestone for the Artemis programme,” said Andrew Shroble, a manager with Jacobs engineering group which is working on the rocket for Nasa.

SCIENTISTS have figured out a way to create and cancel magnetic fields from afar. The method involves running electric current through a special arrangement of wires to create a magnetic field that looks as if it came from another source. This illusion has real applications: Imagine a cancer drug that could be delivered directly to a tumor deep in the body by capsules made of magnetic nanoparticles. It’s not possible to stick a magnet in the tumor to guide the nanoparticles on their journey, but if you could create a magnetic field from outside the body that centered right on that tumor, you could deliver the drug without an invasive procedure. The strength of a magnetic field decreases with distance from the magnet, and a theorem proven in 1842, Earnshaw’s Theorem, says that it’s not possible to create a spot of maximum magnetic field strength in empty space. “If you cannot have a magnetic field maxima in empty space, it means you cannot create the field of a magnetic source remotely, without placing an actual [magnetic] source at the target location,” said Rosa Mach-Batlle, a physicist at the Istituto Italiano Di Tecnologia Center for Biomolecular Nanotechnologies in Italy who led the new research. Mach-Batlle and her colleagues, though, thought they might be able to get around that problem. They were inspired by work in optics that uses engineered materials known as metamaterials (designed to have

properties not found in any naturallyoccuring material) to get around limits on resolution set by the wavelength of light. Similarly, they thought, hypothetical magnetic materials might enable the impossible in the world of magnetic fields. The researchers envisioned a material with a magnetic permeability of negative 1. A material’s magnetic permeability indicates how much that material increases or decreases a magnetic field when exposed to that field. In a material with a magnetic permeability of negative 1, the direction of the magnetism induced within the material would be the opposite of the direction of the initial magnetic field. Of course, a new method of inducing magnetic fields that relied on materials that don’t exist wouldn’t be particularly useful. But even though this hypothetical material with negative permeability doesn’t exist, physicists can create a sort of temporary “material” out of electric current running through a specific arrangement of wires. That’s because current induces magnetism and vice versa, a consequence of Maxwell’s Equations of electromagnetism. “In the end, we do not use any material, we use a precise arrangement of currents that can be regarded as an active metamaterial,” Mach-Batlle told Live Science. To create the field from a distance, Mach-Batlle and her team created a hollow cylinder made of about 20 wires surrounding one long interior wire. When current runs through these wires, it creates a

magnetic field that looks the same as if the long interior wire were actually outside the device. It’s the electromagnetic equivalent of a ventriloquist throwing her voice; the source of the field is not actually outside the device, but the field itself is indistinguishable from the field that would have resulted if the source were outside the device. “We create the illusion of having this source at a distance,” Mach-Batlle said. The researchers published their findings Oct. 23 in the journal Physical Review Letters. There are still questions about how well this method would work for real-world applications. One quirk of the system is that there is an area of very strong magnetic fields between the wire cylinder and the field-at-adistance. This region could interfere with some applications of the research, Mach-Batlle said, though whether it would be problematic or not probably depends on what you’re trying to do with the field. Possible applications beyond drug delivery include canceling out magnetic fields from afar, a technique that could be useful in quantum computing to reduce “noise” from external fields that can interfere with measurements. Another use might be improving transcranial magnetic stimulation, which uses magnets to stimulate neurons in the brain to treat depression. Being able to control magnetic fields at a distance could improve the targeting of transcranial magnetic stimulation, so that doctors could better focus on particular regions in the human brain.

FOOTBALL legend Diego Maradona has died at the age of 60 following a heart attack. Matias Morla, Maradona’s longtime agent, confirmed the news to EFE on Wednesday. A statement from the Argentina Football Association read: “The Argentine Football Association, through its President Claudio Tapia, expresses its deepest pain at the death of our legend, Diego Armando Maradona. You’ll always be in our hearts.” Argentina President Alberto Fernandez also confirmed three days of national mourning following the news. Fernandez posted a photograph of himself on Twitter hugging Maradona with the message: “You took us to the highest place in the world. You made us immensely happy. You were the greatest of all. Thanks for existing, Diego. We are going to miss you the rest of our lives.” Retired Brazilian soccer star Pele

There were also notable lows, when he was kicked out of the 1994 World Cup after being found guilty of doping. Napoli said on Wednesday the death was a “devastating blow” for

both the city and the club. “We are in mourning,” club spokesman Nicola Lombardo said. “We feel like a boxer who has been knocked out. We are in shock.” Since ending his playing career in 1997, the ex-Napoli, Barcelona and Boca Juniors star battled a series of health issues. He was admitted to hospital in January 2019 with internal bleeding in the stomach. He also fell ill at the 2018 World Cup in Russia, where he was filmed passing out in an executive box at the Argentina-Nigeria game. In 2004, he was hospitalised with severe heart and respiratory problems related to a long battle with drug addiction. He had undergone two gastric bypass operations to control his weight and received treatment for alcohol abuse. Maradona is survived by his longtime partner, Veronica Ojeda, two daughters, two sons, four grandchildren, and his former wife, Claudia Villafane. (ESPN)

Gordon Taylor: PFA chief executive to stand down at end of season PROFESSIONAL Footballers’ Association chief executive Gordon Taylor will stand down at the end of the season - two years after first announcing his intention to do so. The 75-year-old has held the role since 1981 and a letter announcing his resignation was sent to members on Wednesday afternoon. In 2019, the PFA commenced a “full and open review” into its finances. This review - first announced in November 2018 - was completed in July. It came following intense criticism of the players’ union. At the time, he said the organisation’s entire management committee, including himself, would stand down at the annual general meeting following the report’s release. The 2020 AGM will take place on Thursday, where members will vote on a new governance structure in which the outgoing management committee would be replaced by a players’ board and an operational board, which would oversee the day-to-day

running of the union. “As I announced at our previous AGM, now that the independent review process has completed, I too will step down, by the end of the current season,” Taylor wrote. “A new chief executive will be elected following the recruitment procedure recommended by the independent review, and we have already made substantial progress in that direction. I will of course be available in the future whenever needed to support the PFA.” Taylor is credited with negotiating the PFA’s biggest source of income - around £25m per year from the Premier League. But the PFA has recently come under more scrutiny around the issue of dementia, which is a growing concern for former players and the subject of fury from some over a perceived lack of action and support by the PFA. Earlier on Wednesday, John Stiles - the son of former England international Nobby Stiles, who died in October - had called for the resignation of Taylor and his leadership team.

Pope Francis meets with NBA players to discuss social injustice FIVE NBA players visited the Vatican on Monday to discuss social and economic injustice with Pope Francis. According to the NBPA -- the league’s players association -- the meeting took place in the papal library of the Apostolic Palace where the players spoke about their efforts to address inequality in their communities. The players present were Jonathan Isaac, Sterling Brown, Marco Belinelli, Kyle Korver and Anthony Tolliver. “Today’s meeting was an incredible experience,” said Tolliver. “With the Pope’s support and blessing, we are excited to head into this next season reinvigorated to keep pushing for change and bringing our communities together.”

The meeting comes in a year when athletes in the Unites States and around the world have protested against social injustice. In the NBA last season, as with many sports leagues, players took a knee before games and wore the Black Lives Matter slogan on jerseys. “Looking at the problems in society and especially those of social justice, sport can be a good means of resolving them,” Pope Francis said during the meeting. “We should always remember this because your message is the goodwill of sports but also working together as a team, the work as a community and may this be the seed of beauty and of a shared development towards justice.” (CNN)

THE ENGLAND and Wales Cricket Board (ECB) has announced a range of measures designed to increase diversity in the game, including the formation of an independent commission for equality. A number of allegations of racism have been made against the English game. The governing body will also establish a “Forum for Race”, which it says will exist to “listen to and learn from” experiences of those within the game. It will also introduce an equality code of conduct. In June, against the backdrop of the Black Lives Matter movement, former England batsman Michael Carberry said that racism is “rife” in the game. The following month, ECB chief executive Tom Harrison said that English cricket had to face some “uncomfortable truths”. More recently, Azeem Rafiq accused his former team Yorkshire of “institutionalised racism” and the county have since opened an inquiry. Last week, ex-umpires John Holder and Ismail Dawood pointed to the fact that the last appointment of a black, Asian and minority ethnic (BAME) umpire to the ECB’s firstclass list came 28 years ago. Now, the ECB says it is committing to “further action to drive out discrimination and increase

The independent commission will “assist the ECB board in assessing the evidence of inequalities and discrimination of all forms within cricket, and the actions needed to tackle these issues”. TRIBUTES have been paid to “immense” former France rugby union international Christophe Dominici, who has died aged 48. Dominici was best known for helping France knock New Zealand out of the 1999 Rugby World Cup. A witness saw him climb the roof of a disused building at Saint-Cloud park, near Paris, on Tuesday before falling, officials say. Prosecutors have opened an inquiry into the cause of his death. “So much sadness. Christophe Dominici was an immense player, an artist. His sudden death is a shock,” said sports minister Roxana Maracineanu. Dominici played 67 times for his country and won the French championship five times with Stade Français before retiring in 2008. In recent years he had worked as a pundit for French radio and TV. His 1999 World Cup semi-final performance spurred France to a sensational comeback, as he darted down the left of the pitch and seized the ball ahead of two New Zealand defenders to score a try. The All Blacks were leading the game at the time and had the brilliant Jonah

South Africa v England: Proteas’ knee decision taken ‘unanimously’ SOUTH Africa say their decision not to take a knee before matches in the upcoming series against England has been taken “unanimously” as a team. The Proteas will wear black armbands as part of a period of national mourning for victims of gender-based violence and the coronavirus pandemic. “Our decision does not indicate we do not care about racism, racial equality, or justice,” said a statement. “Now, more than ever, we are committed to this work.” The first of three Twenty20 internationals is on Friday, with a

Since taking the reins of the sport some 13 years ago, Burant has transformed it from a past time for expats to a competitive entity—with the senior national rugby team excellent against formidable opponents. In an invited comment, Burant told the Weekly News that the AGM gave members a chance to discuss the many challenges that the pandemic had posed to rugby and

WHEN Marco Fenelus took a break from football to recover from a thigh injuries in June, his team was struggling in the league and a top-three finish looked difficult. At that time they had won four games in eight tries, which had left them fourth in the eight-team battle of the Taiwan Football Premier League. The Turks and Caicos Islands’ Football player returned in early July with a bang and led his team to a phenomenal run, which resulted in them picking up the pace to not only enter the top three, but to battle for second place and then to hold off all competitors for the top spot. Last weekend, they inked their name in the annuals of the tournament in the Asian country by winning the 2020 league. They accumulated a whopping 48 points from 20 games, with a game left to play. Their main competitors Taipower ended up drawing their

clash, which left them on 43 points with one game to play. As he did from July, Fenelus again left the charge. He scored twice and made the assist in the Tainan Football Club’s 3-1 win against Hang Yuen FC. TOUGHEST RUN For Fenelus playing with a new team, overcoming an injury and remaining mentally calm during a pandemic resulted in the season being the toughest since he travelled to Taiwan four years ago. “This year with the new team is definitely the toughest one due to the injuries I’ve had at the beginning of the season.” Despite the fairytale run, Fenelus still feels that this season is pale in compassion to 2017 when he led former team Tatung FC to victory and won the Golden Boot award with 38 goals. With one game left, he sits in second place with 18 goals. Two players are tied with 19 goals.
