Residents still annoyed with level of noise coming from trains RAHUL GUPTA rgupta@insidetoronto.com Metrolinx has reduced the volume of the bells on Union Pearson Express trains, which residents living by the West Toronto rail corridor say have constantly disrupted their lives since the line opened. The provincial transit planning agency relocated the ringing bells, described by residents as a constant dinging, to the middle of all UP trains, approximately 17 in total, and partially concealed them in soundproof material. They also clarified to train operators when the bells should be triggered. "These actions have had a positive effect at reducing the noise heard by the surrounding community," said Metrolinx spokesperson Anne Marie Aikins over email Monday, April 17. Aikins said the measures taken are part of an existing agency strategy to reduce noise in the vicinity of rail stations, which includes installing heated platforms - to eliminate the need for early morning snow plowing - and more digital signage in place of platform announcements. The actions were taken ahead of a hearing before the Canadian Transportation Agency (CTA) in response to a community grievance filed against Metrolinx for the bells. McComish and other residents complained about the endless ringing of bells from UP Trains running seven days a week from approximately 5 a.m. until after 1 a.m. There are 140 UP trains currently traveling to and from Bloor GO Station every day. They allege the sounding of the bells was lasting far longer than the 20 to 22 seconds estimated by Metrolinx. Last year more than 70 people, almost all residents of the Glenlake con-
dominium complex at 2495 Dundas Ave., signed a petition addressed to the Ontario transportation minister calling for the ceasing of the bells and the development of a mitigation plan with the federal government. Since the changes, the noise coming from the UP trains has reduced by half, acknowledged McComish, who chairs the West Bend Community Association and lives about four blocks away from the Bloor GO station. "I think it made a difference relocating the bells," he said. "It’s not perfect but it’s a whole lot better than it was." McComish said he filed
the grievance on behalf of a group of residents, and was unaware of the changes made by Metrolinx to the bells, which the agency did not publicly announce, at the time of the hearing. "I think the process demonstrates how difficult it is for community groups to win a CTA appeal given the high threshold of expert evidence required," he said. Not all residents are pleased with the changes. Michael Mahovlich who resides on Ernest Avenue said even with the reduced volumes, the noise remains intolerable. "I can’t have my windows open," Mahovlich said last week. "Even when
it’s closed I can hear the dinging." Mahovlich said he contacted the office of local city councillor Ana Bailao, and was forwarded a letter from city manager Peter Wallace acknowledging concern for the increased future use of the bells. In the letter addressed Feb. 23, Wallace admits the city is concerned about the prospect of increased noise from train bells once Metrolinx substantially boosts rail traffic after it expands and electrifies the GO Transit network. "My staff have communicated these concerns to Metrolinx and Transportation Canada and are in the process of assessing vi-
able alternatives," writes Wallace. The need for audible alerts at rail crossings, whether a bell or a whistle, is a federal requirement, but can be exempted if a safe alternative can be found, said a spokesperson for Transport Canada. "The Canadian Rail Operating Rules require trains to sound their whistle when they approach a public grade crossing," said Natasha Gauthier over email Tuesday. "Whistling is an important safety feature and can only be stopped if other safety requirements are met." The exemption can come from the federal transportation minister, who has final say in the matter. However, in order to get one, a rigorous multi-step process must be followed. First the city must receive a request from a citizen or community group. It must also consult with the rail operator before issuing a public notice it intends to challenge the whistling. The rules also require independent assessments on whether it’s feasible to cease the alerts. Even if an exemption is granted, Transport Canada can still revoke it if it feels not enough is being done to maintain safety at the crossing. Metrolinx will continue to work on mitigation efforts but rail safety is the paramount concern, Aikins said. "Safety is and must always remain our first priority," she said. "As service is increasing across the region, residents have also been clear that safety is as equally important to communities as efforts to mitigate noise."

Petitioning for ASD help for Aboriginal kids Petition needs 500 signatures by May 4 FANNIE SUNSHINE fsunshine@insidetoronto.com Ken Robertson moved his family some 4,000 kilometres from his home on a British Columbia reserve to Toronto so his children could receive top care for Autism Spectrum Disorder (ASD). Robertson moved with his wife and four children, two of whom have ASD, to Toronto a decade ago from Neskonlith reserve due to a lack of support services on reservations. The family could have stayed in British Columbia, but chose to make the trek to Toronto because of the city’s reputation as a leader in genetic research. Though he’s happy his children have received medical and educational support, Robertson said First Nations children fall short of getting proper access to
the health care they need. That’s why the Lansdowne Avenue and Bloor Street resident created a petition in January with the goal of acquiring a report focused on urban Aboriginal children with autism and details of the wait list for off-reserve First Nations, Inuit, nonstatus and Métis children. "It would be helpful for the Trudeau government to work with the provinces and territories and stakeholders to develop a pan-Canadian strategy for autism spectrum disorder, including, awareness and education campaigns, child, and adolescent and adult intervention innovative funding arrangements for financing therapy, surveillance, respite care, community initiatives, and research," the petition reads. "We, the undersigned, Canadian citizens, call upon the Minister of Indigenous and Northern Affairs to present findings to the Standing Senate Committee on Aboriginal Peo-
ples." According to Autism Ontario, ASD is a lifelong neurological disorder that affects the way a person communicates and relates to the people and world around them, including behaviour, social interactions, and verbal communication. Robertson is hoping to gather the 500 signatures needed for the government to acknowledge the petition by Thursday, May 4. As of the afternoon of Monday, April 10, it had 460 signatures. He admitted he will be "disappointed" if the petition, sponsored by Davenport MP Julie Dzerowicz, were to fall short of signatures, but "the fight never ends." World Autism Day is celebrated April 2. Community hospitals need your support Next week marks Community Hospital Week in our city – a week designated to help spread awareness of all that happens in these hospitals right in our own backyards. These health-care institutions are centres of innovation, teaching facilities and the place we go for countless health-care needs. Many of us know the emergency department well, but do you know they also offer highly specialized care? Internationally recognized programs and expert physicians and staff help put Canada’s health-care system at the front of the pack. The contributions of our community hospitals in achieving this can’t be taken for granted. East York pride can survive new boundaries East York is dead, yet it’s still with us. Next year will be 20 years since the province pushed six unwilling cities together, and East York – that borough on the Don River – was one. The spirit of East York hangs on, though; in sports leagues, legion halls, its historical society and garden club. The old civic centre is still there, and East York’s politicians don’t let residents forget. But now comes a new challenge: East York will take territory from North York. Ward boundaries designed to last Toronto the next four elections – Toronto council passed a bylaw establishing them last month – have "really torn apart the traditional boundaries of East York,"

town, a bit more new blood. It also means East York wards north of the Danforth absorb parts of North York west of the Don Valley. Paula Fletcher, council veteran from nearby Riverdale, bluntly says the boundary plan "completely disrespects East York as a legacy city." People have communities and they’re attached to them, Fletcher adds. "I think that’s important that we honour that, not carve it up." Davis, however, says she’s trying to be positive about the change. She’ll work even harder to keep East York pride, and identity, going. That identity is strong, she insists, in a generation calling themselves East Yorkers - some trading
memorabilia online - after East York, the municipality, ceased to be. The plan’s also notable for what it doesn’t change. Etobicoke, beyond the Humber River, stays intact, though a councillor there, Justin DiCiano, is appealing the redistribution anyway. Victoria Park Avenue remains the wall beyond which Scarborough lies. An earlier option divided the Beach, merging one of its wards with southwestern Scarborough. Sarah Lo, co-owner and coach at Toronto Boxing Academy, was named best female fighter at the Ontario Golden Gloves competition April 8. The tournament, which took place in Kitchener, Ont., saw Lo and co-fighter Dylan Stainthorpe compete in events. Lo went to the finals, where she went the full three rounds and won by unanimous decision. Meanwhile, Stainthorpe made it as far as the semifinals, where through three action-packed backand-forth rounds he lost in a split decision. Last year, Stainthorpe earned a gold medal and best boxer of the tournament honours, and Lo earned a silver medal and fight of the night honours. The next round of the Ontario Golden Gloves is April 22.

The committee also heard from representatives from big mall owners like Oxford Properties and Cadillac Fairview. Martin Wray of Cadillac Fairview manages malls like the Toronto Eaton Centre - which as a designated tourist area can be open on holidays and Sherway Gardens in Etobicoke - which does not have that designation. The contrast between the two is stark. At the Eaton Centre, Wray said that 3,000 people are going to work on holidays, and are seeing close to $100 million in sales. At Sherway Gardens, "we’re probably losing 550,000 shoppers in a year and giving up $60 million in sales going elsewhere." Labour representatives urged the committee, meanwhile, to simply shore up the definition of what a prepared meal was, and leave the exemptions to bars and restaurants alone - as well as other measures that might loosen the bylaw.

Toronto’s licensing and standards committee took a step toward opening up more retail on statutory holidays - letting city staff start consultations on opening up grocery stores, entire pharmacies and creating more tourism exemptions for small business. Once that’s done, Toronto’s holiday shopping bylaw could undergo its first major overhaul since it was approved in 2006 - an amendment spurred on by a court decision overturning Toronto’s attempt to prosecute Longo Brothers Fruit Markets Inc. for defying the bylaw. That decision found that Longo could fall under the exemption for holiday openings for businesses that serve prepared meals, as the grocery store chain also served prepared meals from its delicatessen. Now, however, city staff are looking to consult on other possible exemptions that would allow businesses to stay open on the nine statutory holidays in Ontario. Among those: allowing pharmacies to open grocery and cosmetic sections of the stores on statutory
holidays; allowing more business improvement areas to apply for tourist area exemptions; and developing an application process for any retailers to request an exemption from the bylaw. Committee member Glenn De Baeremaeker said the changes would simply a matter of keeping up with the times. "For us to think that the society we live in today is the same as it was in 1950 where people work only five days a week . it doesn’t exist anymore," he said. "To say to the brick and mortar stores, to say we’re going to handcuff you nine days out of the year . that’s wrong." The committee heard from both sides of the argument. Workers Action Centre organizer Pam Frache said that the holidays are the only days off that nonunionized retail workers can count on. "Those nine days are the only days that they know their workplace is closed," said Frache. "In the Greater Toronto Area, hundreds of thousands of workers are in the retail sector and it’s a minority that are in unions." She scoffed at the idea

Dreaming of a big transit win Maybe it’s all those crowds gathering in Maple Leaf Square lately, but I can’t help compare the fortunes of public transit with this city’s long-suffering sports teams. Both the Leafs and Raptors are embarking on playoff quests, creating a fervour not usually seen around here this time of year. Fans of that other municipal pastime, transit watching, might also feel a little optimistic these days with federal funds flowing and mega infrastructure projects like the Eglinton Crosstown LRT nearing completion. For the first time in a while, there’s optimism Toronto might yet achieve its sporting and mobility dreams. Let’s not get too carried away. Improvement in both realms is largely incremental. The Raps have ignited the city for the last three years only to fall short of a championship, sometimes embarrassingly so. Leafs fans are only just getting

Last week, Mayor John Tory continued his practice of blitzing neighbourhoods to speak on his twin passions: pumping up Toronto’s professional sports teams and beseeching other governments for funding. On that second matter, he
spoke directly to Ontario Premier Kathleen Wynne, imploring her to think of the opportunity presented in saving transit. Pleading with a higher power? Most sports fans can relate. Let’s not forget the transit rider, pitched on the promise of a network expansive enough to one day connect Agincourt with Alliston, yet forced to rely right now on a service growing ever more expensive and unreliable. Kind of like a season-ticket holder asked to re-up for pricier ducats with little guarantee of a winning team. You get the picture. Hope springs eternal and maybe, just maybe, we will one day see this city’s transit ills addressed. Perhaps in time for a championship parade down Bay Street. In last week’s column, we spoke of John Tory’s conundrum in the coming 2018 election: how to balance the need to defend against a candidate running from a populist rightwing Ford Nation position, and convince the majority of non-Nation voters that he hasn’t out-and-out defected. Kathleen Wynne’s problem is much starker. As it stands, it seems as though the MPP for Don Valley West is a premier without a nation. Going into the 2018 provincial election, her approval rating hovers in the middle teens. Faced with ratings not very much lower last year, French President François Hollande made the call to bow out of the elections there. There is pressure on Wynne to do the same. Her reluctance (as of this writing April 18) is understandable: after all, didn’t she just deliver a majority government to the Liberals three short years ago?
DAVID NICKLE The City That one was a long-shot too, and Wynne won by tacking to the left while Tim Hudak’s PCs and the New Democrats’ Andrea Horwath tacked populist right. And she has governed more or less as she campaigned, pushing progressive sex education rules, public transit expansion, and, soon to come, rising minimum wage, and even a guaranteed universal basic income pilot project. There have been problems - out-of-control Hydro rates, electoral scandals and a sputtering climate-change plan - but many of them are frankly
business-as-usual for the Liberal oligarchy in Ontario. If they weren’t branddestroying in 2014, why are they now? Ontario voters got what they asked for and knew what they were getting. So what gives? The fact that no one can offer a definitive answer is what makes Wynne’s conundrum so bedevilling. Her last chance to find that answer is coming in just a week, when her finance minister Charles Sousa delivers what he promises to be a balanced budget - the first in years - without, he promised last week, any new taxes on families. If that doesn’t work . well, it will be hard to justify anything other than following Hollande’s lead, and give up on any hope of leadership.
