"One of the reasons it’s a long road (to changing that) is that homeowners vote," said Jon Burnside, Thorncliffe’s councillor. Landlords want property tax breaks, or big cuts in development charges before they build apartments. Tenants who live in Thorncliffe, or anywhere there are roaches or the hot water cuts out when people are showering, can mostly look forward to more of the same. But they’re tired of landlords being awarded rent hikes above inflation while renters get no raises at work, work orders that see months go by without results, and a tenant board seemingly weighted toward landlords. If they’re lucky, they’ll get tougher city enforcement - thanks to a new landlord bylaw - and rebuilt elevators that beep angrily when overcrowded, until enough people step off.

What’s happening in Thorncliffe Park is what’s happening in Toronto’s other highrise neighbourhoods, only more so. Its problems can’t be solved, only patched. The elevators grind, fail, sit waiting for repair. Bugs crawl. Kitchen cabinets fall apart. Thorncliffe’s aging: 43 apartment buildings in a horseshoe of land on the Don River. They were built long ago, like St. James Town, Flemingdon Park, and Scarborough’s Markham Road highrises, when Toronto apartment towers rose at the rate condos are popping up today. Thorncliffe’s overcrowded: grandparents and cousins are shoehorned in. Families rent rooms in other people’s apartments. Designed for 12,000 residents, the neighbourhood has 30,000, possibly 45,000. Ontario Premier Kathleen Wynne, the area’s MPP, pronounced the overcrowding unsolvable, except through "community conversation," last week when Thorncliffe tenants and landlords

The burden - and cost - of preparing for these potential disasters falls squarely on the shoulders of municipalities. Not only must our towns and cities prepare without knowing when, how often and what materials companies are transporting, they must also find a way to pay for managing the dangers these private rail carriers pose. For security reasons, real-time information is not available. And what information is shared with select municipal officials is not intended to be shared with the public. No one wants to tip off a potential terrorist about the exact location of specific chemicals. And the rail carriers don’t want to panic the public. Not only are emergency responders faced with a lack of information, the public remains largely in the dark about what dangerous goods are rolling through their communities. This culture of secrecy does not allow residents to make informed decisions or adequately prepare for possible disaster scenarios. More information is needed. The public needs to have general data regarding what is regularly transported through their backyards. Municipalities need more up-to-date information about what dangers their first responders might have to battle. And those first responders need adequate funding to defend against the worst case scenarios. Rail lines are an important part of this country’s economy, but the dangers they pose need to be better managed. It shouldn’t take another LacMegantic to bring about these much-needed reforms.

A PLACE OF UNSOLVABLE PROBLEMS

Rail carriers are working under a shroud of secrecy, putting Ontarians at risk every day. Information regarding what hazardous materials are shipped through our communities remains elusive. At any given moment, emergency responders and local governments have no idea what, exactly, is being transported through municipalities across the province. Yet they are the ones tasked with keeping the populace safe in the event of a disaster. The continued secrecy is putting the public at unnecessary risk and it is not a theoretical risk. The danger is very real. In 2015, 144 rail-related accidents occurred involving dangerous goods in Canada. The five-year-average is 140. One need only look to the disaster at Lac-Megantic to see how very real and devastating such disasters can be. When the unattended freight train derailed, it left 47 people dead and half of the community’s downtown destroyed. That train had previously passed through the densely populated GTA. The disaster prompted renewed calls from municipalities and the province for increased transparency on the shipment of dangerous goods. There have since been improvements to informationsharing, but has it gone far enough? Emergency responders in municipalities have access to historic data of what has come through their community. From that they can undertake disaster planning.

Family receives parking exemption Committee reverses original decision after ’human rights’ appeal RAHUL GUPTA rgupta@insidetoronto.com A Bedford Park couple can breathe easy after receiving an exemption from the city to park in their front yard to accommodate their young son with special needs. Kas and Kurt Lingenfelter originally had their appeal for the space in the front yard of their home at 45 Cranbrooke Ave. turned down by North York Community Council (NYCC) back in 2015. The couple launched an appeal on the grounds denying them use of the parking space to ac-

commodate disability is a violation of provincial human rights legislation. At its January meeting held Tuesday, NYCC voted to allow an exemption, supported by city staff and local city councillor Christin Carmichael Greb, to allow the space. "We’re very relieved we don’t have to take further legal action," said Kas Lingenfelter alongside her husband Kurt following the vote held in North York Civic Centre’s council chambers. "This isn’t just about a private parking spot," Kurt said. "It’s about inclusion in your own neighbourhood and being able to access your own home." The Lingenfelters initially made a permit application in late 2013 to be able to park in the front yard of their detached home, which was turned down by the city because parking

was available at the back of the property. The couple decided to appeal the decision and also reconstruct their home, they said to better accommodate the needs of their son, which included removing the rear space and installing a new paved spot at the front. After NYCC rejected the appeal, the couple decided challenge the decisions on the grounds Toronto’s residential parking standards violate provincial laws since there’s no allowance for disability. "The process is flawed," Kas said. "There’s nowhere you can indicate (in the city permit application) this is for an accommodation of a disability." Because the matter is also before the Ontario Human Rights Tribunal, part of the debate was held in closed chambers. During the public portion, the

council did hear from several deputants for and against the application. Michael Dell, who lives across the street told councillors he’s had to park on the street for 30 years, and when the Lingenfelters moved to the area approximately 10 years ago they were aware of the regulations banning front-yard parking. According to Dell, the Lingenfelters received several exemptions from the city already for the rebuilding of their home. He worried if the parking appeal was granted more residents would come forward with legal please of their own to park in their own front yards. "It’s always nice to do something for a neighbour," Dell said. "But the parking will suffer." Megan Segsworth, a neighbour and close friend of the Lingenfelters point-

She said the couple are dedicated parents whose "entire lives are structured around the care of their child". Despite much of the debate taking place in closed chambers to ensure the family’s privacy, Kas said it was important to have the matter at least partially discussed in public to provide encouragement to other families struggling to deal with a loved one’s disability. "We want other people who haven’t faced the city, because they’re afraid, to know you can fix it," she said. "Everyone who has a child with a disability feels beaten already and they don’t have the strength (to go up against the city). Thankfully, we have friends who said ’do this, it’s the right thing’".

Municipalities (FCM) rail safety advisory panel demanded the federal government equip and support local first responders and keep them informed of the type of dangerous goods being shipped through their communities. “Railways, transportation companies and federal, provincial and territorial agencies cannot plan for emergencies alone,� said FCM president Clark Somerville. “Municipalities play a key role as well.� The only people in possession of the information are the municipality’s emergency responders, who are trained to look for the placard and identify the hazardous materials, then deploy a HAZMAT team if required. Mark Ormond, assistant chief operations and communications for the City of Mississauga, said information is more transparent now than in the past. Resources such as AskRail, a Smartphone app that provides first responders access to timely data about what type of hazardous materials a railcar is carrying, and CANUTES, the Canadian Transport Emergency Centre, have been steps in the right direction. “But the bottom line is trains loaded with dangerous goods still travel through the heart of the most densely populated communities in Canada,� said Mississauga Mayor Bonnie Crombie, who is fighting to divert freight traffic off the Milton GO Line and free up space for commuter rail. In 2015, 144 rail-related accidents occurred involving dangerous goods in Canada. The five-year-average is 140. Transport Canada, Ottawa’s transportation regulator, mandated rail companies to post the top 10 dangerous goods transported across each province. Petroleum crude oil topped the list in 2015 for CN and CP, reporting shipments of 28 per cent and 29.2 per cent respectively. Other items included sulphuric acid, sodium hydroxide and ethanol-gasoline mixture. Real-time data raises legitimate security concerns, Winfield noted, but more detailed aggregate data on a quarterly basis would give the public a better sense of what is crossing through their communities. “It’s a culture of nontransparency. They (rail companies) don’t want to panic the public. Yet, it’s the public being exposed to the risk by the movement of materials.� Rail remains the preferred method to transport dangerous goods for this very reason - lack of oversight, critics argue. The most recent available data was from a 2012 Statistics Canada survey which found over 107 million tonnes of goods moved by truck that year were dangerous materials. “With four million more people coming to the Greater Toronto Area (GTA) in the next 25 years, the situation will grow more urgent,� noted Crombie. And with Canada’s transportation network the backbone of the national economy, appropriate policies with improved safety measures regarding the movement of hazardous goods are critical.
