Tip 1. Before implementing site-wide policies consider whether the PPE specified is appropriate for all individuals involved and the tasks they’re undertaking. Ensure that wearing it will not place workers at increased risk of harm.

Tip 2. Check that you have facilities to dry out PPE which gets damp. This was omitted from previous versions; an error which has been corrected in the new guidance.

Updated guidance on PPE The HSE has revised one of its guidance documents: the book which explains the requirements for personal protective equipment (PPE). What’s changed and do you need the new version on your shelf? What’s its status? This document is known as L25 and its full title is Personal protective equipment at work (third edition). It contains the HSE’s guidance to the Personal Protective Equipment at Work Regulations 1992. Note. It’s sensible to apply the guidance, as by doing so you should have done enough to comply with the Regulations. However, you can’t be prosecuted for contravening guidance. Why the update? The HSE wanted to remind employers that by virtue of the PPE Regs, hard hats are still required on construction sites if there’s a danger from falling objects. There have also been changes in the law which allow turban-wearing Sikhs exemption from head protection requirements in most workplaces.

NOTHING. THIS TIME AROUND THERE ARE NO NEW PIECES OF LEGISLATION SLATED FOR APRIL 2016. NOR ARE THERE ANY PLANS TO GIVE ANY OF THE MAIN ACTS OR REGULATIONS AN OVERHAUL. THIS MEANS THAT YOUR LEGAL OBLIGATIONS REMAIN EXACTLY THE SAME. THIS WILL BE THE CASE UNTIL OCTOBER 2016 AT THE EARLIEST.

Fire enforcement what’s happening? There’s been little in the way of news from the fire & rescue service (FRS) for some time. What’s going on behind the scenes and how might you be affected? In the years following the introduction of the Regulatory Reform (Fire Safety) Order 2005 the role of the fire & rescue service (FRS) was heavily promoted and stories about enforcement action regularly hit the headlines. But this has all but dried up. However, visits are still taking place. Fire safety officers are still completing routine inspections, and expectations to be on top of fire safety compliance are as high as ever. If you are found to be non-compliant, you run the risk of being put on an enforcement register This details what’s wrong and when the offences took place. These are listed by sector, e.g. hotels, and are searchable by location. In short, it’s straightforward for anyone to see whether a business has adequate fire safety arrangements.

It really is worth making the effort to get your house in order, as apart from the legal implications, being on the register is hardly the best advertisement for your business. We can help with fire risk assessment and fire safety training for your staff. The Home Secretary has demanded that the FRS implements significant reforms to become more efficient and transparent. Plans include fire and police services being forced to work together, new IT and telephone systems being adopted and becoming accountable to a new independent inspectorate. These changes should bring improvements with enforcement practices becoming more consistent. Rather than services developing their own approach locally, they are likely to be determined centrally. Other improvements, such as better communication channels, should be made available too.
