Not so fun in the sun

Summer seems to be now upon us. The Institution of Occupational Safety and Health (IOSH) is warning about the risks associated with working in the sun. What are they and what should you be doing as an employer?

Timely reminder. As part of its “No time to lose” occupational cancer campaign, http://www. notimetolose.org.uk/ IOSH has turned its attention to the risks of working in the sun. It has identified that skin cancer kills 60 workers per year in Britain and there are at least 1,500 new cases of non-melanoma skin cancer and 240 cases of malignant melanoma linked to solar radiation exposure through work each year. Warning. IOSH warns that the responsibility for protection from the effects of the sun appears to be shifting towards employers. It backs this up by identifying a compensation payout awarded for skin cancer following ultra violet exposure at work. However, it should be noted that this case was heard in Australia. What does the HSE say? As of May 2015 HSE guidance hasn’t been updated. It still says that employers should take the time to warn their staff about the risks associated with working in the sun, including covering up and using sunscreen with a protection factor of 15 or more. But it stops short of suggesting that staff

mustn’t work in the sun for prolonged periods or that employers should provide sunscreen, etc. However, this position could change. Why is this? Since 2014 the HSE has started to focus on employers managing risks which can lead to ill health. As there are proven links to workers developing skin cancer from exposure to the sun, it’s likely that there will be increased expectations on employers to do more to mitigate the risks associated with working in the sun. Tip. For now, follow current IOSH and HSE guidance. Both suggest that training and awareness is key - you can use the IOSH campaign material for this purpose. Deadly distraction An accident in which eleven people were killed was caused because an individual was playing games on his phone. What can be learned from this? The accident. Two commuter trains collided on a single-track stretch near Munich. The trains crashed head-on whilst travelling at approximately 60mph. Eleven people were killed and 85 injured. Many of the injuries sustained were life threatening. How did it happen? The stretch of line on which the accident happened was fitted with an automatic signalling system. This is designed to stop any trains that pass a stop signal. However, investigators have identified that this system had been disabled. This was to let one of the trains, which was running late, go past. Watch out. The train controller, who should have been monitoring the trains and taken direct action to prevent them colliding, wasn’t paying attention to what was happening. Unfortunately, he had decided to ignore his safety-critical duties and play games on his mobile phone instead. The case has yet to reach court, but under German legislation, he could be charged with involuntary manslaughter and face up to five years in jail.

The dangers are known. Mobile phones are known to be distracting, which is why drivers are banned from using them. However, this is the first significant case that identifies that they may pose a bigger problem than first thought. Because phones have so many uses, some people are now almost incapable of putting them down. Whether it’s answering e-mails, texting, browsing or as this incident shows, playing games. Tip 1. Prohibit the use of mobile phones, or other devices such as tablets, when staff are completing safetycritical tasks, for example, operating machinery, driving, monitoring processes etc. This should be reflected in your risk assessments, safe systems of work, etc. Tip 2. Make it clear to staff that using electronic devices (for any reason) when their use has been prohibited will be treated as serious misconduct. How to get to YES The problem with asking someone to do something? They might say ‘no’. In fact, when people want to ask someone to do something for them, they tend to either: • Ask a yes/no question, get a “no” and feel disappointed; and/or • Dread getting a “no”. So they don’t ask at all However, here’s a very simple way to increase your chances of getting a “yes”. Just add a question word at the start! For example, imagine you’re meeting with someone, and want to meet them again: • If you say “Shall we meet again?”, they might reply “no” • But if instead you say “When shall we meet again?”, you’re more likely to get a “yes”. After all, it’s much harder for them to reply with “Never” So ‘when’ is one of the question words you could use. Others work too: • When shall we meet again? • Who else shall we invite to our next meeting? • Where would you like our next meeting to take place? • How should we meet next time – face-toface or virtually? You can give them 2-3 options if it’ll help – “When shall we meet again? Later this week or early next?” or just keep it as open and let them choose.

But the Golden Rule: don’t offer a yes/no choice. You can use this technique it with lots of situations: • Looking to make a sale? Offer the customer two options with different price points, and ask “Here are the two ways we can best help. Which do you prefer?” • Wanting your boss to see you today? Try “When’s best for you, for us to have a quick catch-up today?” • Want your children to go to bed? “It’s bedtime soon. You can go now. Or – because you’ve been so good today – you can have another 5 minutes if you want. Which do you want?” Clever!
