Who’s Opening and Where In-N-Out Burger, Inc. (949-509-6200) will open a 3,500 sq.ft. In-N-Out Burger restaurant with a drive-thru on a 45,000 sq.ft. pad site of Tucson Mall, located along North Oracle Road in Tucson, AZ. The restaurant will be the company’s sixth in the area, and construction began this month. Sunflower Farmers Market (303-530-4809) plans to open a store at the intersection of 200 South and 700 East in a former Big Lots location in Salt Lake City, UT. The company also plans to open a store in Holladay, UT early next year.

Weis Markets (866-999-9347) is slated to open a 63,000 sq.ft. Weis grocery store as an anchor to a shopping center currently under construction along West Wyomissing Boulevard in Spring Township, PA. The store will be in the company’s new prototype, featuring advanced refrigeration and climate control technology, solar/thermalrated windows and reflective roofs and skylights. The store will replace an existing location and is slated to open during late spring 2011. TJX Cos., Inc. (508-390-3000) plans to open a 28,000 sq.ft. T.J. Observations & Conversations Foreclosures throughout California have been rampant – never a sign of a healthy economy. Mix that with double-digit unemployment and you’ve got a recipe for everything to hit the fan. Here we are in beautiful southern California at the ICSC’s Western States Conference. This issue is being distributed at the show, so that’s why I’m focusing my column on California. San Diego is a great town, and you can’t beat its zoo. La Jolla will always be a special place to me. Los Angeles…well, it’s L.A., and I have horrific memories of driving in rush-hour traffic, so enough said, but Balboa Island and Beverly Hills are worth the pain. Monterey has the best aquarium and whale watching I’ve ever experienced. I’ve spent some time in a lovely beach town called Avalon, and camped out in a rented cabin overlooking Lake Tahoe on the California side. I’ve eaten way too much wine-infused chocolate while sampling the fruits of Napa Valley, and I’ve walked for miles in San Francisco. Other California experiences that will never escape my memory include hiking Big Sur (it was exhausting, but one of the most surreal moments of my life) and watching sunsets in La Jolla Cove. It is one of the most spectacular states in the country, but beauty is expensive. I wanted to move to La Jolla in the early ‘90s; however, after a half-dozen realtors explained that housing in my budget could only be found south of Chula Vista, I gave up on that dream. So needless to say, I’m a cheerleader for the state, but it has hit some hard times. Foreclosures throughout California have been rampant – never a sign of a healthy economy. Mix that with double-digit unemployment and you’ve got a recipe for everything to hit the fan. But, in spite of all that doom and gloom, I am hearing some good rumblings about retailers taking advantage of the opportunities left behind from the likes of Circuit City, Mervyns, Gottschalks and several supermarket chains. (Oh, and while I’m on the topic of releasing second-generation space, check out our feature on Excess Space. It will give you some insight as to how this company has filled and restructured millions of retail square feet.) I was impressed with Forever21’s ability to move in quickly on some of the former Mervyns and Gottschalks. I’ve seen a few of the larger Forever21 stores, and it’s an incredible operation. My jaw dropped a couple of times looking at their stores. Another chain taking the opportunity to enter the state with a recycled Mervyns location is Hobby Lobby, which plans to open a 59,000 sq.ft. store in Visilia. Sprouts Farmers Market leased 34,000 sq.ft. of a former Circuit City in Dublin and is slated to open next year, marking its second location in northern California. The company also plans to open a supermarket in Roseville next spring. Mi Pueblo Food Centers, a supermarket chain that caters to a Hispanic clientele, is rumored to be taking six former Circuit City stores in the state, too. Pacific Sales, a consumer appliance, plumbing and home entertainment concept, is opening at a former Circuit City in Escondido this fall. It’s good to see absorption, but I’ve also heard that a lot of the deals that have been signed in the past six months for big box spaces were released at rents 20% to 30% less than what the original tenant was paying, so my hunch is that a lot of landlords took a haircut, even if those 20% to 30% figures are exaggerations.

In addition to all the supermarket players I noted above, Henry’s Farmers Market is opening a 25,000 sq.ft. location in Walnut Creek next year, marking its entry into the Bay area, and the store is being built from the ground up. The company is planning to open more stores in the East Bay trade area, as well as in northern California. Foods Co., a division of Kroger, plans to open two 72,000 sq.ft. stores in East Oakland. Fresh & Easy is planning to open seven supermarkets next year in the 12,000 sq.ft. to 15,000 sq.ft. range, including locations in Walnut Creek, Concord, Danville and San Jose. Grocery Outlet is also looking to open as many as 10 supermarkets throughout the Sacramento area within the next several years, including a location in Davis slated for early next year. Plus, Costco just signed a deal for a 146,000 sq.ft. store in Los Angeles. In a year or two, there are going to be a lot more places for Californians to buy groceries. (Let’s just hope there aren’t too many!) I’ve heard of a couple of interesting concepts coming out of the West Coast market, and both are in the hairstyling business. The franchises offer limited services – no color and no cutting, just a shampoo and blow-drying. A new hair salon concept called Drybar plans to open five units in southern California by the middle of next year following its debut in Los Angeles. New locations are slated for Studio City and West Hollywood. The concept is different from the norm, because it specializes in blow drying hair at a flat fee of $35. In a similar vein, Blo Nation made its California debut in San Francisco and now plans to open 125 locations by the end of next year. (With the tag line of “just blo me,” I’m sure they’ll get some attention.) Lease restructuring and dispositions reshaping retail leaseholds

Adam Taliercio Excess Space Retail Services, Inc. is the largest company in the U.S. specializing in disposition, lease restructuring and renewal for retailers nationwide – and was the first firm in the country to focus solely on those services. With offices on each coast in Lake Success, NY and Huntington Beach, CA, Excess Space provides their services to companies in every retail niche, including supermarkets, drug stores, specialty retailers, department stores, home furnishing retailers, banks, restaurants and automotive service centers. The recession has impacted both the lease restructuring and disposition aspects of Excess Space’s business in different ways, according to Al Williams, principal at the West Coast office. “Disposition has clearly been more challenging due to retailers substantially scaling back acquisitions, while lease restructuring has grown by about 400%,” he said. “Fortunately, we have a highly-developed local/regional nationwide broker network that assists us in keeping the properties moving, with an on-the-ground leasing effort that is best employed when faced with recessionary times.” This year the company will handle approximately 30 million sq.ft. for disposition, and additionally expects to renegotiate more than 3,000 leases collectively for more than 50 clients. Williams’ take on the western U.S. is that it hasn’t been impacted any more or less than the rest of the country, with certain obvious exceptions, including parts of California and Arizona. “Specifically, the Inland Empire in California, Salt Lake City, UT and Boise, ID all had economic growth that was connected to sub-prime lending,” he said. “That growth has completely reversed itself, as illustrated by current events in Arizona. However, the national landscape is pretty consistent: an increase in vacancy rates, a decrease in rental rates, and the need for landlords and property owners to be increasingly proactive regarding what they’re willing to do to keep their tenants operating.” The most notable difference between now and pre-recessionary times, Williams added, is an increased ability to approach landlords for a reduction or concession. “Even three years ago, a retailer would have a very low probability of success,” he said. “But as the economy shifted, vacancy levels rose and retail sales have gone down, retailers have been increasingly forward-looking and become more proactive in reviewing retail occupancy costs. Part of this evaluation requires engaging landlords on ways they can work together to reduce them.” Even the term “lease restructuring” has taken on a new meaning for the company of late. Whereas in the past, “restructuring” typically meant rent negotiations in advance of a lease renewal, option or extension, Excess Space is now more able to negotiate within the current term of the lease, with a fairly high probability of success to decrease rent or receive other favorable concessions – Williams estimated the success rate has increased from between 5% and 10% to 50% and 60%, or even higher in the proper circumstances. In the past two years alone, the company has handled over 6,000 lease restructurings on behalf of both ailing (but not bankrupt) and healthy and solvent retailers. “It’s a fantastic time for a retailer to renegotiate a lease; in fact, it’s arguably the best time in the past two decades – maybe even longer,” he said, as landlords are now more than ever concerned with maintaining their existing tenant base, making them more amenable to restructuring an existing lease than pre-recession. “It’s a much more fruitful exercise for retailers than it was in the past, and for our clients it’s just a matter of executing a good business plan. In the best-in-class lease restructuring exercise, a retailer can go in and reshape their entire leasehold portfolio for the foreseeable future. In fact, that’s exactly what we’re doing on behalf of many of our clients.” When renegotiating a lease, the company performs “intense” due diligence within the local marketplace to be able to approach landlords page 6

in a knowledgeable and effective way. In-depth market analysis allows Excess Space to determine the value of the property in question and what an appropriate rental rate should be. The company also carefully examines each lease during negotiation to determine how its provisions can best benefit their clients. “Retailers sometimes don’t even know that there are many favorable clauses that exist within their leases, as lease review is a very time consuming process,” Williams said. He provided a common example, where a client’s lease may can contain an occupancy clause tied into the occupancy percentage of the entire shopping center. “Once the tenancy level dips below a defined percentage, our client may have the right to terminate the lease or reduce rent,” he explained. Of course, retailers are not in such a favorable a position that they can negotiate without often making concessions themselves – a common misconception about lease restructuring, Williams said. When performing due diligence on a property, Excess Space looks for potential opportunities for both the client and the landlord to benefit from restructuring. More often than not, the best method of negotiation is to offer an increased lease term, especially if the client is a larger, national tenant. “All negotiations, in my experience, have some level of quid pro quo,” he said. “If you’re going to have a successful exploration of reducing occupancy costs, you absolutely need to be prepared to make some trade-offs. If you’re calling a landlord without being well prepared, just saying ‘gimme, gimme’, then they’re not going to be willing to work with you. Landlords today are very sophisticated; a retailer needs to approach them with a very wellthought-out strategy as to why and how they should cooperate with what the retailer is looking to accomplish.” Excess Space helps clients to make concessions that may benefit the landlord without harming the retailer – for example, a tenant may be capable of making a concession regarding parking relatively painlessly, which in turn benefits the landlord more than it hurts the client. On the disposition end of the business, the company has also experienced an increase in activity as of late. Although the company doesn’t discuss specific clients, Williams said that they have worked with 150 of the largest retailers in the country. “The list of our clients [over time] is larger than the list of national and regional retailers we’ve not done business with, that’s for sure,” he added. The company boasts a rate of disposition two to four times faster than its competitors – a speed that Williams attributed to experience and dedication within the field. “We’re the ones that really pioneered this niche as an industry; the ones who remained true to our core business model – a model that has withstood the test of time and every imaginable economic cycle,” he said. “The reality is that we’d better be two to four times faster, because this is all our company does each and every day! Clients would love for us to do some other things for them, but we stick to what we know and do well, and I think our track record for success is one we humbly let speak for itself.” Cumulatively, Excess Space has been able to put approximately $3.5 billion in capital back to work for its clients – and the majority of their clients develop long-term relationships with the company. “We have very little attrition amongst our clients; our average client has been with us for over five years,” Williams said. “We’ve had tremendous partnerships that have lasted a long time, and that’s probably what we’re most proud of as a company. We’re in a business where change is probably the norm among these types of relationships. One location will be a two-level, 100,000 sq.ft. store at a former Mervyn’s site at the intersection of Geary Boulevard and Masonic Avenue, and the other will be at The Metreon, located in the South of Market area of the city. Construction on both stores is tentatively slated to begin early next year. The company currently operates 1,700 locations nationwide. Dunkin’ Brands, Inc.
