President Rule: Arunachal Governor submits reports to the Supreme Court Cited cow slaughter and Tuki link with NSCN to recommend President’s Rule Breakdown of governance, including law and order, and lock down of Assembly building were cited as key reasons for collapse of the constitutional machinery in Arunachal Pradesh by Governor J P Rajkhowa in its report to the Centre recommending President's rule. Rajkhowa submitted the reports in pursuance to the constitution bench of Justice Jagdish Singh Khehar, Justice Dipak Misra, Justice Madan B Lokur, Justice Pinaki Chandra Ghosh and Justice NV Ramana's direction to his counsel Satya Pal Jain on Wednesday "to furnish a copy of the governor's report and other material recommending issuance of a proclamation under Article 356 of the Constitution of India, to the court in a sealed cover". The Governor also said reports indicated about involvement of ruling Congress through third parties with banned underground Naga outfit NSCN (Khaplang) for pressurising dissident MLAs. Rajkhowa said the Arunachal Pradesh Assembly Speaker, together with the government, had prevented the meeting of the Legislative Assembly from taking place in Assembly premises.

GOVERNOR’S 6 POINTS REPORT Governor’s letters/references to Chief Minister on public matters were ignored. Raj Bhavan premises were under seize by supporters of CM and speaker. The Governor was publicly insulted, humiliated and gheraoed by supporters of the present government. Reports indicate involvement of ruling parties with outlawed outfit Nationalist Socialist Council of Nagaland (NSCN).

Incited, Provoked and Funded Nyishi Elite Society, an apex communal organisation of Nyishis to encourage indiscipline, lawlessness and politicking by government officials. “Cow” being slaughtered outside Raj Bhavan which makes a case for the breakdown of law and order in the state.

The report also highlighted that as per article 174 there should not be a gap of more than six months between two legislative assemblies. The report listed two scenarios: 1. If the assembly session on 16th December was accepted, then the current government was proved in minority. 2. If the 16th December assembly is not accepted, there is a clear violation of article 174, with six months ending on 21st January 2016.

Rajkhowa submitted the reports in pursuance to the constitution bench of Justices of Supreme Court’s direction to his counsel Satya Pal Jain on Wednesday. PTI

"It is worth mentioning that locking of Assembly premises amounts to locking of the Constitution," the report said.

does not command the majority in the Assembly. By making attempts to prevent the assembly session, "the Speaker, in connivance with the minority government, has tried to defeat the basic principle of democracy and the basic requirement of the Constitution that the Chief Minister must command majority of the House and such majority should be tested on the floor of the House," the Centre said while batting for central rule in Arunachal Pradesh.

dicators of such Constitutional breakdown are: Governor's letters/ reference to the Chief Minister on matters of public importance concerning state administration are mostly not responded to, in violation of Article 167(b) of the Constitution.

While recommending central rule in the border state, the Union Cabinet said the Congress government in the state

"Even the Raj Bhavan premises were under seige by the supporters of Chief Minister Nabam Tuki and Speaker Nabam Rebia for several hours as the district administration and police did not enforce the prohibitory orders and not even single arrest was made," the Cabinet's recommendation said.

The Governor, who is the nominee of the President, is being publicly insulted, humiliated and even gheraoed by the supporters of the present government and the state government is behaving as a silent spectator. Gherao of the Governor amounts to Constitutional breakdown in the state, the Centre said. In his report, Rajkhowa accused Tuki of “encouraging indiscipline, lawlessness and politicking by government officials by inciting, provoking and funding Nyishi Elite Society, an apex communal organisation of Nyishis, mainly

In both cases, the report suggested, the state was heading for a constitutional crisis. comprising government officials.” The report also attached photographs of a “cow” (a mithun actually) being slaughtered outside Raj Bhavan and said that it made a case for the breakdown of law and order in the state. Referring to pressurizing of dissident MLAs through Naga insurgent group NSCN-K, the Centre said involvement of an unlawful organisation in matters of government formation/ majority is extremely dangerous. There is a need to create an atmosphere where the democratic principle of majority rule can be tested without fear.

The Bharatiya Janata Party (BJP) on Thursday declared Union youth affairs and sports ministerSarbanand Sonowal as its chief minister candidate for the upcoming Assam assembly elections.

Nabam Tuki speaking to a news Channel rubbished the reports and all the allegations against him as baseless. He challenged the Governor to prove if cow slaughter has ever happened. While clarifying the allegation of his link with the terrorist outfit NSCN-K he out rightly denied and termed the allegation as an attempt to harass him. The Governor in his report also alleged Tuki of mobilizing students’ Union and NGOs to protest against him as he is of Assamese origin. Nabam Tuki clarified that the allegations are absolutely wrong, baseless and false. “I agree that I did lead a movement which was against some of the decisions of the Governor but it has no communal color to it. It was a peaceful protest”. Tuki Clarified. The Arunachal Pradesh governor, Jyoti Prasad Rajkhowa, in his report to the SC yesterday said that there was complete breakdown of the constitutional machinery in the State. He linked it to the incident of cow slaughter which took place outside the Raj Bhavan, justifying the proclamation of the emergency that lead to the imposition of President’s rule in the State.

Former Arunachal Pradesh Chief Minister Nabam Tuki today filed a fresh petition in the Supreme Court challenging the promulgation of President's rule in the crisishit state. The plea filed by the Congress leader is likely to be taken up for hearing on Monday by a five-judge constitution bench headed by Justice JS Khehar, along with other petitions moved by persons like Rajesh Tacho, Chief Whip of Congress Legislature party in the state assembly. The plea has been filed after Attorney General Mukul Rohatgi, representing the Centre, had raised the objection that the earlier petitions have not challenged the imposition of President's rule which was invoked after filing of those pleas. Yesterday, the imposition of President's rule in Arunachal Pradesh had come under the scanner of the court which sought the report of Governor Jyoti Prasad Rajkhowarecommending central rule in the state, saying "it is too serious a matter". The bench had asked the Attorney General not to raise "technical objections" when he persisted with his plea, arguing that "rules are rules" and they apply equally to all.

It had then posted the matter for February one asking the Governor and the Ministry of Home Affairs to file responses by Friday, by when the petitioners have been allowed to amend their plea. The bench, for its own perusal, sought in a sealed cover the report and recommendation on imposition of the President's rule. "Unless we get the grounds for recommending the President's rule, we cannot proceed. If grounds are not same in the proclamation then it is totally a different ball game," the bench, also comprising justices Dipak Misra, MB Lokur, PC Ghose and NV Ramana, had said. The bench was also of the view that no interim order can be obtained unless the parties see grounds for proclamation for President's rule. "We will not pass any order without hearing all the parties. It is a sensitive issue," it had said. A battery of senior lawyers including Fali S Nariman, Kapil Sibal, Rajeev Dhawan and Vivek Tankha, had opposed the plea of governor seeking to maintain secrecy of his report and recommendation saying that larger bench of more than five judges have already laid down the proposition on this aspect.
