Kojum Taba wins Senior Commonw ealth Weightlifting Championship A Staff Reporter Penang, 28 Oct

Junior International Weightlifter of Arunachal Pradesh, Kojum Taba made India proud again in Penang, Malaysia by clinching the Senior Commonwealth Weightlifting Championship title. He not only became the Senior Commonwealth Champion but also defended the Junior Commonwealth title by winning the gold medal for the second consecutive time. Participating in the 85-kg weight category, he excelled at all the attempts by finishing his final lifts of 146 and 184 kg respectively in Snatch and Clean & Jerk sections, breaking his own records set during selection trail conducted by Indian Weightlifting Federation few weeks ago at NIS Patiala, India. Prior to this, he was the youth, junior and senior national champion, including current defending Junior Commonwealth Weightlifting Champion. Kojum will be back in India on October 30 and will board again for Tokyo, Japan on November 7 next.

Tacheng had applied against Papum Pare as a candidature for DPC (SSA) on April 22, 2016 in order to replace Jitendra Tiwari. Highlighting that the terms to be appointed as DPC (SSA) require him/ her to be professionally trained graduate with 10 years experience as TGT/ Educational Officer with vast knowledge of SSA schemes/ activities and knowledge of the topography of the district posted at, the APPDSU said that the new appointee is a junior and does not fulfill the guidelines issued by the SPD, Itanagar. “In order to replace Tiwari as DPC (SSA), an experienced person like Gollo Tacheng, BEO cum BRCC, Mengio, who has been working as BEO (2008) cum circle/ block Resource Coordinator since 2005-06 should be appointed as a DPC (SSA) Papum Pare district. He has attended many workshops, trainings and seminars at district and zonal levels”, the APPDSU said. The union requested the education minister to appoint senior candidate Mengio BEO cum BRCC Gollo Tachengas as DPC (SSA) as per guidelines in the interest of the public service of Papum Pare district and reconsider the appointment of the new appointment order. However, the union said that if its plea was not considered, it would resort to a democratic movement.

Mossang Memorial Society winds up monitoring visits to eight villages under NERCORMP Lomhom Tangha Kharsang, 28 Oct: Memorial Society under NERCORMP started their monitoring spree to visit 8 villages, namely, Manmao, Walangtoi, Renuk, Sinwang, Sasum-I, Sasum-II, Hetman, Tengman under Manmao Block to monitor the schemes given by NERCORMP to the NaRM-Gs (Natural Resource Management Group). Staff of Memorial Society arrived Walangtoi and Manmao village on 14th of October. Scheme taken by Walangtoi NaRM-Gs was 19th unit of Low Cost Latrine and they found that work is completed by them. In Manmao, 1 unit of Low Cost latrine and some non-farm activities like tailoring, carpentry and electrician schemes were given to Manmao NaRM-Gs. On the second day they moved from Manmao village to Sinwang village. The activity was Low Cost latrine 1 unit, piggery 3 unit and Arecanut. Around 3 pm they moved towards Renuk village and we reached the destination at 7pm on foot. Activities in Renuk village i.e. Piggery, Spices Crop and Masonry unit after monitoring the activities in Renuk village, they we move towards Sasum-I, activity was canal construction and 1 unit of Low Cost Latrine. Staffs stayed in President NaRM-G, Sasum-I residence only to be continued their further trip. On 16th evening they had reached Sasum-II village to see how their activity of 1 unit of Low Cost Latrine and other non farm sector i.e. rice mill to doing. After monitoring it we moved Hetman and reached at 8 pm on Hetman village where they found that 14 units of Low cost latrine and 1 unit of piggery was almost at the helm of completion, on 19th morning they moved from Hetman towards Tengman village where one village road and 2 unit of Low Cost latrine propagating at good pace. On 21st October they wound up their visit and moved towards Head office Jairampur.

They said respiratory problems, asthma attacks, eye sores, breathlessness and other health problems get aggravated during this time of the year. "Every Diwali, we attend to a large number of cases of breathlessness, asthma attacks and respiratory problems. Burns are common. What is important is that cases pertaining to Diwali pollution are increasing every year. We discourage the use of firecrackers," said Debabrata Goswami, head of the department of medicine at Gauhati Medical College and Hospital (GMCH). According to an ongoing
study titled 'Urban Black Carbon Emission-Its Global Impact and Local Mitigation', some parts in this thriving metropolis have recorded 80 micrograms per cubic meter of particulate matter (PM) 2.5. The World Health Organization's threshold of PM 2.5 for humans is 10 micrograms per meter cube annual mean and 25 micrograms per cubic meter for 24-hour mean. PM 2.5 comprises particles emanating from automobiles, heavy metals and toxic compounds. "Pollution will only get worse during Diwali. The city already records PM 2.5 of more than 80 micrograms per cubic metre. We are also approaching winter and the effects of pollution are more visible during this season. During festivals like Diwali, there are more vehicles on the roads and high emission makes matters worse," said Sharad Gokhale, professor
of environmental engineering, department of civil engineering, IIT-G. His team is doing the study on black carbon and pollution in the city. According to measurements recorded over the past few years, the average value of sulphur dioxide (SO2) was between 6 to 8.30 micrograms per cubic meter. This figure tended to increase between 12.20 to 15 micrograms per cubic meter during Diwali. Sulphur dioxide increases asthma attacks, chronic bronchitis and may also lead to increased mortality among the elderly and infants. Exposure to SO2 causes corneal haze, heart failure and fluid accumulation in lungs. Nitrogen dioxide (NO2) leads to respiratory problems. It inflames the lining of the lungs and is responsible for reduced immunity. It also intensifies asthma attacks, especially among children.

Life Expectancy of people living in Assam is 76.4 years: SRS Survey ET Bureau Guwahati, 28 Oct: The latest SRS Survey findings reveal that people living in Assam if can expect a low life span if the country's current mortality trends were to continue. In other words, if you are now below 60 years of age, you have the least average number of additional years to live than most other Indians. However, on the brighter side, Assam’s status is little better that the case of Chhattisgarh. Those who are 60, that is when you retire, can expect to live 16.4 years more, just a shade more that those living in Chhattisgarh (15.6 years). The senior citizens in the 70 years and above age bracket have on an average 10.3 more years to live, again preceded by

A child at birth in Kerala on an average can live till 74.9 years, which is the highest in the country. The silver lining is that a female child at birth in Assam can live 2.8 years longer than a male child. Those who have survived through the first year of life in Assam have a bet-
ter life expectancy of 66.5 years. At childhood (5 years), the life expectancy drops to 63.9 years and slides further to 59.2 years for those who are 10 years. Those who are 20, can expect to live on an average for 49.9 years more while a 30-yearold will live 40.9 years more. A 40-year-old on an average can live another 31.9 years more and those who are 50 years have on an average 23.6 more years. Assam's situation hasn't been better in the past too. Between 1970 and 1975, the average life expectancy at birth in the state was 45.5 years, which was just one notch above Uttar Pradesh, which recorded the lowest life expectancy at birth.

He said that a 110 milliontonne high-capacity rig valued at more than Rs 23 crore was deployed last week in the Kunjaban field, near Agartala. Its 109-foot mast height is suitable for operations up to 5,000 metres depth and is equipped with the latest technology and all safety features. The company earlier this month hired the Chinese rig for Rs 9.5 lakh per day. The truck-mounted rig can drill up to 3,500 metres.
"Additionally, being a mobile rig, precious time would be saved in moving it and its accessories from one location to the other," Soni noted. "The ONGC board had earlier approved a plan to invest Rs 5,050 crore by 2022 to explore for more gas in Tripura," said Soni, a technocrat who has vast experience in managing high-value projects. "Under this plan, new wells would be drilled and additional surface facilities would be created to increase gas production from 5.1 million standard cubic metres per day (MSCMD) to at least 6.25 MSCMD from

The company had earlier commissioned its first commercial power project in India, located in southern Tripura and run by ONGC Tripura Power Company (OTPC), formed by ONGC, the Tripura government and Infrastructure Leasing and Financial Services Limited (IL&FS). The 726 MW gas-based combined cycle power project (hydro and natural gas) is located at Palatana, 60 km from Tripura capital Agartala.
"Electricity is being supplied to seven of the eight northeastern states from Palatana. Also 100 MW of power is being supplied to Bangladesh since March," Soni said. "The generation capacity of the OTPC power project is likely to be increased to 1,090 MW in the near future. Work is going on in this direction," a top OTPC engineer told IANS, on condition of anonymity. ONGC has also committed to supply gas to another stateowned company, North Eastern Electric Power Corporation (Neepco), which set up a 100 MW power project at Monarchak, 70 km south of here. Besides, ONGC, which had started its operation in Tripura in 1972, has been supplying gas to various Tripura government and Neepco-owned power projects in the state. ONGC has also planned to set up a Rs 5,000 crore fertiliser plant in northern Tripura in association with the state government and Chambal Fertilisers and Chemicals Ltd, a Rajasthanbased private company. This prompted the district administration to order a magisterial probe into the incident. The incident happened at Nongthjymmaineng in Mawphlang block around 2 pm on Thursday. Initial reports indicate that the wiring in the meter box was tangled with the CGI sheet. The woman, Prisdalin Shangpliang, who was fivemonth pregnant, was the first one to be electrocuted followed by her four children - Kamustar (9), Sngewbhalang (6), Bedingstar (5) and Sisharlin (2 year 6 months) - who ran towards her. The woman was carrying the sevenmonth-old baby. All the six died on the spot. A trans-
former is located near the residence and it is suspected that this might have caused the accident since similar problem was reported in the nearby houses though there was no casualty so far. According to police, the incident was caused reportedly, due to leakage of electricity from the nearby transformer. He also extended all possible assistance to the bereaved family. "Precious lives are lost and the government stands committed to ensure that a thorough inquiry is conducted to find out the root cause so that such incidents do not happen again," Sangma said while extending his condolences to the bereaved family members. "In view of the above, we are not inclined to entertain this intra court appeal. The appeal is therefore dismissed summarily," the Court observed. However, in the circumstances of the case, the division bench made it clear that they have not pronounced on the merits of the contentions sought to be urged by the appellant on her prayer for transfer of investigation to CBI "and the parties are otherwise at liberty to take recourse to appropriate remedies in accordance with law". Agartala , Oct 28: Tribal Ministry will analyse the progress of allotment of land titles to the tribals under Forest Rights Act, 2006, after the Parliament session, Union Tribal Affairs minister Jual Oram today said, underlining that some states were "lagging behind" in this regard."We will physically verify titles. Some states are lagging behind due to court cases, but in other states also its slow. We will study the reasons for it," the minister said at a workshop on Forest Rights Act organised as part of National Tribal Carnival held here. More than 16 lakh tribals have been given land titles and over one crore hectare of land has been allotted which is an
achievement but it needs to be further worked on, he said. "Some states like Tripura have performed well in title allotments while performance of others has not been so good. We will go there after Parliament session and study it," Oram said.The minister said that the rate of rejection of title claims was a matter of "concern" which needs to be looked into.Over 40 lakh title claims were received out of which decisions were taken on 88 per cent cases while 12 per cent are pending. Shillong-Dawki road project on track Shillong, Oct 28: The State government will start acquiring land for the widening of the 71.5-km road from Shillong to Dawki after the final survey of the project is complete. PWD (Roads) Minister MM Danggo held a meeting on Thursday with local MLAs Ronnie V. Lyngdoh and Prestone Tynsong in the presence of the representatives of Japanese International Cooperation Agency (JICA) and National Highway Infrastructure Development Corporation Limited (NHIDCL) to expedite the road project. Speaking to media per-
sons after the meeting, Danggo said the road will be of international standard. The total budget of the project, excluding land acquisition, is Rs 1,251 crore that will be funded by JICA. On acquiring defence land, the Minister said the authorities are cooperating with the government. "We have had a word with the station commanders of 101 Area and Eastern Air Command and they are very responsive," he said and added that the KHADC has also agreed to give its consent to the project. The project proposes to build a four-lane road from Umshyrpi to
Mylliem and from there a two-lane road to DawkiTamabil. The road, which will take two and a half years to be complete after the issuing of tender, will also include a 368-m long and 12.5-m wide bridge in Dawki. On the other hand, Nakamura Jun, a delegate from JICA said the company is conducting an exercise in the State to see if the proposed project is feasible. Search for 2nd human rights panel member to take more time Shillong, Oct 28: The State Selection Committee has allotted more time to the Political Department to search for the second member of the Meghalaya Human Rights Commission. The Meghalaya Human Rights Commission currently has Justice (retd) Aftab H. Saikia as the chairman and PJP Hanaman as a member. The search for the second member is still on. Speaking to media persons after the meeting of the Selection Committee here on Thursday, Chief Minister Mukul Sangma said the Committee had a look at the various profiles for the post of the member of the Commission.
However, the Committee now has asked the Political Department to take more time as out of the two profiles presented before the committee, only one qualified for the post of the member of the rights panel. Reacting to a query on the rights panel functioning from Guwahati, the Chief Minister said the department has scouted available spaces and would soon take a final decision on the permanent office of the Commission. Sangma also said the website of the Meghalaya Human Rights Commission is under construction and that complaints can be
filed online after the site is ready. After the Supreme Court set the June 30 deadline for the State to form the human rights panel, the Political Department had on June 7 notified the human rights body. The comeback man The political rehabilitation of former Karnataka Chief Minister B.S. Yeddyurappa of the Bharatiya Janata Party happened long before his legal exoneration by a special court of the Central Bureau of Investigation this week in the mining operations corruption case. After having forced him to resign as Chief Minister in 2011, on his indictment by the Lokayukta, the BJP made him its State unit president and has even been projecting him as the chief ministerial candidate following his return to the party after a failed experiment of going it alone in the 2013 Assembly polls. Mr. Yeddyurappa and the BJP seemed supremely confident that he would get past the legal hurdles and be ready to lead the party to fight the Assembly election of 2018. But despite the acquittal, there remain several unanswered questions brought up in the Lokayukta report on illegal mining in Bellary: these include the nexus between those in the government and the mining barons sustained through a web of intricate transactions involving charitable trusts run by family members of politicians and the use of corporate social responsibility initiatives by business houses as a cover for illegal gratification of politicians and their kin. While the payments made by affiliates of JSW Steel to the trusts managed by his sons are not in dispute, the court held that Mr. Yeddyurappa's order to ban export of iron ore was a collective decision of the government and that there was no evidence of corruption. Unless the order is challenged in the higher courts, the path is clear for Mr. Yeddyurappa to lead the BJP's campaign in Karnataka, shutting out rivals within the party. For the BJP too, which publicly swears by clean governance, the verdict removes all doubts about making him its political mascot for 2018. Karnataka is the only State in the south where it has a reasonable chance to form a government, and the party would not like to make a mess of its political options ahead of the Assembly election. With the possible exception of Ananth Kumar, the party has no leader capable of matching Mr. Yeddyurappa in stature in Karnataka. He can deliver a chunk of the Lingayat vote bank to the BJP. If the other principal party, the Janata Dal (Secular), can keep a substantial part of the Vokkaliga vote bank, the ruling Congress will certainly find the going tough in 2018. The court verdict allows Mr. Yeddyurappa and the BJP to look ahead, rather than be defensive about their past record. They must also be hoping that public memory does not go back beyond the last five years.
Maduro faces rough weather V
enezuela has once again been rocked by opposition-led protests after the process to requisition a recall referendum to oust President Nicolas Maduro was obstructed last week. Local courts in four states issued injunctions to halt the opposition's collection of signatures from 20 per cent of the registered voters, the second phase of the constitutionally mandated recall process, after allegations that there were irregularities in signatures collected in the first phase. The Supreme Court upheld these injunctions, which means the referendum process in the four states will have to be restarted. The timing of the referendum is important. If the outcome were to go against Mr. Maduro before January 10, 2017, mid-term presidential elections will have to be held. If the referendum is held later, a setback would only mean his replacement by the vice- president till the scheduled elections in 2018. The besieged government has sought talks with the opposition to be mediated by the Vatican, but Mr. Maduro has poor approval ratings and his government has been unable to arrest a slide towards further economic chaos. The opposition has more popular support than it did during Hugo Chavez's reign and, importantly, it controls the National Assembly. Mr. Maduro does not wield the kind of charismatic sway that Chavez, his mentor, did, but the problem goes deeper than this. The continued fall in global petroleum prices under Mr. Maduro's watch has put the country's social welfare model under severe strain. In Chavez's heyday, the government leveraged the country's immense petroleum reserves to fuel a welfare economy and spend heavily on subsidies. This model resulted in several structural flaws in the economy - corruption in state enterprises, heavy dependence on imported consumer goods due to meagre incentives for production in a highly subsidised economy, and artificial price and exchange controls that resulted in a black market for foreign currency and persisting inflation. When oil prices were high and export revenues booming, these flaws did not hurt the economy much. In fact, there was a reduction in poverty levels, increase in literacy and better health indices over the last decade. But falling oil prices exacerbated Venezuela's economic problems, forcing the government to print money to cover expenses in the face of rising debt, which created a hyperinflationary cycle. Reforms that would stabilise the currency, reduce subsidies and remove artificial price controls will be in order. But it will be difficult for his regime to carry out these reforms without a political compromise of some kind.

Situating law in the land Instead of a blanket ban, the Supreme Court can delegitimize polygyny in India for not being in consonance with the Koranic procedure, just as it invalidated instant triple talaq in the Shamim Ara case A. Faizur Rahman With the submission of the Bharatiya Janata Party-led Central government's affidavit in Supreme Court a few days ago, the debate on Muslim personal law has intensified, prompting even the Prime Minister to join the fray in support of the constitutional rights of Muslim women. Although the government's affidavit did not specifically ask the court to "ban" or "abolish" instant talaq or polygamy, and concedes that "only some women are directly and actually affected by these practices", it nevertheless tells the highest court that "the issue of validity of triple talaq, nikah halala and polygamy needs to be considered in the light of principles of gender justice and the overriding principle of non-discrimination, dignity and equality". The government affidavit seems to have ignored the fact that in the Shamim Ara case (2002) the Supreme Court, relying on several earlier rulings, had invalidated instant triple talaq and, by that decision, rendered even halala redundant and equally illegal. Halala is the un-Islamic temporary marriage a victim of instant talaq is forced to undergo with another man to remarry her first husband. As is obvious, the delegitimisation of instant talaq makes halala unnecessary. An overview of the Shamim Ara judgment and some of the rulings cited in it can be found in Justice K. Kannan's article "Frames of reference", published in this newspaper on October 21. Polygyny in the Islamic context Polygamy includes both polygyny and polyandry. The Koran categorically prohibits polyandry and
therefore, it is polygyny that the Supreme Court will be ruling on in the present case. Polygyny, which finds mention just once (4:3) in the Koran, is one of the most misunderstood concepts of Islamic law. It has been abused over the centuries by Muslim men without appreciating the spirit behind its exceptional sanction, which is clearly contextualised in the historical conditions of the time when a large number of women were widowed and children orphaned as Muslims suffered heavy casualties in defending the nascent Islamic community in Medina. Even a simple reading of verses 4:2, 3 and 127 will show that it was under such circumstances that the Koran allowed conditional polygyny, mainly to protect orphans and their mothers from an exploitative society. Verse 4:2 warns caretakers against devouring the assets of orphans either by merging them with their own or substituting their "worthless properties for the good ones" of the orphans. And, if the caretakers "fear that they may not be able to do justice" to the interests of the orphans in isolation, the next verse allows them to marry their widowed mothers - on the condition that the new family would be dealt justly on a par with the existing one. For those who are not up to it, the instruction of the Koran is: "Then [marry] only one." It is clear from these arguments that verse 4:3 is not a hedonistic license to marry several women. Besides, there are several statements in the Koran which describe husband and wife as "spousal mates" created to find "quiet of mind" (7:189) and "to dwell in tranquility" (30:21) in the companionship of each other. Indeed, verse 7:189, which traces
the origin of man from a single cell (nafsan waahida), talks of the wife in the singular as zaujaha, thereby emphasising monogamy. Thus, marriage according to the Koran is the emotional bonding of two minds which cannot be achieved simultaneously with more than one woman. If despite this, the Koran permitted conditional polygyny, it was, as stated above, only as a social remedy to alleviate the sufferings of women and orphans in calamitous situations. This can be appreciated from the dreadful state of affairs in West Asia today. In November 2011 The New York Times, citing Iraqi government sources, reported the presence in that country of one million war widows - and at least an equal number of orphaned children - who want to remarry for security and companionship; but there aren't enough men. Thankfully, as such conditions do not exist in India, polygyny is not permissible here. The Supreme Court would therefore be justified in delegitimising polygyny practised for reasons other than those mentioned in the Koran just as it invalidated instant triple talaq in the Shamim Ara case for not being in consonance with the Koranic procedure. Indeed, the court's imposition of fetters on polygyny
would serve as a de facto ban on the practice, thereby rendering unnecessary the need for a blanket ban sought by some Muslim groups - which would be politically inexpedient in the prevailing circumstances. Muslim polygyny v. Media bigamy From another point of view too, a total ban on polygyny may not be advisable. Latest census data and impact studies conducted by researchers such as Flavia Agnes show that bigamy continues to prevail among the Medias despite the Media Marriage Act, 1955 outlawing it, and Section 494 of the Indian Penal Code (IPC) declaring it a punishable offence. Chart C-3 of the 2011 Census containing details on marital status by religious community and sex provides the shocking information that among Medias (not including Sikhs, Buddhists and Jains) married women outnumber married men by 43.56 lakh. To be exact, out of 47,13,97,900 married Medias, 23,35,20,803 are males and 23,78,77,097 females, thus exceeding the males by 43,56,294. The only inference that could be drawn from these figures is that 43, 56,294 Media women are in bigamous relationships with Media men unless of course it can be proved they are mostly married to non-Medias. One reason for this could be the fact that Section 198 of the Code of Criminal Procedure does not allow any court to take cognizance of an offence punishable under Chapter XX of the IPC (which includes Section 494) except upon a complaint made by the "person aggrieved" by the offence. For a male bigamist, the first wife is the aggrieved person, and if she chooses not
to lodge a complaint, her husband cannot be prosecuted. However, the bigger issue here is that the "second wife" cannot claim rights on a par with the first wife under the Media law even if the first wife consents to her husband taking another wife and the "second wife" is informed of the existence of the first before marriage. This seriously compromises the equality guaranteed to her as a citizen under Article 14, and the right to life with dignity assured under Article 21 of our Constitution. It also brings into question the constitutionality of laws that discourage women from making informed choices; and when they do, penalise them for exercising their human agency in the name of undefined societal morality! Factoring in social reality The consolation is that our courts are fully aware of the flaws in the Media law and have tried to overcome them through deontological interpretations. In the Rameshchandra Rampratapji Daga v. Rameshwari Rameshch andra Daga case of 2004, the Supreme Court, while justifying the granting of maintenance to a second wife and her daughter, observed: "‌a bigamous marriage may be declared illegal being in contravention of the provisions of the [Media Marriage] Act but it cannot be said to be immoral so as to deny even the right of alimony or maintenance to a spouse financially weak and economically dependent." This view was fully endorsed in 2013 by another Supreme Court Bench in the matter of Badshah v. Sou. Urmila Badshah Godse & Anr where it was emphasised that "just as change in social reality is
the law of life, responsiveness to change in social reality is the life of the law." Unfortunately, ill-informed calls for the abolition of polygyny among Muslims are not based on an appreciation of the change in social reality today which is manifesting itself in the form of a renewed emphasis on individual rights especially with regard to sexual orientation and preference. Rights of the 'second wife' If, in the light of the foregoing arguments, a blanket ban on Muslim polygyny is being opposed, it should not be construed as an expression of support for the practice. The point that is sought to be made here is this: if polygyny is abruptly declared illegal for Muslims, without first identifying and addressing the causes of failure of Media law in preventing bigamy, it would end up creating the same confusions in the Muslim law, especially with regard to the rights of the "second wife" under Articles 14, 15 and 21. Therefore, pending examination of the Media bigamy law through the prism of these facts, the most judicious option, insofar as Muslim polygyny is concerned, would be to fetter it with Koranic conditions as discussed above. This should not be a difficult decision given the fact that eight out of the 10 countries cited approvingly in the government's affidavit have regulated polygyny by making it conditional. It would therefore be improper to hold up these countries as examples in the case of instant triple talaq - which all 10 have invalidated while ignoring 80 per cent of them on polygyny.
How to judge the judges In line with global practice, India must revise existing mechanisms and deliberate on the performance evaluation of judges at all levels of the judiciary Recently, the law department in Gujarat, on the recommendation of the Gujarat High Court, cracked the whip on 17 judges from various cadres in lower courts, ordering their retirement for unsatisfactory performance. News reports suggest that these judges were issued notices to improve their performance but their failure to heed to these warnings led to the government taking this drastic step. While this action of the State government suggests that holding judges to performance standards is gaining momentum, the existing system of performance evaluation for the lower judiciary is plagued with various problems. More worryingly, the higher judiciary in India is not subject to any sort of evaluation. Assessing judges, India and abroad Lower court judges in India are evaluated through a system of Annual Confidential Reports (ACRs), which are
completed by the seniormost judges of the lower court, and reviewed by the State High Court. But ACRs are neither filled up regularly nor is the evaluation process transparent. Concerns about this lack of due process have even reached the Supreme Court, which early this month summoned the Registrar General of the Delhi High Court to explain why a lower court judge was marked as "integrity doubtful" without material basis. The idea for amending and improving existing methods for evaluating judges' performance was floated in 2013, when the Law Ministry acknowledged the need for a more scientific method of performance appraisal of judges. The Ministry also admitted that there was a lack of uniformity of judicial performance appraisal across States. But there have been no significant changes since these observations were made. The Vidhi Centre for Legal Policy recently surveyed the legal community for its views on judicial performance evaluation. Almost all the individuals surveyed said that there should be a

Most survey respondents believed that such appraisal would lead to greater accountability, transparency and better and efficient functioning of judges. This is an opportune moment to revise existing mechanisms and deliberate on the performance evaluation of judges at all levels of the judiciary. Evaluating judges' performance through periodic reviews and evaluations is a common practice across jurisdictions. Formally known as "Judicial Performance Evaluation" (JPE), the system of periodic assessment of judicial performance originated in the U.S. Sitting judges were evaluated to inform voters about a judge's performance record for 'retention elections'. Retention elections allow the public to vote for or against the continuing tenure of judges. JPEs became institutionalised over time, and are now regularly followed across the U.S., with most States incorporating provisions for evaluating judges in their constitutions. In the European Union, the

European Commission for the Efficiency of Justice conducts a periodic performance review of court systems of different member states. This country-wise study collects data on various parameters, including the efficiency of courts in justice disposal, the costs per case, and the budget of courts. The outcome of this exercise is the "EU Justice Scoreboard", published annually, rating the working of justice systems across member states. Studies of JPE programmes suggest that parameters for evaluating judicial performance may be qualitative as well as quantitative. These include the rate of disposal of cases by a judge, the quality of judgments and legal reasoning, knowledge of the law, behaviour towards lawyers in court proceedings, independence and transparency. JPE programmes initially tend to use objective criteria to evaluate judges, eventually moving towards more qualitative criteria when systems have evolved sufficiently to reduce likelihood of bias and subjectivity in assessment processes.
Judges in India are nominated or appointed through examination processes and not elected as in the U.S. Therefore, JPE programmes here would not work the same way as in the U.S., where they were formulated to give voters information on judges before retention elections. However, studies of JPEs show that besides providing information to voters, these programmes also serve the purpose of increased transparency and accountability of the judiciary. A regular review of judicial performance ensures that once appointed, judges are mindful of their accountability to the institution of the judiciary. A conversation must begin But even while measuring judicial performance, a delicate balance needs to be struck. Scholars have expressed reservations that performance evaluations could compromise the independence of the judiciary. To avoid this, a JPE programme is best devised by the judiciary itself, instead of by the government. The Madras High Court, for the first time, has come out with qualitative as well as
quantitative performance assessment of its judges this year. This exercise was met with mixed reactions from lawyers, some of whom felt that this could unduly pressurise judges to dispose of cases, and encourage indiscriminate disposal rather than delivering justice. Despite the opposition from a section of lawyers, this is precisely the sort of performance evaluation courts should start conversations about. The first step towards such evaluation should be the objectives of such evaluation, such as improving quality of justice, pendency rates, and so on. A joint consultation could be held with stakeholders, including judges, lawyers, academics and members of civil society to understand how best to initiate such a system in India. Any codified system that emerges from these discussions, say, in the form of guidelines or regulations, must be reviewed to ensure minimum bias and maximum transparency. All these steps would help India work towards higher standards and greater accountability in judicial functioning.

Sensex, Nifty recover a Tata said to approach sovereign funds tad, reverse early losses on buying out ousted chief Mumbai, Oct 28: Market reversed initial losses as the Sensex rose 45 points after emergence of fresh buying mainly in metal, auto and industrials. But telecom remained on the sell list. Nifty jumped over the 8600 level on the first day of the November series of derivatives contracts. The BSE Sensex traded at 27,960.67 at 1100 hours, up 44.77 points, or 0.16 per cent, from its last close. The 50-share Nifty firmed up 25.45 points, or 0.30 per cent, to 8,640.70 at 1100 hours. Major gainers were Tata Motors 2.53 per cent, Coal India 2.05 per cent, Dr Reddy's 1.89 per cent, Tata Steel 1.41 per cent, Adani Ports 1.33 per cent, Lupin1.21 per cent and Hero MotoCorp 1.16 per cent.

Amazon boxes are seen stacked for delivery Bengaluru, Oct 28: Amazon's fight with Flipkart to become India's largest e-commerce marketplace has emerged as the biggest source of drain on its international margins. Since mid 2014, Amazon has pledged to invest $5 billion to grow its business in India, an amount far higher than the $3 billion unlisted rival Flipkart has managed to raise so far. "By far the biggest individual thing is the investment in India that we continue to make and very excited about it, the initial reaction in India from both the customers and also sellers," said Brian T Olsavsky, Chief Financial Officer at Amazon, during a call with analysts and investors on Thursday. Since entering India three years ago, Amazon has invested in building warehouses in major hubs, buying bollywood rights to power its upcoming Prime video streaming service, under cutting costs of products by charging lesser commission from traders on its
platform and marketing aggressively to build its brand. It also has expanded its India technology team, which helps build products for its global operations, besides solutions for the local market. In the quarter ending September, Amazon's international losses, which includes India, more than doubled to $ 541 million, largely due to investments in India. Amazon's international business, which contributes a third of its total revenue, stood at $10.6 billion in the quarter. The losses would have spiked in the quarter due to its aggressive spending during the Great Indian festival sale, which saw Flipkart that was almost written off to fight back to top sales during the period. Since mid-last year Flipkart's value eroded by a third from a peak of $15.2 billion to as low as $9 billion after several investor markdowns. Amazon's aggression forced Flipkart to overspend on discounts to customers and and hire ex-
pensive talent, a plan which soon backfired. It led to massive management change that saw cofounder Binny Bansal replace his partner Sachin Bansal as the chief executive and also exodus of top leaders such as Punit Soni, Mukesh Bansal and most recently Sanjay Baweja. At the same time, top investor Tiger Global stepped in to rationalise costs, weed out expensive talent and push the company towards profitability. "As people get more and more comfortable with the convenience that e-commerce offers, the scale, the diversity and more customers come into the fold, the business structure is such that we will see profitability. It may not be in the next 6 months but we definitely are on that path," said Sanjay Baweja, outgoing CFO of Flipkart in an interview on Wednesday. Now that Amazon is within striking distance of Flipkart, the pace of investment isn't expected to slow down soon as the Indian company is looking to raise fresh funds of $1 billion, reportedly from Walmart. "We are very encouraged by what we're seeing in India but it is certainly very early on still. Most recent highlights would be the launch of the Prime program in India this past quarter. It's now one of the top selling units based on Amazon.in. And so it's very been very well received by customers," said Olsavsky. "It's hard to compare India to any other country. Mumbai, Oct 28: Ratan Tata, who returned this week to the helm of India's largest conglomerate, is seeking a partner that could buy out the Tata Sons stake held by the family of ousted Chairman Cyrus Mistry, people with knowledge of the matter said. The Tata family trusts have reached out to sovereign wealth funds and other long-term investors to gauge their interest in purchasing the Mistry family's stake if it became available, according to the people. The trusts held preliminary talks with potential buyers of the about 18 per cent Tata Sons stake as they prepare for a number of possible scenarios, the people said. Mistry's family doesn't currently plan to sell its holdings, the people said, asking not to be identified because the information is private. The family trusts wants to ensure that if Mistry's family later decides to sell its stake in the Tata Group holding company, the new investor will be a friendly party that shares their longterm vision, according to the people. Tata Sons owns more than $65 billion worth of listed company shares, data compiled by
Bloomberg show. On Monday, Tata Group's holding company abruptly ousted Mistry as chairman and replaced him with his 78-year-old predecessor Ratan Tata, a scion of the founding family. The rift, which had been brewing for months, signals an end to Mistry's push to bring more fiscal prudence to the coffee-to-cars conglomerate after a string of global acquisitions. The Tata trusts, which currently own about 66 percent of Tata Sons, have also been drafting plans for how to raise funds if they were to make an offer for the Mistry family stake themselves, one of the people said. The plans could involve the Tata trusts paring holdings in various operating companies to be able to afford the purchase, according to the person. Mistry is still considering his next steps and plans to make a decision on his response to the ouster in the next couple of weeks, another person said. A spokesman for Tata Sons declined to comment and a representative for the Mistry family's holding company, Shapoorji Pallonji Group, declined to comment.
Allahabad High Court the first batch of eight on January 28 and the second for appointment of 27 judges in August both are yet to be notified. The Allahabad High Court is functioning with less than 50 per cent of its strength with just 77 judges against the approved strength of 160. These appointments assume significance considering that the country's largest High Court accounts for about 25 per cent of nearly 40 lakh cases pending in all 24 high courts and would have helped bring down vacancies from a high of 83 to 48, improving the bench strength to 112. Annoyed by the inordinate delay in notifying appointments, Chief Justice of India TS Thakur had during the last hear-
ing warned the government of passing an order and "fastening accountability" if the logjam continued which, he said, stifled judicial work. In the last week of September, the government notified appointment of at least 25 judges. The SC collegium is believed to have cleared more than 100 names for appointment to several high courts after scrapping the National Judicial Appointments Commission in October 2015. In the first batch of recommendations sent to the government in January for the Allahabad high court, the apex court collegium is believed to have recommended eight out of 19 advocates approved by the Allahabad High Court collegium and rejected 11. "There should not be a deadlock in appointment of judges. You (Centre) cannot bring the institution to a grinding halt," the apex court said. The court pulled up the Centre saying, "You have committed that process of appointment will continue without finalisation of Memorandum of Procedure. Finalisation of MoP has nothing to do with the ongoing appointment process in judiciary." The apex court is particularly peeved at the pendency of 35 appointments it had cleared for the

Country's fifth largest software exporter Tech Mahindra's revenue rose 8.34 per cent to Rs 7,167.4 crore but margins compressed to 14.9 per cent from 16.4 per cent. in September quarter net income at Rs 644.7 crore from Rs 776.1 crore a year ago owing to restructuring exercise in Europe which hurt its margins. Chief Financial Officer Milind Kulkarni said the quarter saw a USD 13 million hit due to a one-time restructuring exercise in Belgium, where it transferred a part of its operations to India, resulting in margin impact. During the reporting quarter, revenue from European operations grew the fastest at 9.4 per cent over the preceding June quarter, followed by the US at 2.5 per cent. (PTI)
Mumbai, Oct 28: Benchmark share indices firmed up in late noon trades with auto stocks gaining the most led by Tata Motors. At 2:40pm, the S&P BSE Sensex was up 53 points,at 27,969 levels and the Nifty50 was up 26 points at 8,641. Tata Motors was up 2.5% on short covering and renewed buying interest at lower levels after the sharp correction this week. Bajaj Auto was up 2.4%. The two-wheeler major posted a net profit of Rs 1,201 crore for the quarter ended September 2016 compared with Rs 1,120 crore for the quarter ended September 2015. Among other auto stocks, Hero MotoCorp, M&M and Maruti Suzuki were up 0.6%-1.4% each. Markets have remained rangebound as Tata Motorsrebounded, given the corporate struggle prevailing in the conglomerate. At 12:00 pm, the S&P BSE Sensex was up by 40 points, or 0.14 %, trading at 27,955 levels. Nifty50 was up by 26 points, hovering around 8,643 levels. The broader index have clearly outperformed the
benchmarks, with S&P BSE Midcap and Smallcap gaining 1% each. On Sensex, Tata Motors, Coal India, Dr Reddy were the top gainers, posting gains above 2% each, while ICICI Bank, Cipla, Bharti Airtel were the major losers, slipping between 1%-1.5%. Buzzing Stocks Shriram City Union Finance has surged 9% to Rs 2,546, also its record high on BSE, after the company reported a strong 34.3% year on year growth in net profit at Rs 204 crore for the quarter ended September 30, 2016 (Q2FY17), on the back of healthy net interest income. Tech Mahindra has rallied 7% to Rs 444 on BSE in early morning trade after the company reported dollar revenue growth of 5% sequentially on a constant currency basis, best among its peers for the quarter ended September 30, 2016 (Q2FY17). Broader Markets On BSE Midcap, Shriman City Union Finance Ltd gained almost 8%, while Ashok Leyland and Bajaj Finserv edged up 5% and 4% respectively. 65 scrips on the index advanced while 18 declined.
Global Markets Japan's Nikkei share average rose on Friday morning to hover near a six-month high as rising bond yields lifted insurers and banks, which are investing more in overseas bonds amid Japan's low bond yield environment. The Nikkei gained 0.4% to 17,410.28 in mid-morning trade after hitting a fresh sixmonth high of 17,459.02 earlier. For the week, the benchmark index is poised to post two consecutive week of gains. It has gained 1.4% this week. The dollar notched a threemonth high against the yen of 105.34 yen on Thursday, also supporting overall sentiment. The dollar got an overnight lift from yields on US Treasuries, which climbed to roughly fivemonth peaks tracking gains in German and British bond yields as investors speculated that the Bank of England and the European Central Bank would both hold off on further easing measures. Yemen, Oct 28: Shiite rebels in Yemen fired a ballistic missile toward the holy Muslim city of Mecca overnight, Saudi Arabia has said, the insurgents' deepest strike yet into the kingdom amid the country's stalemate civil war. Rebel media in Yemen said the missile targeted an international airport in Jiddah, though Saudi Arabia said it was "intercepted and destroyed" 65 kilometres (40 miles) from Mecca, which is home to the cube-shaped Kaaba that the world's Muslims pray toward five times a day. The missile launch shows the capability of Yemen's Shiite rebels, known as Houthis, and their allies to continue to strike Saudi Arabia. It also drew the immediate anger of Saudi citizens, as the protection of Mecca is a key pillar of the Saudi royal family's prestige and the country's national identity. The Saudi military said the missile, fired Thursday
night from Yemen's northwestern Saada province bordering the kingdom, caused no damage. The Saudi military has a supply of US-made, surface-to-air Patriot missile batteries it previously has fired at Houthi-launched missiles. The military said in a statement carried by the staterun Saudi Press Agency that it immediately targeted the area where the missile was launched in airstrikes. The Houthis and their allies, including forces loyal to former Yemeni President Ali Abdullah Saleh, have a stockpile of Soviet-era Scud missiles and locally designed variants. The Houthi-controlled satellite news channel Al-Masirah published a bulletin saying its forces had fired a Volcano-1 variant missile at Jiddah's King Abdulaziz International Airport, without mentioning Mecca. A resolution presented by Austria, Ireland, Mexico, Nigeria, South Africa and Brazil was adopted by a vote of 123 to 38, with 16 abstentions, following weeks of lobbying by the nuclear powers for 'no' votes. The non-binding resolution provides for negotiations to begin in March next year on the new treaty, citing deep concern over the "catastrophic humanitarian consequences of any use of nuclear weapons." Four of the five UN Security Council nuclear powers -- Britain, France, Russia and the United States -- voted against the resolution while China abstained, as did India and Paki-

Washington, Oct 28: Johnson yesterday said an inter-agency effort resulted in the indictment of all five call centers and 56 people, including 31 from India, as well as the arrest of 20 others in the US, most of whom are Indians. He said they were "engaged in defrauding thousands of victims, stealing more than a total of USD 300 million." The scheme involved a network of call centers based in Ahmedabad, where associates of the ring would call victims in the US impersonating Department of Homeland Security, Internal Revenue Services, or other government officials, demanding payment in order to clear fictitious arrest warrants, orders of deportation, or unpaid income tax, Johnson said. The five Ahmedabad-based call centers that made calls to people living in the US are Hglobal, Call Mantra, Worldwide Solution, Zoriion Communications and Sharma BPO Services. The Treasury Inspector General for Tax Administration (TIGTA), Department of Homeland Security, Department of Justice, the In-
ternal Revenue Service and the Federal Trade Commission announced the indictments, the result of a threeyear investigation that was the largest single domestic law enforcement action connected with the impersonation scam. "To date, more than 1.8 million people have reported to TIGTA that they have received an impersonation call; more than 9,600 victims reported that they paid the impersonators a total amount that exceeds USD 50 million," TIGTA Inspector General J Russell George said. "The largest single amount paid as a result of the IRS impersonation scam as charged in the indictment is USD 136,000, paid by a victim in California," George said. The US Senate Aging Committee, that studies issues related to older Americans, received more than 1,100 calls from senior citizens across the country on its fraud hotline in 2015. Pakistan's main industry body is reviewing trade ties with India and said it has "no compulsions of any sort to continue business and trade relations with India under the current hostile conditions", Pakistan's Dawn newspaper reported today. That's unlikely to affect India in any way, as Indian trade body Assocham said last month that out of India's total merchandise trade of $641 billion in 2015-16, Pakistan accounted for a meagre $2.67 billion. The Federation of Pakistan Chambers of Commerce and Industry president Abdul Rauf Alam further said that the Pakistani business community "was united to take any decision and given the tense situation in the region, it was not possible to continue trade relations with India", the paper said. Manmeet Alisher, a wellknown singer in the Punjabi community, was driving a Brisbane City Council bus when he was targeted by the man who threw an "incendiary device" at him which sparked a fire. Alisher died on the spot while several passengers on board the bus at the time managed to escape through the rear door, said police in Brisbane, the capital of Queensland. Six persons were rushed to a nearby hospital for smoke inhalation and minor injuries, they said. Police said there was "no apparent motive" including terror or race related. A 48-year-old man was taken into custody over the incident.
Detectives from South Brisbane district and the state crime command's homicide group have commenced a homicide investigation, Police Commissioner Ian Stewart said. Preliminary inquiries indicate just after 9 AM (local time) passengers were boarding a bus on Beaudesert Road when a man threw an item at the driver causing fire, police said. Police said the bus, carrying six passengers, pulled into Moorvale Shopping Centre on Beaudesert Road to pick up three passengers when the incident took place. New Delhi, Oct 28 : The new law to prohibit benami transactions, which also provides for up to 7 years imprisonment and penalty for those indulging in such activities, will come into effect from November 1. With a view to curb the menace of black money, Parliament in August had passed the Benami Transactions (Prohibition) Act, after assurance from Finance Minister Arun Jaitleythat genuine religious trusts will be kept out of the purview of the legislation. "The rules and all the provisions of the Benami Transactions (Prohibition) Act shall come into force on November 1, 2016. After coming into effect, the existing Benami Transactions (Prohibition) Act, 1988, shall be renamed as the Prohibition of Benami Property Transactions
Act, 1988," a CBDT statement said. While the existing law provides for up to three years of imprisonment or fine or both for carrying out benami transactions, the amended legislation would provide for seven years imprisonment and fine. The Act defines benami transactions, prohibits them and further provides that any violation is punishable with imprisonment and fine. The PBPT Act prohibits recovery of the property held benami from benamidar by the real owner. "Properties held benami are liable for confiscation by the government without payment of compensation," it said. An appellate mechanism has been provided under the Act in the form of Adjudicating Authority and Appellate Tribunal. A Joint or Additional Commissioner of I-T, an Assistant or Deputy Commis-
sioner and a Tax Recovery Officer in each Principal CCIT Region have been notified to perform the functions and exercise the powers of the Approving Authority, Initiating Officer and Administrator, respectively under the Act, the statement said. While the 1988 Act has nine sections, the amended law would have 71 sections. "There is Section 58 under the law which clearly states that in case of charitable or religious organisation properties, the government has power to exempt those," Jaitley had said responding to concerns of some Parliament members about the applicability of the amended law on properties in the name of holy books and deities. "If there is a genuine property which belongs to a church or a mosque or a gurdwara or a temple, section 58 says that the government has the power to exempt it," he had said. (PTI)
Pakistani troops increasingly target civilians living in border hamlets
The situation worsens during night time as villagers struggle to find a safe place to escape from the gunfire. Jammu, Oct 28: Pakistani troops are pounding border hamlets with heavy mortar shells to especially target civilians in the latest round of ceasefire violations by the neighbouring country. In the past four days, a sixyear old boy and a man have been killed and 24 civilians injured while over 60 cattle have perished and 200 cattle left injured in firing by Pakistani troops. Scores of houses and other structures along the IB in Jammu district are riddled with ammunition from across the border. The situation worsens during night time as villagers struggle to find a safe place to escape from the gunfire. "Pakistani troops are now increasingly targeting civilians. They are resorting to heavy mortar shelling and firing targeting our houses and animals," says Subash Chander of village Suchetgarh said. Subash, whose seven family members were injured as shells exploded in the compound of his house close to IB in Suchetgarh, said the Pakistani troops rain mortar bomb shells and fire from automatic weapons targeting civilians. "We are sitting ducks for the Pakistani troops, who find
civilian targets and their properties to target after they failed to fight with Border Security Force (BSF) troops," he said. The firing from across the border had intensified from October 21 when BSF killed seven Pakistan Rangers and a terrorist in retaliatory firing. Many people from border hamlets in R S Pura, Arnia, Hiranagar, and Pargwal sectors have fled their homes and taken shelter in migrant camps set up by the state government at safer places. "As the shell landed in our compound, there was a deafening blast and splinters injured us mostly in legs. All were lying in blood," Subash's wife Kamlesh Devi said. Kamlesh along with her daughter Sukhi is undergoing treatment in GMC hospital. Daljeet Kaur, who was working close to her house in Chand Chak (R S Pura), was injured when a mortar shell exploded. She was taken by her husband to hospital. "It looks as if Pakistan is specifically targeting civilians and cattle with specific. Their guns look for human targets," Kaur said. In Suchetgarh, Ramesh Chander was returning home on a motorbike when a shell exploded near him, injuring
his leg. In Karotana Khurd hamlet close to Indo-Pak border, Pakistani troops shelled the houses of Kuwinder Singh and Bishan Dass. "We passed the night huddled in one room as the house was shelled," said Kulwinder, who later left his home along with his mother, wife and two daughters. There are similar horrific tales from people, who feel they living under the shadow of death. Harbans Lal of Vidhpur says his entire family would have perished had the shell, which pierced through the roof of their house, had landed any closer to the room where they were huddled. Three shells landed in the compound of the house of Desh Raj of Vidhpur hamlet close to IB in R S Pura. "One shell hit a vehicle and damaged it. One landed close to wash room and another landed in the compound of the house," he said. Director General of Border Security Force K K Sharma had on Monday said that Pakistani troops were targeting civilian areas. "The way they are bombarding our areas, they are targeting civilians but as a policy BSFdoes not target civilians at all," Sharma told reporters here after laying wreath at the mortal remains of BSF Head Constable Susheel Kumar, who died in Pakistani firing, on Monday. "We only target the place from where the fire is coming. We only target military and Pakistan Rangers establishments. we never intentionally target civilian areas," he had said. "As a policy matter, BSF does not target civilian areas in retaliatory action," Sharma had said. He also asserted that the forces "have never initiated" firing. "It is Pakistan who is doing it. As you know in case of Gurnam Singh they killed him in a sniper fire and we gave them a befitting reply," he had said. (Agencies)
The job of 'Police Mitra' will be to help police in addressing issues like drug addiction. New Delhi, Oct 28: Civilians will soon be able to assist police in handling local matters as 'Police Mitra', in an initiative to strengthen the relationship of the security force and the public. The idea was suggested by Prime Minister Narendra Modi at the Directors General of Police and Inspectors General conference last year where he had stressed that police forces should work on bridging the gap between them and the society. Delhi Police Commissioner Alok Kumar Verma has issued standing orders to implement the initiative from today. "The Police Mitra initiative will be implemented from today. Every police station will have civilian volunteers, whose number will depend
on the area, and they will help police in crime prevention and establishing a better public-police interface," said Dependra Pathak, Delhi Police spokesperson and Joint Commissioner of Police (Southwest). The modalities of the programme have also been worked out and those people who have a "good social record" in the area will be enrolled, said the officer. Their job will be to help police in addressing issues like drug addiction, maintaining communal harmony in the area, he added. After being chosen, they will undergo an interactive session at the local police stations where they will be posted and will be apprised of their duties, said the officer.(PTI)
Govt announces 'High Altitude medal' for border troops Greater Noida, Oct 28: Border-guarding troops deployed on posts above 9,000 feet will now be decorated with a new 'high altitude medal' to recognise their services in the tough terrain and adverse climate areas, Union Home Minister Rajnath Singh today. Officiating as the chief guest for the 55th Raising Day celebrations of the Indo-Tibetan Border Police here, Singh said a policy decision has been taken to honour the valour and commitment to duty of the men and women of these forces. The new medal will also given to the personnel of forces like the BSF (IndoPak, Indo-Bangla borderguarding force) and the SSB (Indo-Nepal and IndoBhutan border guarding force) among others. "We got to know that there were some difficulties in awarding the high altitude medals to the personnel working at border outposts located above the height of 9,000 ft. So, we have decided that now all jawans and officers who work at a height of 9,000 ft and above will be awarded with the high altitude medal," he said. The forces, officials said, have been making a demand for instituting such a medal as this will work to boost the morale of those personnel who render duties in such harsh conditions. The Home Minister acknowledged that forces like ITBP work in adverse conditions facing vagaries of harsh climate and difficult
terrain. "I am aware of the adverse conditions the ITBP personnel face while discharging their duties," he said. He recalled his visit to such an ITBP border post in the Ladakh region sometime back. "I have seen ITBP personnel working in tough, adverse conditions and even that could not dampen their morale. They have carried out all responsibilities they were entrusted with," he said. Singh said the government has also recently decided to raise the financial aid amount to the families of the troops of paramilitary forces who lay down their lives in line of duty. "The force personnel who are martyred in combat with terrorists and extremists or anti-social elements, the compensation to them has been increased from Rs 10 lakh to Rs 25 lakh. Those who make the supreme sacrifice in the duty at border posts, the financial aid to their families has been increased from Rs 15 lakh to Rs 35 lakh," the Home Minister said. The 90,000-personnel strong ITBP, raised in 1962, is deployed to secure the 3,488-km Sino-India border running along five states from Karakoram Pass in Jammu and Kashmir to Jechap La in Arunachal Pradesh. Many of the ITBP posts are located at a height of 9,000 feet upto 14,500 feet. (Agencies)
New Delhi, Oct 28: Mehmood Akhtar, the Pakistan High Commission official who was caught for espionage, was trying to gather classified information on deployment of Indian security forces along the western coast, possibly to carry out a strike similar to the 2008 Mumbai terror attack. Akhtar was trying to gather information pertaining to deployment of security forces along the western coast, Sir Creek and Kutch areas and also about military installations in Gujarat, Maharashtra and Goa, a Home Ministry official said. "There have been intelligence inputs that Pakistan's ISI was planning to send terrorists through the sea route to carry out a Mumbai-type terror attack in India. Akhtar's activities and his interests to gather information about the western coast buttress the intelligence inputs," the official said. 166 people lost their lives when 10 terrorists, who came through the Arabian sea from Karachi, carried out mayhem for three days in Mumbai in November 2008. Maulana Ramzan and Subhash Jangir were handing over information to

Shoaib was detained near Jodhpur last evening and after being brought here, he was arrested. While Akhtar was on Thursday declared persona non grata, Subhash and Maulana have been arrested on charges of passing on sensitive information and defence documents and deployment details of BSF along the Indo-Pak border. Akhilesh cautions people against BJP, BSP Lucknow, Oct 28; Hitting out at opposition BJP and BSP, Uttar Pradesh chief minister Akhilesh Yadav on Friday said that while the former was taking the upcoming state Assembly elections towards a "communal agenda", the latter had grabbed "precious land" in the state by putting up statues. "There is a need to remain vigilant from BJP as no one knows what its leaders would say during campaigning," Akhilesh said at a programme here during which he distributed steel plates and glasses to children of government schools on the occasion of Dhanteras. Referring to Prime Minister Narendra Modi's Lucknow speech recently and BJP president Amit Shah's "Jai Shree Ram" slogan in Etawah on Thursday, he
said, "Remember these very people had a different slogan earlier...they used to end their speech with 'Bharat Mata ki jai'...what is being said now?.... this is why we have to remain vigilant." On the development front, Akhilesh said, "I want to ask BJP and its people as to what big they have done for Lucknow...if you compare the two governments on the basis of work done, you will not be able to compare it with Samajwadi government." Taking a dig at BJP, he said that its leaders coin terms which are not easily understood by people and he himself had to consult Google to find out what surgical strike is. Two CoBRA jawans injured in naxal blast Raipur, Oct 28: Two CoBRA jawans were on injured in a pressure bomb blast triggered by naxals in Chhattisgarh's insurgencyhit Bijapur district. The incident occurred at around 11:45 AM when a team of Commando Battalion for Resolute Action's 204th battalion was carrying out a search operation in Basagudapolice station area, a CRPF official said.
"Security forces were out for the operation since morning to the interiors of Basaguda, located around 450 kms away from here. "While they were cordoning off a forested patch near Sankanpalli, about 8 kms away from Basaguda, two jawans inadvertently stepped over a pressure IED (Improvised Explosive Device) connection, triggering the blast that left them
injured," he said. Constable Kishore Behera is seriously injured whereas the other constable Nandan of the battalion has sustained minor injuries, the official said. Soon after the incident, reinforcements were rushed to the spot and the injured were taken to Basaguda from where they will be airlifted to Raipur for further medication, he said. (Agencies)

P12 Debt-ridden Jaypee Group has no plans to sell Buddh International Circuit F1 track New Delhi, Oct 28: Maintenance cost of Buddh International Circuit remains high and no major international race are being organised. Getting Formula 1 back to the Buddh International Circuit (BIC) is not on the priority list for the debt-ridden Jaypee Group but at the same time, it has no plans to sell the USD 400 million facility that put India on the world motorsport map, said track chief Sameer Gaur. "Yes, we are not thinking of hosting any big race including F1 in the near future because of reasons well known but it doesn't mean we are open to selling the circuit. The thought has not even crossed our mind," Gaur, who is Jaypee Sports International MD and CEO, told PTI. The BIC has been away from the limelight ever since the race was dropped from the F1 calendar following three editions from 2011 to 2013. The maintenance cost of the circuit remains high and with no major international race being organised, a handful of domestic events besides vehicle testing days contribute to its running cost. "Maintaining a big facility like BIC is surely tough but we have been able to do that well despite the constraints," he said. The Jaypee Group overall is undergoing tough times. The total debt of the conglomerate is estimated to be around Rs 75,000 crores as on March 31, 2015, according to foreign brokerage firm Credit Suisse. It was not a surprise that it chose to sell some of its cement and hydro-power plants to reduce the debt burden. Even in the existing scenario, Gaur remains an optimist and promised that F1 will return to BIC at some point, though not in the near future. "We built such a huge circuit to host big events like F1. Yes, under the circumstances, it is not at all our focus but when the situation improves, we will surely think about making better use of the track," added Gaur.

I am not training the way I used to train 20 years ago: Paes Pune, Oct 28: Practicing his strokes for over seven million times has given him an unforgettable muscle memory and an uncompromising diet has kept his enviable fitness intact in an astonishing 25-year long career but Leander Paes is not training the way he used to train 20 years ago. The 43-year-old has just finished another season in his glorious career and he is not finished yet. Rather, he has set himself a new target - taking his Grand Slam tally to 20. Passion for the game and a knack for creating history has kept him going but it also involves pain of hard work that may become difficult to sustain year after year. But the legendary athlete keeps himself motivated and continues to find ways to train and hone his body in a way that he can be at par with the younger lot. Never in his career, Paes suffered a major injury that stopped him from playing. Though a few minor injuries such as a rolled ankle have troubled him in the past. So, how has he trained over the years to get such supreme fitness? "Now it's very different than how I used to train 20 years ago," Paes, winner of 18 Grand Slam titles, told media in an interview. "I loved the result of being vegetarian. But my body was not getting Omega 3. I was not getting the zinc, magnesium, and the iron in my body. Because my fat4 percentage was low, every time I played a match, that was over in three sets, which means over two hours, I was getting full body cramps. So I started taking fish, I was only taking salmon. I was allowing good fats but no bad fats like ghee and butter. Till today I eat lot of fish," he elaborated on his diet over the years.
