Crane collapse MAGIC TRICKS investigation continues, public advised to avoid area CYNTHIA REASON creason@insidetoronto.com A Ministry of Labour investigation into a toppled construction crane that left nearly 500 north Etobicoke residents without power Monday has continued after crews worked to safely right the equipment yesterday. The crane, which was being used in the redevelopment of Kipling Acres – a city-owned and operated long-term care home at 2233 Kipling Ave. – collapsed at around 1:45 p.m. Monday and brought down with it an estimated six to seven hydro poles, rendering hundreds of surrounding Toronto Hydro clients powerless. Ministry of Labour spokesperson Matt Blajer told The Guardian on Tuesday that the ministry had both an engineer and an inspector on the site, but their investigation was delayed by the upturned crane. “We can’t do anything until the crane is righted. They have to come up with a procedure on how they’re going to do that and it’s going to be quite complex, and then we have to approve it so that nobody gets hurt,” he said. “Any information we need to do an investigation is in the cab of the crane – all of the documentation and whatnot – and the crane is currently seven metres up in the air, so until they right the thing we can’t really get started on the investigation.” >>>KIPLING, page 9

Youth reminded to ‘dare to dream’

ean Miso’s penned her first children’s book, We’ll Never Forget, to help ensure Canadian veterans from the Second World War up to Afghanistan, including her grandfather, retain their rightful place not only in history, but in the hearts and minds of Canadians. Readers’ questions about the Canadian Forces (CF) and its occupations led the music teacher at Seneca School in central Etobicoke to spend the past year conducting research, searching photo archives, obtaining permissions from various government agencies and conducting inperson interviews with dozens of Canadian Forces’ personnel from coast-to-coast to write her latest volume. Her recently self-published, Their Duty, Our Pride, features the military biographies of soldiers working in countless trades in the Canadian Army, Air Force and Navy not necessarily serving with boots on the ground, in an airplane or on board a ship. By design, male and female soldiers of various ethnic backgrounds through every rank, up to and including Brig.-Gen. Fred Lewis, are chronicled. “The book profiles everyone from privates to generals throughout the Forces from a diversity of backgrounds, both men and women,” the Etobicoke author and music composer said. “What’s key is that they all feel success at their level. Success does not depend on making it to general. Success is intrinsic.” Miso focused on casting the military “in the light of leadership” in her book, and as an inspiration to children in particular, and to Canadian society as a whole. “I saw them as exemplary role models for people who need them, such as children, students. The core values in the military are the same values we want to instill as parents and educators. I want youth to look at them as a source

of inspiration.” Their Duty, Our Pride profiles an intelligence officer, infantry officer, Canadian Ranger, combat engineer, supply technician, chaplain, search and rescue technician, medic, pilot and logistics officer, among others. Search and rescue (SAR) technician Sgt. Audrey Bourgoin’s story stuck with Miso. The woman from Chicoutimi, Que. is only the second woman in Canada to become a SAR Tech since 1944. Bourgoin’s first hurdle was to learn English. She became bilingual. Trained as paramedics, mountain climbers, parachutists and scuba divers in all terrains and Canadian climates, Bourgoin must pass exams regularly to keep her demanding job. “Audrey shows such drive and determination,” Miso said. “She’s a real leader. She’s focused and driven to meet her goals and to do what it takes.” Bourgoin offered this inspira-

tion to young Canadians in Miso’s book: “It is all about what you want to do and what you think you can do. If you focus on your goals in life, you will achieve them.” Miso worked with reprographics’ artist Doug Shaw on the unique look of the hardcover book. The pair collaborated on the popular videogame Call of Duty-inspired illustrations expanded out from actual photographs, most of which Miso sourced from the website, Combat Camera. Some interview subjects, including Bourgoin, also provided Miso personal photographs. Miso and Shaw’s first image for the book is a scene referenced by nearly every CF personnel she interviews: soldiers carrying the Canadian flag-draped casket of a fallen colleague down the airfield to the waiting plane for the repatriation flight home. This week, Miso hand-delivered a copy of her book to “a

great man, a true leader” — Chief of the Defence Staff Gen. Walter Natynczyk, in his Ottawa office where she had earlier met and interviewed him. Natynczyk wrote in his foreword to Miso’s book: “The Canadian Forces is one of the finest, most professional armed forces in the world. Wherever our men and women go, they make a contribution to their community, to Canada and to troubled regions around the world. Canadians have felt pride during our successes and they have grieved the losses. “As members of the Canadian Forces, we always strive to do our duty with integrity, loyalty and courage to bring honour to Canada.” “All gentle giants” is how Miso described Canada’s highest general, indeed all four generals she met this week. Miso composed the words and music to the song, Honour and Pride, to accompany the book. A CD featuring three versions of the song is attached to the book’s back cover. “Dare to dream with open eyes; imagine who you can be” is Miso’s favourite line of the song. “Youth have to be able to dare to dream it,” Miso said. “The message of the book is that you are somebody even at an entry-level position in the Canadian Forces. I think that’s a positive message. Canadian Forces train the person below them and train for the next level while performing the job. There is advancement for everybody; that opportunity is available to you if you want it. “Youth, especially, need to see there is success at every level. They need to internalize that, to know that success comes from within.” Miso has printed 5,800 copies of the self-published title. Donate school supplies and help homeless high school-aged youth get a jump on their studies. Woodbine Centre visitors are invited to donate school supplies to a large “school bus” donation box in the mall’s centre court for youth enrolled in Youth Without Shelter’s Stay in School program. Visitors to the Hwy. 27 and Rexdale Boulevard mall who donate five items or more receive a free movie pass for Rainbow Cinemas. Supplies needed include pens and pencils, markers, crayons, pencil crayons, memory sticks, loose-leaf paper, glue sticks, memory sticks, lined and blank notebooks, binders, dividers, graph paper, rulers, printer paper, erasers, pencil cases, calculators, geometry sets, bristol board and alarm clocks. The drive runs through Sept. 2. Youth Without Shelter (YWS) is an emergency residence and referral agency in north Etobicoke that has served more than 14,000 homeless youth aged 16 to 24 since it opened in 1986. Thirty youth live on the shelter’s emergency side, with another approximately 20 enrolled in YWS’s Stay in School program. Since opening in 2007, YWS’s Stay in School program has celebrated 27 high school graduations.

The Ex sets the stage for creating family traditions

T

he Canadian National Exhibition has been one of Toronto’s great summer traditions since 1879. Whether you are a newcomer to this city or a born-and-bred Torontonian, the Ex is one of those experiences that make living here special. Many residents hold memories of visits to the fair with family and friends as a key part of their summer. Perhaps they remember going on their first roller coaster, maybe it was the old wooden Flyer, seeing a big-name band play at The Grandstand, or eating a special food that only seemed to be available at the Ex. our view For those spending their first summer in Toronto, it’s a chance Beginning of to create family memories and traditions of their own. It’s a bittersweet time as summer marches to its end, and that’s why the 18 days of the Ex mean so much to those who attend. Along with going to the Ex as a visitor, the fair is also a huge employer for local youngsters. The economic impact of the CNE to Toronto, though, goes beyond youth employment. According to the CNE, it had 1.31 million visitors last year, with many of them coming from out of town, spending their tourists dollars not only at the Ex but also other sites across the city. Along with economic benefits, the Ex is also a place for many young people to highlight skills ranging from dancing to accordion playing to baseball. And speaking of baseball, the Ex is home to one of the province’s most prestigious peewee tournaments. The 56th annual Lions-CNE Peewee Baseball Tournament is now underway at the ballpark located near the Dufferin Gate. Local teams competing in this year’s tournament are from East York, Scarborough, North York, North Toronto, Etobicoke, and a squad from the Toronto Playgrounds league. Other teams participating come mostly from the Greater Toronto Area, with squads this year also travelling in from Stratford and Niagara Falls. The champs of the first tournament back in 1956 were from the East Riverdale playground league, but it’s been 10 years since a Toronto-based team, the Agincourt A’s of Scarborough in 2002, took a title. To the editor: Re: ‘Better recycling starts at home,’ Editorial, Aug. 16. While I agree with the gist of the editorial that we must each do our part to sort our trash properly, I believe we need to take a step back further to the origin of our recyclables. While it may not be an issue for the City of Toronto on its own, all municipalities would benefit from requiring the manufacturers of goods to ensure their products and packaging is recyclable. This may entail an increase in packaging cost that may be passed onto consumers, but the ultimate savings would recover those costs. I am prepared to do my part in sorting, but I would hope it would be easier knowing all packaging and products were eventually recyclable. This would ensure the 100 per cent compliance you call for in your editorial. Marc Charbonneau

TTC should remember riders in new board

T

here’s been a lot of to-ing and fro-ing on the transit file this past year. But as the dust settles on the subwayversus-light-rail battle for the future of transit – the hiring and firing of chief general managers — the prospect of new taxes to pay for new subways, our attention slipped away from a more quotidian matter: the question of governance. It came up earlier this year as Toronto City Council voted to keep Karen Stintz as chair of the TTC and replace a commission of Mayor Rob Ford loyalists with members from council’s centre and left wings. That shift — a response to the mayor’s role in the firing of transit boss Gary Webster — was half the plan. The other half was the introduction of an old idea: citizen members,

appointed by council, would sit on the TTC along with elected officials. This was something Ford wanted to do holus-bolus, but council went a more moderate route, agreeing to create an 11-member commission with four citizen appointees and seven councillors. In September, Toronto’s Civic Appointment Committee will be making recommendations about who those four citizens should be. Toronto City Manager Joe Pennachetti has hired NAFOR Executive Recruiting to pre-select candidates, and the committee will be

looking at their report in September. Hard to say who will be on that list, but in a letter NAFOR has given a sense of the size of the pool – 485 applied – and the criteria they’re using. The most qualified candidates meet some high requirements: they will understand large project management, have experience working for large boards and large companies and will have strong management skills, honed in the public, private or non-profit sectors. If the commission has four of these sorts on board, the politicians will find themselves outclassed in terms of organizational management: municipal politicians, particularly the ones in Toronto, arrive with more populist CVs. They also may find themselves further isolated from the people who

matter most in the transit equation: namely, the riders who are navigating an increasingly crowded, expensive and frankly spotty service as they make their way about the city. For the past year and a half, those riders could be excused for feeling a little like pawns in a highlevel political chess game between council and the mayor. It would be wrong to say that riders have been utterly voiceless in this age of Twitter and Facebook; but it would go a long way to righting the imbalance, to have one or two citizen appointees whose major contribution to the debate was in their understanding of the rider’s experience. n David Nickle is The Guardian’s city hall reporter. Crown appeals “manifestly unfit” sentence in scaffolding tragedy Ontario’s Office of the Attorney General has filed an appeal of what it calls the ‘manifestly unfit’ sentencing of a Torontobased construction company convicted of criminal negligence and ordered to pay just $200,000 in fines in the deaths of four workers in Etobicoke on Christmas Eve 2009. The Crown’s appeal, which was filed back on Aug. 7, alleges the trial judge erred in his sentencing assessment of Metron Construction and in his approach to two sections of the Criminal Code. “The trial judge erred in his assessment of the appropriate sentencing range and imposed a sentence that did not sufficiently reflect the high level of culpability required for a criminal conviction,” the appeal reads in part. The Ontario Federation of Labour (OFL) applauded the Crown’s move to appeal this week. “The criminal conviction of Metron Construction was historic, but the imposition of a trivial sentence for the deaths

of four workers was a disgrace to the families of the survivors and set a shameful precedent,” OFL President Sid Ryan said in a statement released on Tuesday. “If a worker’s life is only worth $50,000, then bosses can simply chalk workplace fatalities up as the cost of doing business.” On Dec. 24, 2009, Alexander Bo n d o re v, 2 5 , A l e k s e y Blumberg, 33, Fayzulla Fazilov, 31, and Vladimir Korostin, 40, plummeted 13 storeys to their deaths when the highrise scaffolding they were working on at 2757 Kipling Ave. snapped in half and collapsed. None of them were connected to safety lifelines. A fifth worker, then-21year-old Dilshod Mamurov, who was not secured properly by his lifeline, clung briefly to the broken equipment before falling and suffering broken legs and a broken spine. A sixth, unnamed worker survived unharmed, as he was properly connected to his safety harness. All five victims of the acci-

dent – considered the worst construction accident in Toronto in more than 50 years – were reported to be migrant workers from the Republic of Uzbekistan, Ukraine, and Latvia. Back in June of this year, Metron Construction – the company the men were working for at the time of the accident – pleaded guilty to criminal negligence causing death in the accident, becoming the first firm in Ontario to be convicted of such a charge. While the OFL had been calling for jail time for Metron’s owner Joel Swartz, Justice Robert Bigelow instead handed down $200,000 in fines against Metron during sentencing on July 13. Swartz himself faces $90,000 in fines for Occupational Health and Safety Act violations. The ‘leniency’ of the penalty sparked outrage among workers and led the OFL to immediately call on the Crown to appeal the sentence, Ryan said. ~Cynthia Reason

Tested here is the 2012 Ford Focus Electric or more properly BEV (Battery Electric Vehicle), which is just like any other Focus except there is no engine, gas tank and zero, and I mean zero, emissions. Outwardly, it is identical to a standard Focus and so is most of the standard equipment. both heated and cooled to cope with weather extremes. Ford in Michigan makes the battery in partnership with LG Chem. Together, power is rated at 143 hp and 184 lb/ft of torque. Ford claims it has a range of up to 160 km and top speed is 136 km/h with a one-speed transmission driving the front wheels. It comes equipped with a special hand-held five-prong plug and a 10-foot electric cord with a grounded three-prong plug at the other end that goes into any standard 110-volt outlet. Located on the left front fender, the charge port activates a light ring that illuminates the port twice when plugged in. Each quadrant represents 25 per cent of the maximum battery charge. Flashing quadrants represent charge in progress and solid-lit quadrants show stages of charge completion. bottom. As power is consumed, the level goes down and shows roughly how many kilometers remain based on the way the car is being driven at the time. You can add kms by braking and, as I was to find out, by coasting downhill. One of the anxieties about electric cars is charge time. Ford does offer a 240-volt charging station that is claimed to lower the charge time to something like four hours. On my first trip around town I covered 80.1 km and used 12.7 kW. The

display showed the battery down about 40 per cent. According to the supplementary readout, it was going to take 8.1 hours to recharge. Plugging in inside our garage at 8 p.m. to take advantage of off-peak power rates, the blue ring was out, showing it was fully charged when I went out to check at 8 a.m. the next day. That was quite acceptable, as getting around town and having it ready to go the next day is probably the main use this car will see.

The 2013 Mercedes-Benz SL 550 is more powerful and 13 per cent more fuel-efficient than the outgoing model.

It wasn’t so much the eyebrowraising amenities or the riveting acceleration of the 2013 Mercedes-Benz SL 550 that captured my attention, but the fuel mileage. Good mileage in a 429 hp (516 lb/ft of torque) twin-turbo V8 luxury roadster was the last thing I was thinking about dur-

ing the Canadian press launch in Halifax - but the gas gauge rarely lies. After some 400 km, my co-driver and I used just a tad below half a tank. Later I learned the EnerGuide numbers for the new SL 550 are 12.7/8.1L/100 km city/highway. You’d never guess by looking at the engine. It’s a DOHC 4.6-litre

V8 with turbo intake runners the size of rainwater downpipes. All shrouded and jam-packed into the engine bay, good on gas is the last thing that comes to mind. And it is fast. The $129,900 (to start) SL 550 tested here gets from 0-100 km/h in 4.6 seconds. If that isn’t enough, the SL AMG

63 with this 530 hp (590 lb/ft) 5.5-litre biturbo does 0-100 km/h in 4.3 seconds and 4.2 seconds if you add the AMG Performance Package. And just to hammer it home, the SL AMG 65 with 621 hp (738 lb/ft) 6.0-litre V12 does it in 4.1 seconds with a top speed of 300 km/h. Highway cruising in the SL 550 is effortless. You can drive this car across Canada and emerge relaxed and rested. But when you get to windy roads, the real beauty of the new SL 550 comes to the fore. One of the contributors is Active Body Control (ABC) that adapts the damping of the car body to the current driving situation in a split second using high-pressure hydraulics and two high-performance microcomputers. By countering body pitch, roll and squat, the ABC system provides tenacious road holding as well as improved ride comfort. On the nifty side is a button just to the right to manually adjust ride height and beside that one, when pressed, shows a graphic on the centre monitor with G forces in real time. The standard 7G-TRONIC PLUS automatic transmission has been optimized in relation to fuel consumption and comfort and also contributes to low

fuel consumption, not to mention the 125 kg lighter body thanks to the extensive use of aluminum. The SL Active Lane Keeping Assist system raises the bar. When you stray across the yellow line, it gives a little vibration to the steering wheel. Inside, the new SL brims over with a truly lengthy list of standard and optional features. One is the unique “Frontbass� system, which turns the luxury sports car into a concert hall regardless whether the top is open or closed. It features subwoofers buried in the front foot wells that createn a resonating chamber that lets low notes through with minimum distortion. I could write volumes about the interior amenities but I have to mention the 10-way power front seats. They have a massage function with four settings including one called “Fast and Vigorous.� Longer than the outgoing SL, the upright grille with large three-pointed star, big slated air vents behind each front wheel and (for Canada) standard 19inch AMG wheels make for an imposing package moving or standing still. One way of wowing the onlookers was demonstrating how the trunk could be opened with

the swipe of a foot under the rear bumper. Part of the Premium Package, there are motion sensors beneath the rear valance panel. As long has you have the key in your pocket, you can walk up with arms full of groceries swipe and, presto, it opens. The roof goes up and down in 20 seconds and there are two to chose from. Also part of the system is a power wind blocker that retracts between the two seats. It was a glorious day in brilliant sunshine on near traffic free open roads. And in a red roadster like the 2013 Mercedes-Benz SL 550 how does it get better than that?.

ONTARIO GOVERNMENT NOTICE NOTICE OF PUBLIC INFORMATION CENTRE Rehabilitation of the Highway 401 Eastbound Collector Lanes From Jane Street to East of Avenue Road Detail Design and Class Environmental Assessment Study THE PROJECT URS Canada Inc. has been retained by the Ontario Ministry of Transportation (MTO) to undertake a Detail Design and Class Environmental Assessment Study to determine the rehabilitation needs for the eastbound collector lanes along the section of Highway 401 from Jane Street to east of Avenue Road. The improvements for this contract include the rehabilitation of pavement, bridges, retaining walls and the replacement/upgrading of overhead sign support structures, traffic signals, noise barriers, illumination and roadside safety treatments. This contract also includes the consideration of an additional lane from Allen Road to Avenue Road in an effort to improve traffic flow. Construction staging for the recommended improvements is also being considered as part of this study. The project limits are located in the City of Toronto. THE PROCESS This study is following the approved planning process for a Group ‘B’ project under the MTO Class Environmental Assessment for Provincial Transportation Facilities (2000).
