ALot has changed in the intervening years but one thing hasn’t…..America’s love of the automobile has grown stronger every year. Whether it is a combustion engine or electric, the fact that we can achieve independence through a car has put America on the road since the turn of the last century.

There is a car for every man, woman and child in the USA. With over 300,000,000 autos in circulation in the USA that is alot of wear and tea and all of those vehicles will need servicing on a somewhat regular basis. Not to mention, many

cars on the roadways aren’t brand-new. The average car in operation in the U.S. is just under 12 years old.

With iconic brands like Meineke, MAACO, Jiffy Lube, AAMCO, Midas, Costa Oil and the list goes on and on, the US has services to reach just about every car owner. Auto franchises are part of the automotive aftermarket industry. The automotive aftermarket includes all products and services purchased after the first sale of an automobile. Find out exactly who regulates franchising in the world’s biggest single market

The European Union comprises 27 member nations with an estimated 450 million people within the trading block. There are an estimated 22.5 million small and medium sized enterprises in the EU. From that, the European Franchise Federation (EFF) estimates there are 8,500 distinct franchise brands.

Despite the vast language and cultural differences in Europe, franchising is more widely used as a business strategy in Europe than it is in the United States – which has an approximate 2,500 distinct franchise brands.

As it stands, there is no overarching body of law that governs franchising in the member states of Europe. It

therefore becomes a matter of state-by-state legislation regulation between the participating entities, as opposed to any type of common EU legislature. That’s not to say the EU or other governing bodies haven’t had any input in establishing the perimeters of what is both fair, or just, in terms of franchising. This article will

unpack the who’s-who of European franchise regulation, before outlining several European state examples of how franchising law operates within national borders.

THE EUROPEAN COMMISSION

The European Commission is the executive branch of the European Union, responsible for proposing legislation, implementing decisions, upholding the EU treaties and managing the dayto-day business of the EU. Therefore, among EU nations, the concept of franchise is taken from the European Economic Community (EEC) Treaty. In 1988 the European Commission defined a ‘franchise concept’ and a ‘franchise contract’ in Article 85 (3) of the Treaty to categorize franchise agreements.

FRANCHISE CONCEPT

“A package of industrial or intellectual property rights relating to trademarks, trade names, shop signs, utility models, designs, copyrights, know-how or patents, to be exploited for the resale of goods or the provision of services to end users.”

Franchise Contract

“An agreement whereby one undertaking, the franchisor, grants the other, the franchisee, in exchange for direct or indirect financial consideration, the right to exploit a franchise for the purposes of marketing specified types of goods and/or services.”

JURISPRUDENCE

This updated EC definition of franchising was spurred by case-based rulings of the Court of Justice of the European Union (CJEU). The Court of Justice of the European Union (CJEU) interprets EU law to make sure it’s applied the same way across all EU countries, settling legal disputes between national governments and EU institutions. There have been several major cases, but the most important is the Pronuptia (1986) case, which set the benchmark for obligations of franchisees and franchisors and led to the creation of the block exemption regulations.

The CJEU ruled that franchisees had to be an independent business. Therefore, franchisees should learn the know-how skills of the franchisor, use their brand name, have a reasonable non-compete clause and pay royalties to the franchisor. Price recommendations made by the franchisor were not prohibited as long they were not obligatory.

THE EUROPEAN UNION INTELLECTUAL PROPERTY OFFICE (EUIPO)

Another cornerstone of the franchising framework is the European Union Intellectual Property Office. Founded in 1994, this EU agency is responsible for the registration of the European Union trade mark and the registered Community design across the 27 Member States of the EU. They also work with the IP

offices of all EU Member States and international partners to offer a similar registration experience for trade marks and designs across Europe and the world.

With a single application, the EUIPO offers business and citizens exclusive rights for trade mark and design protection in the EU. There are five working languages at the Office – English, French, German, Italian and Spanish. The office also processes trade mark and design applications in 23 official languages of the EU.

• The European Union trade mark (EUTM) grants exclusive rights in all current and future Member States of the European Union through a single registration, filed online. The basic registration fee is EUR 850 and it covers one class of goods and services. An EU trade mark registration lasts for 10 years but can be renewed indefinitely in blocks of 10 years.

• The registered Community design (RCD) also grants exclusive rights throughout the European Union and future Member States. The fee for registering and publishing one design is EUR 350. A registered Community design is initially valid for five years from the date of filing and can be renewed in blocks of five years up to a maximum of 25 years.

Federation has led the way for ethical franchising practices. The EFF has 19 state members from EU, EEA and other European nations. In 1972 this non-for-profit organization developed a European Code of Ethics.

The European Commission endorses the organization, describing the code as, “the franchising industry’s selfregulatory code, designed for all stakeholders in the franchise industry in Europe, franchisors and franchisees in particular, looking for guidance on best practice in franchising relations.”

CODE OF ETHICS

The Code of Ethics isn’t designed to replace the sovereign law of any nation, but rather unify the diverse franchising industry of Europe’s regulation integrity. Only one national franchising association can become a member in each European country. And for EFF members the code is binding.

As individual laws and regulations vary from country to country, member associations will be the specialist authority in their own jurisdiction, while at the same time following the code of ethics to ensure the best and fairest franchising practices will be met by all.

BELARUS

The Civil Code of the Republic of Belarus is the main legal document regulating franchising in Belarus.

The franchising agreement must be concluded in writing. The agreement has to be registered at The National Centre of Intellectual Property. Amendments to the agreement or its termination, or expiry, also constitutes grounds for registration. If the franchisor does not reside in the country, the amount of its franchise remuneration

constitutes the grounds for the taxation of income of foreign companies that do not perform any activities in the territory of Belarus. Unless otherwise provided in the Agreement of the Elimination of Double Taxation, the tax tariff for the franchise fee payment is 15 percent. A franchisee residing in the Republic of Belarus shall hold and transfer this tax to the tax office from the amount of franchise remuneration payable to a foreign franchisor.

ESTONIA

Franchise agreements in Estonia are regulated by the Law of Obligations Act. The legal regulation of franchise agreements in Estonia allows a relatively easy signing of an agreement. Rights, obligations and liabilities (duties) of the parties are defined by the law in order to provide additional protection to the agreement. Industrial property law and competition laws are in accordance with EU regulations.

FRANCE

France has no such regulation that defines a franchise. Franchising in France has been defined by case-law and is subject to business regulations such as contract and commercial law principles. As such, to be considered a franchise in France the agreement must cover the

right to use a registered trademark, and cover the transfer of know-how.

Furthermore, franchisors have to produce a precontractual document and be transparent with their franchisees in terms of their business and franchise network. The precontractual document has to be delivered ahead of time before the signing of any franchise agreement. It is imperative that the franchise agreement be balanced and reflects real negotiation between the franchisor and franchisee to avoid any future annulling of contractual provisions down the line (under domestic French laws).

GERMANY

There are no specific regulations outlined in German law pertaining to franchising. Therefore, the legal frameworks come through domestic German contract law, consumer law, commercial law, competition law and unfair trade laws. Franchisors in Germany must also deliver pre-contract information to the franchisee ahead of time. Furthermore, all contract provisions have to be reasonable and cannot unduly disadvantage one

party over the other – or else those contractual provisions could be void down the line.

HUNGARY

There are no specific franchising laws in Hungary, however a civil code outlines the basic relationship of a franchise (Act V). Local provisions of contract law within the civil code act as the legal protocols for franchising at this point in time. In addition, intellectual property laws, competition laws and advertising laws in Hungary may also play a part in franchising regulation. There are no laws that affect the offer and sale of franchises in Hungary, nor are there laws that affect the ongoing relationship between franchisor and franchisee.

ITALY

In Italy there is a law that regulates Franchise law. Law no 129/2004 applies to all franchisors both local and foreign. This ‘Italian Franchise Law’ outlines rules in relation to content of the contract, such as form, duration, termination and renewal, etc. Under law no 129/2004, franchisors have to provide the pre-contract disclosure at least 30 days before signing

the franchise agreement. In terms of duration, the minimum franchise agreement is three years and must include explicit territory specs and clear royalty calculations. To operate in Italy, you will also need to provide a business formula that has been tested on the market.

Other laws that govern and protect franchising in Italy include the Min. Decree no 204/2005 (particularly relevant for foreign investors and master franchisees), the intellectual property code, consumer code, and the decree on misleading advertising and various contract laws.

LATVIA

Franchise agreement is regulated by the national Commercial Law. The regulation of the trade agreement is applicable to all types of franchise agreements and includes the regulation of franchise publication, determines rights and obligations of both parties and provides for exclusive rights for the parties to terminate the agreement unilaterally. Industrial property law and competition laws are in accordance with EU regulations.

LITHUANIA

Lithuanian Civil Code contains an entire chapter devoted to franchise (chapter XXXVII). Franchise agreements must be concluded in writing. The franchise must be remunerated and when forming a franchise agreement, it must be entered in the Register of Legal Entities - where the franchisor's business is registered. When the franchisor’s business is registered in a foreign country, a new franchise agreement must be filed at the Register of Legal Entities, where the franchisee is registered. A franchisee who has duly fulfilled their obligations under the franchise agreement has the right to seek a new agreement, for a new term, under the same terms and conditions. Industrial property law and competition laws are also in accordance with EU regulations.

POLAND

There are no specific laws in Poland that regulate franchising. General civil contract laws cover franchising agreements, as well as industrial property law and competition laws. These systems are in accordance with EU regulations. Franchise contracts can be signed in

any language. In the event of a dispute, parties have the option between litigation or alternative resolutions and are free to choose any jurisdiction which will accept to settle the dispute. However, most franchisees will expect the contract to be in the Polish language and under Polish law.

Disputes regarding franchise agreements have been brought to courts and typically refer to jurisprudence. One key judgment stated in the case of a dispute, unclear and imprecise contractual provisions within a franchise agreement, will be interpreted in favor of the party that received the draft of agreement to sign (i.e. the franchisee).

SPAIN

There are no specific franchise laws in Spain that regulate the relationship between franchisee and franchisor. Rather, Spanish franchise regulations are set out across several laws that relate to different aspects of franchising. Spanish franchising agreements fall under civil and commercial laws of contract. It is also important to know when entering the Spanish market about the Competition Act

– and the vertical restraint block exemptions.

Another important thing to know is there is a coolingoff period. This means the franchisor has to deliver a full pre-agreement 20 days prior to signing the contract, otherwise the contract will be void and no money will be exchanged.

TURKEY

There are no specific laws or regulations for franchising in Turkey. General regulations for trade and contracts validate franchise relations. Competition Law is enforced on franchise relations in Turkey, which are similar to EU regulations:

• Franchisors shall not force franchisees to buy goods from approved suppliers, if the same or equivalent goods are available in the market at better price;

• Franchisors shall not predict selling retail prices to franchisees;

• Agreements longer than 5 years are regarded as limitless and may be terminated in writing with a notice period.

Judgements and supreme court decisions about franchise conflicts have set a precedent in Turkey. For example, when a franchisor

does not support its brand and franchisees properly, the franchisee's obligations in the agreement become ineffective and can no longer be enforced..

THE NETHERLANDS

As of January 1, 2021, the Netherlands implemented the Dutch Franchise Act. This new law is aimed to promote the relationship and cooperation between franchisors and franchisees – in that both parties must behave in good nature towards one another.

The Act states the franchisee must disclose information about their financial position ahead of franchisee agreement. On the other hand, the franchisor must provide a draft of the franchise agreement containing applicable fees and financing, as well as ongoing consultations. The Act also introduces a 4-week cooling-off period from when the franchisee receives the full pre-agreement, until the day the franchise agreement is signed.

The Dutch Franchise Act also introduces a franchisee’s right to consent of changes in the agreed franchise formula, the right of goodwill compensation for the franchisee upon termination of the franchise agreement, and sets a limitation to exclusive purchasing provisions. This specific franchise law outlines the franchisors obligation to provide reasonable commercial assistance and technical support to the franchisee.

UNITED KINGDOM

The UK has no specific franchise laws – but does have general business regulations such as intellectual property, competition laws, real estate and contract laws which need to be investigated depending on the industry of operation. Due to the easy-going regulations in the UK market – this has traditionally been a good test market for new international franchises in Europe.

The UK officially left the

European Union on the 31st of December, 2020. This put an end to free trade between the UK and EU nations. As UK laws are now autonomous, all existing EU trademarks were automatically cloned into a UK right (or a comparable trademark). Pending trademarks that missed the Brexit date still have until the 30th of September, 2021, to file a UK application for the same trademark. All new franchises will have to apply via a full separate application.

Why you won’t always be successful as a franchisee

It can lead franchisees to be overly reliant on the franchisor's brand, failing to recognise that business success, regardless of the model, is also reliant on their individual effort and entrepreneurial grit. The Reality Check: Is Owning an Automotive Franchise as Exciting as It Seems for Car Guys?

Are you a car guy? I am. I grew up around cars and have owned close to a hundred myself. They are a fascination and for many they are part of our culture. They embody camaraderie and friendship over a common passion and have become an integral part of our American identity.

As Marc Anthony once said “If you do something you love, you’ll never work another day in your life.” So if you have a strong entrepreneurial spirit, why not look into buying an

automotive franchise, right? Not so fast…

Prior to being a consultant and helping my clients discover franchise opportunities, I owned a car dealership. I was young and I wanted to do something I enjoyed. But let me tell you, the car business is tough! It is certainly not what I thought it was going to be. We offered a variety of services. We had sales, finance, parts, and service. Our service department included routine maintenance, performance upgrades, lift kits, dent repair, and window tint among other things. We also built custom limousines and did high end restorations. Our facility was 25,000sqft of pretty much everything you could ever want or need for a vehicle. What I realized through that experience is that there are some parts of the automotive industry that were fun, exciting, and profitable while others were a 24/7 pain in the butt.

For example, there are a lot of automotive franchises that specialize in service. You have the general automotive repair franchises, transmission

franchises, etc. Here are some things you need to prepare yourself for if you are going to look at one of those. Firstly, that is not a clean business. You are dealing with dirty and grimy work. There are also hazardous chemicals that need to be disposed of properly. But the biggest challenge I faced was in finding good help. For these kinds of jobs, you need certified technicians. A good mechanic is extremely hard to find and even harder to keep. Even if you find a good one, they are still human so they are going to make mistakes, right. Well, what happens when they repair intake gaskets on a vehicle and didn’t see that nut that fell into the intake as they were putting it back together? You deliver the vehicle and then next thing you know the car is back with a misfire. Come to find out it damages a piston as it fell through the valve and now that $600 job that you made a couple hundred on now requires a $6000 motor. For those of you who have been in this industry, you would say

“yeah but that’s rare”. That’s true, but it happens. If you try to ask that technician to cover those losses then you might as well call that rollback and help them load up their toolbox yourself because they are gone. You’re going to have to eat it, or at least most of it.

Let’s say you own a transmission repair business. Have you ever gotten transmission fluid on anything? It is one of the nastiest things to deal with. It’s smelly and it’s almost impossible to get off anything that is not a smooth surface. The same labor issues still apply.

But there are a few automotive industries that are none of those things. Like window tint. This is a business that is clean, well lit, and well organized. Dust is the enemy of window film. If you are opening a franchise with your spouse, it’s a place that they will be comfortable. Second, it’s a small footprint. My dealership cost me a fortune in expenses before I ever made a dime. These businesses can be operated out of a very small commercial location which keeps your overhead low so you can sleep easier at night. Third, labor is much easier to find and keep. This is a trainable job. Most window tint franchises can train someone how to tint windows in a week or so. Then, once they have that skill, they can make better money than other types of jobs out there in a simple retail environment which makes the employees sticky. They now have a career where they can make good money, and you can too. Fourth, window film is universal.

You don’t need to carry inventory for numerous makes and models. That saves space and improves cash flow. Fifth, if your tinter messes up a window, you just peel the film off and redo it. NO BIG DEAL, film is cheap! Finally, let’s talk about margins. This is an industry with great profit margins. If you were looking across multiple industries for a simple retail type of business, then the more you look at these types of businesses, the more you will like the simplicity of them and the opportunity for a savvy car guy to be surrounded by the cars they love while having fun at the same time.

There are lots of great franchises in the automotive industry but there are some things you should consider when making that decision. If the idea of a simpler automotive franchise, like window tint for example,

interests you then take a look at what it has to offer in terms of the lifestyle you are looking for as well as your income requirements. Like any other industry in franchising there are good tint franchises as well as bad ones. Former Realtor is Rookie of the Year in Pillar to Post Home Inspectors® Growing System

At the ripe age of 27, Jesse Durham was so impressed by his dealings with Pillar To Post Home Inspectors during his career as a Realtor, he decided to become a franchise owner with the No. 1 home inspection company in North America in 2021. Durham was a Realtor in southeast Michigan before relocating to Texas. “I enjoyed every minute of my career in real estate but when we moved to Fort Worth, I decided to make a leap while still staying close to the real estate market. I wanted to put my skills to the test,” said Jesse. “Choosing Pillar To Post Home Inspectors was an easy choice for me. “Home sales were booming,” said Jesse. “Cash bids were coming in at sometimes 30 to 40% over asking price in many markets, which until then was unheard of”.

In a bustling, crazy real estate market, we kept our cool, stressing to everyone to NOT skip a home inspection, especially because it was such a competitive market. People who were convinced to skip some contingencies to “get that house” have lived to regret

The Thrill of Independence: A High Schooler's First Solo Drive

It was a bright, sunny morning, and excitement filled the air as I anxiously waited for the clock to strike 10:00 a.m. Today was the day I had been eagerly anticipating for months - the day I would finally obtain my driver's license. For me, this milestone represented newfound

independence, a ticket to exploration and adventure. As the clock struck the magical hour, my heart raced with anticipation. We went to the DMV early as I didn’t want to be late. The instructor got into the car and we drove around the cones, parallel parked and went through the test.

I passed! My parents were excited for me and I could barely contain my happiness. My dad said he remembered when he got his license like it was only yesterday. It really is a rite of passage.

We went home and I was ready to go on my first solo trip.

ensuring a clear view of my surroundings. Taking a deep breath, I pulled out of the driveway as a wave of exhilaration washed over me. The empty passenger seat beside him seemed to beckon me toward a world of possibilities. The engine purred, the sun was shining and I was off. I turned up the volume on the radio, relishing the freedom of selecting my favorite songs and singing along at the top of my lungs.

The familiar streets of my town took on a new hue as I explored them from the driver's seat. The once-familiar sights appeared different, somehow more vibrant and alive. I wanted to go to my friend's houses but first I wanted to drive all by myself. Alone. Free.

WITH EACH TURN, MY CONFIDENCE GREW.

The apprehension I had initially felt was replaced by a sense of mastery and control. I reveled in the smoothness and

precision of the car. We were in perfect harmony, united in our pursuit of the open road.

With the wind in my hair and the Miami sun in my face, I felt the thrill of independence coursing through my veins. I reflected on the countless rides I had anticipated during my years as a passenger and realized that this was just the beginning of a lifetime of adventures.

As the day turned to dusk, I reluctantly made my way back home. I could go see my friends another day. Today was for me.

The satisfaction of this first solo drive lingered, leaving behind memories that would last a long time. As I parked the car in the driveway, I stepped out of the vehicle and took one last look, knowing that this was the start of a new chapter in my life.

Many of you will fondly remember your first drive. I know I will for a long time. Maybe forever. When I think about how this feeling of independence unifies us and how I have now irrevocably become a consumer of all things automotive, what a great business opportunity there is in the car field. It is something that everyone needs.

Our mission is to gamify food education and empower kids to make their own healthier food choices. Via daily food dares, weekly food experiments, recipe contests, an Unusual Produce BINGO card, and plenty of camaraderie, Kids Food Fight delivers simple daily nutrition insights for families. When so many food options are available worldwide, we help children understand food choices and make one smarter choice at a time.

Kids Food Fight is a game played online over 28 days. Kids can earn 2 to 5 points each day by completing small tasks like eating a fruit or vegetable or playing ball outside for 20 minutes. Each week focuses on a different meal. There are 100 points possible. Kids who earn 86 or more points get a spot in our Hero Hall of Fame.

The real magic is revealed in the Daily Missions. Players follow along the comic story of two kids, Giro and Fendi, as they go through their days fending off junky Immobilizers like DoughNOT and Pizzilla.

Fortunately, our Healthy Heroes swoop in and help our kids make smarter food choices.

We run group games three times a year and privately. It is offered through private schools and afterschool programs. A few teachers have taken it into their classrooms. We aren’t operating in public schools at this time, but we would love to get there.

The cost is $149 to join one 28-day game, or $249 for 3 games in a year. We also offer scholarships. If any kid wants to play and they can't afford it, we will scholarship them in. We want every kid who wants to play Kids Food Fight to play!

How a Great Paul Davis Restoration Franchisee Built a Great Company: Leadership Starts at the Top

Russell Vent wears a lot of hats for Paul Davis Restoration of Greater Rochester, NY and it appears he wears them very well, because he’s brought a Midas touch to the location that is one of the top performers in the North American franchise chain.

“Pretty astonishing for a young man without a college education,” said David Savage, the owner of PD of Greater Rochester and Russell’s boss

and mentor. “Russell having achieved professional success in the trades without a college education, now looks for every opportunity to provide mentorship to members of his team and those around him who may be on a similar path.”

David Savage himself is quite the prized Paul Davis franchisee. He comes from an impressive career with General Motors as an engineer in the area of Hydrogen Fuel Cells, among other tasks and has owned the

Paul Davis business for eight years. He’s built his Greater Rochester location into one of the most successful in the Paul Davis system which consists of several hundred offices in North America. And he prides himself on building great team players, something he sees as key for this particular industry.

“You can interview a candidate and they look great on paper,” said Savage. “They say all the right things in the interview too. But until you

really see how they perform under stress; you have no idea what they are capable of.”

This is what happened with the 35-year-old Vent who joined the company in March 2017 as a project manager and was named general manager in February 2021.

Vent oversees the company’s seven divisions, which range from Fire Restoration to Asbestos Abatement, and is responsible for 12 project managers, 4 directors, 6 sales and office staff members and 24+ field employees.

It all translates into the success of the Rochester office – which is a full-service water, fire, content/textiles, mold, asbestos, and reconstruction restoration contractor –generating millions in profitable revenue annually with a history of 30 percent growth or more year over year. The office is on track to do $14 million this year. Its NPS (Net Promoter Score), a metric used in customer experience programs that is used to measure customer loyalty, increased from 42 to 82 during a three-year span.

“Throughout the years, Vent has operated at all levels of the company. He has functioned as technician, estimator, project manager, accountant, coach, and mentor,” said Savage. “As is common in this industry, Russell has sacrificed countless nights, holidays, and family

gatherings; when duty calls or the team needs him, he is there. Russell loves his work. He hopes to own a restoration company, and with likely expansion plans coming in the near future, that will be a reality soon.”

According to Restoration & Remediation Magazine, millennials such as Vent are not only the largest adult generation in the U.S., but they are also the largest generation in the labor force at more than 56 million, per figures from the Pew Research Center.

Vent has helped to drive the meteoric growth of Paul Davis through his dedication to employee training for improved technical skills and safety and focusing on customer satisfaction. He has also mentored four technicians who advanced into crew chief and then project management roles, who now produce sizable amounts of revenue in each of their roles. Vent is also an expert on asbestos abatement and hospital infection control practices for the entire Paul Davis network.

1. Congratulations on being awarded the "Bet on a Vet" grant! Can you share with us the inspiration behind your decision to open a business with the Franchise consulting company and Homefront Brands?

Even while in the Army, I have always had an entrepreneurial mindset. After being out almost six years and gaining valuable experiences in the civilian business sector, I wanted to create a business that allowed more control over our family's future. I knew it was time to start something that our

community has a need for. Most importantly, we want to be an example to our daughter by showing her what hard work and dedication can build.

2. How do you envision utilizing the $10k grant to support the establishment and growth of your new business?

The grant has allowed us to purchase this franchise and we are so grateful for the opportunity that comes with it. We plan to use the funds towards our marketing strategy and help get our new business brand front and center in our territory.

3. Could you provide some insights into the specific franchise services you plan to offer and the target market you intend to serve?

We will provide window

cleaning services, power washing, soft washing, gutter cleaning, and LeafGuard installation. The target market; any building with windows, just kidding. We will provide all of our services to residential and commercial buildings in our service area.

4. As a veteran, how do you believe your military experience and skills will contribute to your success in the franchise consulting industry?

After serving thirteen years in the military, the knowledge you gain is all encompassing. You learn about inventory, maintenance schedules, how to plan, leadership, and growing both professionally and personally. My favorite part, and a big factor that brought me to HomeFront

Brands, is that the values I learned while in the military align with HomeFront Brands core values.

5. Opening a business can be challenging. What strategies do you have in mind to overcome potential obstacles and ensure the long-term sustainability of your venture? I know this journey is just starting, it's new and exciting, and I'm learning as I go. We've already overcome multiple obstacles getting to this point. The business we're starting is in the service industry, so customer satisfaction will be key to the long-term sustainability of our company. An important aspect of our business model will be having control measures in place and follow ups with our clients.

6. How do you plan to leverage your connections within the veteran community to raise awareness about your franchise consulting services?

We have lived in our great community for 17 years and there's a large active duty and Veteran presence. We have close friends who are active duty as well as Veterans. Due to my excitement, I think they all know about our business venture, as I have shared my experiences with them. We plan to stay committed to our Veteran community by being active at local events that raise awareness on the issues Veterans are facing today. Service without Sales is how we plan to raise awareness about our business to the Veteran community.

7. In your opinion, what key advantages does franchising offer for aspiring entrepreneurs, particularly for veterans looking to start their own businesses?

The number one advantage is a road map to success. The Army has a road map for

promotions and various plans for Soldiers to be successful. HomeFront Brands has provided that road map, and we just have to mark each checkpoint off as we move forward.

8. Can you elaborate on the support and guidance provided by the Franchise consulting company to veterans who receive the "Bet on a Vet" grant? How will this assistance contribute to your business's growth?

FCC was great to work with and Joe was a wealth of knowledge. Joe made phone calls on our behalf, helped setup meetings, and advised us on the current growth in multiple business spaces. The advice we received allowed us to make a very informed decision. We received the "Bet on a Vet" grant and the money will definitely help our business, but to have the peace of mind that we made the right decision is priceless.

9. Are there any specific franchise brands or industries that you find particularly compelling and

intend to focus on within your consulting services? If so, what factors influenced your choice?

We signed with HomeFront Brands and have purchased a Window Hero Franchise. The factors that influenced us the most are the need for the services in our community, the values that HomeFront Brands has align with our own, and getting to meet the team and see the support offered made the decision easy.

10. Looking ahead, what are your long-term goals and aspirations for your business? How do you plan to expand and make a positive impact on the lives of other veterans in the future?

Our long-term goal is to expand into other territories and eventually add additional services to our current lineup. We plan to create an aggressive marketing campaign and continue building relationships within our community. One of our goals is to be a Veteran friendly business. We would really enjoy hiring Veterans and having a mentorship program in place to support them in reaching their future goals.

What's the Next BIG ACQUISITION for this Power Couple?

1. As a power couple in franchising, you both transitioned from successful corporate careers to entrepreneurship. What was the turning point in your lives that made you think outside the box and take the plunge into the world of franchising? So it was not sudden and it was not a particular point. It was a long 2 decade journey of pretty insignificant moments which when we look back now solved the puzzle of entrepreneurship for us.

Since our marriage in

2001, Ruchika and I had been driven by the desire to establish our own business. Over the years, we ventured into various industries, from a child care venture in 2002 to auto trading in 2003, an IT consulting business in 2010, and even a hotel/restaurant investment in Thailand in 2018. Unfortunately, these endeavors lacked the necessary vision and ultimately faced challenges.

But being open to opportunity even after all these failures finally opened

up the doors to Franchising in the Salon industry. Even that came with huge setbacks as 5 months into the business we were closed because of COVID. But since then slowly but surely we have recovered and learnt lessons and are still learning something new everyday.

We feel blessed to have been able to undertake this journey.

BTW we are not a power couple but rather a couple who has learned and grown together despite facing more downs than ups in the past 22 years. By sharing our story, we aim to inspire others to find strength in their relationships and persevere through life's obstacles.

2. Salon franchising was a successful venture for you, and now you have ventured into the AI space by acquiring the entire territory of Robot Labs. Can you walk us through the process of purchasing the Robot franchise and share the excitement and thrill you are experiencing as business leaders in the rapidly evolving AI industry. Ruchika had the honor of

being invited to a panel at UTD, where the topic of discussion was “Success in franchising”. It was during this event that we had the pleasure of meeting Elad, the founder of RobotLAB. Instantly, there was a mutual recognition of synergies between our respective strengths.

In the weeks that followed, we continued to meet and explore the possibilities that lay ahead. The potential of AI and Robotics for the betterment of humanity filled us with excitement and exhilaration. We are proud to be part of this incredible journey, standing alongside Elad and sharing in his visionary outlook.

Believing wholeheartedly in Elad's vision for Robotics, coupled with our ability to scale, we are confident that this partnership is a winning combination.

3. Maintaining consistency and high standards across multiple franchises while allowing each location to have its unique identity can be challenging. How do you approach this balance and ensure that the brand's standards are upheld while embracing local variations? That’s an awesome question. Every Franchisee starts the business with a vision to scale and it is imperative that standards be maintained as you do it. The key point to be noted is that the owner’s job should be to create a culture that binds everyone together. If the owner is doing operations then their reach is limited.

Delegate everything that can be delegated. Empower your senior management to make decisions. Keep them accountable and aligned with your vision but don't micromanage them.

We have achieved this by outsourcing everything that can be done remotely to our arm in India. We do all the BackOffice work there so our team on the ground can focus on Customer Experience and Employee engagement. In fact our Franchisor liked this idea so much that they encouraged us to offer these services to other Franchisees and today we are helping more than 500 locations across different industries. Again, I would like to reiterate, decouple yourself from operations as early as possible in your entrepreneurship journey. Small operational issues will tire you and scare you. Businesses are run with a happy and positive mind and not by focussing on issues.

4. Now Elad, I would like to ask you the next question, as a CEO of Robot Labs What were you looking for in a Franchise? Franchisee selection plays a crucial role in representing your brand effectively. How do you approach the process of selecting franchisees and building strong partnerships with individuals who align with your brand's values and vision?

Elad Inbar- Choosing the right franchisees is indeed a critical step in extending the RobotLAB brand.

We mainly focus on Personal and Brand Culture Fit, trainability, excitement about our products and about servicing customers.

For us at RobotLAB, choosing a franchisee is not just about their ability to pay the franchise fee. The best partnerships come from finding individuals who are passionate about our brand, share your business vision, and are capable of running a

successful operation. We put together processes to hear and implement feedback from franchisees, we invite them to join all our company meetings, and generally speaking, we see them as an integral part of RobotLAB. Their success is our success!

5. In any partnership, differences of opinion can arise. As a power couple, how have you managed to navigate disagreements and ensure harmony in both your personal and professional lives? Have you established a system or division of work to maintain a healthy balance?

As a couple, we often find ourselves having disagreements on various topics, and when it comes to business, it can be an additional source of tension. However, we recognize that disagreements can actually be healthy for our relationship

and partnership. It's not about avoiding them, but rather how we handle them that truly defines the strength of our bond. Like anything worthwhile in life, it takes practice and learning from failures.

Over a period of time, we have established a clear division of responsibilities. Ruchika oversees the Salon and Hospitality business, while Prashant takes care of the BackOffice and Robotics. Although there are overlaps between our areas of focus, we navigate through them as they arise, finding solutions that work for both of us.

One valuable lesson we have learned is the importance of keeping business discussions separate from our personal time. However, because we both are deeply passionate about our ventures, we don't mind occasionally talking about business even during

our date nights while sipping wine:) It's exciting for us to share our ideas and plans with each other, knowing that we both understand and support each other's passions.

What's even more fulfilling is seeing our boys show an interest in our businesses and contribute their own inputs. Even at such a young age, they actively engage in discussions, which we find inspiring and encouraging. Witnessing their curiosity and willingness to learn is a source of joy for us as parents.

6. Every entrepreneurial journey comes with obstacles and setbacks. Could you share any significant challenges you have faced as a power couple in franchising, and how did you overcome them?

Indeed, it is crucial to acknowledge that embarking on a new venture or taking a

different path will inevitably bring challenges. As entrepreneurs, we understand that uncertainty is part of the game, and our ability to handle it effectively is what sets us apart. We have certainly experienced our fair share of missteps and setbacks, just like any other business person. However, we approach these challenges with a mindset that they are normal and solvable.

One notable challenge that comes to mind is the COVID-19 shutdown. It was a scary time for businesses worldwide, and we knew we were not alone in facing this crisis. To navigate the situation, we focused on minimizing our cash outflow. We took advantage of government allowances and temporarily stopped paying our mortgage and credit cards. By being resourceful and strategic, we were able to come out of that situation.

Another recent challenge we encountered was when we took over 11 Salons in the

State of Tennessee. During the transition, approximately 70% of the existing staff decided to walk away. This unexpected development posed a significant problem as we had already invested a considerable amount of money based on certain projections and valuations.The numbers we based our valuation on did not hold true.

To address this challenge, we immediately started reaching out to each individual who had left and initiated negotiations. Over the course of the next

few days, we engaged with them individually, taking into account their emotions, concerns, and desires for attention. It was a painstaking, tedious, and mentally exhausting process. However, we understood that rebuilding the team was crucial to the success of the salons. Through persistent efforts, we were able to convince almost 90% of the departed staff to return. While it drained our energy, we knew it was a necessary step that had to be taken.

In facing these challenges, we hold onto core principles that guide us. We believe that setbacks are temporary, everything is fixable, and everything is negotiable at every stage of the journey.

7. Supporting and inspiring each other's professional growth is vital for a power couple's success. How do you motivate and encourage one another to reach new heights in your respective careers?

After spending 22 years together, we have developed a deep understanding of each other's strengths and weaknesses. Ruchika's attention to detail is remarkable, while Prashant

has a knack for spotting new opportunities. Ruchika's negotiation skills are excellent, and Prashant possesses the ability to remain calm in the face of adversity.

We support and uplift each other based on our individual strengths, and we help one another in areas where we may have weaknesses. Over time, we have reached a stage where our collaboration happens organically, without the need for extensive planning. We operate like a well-oiled machine, smoothly navigating through challenges and seizing growth opportunities.

However, we are mindful that real growth in relationships, as well as our understanding of business, occurs when faced with difficult times. It is during these challenging moments that the true nature of our partnership is revealed. When everything is going well, it's easy for shortcomings or conflicts to remain hidden. Therefore, we constantly remind each other of the importance of staying aware and attentive even when things are good.

8. What advice would you give to aspiring entrepreneurs looking to enter the franchise industry and expand their portfolio? What key lessons have you learned along your journey that you believe would be valuable for others embarking on a similar path? Entering the world of entrepreneurship or franchising is indeed a roller coaster ride, unlike the predictable and structured

nature of a 9-5 job. It's important to embrace this unpredictability and understand that making mistakes is part of the journey. The key is to keep moving forward and making decisions.

Many aspiring entrepreneurs or franchisees fall into the trap of constantly finding excuses to avoid making decisions. This "finding an excuse to not take a decision" syndrome hinders progress and leads to a false sense of being on the right path. In reality, it only delays progress and doesn't benefit anyone, including themselves.

The franchise industry is a wonderful model, often underestimated, especially in industries beyond food. To embark on this path, it's important to find an industry that genuinely excites you. Once you identify a compelling industry,

analyze the franchise model without getting caught up in overanalysis. Determine the amount you can invest and then take the plunge.

The truth is, there is nothing more to it than that. Everything else beyond these essential steps is just part of the aforementioned syndrome. By acknowledging this, you can avoid getting caught in analysis paralysis and take the necessary actions to pursue your entrepreneurial dream.

TURBO TINT: Accelerating into the Window Tinting Industry

Moran Family of Brands, a respected name in the aftermarket auto repair, maintenance, and accessories industry, knows the benefits of a successful model for business expansion. As an Alta Mere franchisee, Greg Goodman sold window tinting and a variety of other car accessories, such as backup cameras and alarms.

But, as those accessories became standard in today’s car models, Goodman looked to modernize his business. He conceptualized Turbo Tint, a streamlined automotive window tinting concept that prioritized speed and convenience, in 2019. Customers select a window tint package and schedule their appointment online. When they arrive at the store, they choose their shade of window film, with the installation taking an hour or less to complete.

UNPARALLELED GROWTH AND EXPANSION

Goodman shared his ideas with Moran Family of Brands,

and they collaborated together to develop the concept while beta testing it at Goodman’s Oklahoma City store. The beta test was more successful than anticipated which led to the development of the full Turbo Tint model. The test occurred during the pandemic and the store experienced a nearly 30% growth in sales year over year.

It offers architectural window tinting solutions for residential and commercial applications, as well as automotive paint protection film.
