YACHT SCENE GIBRALTAR YACHT SCENE GIBRALTAR was launched in 1983 and is published annually in December for the following year. The Rock is a pivotal point for yachtsmen either arriving or departing from Europe, the Americas or Africa. It serves two seas, the Mediterranean and the Atlantic, as well as the adjacent popular coastlines of the Algarve and the Costa del Sol. Consequently, the response from yachtsmen, tourists and advertisers has been such as to warrant continuous enhancement and extension of the publication. The A5 size sailors’ guide has full colour gloss covers and a wire binding. Its contents are colour coded into sections to facilitate ease of use and access to information. These comprise white pages containing editorial, news, views and articles; blue pages of local regulations for Gibraltar, Spain, Portugal and Morocco, tide tables, tidal atlas and radio weather forecast details; yellow pages indicating marine services and supplies; and pink pages comprising a complete local leisure guide. It is hoped that regular clients will be pleased with the continually improved layout and the reasonable advertising rates and that new ones will appreciate its use as an advertising medium. There is a Yacht Scene website which includes an internet index of marine sales and services at a small annual fee. Advertisements can also be displayed by arrangement. This new service should allow for advance sales to yachtsmen including Gibraltar in their itinerary. Copies of Yacht Scene are sent each year to the various International Boat Shows and are on sale locally at bookshops and chandleries in Gibraltar as well as selected outlets in Spain, Portugal, UK and the United States at £5.00 or by mail order at £8.00 to include airmail postage and packing from Yacht Scene. PUBLISHER’S TERMS & CONDITIONS FOR THE ACCEPTANCE OF AN ADVERTISEMENT 1. The placing of an order for the insertion of an advertisement shall amount to an acceptance of these terms and conditions and any terms and conditions stipulated on an agency’s order form or else where by an advertiser shall be void in so far as they are in conflict with them. 2. The Publisher shall have at its absolute discretion the right to refuse, omit, suspend or change the position of any advertisement accepted for publication. 3. The Publisher shall have the right to make any alterations considered necessary or desirable in any advertisement, or to require any block or copy to be amended to meet its approval. 4. The Publisher will not be responsible for any loss or damage consequential or otherwise, occasioned by error in the insertion of, omission to insert or late publication of any advertisement or for any damage or loss of any blocks, drawings or other material supplied for the purpose of an advertisement. 5. The Publisher shall not be bound by stop orders, cancellations or transfer of advertisements booked for insertion received less than 8 weeks before the publication date. 6. Advertisements submitted for insertion shall comply with all legal requirements, and in particular (but without limiting the generality of the foregoing) shall not contain any defamatory, fraudulent misleading or false statement, infringe the copyright or other right of any third party or unfairly prejudice the legitimate interests of third parties by implication or otherwise. In the event of any breach of the foregoing it is accepted that the advertiser (which expression shall include any agent involved in placing the advertisement) shall keep the Publisher fully and effectively indemnified against all costs claims damages or other liability incurred by the Publisher as a result thereof. 7. Payment of accounts: a) Space shall be paid for at the time of placing the order; b) Art work shall be paid for on acceptance of proof. 8. The existence of a query on any individual item in an account shall not affect the due date of payment. 9. Notwithstanding anything in these conditions providing to the contrary neither the Publisher nor the Advertiser shall be liable to each other for any loss or damage consequential or otherwise caused by or arising out of any legislation enacted by the House of Assembly or Act of Parliament, Act of State, strike by employees, lock-out, trade dispute, enemy action, rioting, civil commotion, fire, force majeure, act of God or other similar contingency beyond the control of either of them. 10. Gibraltar law shall govern any agreement entered into with the Publisher incorporating these terms and conditions.
