come to an agreement. Though both sides are at fault for this, right now I blame the Republicans who don’t want to agree to a bigger stimulus check. (I consider myself Republican, but I never swore allegiance to anyone.) If in a time of crisis our politicians cannot unite to help the American people, then they certainly cannot do so in ordinary times.

I would love to see compromise alive in Washington, but wherever I look, it seems dead. As they say, if pro is the opposite of con, what’s the opposite of progress? Congress.

Riki AVROHOM LEVI RESPONDS: Thank you for your letter. Politics will always be partisan, but the COVID-19 relief bill and other recent developments in Congress give real hope to the idea that effective bipartisan governing is still possible. The COVID-19 relief bill was ultimately signed into law due to bipartisan pressure to get the deal done. In fact, the legislation was a classic example of bipartisan compromise. No side got everything they wanted, but everybody got something. Republicans compromised on liability protections for businesses, and Democrats compromised on the amount of relief. Furthermore, the legislation did not originate from party leadership but rather from bipartisan caucuses in the House and Senate. The 50-member Problem Solvers Caucus under the direction of Tom Reed (R-NY) and Josh Gottheimer (D-NJ) led the House’s push, while the bipartisan 908 Coalition took the lead in the Senate. The recent veto override of the National Defense Authorization Act (NDAA) was also passed with strong bipartisan support. The incoming Congress will have slim majority margins in both the House and the Senate. This will give Congressional groups committed to bipartisanship more clout in passing legislation. Congressional leaders like Senator Bill Cassidy (R-LA) and Joe Manchin (D-WV), who are committed to governing effectively, have expressed their belief that recent developments and the composition of the incoming Congress will provide the right conditions for a practical, bipartisan approach to addressing the pressing issues facing our country.

A PLACE THAT SPARKLES The mitzvah of mora mikdash means that not only must I personally act in a refined and befitting manner in shul, it also means that I must do my part to ensure that the aura in the shul is one of dignity and refinement. It is my responsibility to avoid doing anything that might damage the regal atmosphere, as well as being proactive to ensure that the atmosphere is maintained. One element within this mitzvah is that of ensuring cleanliness. All too often, people assume this is taken care of by a janitor or somebody else chipping in with a helping hand. But maintaining the pristine and beautiful appearance of our shuls is something that is incumbent upon each one of us.

Let’s shine a spotlight on some typical issues that arise: COFFEE CUPS AND EMPTY TISSUE BOXES The first point here is something that should go without saying, yet needs to be said: If you brought a coffee into the beis knesses, throw out the cup when you’re done. The same goes for any tissues, receipts, candy wrappers or other trash you left on the tables. While this is certainly nothing less than basic decency, in a beis knesses it goes well beyond that. We are commanded to maintain an environment of awed reverence; you wouldn’t leave wrappers in the Oval Office. At the very least, we are charged with treating the beis knesses on par with standards we have come to expect in our homes. If you wouldn’t look favorably on someone doing something in your dining room, you cannot do that in a beis knesses.[1] Let’s move on to another scenario. The person next to you heads for the door, leaving his almost-empty coffee cup behind. A reproachful thought flits through your mind as you watch him go. Do you leave it at that? The instinctive reaction might be that it’s his problem, not yours.

Ultimately, this is not the case. Granted, he bears causational responsibility, but at the moment, the reality remains that the offending item is in fact there, the item is a cause of some level of disrespect for the beis knesses, and it’s your responsibility to maintain and ensure a properly dignified atmosphere in your shul. Think of a parent telling his children to clean up a playroom full of toys. Cries of “But I didn’t make the mess!” ring out. That may be true, but right now the kids’ job is to help make their home look up to par. So go ahead and throw out that cup. It’s the same you would do if a guest left his coffee cup on your dining room table. The only difference is that in shul, you have the zechus of fulfilling a tremendous mitzvah of maintaining Hakadosh Baruch Hu’s home.

SCRUBBED TO SHINE Ensuring the proper aura in the shul is not merely a matter of removing garbage. Even if the floor is debris-free,

the Shulchan Aruch mandates that we take it further, having the floor washed regularly. The room should not only be clean; it has to shine.[2] NO TRACKING In a halacha that finds much relevance at this time of the year, the Shulchan Aruch tells us[3] that footwear is to be cleaned off from mud, snow or any other filth before one enters a beis knesses. While it is true that one should ensure that all of one’s clothing is clean and stain-free before entering (as described in a previous installment), there is a specific insistence on clean shoes to avoid tracking mud all over the beis knesses.

other, and the pile on your table grows steadily. Suddenly, you realize the late hour and the need to be home. Closing your seforim, you rush home... leaving a small mountain of sifrei kodesh on the table.

Many seforim speak of such conduct as wrongdoing. Aside from causing a significant load on others, doing so can cause a serious loss of time for one searching for a particular sefer — time that could have been spent learning.

Rather than focus on the seforim themselves, though, let’s focus on the image such piles convey.

It is true that a shul or beis midrash is not a formal library, and there is often some degree of tolerance. No matter the particular shul, however, there is always a point where growing piles transmit a message of casual disregard, a real show of a lack of concern for such a majestic atmosphere. Treat your seforim, and your beis knesses, with the proper respect, and return them to their proper shelf.

EXPECTORATION This is not the most palatable topic, but something to be mentioned nonetheless. The Shulchan Aruch writes that one is permitted to spit on the floor within a beis knesses, provided one is not in middle of reciting Shemoneh Esrei and is not within proximity to another individual who will be repulsed. This ruling, however, hinges on a reality where people would do this in their homes as well. Fast forward to our modern era, where societal norms certainly don’t allow for this, and halacha dictates that also in shuls it is disrespectful and forbidden.

Furthermore, it is worth noting that any possibility of allowance is limited to a dirt or similarly absorbent floor where the saliva can be rubbed under one’s shoe into oblivion. With tile or vinyl flooring, this is obviously not the case.

This halacha is worth mentioning insofar as there are a number of

sects who have this practice during Aleinu when saying the words sheheim mishtachavim l’hevel v’rik, to demonstrate disgust with corrupt beliefs.[4] Those wishing to do so should spit into a tissue or such in a manner similar to what they would do at home — a manner that does not sully the beis knesses.

GARBAGE CANS Although not dealt with specifically by the poskim, in keeping with the metric we were provided by Chazal, it would stand to reason that just as people generally refrain from keeping garbage cans in their dining rooms, so too garbage cans should be placed outside the main room of the beis knesses. In many shuls, however, garbage cans are in fact placed within the shul. Presumably, this is to avoid the far more unpleasant alternative of litter being left all over the tables. Even so, it would certainly stand to reason that care should be taken to do so in as refined a manner as possible, such as using smaller, more tasteful receptacles rather than industrial-style ones. Furthermore, an overflowing abundance of tissues, cups and debris spilling over onto the floor waiting for the elusive “someone” to do something about it is certainly a degradation of the beis knesses and should be tended to immediately.

Hakadosh Baruch Hu is coming to spend time with us. This is the space we’re preparing for Him. Let’s do it right and make the room truly dignified for His presence.

Potential Relocation Plans Looming for Monsey Post Office Monsey area residents may have been surprised last week to receive a postcard from the United States Postal Service informing them that the Monsey Post Office may be moving to a new facility sometime over the next twelve months.

“The current location is larger than is required to conduct our ongoing operations,” read the missive. “The USPS proposes moving to a building of approximately 4,000 square feet with 30+ parking spaces within the city limits. The proposed facility will maintain the same level of service.”

Because of COVID-19 there will be no public hearing held on the matter, and the USPS is encouraging residents instead to mail their comments within the next month to the USPS at P.O. Box 27497, Greensboro, North Carolina 27498-1103. All letters should be marked “Attn: Monsey, NY — Main Office Relocation.”

According to The New York Times, the first post office in Monsey was established in 1846, with the USPS putting the timeline for the first local postal route established on April 15, 1904. Local mail processing was shifted from the Melnick Drive facility to White Plains several years ago, and both elected officials and the public are being asked for their input on any potential move, reported The Journal News.

USPS spokesperson George Flood said that discussions about finding a facility better suited to meet postal service needs have just begun, with a second comment period to be opened should the process move ahead to more definitive

NY’s Vaccine Rollout Criticized as State Shortens Quarantines The long-awaited COVID-19 vaccines have finally arrived, but the rollout in New York has been anything but swift, leaving Governor Andrew Cuomo facing harsh criticism.

New York Post reported that as of last Thursday, only a third of New York’s available vaccines had been distributed. Rensselaer County Executive Steve McLaughlin criticized Cuomo for spending too much time micromanaging details, cutting local government out of the process.

“It’s chaos out there,” said McLaughlin. “The state has no idea what it’s doing.”

By Friday, Larry Schwartz, a former Cuomo aide and director of the state’s vaccine program, put the number of available vaccines administered at approximately 42%, with 266,000 vaccines administered — a rate of 723 vaccinations per 100,000 residents. By contrast, Florida residents are receiving their vaccines at a rate of 823 per 100,000 residents, and Israel has already vaccinated one million people, 10% of its total population.

Staten Island City Councilman Joe Borelli suggested that Cuomo’s PowerPoint presentations given at the governor’s press conferences may be painting an overly optimistic picture of the state’s COVID-19 realities.

“New York is overemphasizing the safety protocols rather than the need to get vaccines out the door and into people’s arms,” said Borelli.

While Schwartz blamed the federal government’s vaccine allocations for New York’s slow distribution, Congresswoman Elise Stefanik described Cuomo’s vaccination track record as an embarrassment.

She slammed the governor for focusing on plans to allow fans to attend an upcoming Buffalo Bills playoff game, instead of prioritizing the state’s vaccine rollout.

Phase two of the vaccine distribution is set to include teachers, school staff, very high-risk individuals and essential front-line workers, including pharmacists, grocery store workers and transit employees. The next phase of vaccine distribution would include anyone over 65 and high-risk individuals under 65, with other essential workers and healthy adults to be vaccinated in phases four and five respectively.

Cuomo trimmed the quarantine period last week for asymptomatic individuals who were exposed to COVID-19 by four days, with no further testing requirement, bringing state policies in line with the latest recommendations from the Centers for Disease Control.

Under the new guidelines, anyone exposed to COVID-19 would still be required to isolate and monitor themselves for symptoms. But once they hit the ten-day mark and remain symptom-free, they would be free from quarantine, though they would be required to self-monitor for symptoms for an additional four days.

Cuomo’s December 29th announcement came nearly four weeks after the CDC reduced its quarantine requirements. It also makes no mention of the agency’s allowance of a possible seven-day quarantine for those who test negative for COVID-19 within the last two days of their isolation period and have no virus symptoms.

“We continue to refine our guidance to prevent transmission and protect Americans,” said CDC coronavirus incident manager Henry Walke. “Reducing the length of quarantine may make it easier for people to follow critical public health action by reducing the economic hardship associated with a longer period, especially if they cannot work during that time.”

Court to Decide on Possible Trial in Chanukah Terror Attack The man who carried out a deadly Chanukah machete attack in the home of Rabbi Chaim Leibish Rottenberg will be facing a hearing later this month to determine if he may potentially face charges in a court of law.

The Journal News reported that a recent psychiatric evaluation found 38-yearold Grafton Thomas mentally unfit to stand trial, despite having been hospitalized in Missouri for months with schizophrenia. Federal prosecutors wrote in a recent court filing that there is reason to believe that Thomas “can be restored to competency,” and his handwritten journals and online activity are proof of his strong anti-Semitic leanings.

But defense attorneys have long claimed that Thomas suffers from mental illness and should not be tried for his actions, petitioning the court to place him in a prison hospital where he could receive care until he is no longer deemed a danger. Defense attorney Michael Sussman said that if Thomas was to be committed to an institution, it would be for a period of “at least several years.”

The upcoming hearing could result in federal hate crime charges being dropped and could also affect state charges against Thomas, including one for attempted murder.

The state legislature passed the Josef Neumann Domestic Terrorism Act last April, equating hate crimes with domestic terrorism, and in a statement released on December 28, Governor Andrew Cuomo remembered the 72-yearold Monsey resident who died as a result of injuries sustained in the attack.

“One year ago today, a hate-fueled attack on the Jewish community in Monsey shook us all to our core and led to the tragic death of Josef Neumann, may his memory be a blessing,” said Cuomo. “Here in New York, we find strength in our differences, and know that an attack on one of us is an attack on us all. An act of such violent hatred only strengthens our resolve and brings the family of New York closer together.”

Arik and Daniel are playing Kapla here next to me, Malka is trying to knock it down, and Kreindy is sleeping, and that’s it. Oh, and Yisrael Meir is not back from cheder yet, of course.”

“And who was right? I’m curious. Are there deer in the Galilee or not?”

“What else do you want me to know? I don’t even know if there’s enough laundry detergent in the house, and you’re asking me about deer?”

Sarah chuckled. “Would you like to come to us for Shabbos?”

“With Kreindy? I don’t like traveling with such a small baby in this cold.”

“But how will you be able to cook this way?”

“Oh, the kids help me. You have to see the dips that Shulamis can prepare… I’ll put up a challah dough and fish tonight, Aryeh will make the cholent, and we’ll manage just fine.”

“I want to send you something,” Sarah said, reaching for the yeast cake that had gone into the oven straight as a ruler and emerged looking

“When, exactly? When you get home from Haifa at nine p.m.? Or maybe on Wednesday, when you go to the clinic in Bnei Brak and come back after midnight, collapsing from exhaustion?” Bassi suppressed her own yawn.

“You can laugh, but I can even bake then.”

“So maybe I’ll ask Aryeh to come over to you on Friday, if he has time, and take a few of the kids with him.

They’ll have an outing, and I’ll be able to sweep out this caravan and maybe even have a chance to mop the floor.”

“Great idea. Your kids will enjoy Elazar’s boys, and I’ll finally be able to send you the gift I bought for Kreindele. But tell me, Bassi, isn’t it very cold out there for you?”

“Are you kidding me? You have to come see how warm and dry it is here!” Her sister laughed as she placed the baby over her shoulder. “The heat is so strong, it’s sometimes too much.

Do you know what Kreindy’s wearing right now? The light-blue footie that you bought for Baruch when he was born. And that was in Sivan, just to remind you.”

“All right, tell her that she should wait patiently until the bag comes from her old aunt. There’s the pinkest footie ever in there.” ***** Little Kreindy howled all evening, and by the time she calmed down, Bassi’s arms ached. She sat down at the table and drank the cup of tea she’d made for herself, eyeing the roll of patterned wallpaper that was resting on the fridge for a week already. She’d promised herself that she’d put it up, and if she wouldn’t fulfill these kinds of promises, then she wouldn’t be trustworthy in her own eyes.

“Now you have no excuse,” Bassi told herself in a low voice. “Everyone’s sleeping. You can go back to being energetic and productive, and start working on the hallway.” She carefully moved Daniel over and stood up. From the doorway to the hallway, she saw the

row of cars Daniel had lined up earlier, before he’d gone to sleep. She’d have to move them if she wanted to put down a stool so she could work on the upper half of the wall. Where was the stool, anyway?

She abandoned her tea and moved toward the roll. But no. She did not have the energy to glue wallpaper right now… And she had even less energy to wash dishes. She needed something else to do, something that would refresh her, and help her air out…Where was that box she hadn’t managed to unpack since they’d moved?

Bassi rummaged around inside until she pulled out her old origami booklet. She took three colorful pages out of the envelope stapled into the back. The children didn’t have access to this paper; she let them use it only for special occasions.

Slowly, she crafted a tall vase, and then she added three white carnations, all of different heights. The fourth flower, the lowest of them all, fell out of her hand when she nodded off.

“Bassi?”

She didn’t hear Aryeh.

He stood in place quietly, and after a few seconds, he went into the kitchen.

He placed a brown paper bag on the counter, cleared the counter from the remnants of the children’s and Bassi’s supper, and looked for the kettle to boil up some water. The base was in its place, plugged in. But where was the actual kettle? Oh, there it was, behind the bread on the table. Yisrael Meir must have made a drink for himself when he came home from cheder.

Aryeh left the kitchen and quietly tiptoed to the boys’ room. His oldest lay there quietly, eyes closed. Aryeh straightened his blanket and sat down on the edge of the bed, gazing at his son. They hardly saw one another during the week since they’d moved to this new town. In the morning they traveled together to Tzefas for a vasikin Shacharis, and then they parted ways.

He continued on to kollel, while his son went to cheder for a long day, until seven in the evening. When Aryeh would return home after night seder, Yisrael Meir would already be sleeping, recharging for the next day. Aryeh wished they could schmooze a little in the morning, on their ride to Tzefas, but Yisrael Meir usually dozed off.

Aryeh smiled when he saw the tiny pastry almost swallowed up by the huge plate. A minute later, his own meal was ready. Bassi disappeared for a moment to the dining room and returned with her paper vase. With a flourish, she placed it in the middle of the table and sat down.

“I was so exhausted before, I just fell asleep,” she told him. “I had actually planned to finally start with the wallpaper, but I just couldn’t. Maybe I’ll do it soon, when we finish eating.”

“Now? At ten-thirty at night?”

“Why not?”

“Um… when will you sleep?”

“When I was a baby I slept a ton, my mother says. I think I slept enough for my whole life.”

“Too bad that Kreindy’s not learning much from your habits as a baby.

But what can we do if the example you’re setting for her these days is not exactly the greatest?”

“Maybe she’s setting an example for me?” Bassi smiled as she sliced her pastry into miniscule pieces. “Everyone is so worried about my sleeping enough. Sarah’s also worried about

Osher Ariella would say that I’ve settled into a routine. I’m working, learning, eating and sleeping. I think you could say that I’ve gotten used to this place, and that it’s gotten used to me. I’ve also developed a few habits, like giving in to Shlomo about the light in the room.

It’s a bit annoying that he takes it for granted and doesn’t say thank you, but I’ve already survived more serious things than a lack of appreciation.

veloped. Every night I lie in bed for a few minutes, and when I think Shlomo is sleeping, I get up and go to the window. Reb Elazar seems to have a nightly “custom” of his own — walking on the beach — and I like to watch him. I’m not always sure that the one I think is him is actually him, but all kinds of figures pass there, and there’s always someone who I can tell is him.

Tonight he was walking so far away that I decided to go down myself to see whether it was actually him or not.

I dressed quietly, in the dark, and went downstairs. I hoped Shlomo wouldn’t wake up and worry about me — though I doubted he’d make the effort to check if I was in bed or not, even if he did get up. It was cold on the beach, and I was sorry that I hadn’t taken my coat. The sand was a bit moist, because it had been very windy earlier, and that pushed the waves onto the beach. I walked calmly, looking at the forms the bottom of my shoes made in the sand. If Shlomo would want to follow me, he’d have no problem doing so.

“I thought that was you, over there,” I said, confused, as I pointed with my chin to the old pier.

“Did you come to look for me? To talk to me?” He looked at my trembling shoulders.

“Yes. No,” I said. “I just wanted to see if it was really you or not.”

“It’s really me. You can go back to sleep now.” His mouth was serious, but there was a smile in his voice.

“I’d rather be here a bit.”

“Here?”

“Yes, it’s boring in my room.”

He opened his mouth, closed it, and then opened it again.

“Fine,” he said, and took off his jacket. “Just put this on in the meantime; you might catch a cold.”

“Do you come to the beach every night?”

“Almost every night,” he replied, as he walked on. I walked next to him.

“Why?” He stopped and looked at the sea. “Look at how beautiful it is,” he said. “When I was a little boy, I fell asleep with this scenery in the background. Lots of my childhood memories are from here. My personality developed in front of these waves and the sea.”

“Hey, one minute!” I said suddenly, like an old fluorescent light that turns on only a few seconds after hitting the switch.

“This was your house when you were a boy, right?”

“Actually, no.” Rabbi Reiness smiled. “We lived further into the city, in the new section.”

“So what do you mean by those lofty sentences about your personality that…” I didn’t remember exactly what he’d said, and the truth is, I was afraid it might be chutzpah to speak to

“And besides, why is speaking about a personality considered ‘lofty’? I don’t think it is. And it certainly doesn’t have to be philosophical. To speak about your personality, and about what you aspire to be, is just like talking about what you want to eat for breakfast or supper.”

“My personality is totally satisfied,” I said, very seriously.

“You didn’t understand the mashal.”

“I understood, Rebbi. I meant that my personality is so satisfied from all this talking that it doesn’t need breakfast or supper for at least three years, I think.”

He was quiet.

“Was I being chutzpah’dig?” I asked, after we continued walking for a few

long, silent moments. I closely studied the imprint of Reb Elazar’s shoes.

“Not at all,” he replied. “I’m just wondering why you chose to say three years.

Maybe thirty? Maybe seventeen? Why three?”

“No special reason,” I said. I sensed my voice getting whiny. “Maybe because three years have passed since my bar mitzvah, and everyone expected that I’d be all grown up by now. But with me, things don’t exactly go as expected.”

He remained quiet, just walking alongside me in the stillness of the night, as the imprints of our soles continued making tracks in the sand.

GOP Thrown Into Turmoil THE PULSE: A group of eleven Republican senators an-

nounced that they would challenge the Electoral College results when presented to Congress on January 6. Senator Josh Hawley (R-MO) was the first senator to announce that he would defy Senate Republican leadership and join with congressional Republicans to challenge the results. Shortly after, a group led by Senator Ted Cruz (R-TX) announced that they would follow suit. The president called on his supporters to come out and rally for his cause on January 6 in Washington, D.C. In a message to his supporters, he said, “Big protest in D.C. on January 6th. Be there, will be wild!”

THE CHALLENGE: In a letter detailing the purpose of

the challenge, the Republican senators wrote that many Americans believe that “the election was rigged.” They point to the election of 1877 when Congress set up an electoral commission to investigate potential misdoing as precedent. The eleven senators are calling on Congress to do the same before certifying this year’s results from key swing states. In a joint statement, the group said, “A fair and credible audit — conducted expeditiously and completed well before January 20 — would dramatically improve Americans’ faith in our electoral process and would significantly enhance the legitimacy of whoever becomes our next president. We owe that to the People.” The challenge to the certification has strong support among members of the Republican caucus in the House. A spokesman for Vice President Mike Pence said that “the vice president welcomes the efforts of members of the House and Senate.”

THE COUNTER ARGUMENT: Those opposing the efforts point out that each disputed state has held recounts, investigated allegations of fraud, and verified their results. Additionally, Attorney General Barr confirmed that “we have not seen fraud on a scale that could have effected a different outcome in the election.” Furthermore, courts have resoundingly rejected the Trump administration’s allegations of fraud. They argue that while it is true that people have doubts regarding the election, the logic is circular because the more these allegations are spread, the more people believe them. Senator Ben Sasse (R-NE) said, “Let’s be clear what is happening here: We have a bunch of ambitious politicians who think there’s a quick way to tap into the president’s populist base without doing any real, long-term damage.” He accused his fellow Republicans of instigating “a dangerous ploy” and of “playing with fire.” Former Republican Speaker of the House and Vice Presidential Candidate Paul Ryan said, “Efforts to reject the Electoral College votes and sow doubt about Joe Biden’s victory strike at the foundation of our republic. It is difficult to conceive of a more anti-democratic and anti-conservative act than a federal intervention to overturn the results of state-certified elections and disenfranchise millions of Americans.” Republican Congressman Will Hurd echoed these sentiments when he said, “The 2020 election has been the most scrutinized election in our history. The voices of countless Americans have been counted, and there is a clear winner. It’s not a conservative principle to deny a single American his or her voice. That is not what the GOP stands for.”

THE IMPACT: The Republican challenge has virtually

no chance of success. Democrats control the House, and numerous Republican Senators are on record opposing efforts to challenge results that have been certified by the states. Republican Senator Pat Toomey (R-PA) said, “I voted for President Trump and endorsed him for reelection. But, on Wednesday, I intend to vigorously defend our form of government by opposing this effort to disenfranchise millions of voters in my state and others.” A bipartisan group of senators, including Lisa Murkowski (R-AK), Bill Cassidy (R-LA), Mitt Romney (R-UT) and Susan Collins (R-ME), announced that they intend to certify the results. However, the issue has exposed a rift and divide in the GOP. The split will affect the GOP’s future direction, and will pit Republicans seeking to appeal to the populist base of Trump supporters against mainstream conservative Republicans.

There is also fear that the heated rhetoric surrounding the election results may lead to violence. Right-wing lawyer Lin Wood recently called for VP Mike Pence to “face execution by firing squad” due to his alleged inadequate backing of Trump’s election fraud claims. Another rightwing lawyer Joseph diGenova called for former Homeland Security official Chris Krebs (who called the 2020 election “the most secure ever”) to be “taken out at dawn and shot.” Former National Security Adviser Michael Flynn has called for the implementation of martial law. Many

fear that the streets of Washington, D.C., may be consumed by violence between extreme left-wing Antifa-inspired groups and right-wing groups such as Proud Boys and other affiliated militias. D.C. Mayor Muriel Bowser advised D.C. residents to steer clear of the downtown area on Tuesday and Wednesday to avoid possible confrontation with protesters.

Georgia Completes Signature Match Audit THE PULSE: The Georgia Secretary of State’s office announced that they had completed a signature audit of 15,000 votes. Ten mail-in ballots had signatures that did not have an exact match, but eight of the voters confirmed their signatures when contacted by the Georgia Bureau of Investigations. One voter mistakenly signed his name on the front of the envelope instead of the back, and one woman signed her husband’s signature for him on his ballot. This audit comes on the heels of a full hand recount of Georgia’s ballots that also found no irregularities in the vote count. Recently, audio surfaced of President Trump in a phone conversation with Georgia Secretary of State Brad Raffensperger, in which Trump is heard complaining about the election results and asking Raffensperger “to find 11,780 votes” to give him a win in Georgia.

THE IMPACT: Raffensperger has made tremendous ef-

forts to verify the election results as accurate and correct.

He has overseen a machine recount, a hand recount, a signature audit, and has investigated multiple fraud allegations. However, this has not stopped Raffensperger from being on the receiving end of threats to himself and his family. Recently allegations were spread that Raffensperger was doing the Chinese government’s work because his brother Ron Raffensperger works for Huawei, a Chinese-owned company. However, while Raffensperger has three sisters and a brother, he has no brother named Ron, and his brother does not work for Huawei.

Pelosi Elected Speaker of House for Fourth Term THE PULSE: On Sunday afternoon, Nancy Pelosi nar-

rowly won reelection as speaker of the house for a second consecutive term and fourth overall. Pelosi received 216 votes to 209 for Republican Kevin McCarthy. The vote was close as Republicans picked up House seats in the recent election, and some Democratic members of the House did not vote for Pelosi. Jared Golden (D-ME) voted for Tammy Duckworth, and Conner Lamb (D-PA) voted for Hakeem Jeffries. Abigail Spanberger (D-VA), Elissa Slotkin (D-MI) and Mikie Sherrill (D-NJ) all voted present. Additionally, some House members were unable to vote due to COVID-19 quarantine restrictions.

In 2018 she pledged that she would step down from her leadership role at the end of this session of Congress in 2023.

CARAMELIZED MUSHROOM CALZONES These cute mini calzones are the perfect little somethings to pull out of the freezer. They dress up any occasion, be it a weeknight supper or an impromptu melaveh malkah!

INGREDIENTS 1 pkg. (24 pieces) 3-inch pizza rounds 1 large onion, sliced 1 T. olive oil ½ tsp. salt ⅛ tsp. pepper 16 oz. fresh mushrooms, sliced 1 tsp. parsley flakes, plus more for garnish 1 T. soy sauce ½ T. honey 1 egg, beaten DIRECTIONS 1. Defrost the pizza rounds.

2. In a pan over medium heat, saute the onion for 20 minutes with the oil, salt and pepper, mixing occasionally.

3. Add the sliced mushrooms, and saute for an additional fifteen minutes.

4. Add the parsley, soy sauce and honey, and stir to combine. Remove from heat.

5. Place an empty baking sheet in the oven to heat through, and preheat the oven to 400°.

6. Place about a tablespoon of filling in the center of each pizza round.

7. Fold over the dough, and make indentations with a fork around the edges to seal it tightly.

8. With a knife, cut a small X into the top of each calzone.

9. Brush the top with egg wash and sprinkle with parsley flakes. (At this point you can freeze whatever you won’t be using right away, and have the calzones fresh as can be whenever you decide to defrost and bake them.)

10. Bake at 400° until golden, approximately 12 to 15 minutes.

Note: For best results, use a non-disposable metal pan or pizza stone for this recipe.

1 T. margarine 1 tsp. salt 1 tsp. garlic powder ¼ tsp. black pepper ½ cup non-dairy creamer 1 cup instant mashed potato flakes 3 T. deli mustard 3 T. brown sugar 15 oz. semi-rolled sheet of puff pastry 8 oz. smoked deli turkey breast 8 oz. salami or pastrami

8. Spread the mustard mixture evenly over the entire surface.

9. Cut the puff pastry in half down the middle.

10. Spread a layer of potatoes over each piece of puff pastry.

12. Brush with egg wash and sprinkle with sesame seeds.

(At this point you can freeze it for later use, then defrost to room temperature before baking.)

13. Bake until puffed and golden, about 40 minutes.

Saying goodbye to bedtime battles...

1 cup non-dairy creamer 15 oz. semi-rolled sheet of puff pastry 1 egg, beaten DIRECTIONS 1. Saute the onions with ¼ tsp. salt for half an hour, until golden.

TO PREPARE THE BROCCOLI: 1. Place the broccoli in a pot with 2 cups of water, and bring to a boil over high heat.

2. Cover the pot and reduce the heat. Cook gently for 5 to 6 minutes, then drain.

Season with 1 teaspoon salt, 1 teaspoon garlic powder, ¼ teaspoon pepper, and half the sautéed onions. Using a potato masher, mash the broccoli into small pieces.

TO PREPARE THE POTATOES: 1. In a pot with the rest of the sauted onions, add 1 cup water, 1 teaspoon salt, 1 teaspoon garlic powder, 1 teaspoon onion powder (optional), ¼ teaspoon pepper and the margarine, and bring to a boil. Remove the pot from heat and stir in the creamer. Slowly add the instant potato flakes, mixing to combine.

TO ASSEMBLE: 1. Lay the puff pastry on a floured surface, and roll it into a 16-inch square. Cut it in half down the middle. Spread a layer of potatoes on each sheet of puff pastry. Top this with a layer of broccoli, then roll each sheet into a log, so you have two 16-inch-long logs.

2. Brush the top of each log with beaten egg. Cut slices to form round pinwheels. (You can freeze the pinwheels raw at this point, spaced apart in a greased pan ready to be popped into the oven after defrosting.)

3. Bake at 400° for approximately 40 minutes.

It is somewhat ironic that an institution set up to protect our freedom has become associated with a dreaded governmental burden interrupting our daily lives.

The right for a defendant to be tried by a jury was so important to our Founding Fathers that it is mentioned in the Declaration of Independence, again in the Constitution, and then three more times in the early amendments known as the Bill of Rights. This right was a way of ensuring that an oppressive government, with the help of compliant judges, cannot bring unfounded criminal charges against its domestic enemies.

Guaranteeing the right to a trial by jury was a safeguard to ensure that the power to take an individual’s freedom due to alleged crimes would remain in the hands of his fellow citizens and not the government.

It should be noted that nowhere in the Constitution is mandatory jury duty mentioned directly. While it is stated multiple times that defendants can be tried only by a jury, it does not say that the government can compel citizens to actually sit on those jury panels. However, it has become commonly accepted that jury duty laws are a logical extension of this fundamental assurance that guilty verdicts will be handed down only by a jury of impartial peers.

The idea of juries has been around well before the founding of America, and the jury system was an integral part of the English common-law legal system.

Today, America uses juries far more extensively than the rest of the world, but they still are utilized in countries like Canada, the United Kingdom, New Zealand, Australia and others whose legal system is based on that of the British Empire. ***** Approximately 30 million Americans receive a jury duty notice every year. The specific rules vary by state, but jurors are protected under federal law from being fired or penalized by their employer, or otherwise being harassed to avoid it.

Employers do not have to pay their employees for the time missed for jury duty,

but some states do require some wages to be paid out — at least for the first few days. In New York, it’s $40 per day, the same amount as the juror fee.

A jury duty notice is a court summons, which means that ignoring it is against the law. Yes, generally the court will just send another summons with a new date and nothing will happen, but they do have the right to enforce it with civil or criminal penalties. Some jurisdictions can issue arrest warrants — after all, anyone ignoring the summons is in contempt of court — which means they can be arrested during a routine traffic stop, or in some cases, even see sheriffs show up at the door.

If the grand jury feels the case is strong enough, they return an indictment leading to an arrest and a full trial, which will be heard by the more popular “petit jury,” or trial jury. The reason they are called grand and petit juries is because a grand jury has up to twentythree jurors, while a trial jury has six to twelve.

Grand juries are held in complete secrecy, with only the prosecutor, jurors and court stenographer present. When a witness is called, they are required to come by themselves as well. There are no attorneys or judges present, as this is primarily a way for the government to see if reasonable people agree that there’s enough evidence to charge a potential criminal. Unlike trial juries, the verdict does not have to be unanimous, and requires only a supermajority agreeing to indict, with the exact number depending on the jurisdiction.

Sitting on a grand jury is very different from sitting on a trial jury. Those on the former often sit for months at a time, hearing multiple cases. Federal grand juries can even be on duty for up to three years at a time! The juries don’t sit every day, but rather convene a couple of days per month at the most. Juries with longer commitments often consist of retired people or those without traditional jobs, who are able to serve their country in this capacity.

JURY DUTY AND COVID T H E J U R Y I S O U T:

The coronavirus pandemic and resultant shutdowns have greatly impacted every aspect of our lives, and jury duty has been no different. The early days of the outbreak saw the near-complete shutdown of the nation’s courthouses, but as the lockdown measures were eased and courts began tending to the growing backlog, the issue of filling juries quickly became a serious problem. Today, all these months later, this matter continues to be in constant flux.

The U.S. court system is vast, and each court needs to deal with local ordinances, their building’s unique size and ventilation, the prevalence of the virus in their community, and other issues that determine if and how jury members can join a case. Some courts have tried holding trials via videoconference, but many defense attorneys objected as they can’t see the faces and reactions of the jury to determine the most effective way of presenting their case.

Some have argued that trials are not essential at the moment and can wait until things return to relatively normal, but criminal justice advocates have pointed out that many defendants are held while awaiting trial, and it is unfair — as well as a potential violation of their right to a “fair and speedy trial” — to make them wait.

Then there’s the important fact that jury duty requires people to actually show up, and all the safety accommodations offered by court officials are worthless if people don’t feel comfortable sitting in enclosed spaces for hours at a time. According to The Associated Press, cities across the country were forced to delay jury selection because not enough people showed up. One San Diego criminal case had to be postponed because, despite jury duty summonses being sent to 900 people twice, only around 40 of them showed up each time. There have also been a number of other places where judges had to declare a mistrial because people connected to the case contracted the coronavirus.

The courts that were in session took great pains to protect the jury members. Some reconfigured seating arrangements to no longer feature so many people sitting close together, others installed plexiglass, many improved ventilation, and nearly all required masks. With the resurgence of the virus in the fall and early winter, many of the courts that had successfully reopened were reluctantly forced to again suspend jury selections and trials. When jury selections will once again return to normal remains to be seen.

and civil cases. Most criminal juries consist of twelve members, but some states, like Florida, rely on just six jurors. In civil cases, having six jurors is common in most of the country.

REACHING A VERDICT Anyone who has followed a court case is familiar with the requirement for all members of the jury to agree on a verdict. This is true in most criminal cases taking place in federal court, as well as in most states. In civil cases and lighter misdemeanor charges the rules vary, with some states requiring only a majority, and some requiring a majority if the monetary amount at stake is under a certain amount.

After the jury has heard testimony and considered all the evidence presented at a trial, the members gather for deliberations. During this time, they can ask the judge certain legal questions related to the laws at hand and can sometimes request to see certain evidence again, or have witness testimony read back to them.

A jury panel that can’t come to an agreement is called a hung jury and can result in a mistrial. In this case, the defendant can be tried again if prosecutors think they have a strong enough case.

This is becoming increasingly rare, though, and jurors are allowed to go home, with judges providing strict instructions that they refrain from discussing the case or learning more about it from anywhere else.

Jury duty is an essential part of American civic participation. Members of the armed forces, police, firefighters and government officials are automatically exempt, and different courts have different exemptions for those for whom it would be extremely difficult to join. As for everyone else, getting out of jury duty seems to be relished greatly. After all, is there anything more truly American than finding the right loophole to skirt a government-imposed obligation?

The white envelope arrived in the mail. The return address was the Hillsborough County Clerk of Courts.

I tore off the perforated edges and read the enclosed notice. I had been chosen for jury duty by the state of Florida, and I was expected to report in one month’s time.

My first reaction was one of exasperation. I was not in a position to take off time from work and had little interest in sitting as a member of a jury in a court case. I flipped over the paper and looked to see if I qualified for any of the jury exemptions listed on the notice’s back. The first list detailed those legally unable to serve. I did not qualify for any of those exemptions.

I was not under 18. I was a U.S. citizen. I was still a resident of Hillsborough County. I was not a convicted felon or under investigation for a crime, and I was not deceased. The second list exempted those who are legally able to serve but may choose not to. I was not over 70 years of age, I was not physically impaired, and I was not a member of law enforcement. I was legally bound to show up for jury duty.

As jury day drew near, I spoke with my Rav, a respected posek in the community. He firmly believed that jury duty is not something to avoid. Jury duty is a civic duty and an act of hakaras hatov to the United States of America. The Constitution’s Bill of Rights guarantees a trial by a jury of one’s peers. It is a safeguard against governmental abuse of power and ensures equitable administration of justice. Hakaras hatov is a recognition of the good that one has received. Failure to recognize and partake in a system established for the good of society — when one is called to serve — is a lack of appreciation for the good that we have received.

Jury day arrived, but the jury selection process did not require that I show up in person. Instead, I was on standby for a period of two weeks. Each morning during this period, I would call the court’s automated jury pool number and provide my jury ID. The automated machine told me if I needed to present myself in court the following day. I called every day from Monday to Friday. Each day I was told that I was not selected and that I should carry on with business as usual. I began to believe that I had dodged my jury summons. The second week, when

I called in on Monday morning, the automated system informed me that I was required to show up in the County Courthouse the following morning at 8 a.m. to serve in that day’s jury selection pool.

Now the real jury selection day arrived. I took a train downtown and arrived at the courthouse. I was required to present my jury summons notice and photo ID. Once I cleared courthouse security, I was directed to a large waiting area, where approximately 100 potential jurors were told to wait. A court representative entered the room and thanked us all for coming in. He said that jury duty is an act of civic service for the country, second only to those who serve in the military. American justice could not be administered without those who serve as jurors, he said, and the court and the state recognized our contribution to society.

There were numerous cases in court that day, and we were told to wait until the announcement of our names on the loudspeaker. Once we were called, they would assign us to a prospective pool for a specific case. I sat in the jury waiting room until 2 p.m. when on the loudspeaker my name was announced.

I was assigned to the courtroom of Judge William Dailes.

Judge Dailes was an impressive man. He was tall, with an imposing stature and deep voice. He sat the prospective jurors in the court gallery. Of the thirty of us, only six would be chosen to be part of this jury.

Judge Dailes explained to us the general parameters of the case. The defendant was accused of attempting to violently attack two police officers who were trying to arrest him. The judge asked us if any of us had reason to be excused from this case. Some raised their hands and said that they could not miss work. He rejected that excuse and noted that missed work was not a legitimate reason for declining to serve as juror.

The judge then asked if any of the potential jurors had relatives who worked in law enforcement. As this was a case of an attack on law enforcement, all those with family members who were police officers were considered potentially biased and sent back to the jury pool waiting area. Next, the judge asked if any members of the jury pool were victims of violent crime. As this was a case of violent crime, these potential jurors were also perceived as potentially biased and sent back to the original jury pool.

The next question posed was if anyone was a victim of a crime left unsolved or not adequately addressed by the police. The reasoning was that if people harbor ill feelings toward law enforcement, they would not be impartial jurors.

One man raised his hand and said that his brother had been killed. The judge asked him if the murderer had been arrested and tried in court. The man responded that the murderer had not been apprehended, but added, “Let’s just say they got him anyway.”

The judge asked him to explain. The man said that his brother had been a reporter in Afghanistan and was killed by terrorists. Police never apprehended his brother’s killers, but One year later, Judge Dailes, who presided over the military took out this case, received a prestigious federal appointthe terrorists in a tarment by President Obama, which received widegeted missile attack. spread coverage in the national news media.

As the hours ticked by, the number of potential jurors got whittled down. By five o’clock, there were only about ten of us left. The judge excused us from the chambers and told us to return in fifteen minutes.

We waited in the hall, and then, surprisingly, the judge appeared. He called all of us together for an important announcement. As he was finalizing the procedures for the court case, he said, the defendant had chosen to plead

We were free to leave.

Florida law allows that if one served or was called to jury duty, he is exempt from serving again for the following year. This exemption applied to me even though I did not actually serve on a case. The exemption applies only to state cases, and I would not have been exempt if summoned to serve as a juror on a federal case. In any event, I was not summoned again within the following year.

“That’s it - I’m never doing another interview in my life! I didn’t spend 10 years becoming this company's top coder to be able to interview so-called engineers who can’t write a line of code!”

This was a pretty standard opening line for sessions at the software company where I worked as the Director of Employee Happiness. I sat listening to Chaim tell me about his current frustration.

He was right - he was known to be an excellent developer, which was why he was the one who was constantly being roped into interviews. He worked on a fast-growing team, and it was becoming standard for him to be interrupted multiple times a week to do a work interview. The way that worked was when a new developer was being interviewed, part of the assessment process was having him go through coding challenges that Chaim was particularly good at creating and reviewing.

In my experience, there are 2 types of developers: those who love writing good code, solving problems, and just want to be left alone with their screens. Others are great at coding as well, but also have the talent and interest in leading groups of developers.

Chaim was somewhere in between. He had a young family, was known as a quiet guy, but also enjoyed a good back and forth with friends and colleagues. The decision he had to make at work was whether or not he wanted to be considered for managerial positions in the future. Being part of the interview process was a first step in displaying skills that eventually could have him promoted to a role where he’d be part of the decision making process, mentoring, and product development. Chaim had an important decision to make: was becoming a manager a goal of his, or would he prefer to continue to work directly on the code?

Before he could make that decision, it was important to get the balance clear. The way I see it, there is no job that is 100% exactly what we enjoy doing. Whether it’s the meetings, the documentation, or the calls, every job has it’s equivalent of taking out the garbage. If it’s not taken out… well, we all know what happens. The ideal goal is more like an 80% - if we get to spend most of our time doing work that we really enjoy, that’s a good day.

What was happening to Chaim at work was that instead of doing what he loved 80% of the time, he was doing things that he got zero satisfaction from 50% of the time. No wonder he felt out of balance!

It was fascinating to see, but as soon as we validated that point, Chaim’s shoulders visibly relaxed, as his options came into focus.

Now, he was ready to make a level-headed decision. We discussed Chaim’s long-term goals, and where he saw himself in 5 years. The truth was that he looked forward to a time when he wouldn’t merely have to follow others plans, and would have a say in the strategy.

Once we were clear on the balance between what was necessary and what was enjoyable at work, we were able to come up with a solution. Chaim discussed this newfound insight with his boss, and together they came to a mutual agreement: Chaim wouldn’t be asked to conduct more than one interview a week. After meeting a few times, Chaim was able to discover what had really been bothering him all along, and found the solution inside of himself.

Every one of us has our tipping point of when we’re doing too much of the wrong thing, and too little of the things we love. The trick is being able to recognize before we reach that tipping point, and make sure that on most days, we mostly do things we’re good at and enjoy. I was on my eighth cigarette. The smoke hung low in the living room as I took to the floor with long, heavy strides. For once, even my wife let me be, even though I was violating her non-negotiable no-smoking-athome rule.

I was just hours away from the din Torah, and $10,000 was at stake.

It had been only a few weeks earlier that I discovered that the watches my supplier had sent me were not of the typical quality.

Upon inspection, I had confirmed that they were definitely of inferior make and cheaper workmanship, merchandise that as an honest businessman I would have to sell at a loss. Yet my supplier had denied it.

He’d promised that he had sent the items I requested. That it might have been changed up in transit. Mr. Gross was a man I dealt with often. There were even some distant familial ties binding the two of us.

I was living comfortably and business was going well, but a $10,000 loss would seriously put me in the red. I had tried to send a mediator, some common acquaintance, but we couldn’t come to an agreement. But now he had refused to take the items back, refused to back down and investigate the manner.

With no other recourse, we had agreed to bring the matter to beis din. I was willing to submit only if daas Torah would tell me to do so.

I checked the time: 12:00 a.m. On the other side of the world, my father was probably shuffling around in his slippers, preparing his morning tea with one teaspoon of sugar and asking my mother if she’s sure that he shouldn’t add sugar to her tea, too, and how she could possibly drink tea without sugar.

I decided to give him fifteen more minutes.

It was now 12:15. I dialed the familiar number. My father, though retired by then, was a seasoned businessman; the forty years he’d been in business had only sharpened his entrepreneurial acumen. I couldn’t go to beis din without my father’s advice, without his blessing. There are some things you just don’t outgrow.

Especially prominent in my memory was a din Torah he was once summoned to.

I was eighteen years old at the time, and I remembered the discussions, the nervous tension running through the house. I also remembered the day my father came home,

elated, the rightful winner of the din Torah.

My father earned every penny of his wealth honestly. He had never cheated anyone in business, and we were relieved that the beis din had ruled in his favor.

“Tatty?” Despite the salt and pepper sprinkled in my beard, it was a little boy’s voice that explained what was going on.

“I’m going to beis din in just a few hours. I need your bracha, and I need your advice.”

I sat, tense as a coil, and then in silent submission, as my father spoke. I nodded.

I thanked him for his advice, still mulling over it. I wished him a wonderful day, and then I turned in for the night.

I woke up early and davened a long, unhurried Shacharis, and bracing myself, left for beis din.

The morning was taxing. The facets were explored as we each voiced our argument.

The various minutiae were dissected and discussed through a halachic lens. The arguments were weighed, all things considered.

And then it was over.

I squinted in the sunlight as I left the beis din. Mr. Gross walked ahead of me, relieved, a spring in his step. I walked behind, more slowly, having just lost $10,000. The void in my pocket weighed down on me as I thought of my bank account.

I went to the nearest pay phone and dialed the long-distance number.

“Tatty,” I said. “I lost the din Torah.”

“I’m so proud of you, Menachem,” he whispered, a catch in his throat.

I smiled sadly and thought back to the conversation we’d had the previous night.

“Menachem,” my father had told me. “Do you want my sincere advice? Remember the din Torah I won when you were a bachur?

I won the money — money that was halachically and legally mine. But I lost a friend.

For as long as he lived, Mr. Hecht would not look me in the eye comfortably. Our conversations were always stilted. I always felt that grudge he carried. In yeder shmuez hub ich geshpirt dee shver hartz vos ehr hut oif mir.

was an insult to my intelligence, if there ever was one.

I was scanning the instruction manual of my brand-new Rowenta iron, and I did a double take. On a flashy yellow background was the bolded warning: Do not iron clothes while wearing.

Really now? What possessed Rowenta to include this crucial bit of enlightening information in their manual?

And they’re far from the only company to have ridiculous warning labels on their products. There are countless items branding cautions that leave us scratching our heads and wondering: Who woulda thunk?

Take Nytol sleep aid, for example, whose box warns potential users — Warning: May cause drowsiness. Consumers be warned!

Same goes to the blow dryer advising that the device not be used while sleeping (turns out a sleeping user once caused a fire in such a way!) and the washing machine that comes with the warning of do not wash children in the washer, because who wouldn’t want to save all the manual labor bathtime entails?

But these companies often have good reason to include these labels. Because while they may be protecting the safety of some dimwitted consumers, they mostly want to protect themselves — from lawsuits.

Because over the years, too many consumers have cried legal foul in the hopes of making a nice buck. And sometimes the legal system actually saw things their way.

Bob Dorigo Jones, author of a book that includes “the stupidest, silliest and wackiest warning labels,” explains it perfectly: “You see these warning labels because there used to be a time in America where if you spilled hot coffee on yourself, you’d call yourself clumsy, and nowadays, more and more people are calling themselves an attorney.”

And that brings us to what was probably the father of ridiculous lawsuits and the harbinger of the era of “Why not sue?”

PLAINTIFF WON $640,000, SETTLED FOR LESS The case infamously known as “McDonald’s coffee case” or the “hot coffee lawsuit” started out in 1992 in the passenger seat of a car occupied by 79-year-old Stella Lieback. Wanting to add sugar and cream to the coffee she’d purchased for 49 cents, Lieback placed the cup between her knees, pulled the lid off, and bam! The entire scalding liquid spilled all over her, resulting in serious third-degree burns and skin damage that needed grafting and left long-lasting injuries.

Claiming their coffee temp was way too high, Lieback tried to settle with McDonald’s first, but then brought the case to court in 1994, where the jury found McDonald’s 80% responsible for the incident and Liebeck 20% at fault. (There actually was a warning on the coffee cup, but the jury did not feel it was large enough or sufficient.)

Though the judge initially ruled that Lieback would be compensated with $2.7 million in damages, the final verdict was settled at $640,000, and in the end, the two parties settled out of court for even less.

LOST BY PLAINTIFFS In 2018, PepsiCo was sued by two apparently weight-conscious women who insisted that Diet Pepsi’s name is misleading. The word “diet,” they said, convinced them that imbibing said beverage will send the pounds flying. And nothing of that sort happened.

PepsiCo won this one when a federal judge, Judge Englemayer, dismissed the lawsuit because he expected people to interpret the word “diet” on a soft drink as a differentiation from regular Pepsi and an indication that it contains fewer calories, ruling: “[E]ven if the word ‘diet’ may sometimes identify weight-loss products … in the context of soft drinks, the term unambiguously signals reduced calorie content relative to the nondiet version of the drink in question. Dictionary definitions specifically defining ‘diet’ in the context of soft drinks confirms this.”

Nice try, ladies! No loss, no gain, eh?

Much like the sugar, the case evaporated before it turned into anything concrete, since the sugar content was clearly displayed on the nutrition label.

A very disgruntled woman from Haifa sued the weather station, saying that she’d dressed very lightly in anticipation of the sunny skies. Due to her unpreparedness, she said, she caught the flu, missed several days at work, spent $38 on meds, and was also impacted psychologically by the stress.

The judge ended up dismissing the case, but not without much work on his part; he wrote up a 44-page explanation to explain why a customer can reasonably expect some air in a package of food.

So in case you had some ideas after finding only four potato chips in the bag, it might be a royal waste of your time…

The case was dismissed on the grounds of accurate labeling of content, and with the advice to consumers that they can decide whether it is worth their while to find some kind of tool with which to dig out the remaining balm.

CASE DISMISSED In 2011, Lauren Rosenberg was studiously following Google’s walking instructions, which took her across a rural highway, when she was hit by a car.

She sustained serious injuries and later sued Google for negligence, failure to warn, and defective design, but the judge dismissed the case, ruling, among other points, that it’s a pedestrian’s job to make sure to cross safely.

JUDGE VS. JUSTICE

What’s the difference between a judge and a justice?

Generally speaking, a judge presides over the lower courts and justices over the higher courts.

(New York, however, is one state that inverts this order, using the term “judges” for those in the higher courts.)

RIDING CIRCUIT Up until 1901, SCOTUS justices were required to “ride circuit,” which means they had to travel all around America to courts within their assigned “circuits” and preside over cases with local judges.

KEEPING ORDER IN THE COURT The Supreme Court has its own police force, which is responsible for protecting the justices, the building and visitors.

COURT TR ADITIONS Seniority is treated with great respect by the justices. In private meetings, the chief justice sits at the head of the table and speaks/ votes first, followed, in order of seniority, by the other justices.

THE SUPREME COURT BUILDING It wasn’t until 1935 — after 146 years of existence! — that the Supreme Court had its own building. Prior to that time, the justices would switch between meeting places in New York, Philadelphia, and multiple locations in the nation’s capital.

The most junior justice is tasked with manning the door, transmitting messages to legal clerks as needed, and serving his/her seniors with beverages.

Some of the cases that the Supreme Court hears are cases in which a litigant appeals a decision rendered by a lower court or in which a government body, such as a state, has a complaint (or is complained against). Most of the petitions submitted for review are not accepted by the Supreme Court.

FROM POTUS TO SCOTUS After serving as president from 1909 to 1913, William Taft headed over to SCOTUS to serve as chief justice from 1921 to 1930.

Back in 1893, a produce-seller was peeved that he was being taxed for tomatoes, which was the standard requirement for imported veggies. Arguing that the tomato is a fruit because it bears seeds, he felt they should be allowed to enter the country tax-free, just like all other fruits. But nope, the SCOTUS justices unanimously voted the tomato a vegetable, on the basis that tomatoes are typically eaten as part of the main course and not as a dessert.

FRIGHTENED ON THE FARM Chickens don’t like planes.

Mr. Causby learned that the hard way.

After 150 of his chickens died from fright after military airplanes roared overheard, Causby gave up his farm and sued the government for compensation. He claimed that the planes had violated his private property — the air above his farm.

He won his case, with new guidelines being instituted for what constitutes ownership over airspace. Depending on the time of day, anywhere above 300 to 1,000 feet can fall into the sphere of public property; below that belongs to the landowner.

This ruling is important because if airspace were owned by landowners without limits, then airplanes would be continually trespassing private property, resulting in lawsuits galore and the stifling of air travel.
